The concept of social justice is making a revival in nursing scholarship, in part in response to widening health inequalities and inequities in high‐income countries. In particular, critical nurse scholars have sought to develop participatory research methods using peer researchers to represent the ‘voice’ of people who are living in marginalized spaces in society. The aim of this paper is to report on the experiences of nurse and peer researchers as part of a project to explore the experiences of people (...) who find themselves destitute following the asylum process in the UK. In seeking to explore social injustice, three challenges are identified: lack of a robust political theory, institutional/professional constraints and an absence of skills to engage with the politics of social (in)justice. Each challenge is presented, opposing voices outlined and some possible solutions are suggested. The work of political theorist Nancy Fraser is used as a conceptual framework, in particular her focus on mis/framing and political representation for social justice. In addition, it is suggested that social justice needs to be further embedded in nursing policy and curriculum. Finally, nurses are encouraged to develop practical political skills to engage with both politics and the media in a neoliberal globalizing world. (shrink)

How many senses are there? How many could there be? Wha t interaction takes place between the senses? This introduction is a guide to thinking about these questions.

Fiona Woollard presents an original defence of the Doctrine of Doing and Allowing, according to which doing harm seems much harder to justify than merely allowing harm. She argues that the Doctrine is best understood as a principle that protects us from harmful imposition, and offers a moderate account of our obligations to offer aid to others.

This powerfully iconoclastic book reconsiders the influential nativist position toward the mind. Nativists assert that some concepts, beliefs, or capacities are innate or inborn: "native" to the mind rather than acquired. Fiona Cowie argues that this view is mistaken, demonstrating that nativism is an unstable amalgam of two quite different--and probably inconsistent--theses about the mind. Unlike empiricists, who postulate domain-neutral learning strategies, nativists insist that some learning tasks require special kinds of skills, and that these skills are hard-wired into (...) our brains at birth. This "faculties hypothesis" finds its modern expression in the views of Noam Chomsky. Cowie, marshaling recent empirical evidence from developmental psychology, psycholinguistics, computer science, and linguistics, provides a crisp and timely critique of Chomsky's nativism and defends in its place a moderately nativist approach to language acquisition. Also in contrast to empiricists, who view the mind as simply another natural phenomenon susceptible of scientific explanation, nativists suspect that the mental is inelectably mysterious. Cowie addresses this second strand in nativist thought, taking on the view articulated by Jerry Fodor and other nativists that learning, particularly concept acquisition, is a fundamentally inexplicable process. Cowie challenges this explanatory pessimism, and argues convincingly that concept acquisition is psychologically explicable. Artworks at Lascaux and other late Palaeolithic caves integrate geological features or “relief” of the cave wall in a way that suggests a symbiotic relation between nature and culture. I argue this qualifies as “receptivity to a situation,” which is neither fully active nor merely passive and emerges as a necessary element of the intentions made apparent by such cave art. I argue against prominent interpretations of cave art, including the shamanist account and propose a structural interpretation attentive to particular (...) cases. Seen in this way, cave art displays intentions that are analyzable as having a tripartite structure: mentally directed, embedded in actions and receptive to a situation. Moreover, the latter is the medium through which the other two elements are conjoined. Drawing on a range of archaeological and philosophical resources from both analytical philosophy and phenomenology, I argue that what I call cave art’s “intentional story” is important for the philosophy of intentions more generally. For any system that uses previous experience to solve problems in new situations, it is necessary to identify the features in the situation that should match features in the previous cases through some process ofsituation analysis. In this paper, we examine this problem in the legal domain, where lawyers know it asissue spotting. In particular, we present an implementation of issue spotting in CHASER, a legal reasoning system that works in the domain of tort law.This approach is a compromise between (...) generality and efficiency, and is applicable to a range of problems and domains besides legal reasoning. In particular, it presents a principled way to use multiple cases for a single problem by exploiting the inherent structure present in many domains. (shrink)

Badiou has said that his entire philosophical project stems from the need to “update” the traditional philosophical categories of Truth, Being, the Infinite and the Universal in the wake of the 19th Century German mathematician Georg Cantor’s explication of transfinite set theory. In his essay, “What is Love?”, he provides an account of one of the ways in which a post-Cantorian reconfiguration of the ontological status of the category of Woman might operate. This is given in the form of a (...) postscript subtitled “The Feminine Position and Humanity” wherein he gives Lacan’s conception of supplementary feminine jouissance “an extra turn of the screw”. This essay draws on Badiou’s reconfiguration of the philosophical category of Woman to examine the implications of another postscript, that which abruptly concludes the 2003 novel Elizabeth Costello by J. M. Coetzee. It reads Coetzee’s invention of the “Letter of Elizabeth, Lady Chandos” with recourse to Lacanian psychoanalytic theory and on through the ontological reconfiguration of the philosophical category of Woman demonstrated by Badiou. It argues that Coetzee assembles, through the intervention of the postscript, a situation that “makes it possible to argue”, along with Badiou, that, for the woman position, love knots together the four types of truths – Politics, Art, Science, and Love (2008, 196). Fiona Nicoll and Melissa Gregg met on the job at a new university having both moved from Sydney to Brisbane to take up their appointments. Here they share reflections on teaching a cultural theory course that they inherited from a prominent Australian Professor of Cultural Studies, offering the perspectives of two consecutive generations of cultural studies theorists now teaching in the field since the early 1990s. This situation gives rise to new interpretations regarding the value and uses of theory (...) in the classroom. Noting the subtle differences involved in teaching the same theoretical material in different cities, the ironies of teaching radical cultural theory in a conservative institutional environment, and the specific opportunities and challenges of teaching cultural studies theory as opposed to others, the article considers some of the silences teachers must also contend with in their classroom practice, drawing on and expanding the terrain established by Thorkelson's thesis. This book traces a deep misunderstanding about the relation of concepts and reality in the history of philosophy. It exposes the influence of the mistake in the thought of Locke, Berkeley, Kant, Nietzche and Bradley, and suggests that the solution can be found in Hegelian thought. Ellis argues that the treatment proposed exemplifies Hegel's dialectical method. This is an important contribution to this area of philosophy.

Is there a space of the sensory modalities? Such a space would be one in which we can represent all the actual, and at least some of the possible, sensory modalities. The relative position of the senses in this space would indicate how similar and how different the senses were from each other. The construction of such a space might reveal unconsidered features of the actual and possible senses, help us to define what a sense is, and provide grounds that (...) we might use to decide what is one token sense rather than multiple token senses. -/- In this paper, I explore, refine, and defend the idea that we can construct such a space—an idea that I briefly proposed in earlier work (Macpherson 2011a and 2011b). In doing so, I defend the idea from an objection that Richard Gray (2012) has voiced. Gray claims that the dimensions of the space of sensory modalities must generate a non-­‐arbitrary ordering of the senses. He argues that we cannot find dimensions that do so. I disagree. I identify different ways in which a space could be arbitrary but I argue that we can define a space of the sensory modalities in a non-arbitrary manner. If beliefs and desires affect perception—at least in certain specified ways—then cognitive penetration occurs. Whether it occurs is a matter of controversy. Recently, some proponents of the predictive coding account of perception have claimed that the account entails that cognitive penetrations occurs. I argue that the relationship between the predictive coding account and cognitive penetration is dependent on both the specific form of the predictive coding account and the specific form of cognitive penetration. In so doing, I spell out different (...) forms of each and the relationship that holds between them. Thus, mere acceptance of the predictive coding approach to perception does not determine whether one should think that cognitive penetration exists. Moreover, given that there are such different conceptions of both predictive coding and cognitive penetration, researchers should cease talking of either without making clear which form they refer to, if they aspire to make true generalisations. Unlike those with type 1 blindsight, people who have type 2 blindsight have some sort of consciousness of the stimuli in their blind field. What is the nature of that consciousness? Is it visual experience? I address these questions by considering whether we can establish the existence of any structural—necessary—features of visual experience. I argue that it is very difficult to establish the existence of any such features. In particular, I investigate whether it is possible to visually, or more generally (...) perceptually, experience form or movement at a distance from our body, without experiencing colour. The traditional answer, advocated by Aristotle, and some other philosophers, up to and including the present day, is that it is not and hence colour is a structural feature of visual experience. I argue that there is no good reason to think that this is impossible, and provide evidence from four cases—sensory substitution, achomatopsia, phantom contours and amodal completion—in favour of the idea that it is possible. If it is possible then one important reason for rejecting the idea that people with type 2 blindsight do not have visual experiences is undermined. I suggest further experiments that could be done to help settle the matter. (shrink)

According to Brad Hooker's rule-consequentialism, as well as ordinary moral prohibitions against lying, stealing, killing, and harming others, the optimific code will include an over-riding “prevent disaster clause”. This paper explores two issues related to the disaster clause. The first issue is whether the disaster clause is vague—and whether this is a problem for rule-consequentialism. I argue that on Hooker's rule-consequentialism, there will be cases where it is indeterminate whether a given outcome counts as a disaster such that it is (...) permissible to infringe a given prohibition to avoid that outcome. I argue that it counts in favour of Hooker's rule-consequentialism that it makes this space for vagueness. The second issue is how to understand the disaster clause so that it does not make rule-consequentialism intolerably demanding—and more particularly whether avoiding over-demandingness requires the rule-consequentialist to place a counterintuitive limit on requirements to aid. I will argue that rule-consequentialism can avoid over-demandingness without placing a counterintuitive limit on requirements to aid. (shrink)

How many could there be? What makes the senses different? What interaction takes place between the senses? This book is a guide to thinking about these questions. Together with an extensive introduction to the topic, the book contains the key classic papers on this subject together with nine newly commissioned essays.One reason (...) that these questions are important is that we are receiving a huge influx of new information from the sciences that challenges some traditional philosophical views about the senses. This information needs to be incorporated into our view of the senses and perception. Can we do this whilst retaining our pre-existing concepts of the senses and of perception or do we need to revise our concepts? If they need to be revised, then in what way should that be done? Research in diverse areas, such as the nature of human perception, varieties of non-human animal perception, the interaction between different sensory modalities, perceptual disorders, and possible treatments for them, calls into question the platitude that there are five senses, as well as the pre-supposition that we know what we are counting when we count them as five.This book will serve as an inspiring introduction to the topic and as a basis from which further new research will grow. For many women experiencing motherhood for the first time, the message they receive is clear: mothers who do not breastfeed ought to have good reasons not to; bottle feeding by choice is a failure of maternal duty. We argue that this pressure to breastfeed arises in part from two misconceptions about maternal duty: confusion about the scope of the duty to benefit and conflation between moral reasons and duties. While mothers have a general duty to benefit, we argue that this (...) does not imply a duty to carry out any particular beneficent act. Therefore, the expectation that mothers should breastfeed unless they have sufficient countervailing reasons not to is morally unwarranted. Recognising the difference between reasons and duties can allow us to discuss the benefits of breastfeeding and the importance of supporting mothers who wish to breastfeed without subjecting mothers who bottle feed to guilt, blame and failure. The symposion was a key cultural phenomenon in ancient Greece. This book investigates its place in ancient Greek society and thought by exploring the rhetorical dynamics of its representations in literature and art. Across genres, individual Greeks constructed visions of the party and its performances that offered persuasive understandings of the event and its participants. Sympotic representations thus communicated ideas which, set within broader cultural conversations, could possess a discursive edge. Hence, at the symposion, sympotic styles and identities might be (...) promoted, critiqued and challenged. In the public imagination, the ethics of Greeks and foreigners might be interrogated and political attitudes intimated. Symposia might be suborned into historical narratives about struggles for power. And for philosophers, writing a Symposium was itself a rhetorical act. Investigating the symposion's discursive potential enhances understanding of how the Greeks experienced and conceptualized the symposion and demonstrates its contribution to the Greek thought world. Can the phenomenal character of perceptual experience be altered by the states of one's cognitive system, for example, one's thoughts or beliefs? If one thinks that this can happen then one thinks that there can be cognitive penetration of perceptual experience; otherwise, one thinks that perceptual experience is cognitively impenetrable. I claim that there is one alleged case of cognitive penetration that cannot be explained away by the standard strategies one can typically use to explain away alleged cases. The case (...) is one in which it seems subjects' beliefs about the typical colour of objects affects their colour experience. I propose a two-step mechanism of indirect cognitive penetration that explains how cognitive penetration may occur. I show that there is independent evidence that each step in this process can occur. I suspect that people who are opposed to the idea that perceptual experience is cognitively penetrable will be less opposed to the idea when they come to consider this indirect mechanism and that those who are generally sympathetic to the idea of cognitive penetrability will welcome the elucidation of this plausible mechanism. The debate is one that takes place among advocates of a certain way of thinking of perceptual experiences: that they are states that represent the world. For to say that a state has content (...) is to say that it represents; and its content is usually taken to be that which is represented. One should not be tempted to think that the debate is therefore marginal or esoteric, for this view of perceptual experience has been by far the dominant view of perceptual experience in recent years in philosophy (and in psychology and neuroscience). The debate is about what answer to give to a fundamental question about the nature of perceptual experience, namely: what objects and properties can it represent? (shrink)

This article draws on Kristeva's theories of the foreigner within the national boundaries and, combining this with her earlier work on the abject, considers the challenge posed by the individual who is rejected as foreign, to the boundaries which constitute collective and individual identity. With reference to Prévost's Le Passé sous silence, it argues that the solutions posited by Kristeva are of limited value within contemporary French society, and concludes by considering the potential of literature as an alternative means of (...) reconciliation with otherness. Legal protections and remedies for sex workers are important mechanisms for redressing discrimination. This paper proposes a strategic approach at Queensland and national levels using industrial and anti-discrimination laws and institutions to effect change in legal processes and regimes and increase uptake of individual remedies. It provides a strategic approach that could be considered by other organisations advocating with, and for, members of other marginalised groups to effect systemic change.

Gangestad & Simpson review sexual selection theory and discuss their work on fluctuating asymmetry and mate preference in humans. We question some aspects of their account and mention problems with the data. We also suggest that more theoretical work on complex but realistic mating systems is required.

I consider whether there are philosophical developments which can deepen our understanding of God. I focus upon the relation between experience and physical things and the nature of value. I reject the narrow limits of experience presupposed by the verificationist, and the related monopoly of science on reality. I recommend a conception of reality which is rich enough to accommodate physical things and also the intertwining of value in the natural world. I detect structural similarities between these two problems and (...) the problem of God, and consider how they might be related at the level of content. (shrink)

I examine Roger Scruton's account of the religious and soteriological significance of Wagner's Tristan and Isolde . The relation between Scruton and Wagner remains unclear, and the position at issue is a curious amalgam of the two. I refer to its author as ‘Scruton's Wagner’. Scruton's Wagner argues that erotic love has religious and soteriological significance, and that the notions of religion and salvation are to be defined in terms which are shorn of any reference to God. I argue that (...) there may be good reasons for setting these limits short of God, but that Scruton's Wagner does not provide them. (shrink)

In this paper we trace the historical exclusion of women from the legal profession in Canada. We examine women’s efforts to gain entry to law practice and their progress through the last century. The battle to gain entry to this exclusive profession took place on many fronts: in the courts, government legislature, public debate and media, and behind the closed doors of the law societies. After formal barriers to entry were dismantled, women continued to confront formidable barriers through overt and (...) subtler forms of discrimination and exclusion. Today’s legal profession in Canada is a contested one. Women have succeeded with large enrolments in law schools and growing representation in the profession. However, women remain on the margins of power and privilege in law practice. Our analysis of contemporary official data on the Canadian legal profession demonstrates that women are under-represented in private practice, have reduced chances for promotion, and are excluded from higher echelons of authority, remuneration, and status in the profession. Yet, the contemporary picture of the legal profession also reveals that women are having an important impact on the profession of law in Canada by introducing policy reforms aimed at creating a more humane legal profession. This article brings a phenomenological account of the body into dialogue with theories of gender performativity, through an analysis of performance artist Cathy Sisler’s videos Aberrant Motion #1 (1993) and Aberrant Motion #4 (1994). In the work I discuss, Sisler foregrounds he limits of visibility and employs a visual mode which is more haptic than strictly optic. At the same time, the work makes explicit the power of visibility to regulate, control and mark out the subject and critiques the effect (...) of the gaze upon structures of identity formation and, crucially, the motility of the body. I argue that in this work, the viewer’s relation to the images is severed from the visual mastery associated with the modes of viewing which position Sisler as ‘other’, but which remain vitally at stake within the haptic visual economy she creates. This paper employs Mikhail Bakhtin for a dialogic reading of dialectics, conceptualising how early childhood education (ECE) teachers’ political dialogues are opened up and closed down. Explorations of ‘political dialogue’, or how teachers respond to issues they deem of political concern, is pertinent for teaching’s inherently political nature. How such encounters are opened and closed has special significance for ECE teachers, who have expressed feeling professionally and politically silenced. Guided by a philosophical framing of the contradictions and jostling interplays between (...) dialogism’s in-betweenness and dialectic’s one-ness, excerpts are analysed from a doctoral study involving 10 Victorian, Australian ECE teachers. This framing and analysis signal the potential ramifications of a dialectical closing down of ECE teachers’ political dialogues in addition to how dialogism’s in-betweenness fosters openness. Contemplating these language strategies, the paper highlights how a silencing divisiveness may transpire, prompting a need for genuine listening in the threshold in-between the self and other.
