We examine the relationship between scientific knowledge and the legal system with a focus on the exclusion of expert testimony from trial as ruled by the Daubert standard in the US.We introduce a simple framework to understand and assess the role of judges as “gatekeepers”, monitoring the admission of science in the courtroom. We show how judges face a crucial choice, namely, whether to limit Daubert assessment to the abstract reliability of the methods used by the expert witness or also (...) to check whether the application of those methods was correct. Undesirable outcomes result from both choices, thereby giving rise to the “gatekeeper’s dilemma.” We illustrate the dilemma by analyzing in some detail two well-known cases of Daubert challenges to economic experts. Finally, we present reasons for the absence of straightforward solutions to the dilemma and for its likely endurance. (shrink)

Bioethics should pay more attention to globalization and some of its consequences than it has done so far. The COVID-19 pandemic would not have been possible without globalization, which has also increased some of its negative consequences. Globalization has intensified wildlife trade in the world. One of the main hypotheses about the origin of this pandemic is that it originated in illegal forms of wildlife trade in China. In the last 30 or 40 years, there have been zoonotic outbreaks at (...) a much frequent pace than before, many of those have been related to wildlife trade. Legal and illegal wildlife trade has grown in the shadow of globalization. Second, globalization has had a huge impact on the redistribution of wealth in the world. Since 1990 income inequality has increased in most high- and in many middle- and low-income countries. A country’s level of pre-COVID income inequality is the best predictor of the COVID death rate. These two issues are not unrelated. People living in poverty in LMIC tend to suffer more from infectious diseases and tend to be marginalized from the health sector. Additionally, poverty tends to reproduce the conditions under which zoonotic diseases can more easily spread. (shrink)

We present a fully relational definition of inertial systems based in the No Arbitrariness Principle, that eliminates the need for absolute inertial frames of reference or distinguished reference systems as the ``fixed stars'' in order to formulate Newtonian mechanics. The historical roots of this approach to mechanics are discussed as well. The work is based in part in the constructivist perspective of space advanced by Piaget. We argue that inertial systems admit approximations and that what is of practical use are (...) precisely such approximations. We finally discuss a slightly larger class of systems that we call ``relatively inertial'' which are the fundamental systems in a relational view of mechanics. (shrink)

In this paper, we introduce the variety of algebras, which we call monadic \-rough Heyting algebras. These algebras constitute an extension of monadic Heyting algebras and in \ case they coincide with monadic 3-valued Łukasiewicz–Moisil algebras. Our main interest is the characterization of simple and subdirectly irreducible monadic \-rough Heyting algebras. In order to this, an Esakia-style duality for these algebras is developed.

El texto analiza algunas de las propuestas que las agencias internacionales más directamente relacionadas con el sector educativo han ofrecido a fin de afrontar las situaciones creadas por la pandemia de covid-19 y reactivar la educación en condiciones similares, o al menos comparables, a las que se encontraba antes de pandemia. A partir de ese análisis, se trazan conexiones entre las agendas educativas, políticas y económicas que enmarcan las respuestas actuales en términos de mediciones, evaluaciones e inversión de recursos y (...) tiempos. Al cierre, despejadas algunas dudas y aclaradas algunas decisiones, se toma distancia frente a las estrategias sugeridas por los organismos multilaterales, y se les ve desde una perspectiva que hace énfasis en las personas y las comunidades, antes que en los sistemas y en el comercio de datos, para sacar conclusiones que permitan repensar las direcciones en las que las acciones han de apuntar. Over the last few decades climate change has been gaining importance in international scientific and political debates. However, the social sciences, especially in Latin America, have only lately become interested in the subject and their approach is still vague. Scientific understanding of global environmental change and the process of designing public policies to face them are characterized by their complexity as well as by epistemic and normative uncertainties. This makes it necessary to problematize the way in which research efforts understand (...) ‘the social’ of climate change. How do ‘the climate’ and ‘the social’ interpenetrate as scientific objects? What does the resulting field look like? Is the combination capable of promoting reflexivity and collaboration on the issue, or does it merely become dispersed with diffuse boundaries? Our paper seeks to answer these and other related questions using Chile as a case study and examining peer-reviewed scientific research on the topic. By combining in-depth qualitative content analysis of each paper with a statistical meta-analysis, we were able to: characterize the key content and forms of such literature; identify divisions and patterns within it; and, discuss some factors and trends that may help explain these. We conclude that the literature displays two competing trends: while it is inclined to become fragmented beyond the scope of the ‘mitigation’ black box, it also tends to cluster along the lines of methodological distinctions traditionally contested within the social sciences. This, in turn, highlights the persistence of disciplinary divisions within an allegedly interdisciplinary field. (shrink)

Some initial considerations on film in documentary form are discussed, along with its relationships with reality and fiction in cinema language. Found footage genre is explained, pointing its most important technical and aesthetical characteristics. The text points the importance of the movie camera in documentary and found footage, not only as a technical device that objectivizes the information in a static manner, but also as an axis that configures dynamism and subjectivity on films. Redacted (2007) by Brian De Palma is (...) analyzed as an example of hybrid forms of fiction and reality in cinema. Beyond a traditional analysis of narrative of films, this text emphasizes the forms in which they are developed, which affect and determine the substance of films. (shrink)

In 2015, A.V. Figallo and G. Pelaitay introduced tense n×m-valued Łukasiewicz–Moisil algebras, as a common generalization of tense Boolean algebras and tense n-valued Łukasiewicz–Moisil algebras. Here we initiate an investigation into the class tpLMn×m of tense polyadic n × m-valued Łukasiewicz–Moisil algebras. These algebras constitute a generalization of tense polyadic Boolean algebras introduced by Georgescu in 1979, as well as the tense polyadic n-valued Łukasiewicz–Moisil algebras studied by Chiriţă in 2012. O presente artigo vem refletir sobre a crise do sacramento da penitência. Nesse contexto, apresenta-a como originária no relativismo e na distorção da noção de pecado presentes na sociedade atual. Por fim, apresenta os desafios atuais provenientes dessa reflexão, abrindo possibilidades para futuras reflexões e maior aprofundamento sobre o tema.

Proponemos una lectura de la obra de Hobbes como revolución, como ruptura radical con el pensamiento de la tradición dominante: ruptura, que lo es en casi todos los ámbitos, pero sobre todo en el del pensamiento político, moral y jurídico. Sugerimos, además, que esa radical ruptura sigue manteniendo elementos vivos y útiles para pensar la política hoy.

This article discusses Axel Honneth’s recent theory of recognition, as exposed in his book Freedom’s Right (2001). The argument defended here is that Honneth’s approach does not apprehend the normative implications of political conflicts, for it relies on what some critics have called normative history. Against that approach, this paper defends a model of social theory that is not committed to normative presuppositions of analysis. Rather, it seeks to understand how political struggles strive for normative authority. As an illustration of (...) forms of recognition that are alternative to the ones Honneth calls normative, the paper builds on an example from Brazilian society. (shrink)

In this paper I argue that the way in which we revise and change our beliefs is different from that in which we revise and change our judgments of value; this is due to the fact that judgments of value, unlike beliefs, have no truth-values. Changes of judgments of value do not answer in the same way to the restrictions that apply to changes of beliefs and that are determined by the norms that govern beliefs. I argue that, first when (...) we revise and change our beliefs, we should be in a posi-tion to suspend judgments, and when trying to remove doubts, we should try to avoid falsehood and, second when changing beliefs, we should be in a position to assign probabilities to those conjectures we are in suspense about. These two conditions apply to the case of changes of attitudes with truth-values, such as beliefs; I argue that these two charac-teristics do not apply to cases of changes of judgments of value. En esta discusión abordo la hermenéutica analógica de Mauricio Beuchot comparándola con la hermenéutica filosófica de Hans-Georg Gadamer. Argumento que Beuchot vuelve a la idea clásica de la hermenéutica como método de interpretación y no la juzga, como Gadamer, como una fenomenología de la comprensión. Sin embargo, Beuchot no atiende las razones de Gadamer en contra de concebir la hermenéutica como una metodología. Si se considera como metodología centrada en la analogía, la hermenéutica analógica deja de lado otros recursos interpretativos (...) importantes. Finalmente, Beuchot adopta una teoría correspondentista de la verdad contra la que argumenta Gadamer y que es incompatible con una hermenéutica filosófica. In this paper I analyze Mauricio Beuchot's analogical hermeneutics by contrasting it with Hans-Georg Gadamer's philosophical hermeneutics. I argue that Beuchot goes back to the classical idea of hermeneutics as a method of interpretation, and does not see it, as Gadamer does, as a phenomenology of understanding. However, Beuchot does not address Gadamer's arguments against using hermeneutics as a methodology. Considered as a methodology centered on analogy, analogical hermeneutics overlooks other important interpretation resources. Finally, Beuchot adopts a correspondence theory of truth, which Gadamer objects and is incompatible with philosophical hermeneutics. (shrink)

This textbook presents the basics of philosophy that are necessary for the student and researcher in science in order to better understand scientific work. The approach is not historical but formative: tools for semantical analysis, ontology of science, epistemology, and scientific ethics are presented in a formal and direct way. The book has two parts: one with the general theory and a second part with application to some problems such as the interpretation of quantum mechanics, the nature of mathematics, and (...) the ontology of spacetime. The book addresses questions such as "What is meaning?", "What is truth?", "What are truth criteria in science?", "What is a theory?", "What is a model?" "What is a datum?", "What is information?", "What does it mean to understand something?", "What is space?", "What is time?", "How are these concepts articulated in science?" "What are values?" "What are the limits of science?", and many more. The philosophical views presented are "scientific" in the sense that they are informed by current science, they are relevant for scientific research, and the method adopted uses the hypothetical-deductive approach that is characteristic of science. The results and conclusions, as any scientific conclusion, are open to revision in the light of future advances. Hence, this philosophical approach opposes to dogmatic philosophy. Supported by end-of-chapter summaries and a list of special symbols used, the material will be of interest for students and researchers in both science and philosophy. Previously, the author tried to show that some arguments in one of the two versions of Nicholas of Autrecourt’s Quaestio de intensione visionis are taken almost verbatim from the anonymous Tractatus de sex inconvenientibus. This paper concentrates on the arguments themselves in order to consider two main issues: the ‘translatability’ of limit decision problems, manifest in Autrecourt’s juxtaposition of questions de maximo et minimo, de primo et ultimo instanti, and the intension and remission of forms; the importance of Parisian discussions (...) of limit decision problems prior to the adoption of the new analytical languages developed at Oxford. Thus, the paper is divided in two sections, the first concerning some arguments of Autrecourt’s question, the second focusing on the link between one of Autrecourt’s arguments and the medieval tradition of commentaries on Aristotle’s De caelo, in which it is possible to find some antecedents of the analytical approach that later Parisian scholars would apply to these problems. It is well known that the modern atomists assumed the ancient thesis that things are composed of simple entities. It is also known that Leibniz went beyond atomism, since he affirmed that the true substances on which things are founded, the so-called monads, cannot be divisible or extended, for they are souls. For Christian Wolff, the elements of bodies are not extended; these elements have no figure and no magnitude whatsoever, they fill no space and are indivisible. In the Monadologia (...) physica, published in 1756, Kant also argues that the ultimate principles of bodies are the monads or simple substances. The goal of this work is to reconcile the confronted positions of “metaphysics” and “geometry”. (shrink)

Neste artigo pretendemos analisar a maneia pela qual o filósofo francês Jean-Paul Sartre modaliza, a partir da psicanálise existencial elaborada em L’être et le néant, sua biografia existencial sobre o poeta Charles Baudelaire. Em Baudelaire, seremos capazes de localizar os prolegômenos a toda biografia existencial sartreana futura, isto é, o modus operandi de investigação/escrita biográfica de Sartre.

Imaginary is, in Taylor's thought, a category of understanding social praxis and the reasons people give to make sense of these practices. The ultimate reason is the hypergood, which influences the strong decisions. Those strong evaluations outline the moral framework from which people address their own lives and the lives of others. We only recognize our cultural framework as an `imaginary' — challenging the supposition it is something `objective' — when others make their apparition in our lives. After the encounter (...) nobody remains the same; something in our imaginary has changed. The outcome of this process is the `best account' we have to make sense of our life. If we accept the category of `imaginary' and the process of `best account' as accurate enough to address Latin American reality, the problem we have to solve is how we can find out a Latin American social imaginary. Para tanto, analisa o contraste entre a fundamentação do direito em Kant, fortemente marcada pela ideia de liberdade como legitimadora do Estado e da ordem jurídica, e sua estrutura, caracterizada pelo formalismo, pelo rigor lógico, pela importância exagerada da coação e pela manutenção da validade da ordenamento mesmo diante de um rompimento com a ideia de justiça (...) que o sustenta (negação do direito de resistência). This article provides a comparative and interpretative analysis of the emerging projects in Latin America after the crisis of the neoliberal modernity project. It offers a critical interpretation of the current tendencies in Latin American politics at the national level, while suggesting some hints to understand the current neoliberal crisis in Western countries after Trump’s electoral triumph. The purpose is to figure out the collective meanings behind the new national projects in Latin America (postcolonial indigeneity, confrontational populism, defective neoliberalism, and (...) social liberalism) that are constructing a new regional order. The work examines how the neoliberal modernity project came to be dominant in the late 1980s, only to enter into a period of crisis in the current century. That crisis, in turn, provides the basis for exploring four different alternative projects of modernity, based on the kind of rationality and agency promoted by them. (shrink)

Can a planetary anthropology cope with both the "provincial cosmopolitanism" of alternative anthropologies and the "metropolitan provincialism" of hegemonic schools? How might the resulting "world anthropologies" challenge the current panorama in which certain allegedly national anthropological traditions have more paradigmatic weight--and hence more power--than others? Critically examining the international dissemination of anthropology within and across national power fields, contributors address these questions and many others.

The Darwinian revolution supposed and imposed a much broader and more complex concept of environment than that which, until that moment, had been considered by most as part of natural history. Until Darwin, the environment of living beings had been regarded, almost exclusively, as the inanimate surroundings. This pre-Darwinian notion of environment included physicochemical and climatic variables: the living beings themselves were scarcely considered, or they were regarded just as food to be assimilated. In contrast, with Darwin, the influence of (...) living surroundings began to be regarded as having decisive importance for understanding the distribution, configuration, and viability of living beings. The relationships established among different living beings became the main and more significant features of the biological environment. This conceptual change was an exigency derived from the formulation and justification of the theory of natural selection. The idea of struggle for existence supposed by that theory requires that the biotic environment be considered critical in determining the viability of each living being. (shrink)

We provide a 'verisimilitudinarian' analysis of the well-known Linda paradox or conjunction fallacy, i.e., the fact that most people judge the probability of the conjunctive statement "Linda is a bank teller and is active in the feminist movement" (B & F) as more probable than the isolated statement "Linda is a bank teller" (B), contrary to an uncontroversial principle of probability theory. The basic idea is that experimental participants may judge B & F a better hypothesis about Linda as compared (...) to B because they evaluate B & F as more verisimilar than B. In fact, the hypothesis "feminist bank teller", while less likely to be true than "bank teller", may well be a better approximation to the truth about Linda. (shrink)

Popper’s original definition of truthlikeness relied on a central insight: that truthlikeness combines truth and information, in the sense that a proposition is closer to the truth the more true consequences and the less false consequences it entails. As intuitively compelling as this definition may be, it is untenable, as proved long ago; still, one can arguably rely on Popper’s intuition to provide an adequate account of truthlikeness. To this aim, we mobilize some classical work on partial entailment in defining (...) a new measure of truthlikeness which satisfies a number of desiderata. The resulting account has some interesting and surprising connections with other accounts on the market, thus shedding new light on current attempts of systematizing different approaches to verisimilitude. There are communities in which disadvantaged groups experience severe inequality. For instance, poor and indigent families face many difficulties accessing their social rights. Their condition is largely the consequence of the wrong choices of those in power, either historical or more recent choices. The lack of opportunities of these deprived citizens is due to state omissions. In such communities, it is not unusual for homeless members of these particular groups to occupy abandoned lands and build their shelters there. However, almost (...) everywhere, these actions constitute a crime. The typical response to this situation is prosecution and punishment. In this paper, I will defend the occupation of public places as a consequence of the failure of governments to solve the problem of housing, and I will argue that we must distinguish a social claim from a crime and avoid the use of criminal law in these “occupation cases”. I will also argue that our right—as a community—to blame and punish these “squatters” is eroded by the fact that we perpetrated their situation of injustice. (shrink)

In this paper, we address the problem of truth approximation through theory change, asking whether revising our theories by newly acquired data leads us closer to the truth about a given domain. More particularly, we focus on “nomic conjunctive theories”, i.e., theories expressed as conjunctions of logically independent statements concerning the physical or, more generally, nomic possibilities and impossibilities of the domain under inquiry. We define both a comparative and a quantitative notion of the verisimilitude of such theories, and identify (...) suitable conditions concerning the (partial) correctness of acquired data, under which revising our theories by data leads us closer to “the nomic truth”, construed as the target of scientific inquiry. We conclude by indicating some further developments, generalizations, and open issues arising from our results. (shrink)

Theory change is a central concern in contemporary epistemology and philosophy of science. In this paper, we investigate the relationships between two ongoing research programs providing formal treatments of theory change: the (post-Popperian) approach to verisimilitude and the AGM theory of belief change. We show that appropriately construed accounts emerging from those two lines of epistemological research do yield convergences relative to a specified kind of theories, here labeled “conjunctive”. In this domain, a set of plausible conditions are identified which (...) demonstrably capture the verisimilitudinarian effectiveness of AGM belief change, i.e., its effectiveness in tracking truth approximation. We conclude by indicating some further developments and open issues arising from our results. (shrink)

Dung’s argumentation frameworks have been applied for over twenty years to the analysis of argument justification. This representation focuses on arguments and the attacks among them, abstracting away from other features like the internal structure of arguments, the nature of utterers, the specifics of the attack relation, etc. The model is highly attractive because it reduces most of the complexities involved in argumentation processes. It can be applied to different settings, like the argument evaluation of an individual agent or the (...) case of dialectic disputes between two agents (pro and con), or even in multi-agent collective argumentation. The latter case involves agents with possibly different arguments and/or opinions on how to evaluate them, leading to the possibility of considering multiple sets of arguments and attack relations. Two basic questions can be asked here, namely ‘what to aggregate’ and ‘how to aggregate’. The former concerns what kinds of entities do the agents intend to choose (arguments, attacks, assessments, etc.), while the second one focuses on which aggregation mechanisms yield rational choices (voting on arguments, merging procedures to obtain a common argumentation framework, deliberation processes, etc.). In particular, the question about the rationality of a collective argument choice relates this topic to Social Choice and Judgment Aggregation theories, while its associated strategic issues relate it to Game Theory. The research efforts on the disparate problems elicited by collective argumentation have generated a considerable corpus of literature that deserves an orderly evaluation. Conceptual engineering is commonly characterized as the method for assessing and improving our representational devices. Little has been said, however, on how best to construe these representational devices—in other words, on what conceptual engineering should be all about. This paper tackles this problem with a basic strategy: First, by presenting a taxonomy of the different possible subject matters for conceptual engineering; then, by comparatively assessing them and selecting the most conducive one with a view to making conceptual engineering an actionable (...) method, that is, a method that can be applied effectively and consistently to specific case studies. The outcome is that conceptual engineering should be all about concepts on pain of pragmatic inconsistencies otherwise. (shrink)
