This paper examines the effectiveness of the use of executive compensation linked to Corporate Social Responsibility (CSR) goals across US firms. Empirical analysis of a cross-industry sample of 746 listed companies for the period 2002–2013 showed that the use of CSR-linked compensation contracts for Named Executive Officers (NEOs) promotes CSR performance. More specifically, we found that linking NEOs’ compensation to CSR goals produces positive effects in the 3rd year after adoption. As firms accumulate experience and learn how to use the (...) system over the following eight periods, CSR performance increases monotonically. Furthermore, experience accumulated over time affects the different specifications of CSR performance asymmetrically, by reducing both environmental and social CSR concerns and increasing only environmental CSR strengths. Interestingly, we also found that the simultaneous use of other CSR-focused governance systems moderates the effect of a firm’s accumulated experience in using CSR-linked executive compensation on CSR performance: the existence of a CSR committee at the board level and the public release of a CSR report are likely to have a positive moderating effect, while the purchase of a CSR audit has no moderating effect. The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. . I will argue that the concept of law is a normative notion, irreducible to any factual description. Its conceptual function is that of relating certain properties a norm may possess to the conclusion that the norm is legally binding, namely, that it deserves to be endorsed and applied in legal reasoning. Legal validity has to be distinguished from other, more demanding, normative ideas, such as moral bindingness or legal optimality.

In his writings about hypergeometric functions Gauss succeeded in moving beyond the restricted domain of eighteenth-century functions by changing several basic notions of analysis. He rejected formal methodology and the traditional notions of functions, complex numbers, infinite numbers, integration, and the sum of a series. Indeed, he thought that analysis derived from a few, intuitively given notions by means of other well-defined concepts which were reducible to intuitive ones. Gauss considered functions to be relations between continuous variable quantities while he (...) regarded integration and summation as appropriate operations with limits. He also regarded infinite and infinitesimal numbers as a façon de parler and used inequalities in order to prove the existence of certain limits. He took complex numbers to have the same legitimacy as real quantities. However, Gauss’s continuum was linked to a revised form of the eighteenth-century notion of continuous quantity: it was not reducible to a set of numbers but was immediately given. (shrink)

Rational beliefs and actions are typically evaluated against certain benchmarks, e.g., those of classical logic or probability theory. Rationality therefore is traditionally taken to involve some sort of reasoning, which in turn implies contentful cognition. Radically Enactive views of Cognition, on the other hand, claim that not all cognition is contentful. In order to show that rationality does not need to lie outside of REC’s scope of radicalizing cognition, I develop a Radically Enactive notion of Rationality, according to which rationality (...) is embodied, situated and contentless. For RER, an organism acts rationally insofar as it sustains a proficient interaction with its environment, which in turn requires the coordination of cognitive abilities in accordance with environmental constraints. Rationality is thus distinguished from reasoning, for reasoning is understood as a capacity to coordinate representational cognitive abilities. (shrink)

This paper intends to offer a critical evaluation of the role played by intuitions in the mainstream methodology in traditional analytic epistemology. The criticism directed to what I call methodology of evaluation by intuitions shows that epistemologists often idealize the reliability of intuitions when assessing a theory against potential counterexamples, ignoring that the disposition to answer intuitively to a case of concept attribution is bounded to the familiar dimension in which the relevant conceptual competence emerges. Thus, the reliability of intuitions (...) does not necessarily extend to far-fetched cases. Given that the assessment by our intuitions is not sufficient to decide for or against an epistemological theory, I offer a sketch for a pragmatic and naturalized conception of theoretical decision-making in epistemology.Key-words: Intuitions, Analytic epistemology, Conceptual abilities, Naturalism, Pragmatism. Euler developed a program which aimed to transform analysis into an autonomous discipline and reorganize the whole of mathematics around it. The implementation of this program presented many difficulties, and the result was not entirely satisfactory. Many of these difficulties concerned the integral calculus. In this paper, we deal with some topics relevant to understand Euler’s conception of analysis and how he developed and implemented his program. In particular, we examine Euler’s contribution to the construction of differential equations and his (...) notion of indefinite integrals and general integrals. We also deal with two remarkable difficulties of Euler’s program. The first concerns singular integrals, which were considered as paradoxical by Euler since they seemed to violate the generality of certain results. The second regards the explicitly use of the geometric representation and meaning of definite integrals, which was gone against his program. We clarify the nature of these difficulties and show that Euler never thought that they undermined his conception of mathematics and that a different foundation was necessary for analysis. (shrink)

This paper offers a conceptual framework which (re)integrates goal-directed control, motivational processes, and executive functions, and suggests a developmentalpathway from situated action to higher level cognition. We first illustrate a basic computational (control-theoretic) model of goal-directed action that makes use of internalmodeling. We then show that by adding the problem of selection among multiple actionalternatives motivation enters the scene, and that the basic mechanisms of executivefunctions such as inhibition, the monitoring of progresses, and working memory, arerequired for this system to (...) work. Further, we elaborate on the idea that the off-line re-enactment of anticipatory mechanisms used for action control gives rise to (embodied)mental simulations, and propose that thinking consists essentially in controlling mental simulations rather than directly controlling behavior and perceptions. We concludeby sketching an evolutionary perspective of this process, proposing that anticipationleveraged cognition, and by highlighting specific predictions of our model. (shrink)

Much of the recent philosophical debate on causation and causal explanation in the biological and biomedical sciences has focused on the notion of mechanism. Mechanisms, their nature and epistemic roles have been tackled by a range of so-called neo-mechanistic theories, and widely discussed. Without denying the merits of this approach, our paper aims to show how lately it has failed to give proper credit to processes, which are central to the field, especially of contemporary molecular biology. Processes can be summed (...) up in the notion of ‘pathway’, which is far from being just equivalent to that of ‘mechanism’ and has a profound epistemological and explanatory relevance. It is argued that an adequate consideration of pathways impels some rethinking of scientific explanation in molecular biology, namely its functional and contextual features. A number of examples are given to suggest that the focus of philosophical attention in this disciplinary field should shift from the notion of mechanism to the notion of pathway. (shrink)

Definition of the problem Medical ethics is increasingly faced with issues that result from power asymmetries and epistemic injustice. However, medical ethics lacks the epistemic lenses for analyzing these social context factors of clinical practice. A theoretical and conceptual reconfiguration is necessary in order to be able to address these issues. Arguments This paper discusses the foundations of critical medical ethics, which takes perspectives and epistemic categories from critical theories. This includes the Critical Theory of the Frankfurt School as well (...) as those approaches from social sciences and cultural studies that reflect on power asymmetries. By drawing on these theories, the epistemic spectrum of medical ethics could be broadened in order to better include real power relations into normative analyses. The paper starts by outlining the contribution of social sciences to empirical medical ethics. This shows that an empirical approach as such cannot bridge the epistemic gap. In a further step, epistemic lenses and concepts from critical theories are discussed, such as Critical Theory of the Frankfurt School, feminist approaches, postcolonial approaches, queer theory, gender studies, and science and technology studies (STS). The conclusion sums up the foundations of critical medical ethics and discusses its limitations. Conclusion Critical medical ethics possesses the epistemic categories and broader social perspective needed to address issues in medicine that result from power asymmetries and epistemic injustice in society. The author investigates the origin and development of the concept of liberty and its special meaning in the Republican tradition of political thought. The origin of the Western concept of liberty lies in ancient Greece, in the opposition between liberty and slavery conceived after the liberation of Athens from tyranny and the victory over the Persian empire. The author then investigates the Republican notion of liberty that originates in ancient Rome and reaches its peak with Cicero. This conception of liberty (...) emphasizes self-government and partecipation in common deliberation and runs through Western political thought up to Rousseau, Tocqueville and the authors of the Federalist Papers. Not many studies have focused on the analysis of the rhetorical organization of a genre and the respective frequency of occurrence of moves and steps as they occur in a corpus across disciplines – particularly, with a complementary qualitative-quantitative approach. This article aims to become a step in helping to fill this gap in research on Spanish. In this way, the textbook genre, the occurrence of its rhetorical macro-moves, moves and steps and disciplinarity are the central focus of this study. (...) More specifically, in this article we seek to determine and to compare the frequency of occurrence of macro-moves, moves and steps in a corpus of 126 university textbooks across the academic discourse of four disciplines. We distinguish the major areas of knowledge as well as the specific disciplines. The main findings show there are differences between the occurrence of some discourse moves and steps across the texts of disciplines under study, which reveals a distinctive feature in the didactic component of textbooks. So we can infer that knowledge construction process through this genre is not carried out in the same way and that disciplinarity plays an important role in the diversifying organizational discourse patterns detected. The search for a synthesis between formalism and constructivism, and meditation on Gödel incompleteness, leads in a natural way to conceive mathematics as dynamic and plural, that is the result of a human achievement, rather than static and unique, that is given truth. This foundational attitude, called dynamic constructivism, has been adopted in the actual development of topology and revealed some deep structures that had remained hidden under other views. In recent years, the biomedical field has witnessed the emergence of novel tools and modelling techniques driven by the rise of the so-called Big Data. In this paper, we address the issue of predictability in biomedical Big Data models of cancer patients, with the aim of determining the extent to which computationally driven predictions can be implemented by medical doctors in their clinical practice. We show that for a specific class of approaches, called k-Nearest Neighbour algorithms, the ability to draw (...) predictive inferences relies on a geometrical, or topological, notion of similarity encoded in a well-defined metric, which determines how close the characteristics of distinct patients are on average. We then discuss the conditions under which the relevant models can yield reliable and trustworthy predictive outcomes. (shrink)

In particolare, l’importanza inedita assegnata alla convenienza di proporzionalità nelle Quaestiones disputatae de veritate ha suscitato un dibattito secolare, che oppone quanti riconoscono in questa soluzione la dottrina autentica a coloro che la valutano meramente come uno stadio provvisorio all’interno di un’evoluzione riscontrabile nelle opere di Tommaso. Nel presente contributo (...) si intende segnalare alcuni dati testuali che aiutano a chiarire il passaggio dalla concezione dell’analogia presentata nello Scriptum super sententiis a quella del De veritate, un passaggio strettamente legato alla funzione euristica svolta dall’analogia. The attempts made within the Thomist tradition to identify the official doctrine of analogy elaborated by Thomas Aquinas had to deal with the various distinctions drawn by Aquinas in his writings. In particular, the great importance given to the agreement of proportionality in the Quaestiones disputatae de veritate has elicited a long debate, in which those who consider such a solution as the authentic doctrine are opposed to those who see it merely as a temporary stage of an evolution which could be observed in Thomas’s works. The aim of this essay is to present some textual data that contribute to clarify the transition from the analogy as conceived in the Scriptum super Sententiis to that of the De veritate, a transition closely related to the heuristic function of analogy.
