Ethical problems surrounding organ donation have been discussed since before technologies supported the procedure. In addition to issues on a societal level (e.g. brain-stem death, resource allocation), ethical concerns permeate the clinical practice of health care staff. These latter have been little studied. Using qualitative methods, this study, focused on transplant co-ordinators and their descriptions of dilemmas, ethical concerns and actions in response to them. Interviews with three co-ordinators in Japan and two in the UK revealed five areas in which (...) dilemmas occurred: aspects of discrimination; conditions placed on who should be the recipient and the related issues of directed donation; respect for a person's right to make a decision and the extent of information provided and understood by donors and recipients; potential issues of coercion, compensation and rewards in live-related and live-unrelated donations; and potential conflicts in duties. This study describes the dilemma areas revealed. Their meaning for co-ordinators will be presented in a subsequent report. (shrink)

Deeply informed by jazz as music and sociality, Fumi Okiji explores black movement of thought as marked by a failure to be adequately disturbed by contradiction. The tarrying with the negative so crucial to European critical theory cannot quite account for the exorbitance characteristic of black thought. This is an orientation that allows for an oversubscription of intention, sense, and logic, against the parsimony prized by the dialectical form. Attending to the black immoderation that registers as nonsense or deafening feedback (...) from the perspective of European thought, Okiji tunes in to moments ranging from the Haitian revolutionary forces' singing of "La Marseillaise" to Cecil Taylor's synesthetic poetics to the aporetic mien of the orisha Esu. She brings our attention to a galaxy of intimacies that flash up with such improvisatory and untimely thought. Extending the encounter between black study, Frankfurt School critical theory, and sound studies developed in Jazz as Critique, and drawing Yoruba aesthetics into this cluster, On Black Exorbitance is both a statement of non-citizenry and a preparation for practices of intoxication. This article explores Gerardus van der Leeuw’s view of phenomenology of religion. The phenomenological method he defended is basically a hermeneutical approach in which an observer relates personally and even existentially to the “phenomena” (s)he studies in order to determine their essence (Wesensschau). In his anthropology (that reflects on the basic structure of human beings) a similar way of relating to the world is discussed: the “primitive mentality” that is characterized by the “need to participate” (besoin de participation). Both phenomenology (...) and mentalité primitive imply a critique of modern scholarship. This fundamental criticism of the prevailing (historical) approach in the humanities including religious studies explains the growing distance between van der Leeuw and the majority of scholars of religion in the decades after his death in 1950. Many have claimed that education of the ethical issues raised by biotechnology is essential in universities, but there is little knowledge of its effectiveness. The focus of this paper is to investigate how university students assess the information given in class to make their own value judgments and decisions relating to issues of agricultural biotechnology, especially over genetically modified organisms (GMOs). Analysis of homework reports related with agricultural biotechnology after identification of key concepts and ideas in each student report is (...) presented. The ideas were sorted into different categories. The ideas were compared with those in the reading materials using the same categories. These categories included: concern about affects on humans, affects on the environment, developing countries and starvation, trust in industry, responsibility of scientists, risk perception, media influence, need for (international) organizations or third parties, and information dissemination. What was consistent through the different years was that more than half of the students took a “neutral” position. A report was scored as “neutral” when the report included both the positive and negative side of an issue, or when the student could not make a definite decision about the use of GMOs and GM food. While it may be more difficult to defend a strong “for” or “against” position, some students used logical arguments successfully in doing so. Sample comments are presented to depict how Japanese students see agricultural technology, and how they value its application, with comparisons to the general social attitudes towards biotechnology. This remarkable book--the fruit of almost two decades of study--traces in compelling fashion the changes in Western attitudes toward death and dying from the earliest Christian times to the present day. A truly landmark study, The Hour of Our Death reveals a pattern of gradually developing evolutionary stages in our perceptions of life in relation to death, each stage representing a virtual redefinition of human nature. Starting at the very foundations of Western culture, the eminent historian Phillipe Aries shows how, (...) from Graeco-Roman times through the first ten centuries of the Common Era, death was too common to be frightening; each life was quietly subordinated to the community, which paid its respects and then moved on. We think that it is important to develop a response that presents the traditional Orthodox Jewish position on these same issues in order to present an alternative, parallel system. There are many points of commonality between the Vatican document and traditional Jewish thought as well as several important issues where there is a divergence of opinion. The latter include (...) the status of the zygote as produced during in vitro fertilization, the acceptable of procreation in a method other than through the conjugal act, and the permissibility of deriving benefit from the products of an illicit act. Universities are increasingly part of wider geographical processes including international, national and sub-national actors. Universities now find themselves having to pay attention to many more political centres than before, as seen, for example, with research grants, assessments and teaching accreditation from transnational bodies, individual states and regional authorities. As an institution, the university constitutes a place which needs to be situated within a wider space and the geography of power-relations. This article traces these spatial developments in relation to recent policy (...) changes in the Japanese context. The current university reforms, set against the development of the globalising knowledge-based economy and regionalization of innovation policies, are examined in relation to the changing role of universities in multi-spacial innovation systems. Reasoning with the maximally consistent subsets of the premises is a well-known approach for handling contradictory information. In this paper we consider several variations of this kind of reasoning, for each one we introduce two complementary computational methods that are based on logical argumentation theory. The difference between the two approaches is in their ways of making consequences: one approach is of a declarative nature and is related to Dung-style semantics for abstract argumentation, while the other approach has a more (...) proof-theoretical flavor, extending Gentzen-style sequent calculi. The outcome of this work is a new perspective on reasoning with MCS, which shows a strong link between the latter and argumentation systems, and which can be generalized to some related formalisms. As a by-product of this we obtain soundness and completeness results for the dynamic proof systems with respect to several of Dung’s semantics. In a broader context, we believe that this work helps to better understand and evaluate the role of logic-based instantiations of argumentation frameworks. (shrink)

Treating pragmatics, semantics, and syntax in parallel and integrating insights from linguistics, psychology, and animal communication, Arie Verhagen develops a new understanding of linguistic communication. The notion of bilattice was introduced by Ginsberg, and further examined by Fitting, as a general framework for many applications. In the present paper we develop proof systems, which correspond to bilattices in an essential way. For this goal we introduce the notion of logical bilattices. We also show how they can be used for efficient inferences from possibly inconsistent data. In Part I of this series, we presented the microscopic approach to Souslin-tree constructions, and argued that all known ⋄-based constructions of Souslin trees with various additional properties may be rendered as applications of our approach. In this paper, we show that constructions following the same approach may be carried out even in the absence of ⋄. In particular, we obtain a new weak sufficient condition for the existence of Souslin trees at the level of a strongly inaccessible cardinal. We (...) also present a new construction of a Souslin tree with an ascent path, thereby increasing the consistency strength of such a tree's nonexistence from a Mahlo cardinal to a weakly compact cardinal. The main aim of this paper is to revisit the curve fitting problem using the reliability of inductive inference as a primary criterion for the ‘fittest' curve. Viewed from this perspective, it is argued that a crucial concern with the current framework for addressing the curve fitting problem is, on the one hand, the undue influence of the mathematical approximation perspective, and on the other, the insufficient attention paid to the statistical modeling aspects of the problem. Using goodness-of-fit as the (...) primary criterion for ‘best', the mathematical approximation perspective undermines the reliability of inference objective by giving rise to selection rules which pay insufficient attention to ‘accounting for the regularities in the data'. A more appropriate framework is offered by the error-statistical approach, where (i) statistical adequacy provides the criterion for assessing when a curve captures the regularities in the data adequately, and (ii) the relevant error probabilities can be used to assess the reliability of inductive inference. Broadly speaking, the fittest curve (statistically adequate) is not determined by the smallness if its residuals, tempered by simplicity or other pragmatic criteria, but by the nonsystematic (e.g. white noise) nature of its residuals. Longer-term developments shape the present and endogenous futures of institutions and practices of science and technology in society and their governance. Understanding the patterns allows diagnosis and soft intervention, often linked to scenario exercises. Paradefinite logics are logics that can be used for handling contradictory or partial information. As such, paradefinite logics should be both paraconsistent and paracomplete. In this paper we consider the simplest semantic framework for introducing paradefinite logics. It consists of the four-valued matrices that expand the minimal matrix which is characteristic for first degree entailments: Dunn–Belnap matrix. We survey and study the expressive power and proof theory of the most important logics that can be developed in this framework.

A recent commentary defends 1) the concept of 'brain arrest' to explain what brain death is, and 2) the concept that death occurs at 2–5 minutes after absent circulation. I suggest that both these claims are flawed. Brain arrest is said to threaten life, and lead to death by causing a secondary respiratory then cardiac arrest. It is further claimed that ventilation only interrupts this way that brain arrest leads to death. These statements imply that brain arrest is not death (...) itself. Brain death is a devastating state that leads to death when intensive care, which replaces some of the brain's vital functions such as breathing, is withdrawn and circulation stops resulting in irreversible loss of integration of the organism. Circulatory death is said to occur at 2–5 minutes after absent circulation because, in the context of DCD, the intent is to not attempt reversal of the absent circulation. No defense of this weak construal of irreversible loss of circulation is given. This means that paents in identical physiologic states are dead (in the DCD context) or alive (in the resuscitation context); the current state of death (at 2–5 minutes) is contingent on a future event (whether there will be resuscitation) suggesting backward causation; and the commonly used meaning of irreversible as 'not capable of being reversed' is abandoned. The literature supporting the claim that autoresuscitation does not occur in the context of no cardiopulmonary resuscitation is shown to be very limited. Several cases of autoresuscitation are summarized, suggesting that the claim that these cases are not applicable to the current debate may be premature. I suggest that brain dead and DCD donors are not dead; whether organs can be harvested before death from these patients whose prognosis is death should be debated urgently. (shrink)

Brain death is accepted in most countries as death. The rationales to explain why brain death is death are surprisingly problematic. The standard rationale that in brain death there has been loss of integrative unity of the organism has been shown to be false, and a better rationale has not been clearly articulated. Recent expert defences of the brain death concept are examined in this paper, and are suggested to be inadequate. I argue that, ironically, these defences demonstrate the lack (...) of a defensible rationale for why brain death should be accepted as death itself. If brain death is death, a conceptual rationale for brain death being equivalent to death should be clarified, and this should be done urgently. (shrink)

This article calls into question the charge that frequentist testing is susceptible to the base-rate fallacy. It is argued that the apparent similarity between examples like the Harvard Medical School test and frequentist testing is highly misleading. A closer scrutiny reveals that such examples have none of the basic features of a proper frequentist test, such as legitimate data, hypotheses, test statistics, and sampling distributions. Indeed, the relevant error probabilities are replaced with the false positive/negative rates that constitute deductive calculations (...) based on known probabilities among events. Maximality is a desirable property of paraconsistent logics, motivated by the aspiration to tolerate inconsistencies, but at the same time retain from classical logic as much as possible. In this paper we introduce the strongest possible notion of maximal paraconsistency, and investigate it in the context of logics that are based on deterministic or non-deterministic three-valued matrices. We show that all reasonable paraconsistent logics based on three-valued deterministic matrices are maximal in our strong sense. This applies to practically all three-valued (...) paraconsistent logics that have been considered in the literature, including a large family of logics which were developed by da Costa's school. Then we show that in contrast, paraconsistent logics based on three-valued properly nondeterministic matrices are not maximal, except for a few special cases (which are fully characterized). However, these non-deterministic matrices are useful for representing in a clear and concise way the vast variety of the (deterministic) three-valued maximally paraconsistent matrices. The corresponding weaker notion of maximality, called premaximal paraconsistency, captures the "core" of maximal paraconsistency of all possible paraconsistent determinizations of a non-deterministic matrix, thus representing what is really essential for their maximal paraconsistency. The public sphere, be it the Greek agora or the New York Times op-ed page, is the realm of appearances - not citizenship. Its central event is spectacle - not dialogue. Public dialogue, the mantra of many intellectuals and political commentators, is but a contradiction in terms. Marked by an asymmetry between the few who act and the many who watch, the public sphere can undermine liberal democracy, law, and morality. Inauthenticity, superficiality, and objectification are the very essence of the (...) public sphere. But the public sphere also liberates us from the bondages of private life and fosters an existentially vital aesthetic experience. Reign of Appearances uses a variety of cases to reveal the logic of the public sphere, including homosexuality in Victorian England, the 2008 crash, antisemitism in Europe, confidence in American presidents, communications in social media, special prosecutor investigations, the visibility of African-Americans, violence during the French Revolution, the Islamic veil, and contemporary sexual politics.
