In this essay, we suggest practical ways to shift the framing of crisis standards of care toward disability justice. We elaborate on the vision statement provided in the 2010 Institute of Medicine (National Academy of Medicine) “Summary of Guidance for Establishing Crisis Standards of Care for Use in Disaster Situations,” which emphasizes fairness; equitable processes; community and provider engagement, education, and communication; and the rule of law. We argue that interpreting these elements through disability justice entails a commitment to both (...) distributive and recognitive justice. The disability rights movement's demand “Nothing about us, without us” requires substantive inclusion of disabled people in decision‐making related to their interests, including in crisis planning before, during, and after a pandemic like Covid‐19. In recent years, some political realists have argued that there is a “distinctively political normativity” which should be used when construing and justifying political theories. Among realists focusing on a distinctively political normativity, one can identify two approaches. On the “moral view,” it is explicitly acknowledged that moral norms have a role to play in political normativity. On the “non-moral view,” distinctively political normativity is understood in terms of a non-moral kind of practical normativity. The non-moral view has received severe (...) criticism, not least pertaining to its instrumental versions. Recently, however, Carlo Burelli has attempted to develop a realist account that is faithful to the non-moral view, but which is said to avoid the criticism directed against non-moral accounts in general, and the purely instrumental ones, in particular. Burelli offers a functional account of distinctively political normativity, according to which the function of providing binding collective decisions generates a normative standard that is independent of morality. Despite its many innovative features, however, we argue that it fails with regard to the most pressing concern, which is not whether functional normativity is genuine normativity, but whether it is the right normativity for its assigned role. The practice-dependent approach to justice has received a lot of attention in post-millennium political philosophy. It has been developed in different directions and its normative implications have been criticized, but little attention has been directed to the very distinction between practice-dependence and practice-independence and the question of what theoretically differentiates a practice-dependent account from mainstream practice-independent accounts. The core premises of the practice-dependent approach, proponents argue, are meta-normative and methodological. A key feature is the presumption that a concept of justice (...) is dependent on the function or aim of the social practices to which it is supposed to be applied. Closely related to this meta-normative thesis is an interpretive methodology for deriving principles of justice from facts about existing practices, in particular regarding their point and purpose. These two premises, practice-dependent theorists claim, differentiate their account since they are not accepted by practice-independent accounts and they justify different principles of justice than practice-independent accounts. Our aim in this article is to refute both and, demonstrating that practice-independent accounts may indeed accept the meta-normative and methodological premises of the practice-dependent accounts, and that we are given no theoretical reason to think that practice-dependent accounts justify other principles of justice for a practice than do practice-independent accounts. In other words, practice-dependent theorists have not substantiated their claim that practice-dependence is theoretically differentiated from mainstream accounts. When practice-dependent proponents argue for other principles of justice than mainstream theorists, it will be for the usual reason in normative theory: their first-order normative arguments differ. The central ideas coming out of the so-called pragmatic turn in philosophy have set in motion what may be described as a pragmatic turn in normative political theory. It has become commonplace among political theorists to draw on theories of language and meaning in theorising democracy, pluralism, justice, etc. The aim of this paper is to explore attempts by political theorists to use theories of language and meaning for such normative purposes. Focusing on Wittgenstein's account, it is argued that these (...) attempts are unsuccessful. It is shown that pragmatically influenced political theorists draw faulty epistemological, ontological and semantic conclusions from Wittgenstein's view in their normative theorising, and it is argued that pragmatically influenced theories of language and meaning, however full of insight, cannot be put to substantial normative use in political theory. The general scope of the thesis is motivated by pointing to the general form of the argument and by moving beyond Wittgenstein to other philosophers of mind and language, illustrating how similar overextensions are made with regard to Robert Brandom's theory of language and meaning. A growing number of medical professionals claim a right of conscience, a right to refuse to perform any professional duty they deem immoral—and to do so with impunity. We argue that professionals do not have the unqualified right of conscience. At most they have a highly qualified right. We focus on the claims of pharmacists, since they are the professionals most commonly claiming this right.

Social distancing during the COVID-19 pandemic has presented millions of people with extraordinary challenges that are associated with significant amounts of stress. Emotion regulation is crucial during this crisis as people seek to mitigate the stress and uncertainty of the present moment. In this study, we surveyed a nationally representative sample of 297 adults from the United States on their levels of perceived stress related to the COVID-19 pandemic as well as their level of engagement of different emotion regulation strategies (...) during the pandemic. We performed multiple linear regression analyses to assess which regulation strategies were associated with individual differences in perceived stress. Among all emotion regulation strategies, psychological distancing, which involves thinking about stressful circumstances in an objective, impartial way, was uniquely associated with reductions in perceived stress due to COVID-19 across individuals. This effect was not moderated by age, gender, socioeconomic status, race/ethnicity, or trait-related difficulty in regulating emotion. Conversely, situation modification was associated with significantly greater perceived stress overall. These results suggest the broad applicability and utility of psychological distancing during pandemic-related social distancing as part of an adaptive emotion regulation toolkit and motivate the investigation of interventions involving psychological distancing in this context. This paper explores the possible impact of the recent legal developments on organizational whistleblowing on the autonomy and responsibility of whistleblowers. In the past thirty years numerous pieces of legislation have been passed to offer protection to whistleblowers from retaliation for disclosing organisational wrongdoing. An area that remains uncertain in relation to whistleblowing and its related policies in organisations, is whether these policies actually increase the individualisation of work, allowing employees to behave in accordance with their conscience and in line (...) with societal expectations or whether they are another management tool to control employees and protect organisations from them. The assumptions of whistleblower protection with regard to moral autonomy are examined in order to clarify the purpose of whistleblower protection at work. The two extreme positions in the discourse of whistleblowing are that whistleblowing legislation and policies either aim to enable individual responsibility and moral autonomy at work, or they aim to protect organisations by allowing them to control employees and make them liable for ethics at work. In this paper, I discuss the conceptualist claim that we cannot speak of perceptual content unless we assume it is objective content. The conceptualist argues that only conceptual content can meet the requirement of being objective, so that the view that perceptual experience has nonconceptual content is not tenable. I start out by presenting the argument from objectivity as it can be found in McDowell. I then present the following objections: First, perceptual objectivity cannot be due to the perceiver’s conception (...) of objectivity; and second, even nonconceptual capacities of the individual cannot and need not be appealed to in order to account for objective perceptual content. Honesty is essential for the care of seriously ill and dying patients. The current study aimed to describe how nurses experience honesty in their work with patients receiving palliative care at home. The interviews in this phenomenological study were conducted with 16 nurses working with children and adults in palliative home-based care. Three categories emerged from analyses of the interviews: the meaning of honesty, the reason for being honest and, finally, moral conflict when dealing with honesty. The essence of these (...) descriptions was that honesty is seen as a virtue, a good quality that a nurse should have. The nurses’ ethical standpoint was shown in the moral character they show in their work and in their intention to do good. This study could help nurses to identify different ways of looking at honesty to promote more consciousness and openness in ethical discussions between colleagues and other staff members. (shrink)

Zusammenfassung Der Beitrag behandelt strukturelle und kontextuelle Spezifika von selbstorganisierten Migrantensportvereinen auf statistischer Grundlage. Er beruht auf einer Sonderauswertung des für den Sportentwicklungsbericht 2009/2010 durch eine Befragung von Sportvereinen in ganz Deutschland gewonnenen Datensatzes (N=19.345). Durch univariate Varianzanalysen abgesicherte Mittelwertvergleiche zwischen den anhand ihrer Mitglieder- und Vorstandszusammensetzung als solche kategorisierten Migrantensportvereinen und den restlichen Vereinen der Stichprobe werden ergänzt durch eine Matched-Pairs- Analyse und eine Regressionsanalyse. Die dafür herangezogenen Vergleichsvariablen liegen in den Bereichen Mitgliederstruktur, Vereinstätigkeit, Standort und Problembelastung. Unter anderem (...) haben Migrantensportvereine im Durchschnitt weniger Mitglieder und einen höheren Männeranteil, öfter Fußball im Angebot und häufiger existenzbedrohende Probleme als andere Sportvereine. Artificial intelligent (AI) systems used in medicine are often very reliable and accurate, but at the price of their being increasingly opaque. This raises the question whether a system’s opacity undermines the ability of medical doctors to acquire knowledge on the basis of its outputs. We investigate this question by focusing on a case in which a patient’s risk of recurring breast cancer is predicted by an opaque AI system. We argue that, given the system’s opacity, as well as the (...) possibility of malfunctioning AI systems, practitioners’ inability to check the correctness of their outputs, and the high stakes of such cases, the knowledge of medical practitioners is indeed undermined. They are lucky to form true beliefs based on the AI systems’ outputs, and knowledge is incompatible with luck. We supplement this claim with a specific version of the safety condition on knowledge, Safety*. We argue that, relative to the perspective of the medical doctor in our example case, his relevant beliefs could easily be false, and this despite his evidence that the AI system functions reliably. Assuming that Safety* is necessary for knowledge, the practitioner therefore doesn’t know. We address three objections to our proposal before turning to practical suggestions for improving the epistemic situation of medical doctors. (shrink)

Two aspects about meaning and emotion are discussed in this paper. The first, which is the main focus of this paper, addresses the semantic shaping of emotions (semanticization). It will be shown how language acquisition leads to the semantic shaping of emotions. For this purpose I will first introduce the theory of language acquisition that has been developed mainly by Michael Tomasello and also by Donald Davidson. Then I will take basic emotions into account in order to show that language (...) plays a crucial role when it comes to the shaping of emotions and how we feel. The second aspect about meaning and emotion addresses the signification that an emotion might have for a person. One could also say that this aspect addresses the meaning an emotion has for a person. The solutions to moral problems offered by contemporary moral theories largely depend on how they understand pluralism. This article compares two different kinds of universal moral theories, liberal impartiality theory and discourse ethics. It defends the twofold thesis that (1) a dialogical theory such as discourse ethics is better equipped to give an account of pluralism than impartiality theory due to a more correct understanding of the nature of conflict, but that (2) discourse ethics cannot, contrary to what Jürgen Habermas (...) claims, embrace the notion of impartiality connected to agent-neutrality. The article argues that pluralism reflects conflicts among values not only between but also within people and that discourse ethics can include both these dimensions since it recognizes the constitutive connection between deliberation and (moral) conflict. Thus, unlike impartiality theory, it can elucidate the transformative aspects of pluralism. (shrink)

Within liberal democratic theory, ‘democratic accountability’ denotes an aggregative method for linking political decisions to citizens’ preferences through representative institutions. Could such a notion be transferred to the global context of human rights? Various obstacles seem to block such a transfer: there are no ‘world citizens’ as such; many people in need of human rights are not citizens of constitutional democratic states; and the aggregative methods that are supposed to sustain the link are often used in favour of nation-state strategic (...) action rather than human rights. So what could accountability mean in relation to human rights? This article argues that discourse theory offers resources for approaching these problems and for rethinking a normative notion of accountability in relation to human rights. It is suggested that accountability should link political decisions to universal agreements through global rights institutions and that the link should be sustained by deliberative rather than aggregative procedures. This paper presents results of a qualitative study focussed on reconstructingcurrent reception processes of Tibetan Buddhist teachings and practicesas well as its representatives by the Swiss public since the mid 1990’s. Byexamining public discourses on Tibetan Buddhism in Switzerland, the paperaddresses issues concerning the social construction, representation and (re-)production of cultural and religious difference. It is argued that public receptionand representation of Tibetan Buddhism in the media clearly – even if implicitly– reflects disputes about conceptions of one’s own religious, cultural (...) and nationalidentity as well as about collectively shared values. It is shown that publicdiscourse on Tibetan Buddhism in Switzerland is characterized by opposingtendencies: on the one hand, it is clearly dominated by well-known positiveimages and stereotypes, which might be regarded as elements of an establishedrepertoire of knowledge about Tibet, Tibetans and the “World Religion of Buddhism”and which are reproduced as a matter of course within public discussionson the topic. On the other hand, nevertheless, these dominant topoi arecurrently being questioned by various social actors and on various levels. Theseefforts at deconstructing popular images and perceptions of Tibetan cultural andreligious traditions, however, have relatively small impact on wider social processesof constructing religious and cultural alterity – not nearly as much, forexample, as the construction of an Islamic “Other” culminating in the minaretreferendum of 2009. ObjectiveLoss of control eating has been directly related to the core aspects of the psychopathology of eating disorders and to different dimensions of emotion and behavior regulation and self-criticism. This study investigates a model representing the interplay between these dimensions to understand LOC eating among a nonclinical sample.MethodsA total of 341 participants, recruited in a college campus, completed a set of self-report measures assessing LOC eating, weight suppression, psychopathology of eating disorders, depression, negative urgency, emotion regulation difficulties, and self-criticism. Path (...) analysis modeling tested a hypothesized model with 3 paths for LOC eating as follows: psychopathology of eating disorders; emotion and behavior regulation; and interplay between these paths.ResultsWe found goodness-of-fit indexes to our data: χ2 = 17.11, df = 10, Comparative Fit Index = 0.99, Tucker-Lewis index = 0.98, Root Mean Square Error Approximation = 0.045, Standardized Root Mean Square Residual = 0.041, suggesting that: participants with higher weight suppression showed higher degrees of the psychopathology of eating disorders, which was linked to higher levels of LOC eating; self-criticism was a mediator between emotion regulation and depression/negative urgency; self-criticism was a mediator between emotion regulation and disorder eating, which was significantly associated with LOC eating via increased negative urgency.ConclusionOur model shows that LOC eating occurs for individuals with the psychopathology of higher eating disorders who experience depressive symptoms and act rashly under distress for their inability to cope adequately with negative feelings of self-devaluation. These findings point to the importance of negative self-evaluations and feelings of inadequacy or worthlessness to understand LOC eating among college students. (shrink)

Drawing on material collected amongst Danish and Australian humanities and social science academics, the article illustrates and problematises a particular and recurring discursive practice amongst academics: 'the conduct of concern'. Conceptualising the conduct of concern as an exclusionary and de-legitimising discursive practice, the article offers a (mis)reading of some of the storylines and constructions it could be seen to invoke and reproduce—amongst others, the idea of the autonomous, rational academic subject. The author discusses the conduct of concern, as a particular (...) kind of subject position and positioning, in terms of Donna Haraway's figure 'the modest witness'. The author suggests that the conduct of concern as a readily available exclusionary discursive practice in academia 'smuggles in' and naturalises constructions and positionings associated with the autonomous rational subject, and participates in masking the discourse mobiliser's subjective and political investments. In that way, by appropriating the ubiquitous discursive practice academics might contribute to upholding constructions and practices they otherwise seek to disrupt. (shrink)
