Brain Organoids in their current state of development are patentable. Future brain organoids may face some challenges in this regard, which I address in this contribution. Brain organoids unproblematically fulfil the general prerequisites of patentability set forth in Art. 3 (1) EU-Directive 98/44/ec (invention, novelty, inventive step and susceptibility of industrial application). Patentability is excluded if an invention makes use of human embryos or constitutes a stage of the human body in the individual phases of its formation and development. Both (...) do not apply to brain organoids, unless ES-cells are used. Art. 6 (1) EU-Directive 98/44/ec excludes patentability for inventions “the commercial exploitation of which would be contrary to ordre public or morality”. While there is no conceivable scenario, in which the commercial application of current brain organoids violates the ordre public, the same is not necessarily true for future brain organoids. Keeping in mind that a development of consciousness-like abilities in future brain organoids cannot be excluded and that an ability for both physical and psychological suffering has been theorized, both of which are aspects of the ordre public, certain applications of future brain organoids may constitute a violation of the ordre public and therefore lead to an exclusion of patentability. Transparency has achieved a mythical status in society. Myths are not false accounts or understandings, but deep-seated and definitive descriptions of the world that ontologically ground the ways in which we frame and see the world around us. We explore the mythical nature of transparency from this perspective, explain its social-historical underpinnings and discuss its influence on contemporary organizations. In doing so, we also theorize in a more general sense about the relationship between myth, as a foundational understanding and description (...) of the world, and the constellation of metaphors, as specific ways of framing and seeing organizational reality, to which it gives rise. While observations and evidence can always be adduced to challenge a particular set of metaphors, the endogenous force of the myth may sustain the overall project. ABSTRACTDrawing upon archival material, this article offers an overview and discussion of the manner in which the topic of representative democracy was addressed during conferences of the Mont Pèlerin Society in the period between 1947 and 1998. I contend that the most common critique of democracy amongst MPS members was that democratic politics has the tendency to lead to interventions in the economy, thus distorting or even destroying the market mechanism. Yet most members were simultaneously convinced that democracy is a (...) necessary condition of individual liberty, which meant that democracy, rather than being either a mere nuisance or an irredeemable obstacle that must be rejected wholesale, posed a genuine problem for them. Whilst at MPS conferences a myriad of solutions to the problem of democracy was explored, one such solution was suggested most often and theorized most thoroughly, namely the imposition of constitutional limits on popular power; a proposal that often amounted to an attempt radically to circumscribe citizens’ influence on the legislature. I conclude by reflecting upon the implications of these findings for the scholarly study of neoliberal thought on democracy. (shrink)

Gotthold Ephraim Lessing stands out among the thinkers of the 18th century for his refusal to synthesize theology and philosophy. But due to his notorious ambivalence about religious questions, even Lessing’s contemporaries remained uncertain whether he ultimately sided with the former or the latter. The short dialogue Hercules and Omphale is, to the detriment of research on this topic, largely unknown. I show that the dialogue offers in a nutshell Lessing’s comprehensive analysis of the intellectual and religious situation of his (...) time. By calling on the mythical travesty of the Asian queen and the Greek hero, Lessing illustrates the mutual attraction that has led astray both Enlightenment philosophy and contemporary Lutheran orthodoxy. Implicitly, his diagnosis of the aberrations of philosophy and theology sheds light on Lessing’s own position. The twofold criticism is an attempt to restore theology as well as philosophy in their genuine forms and to reestablish their proper relationship. Through his twofold restitutio in integrum, Lessing is able to reopen the quarrel between orthodoxy and the Enlightenment and, thus, to radically renew the all but forgotten theologico-philosophical antagonism. In discussions about whether the Principle of the Identity of Indiscernibles is compatible with structuralist ontologies of mathematics, it is usually assumed that individual objects are subject to criteria of identity which somehow account for the identity of the individuals. Much of this debate concerns structures that admit of non-trivial automorphisms. We consider cases from graph theory that violate even weak formulations of PII. We argue that (i) the identity or difference of places in a structure is not to be (...) accounted for by anything other than the structure itself and that (ii) mathematical practice provides evidence for this view. This article outlines what a formal theory of truth should be like, at least at first glance. As not all of the stated constraints can be satisfied at the same time, in view of notorious semantic paradoxes such as the Liar paradox, we consider the maximal consistent combinations of these desiderata and compare their relative advantages and disadvantages.

In this article, I turn my attention to the figure of the ignorant master, Joseph Jacotot, that is depicted in The Ignorant Schoolmaster. Five Lessons in Intellectual Emancipation (1991). I will show that the voice of Jacotot can actually be read as a reaction against the progressive figure of the teacher which, following Rancière's view, can be seen as effecting a stultification. In some respects, however, Rancière's analysis of the pedagogical order no longer seems to be valid in today's partly (...) reconfigured, pedagogical order that depicts the teacher in terms of facilitation. Yet, the figure of the facilitator can be seen as effecting a stultification as well. Therefore, I will stress that Jacotot's voice is highly relevant today. The most important difference between the figure of the (old and current) figure of the stultifyer and that of the ignorant master is identified in their starting point. The stultifying master starts from the assumption of inequality. S/he transforms taught material (words, text, images, etc.) into objects of knowledge or resources for competence development that open the door to another world. The ignorant master (Jacotot) assumes equal intelligence and draws attention to a thing in common. According to Rancière, the ignorant master keeps the door closed and puts his/her students in the presence of a thing in common. (shrink)

It is a commonly raised argument against the family resemblance account of concepts that there is no limit to a concept's extension. An account of family resemblance which attempts to provide a solution to this problem by including both similarity among instances and dissimilarity to non-instances has been developed by the philosopher of science Thomas Kuhn. Similar solutions have been hinted at in the literature on family resemblance concepts, but the solution has never received a detailed investigation. I shall provide (...) a reconstruction of Kuhn's theory and argue that his solution necessitates a developmental perspective wchich builds on both the transmission of taxonomies between generations and a progressive development through history. One of the fundamental problems of epistemology is to say when the evidence in an agent’s possession justifies the beliefs she holds. In this paper and its prequel, we defend the Bayesian solution to this problem by appealing to the following fundamental norm: Accuracy An epistemic agent ought to minimize the inaccuracy of her partial beliefs. In the prequel, we made this norm mathematically precise; in this paper, we derive its consequences. We show that the two core tenets of Bayesianism (...) follow from the norm, while the characteristic claim of the Objectivist Bayesian follows from the norm along with an extra assumption. Finally, we consider Richard Jeffrey’s proposed generalization of conditionalization. We show not only that his rule cannot be derived from the norm, unless the requirement of Rigidity is imposed from the start, but further that the norm reveals it to be illegitimate. We end by deriving an alternative updating rule for those cases in which Jeffrey’s is usually supposed to apply. (shrink)

This article provides a review of scholarly approaches to assessing the impact of certification standards for sustainability. While we observe that some theoretical advances have afforded a better understanding of the potential impacts of adopting such standards, we also find that progress has been constrained due to a strong emphasis on assessing impact via linear causal pathways. This linear focus on the net effects for single stakeholders, such as farmers and producers, local communities and ecosystems, falls short of adequately capturing (...) the broader impact of certifications across social and ecological dimensions. Inspired by theories on complex systems thinking, we present a framework based on a systems-based impact logic that better captures and assesses the impacts of certification standards within broader social-ecological systems. Our framework can be used as a heuristic to design impact-related studies and assess the impact of certification standards across disciplinary vantage points and empirical contexts. (shrink)

This is a review of David Löwenstein’s book "Know-how as Competence. A Rylean Responsibilist Account".

Understanding natural phenomena is an important aim of science. Since the turn of the millennium the notion of scientific understanding has been a hot topic of debate in the philosophy of science. A bone of contention in this debate is the role of truth and representational accuracy in scientific understanding. So-called factivists and non-factivists disagree about the extent to which the theories and models that are used to achieve understanding must be true or accurate. In this paper we address this (...) issue by examining a case from the practice of synthetic chemistry. We investigate how understanding is obtained in this field by means of an in-depth analysis of the famous synthesis of periplanone B by W. Clark Still. It turns out that highly idealized models—that are representationally inaccurate and sometimes even inconsistent—and qualitative concepts are essential for understanding the synthetic pathway and accordingly for achieving the synthesis. We compare the results of our case study to various factivist and non-factivist accounts of how idealizations may contribute to scientific understanding and conclude that non-factivism offers a more plausible interpretation of the practice of synthetic chemistry. Moreover, our case study supports a central thesis of the non-factivist theory of scientific understanding developed by De Regt, namely that scientific understanding requires intelligibility rather than representational accuracy, and that idealization is one way to enhance intelligibility. ‘Non-Fascist Living’: Identity, Subjectivity, Resistance This article explores a recent form of academic and artistic resistance to contemporary modalities of fascism. This form of resistance is premised upon the argument that fascism lodges itself in the deepest recesses of the self, manifesting as fascist desires and beliefs. As such, traces of fascism are present in everyone, including people who do not otherwise hold fascistic ideas. This position goes on to argue that any critic of fascism must accordingly identify and eradicate (...) such traces inside her own subjectivity, by means of an ethics of ‘non-fascist living’. Critically examining the philosophical presuppositions of this position, the article asks what implicit conception of the subject and its relation to resistance is at work here. It brings this position into conversation with Michel Foucault, upon whose work it draws but whose understanding of resistance, it is argued, it reconceptualises. The article concludes by reflecting on the implications of this form of resistance for critical philosophical practice. (shrink)

We describe and analyse how large herbivores strongly diminished a woody vegetation, dominated by the unpalatable shrub Sambucus nigra L. and changed it into grassland. Density of woody species and cover of vegetation were measured in 1996, 2002 and 2012 in the grazed Oostvaardersplassen. In 2002 and 2012 we also measured density and cover in an ungrazed control site. In 2002 we measured intensity of browsing and bark loss of Sambucus shrubs in the grazed and control sites. In the grazed (...) site the density of Sambucus and Salix spp. declined significantly between 1996 and 2012, and large areas changed into grassland. In the control site the density of Sambucus increased significantly during this period, the density of Salix spp. did not change, and the vegetation consisted of a mixture of woody species and a field layer dominated by tall herbs. In 2002 and 2012 the percentages of dead Sambucus shrubs were significantly higher in the grazed site than in the control site. In 2002 the percentages of twigs browsed and ring barked stems of Sambucus shrubs were significantly higher in the grazed site than in the control site. Our results show that debarking caused mature Sambucus shrubs to die, but that heavy browsing may have helped this process. Our results also point to a significant neighbour effect on the break down of Sambucus, suggesting that Aggregational Resistance and Associational Palatability were both active. Essential conditions for the break down of this woody vegetation were the presence of large herbivores, the low ratio between the areas of summer and winter feeding habitats and the competition amongst herbivores. Browsing may have been responsible for seedling death, as seedlings were found only in the control site and not on the old and newly established grasslands in the grazed site. (shrink)

In the sequel, we derive the main tenets of Bayesianism from the relevant mathematical versions of Accuracy to which this characterization of the legitimate inaccuracy measures gives rise, but we also show that Jeffrey conditionalization has to be replaced by a different method of update in order for Accuracy to be satisfied. This papers deals with the class of axiomatic theories of truth for semantically closed languages, where the theories do not allow for standard models; i.e., those theories cannot be interpreted as referring to the natural number codes of sentences only (for an overview of axiomatic theories of truth in general, see Halbach[6]). We are going to give new proofs for two well-known results in this area, and we also prove a new theorem on the nonstandardness of a certain theory of (...) truth. The results indicate that the proof strategies for all the theorems on the nonstandardness of such theories are "essentially" of the same kind of structure. (shrink)

We investigate the conditions under which quasianalysis, i.e., Carnap's method of abstraction in his Aufbau, yields adequate results. In particular, we state both necessary and sufficient conditions for the so-called faithfulness and fullness of quasianalysis, and analyze adequacy as the conjunction of faithfulness and fullness. It is shown that there is no method of (re-)constructing properties from similarity that delivers adequate results in all possible cases, if the same set of individuals is presupposed for properties and for similarity, and if (...) similarity is a relation of finite arity. The theory is applied to various examples, including Russell's construction of temporal instants and Carnap's constitution of the phenomenal counterparts to quality spheres. Our results explain why the former is adequate while the latter is bound to fail. (shrink)

Significant claims about science education form an integral part of Thomas Kuhn's philosophy. Since the late 1950s, when Kuhn started wrestling with the ideas of ‘normal research’ and ‘convergent thought’, the nature of science education has played an important role in his argument. Hence, the nature of science education is an essential aspect of the phase-model of scientific development developed in his famous The Structure of Scientific Revolutions, just as his later work on categories and conceptual structures takes its starting (...) point in the transmission rather than the creation of concepts and categories. This article proposes a rethinking of Bourdieu’s habitus as context-specific, multiple, and decentralized based on nine months of participant-observation fieldwork with dumpster divers in New York City. Dumpster divers are mostly white, college-educated people in their twenties and thirties who eat food from retail trash as a lifestyle choice. Sociologists have recently theorized culture as a fragmented, incoherent “toolkit” of cultured capacities acquired throughout the lifetime. Bourdieu on the contrary, theorized socialized culture as habitus, a relatively durable, classed structure acquired (...) during childhood. While he recognized the possibility of acquiring “specific” habitus (Bourdieu 2000) later in life, he never developed the theoretical implications of socialization across multiple contexts. Building on ethnographic evidence of dumpster divers’ contradictory pursuit of food taste through the distasteful behavior of eating from the trash, I develop an alternative model of habitus as interlinked bundles of dispositions acquired in specific contexts. To theorize the bundled quality of habitus, I introduce what I call the practical congruity of dispositions. I show how rather than being disparate elements of a cultural repertoire, ways of seeing, common sense, dexterity, and orientations “make sense” in conjunction as actors mobilize them in specific contexts: dumpster diving acquires a commonsensical character based on the practical sense practitioners acquire. My understanding of habitus goes beyond the fragmentation assumed in notions of culture as a repertoire of cultured capacities, on the one hand, and the continuity and coherence premised in notions of primary and secondary habitus, on the other hand. Philosophy of science has developed immensely over the last half century. Subspecializations focused on particular scientific disciplines as well as generalist turns towards naturalization, practice, and engagement, not to mention an increasing internationalization, have all contributed to changing the practices of how philosophy of science is produced, published, and received, and to changing the relations between philosophy, philosophy of science, and science itself. This contribution to the Festschrift compiled in honor of Professor Finn Collin provides a brief sketch of these (...) developments as seen through the prism of how Finn Collin as both a philosopher and a philosopher of science has contributed to these developments, nationally and internationally. According to a predominant view, reflection is constitutive of personhood. In this paper I first indicate how it might seem that such an account cannot do justice to the socially embedded nature ofpersonhood. I then present a phenomenologically-inspired account of reflection as critical stance taking and show how it accommodates the social embeddedness of persons. In concluding, I outline how this phenomenological account is also not vulnerable to a number of additional challenges that have been raised against accounts that consider (...) reflection to be constitutive of personhood and what matters for responsibility. The colors we perceive are the outcome of an attempt to meaningfully order the spectral information from the environment. These colors are not the result of a straightforward mapping of a physical property to a sensation, but arise from an interaction between our environment and our visual system. Thus, although one may infer from a surface’ reflectance characteristics that it will be perceived as “colored,” true colors only arise by virtue of the interaction of the reflected light with the eye (...)
