Venn diagrams, which are widely used in introductory logic courses, provide a convenient and illuminating way of presenting the various theories concerning the nature of law. When combined with the Aristotelian square of opposition, these diagrams show not only how the theories are related to one another, logically, which is essential to understanding them, but also which theories are compossible. One surprising result of this approach is that it shows the substantive compatibility of the theories of law set forth by (...) H. L. A. Hart and Ronald Dworkin, who are usually pitted against one another. I show, through quotation and visual representation, that there is no essential disagreement between these jurisprudential stalwarts concerning the relation of law and morality. (shrink)

Conference environments enable diverse roles for academics. However, conferences are hardly entered into by participants as equals. Academics enter into and experience professional environments differently according to culture, gender, race, ethnicity, class, and more. This paper considers from a philosophical perspective entering and initiating culturally into academic conferences as a woman. Speakers of a natural language regularly form justified beliefs about what others are saying when they utter sentences of the language. What accounts for these justified beliefs? At one level, we already have a plausible answer: there is a perfectly good ordinary sense in which users of a language know what its sentences mean, and it is very plausible that the hearer’s knowledge of the meaning of S helps explain her justification for her belief about what is said by an (...) utterance of S. But what exactly does our knowledge of sentence meanings consist in? In this essay I advance and defend the view that we know the meanings of sentences in virtue of having a certain distinctive kind of know-how that I call inferential practical knowledge. I argue that this view provides the best explanation for the justification of our beliefs about what is said. In particular, it provides a better explanation than the more conventional and widely accepted view that we know the meaning of S in virtue of possessing the theoretical knowledge that S has such-and-such meaning. “Hot seating” is a form of creative drama in which the participants play themselves but imagine themselves in someone else’s position, some taking the role of interrogators and others the role of persons in the “hot seat”. This paper documents the case of marketing students who dramatised an ethics enquiry supposedly held under the auspices of a professional marketing association to investigate breaches in its code of professional conduct. Interpretive research, in the form of a cartoon test, was employed to (...) examine the contribution of the educational drama activity to student perceptions of learning within a role-playing experientially-based marketing unit at an Australian University. Findings reveal that students preferred the hot-seating exercise to conventional teaching methods in terms of enjoyment, “real-life” experience, new understandings of both marketing and ethics, and their motivation to learn more about marketing ethics implications for themselves, customers and the profession. Strategically, the convention was found to involve the students emotionally and intellectually with some intensity, while revealing that some students may be fearful of the drama or even over-stimulated by the sometimes tense and powerful environment.This pedagogical approach was also seen to be particularly suitable for instruction for the delicate, contentious and personal issues often raised by ethics. In his essay ‘“Conceptual Truth”’, Timothy Williamson (2006) argues that there are no truths or entailments that are constitutive of understanding the sentences involved. In this reply I provide several examples of entailment patterns that are intuitively constitutive of understanding in just the way that Williamson rejects, and I argue that Williamson’s argument does nothing to show otherwise. Williamson bolsters his conclusion by appeal to a certain theory about the nature of understanding. I argue that his theory fails to consider (...) the role that the structure of a sentence plays in determining its meaning. The cases I present suggest that this role imposes greater cognitive requirements on understanding than Williamson can acknowledge. (shrink)

In the absence of any institution for imposing legal liability on global business, the idea of instituting a cosmopolitan court for international corporate offenses is advocated. The proposal is then critically examined and defended in light of a number of key objections. Having both civil and criminal jurisdiction, such a tribunal could benefit domestic and international legal systems, multinational corporations, and victims of transnational and international corporate misdeeds. By laying down minimal global standards of corporate liability, resolving conflicts between the (...) regulatory activities of national legal systems, and affording redress for aggrieved parties in countries with inadequate legal infrastructures, the tribunal would promote the objectives of compensatory, distributive, procedural and retributive justice at the global level. Moreover, the court would assist corporations by translating compliance with minimum ethical standards to the bottom line. Ethical corporations will gain competitive advantage relative to unscrupulous firms, since the latter'ss activities will be sanctioned. The international community need not leave obedience to basic norms up to the voluntary good-will and discretion of multinational firms. (shrink)

In this paper a method is proposed for empirically determining simultaneity at a distance within the special theory of relativity. It is argued that this method is independent of Einstein's signalling method and provides a basis for denying the conventionality of distant simultaneity.

The article posits the concept of economy of mutuality as an intellectual mediation space for shifts in emphasis between market and social structures within economic theory and practice. Economy of mutuality, it is contended, provides an alternative frame of reference to the dichotomy of market economy and social economy, for inquiry about what business is for and what values it presupposes and creates. The article centers around the objective of gaining a broadened understanding of business so as to include not (...) just market economy, but social enterprise and social economy. In pursuit of this objective, a range of various archetypes of business enterprise are considered in light of higher ends of economic life. The highest telos of business encompassing all such archetypes, it is argued, is founded on reciprocity and integral human development. The article concludes that, compared to market economy per se, economy of mutuality provides a better conceptual framework for business in undertaking the challenges of sustainability. (shrink)

We observe a number of connections between recent developments in the study of constraint satisfaction problems, irredundant axiomatisation and the study of topological quasivarieties. Several restricted forms of a conjecture of Clark, Davey, Jackson and Pitkethly are solved: for example we show that if, for a finite relational structure M, the class of M-colourable structures has no finite axiomatisation in first order logic, then there is no set (even infinite) of first order sentences characterising the continuously M-colourable structures amongst (...) compact totally disconnected relational structures. We also refute a rather old conjecture of Gorbunov by presenting a finite structure with an infinite irredundant quasi-identity basis. (shrink)

This article seeks to consider the policing of anti-fracking protests at Barton Moss, Salford, from November 2013 to April 2014. We argue that women at Barton Moss were considered by the police to be transgressing the socio-geographical boundaries that establish the dominant cultural and social order, and were thus responded to as disruptive and disorderly subjects. The article draws upon recent work on pacification, which views police power as having both destructive and productive dimensions, to consider the impact of police (...) violence on women involved in protest. We seek to explore the ways in which this violence impacts not only on those involved in protest but also those on the peripheries. The article suggests that the threat and use of sexual violence by police towards women aims to enforce compliance within the protest movement and to send a message, specifically to those on the fringes of the movement, that protest is illegitimate and inherently dangerous. As such, sexual violence forms part of the social production and construction of gender and is instrumental in the making and remaking of subjectivities. The case study suggests that police brutality towards women at Barton Moss, therefore, operated as a disciplinary function to regulate acceptable forms of protest and acceptable forms of femininity. I consider in this essay three possible interpretations of the infinitely rich story of Abraham and Isaac found in Genesis 22. Against the background of what I call "the traditional reading," I compare the views of William Blake, Johannes de Silentio, and Søren Kierkegaard. Blake's poetry and painting suggest a striking alternative to our usual understanding of the story, but they finally require too radical a departure from the Biblical text. The pseudonym de Silentio's views on obedience to God, presented (...) in Fear and Trembling, are even more problematic, however. They are at odds with Kierkegaard's powerful account of love of neighbor, related under his own name in Works of Love, for instance. The God who is Love would not literally require murderous intent toward a neighbor, I conclude, but that same God might issue an "ironic" command designed to lift us out of an abominable ritual. This paper contributes to debates on the benefits of single-sex and co-educational school environments by considering both single-sex versus co-educational schools and single-sex versus co-educational classes in co-educational schools. Two research studies provide the empirical basis for this discussion. One study was a 10-year-long investigation of two Australian secondary schools which had been single-sex schools and became co-educational secondary schools over a two-year period. The second study involved a two-year investigation in an English co-educational secondary school where single-sex mathematics classes (...) were introduced for one cohort of pupils for five school terms, after which mixed-sex classes were reintroduced. Evidence relating to academic self-concept, pupil, parent and staff perceptions and academic achievement are discussed. Overall, the evidence suggests that co-educational environments create possible social/interaction disadvantages for girls, but that academic self-concept is not adversely affected by transferring from single-sex environments into mixed-sex ones. This article explores the effect that communications technology has on hegemonic power. The first section establishes a theoretical framework combining Foucault’s carceral archipelago theory with Chiara Bottici’s concept of the social imaginal describing the medium through which inter- and trans-subjective imagination occurs. The remainder employs this framework to examine how four technological innovations (print media, radio, television and Internet) impact the (re)production of discursive hegemonic ideology, integrating a variety of historical and contemporary theories on public discourse and ideological dominance.
