In Between Facts and Norms, Jürgen Habermas works out the legal and political implications of his Theory of Communicative Action (1981), bringing to fruition the project announced with his publication of The Structural Transformation of the Public Sphere in 1962. This new work is a major contribution to recent debates on the rule of law and the possibilities of democracy in postindustrial societies, but it is much more. The introduction by William Rehg succinctly captures the special nature of the work, (...) noting that it offers a sweeping, sociologically informed conceptualization of law and basic rights, a normative account of the rule of law and the constitutional state, an attempt to bridge normative and empirical approaches to democracy, and an account of the social context required for democracy. Finally, the work frames and caps these arguments with a bold proposal for a new paradigm of law that goes beyond the dichotomies that have afflicted modern political theory from its inception and that still underlie current controversies between so-called liberals and civic republicans. The book includes a postscript written in 1994, which restates the argument in light of its initial reception, and two appendixes, which cover key developments that preceded the book. Here, for the first time in English, is volume one of Jurgen Habermas's long-awaited magnum opus: The Theory of Communicative Action. The present volume contains ten essays that provide an overview of Habermas's political thought since the original appearance of Between Facts and Norms in 1992 and extend his model of deliberative democracy in novel ways to issues untreated in the earlier work. Habermas's theory of democracy has at least three features (...) that set it apart from competing positions. In the midst of the current crisis that is threatening to derail the historical project of European unification, Jürgen Habermas has been one of the most perceptive critics of the ineffectual and evasive responses to the global financial crisis, especially by the German political class. This extended essay on the constitution for Europe represents Habermas’s constructive engagement with the European project at a time when the crisis of the eurozone is threatening the very existence of the (...) European Union. There is a growing realization that the European treaty needs to be revised in order to deal with the structural defects of monetary union, but a clear perspective for the future is missing. Drawing on his analysis of European unification as a process in which international treaties have progressively taken on features of a democratic constitution, Habermas explains why the current proposals to transform the system of European governance into one of executive federalism is a mistake. His central argument is that the European project must realize its democratic potential by evolving from an international into a cosmopolitan community. Searle's (1990) argument for the seems to rest on a confusion between ontological and epistemological claims. The potential consciousness of a mental state does not yield the same effect as does its actual consciousness, namely, the preservation of aspectual shape. Searle's distinction between the consciousness of an intentional object and that of a mental state, which is meant to counter the objection that deep unconscious rules cease to be deep once they become conscious, fails to do its appointed task.

James Bohman has succeeded in reinvigorating the old debate over explanation and understanding by situating it within contemporary discussions about sociological indeterminacy and complexity. I argue that Bohman's preference for a paradigm based on Habermas's theory of communicative action is justifiable given the explanatory deficiencies of ethnomethodological, rational choice, rule-based, and functionalist methodologies. Yet I do not share his belief that the paradigm is preferable to less formalized models of interpretation.

In this, the first of two articles outlining a theory of communicative competence, the author shows how the requirements of such a theory are to be found in an analysis not of the linguistic competence of a native speaker, but of systematic distortion of communication of the kind postulated by psychoanalytic theory. The psychoanalyst's hermeneutic understanding of initially incomprehensible acts and utterances depends on the explanatory power of this understanding, and therefore rests on theoretical assumptions. After a preliminary delineation of (...) the range of incomprehensible acts and utterances dealt with in psychoanalysis, the author presents an account of psychoanalysis as linguistic analysis. In the Heptateuch paraphrase, probably written in the first half of the fifth century A. D., its anonymous author embellishes the biblical narrative, which describes the temptation of the first humans in Paradise, with a strange detail: Adam and Eve, who before the Fall were blind and swathed in darkness, enjoy an extraordinary experience of light after eating the forbidden fruit, as promised by the devilish snake: The heavens glow with bright light and their eyes shine. This miraculous light, which (...) is not God’s gift, but the result of their rebellious and self-willed defiance of divine ordinance, symbolizes the presumptuousness of mankind’s progenitors in seeking to equal God. The metaphor of light is borrowed from the philosophic and religious ideas of Neoplatonism and of the mystery cults. These ideas suggest that a God-like status can be achieved through the individual pursuit of knowledge. The Heptateuch poet employs his depiction of the Fall to inveigh against such designs. A new scientific mentality of the late eighteenth century, dissatisfied with mechanistic and mathematical models of reasoning and demonstration, replaced static concepts with dynamic ones and defined reality in terms of complex interconnections. These thinkers believed there were basic regulative patterns common to all living entities which could be grasped only by analogical reasoning and comparison. But they also believed that the specific content, such as laws, languages, and nations, existed within a specific historic context. Historical understanding was seen as (...) combining a sense for the formal pattern of development with an acute awareness of the specific force field of historical and environmental determinants existing at a given moment. Objective Bayesian epistemology invokes three norms: the strengths of our beliefs should be probabilities, they should be calibrated to our evidence of physical probabilities, and they should otherwise equivocate sufficiently between the basic propositions that we can express. The three norms are sometimes explicated by appealing to the maximum entropy principle, which says that a belief function should be a probability function, from all those that are calibrated to evidence, that has maximum entropy. However, the three norms of objective Bayesianism (...) are usually justified in different ways. In this paper we show that the three norms can all be subsumed under a single justification in terms of minimising worst-case expected loss. This, in turn, is equivalent to maximising a generalised notion of entropy. We suggest that requiring language invariance, in addition to minimising worst-case expected loss, motivates maximisation of standard entropy as opposed to maximisation of other instances of generalised entropy. Our argument also provides a qualified justification for updating degrees of belief by Bayesian conditionalisation. However, conditional probabilities play a less central part in the objective Bayesian account than they do under the subjective view of Bayesianism, leading to a reduced role for Bayes’ Theorem. This paper addresses the problem of finding a Bayesian net representation of the probability function that agrees with the distributions of multiple consistent datasets and otherwise has maximum entropy. We give a general algorithm which is significantly more efficient than the standard brute-force approach. Furthermore, we show that in a wide range of cases such a Bayesian net can be obtained without solving any optimisation problem.
