An important subject of bioethical and legal considerations is the relations and manifestations of what happens in current biomedical practice regarding the practice of activities and the provision of health care services. This is particularly important when it comes to disagreements, collisions, and conflicting rules, the ethical and legal origins of different norms, and medical decision making. An appropriate analytical and methodological approach through interpretation and comparison is needed to uncover shortcomings that often remain on the surface, invisible, due to (...) the lack of dialogue. This paper aims to shed light on the fundamentals of bioethical principles on the one hand and the legal-logical system of norms in biomedicine on the other. The conclusion emphasises the elimination of the contradictory elements of the relationship and the affirmation of helpful and complementary aspects with the opening of parallel perspectives and intersections in the service of promoting the legality of the work, the development of good medical practice and respect for human rights in the field of health. Reference is a central topic in philosophy of language, and has been the main focus of discussion about how language relates to the world. R. M. Sainsbury sets out a new approach to the concept, which promises to bring to an end some long-standing debates in semantic theory.There is a single category of referring expressions, all of which deserve essentially the same kind of semantic treatment. Included in this category are both singular and plural referring expressions, complex and non-complex referring (...) expressions, and empty and non-empty referring expressions. Referring expressions are to be described semantically by a reference condition, rather than by being associated with a referent. In arguing for these theses, Sainsbury's book promises to end the fruitless oscillation between Millian and descriptivist views. Millian views insist that every name has a referent, and find it hard to give a good account of names which appear not to have referents, or at least are not known to do so, like ones introduced through error, ones where it is disputed whether they have a bearer and ones used in fiction. Descriptivist theories require that each name be associated with some body of information. These theories fly in the face of the fact names are useful precisely because there is often no overlap of information among speakers and hearers. The alternative position for which the book argues is firmly non-descriptivist, though it also does not require a referent. A much broader view can be taken of which expressions are referring expressions: not just names and pronouns used demonstratively, but also some complex expressions and some anaphoric uses of pronouns.Sainsbury's approach brings reference into line with truth: no one would think that a semantic theory should associate a sentence with a truth value, but it is commonly held that a semantic theory should associate a sentence with a truth condition, a condition which an arbitrary state of the world would have to satisfy in order to make the sentence true. The right analogy is that a semantic theory should associate a referring expression with a reference condition, a condition which an arbitrary object would have to satisfy in order to be the expression's referent.Lucid and accessible, and written with a minimum of technicality, Sainsbury's book also includes a useful historical survey. Listening to someone from some distance in a crowded room you may experience the following phenomenon: when looking at them speak, you may both hear and see where the source of the sounds is; but when your eyes are turned elsewhere, you may no longer be able to detect exactly where the voice must be coming from. With your eyes again fixed on the speaker, and the movement of her lips a clear sense of the source of the sound will (...) return. This ‘ventriloquist’ effect reflects the ways in which visual cognition can dominate auditory perception. And this phenomenological observation is one what you can verify or disconfirm in your own case just by the slightest reflection on what it is like for you to listen to someone with or without visual contact with them. In Contingent Computation, M. Beatrice Fazi offers a new theoretical perspective through which we can engage philosophically with computing. The book proves that aesthetics is a viable mode of investigating contemporary computational systems. It does so by advancing an original conception of computational aesthetics that does not just concern art made by or with computers, but rather the modes of being and becoming of computational processes. Contingent Computation mobilises the philosophies of Gilles Deleuze and Alfred North Whitehead in order to (...) address aesthetics as an ontological study of the generative potential of reality. Through a novel philosophical reading of Gödel’s incompleteness theorems and of Turing’s notion of incomputability, Fazi finds this potential at the formal heart of computational systems, and argues that computation is a process of determining indeterminacy. This indeterminacy, which is central to computational systems, does not contradict their functionality. Instead, it drives their very operation, albeit in a manner that might not always fit with the instrumental, representational and cognitivist purposes that we have assigned to computing. (shrink)

Most moral philosophers who have recently expressed sympathy with feminist or ‘care-based’ perspectives on ethical theory have thought that such perspectives can make valuable contributions to more comprehensive ethical theories. Few have thought that an ethics of care can offer a complete normative theory. However, Michael Slote is one of the ambitious few. In his recent book, The Ethics of Care and Empathy, he seeks to show that a care-based perspective can do a lot of service in first-order moral and (...) political theory as well as in metaethics. Here is a quick overview of the book's content: In Chapter 1, Slote explicates the notion of empathy that is central in his ethics of care, which he locates within the sentimentalist paradigm, stemming from philosophers such as Hume and Hutcheson. Slote's account of empathy and moral development draws substantially on work by the psychologist Martin Hoffman. Chapter 2 discusses care ethics and our obligation to help others, including both the near and the distant needy. Chapter 3 aims to show how the notion of empathy can further the case for deontology in ethics. So, on 22 July 1865, under the title ‘Philosophy and Punch’, did England's premier comic weekly greet the election of J. S. Mill as MP for Westminster. Mill held his seat for only one term, until the general election of 1868, when his Whig-Liberal colleague Robert Wellesley Grosvenor was re-elected, but Mill was replaced by the loser in 1865, the Conservative W. H. Smith, Jr., who, though he never went to sea, became the ruler of the Queen's navy. The reasons (...) for that reversal have engaged the attention of many, including Mill himself; I should like to introduce into the discussion material from an ignored source, the comic weeklies, which took a continued and close look at Mill's behaviour during his parliamentary years. While this evidence generally does not disconfirm earlier judgments—including my own— it does more than merely add to the induction. First, it shows how different political stances led journals to focus on different aspects of Mill's parliamentary career, and to adopt different rhetorical strategies in portraying him in picture and word. Second, it demonstrates how the hardening of party allegiances during the parliament of 1865–68, which accelerated in the preparatory campaigns for the general election of 1868, affected Mill adversely. Third, it suggests strongly that it was not his ‘crotchets’ or ‘whims’, especially women's suffrage and proportional representation, that damaged his chances for re-election, but his advocacy of causes unpopular with the majority of Liberals as well as with Conservatives. It is extraordinary, when one thinks about it, how little attention has been paid by theorists of the nature and justification of punishment to the idea that punishment is essentially a matter of self-defense. H. L. A. Hart, for example, in his famous “Prolegomenon to the Principles of Punishment,” is clearly committed to the view that, at bottom, there are just three directions in which a plausible theory of punishment can go: we can try to justify punishment on purely consequentialist (...) grounds, which for Hart, I think, would be to try to construct a purely utilitarian justification of punishment; we can try to justify punishment on purely retributive grounds; or we can try to justify punishment on grounds that are some sort of shrewd combination of consequentialist and retributive considerations. Entirely absent from Hart's discussion is any consideration of the possibility that punishment might be neither a matter of maximizing the good, nor of exacting retribution for a wrongful act, nor of some imaginative combination of these things, but, rather, of something altogether different from either of them: namely, the exercise of a fundamental right of self-protection. Similarly, but much more recently, R. A. Duff, despite the fact that he himself introduces and defends an extremely interesting fourth possibility, begins his discussion by writing as though, apart from his contribution, there are available to us essentially just the options previously sketched by Hart. Again, there is no mention here, any more than in Hart's or any number of other recent discussions, of the possibility that we might be able to justify the institution of punishment on grounds that are indeed forward-looking, to use Hart's famous term, but that are not at all consequentialist in any ordinary sense of the word. The topics primarily treated are: how they understood “Being/ existence” and “being/existent” and essential natures; the systematic exploitation of the equivocities of certain expressions within a general context in which other than words there are no universals proves to be elegant as well as (...) insightful; the basic categories of primary entities: independant beings and nonindependant beings, created and uncreated, the equivocity of “being/existent” as predicated of contingent entities on the one hand and of God and His attributes on the other, and certain problems that arise because of the rigid application of the system's underlying analytic principles. Special groups [M. Dickmann, F. Miraglia, Special Groups : Boolean-Theoretic Methods in the Theory of Quadratic Forms, Memoirs Amer. Math. Soc., vol. 689, Amer. Math. Soc., Providence, RI, 2000] are a first-order axiomatization of the theory of quadratic forms. In Section 2 we investigate reduced special groups which are a lattice under their natural representation partial order ; we show that this lattice property is preserved under most of the standard constructions on RSGs; in particular finite RSGs and RSGs of (...) finite chain length are lattice ordered. We prove that the lattice property fails for the RSGs of function fields of real algebraic varieties over a uniquely ordered field dense in its real closure, unless their stability index is 1 . We show that Open Problem 1 has a positive answer for the RSG of the field Q . In the final section we explore the meaning of Open Problem 1 for formally real fields, in terms of their orders and real valuations; we introduce the notion of “parameter-rank” of a positive-primitive first-order formula of the language for special groups. The essays display the author's characteristic clarity and vigour; some of them are polemical, targeting particular opponents and rival theories. It is argued that a property framework may be an effective and constructive method of exploring issues arising from this. The issue of the recognition scene in Euripides' Electra, if not as ‘eternal’ as the controversy over the relative dating of the Sophoclean and Euripidean plays of that name, is certainly recurrent. After Eduard Fraenkel's resurrection of the problem at the end of his great commentary on Aeschylus' Agamemnon, the contributions of Hugh Lloyd-Jones and the late Godfrey Bond seemed to have settled the case in favour of authenticity. But soon after, David Bain and then M. L. West, G. Basta (...) Donzelli and finally David Kovacs, all writing in the same journal, raised some new and awkward questions, which, at the very least, require more in the way of answers than they have yet received. The last word, as the saying goes, has not yet been spoken. In this article I try to provide the last word—no, that would be too much to expect, but further reflections on the issue—yes. In particular, I try to set the matter in a wider context, seeking analogies for what, if w. 518–44 are Euripidean, the playwright may have been aiming at in this particular scene. Such analogies should be important, for scholars have generally by contrast stressed the uniqueness of the recognition scene: ‘in the extant remains of Greek tragedy we have indeed nothing’, says Bond, ‘comparable to the Electra parody’. In lieu of an abstract, here is a brief excerpt of the content:The Mystery of Problems for Modern Theological MethodologyBruno M. Shah O.P.Recent trends in Catholic theology emphasize the category of "mystery." But "problems," which can seem distinct from and even opposed to mysteries, have a constitutive role in the work of theology as well. If the object of faith is God, and if theology's goal is typically defined as "faith seeking understanding," then the object of theology must include the (...) seeking's problematical quotient. At the very least, problems condition the faith-and-reason labor of theological enquiry. This essay claims that problems philosophically orient and index the theological articulation of mysteries—not the mysteries themselves—particularly in a modern key, and that they require explicit attention in theological methodology and pedagogy.First, I explain my concern with the "return to mystery" in conciliar-era Catholic theology. This explanation entails, second, describing the special attention to "problems" in neo-Kantianism, which bequeaths the tension between the empirical world and transcendental freedom to modern theology. These two historiographical matters in methodology set up the tension between problems and mysteries for Catholic thinking. Third, I briefly return to Aristotle's thoughts on the matter, which are a lodestone for the tradition. Fourth, I evaluate the positions of Jacques Maritain and Gabriel Marcel, the most important conciliar-era thinkers who thematized the relationship between problems and mysteries. My treatment will show how both ontological (Maritain) and existential (Marcel) dynamics of mystery are necessarily linked to metaphysical and spiritual problems. The [End Page 1265] critical ascertaining of theological mystery formally requires orientation via philosophical problems.My concern here is fundamental, ecclesial, and professional, interested that those who serve the Church through theological writing and teaching do so in a recognizably common or compatible manner, and in a way that can meaningfully stimulate theological interest. If the teaching of theology would invite students to embark upon the via inventionis and not merely yield to the via doctrinae, there must be fundamental advertence to ontological and existential problems as the theologically constitutive point of departure.1 Theologians do well to think in correlative terms of problems and mysteries. As a fifth and final point, then, I suggest that the quintessential starting point for (fundamental) theology today is the problem and mystery of the human person.Historical Context 1: The Return to MysteryContemporary Church life and theology have witnessed a "return to mystery."2 "Mystery" refers to some range or dynamic of reality that is essentially inaccessible apart from some feature of religious or spiritual practice. Christian reference to "mystery" or "mysteries" etymologically intimates that there are realities of which we cannot and/or ought not to speak, even as these mysteries have in some way been disclosed.3 Mysteries, therefore, are tensional in that they indicate at once contact and transcendence, knowledge and nescience. Christians and others communicate in religious mysteries through liturgical exercise and creedal confession, as well as through personal prayer and even existential trial. They are mediations of what is categorically transcendent, of what constitutively eludes or escapes [End Page 1266] the categories of our objectifying consciousness. Accordingly, the mysterious regards the inarticulable.That the substance of religious mysteries is real or true cannot be proven beyond all question, not according to commonly accessible human criteria of justification. For Christians, the gift of faith provides the convincing motive to believe in the reality of Christian mysteries through a kind of thinking with felt decision. Granting this claim, the work of theology is to reflect upon the mysteries of faith and develop expressible knowledge. Theology articulates (the) faith, extrapolating upon the reasons that the heart has for its belief. To do this work, theology trades upon fixed standards of confessional speech, liturgical practice, and perhaps also moral action, which provide lexical cogency and communicable intelligibility.The late nineteenth century witnessed attacks upon theology's claims to objectively or universally valid expression, owing especially to challenges from both epistemology and historiography.4 The surge of post-Enlightenment liberalism was surely catalytic as well. M. I. Finley in his Politics in the Ancient World , 92–6 has recently cast doubt on the extent to which religious phenomena were taken seriously in ancient times. We believe that in stressing the reasons for scepticism he has overlooked much positive evidence for the impact of religious scruples on political behaviour and that in generalising he has undervalued the differences in this respect between ancient societies. The significance of some of this positive evidence is admittedly uncertain since in (...) civilian life scruples might be easy to observe without great suffering. The acid test is in time of war, so that is the concern of our present enquiry. That attitudes varied can be shown only by comparing societies. We have here limited our discussion to three for which the evidence is well preserved: the world of the Greek city before Alexander the Great, Rome before Constantine, and the Jews in the Hellenistic and Roman period. Elucidation of the reasons for their distinct attitudes would reveal much about each of these societies and its religious practices and conceptions, but there will be space here only to show that considerable variety did indeed exist. Most ancient peoples assumed that their gods approved of war; the pacifism of some pre-Constantinian Christians was exceptional. Nor did such rules in combat as were observed necessarily have a religious foundation. Ancient like modern scruples were often based on moral and humanitarian grounds, as in the treatment of corpses and civilians; the gods, as the guardians of general morality, might be involved in such matters, but only at a remove. The debate that raged in the interwar period between the Austrian economists and socialist economists was, narrowly conceived, a debate in positive economics. What was being discussed was certainly not the morality of capitalism or of socialism. Nor, strictly speaking, was the debate even about society's economic well-being under socialism; it concerned the ability of central planners to make decisions that take appropriate account of relevant resource scarcities, in the light of consumer preference rankings. To be sure, the extraordinary interest (...) which surrounded the debate and the passions that lurked barely below its surface testified to the powerful implications of the debate for crucial issues in welfare economics. The Austrians were not merely exploring the economies of socialism; they were in effect demonstrating that, as an economic system attempting to serve the needs of its citizens, socialism must inevitably fail. But, even if the debate is interpreted in its broadest terms, as a debate in welfare economics, it represented a sharp break widi traditional polemics relating to the socialism-capitalism issue. Traditionally the arguments for or against capitalism had, until 1920, been deeply involved in ediical questions. Mises's 1920 challenge to socialism, in contrast, was explicit in making no attempt to address any claims concerning the alleged moral superiority of socialism. He simply argued that, as an economic system, socialism was inherendy incapable of fulfilling the objectives of its proponents; central planners are unable to plan centrally. (shrink)

Malthus did not leave us with a systematic treatment of colonization, but from remarks scattered throughout his publications and correspondence it is possible to assemble a fairly coherent account of his views on the advantages and disadvantages of colonies, and on the reasons why some have failed and others succeeded. Included in these scattered remarks are some comparisons between his own views on colonies and those of Adam Smith. The question of the relationship between Malthus and Adam Smith is a (...) rather complex and subtle one, and cannot be given the full consideration it deserves in one short paper. But, as a general summary, it can be said that Malthus had a high regard for Smith and considered himself a follower and disciple of Smith, by contrast with Ricardo, James Mill, and McCulloch etc., whom he considered as exponents of a ‘New System of Political Economy”. His own Principles of Political Economy was conceived as a collection of ‘tracts or essays”, not as a new systematic treatise replacing the Wealth of Nations, Joseph Gamier in his article ‘Malthus” in the Dictionnaire de l'Economie Politique, 1852, saw that the title of the Principles was in fact a misnomer: ‘Malgré son titre, le livre sur les Principes n'est point un traité complet, mais seulement une collection de dissertations.” In what was probably intended as a criticism of Ricardo's Principles of Political Economy and Taxation, 1817, Malthus stated that the ‘present period … seems to be unpropitious to the publication of a new systematic treatise on political economy”, and, referring to Smith's work, stated that ‘the treatise which we already possess is still of the very highest value”. Nevertheless, despite professing his affiliation, Malthus did not hesitate to criticize Smith when he disagreed with him. The historical development of the famous Einstein formula \ is briefly discussed. In this paper, on the basis of the Einstein viewpoint a new general approach is proposed for demonstrating the correctness of the formula \ . It is can be seen that the generalized approach leads to Einstein’s famous formula, too. During recent years, various papers have been published concerning the incompleteness of this famous formula. It is demonstrated that the presented claims in these articles are not mathematically legitimate. (...)
