In this paper we review selected international legal instruments, the effect, if any, that they have had on global health, and how these instruments might have contributed to the realization of health rights. We consider a number of instruments from the international health law field as well as two from the field of international environmental law.1 The latter two, in addition to the considerable link between health and climate/environment, are considered with the purpose of drawing more generalized lessons about what (...) contributes to the success or failure of an international legal instrument; the lessons are then applied to our analysis of the health law instruments that are the primary focus of our paper. Most academic papers on ethics in pandemics concentrate on the duties of healthcare professionals. This paper will consider non-professional healthcare workers: do they have a moral obligation to work during an influenza pandemic? If so, is this an obligation that outweighs others they might have, e.g., as parents, and should such an obligation be backed up by the coercive power of law? This paper considers whether non-professional healthcare workers—porters, domestic service workers, catering staff, clerks, IT support workers, etc.—have an obligation (...) to work during an influenza pandemic. It uses data collected as part of a study looking at the attitudes of healthcare workers to working during a pandemic to suggest the philosophical arguments explored. These include: being in a position to do good, the ethics of work, competing obligations to family members and in particular to children and the obligations of citizens in a state of national emergency. We also look at whether compulsory measures are justified to support a national health service during a health emergency. We conclude that even if they are, compulsion should not be restricted to non-professionals who happen to be working in the health service at the time. Rather, compulsion involving a larger pool of people with the relevant skills and abilities is more equitable. (shrink)

Reading is not only “cold” information processing, but involves affective and aesthetic processes that go far beyond what current models of word recognition, sentence processing, or text comprehension can explain. To investigate such “hot” reading processes, standardized instruments that quantify both psycholinguistic and emotional variables at the sublexical, lexical, inter-, and supralexical levels (e.g., phonological iconicity, word valence, arousal-span, or passage suspense) are necessary. One such instrument, the Berlin Affective Word List (BAWL) has been used in over 50 published studies (...) demonstrating effects of lexical emotional variables on all relevant processing levels (experiential, behavioral, neuronal). In this paper, we first present new data from several BAWL studies. Together, these studies examine various views on affective effects in reading arising from dimensional (e.g., valence ) and discrete emotion features (e.g., happiness ), or embodied cognition features like smelling. Second, we extend our investigation of the complex issue of affective word processing to words characterized by a mixture of affects. These words entail positive and negative valence, and/or features making them beautiful or ugly. Finally, we discuss tentative neurocognitive models of affective word processing in the light of the present results, raising new issues for future studies. (shrink)

A review, with reflections, of Michael S. Gazzaniga's (2011) book, Who's in Charge? Free Will and the Science of the Brain. Gazzaniga, a distinguished neuroscientist, wishes to connect contemporary understandings of the functioning of the human brain to the proper functioning of the American courtroom. What effect, if any, should these current understandings (and current technologies) have on legal conceptions of personal responsibility, guilt, and punishment? If, as many neuroscientists hold, the functioning of the brain wholly determines the functioning of (...) the mind, can people rightly be held responsible for their actions? This essay provides evidence to support a promising conceptual and potentially practical set of ideas at once both principled and effective found in the work of Max Weber and Alfred Schutz addressed to the issue of ‘adequacy’ as a goal in social research. Efforts to achieve adequacy beyond the epistemological conditions required by Weber’s demand that evidence meet both causal adequacy and adequacy on the level of meaning were significantly refocused by Schutz’s later concern, responding specifically to Weber, that the (...) social sciences also address themselves to his postulate of adequacy. It states that “Each term used in a scientific system referring to human action must be so constructed that a human act performed within the life-world by an individual actor in the way indicated by the typical construction would be reasonable and understandable for the actor himself, as well as for his fellow men”. A serious attempt to implement a more expansive notion of adequacy by practically activating this postulate in the ways suggested can be beneficial not only for the social research situation but in everyday life as well. […] I want to be misunderstood for a long time”.1 So proclaims Nietzsche in a notebook passage from 1883, thereby making one of several positive claims for identification with the Hellenistic Greek philosopher from Samos.2 Epicurus, the full remark suggests, was untimely—misunderstood, unappreciated by his contemporaries—much as Nietzsche himself aims to be untimely; and this point is hardly the only moment of convergence between the two thinkers. This paper uses an extended discussion of Nietzsche’s essay “The Greek State” to uncover the political aspects of his early thinking. The paper builds on a similar discussion of another essay from the same period, “Homer on Competition,” in arguing that Nietzsche’s thinking is based on a confrontation with the work of Plato. It is argued that the key to understanding “The Greek State” is seeing it, in its entirety, as an enigmatic interpretation and re-writing of Plato’s Republic. Nietzsche interprets (...) the Republic as Plato’s accomplishment of the task of the genuine philosopher: the legislation of values and the moulding of human character. (shrink)

It has been argued that if an animal is psychologically like us, there may be more scientific reason to experiment upon it, but less moral justification to do so. Some scientists deny the existence of this dilemma, claiming that although there are scientifically valuable similarities between humans and animals that make experimentation worthwhile, humans are at the same time unique and fundamentally different. This latter response is, ironically, typical of pre-Darwinian beliefs in the relationship between human and non-human animals. Another (...) irony is that debate about such issues has facilitated the participation once more of philosophers in questions concerning experimental psychology: ironic because laboratory-oriented psychologists, especially since the turn of the last century, had been eager to establish the independence of their subject from any influence of philosophy and its investigative methods, as well as from any kind of anthropomorphism.In Britain, certainly more so than in the United States, ethical constraints have prevented the development of psychological research with animals along certain routes. By the 1980s British professional and academic societies had published codes of conduct and guidelines for their members, in part responding to public concern about the welfare of animals in the psychological laboratory. What led to the establishment of these codes and guidelines? This paper analyses the historical background against which professional concern for ethical cost in experimental animal psychology began to take shape, leading to the societies’ open pronouncements of the 1980s. But questions concerning the interpretation of the Aeneid are rarely simple; and the question of Jupiter's relationship to the fata may repay further enquiry.

This essay argues that Johannes von Kries analysis of the status in the criminal law of the rationally intending subject and the doctrine of _mens rea_ so closely associated with it (cf. Kries, 1886 ; 1888 ) was well known to Max Weber, who had initially trained in law, and highly significant both for the development of his sociology of subjective understanding and his parallel view that the social sciences must be jointly committed to combining a generalizing objective with an (...) individualizing method in their research. It also sees many indications that Weber believed that social scientific investigations could and should go further toward franchising the subject of such social research by encouraging active, even critical responses in his/her testimony in the interests of better achieving both causal and meaning adequacy. From this it would have been only a short step to what I call the practical activation of Alfred Schutz’s postulate of adequacy, which requires that intellectual type constructs in the social sciences not only make sense to research subjects but accord with their perceptions, observations and views. The essay discusses the obstacles provided by the environing authoritarian social and political framework, including the trajectories of those professions on which the social sciences had little choice but to model themselves, as reasons explaining why practical activation of the postulate of adequacy has not yet fully come to pass. It concludes by addressing new Weber scholarship which sees him as a complex and dynamic probabilist whose constructivist and interpretivist theory of human social action is based much more on _Chance_ and orientation than we thought, even to the point of being a model for practical activation of the postulate of adequacy as well as a new and revised basis for the analysis of social interaction itself (see Weber, [ 1913 ] ( 1981 ).
