La juridicisation croissante de notre vie publique et le fonctionnement de l'Etat de droit ont rendu nécessaire de reposer la question des modes de raisonnement fondant désormais les décisions judiciaires, de plus en plus importantes, de plus en plus nombreuses, qui régissent notre activité quotidienne. L'enjeu n'en est pas négligeable. Au-delà d'une vision "technologique" du droit - le droit, une technique, un outil... -, c'est aussi, et de manière peut-être plus inquiétante, une vision plus politique qui en est souvent suggérée (...) : la mort annoncée du droit comme technique autonome, capable de résister au politique - simple habillage, habile camouflage, d'une décision dont la motivation ne serait jamais - ne pourrait jamais être - mise en échec, orientée, ou commandée par les contraintes du droit. Entre positivisme et réalisme, l'oscillation risque d'être catastrophique. Entre ces deux abîmes, cet ouvrage tente d'ouvrir les voies d'une réflexion rigoureuse et scientifique sur les moyens intellectuels les plus nécessaires à l'affirmation - et à l'affermissement - de l'Etat de droit. For Dōgen, the Buddhist doctrine of “no self” ultimately presents the self as contextualized. The self is for him not an independent entity, but is intricately related to its environment, determined through the many beings around it. In a quite different philosophical setting, Spinoza developed similar ideas. While Dōgen challenged the specifics of a tradition that explicitly argues against the idea of an absolute self, Spinoza faced a more radical challenge: questioning an absolute, unchanging, and free self that the Western (...) tradition has mostly taken for granted. After an analysis of the ideas of the two thinkers, the essay presents some important implications for contemporary times. Our domination of the earth and one another is arguably rooted in the individualism Dōgen and Spinoza seek to overcome. The insight that we are contextualized is a first step toward re-determining ourselves as placed within a larger whole. (shrink)

Cette contribution fait le point sur ce qui, de Schelling, a pu s’infiltrer dans la Recherche du temps perdu, via Gabriel Séailles, et en particulier son Essai sur le génie dans l’art que Proust avait lu attentivement. Elle éclaire les deux versants de cette possible médiation, d’une part quant au rapport entre l’Essai et la philosophie schellingienne ; d‘autre part, quant au rapport entre l’Essai et ce qui s’en diffuse dans Proust, en particulier dans Le Temps retrouvé. L’enquête montre que (...) si Séailles a lu le Schelling de son temps, le philosophe transcendantal de l’Identité et de l’art ; et que si Proust a lu Séailles, il ne s’en suit nullement que Proust fût « schellingien ». Entre Schelling, celui de la philosophie médiane et tardive, et Proust – une rencontre a lieu qui n’est pas de l’ordre d’une influence attestable, mais d’une affinité profonde autour de thèmes aussi décisifs que la sensation, l’involontaire, le réel et le temps. L’article examine le problème des restrictions qu’il faut apporter à la loi des trois états : la loi du développement de l’esprit est-elle valable à tous les degrés de l’échelle hiérarchique? Ou bien la mathématique fait-elle exception à la loi historique? La réponse apportée par Brentano est assez surprenante et semble même contradictoire. Dans certains textes, il soutient que la mathématique est soumise au même régime que les autres branches du savoir ; et que si restriction il y a, ces (...) restrictions doivent être pensées avec Comte, et non pas contre lui. Dans d’autres textes, Brentano semble se ranger à la position critique de J. S. Mill. Comment concilier ces affirmations apparemment contradictoires? On se propose de répondre à cette question en montrant que la position de Brentano a évolué au tournant des années 1870, et en indiquant le rôle de la nouvelle classification des sciences dans cette évolution. This contribution to the Common Knowledge symposium “Fuzzy Studies” argues, on the basis of recent research, that religious polemic is a phenomenon closely associated only with monotheist traditions. Focusing on religious polemics in medieval and early modern Islamic and Christian Spain, it analyzes polemical texts of diverse natures and from different centuries to see how their authors, by attacking both dogmatic and legal opinion, aimed to harden the amorphous boundaries between groups. On the Christian side, polemicists argued for the restriction (...) of the rights of Muslims and Jews in Christian territories, or for the outright expulsion or conversion of these groups. On the Islamic side, a number of Muslim authors voiced the claim that Muslims should emigrate from Christian territories. The article seeks to show how these polemical voices argued against known opponents but also against anonymous Christians, Muslims, and Jews who, untouched by such polemics, had lived close to one another and, without conflict, had accepted the undefined character of their daily life together. In support of this argument, the author makes use of hitherto unknown archival documents regarding how adherents of the three religions interacted in medieval Christian Spain. (shrink)

Utopia repeatedly sets forth the rhetorical strategy of using pleasant and healing words to “enter” or “flow” or “steal into” fortresses of hardened opinion and custom without arousing warlike passions to keep them out. An important part of this strategy is the creation of a character who denounces major instances and causes of injustice but who nonetheless supports war and other means of force at the expense of law in rectifying that injustice; another part of the strategy is the creation (...) of a character and a plot that embody the “indirect” rhetorical approach aimed primarily at long-term persuasion needed to improve laws and institutions. Este artículo tiene por objeto dar una versión diferente y más breve del poema que contiene una demanda morisca de ayuda al Imperio Otomano, poema estudiado por James Monroe en Al-Andalus XXXI, 281-303. Esta versión indica que había habido otra demanda similar por parte de los moriscos al sultán mameluco de El Cairo, y que ésta era la original. El artículo contiene: 1) un análisis comparativo de las versiones de la casida dirigidas a los mamelucos y a los otomanos, 2) (...) el marco histórico de las relaciones entre los reinos cristianos y musulmanes de la Península Ibérica por un lado y los territorios mameluco y otomano por otro, y 3) una discusión de la fecha de las dos versiones de la casida, así como su autoría. Parece probable que el autor de la casida perteneciera a círculos de musulmanes granadinos que habían formado parte de las clases dirigentes de Granada y que luego habían aceptado puestos en la administración cristiana de la ciudad, como son, por ejemplo, varios miembros de la familia al-Baqannī, algunos de los cuales habían emigrado con Ibn al-Azraq al Norte de África, pero regresaron para integrarse en los grupos dirigentes mudéjares. El trabajo expone, analiza, y evalúa los datos de una nueva fuente sobre las visiones jurídicas de los ‛ulamā’ con respecto al estatuto islámico de las comunidades islámicas bajo dominio cristiano en la Península Ibérica desde el siglo XII hasta el siglo XVI. Se trata de una fetua desconocida e inédita del sabio andalusí Ibn Rabī‛ y fetuas desconocidas de los principales cadíes de los cuatro madhabs sunníes en El Cairo hacia 1510 A.D. Muy probablemente, hay que relacionar la primera (...) fetua con los acontecimientos en Murcia tras la sublevación mudejar de 1265 y la reconquista cristiana de la ciudad en 1266. El muftí subraya que los musulmanes que viven bajo dominio cristiano están imperativamente obligados a emigrar a territorio islámico. Los principales cadíes de los cuatro madhabs sunníes en El Cairo al principio del siglo XVI, sin embargo, defienden un modo de ver mucho más pragmático. Probablemente, las preguntas fueron planteadas por mudejares de Valencia, que estaban en El Cairo camino de la peregrinación. Finalmente, los autores plantean que hay que distinguir dos tipos coexistentes de visiones con respecto al estatuto del Islam bajo dominio cristiano en la Península Ibérica desde principios del siglo xii; una visión pragmática, equivalente a un reconocimiento de facto del Islam bajo dominio cristiano, y una visión «de rechazo», que asume la obligación de emigrar de la España cristiana a Dār al-Islām. El impacto variable de estas visiones jurídicas merece un estudio más profundo dentro del ambiente histórico de las complejas y cambiantes relaciones políticas entre Islam y Cristiandad en esa época. Este artículo está dedicado al famoso pergamino encontrado en 1588 en el antiguo minarete de la que había sido mezquita aljama de Granada, con textos en árabe, latín y castellano. Junto con los libros plúmbeos descubiertos en diversas cuevas a las afueras de la ciudad entre 1595 y 1600, el pergamino está en los orígenes de un importante culto nacional. El artículo presenta un análisis de la composición y escritura del pergamino y pasa revista a las trascripciones y traducciones que (...) se hicieron por testigos cristianos y musulmanes . Éstas se comparan críticamente con los principales elementos del pergamino y se discuten los comentarios paleográfícos hechos por estos testigos contemporáneos . Como conclusión, los autores mantienen que el documento transferido desde el Vaticano en el año 2000, es el original encontrado en 1588 a pesar de lo incomprensible de los textos árabes y de la corrupción de los textos castellano y latino Según los autores, no hay base para considerar al pergamino como documento proto-islámico, puesto que se trata de un mensaje católico romano anunciando la destrucción del islam. Al mismo tiempo, el documento incluye un mensaje simbólico al mostrar que los cristianos granadinos del siglo I, incluyendo a Cecilius, escribían árabe y castellano, lo mismo que hacían los moriscos. Así, aunque el Islam había de ser extirpado, la lengua árabe se podía armonizar con una vida genuinamente cristiana. (shrink)

Daniel Robinson suggests that much of the civil and criminal law "serves as the institutionalized form of praise and blame". Indeed it does. Pulling at this thread of Robinson's tapestry leads the reader straightaway to a host of truths about how law and morality not only intersect, but work together in harmony. "[L]aw", Robinson says, is a "vivid expression of deeper and impenetrably complex moral theories". This essay explores several of these harmonies, but focuses on two. One is that political (...) society must be seen as the cooperation of free persons according to law, which persons hold common moral understandings. The second has to do with retribution as the moral justifying aim of punishing criminals. I survey some important semantical and axiomatic theories of self-referential truth. Kripke's fixed-point theory, the revision theory of truth and appraoches involving fuzzy logic are the main examples of semantical theories. I look at axiomatic theories devised by Cantini, Feferman, Freidman and Sheard. Finally some applications of the theory of self-referential truth are considered.

This paper focuses on how the practitioners of the exact and natural sciences can make a contribution to the project of the social sciences to break free of a reductive Eurocentrism in order to achieve a renewed universalism. Focusing in particular on the last 50 years, the paper: a) describes the 1955–60 turning point that can be perceived in techno-scientific development and its relationship with society; b) analyzes technical developments under the two modes of gigantism and miniaturization, putting them in (...) close relation with the political evolution of the world (Cold War and post-Cold War era) as well as with the phenomena of divergence/convergence among disciplines; c) explains the 'ethical movement in science' namely by introducing the idea of moral revaluation defined by similarity/contrast with the older and now well-accepted concept of scientific revolution; and d) sketches a typology of the scientific community's varied responses to the growing social protests around topics such as nuclear installations, health crises, genetically modified organisms, nanotechnologies and so on. Board oversight of community benefit constitutes an ethical imperative for nonprofit health care organizations. Compared with the Greek and Latin fields, the systematic study of the concept of textual criticism in classical India has made little progress, despite the quality of work produced by specialists. And yet research of this nature would probably lead, paradoxically, to a clearer formulation of the aims and methods of modern critical editions of Indian texts.
