This book undertakes a twofold task: a theoretical examination of the foundations of human rights and an attempt to draw the practical implications of the resultant theory for contemporary society. There are, the author contends, three main traditions regarding human rights: The radical—humanistic tradition deduces rights from an uncritical veneration of man; its ground is a romantic view of man, its end, freedom, its regulatory principle, equality. The utilitarian tradition regards rights as pragmatic fictions; its ground is a hedonistic view (...) of man, its end, quantitative happiness, its regulatory principle, expediency. The metaphysical tradition derives rights from man’s place in a purposive order; its ground is a view of man related to something higher than himself, its end, a cosmic purpose, its regulatory principle, function. The first two traditions ultimately lack coherence. The metaphysical tradition has two subtypes: self-realization and theonomy. The author argues for a Calvinist version of the latter. Such a theory affirms man’s utter depravity, but affirms at the same time God’s righteous will as maintaining the destiny and, therefore, the rights of the elect. The ultimate ground of value and right is the gracious will of God. God owes nothing to man, but he does demand of man justice toward himself and toward other men. This is the foundation of values and of rights, which are claims that value be respected. Worth is the capacity of an entity to fulfill its proper end. The vocation of man has four dimensions: the unity of his moral will with God, creative perception, personal integration, and social communion. Empirically man is free, but totally depraved, and therefore unable to fulfill his function. By the atonement, God imputes to sinful man a value not inherent in him and makes man capable of fulfilling in principle the end for which he was created. This makes possible active love of neighbor, which, however, is a duty owed not to neighbors, but toward neighbor and to God. The practical conclusions drawn from this theory rest upon the fact that love of neighbor requires a universal context of impersonal justice and of freedom under law. Freedom is not an end in itself, but the political body has no higher purpose than assuring negative freedom—"reciprocal freedom from external constraint." From this basis the author proceeds to spell out in considerable detail "the implications of reciprocal freedom for particular areas of human conduct,... guided only by the evidence of social data and the rules of logical consistency." The presumption of innocence (POI) requires all judges, juries, and other officials in a trial, to presume and treat any accused of criminal wrongdoing as innocent, until he or she is proven guilty. Although a POI lacks an authoritative definition, this overarching principle of procedural fairness is so robust and vital for the exercise of legal power in matters of criminal law that one rarely finds anyone questioning its standing. In this article I examine the rationale behind the POI from (...) a different perspective. The basic assumption is that this procedural standard captures the tenor of a broader principle which seeks to ensure fairness in criminal proceedings as well as in criminal law doctrine. I argue that honouring a principle of fairness is not exclusively a matter of criminal procedural law but also something that is deeply rooted in other areas of criminal law doctrine. Hence: not maintaining a principle of fairness in criminal law doctrine could lead to the POI being compromised or even undermined. In the article, I draw attention to three areas in which I believe that criminal law policies threaten a principle of fairness: criminalising remote harm, doctrine of ignorance of law and inversed presumptions of guilt. My conclusion is that some solutions to so called doctrinal problems in criminal law, are questionable and their practical consequences (on a general level) are, at least partially, equal to treating an individual (in a trial) as guilty for something for which he or she ought not to be accountable. Hence: gaining the support of a POI could thus work as principle for keeping the use of criminal law moderate and in accordance with a principle of fairness. (shrink)

Traditional corporate finance endorses the principle of stockholder wealth maximization as the purpose of business. In light of recent scandals and legislation, businesses are increasingly expected to use financial resources in a manner which benefits society and not just the owners of the firm. This imputation of a corporate soul will necessarily reduce investor returns, which has at least two major financial implications for the firm and the economy. The first is that it may cause investors to change their (...) required rates of return and thereby change the amount of capital available to firms, and the economy. The second is that it may implicitly replace equity with debt in the capital structure of firms, with all that implies for financing and corporate governance. Can trust evolve on the Internet between virtual strangers? Recently, Pettit answered this question in the negative. Focusing on trust in the sense of ‘dynamic, interactive, and trusting’ reliance on other people, he distinguishes between two forms of trust: primary trust rests on the belief that the other is trustworthy, while the more subtle secondary kind of trust is premised on the belief that the other cherishes one’s esteem, and will, therefore, reply to an act of trust in kind (‘trust-responsiveness’). Based on this theory Pettit argues that trust between virtual strangers is impossible: they lack all evidence about one another, which prevents the imputation of trustworthiness and renders the reliance on trust-responsiveness ridiculous. I argue that this argument is flawed, both empirically and theoretically. In several virtual communities amazing acts of trust between pure virtuals have been observed. I propose that these can be explained as follows. On the one hand, social cues, reputation, reliance on third parties, and participation in (quasi-) institutions allow imputing trustworthiness to varying degrees. On the other, precisely trust-responsiveness is also relied upon, as a necessary supplement to primary trust. In virtual markets, esteem as a fair trader is coveted while it contributes to building up one’s reputation. In task groups, a hyperactive style of action may be adopted which amounts to assuming (not: inferring) trust. Trustors expect that their virtual co-workers will reply in kind while such an approach is to be considered the most appropriate in cyberspace. In non-task groups, finally, members often display intimacies while they are confident someone else ‘out there’ will return them. This is facilitated by the one-to-many, asynchronous mode of communication within mailing lists. (shrink)

Theories of distributive justice are often criticised for either excluding people with disabilities from the domain of justice altogether, or casting them as deficient in personal attributes. I argue that the capabilities approach to justice is largely immune to these flaws. It has the conceptual resources to locate most of the causes of disadvantage in the interaction between a person and her environment and in doing so can characterise the disadvantages of disability in a way that avoids the imputation (...) of natural deficiency. However, I also argue that the capabilities approach cannot accommodate some of the stronger claims advanced by some disability scholars. No plausible capabilities approach can guarantee that social change will always be the just or fair remedy for disadvantage, and there is a small number of severe cases of disability where capability shortfalls will be attributed to the person’s ‘deficient’ physical and mental impairments. This article analyzes the origins of the “responsible corporate officer” doctrine: the trial of Joseph Dotterweich. That doctrine holds that an officer may be personally liable for the criminal act of a subordinate if the officer was, in some indefinite way, able to prevent the violation. Applying this doctrine, the prosecution of Dotterweich entailed strict liability for a strict liability offense. The underlying offenses—the interstate sale of one misbranded and adulterated drug and one misbranded drug—were said to be strict liability (...) offenses. And then, with respect to Dotterweich as the corporation’s general manager, the government argued that he was strictly liable because he stood in “responsible relation” to the company’s acts. The government never tried to prove that the company, Buffalo Pharmacal, was negligent, nor did it try to prove that Dotterweich was negligent in his supervision of the employees of Buffalo Pharmacal. The prosecutor and judge were candid about this theory throughout the trial, although the judge conceded that it seemed bizarre and unfair. The defense lawyer repeatedly sought to inject what became known throughout the trial as the “question of good faith,” but was circumvented at almost every turn. What would thus seem to be the crux of any criminal trial—the personal fault of the defendant—was carefully shorn from the jury’s consideration. The government’s theory was so at odds with intuitive notions of liability and blame that, as one probes into the case, and looks at the language used in the government’s appellate briefs, imputations of moral fault inevitably crept in. Yet the government was not entitled to make such accusations, as it had pruned moral considerations from the trial. The article argues that the responsible corporate officer doctrine can never enjoy a secure place in our legal system. First, the doctrine is at a minimum in tension with, and often in direct opposition to, basic principles of the criminal law; and second, the doctrine fails, when followed to its logical conclusions, to accord with basic notions of fair play. The article concludes that the responsible corporate officer doctrine is either unnecessary, in cases in which the evidence establishes personal fault, or unjust, in cases in which it creates liability in the absence of personal fault through the unspecified notion of “responsibility.” The Dotterweich case illustrates what is contemplated by the latter possibility, and why it is problematic in any judicial system that purports, in the words of the Model Penal Code, “to safeguard conduct that is without fault from condemnation as criminal.”. Despite this, it seems at several points that he and I are talking about two different, albeit related, concepts of mental illness. 'Mental illness' is used to both explain and excuse certain behaviors, but these two functions, explanatory and exculpable, do not always operate simultaneously. As we discover biological explanations for apparently immoral behaviors, the question arises as to whether the explanation should remove the immorality and liability for punishment. The 'sick role' can be divided into two aspects. One is the role of deserving and warranting medical treatment. The other is the negation of moral responsibility. Wakefield's own example, pedophilia, involves the first sense of the sick role but not the second. Wakefield's use of this example is unusual, because it deftly highlights the limitation of his HD account. Pedophilia is a mental disorder in the sense of warranting treatment, and is a mental illness under Wakefield's model, but it is not something that negates moral responsibility. There is a sense of the term 'mental illness'—an important and, as I argue, an objective sense—that is relevant to establishing one's moral responsibility for such behaviors.In addressing my account of mental illness as though it contained two distinct answers, 'mental illness as dysfunction of rational agency, or 'mental illness as moral judgment,' it is unclear whether Wakefield takes them to be conjunctive or alternative. Hence it is worth reiterating in point form the structure of my account:1. Illness involves dysfunction;2. The 'proper function' of a bodily or psychological mechanism is determined by the purpose that we impose upon that mechanism (within the constraints of our biological needs);3. En ce point, la phénoménologie est inévitable, non plus comme discipline, mais au moins comme problème. If one requires a minimal definition for phenomenology, one may settle for the idea of a descriptive philosophy. William James once replied to the critics of the new pragmatic philosophy with the caution not to be too sharp or logic-chopping but to evaluate pragmatism as a whole, and especially weigh it against its possible alternatives. This is fair advice indeed. All too often the opponents of pragmatism have seized upon one of its formulations and, oblivious of its context and surrounding qualifications, have proclaimed the absurdity of the whole enterprise. James himself admitted that some of his expressions (...) were infelicitous and misleading, but he believed that the intelligent and indulgent reader would grasp his meaning and not impute to him doctrines he never held. Indeed, the reader of James soon comes to realize that he cannot stop at any one formulation of pragmatism but must hurry on to the next in order to see it in a broader and fuller context. He is aware, then, that pragmatism in James’s view is not a doctrine or system but a method and spirit of philosophizing, or, as we would say today, a way of doing philosophy. It is this spirit and perspective that must be appreciated if one is to do justice to the pragmatism of William James. (shrink)

This article attempts to answer the question: What makes the Roman constitution "by far the best," as Cicero claims in De republica? Following Polybius, Cicero analyses the Roman constitution as a mixed constitution, which both regard as the best type of constitution. Cicero, however, does not merely impute the best type of constitution to the Romans. He elevates the Roman constitution above all other mixed constitutions as the single best constitution. In rivalry with Plato, he constructs a model of the (...) Roman constitution as an exemplum that can unite the Romans in a common purpose. The constitution is distinguished by two main features: a fair system of cooperation among the whole citizen body and wise guidance by individual leaders. The moral unity of this constitution sets it apart from all other mixed constitutions. (shrink)

Ce résultat est dû aux études stylistiques bien plus qu'aux travaux d'exégèse. Quand il s'agit de définir le sens et le but du dialogue ou de démêler les liens qui le rattachent aux autres dialogues ou à des écrits contemporains, on est loin d'aboutir à un accord. Platon veut-il simplement établir le programme d'une rhétorique philosophique pour (...) faire pièce à l'action envahissante des écoles de rhétorique ? Vise-t-il plus spécialement telle ou telle doctrine rhétorique ? Vu les points de contact avec des écrits d'Isocrate, d'Alcidamas et d'autres, a-t-il peut-être voulu trancher certaines questions brûlantes, intervenir en conciliateur ou en arbitre ? Le fait est que l'examen dialectique se termine à la p. 272b par la récapitulation et la réponse définitive à la question posée p. 258d et reprise p. 259e. Alors que le débat portait sur le logos en tant que discours écrit ou prononcé, Socrate introduit dans la finale la notion du logos de l'âme pour répondre aux objections de Phèdre. Alors qu'il a prouvé (261e-262b) la nécessité de la connaissance de la vérité, peu importe de quel genre de discours il s'agit, il revient en arrière pour discuter à nouveau la théorie de la vraisemblance de Tisias appliquée au seul genre judiciaire. Pourquoi, après chacune des objections (273d-274a, 278bc) répéter la conclusion finale et reprendre coup sur coup le problème de l'œuvre écrite, qu'il avait expédié en passant, p. 257d-258d ? Au terme de cette dernière diversion, Socrate oppose à la philosophie les techniques spéciales qui lui sont subordonnées : législation, poésie, éloquence. Est-ce peut-être dans ce message destiné à Lysias et doublé d'un message analogue à Isocrate que Platon a voulu nous donner la clef de l'œuvre ? Le Phèdre été conçu comme un drame parfait axé sur la mission et la condamnation de Socrate et cette structure lui donne son sens et son unité. Le cœur, c'est la péripétie et cette „reconnaissance” dans laquelle le daimonion ouvre les yeux de Socrate. Ecoutant son daimonion, il embrasse ses dieux à lui, son Eros, et dès lors sera traité d'impie par le jury. Les politiques, les poètes et les orateurs impuissants à appuyer leurs paroles (par la philosophie) (273c) deviendront ses accusateurs, et c'est Socrate qui, ignorant leur éloquence, sera impuissant à se défendre. On lui reprochera de corrompre la jeunesse. C'est que son discours ici se termine par cette prière significative : „Accorde-moi... d'être, plus encore qu'à présent, en crédit auprès des beaux garçons” (257a trad. Robin). Bref, la scène du Phèdre est le prélude, ou, si l'on veut, la contre-partie du drame de 399. Quel est le rôle de Lysias ? Exactement le même que dans la République et le Clitophon. Contrairement à son frère Polémarque (257b) il ne pense que politique et barreau, une politique qui en définitive adopte les principes de violence de Thrasymaque (Rép. I et Phèdre 266c). Dans une soi-disant Défense de Socrate, il a répondu à Polycrate en ramenant toute l'affaire sur le plan purement politique et en reniant le verdict de 399, imputable à l'absence d'une défense efficace. Soucieux du relèvement de la démocratie, il désire reléguer à l'arrière-plan l'affaire de 399, faire oublier les griefs religieux et peut-être tendre la main aux Socratiques, pour, ainsi, passer à l'ordre du jour. Or, se prêter à cette manoeuvre, pour Platon, c'est renier son maître. Que reproche-t-il à Lysias ? De tourner le dos à la Philosophie en médisant d'Eros. Et nous apprenons en finale, pour mettre fin à toute équivoque, qu'Isocrate n'échappe pas à ce même reproche. Mais tout cela se situe à l'arrière-plan. Dans la trame du Phèdre, celui qui est directement accusé d'impiété, celui qui s'accuse lui-même, c'est Socrate. S'il n'y avait vu clair, s'il avait quitté ce lieu sacré après un succès oratoire sur un thème imposé par Lysias, il aurait renié ses daimonia ; il aurait trouvé grâce auprès des hommes, mais serait justiciable des dieux (242d). Dans ce cas le drame, le vrai drame du Phèdre, n'aurait pas eu lieu et Socrate aurait échappé à son arrêt de mort. (shrink)

One Rawlsian response to G. A. Cohen’s criticisms of justice as fairness which Cohen canvasses, and then dismisses, is the 'Freedom Objection'. It comes in two versions. The 'First Version' asserts that there is an unresolved trilemma among the three principles of equality, Pareto-optimality, and freedom of occupational choice, while the 'Second Version' imputes to Rawls’s theory a concern to protect occupational freedom over equality of condition. This article is mainly concerned with advancing three claims. First, the 'ethical solution' Cohen (...) advances against the First Version of the Freedom Objection does not grant a fair hearing to the Freedom Objection. Second, the distinction Cohen presses between the legal and moral right of occupational choice in his response to the Second Version cannot save him from worries about Stalinist coercion. Third, Cohen’s response to the First Version of the Freedom Objection is actually in tension with his response to the Second Version of the Freedom Objection. (shrink)

A reassessment of the controversial, long-marginalized yet still influential nineteenth-century German philosopher that explores the contentious issue of whether he was, as his critics frequently claim, a nihilist. Max Stirner (1806-1856) is often regarded as an enfant terrible of nineteenth-century German philosophy, but he has continued to exert an influence despite his marginalization as a nihilist. This study is the first to tackle head-on the question of whether Stirner can indeed reasonably be described as a nihilist. Although he is not (...) known ever to have used the word "nihilism" or any of its derivatives, he was first accused of being a nihilist immediately after the publication of his magnum opus Der Einzige und sein Eigentum (translated in most English editions as The Ego and His Own) in 1844. Since then, the allegation has been repeated by well over a hundred writers and critics, with the result that it has become something of a truism. The book aims, first, to establish a clear understanding of the multifarious meanings of the term nihilism; second, to examine the accusations leveled at Stirner in the light of those meanings; and third, to assess not only the fairness and accuracy of the imputation of nihilism but also its usefulness in understanding Stirner as a thinker. It thus provides new insights into Stirner's thought, challenges the orthodox view of him as a philosophical pariah, reassesses his ideas and their place in the history of philosophy, and addresses the recurrent issue of his contemporary relevance. Diabetes is one of the most common metabolic diseases that cause high blood sugar. Early diagnosis of such a condition is challenging due to its complex interdependence on various factors. There is a need to develop critical decision support systems to assist medical practitioners in the diagnosis process. This research proposes developing a predictive model that can achieve a high classification accuracy of type 2 diabetes. The study consisted of two fundamental parts. Firstly, the study investigated handling missing data adopting (...) data imputation, namely, median value imputation, K-nearest neighbor imputation, and iterative imputation. Consequently, the study validated the implications of these imputations using various classification algorithms, i.e., linear, tree-based, and ensemble algorithms, to see how each method affected classification accuracy. Secondly, Artificial Neural Network was employed to model the best performing imputed data, balanced with SMOTETomek ensuring each class is represented fairly. This approach provided the best accuracy of 98% on the test data, outperforming accuracies achieved in prior studies using the same dataset. The dataset used in this study is concerned with gender and population. As a prospect, the study recommends adopting a larger population sample without geographic boundaries. Additionally, as the developed Artificial Neural Network model did not undergo any specific hyperparameter tuning, it would be interesting to explore tuning on top of normalized data to optimize accuracy further. In this article an attempt is made of presenting the deontological feature of A Theory of Justice under a new light. Through an exploration of the meaning of the priority of the good over the right and of the significance and function of the argument of the congruence between justice and individual good, the differences between teleology and deontology are displayed. Deontology seems to have several advantages: a) it allows for pluralism of values and a richer and deeper understanding of (...) practical reason, b) is rooted in a very compelling account of agency, c) points towards an attractive conception of value. Besides, once it is properly understood that the normative content of justice as fairness is to be applied strictly only to an ideal situation and cannot be taken as straightforwardly action-guiding in the real world, we are led to an understanding of deontology that parts from ethical absolutism, makes room for a proper consideration of consequences and avoids the stiffness often imputed to deontological theories. Finally it is suggested that the development of a normative conception of character along Rawlsian lines offers promising prospects towards a proper balancing between an ethic of conviction and an ethic of responsibility. The goal of this paper is to show that Callahan's reasons for withholding life extending care cannot be made out exclusively in terms of contemporary notions of distributive justice and fair allocation. I argue that by relying on a notion of justice which links the merit of the individual with the fairness of a social pattern of shares, Callahan imputes vice to the elderly as he denies them eligibility for life-prolonging care. Aristotle's doctrine of the mean is a useful (...) tool for character evaluation. One can speak meaningfully of a proper disposition of a person of a certain type (an elderly person) with respect to the good of continued life. I claim that the mean of one's disposition with respect to the good of continued life would be relative to one's age group, and would be determined by that principle by which an elderly person of practical wisdom would determine it. This leads to very different conclusions than those drawn by Callahan. (shrink)

Three recent research reports by Topping and Trickey, by Fair and colleagues, and by Gorard, Siddiqui and Huat See have produced data that support the conclusion that a Philosophy for Children program of one-hour-per-week structured discussions has a marked positive impact on students. This article presents data from a follow up study done three years after the completion of the study reported in Fair et al.. The data show that the positive gains in scores on the Cognitive Abilities (...) Test were still present and had not faded after three years. Given the strength of these confirmations of the positive durable impact of the P4C program of structured discussions and given the relatively low cost of implementing the P4C program, it is recommended that it become a standard part of the school curriculum. Causation has traditionally been analyzed either as a relation of nomic dependence or as a relation of counterfactual dependence. I argue for a third program, a physicalistic reduction of the causal relation to one of energy-momentum transference in the technical sense of physics. This physicalistic analysis is argued to have the virtues of easily handling the standard counterexamples to the nomic and counterfactual analyses, offering a plausible epistemology for our knowledge of causes, and elucidating the nature of the relation between (...) causation and physical science. In this article we report the findings of a randomised control clinical trial that assessed the impact of a Philosophy for Children program and replicated a previous study conducted in Scotland by Topping and Trickey. A Cognitive Abilities Test was administered as a pretest and a posttest to randomly selected experimental groups and control groups. The students in the experimental group engaged in philosophy lessons in a setting of structured, collaborative inquiry in their language arts classes for one hour per (...) week for a number of weeks. The control group received the standard language arts curriculum in that one hour. The study found that the seventh grade students who had experienced the P4C program showed significant gains relative to those in the seventh grade control group at a high level of statistical significance, but the eighth grade students in the experimental group did not show such gains over the eighth grade control group. It was discovered that the seventh grade teachers started the program early in the school year and continued it for a period of 22 to 26 weeks, while the eighth grade teachers started much later and used the program for only 4 to 10 weeks. Our findings suggest that the P4C program must involve students in activities for a significant period of time before the program shows results, but that a meaningful impact on students’ cognitive abilities can be achieved in about 24 weeks of lessons, less than half the time evidenced by the study by Topping and Trickey. En este trabajo se intenta elaborar una indagación epistemológica crítica que contribuya a enriquecer al debate sobre la posibilidad o imposibilidad de abordar los fenómenos de las ciencias sociales y humanísticas de una manera neutral y/o objetiva.. A partir de un enfoque centrado en la teoría post-estructuralista francesa y, más específicamente, en los aportes brindados por el psicoanálisis lacaniano, se concluirá que el psicoanálisis, en su vertiente lacaniana, y retomado de un modo distinto por otros autores, como Zizek, ha mostrado (...) de una manera consistente que este supuesto objetivismo no es más que un imposible. La realidad objetiva no puede ser más que una utopía, en tanto toda realidad es construida por un lenguaje, un orden simbólico, que es contingente y, por lo tanto, relativo. Sin caer en un mero relativismo de los actuales enfoques “posmodernos”, que no exista la Verdad con mayúscula no implica que no existan verdades a medias, “minoradas”, como las denomina Lacan en su obra.Palabras clave: Objetividad, neutralidad valorativa, pos-estructuralismo lacaniano, ciencia sociales y humanísticas.This work tries to elaborate a critical epistemological inquiry that enriches the debate about the possibility or impossibility of approaching social and human science phenomena in a neutral and/or objective way. Starting from a view based on French post-structuralist theory, and more specifically, on contributions from Lacanian psychoanalysis, conclusions will be that psychoanalysis, at least Lacanian psychoanalysis, taken up again in a different way by other authors such as Zizek, has consistently shown that this supposed objectivism is impossible. Objective reality can be no more than a utopia, because all reality is constructed by a language, a symbolic order which is contingent, therefore relative. Without falling into postmodern relativism, the fact that there is no Truth with a capital letter does not imply that there are no truths.Key words: Objectivity, valuative neutrality, Lacanian post-structuralism, social and human sciences. In this article I explore two accounts of the Fallacy of Many Questions made famous by the question "Have you stopped beating your wife?" The accounts are from the works of Lennart Aqvist and Noel Belnap, and the two authors differ in their accounts of the fallacy. Then I give my own account based on understanding a facet of erotetic logic, i. e., the logic of questions.

Recently, unrestrained consequentialism has been defended against the charge that it leads to unacceptable trade-offs by showing a tradeoff accepted by many of us is not justified by any of the usual nonconsequenlist arguments. The particular trade-off involves raising the speed limit on the Interstate Highway System. As a society, we seemingly accept a trade-off of lives for convenience. This defense of consequentialism may be a tu quoque, but it does challenge nonconsequentialists to adequately justify a multitude of social decisions. (...) Work by the deontologist Frances Kamm, conjoined with a perspective deployed by several economists on the relation between social costs and lives lost, is relevant. It provides a starting point by justifying decisions which involve trading lives only for other lives. But the perspective also recognizes that using resources in excess of some figure to save a life causes us to forego other live-saving activities, thus causing a net loss of life. Setting a speed limit as low as 35 miles per hour might indeed save some lives, but the loss of productivity due to the increased time spent in travel would cost an even greater number of lives. Therefore, many trade-offs do not simply involve trading lives for some lesser value, but are justified as allowing some to die in order to save a greater number. (shrink)

Resumen: Este artículo analiza cómo se encadenan los planos de lo ontológico y lo óntico en la Teoría Política del Discurso de Ernesto Laclau. Se concluye que, desde el plano ontológico, la hegemonía constituye una forma político-discursiva de articulación y universalización relativa, precaria, contingente y parcial de los particularismos en significantes vacíos que actúan como puntos nodales. Desde el nivel fenoménico-político, Laclau pone en juego estos conceptos para mostrar el desplazamiento y contaminación discursiva entre lo particular y lo universal en (...) la operación hegemónica, que transforma las identidades políticas y construye un orden comunitario y un nuevo sentido común. Desde el nivel ético-político, la conceptualización de la hegemonía se articula a la construcción discursiva de una estrategia socialista y a una democracia radical. Este proyecto político lucha contra los esencialismos y las formas de explotación y opresión social y por un horizonte de liberación que amalgame las luchas de los grupos subordinados y reconozca las diferencias y particularidades como constitutivas y deseables. La teoría formal del populismo presenta algunas inconsistencias óntico-ontológicas en este esquema. Sin embargo, su sobredeterminación simbólica disuelve las disyunciones tajantes entre la lógica y el análisis histórico-político y entre la forma y el contenido. Ello pone de manifiesto el mutuo anudamiento entre lo óntico y lo ontológico y la centralidad de la noción gramsciana de hegemonía para el análisis político y crítico de fenómenos y procesos históricos contemporáneos.: This article analyzes how the ontological and ontic planes are interconnected in Laclau’s political discourse theory. It is concluded that, on the ontological level, hegemony constitutes a political-discursive form of relative, precarious, contingent and partial universalization and articulation of particularities in empty signifiers that act as nodal points. On the phenomenological-political level, Laclau shows the displacement and discursive contamination between the particular and the universal in the hegemonic operation which transforms political identities and builds a communitarian order and a new commonality. On the ethical-political level, the conceptualization of hegemony is articulated as the discursive construction of a socialist strategy and a radical democracy. This political project fights against essentialisms and forms of exploitation and social oppression of subordinate groups, and in favor of a horizon of liberation that recognizes conflicts and differences as constitutive and desirable. The formal theory of populism presents some ontic-ontological inconsistencies in this scheme. However, its symbolic overdetermination dissolves the disjunctions between logic and historical-political analysis and between form and content. This reveals the mutual interconnection between the ontic and the ontological, and the central relevance of the Gramscian notion of hegemony for the political and critical analysis of contemporary historical phenomena and processes. En los últimos 30 años asistimos a un drástico proceso de cambio que ha modificado profundamente los parámetros con los que se guiaba la relación entre el Estado y la Sociedad civil. Este proceso, ligado a la hegemonización mundial del neoliberalismo, ha generado intensas transformaciones en los diversos campos. Este artículo se propone indagar en esas transformaciones. Para ello, examina las características principales que definen a este paradigma, dando cuenta de la apropiación que han hecho sus principales teóricos del concepto (...) de globalización. En segundo término, analiza los efectos que sus políticas han provocado en la política, la economía, la cultura y la sociedad. Se sostiene que el éxito del “sistema global neoliberal” reside en que ha logrado despolitizar en gran medida a la sociedad y a su propio discurso. En este sentido, se coloca el eje en sus efectos de despolitización, en particular durante la década del noventa, fase critica del sistema. En el tramo final, se pregunta acerca de las alternativas surgidas en las nuevas democracias latinoamericanas al modelo de globalización neoliberal. (shrink)

La teoría post-marxista y post-estructuralista de Ernesto Laclau representa, actualmente, una de las perspectivas más relevantes para el análisis filosófico de la política. Sin embargo, mantiene un elevado nivel de abstracción y de complejidad conceptual, promoviendo una multiplicidad de interpretaciones divergentes. Sin asumir la defensa de un objetivismo, el presente trabajo se propone analizar algunos mitos y creencias vinculados a la obra laclausiana. De este modo, se busca contribuir a estimular el debate y la crítica sobre sus principales postulados.

Este artículo investiga los vínculos entre el sujeto y la estructura en el transcurso de la teoría política de Ernesto Laclau, integrando sus aspectos teóricos, onto-epistemológicos y axiológico-normativos. A través de la sistematización de sus principales trabajos escritos durante el período 1977-2014, se indaga en sus contribuciones al debate Agente-Estructura y se propone una periodización compleja de su obra. Mediante una articulación pragmática de conceptos del (pos)estructuralismo, el psicoanálisis, la deconstrucción, la fenomenología, el marxismo y la filosofía posanalítica, a partir (...) de su ruptura onto-epistemológica con el esencialismo de los años 80 Laclau construyó una innovadora teoría discursiva del sujeto, superadora tanto del subjetivismo como del objetivismo, y convergente con una estrategia socialista y radicalmente democrática. La razón populista aportó nuevas herramientas que destacaron la capacidad del agente de articular (parcialmente) lo social. Sin embargo, este trabajo marcó un quiebre en su obra, que dejó de lado el análisis retroductivo de las transformaciones históricas más recientes en la estructura social y en las identidades y su conexión con la creciente fragmentación y proliferación de las luchas sociales. Al mismo tiempo, relegó la centralidad de la categoría de articulación para amalgamar la pluralidad de luchas sociales en el capitalismo complejo actual, para priorizar la construcción (tendencial) de un antagonismo binario y una lógica de simplificación y reducción conceptual del espacio social. Desde el plano axiológico, la teoría formal del populismo Laclau abandonó la iniciativa socialista y el desarrollo de los contenidos ético-políticos críticos, inherentes a la teoría posgramsciana de la hegemonía. Se concluye que ―más allá de estas inconsistencias― la teoría posfundacional del sujeto de Laclau realizó aportes innovadores, relevantes y valiosos que contribuyen a superar la falsa disyunción sujeto-estructura, a complejizar el análisis político y social, y a fortalecer la lucha hegemónica, desde una perspectiva antiesencialista.
