In this article we develop and defend what we call the “Trust View” of promissory obligation, according to which making a promise involves inviting another individual to trust one to do something. In inviting her trust, and having the invitation accepted (or at least not rejected), one incurs an obligation to her not to betray the trust that one has invited. The distinctive wrong involved in breaking a promise is a matter of violating this obligation. We begin by explicating the (...) core notion of “inviting someone to trust one to do something”, suggesting that it involves signaling to the other individual one's recognition of the importance the relevant action has for her, and one’s willingness to license her to have faith or optimism in one's character with regard to the performance of that action. We then turn to a defense of the Trust View, arguing that it has considerable appeal in its own right, that it is distinct from and superior to three similar accounts (T.M. Scanlon's Assurance View, Judith Jarvis Thomson's Reliance View and David Owens' Authority View), and that several objections to it can be answered. (shrink)

This is the third volume to appear in an edition that will be the first complete, critical, and annotated English translation of all of Nietzsche's work. The edition is a new English translation, by various hands, of the celebrated Colli-Montinari edition. The present volume provides for the first time English translations of all of Nietzsche's unpublished notebooks from summer 1872 to the end of 1874. The major works published in this period were the first three Unfashionable Observations: 'David Strauss the (...) Confessor and the Writer,' 'On the Utility and Liability of History for Life,' and 'Schopenhauer as educator.' Translations of the preliminary notes for these pieces are coordinated with the translations of the published texts printed in Volume 2: Unfashionable Observations. These notebooks represent important transitional documents in Nietzsche's intellectual development, marking, among other things, the shift away from philological studies toward unabashed cultural criticism. Zwei scheinbar widersprüchliche Narrative prägen die Geschichte und auch die Theorie der Technik: Das Narrativ der Entzauberung beschreibt, wie eine als fremd und gefährlich erfahrene Natur durch Verwissenschaftlichung und Technisierung gezähmt wurde. Das Narrativ der Verzauberung schildert, wie uns Artefakte und technologische Möglichkeiten unheimlich werden, insbesondere wenn sie sich zu verselbständigen scheinen oder mit „autonomem“ Eigensinn gegenübertreten. In den heutigen Debatten um selbstlernende, ubiquitär verteilte, im Assistenzmodus unsichtbare, dabei opake (...) Techniken schwingt das unheimliche Moment einer „Verselbständigung“ von Technik mit – und trägt im Anschluss an die Mechanisierungs- und Automatisierungsdiskurse des 20. Jahrhunderts zur „Dämonisierung“ der Technik bei. Technik macht Welt einerseits vertraut und nachvollziehbar: Paradigmatisch wird dies in der Idee, dass etwas dann verstanden wird, wenn es technisch rekonstruiert werden kann. Andererseits wird die technische Reproduktion von Welt – oder deren radikale Umgestaltung zu einer entfremdeten – als etwas Verstörendes erlebt. Spätestens, wenn Artefakte zu tun scheinen, „was sie wollen“ oder technische Großsysteme die Lebenswelt nach ihren „Eigenlogiken“ prägen, ist eine schon von Freud benannte Grenze erreicht, an der wir verunsichert werden, ob wir überhaupt noch in der modernen Welt leben. Originally published as separate volumes as Mixed Opinions and Maxims (1879) andThe Wanderer and His Shadow (1880), the two works included here continue the aphoristic style begun in Volume I of Nietzsche's "Book for Free Spirits" and offer a window into the intellectual sources behind his evolution as a philosopher.

The article starts from an examination of the authorship of the ‘Geleitwort’, the programmatic statement which appeared in the Archiv für Sozialwissenschaft when it came under new editors in 1904. Recently scholars have begun to view it as an important text by Max Weber recovered from obscurity, but this is a mistake. Examination of major contemporary works by Weber and Werner Sombart – the obvious co-author – as well as the first public disclosure of an entirely new MS. by Weber, (...) show that in all probability the text was drafted by Sombart and then revised fairly lightly by Weber. This story of a combined, if unequal, authorship leads into two broader seams of intellectual history: the relationship between Weber and Sombart, and the history of the Archiv as a journal. An unusual starting point thus casts fresh and unexpected light on some of the most central figures and episodes in German social science at the beginning of the 20th century, not least Weber's seminal essay on “Objectivity” in social science. ☆ This paper relies on intellectual interchange and the generosity of colleagues to a quite unusual degree. The mechanisms invoked to demonstrate how self-deception can occur without intention or awareness imply that self-deceptive beliefs are nevertheless the outcome of inappropriate and often egoistically driven processes. In contrast, models of pragmatic reasoning suggest that self-deception may well be the “reasonable” output of a more generalized, adaptive approach to hypothesis testing.

Background Sharing anonymized/de-identified clinical trial data and publishing research outcomes in scientific journals, or presenting them at conferences, is key to data-driven scientific exchange. However, when data from scientific publications are linked to other publicly available personal information, the risk of reidentification of trial participants increases, raising privacy concerns. Therefore, we defined a set of criteria allowing us to determine and minimize the risk of data reidentification. We also implemented a review process at Takeda for clinical publications prior to submission (...) for publication in journals or presentation at medical conferences. Methods Abstracts, manuscripts, posters, and oral presentations containing study participant information were reviewed and the potential impact on study participant privacy was assessed. Our focus was on direct and indirect identifiers, such as sex, age or geographical indicators in rare disease studies or studies with small sample size treatment groups. Risk minimization was sought using a generalized presentation of identifier-relevant information and decision-making on data sharing for further research. Additional risk identification was performed based on study participant/personnel parameters present in materials destined for the public domain. The potential for participant/personnel identification was then calculated to facilitate presentation of meaningful but de-identified information. Results The potential for reidentification was calculated using a risk ratio of the exposed versus available individuals, with a value above the threshold of 0.09 deemed an unacceptable level of reidentification risk. We found that in 13% of Takeda clinical trial publications reviewed, either individuals could potentially be reidentified or inappropriate data sharing plans could pose a data privacy risk to study participants. In 1/110 abstracts, 58/275 manuscripts, 5/87 posters and 3/58 presentations, changes were necessary due to data privacy concerns/rules. Despite the implementation of risk-minimization measures prior to release, direct and indirect identifiers were found in 11% and 34% of the analysed documents, respectively. Conclusions Risk minimization using de-identification of clinical trial data presented in scientific publications and controlled data sharing conditions improved privacy protection for study participants. Our results also suggest that additional safeguards should be implemented to ensure that higher data privacy standards are met. (shrink)

In many ways, grief is thought to be outside the realm of bioethics and clinical ethics, and grieving patients or family members may be passed off to grief counselors or therapists. Yet grief can play a particularly poignant role in the ethical encounter, especially in cases of brain death, where the line between life and death has been blurred. Although brain death is legally and medically recognized as death in the United States and elsewhere, the concept has been contentious since (...) its inception in 1968. Yet in most cases, families are not allowed to reject the determination of brain death. Apart from religious exemptions, families have no recourse to reject this controversial determination of death. This paper explores the role of grief in brain death determinations and argues that bioethics has failed to address the complexity of grief in determinations of brain death. Grief ought to have epistemological weight in brain death determinations because of the contested nature of the diagnosis and the unique ways in which grief informs the situation. Thus, I argue that, in some rare cases, reasonable accommodation policies should be expanded to allow for refusals of brain death determinations based on the emotional and moral force of grief. By drawing on ethnographic accounts of grief in other cultures, I problematize the current procedural and linear understandings of grief in brain death determinations, and I conclude by offering a new way in which to understand the case of Jahi McMath.
