In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

In this paper I defend the idea that there is a sense in which it is meaningful and useful to talk about objective understanding, and that to characterize that notion it is necessary to formulate an account of explanation that makes reference to the beliefs and epistemic goals of the participants in a cognitive enterprise. Using the framework for belief revision developed by Isaac Levi, I analyze the conditions that information must fulfill to be both potentially explanatory and epistemically valuable (...) to an inquiring agent and to a scientific community. To be potentially explanatory, the information must state the relations of probabilistic relevance that the explanans bares to the explanandum. But a potential explanation con only be a bona fide explanation if it becomes part of inquiry, that is, if an agent or a group of agents can see any value in it for their cognitive purposes. I provide a way to evaluate the epistemic value of a potential explanation as a function of its credibility and its informational content. (shrink)

“Vulnerability” is a key concept for research ethics and public health ethics. This term can be discussed from either a conceptual or a practical perspective. I previously proposed the metaphor of layers to understand how this concept functions from the conceptual perspective in human research. In this paper I will clarify how my analysis includes other definitions of vulnerability. Then, I will take the practical‐ethical perspective, rejecting the usefulness of taxonomies to analyze vulnerabilities. My proposal specifies two steps and provides (...) a procedural guide to help rank layers. I introduce the notion of cascade vulnerability and outline the dispositional nature of layers of vulnerability to underscore the importance of identifying their stimulus condition. In addition, I identify three kinds of obligations and some strategies to implement them. This strategy outlines the normative force of harmful layers of vulnerability. It offers concrete guidance. It contributes substantial content to the practical sphere but it does not simplify or idealize research subjects, research context or public health challenges. (shrink)

This short article is a commentary to ‘Vulnerability in Research Ethics: A way forward’ from Margaret Meek Lange, Wendy Rogers and Susan Dodds. In their article they describe and accept my criticisms of the subpopulation approach to vulnerability and my analysis of vulnerability based on layers, but they suggest going beyond it using a taxonomy to classify layers of vulnerabilty. I argue that a) we do not need a taxonomy to classify vulnerabilities, b) the authors do not provide an adequate (...) or successful taxonomy, and c) they are unable to link their taxonomy to specific obligations. Thus I propose avoiding an approach that requires taxonomies, and suggest instead using some characteristics of layers of vulnerability. (shrink)

The poverty of stimulus argument is one of the most controversial arguments in the study of language acquisition. Here we follow previous approaches challenging the assumption of impoverished primary linguistic data, focusing on the specific problem of auxiliary (AUX) fronting in complex polar interrogatives. We develop a series of corpus analyses of child‐directed speech showing that there is indirect statistical information useful for correct auxiliary fronting in polar interrogatives and that such information is sufficient for distinguishing between grammatical and ungrammatical (...) generalizations, even in the absence of direct evidence. We further show that there are simple learning devices, such as neural networks, capable of exploiting such statistical cues, producing a bias toward correct AUX questions when compared to their ungrammatical counterparts. The results suggest that the basic assumptions of the poverty of stimulus argument may need to be reappraised. (shrink)

Los sesgos cognitivos afectan negativamente la toma de decisiones en todas las esferas de la vida, incluyendo las decisiones de los jueces. La imposibilidad de eliminarlos por completo de la práctica del derecho, o incluso de controlar sus efectos, contrasta con el anhelo de que las decisiones judiciales sean el resultado exclusivo de un razonamiento lógico-jurídico correcto. Frente el efecto sistemático, recalcitrante y porfiado de los sesgos cognitivos, una posible estrategia para disminuir su efecto es enfocarse, no en modificar el (...) comportamiento de los agentes judiciales, sino en moldear su entorno para que los sesgos tengan menos oportunidades de aparecer. En particular, es más provechoso concentrar los esfuerzos en identificar aquellas reglas procesales que faciliten o limiten el efecto de los sesgos. En este ensayo propongo un diálogo fructífero entre el derecho y la psicología que puede llevar a mejorar la calidad de los sistemas judiciales. La propuesta está basada en la creación de guías de práctica judicial que puedan servir de base para la creación de protocolos procesales que limiten en la medida de lo razonable sus efectos negativos y conduzcan a mejores decisiones judiciales. In this article I focus on two issues concerning bioethics in Argentina: reproductive health and ethics in research. Although these topics are quite dissimilar, they share a particular feature: their special relationship with context.

Wild animals probably have net negative lives. Christine Korsgaard rejects the view that we might engineer paradise by redesigning nature and animals so that they have the best possible existences. She believes the genetic changes required would not be identity-preserving, thereby causing animals to cease to exist. I argue, first, that paradise engineering is permissible. Many harms are caused by non-sentient natural entities and processes. Moreover, sentient animals can survive modifications compatible with their psychological persistence over time. Non-communicable diseases are no longer largely limited to high-income countries and the elderly. The burden of non-communicable diseases is rising across all country income categories, in part because these diseases have been relatively overlooked on the global health agenda. Historically, communicable diseases have been prioritized in many countries as they were perceived to constitute the greatest disease burden, especially among vulnerable and poor populations, and strategies for prevention and treatment, which had been successful in high-income settings, were considered feasible and (...) often affordable in low-income settings. This prioritization has reduced the communicable diseases burden globally but has left non-communicable diseases largely neglected. A new approach is urgently needed to tackle non-communicable diseases. Based on an analysis of potential features which may have underlain the different approaches to non-communicable diseases and communicable diseases until now, including acuity of disease, potential for control or cure, cost, infectiousness, blaming of individuals and logistical barriers, little ethical or rational justification can be found to support continued neglect of non-communicable diseases. Justice demands access to quality and affordable care for all. An equitable approach to non-communicable diseases is therefore strongly mandated on medical, ethical, economic, and public health grounds. Funding must not however be diverted away from communicable diseases, which continue to require attention—but concomitantly, funding for non-communicable diseases must be increased. International and multi-sectoral action is required to accelerate progress towards true universal health coverage and towards achievement of all of the sustainable development goals, such that prevention and access to care for non-communicable disease can become a global reality. ABSTRACT This paper focuses on poverty and inequality in the world today. First, it points out how this topic is a main concern for the IAB. Second, it proposes ‘new’ theoretical tools in order to analyze global justice and our obligations towards the needy. I present John Rawls's denial that the egalitarian principle can be applied to the global sphere, his proposed weak duty of assistance, and his consideration of endemic poverty as essentially homegrown. In opposition, I focus on Thomas (...) Pogge as representative of a cosmopolitan view who also holds a critical position towards the international systems which allow and cause poverty. I endorse the general normative proposal that defends every human being as an ultimate unit of moral concern, as well as the strategy of moving away from the charity model of bilateral aid to the realm of rights and duties. These ideas should redesign and broaden the normative and practical roles of institutions, and should also help provide a new approach on bioethical issues such as drug patenting or the imbalance in global research and neglected diseases. A common objection to probabilistic theories of causation is that there are prima facie causes that lower the probability of their effects. Among the many replies to this objection, little attention has been given to Mellor's (1995) indirect strategy to deny that probability-lowering factors are bona fide causes. According to Mellor, such factors do not satisfy the evidential, explanatory, and instrumental connotations of causation. The paper argues that the evidential connotation only entails an epistemically relativized form of causal attribution, not (...) causation itself, and that there are clear cases of explanation and instrumental reasoning that must appeal to negatively relevant factors. In the end, it suggests a more liberal interpretation of causation that restores its connotations. Una objeción común a las teorías probabilísticas de la causalidad es que aparentemente existen causas que disminuyen la probabilidad de sus efectos. Entre las muchas respuestas a esta objeción, se le ha dado poca atención a la estrategia indirecta de D. H. Mellor (1995) para negar que un factor que disminuya la probabilidad de un efecto sea una causa legítima. Según Mellor, tales factores no satisfacen las connotaciones evidenciales, explicativas e instrumentales de la causalidad. El artículo argumenta que la connotación evidencial sólo implica una forma epistémicamente relativizada de atribución causal y no la causalidad misma, y que hay casos claros de explicación y razonamiento instrumental que deben apelar a factores negativamente relevantes. Se sugiere una interpretación más liberal de la causalidad que reinstaura sus connotaciones. (shrink)

Most nonhuman animals live on the terms imposed on them by human beings. This condition of being under the mastery of another, or domination, is what republicanism identifies as political unfreedom. Yet there are several problems that must be solved in order to successfully extend republicanism to animals. Here I focus on the question of whether freedom can be a benefit for individuals without a free will. I argue that once we understand the grounds that make freedom a desirable property (...) of choices, we can see how it is appropriate to predicate it of those made by any sentient agent. (shrink)

El artículo analiza algunas problemáticas centrales de la literatura caribeña, en particular de expresión francófona y anglófona, relacionadas, por un lado, con la falta de desarrollo y el funcionamiento colonial de sus sistemas literarios, y, por el otro, con el problema social, económico y político de la emigración en las Antillas. Como propongo, es la misma condición migrante de la literatura caribeña, en tanto sistema atravesado por el desplazamiento masivo de sus productores, la que en gran parte determina sus motivaciones (...) e intereses, enfocados a la identidad regional (y a la cultura regionalista) de modo recurrente. El artículo indaga, entre otros lugares-comunes (Glissant) del discurso literario caribeño, su estética geográficamente marcada que es enunciada aun desde un locus migrante (distante) con fines descolonizadores, los cuales se vinculan con la tradición anticolonialista, masculina y de sesgo militante del siglo pasado. Luego de una revisión de este legado a partir de dos aproximaciones críticas (Tinsley, Condé), se lee una serie de textos donde se observa la persistencia de la geoestética antillana, como A Small Place de Jamaica Kincaid, los cuales se apropian creativamente del discurso turístico desde una perspectiva geopolítica de resistencia a las dominaciones aún coloniales. This essay examines the construction of a symbolic figure who has worked to support the reordering of power relationships. It is the invention of a foreign enemy, Islamic radicalism from which United States has served its objectives of establishing a new hegemony. Since the terrorist threat, has extended a speech level that adulterated and showed us a world divided into two opposite poles: a virtuous and civilized axis that is forced to attack to defend itself, and a barbaric and evil (...) axis that threatens global security. This article presents some of the ethical and theoretical problems that reproductive decisions pose. I considerer the difficult situation of HIV infected women who have to decide whether to begin or continue pregnancy, knowing about the possibility of transmitting the infection. Could reproductive freedom be limited? I discuss, among others, Parfit, Harris and Purdy´s proposals. I try to show that a paternalistic solution is inadequate and argue on behalf of the importance of responsible and informed decisions on the part of (...) the mother or the parents. (shrink)

According to Bronislaw Baczko, utopias may be considered as different forms—they are not linked to any precise literary genre—of critique of social reality and the quest for alternatives. Some consist of a detailed description of a new social order, whereas others confine themselves to an overall design, which solely defines a series of values and principles. They all contain an ideal of perfection: a utopian view of the world always stems from the awareness of a breach between what must be (...) and social reality, which is deemed to be in crisis and dominated by evil. There is, thus, no utopia without an ideal opposed to reality. That said, idealized as they may be, utopias do allow such reality to cease to be deemed.. (shrink)

In this work, our hypothesis is that the parody towards historiography and its textualities is the principal axis in Los Perros del Paraíso, by the Argentinian Abel Posse, considered by the critics as part of the New Latin-American historical novel. This textual feature allows questioning the historiographic story and articulating other possible visions of history. This parody is manifested through three mechanisms: 1) form, through which quotations and referents coincides, as well as notes, data and other elements usually found in (...) other formats than literature, i.e., text pretending veracity and non-fiction; 2) superposition of stories overlapping and co-occurring in opposition to the line and causality of the historical text; and 3) the subjective perspective of the narrator, who constantly comments events, thus opposing the historicist objectivity. In this article I examine several criticisms of the concept of vulnerability. Rather than rejecting the concept, however, I argue that a sufficiently rich understanding of vulnerability is essential to bioethics. The challenges of international research in developing countries require an understanding of how new vulnerabilities arise from conditions of economic, social and political exclusion. A serious shortcoming of current conceptions of vulnerability in research ethics is the tendency to treat vulnerability as a label fixed on a particular subpopulation. My (...) paper examines the role of this “label” metaphor in current statements of research ethics. In contrast to this prevailing “label” metaphor, my own positive account of vulnerability develops a dynamic way of understanding the structure of the concept of vulnerability based on the idea of “layers of vulnerability.” I examine several cases involving women, as they are sometimes labeled as a vulnerable population and sometimes not. My analysis demonstrates the essential role of this revised concept of vulnerability in bioethics and research ethics. (shrink)

There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

El movimiento de ‘retorno a Kant’ del siglo XIX se constituye en sus orígenes a través del rechazo a la filosofía especulativa de Hegel. Por diversos motivos que no han sido debidamente clarificados aún, este movimiento filosófico culmina su derrotero a principios del siglo XX afirmando la necesidad de una renovación del hegelianismo. El objetivo del presente estudio es explicar los motivos y las consecuencias de la transformación progresiva del neokantismo de Baden en una variante de neohegelianismo. The concept of vulnerability has been hotly debated in research ethics literature. Some critics considered it a useless concept. In 2009—against some of those criticisms—I defended the importance of understanding this concept in terms of layers instead of applying it as a label given to certain subpopulations. In this paper, I present some of the limits of this analysis and I also explore the similarities and differences this approach has when compared to using a taxonomy as another answer on how (...) to assess vulnerability. I present the notion of cascade vulnerability and underscore the dispositional character of layers and their relevance to identify and evaluate layers of vulnerability. Finally, I show how this layered account has been incorporated in important documents such as the new 2016 CIOMS-WHO Guidelines. (shrink)

In this article, the authors focus on Argentina's activity in the developing field of regenerative medicine, specifically stem cell research. They take as a starting point a recent article by Shawn Harmon (published in this journal) who argues that attempts to regulate the practice in Argentina are morally incoherent. The authors try to show first, that there is no such ‘attempt to legislate’ on stem cell research in Argentina and this is due to a number of reasons that they explain. (...) Second, by examining the role played by different values, conflicting legal and moral views, and the influence of various actors, they attempt to show that the legislative silence regarding stem cell research may not necessarily be a manifestation of a legal/moral disconnection but rather a survival strategy for navigating the long and heated battle on the moral status of the embryo and the kind of treatment it deserves. Esta breve introducción a la filosofía de la ciencia parte del hecho de que tanto la investigación científica como el razonamiento probatorio judicial tienen un carácter inductivo. En esa medida, comparten características esenciales que permiten que el derecho se nutra de muchas de las reflexiones de la filosofía de la ciencia. El capítulo se concentra en cuatro temas principales: los criterios de demarcación entre el conocimiento científico y la pseudociencia; el carácter derrotable de las conclusiones de la ciencia y el (...) derecho; la estructura corroborativa de la relación entre la evidencia y las hipótesis científicas y judiciales; y las teorías de la explicación tanto en el ámbito científico como en el judicial. En este segundo documento nos ocupamos del aborto realizado por motivos terapéuticos o, dicho más brevemente, del aborto terapéutico. En la Argentina, el aborto plantea serios desafíos para la salud pública, ya que, pese a estar prohibido, se practica de forma clandestina y, muchas veces, insegura, poniendo en riesgo la vida y la salud de las mujeres. Por esta razón, creemos que la sociedad y el Estado deben debatir este problema y encontrar soluciones que resguarden los derechos de las mujeres. (...) El artículo 86, inciso 1, del Código Penal argentino expresamente despenaliza el aborto cuando corre peligro la vida o la salud de la mujer. En estos casos, se habla de aborto terapéutico. Esta disposición legal no suele aplicarse ni por los médicos ni por los profesionales que trabajan en la justicia, ya sea por desconocimiento o por razones ideológicas. Más aún, en muchos casos, las interpretaciones del Código Penal se apartan de su letra y restringen arbitrariamente su aplicación. Por estas razones, nos parece importante analizar este problema y proveer información sobre los aspectos legales y éticos involucrados en el aborto terapéutico en la Argentina. Este documento comienza con el relato de un caso hipotético, elaborado a partir de experiencias reales, con el objetivo de acercar al público a una situación concreta. Intercaladas en el cuerpo del relato, se desarrollan algunas reflexiones acerca de las implicaciones médicas, éticas y legales del caso. A continuación, se presenta un apartado referido al marco legal en el que se deben encuadrar los casos de aborto no punible. El documento sigue con una serie de breves recomendaciones destinadas tanto a los profesionales que trabajan en el sistema judicial como a los profesionales de la salud. Por último, se incluye un apéndice que contiene los principios que rigen la interpretación en materia penal y el glosario médico y legal, donde se pueden buscar las palabras resaltadas a lo largo del documento. In this paper, I will explore the relationship between ideal and nonideal theories and bioethics. I explore the challenges we face in their implementation in the real world. I argue that there is no sole theory that can guide the multiplicity of real world cases and policies. If we consider there are a variety of possibilities, we should ask several questions: When should we use NITs and when should we opt for ITs? Are there appropriate criteria for making these decisions? (...) Which are the valid uses or justifications for NITs? Is there a way to guide the decision-making process in real world contexts? This paper will try to answer the above questions. In the first part of this paper, I make some distinctions to present the theoretical arena and debate, and I propose five criteria that can help our decision making process. In the second part, I introduce two cases focused on reproductive rights-related problems in order to apply the decision-making process developed in the first part. The first one examines conscientious objection in the case of legal abortion in Argentina and the second one analyzes the case of research with pregnant women in countries where abortion is illegal. In one case, I argue that we ought to follow NIT, while in the other we should follow IT. (shrink)

In this paper I analyse changes AIDS brought to research with human beings . One of the issues I consider is the relevance of ethical codes to these new proposals in research and if we are justified to think this implies a new paradigm in research . I evaluate some of the arguments activits of AIDS have done, the relevance of considering informed consent as the only criterium and I give special importance to the benefit-risk evaluation as one of the (...) necessary conditions for research work. Multiple constraints, including semantic, lexical, and usage-based factors, have been shown to influence dative alternation across different languages. This work explores whether fine-grained statistics and semantic properties of the verb affect the acceptability of dative constructions in Spanish. First, a corpus analysis reveals that verbs of different semantic classes occur naturally in alternative dative constructions, a pattern quite different from English. The fact that dative alternation appears independent of semantic classes challenges traditional semantic-based approaches. Second, acceptability rating tasks reveal that (...) dative constructions containing highly entrenched word combinations and frequent word order are judged more acceptable regardless of the verbs' semantics. The results are interpreted in favor of usage-based accounts: Acceptability of dative constructions may be language-specific and depend on patterns of use and conventionalization. (shrink)

The use of machine learning algorithms has become ubiquitous in hiring decisions. Recent studies have shown that many of these algorithms generate unlawful discriminatory effects in every step of the process. The training phase of the machine learning models used in these decisions has been identified as the main source of bias. For a long time, discrimination cases have been analyzed under the banner of disparate treatment and disparate impact, but these concepts have been shown to be ineffective in the (...) context of AI. This paper examines the possibility of studying algorithmic discrimination from the perspective of negligence law. Negligent selection and validation of datasets and classifiers is a salient cause of improper training in machine learning. It is a breach of an employer’s duty to protect others, a failure of its exercise of due care in the manner of choosing employees. Adopting negligence to algorithmic discrimination requires a reformulation of what is foreseeable and reasonable within the context of black box algorithms, and a shift in the burden of proof to the employer, who must present evidence of its efforts to avoid bias. The goal of this paper is to show how culture – shared norms and values – is challenged and used to facilitate cooperative behavior within the context of farmer field schools (FFS) in central Luzon, Philippines. The success of the FFS is primarily associated with cultural norms that encourage experiential and collective learning and eventually lead to the adoption of integrated pest management (IPM) methods among the farmers. The study was conducted in central Luzon, the rice granary region of the (...) Philippines, from 1992 to 1995 and again in 1999. Both qualitative and quantitative research methods were employed. Results indicate that a keen understanding of Filipino culture and values is essential if FFS is to be successful and if farmers are to successfully learn and practice IPM. (shrink)
