BackgroundA requisite for ethical human subjects research is that participation should be informed and voluntary. Participation during the informed consent process by way of asking questions is an indicator of the extent to which consent is informed.AimsThe aims of this study were to assess the extent to which parents providing consent for children's participation in an observational tuberculosis (TB) research study in India actively participated during the informed consent discussion, and to identify correlates of that participation.MethodsIn an observational cohort study (...) of tuberculosis in infants in South India, field supervisors who were responsible for obtaining informed consent noted down questions asked during the informed consent discussions for 4,382 infants who were enrolled in the study. These questions were post-coded by topic. Bivariate and multivariate analysis was conducted to examine factors associated with asking at least one question during the informed consent process.ResultsIn total, 590 out of 4,382 (13.4%) parents/guardians asked any question during the informed consent process. We found that the likelihood of parents asking questions during the informed consent process was significantly associated with education level of either parent both parents being present, and location.ConclusionsThe findings have implications for planning the informed consent process in a largely rural setting with low levels of literacy. Greater effort needs to be directed towards developing simple participatory communication materials for the informed consent process. Furthermore, including both parents in a discussion about a child's participation in a research study may increase the extent to which consent is truly informed. Finally, continuing efforts need to be made to improve the communication skills of research workers with regard to explaining research processes and putting potential research participants at ease. The practice of HIV‐infected physicians who perform seriously invasive procedures calls for professional guidance to protect patient safety and the privacy of infected physicians.

I discuss the interpretation of a recent experiment showing quantum interference in time. It is pointed out that the standard nonrelativistic quantum theory does not have the property of coherence in time, and hence cannot account for the results found. Therefore, this experiment has fundamental importance beyond the technical advances it represents. Some theoretical structures which consider the time as an observable, and thus could, in principle, have the required coherence in time, are discussed briefly, and the application of Floquet (...) theory and the manifestly covariant quantum theory of Stueckelberg are treated in some detail. In particular, the latter is shown to account for the results in a simple and consistent way. (shrink)

In 1991, the CDC recommended that health care workers (HCWs) infectedwith HIV or HBV (HbeAg positive) should be reviewed by an expert paneland should inform patients of their serologic status before engaging inexposure-prone procedures. The CDC, in light of the existing scientificuncertainty about the risk of transmission, issued cautiousrecommendations. However, considerable evidence has emerged since 1991suggesting that we should reform national policy. The data demonstratesthat risks of transmission of infection in the health care setting areexceedingly low. Current policy, moreover, does (...) not improve patientsafety. At the same time, implementation of current national policy atthe local level poses significant human rights burdens on HCWs.Consequently, national policy should be changed to ensure patient safetywhile protecting the human rights of HCWs. This article proposes a newnational policy, including: (1) a program to prevent bloodborne pathogentransmission; (2) a responsibility placed on infected HCWs to promotetheir own health and well-being and to assure patient safety; (3) adiscontinuation of expert review panels and special restrictions forexposure-prone procedures; (4) a discontinuation of mandatorydisclosure of a HCW's inflection status; and (5) the imposition ofpractice restrictions if a HCW is unable to practice safely because of aphysical or mental impairment or failure to follow careful infectioncontrol techniques. A new national policy, focused on management of theworkplace environment and injury prevention, would achieve high levelsof patient safety without discrimination and invasion of privacy. (shrink)

In this chapter, I embrace Jeff Goldsworthy’s conclusion that Ronald Dworkin was an originalist regarding the meaning of canonical legal texts. I briefly examine the evidence for that claim, and I ask how its truth affects Dworkin’s fit-acceptability account of the nature of law. In a brief digression, I present a broad-brush view of the jurisprudential debate between legal positivists and natural lawyers. I then explain why the natural law view must fail and why legal positivists must make an unpalatable (...) choice between a gunman model and a model based on deception. Finally, I situate and explain Dworkin’s third-way jurisprudence and its fatal flaws. I conclude by explaining how devastating Dworkin’s originalism is for his third-way jurisprudential view that law consists of those principles that best justify the community’s past and present coercive political decisions. In order to understand the animal rights movement as it exists today in American society, it is necessary to explore the ways in which the beliefs of those who support the movement differ from the beliefs of their adversaries. Societal views generally determine the perceived differences and similarities between people and animals, and the issues surrounding these differences are fundamental to the animal rights controversy.

This ambitious and lively book argues for a rehabilitation of the concept of 'human needs' as central to politics and political theory. Although now replaced by more modern theories, classical mechanics remains a core foundational element of physical theory. From its inception, the theory of dynamics has been riddled with conceptual issues and differing philosophical interpretations and throughout its long historical development, it has shown subtle conceptual refinement. The interpretive program for the theory has also shown deep evolutionary change over time. Lawrence Sklar discusses crucial issues in the central theory from which contemporary foundational theories are derived and shows how some (...) core issues have nevertheless remained deep puzzles despite the increasingly sophisticated understanding of the theory which has been acquired over time. The world is complex, dynamic, multidimensional; the paper is static, flat. How are we to represent the rich visual world of experience and measurement on mere flatland?

Grounded cognition offers a natural approach for integrating Bayesian accounts of optimality with mechanistic accounts of cognition, the brain, the body, the physical environment, and the social environment. The constructs of simulator and situated conceptualization illustrate how Bayesian priors and likelihoods arise naturally in grounded mechanisms to predict and control situated action.

:Within the literature surrounding nonhuman animals on the one hand and cognitively disabled humans on the other, there is much discussion of where beings that do not satisfy the criteria for personhood fit in our moral deliberations. In the future, we may face a different but related problem: that we might create beings that not only satisfy but exceed these criteria. The question becomes whether these are minimal criteria, or hierarchical, such that those who fulfill them to greater degree should (...) be afforded greater consideration. This article questions the validity and necessity of drawing divisions among beings that satisfy the minimum requirements for personhood; considering how future beings—intelligent androids, synthezoids, even alternate-substrate sentiences—might fit alongside the “baseline” human. I ask whether these alternate beings ought to be considered different to us, and why this may or may not matter in terms of a notion of “human community.” The film Blade Runner, concerned in large part with humanity and its key synthezoid antagonist Roy Batty, forms a framing touchstone for my discussion. Batty is stronger, faster, more resilient, and more intelligent than Homo sapiens. His exploits, far beyond the capability of normal humans, are contrasted with his frailty and transient lifespan, his aesthetic appreciation of the sights he has seen, and his burgeoning empathy. Not for nothing does his creator within the mythos term him “more human than human.”. (shrink)

Should the nation provide expensive care and scarce organs to convicted felons? We distinguish between two fields of justice: Medical Justice and Societal Justice. Although there is general acceptance within the medical profession that physicians may distribute limited treatments based solely on potential medical benefits without regard to nonmedical factors, that does not mean that society cannot impose limits based on societal factors. If a society considers the convicted felon to be a full member, then that person would be entitled (...) to at least a decent minimum level of care — which might include access to scarce life-saving organs. However, if criminals forfeit their entitlement to the same level of medical care afforded to all members of society, they still would be entitled to a kind of rudimentary decent minimum granted to all persons on simple humanitarian grounds. Almost certainly this entitlement would not include access to organ transplants. (shrink)

Few modern artists so consistently embodied a fuzzy logic of their own as did the Indian painter Maqbool Fida Husain (1915 – 2011). His critics tried to define him as a reckless defamer of Hindu values, but another way to define him is as a dutiful devotee of a vision that was inclusive, rather than exclusive, and that understood all boundaries and identities as fluid or blurry, rather than as fixed and immutable. Or one might say that Husain strove to (...) project what Ashis Nandy has called “Indian-style secularism,” celebrating creation, humanity, and beauty in the multiple religious forms of the subcontinent. Having lived and painted in India all his life, he was forced into exile in his nineties by right-wing Hindu politicians. In London, he continued to work on a new interpretation of Indian civilization as universally relevant, in a sequence of paintings with themes from the Mahabharata, while, in Doha, a royal patron commissioned him to paint a series relating Islamic and Christian civilization. The two series are shown, in this essay, to best exhibit Husain's view of “all distinctions” as “political, artificial.”. (shrink)

The coauthors of this dialogue, a surgeon and an internist, work together on an institutional patient selection committee for transplantation of solid organs. They have observed a spectrum of outcomes of organ transplantation, mostly favorable, at several institutions.
