In her account of a debate held at Princeton University between herself and Peter Singer, the lawyer and disability rights activist Harriet McBryde Johnson criticizes the ‘terrible purity of Singer's vision’. Although she certainly disagrees with the substance of Singer's arguments concerning disability and infanticide, this remark is best understood as a critique of their form. In this paper, I attempt to make sense of this critique. I argue that Singer's characteristic mode of argument, with its appeal (...) to a universal, neutral point of view, makes it impossible for McBryde Johnson to give voice to her particular experience and thus obscures her humanity. In order to clarify the positive contribution that an appeal to particular experience may make to moral reasoning, I draw a parallel with the transformative effects of the experience of beauty, arguing that McBryde Johnson's writing ought to be regarded as both morally and philosophically instructive. This paper charts the concepts of grip and the bodily auxiliary in Maurice Merleau-Ponty to consider how they find expression in disability narratives. Arguing against the notion of “maximal grip” that some commentators have used to explicate intentionality in Merleau-Ponty, I argue that grip in his texts functions instead as a compensatory effort to stave off uncertainty, lack of mastery, and ambiguity. Nearly without exception in Phenomenology of Perception, the mobilization of “grip” is a signal of impending loss, and is (...) offered as a strategy for managing failure rather than as an example of sure-footed mastery. I read Merleau-Ponty alongside Mary Felstiner's Out of Joint: A Public and Private Story of Arthritis to explore these other, attenuated dimensions of grip. Finally, the paper turns to Harriet McBryde Johnson's memoir Too Late to Die Young as an example of a way of thinking disabled embodiment otherwise. (shrink)

Two rival paradigms permeate bioethics. One generally favors eugenics, euthanasia, assisted suicide and other methods for those with severely restricting physical and cognitive attributes. The other typically opposes these and favors instead ample support for "persons of difference" and their caring families or loved ones. In an attempt to understand the relation between these two paradigms, this article analyzes a publicly reported debate between proponents of both paradigms, bioethicist Peter Singer and lawyer Harriet McBryde Johnson. At issue, (...) the article concludes, are two distinct axiomatic sets of values resulting in not simply different styles of rhetoric but different vocabularies, in effect two different languages of ethics. This paper seeks to redress the marginalization of Adorno in environmental philosophical discourse. Kate Soper describes two opposing ways of conceiving nature. There is the redemptive “nature-endorsing” paradigm that lays claim to the intrinsic value or “otherness” of nature. Conversely, the “nature-sceptical” approach denies that we can access originary, untouched nature. This paper argues that the significance of Adorno’s treatment of natural beauty lies in how he brings these approaches together. In writings that resonate with the dual connotations of Sebald’s (...) phrase “after nature”, Adorno both affirms the skeptical point that we cannot transcend a human history alienated from nature as well as retaining redemptive hope wherein art “after” nature seeks creative possibilities from out of the very ruins of history marked by nature’s destruction. In this paper, I argue that a coalition of the arts and sciences might draw upon György Márkus’s extensive studies of the topography of ‘high’ (...) culture. I reconstruct Márkus’s conceptual map of the arts and sciences as regions of ‘high’ cultural activity, each with their own criteria of value yet subject to an integral unity and shared ambition. Both regions of ‘high’ culture aim to create original works of significance for an engaged public. I then examine the implications of Márkus’s claim that the classical vocation of robust, public-oriented culture has run aground. The field of problems that this paper traverses are not the ecological crises of the Anthropocene per se. I attend rather to Márkus’s account of the neoliberal erosion of cultural infrastructure where democratic publics might engage with such problems. (shrink)

These essays showcase the value of the narrative arts in investigating complex conflicts of value in moral and political life, and explore the philosophical problem of moral dilemmas as expressed in ancient drama, classic and contemporary novels, television, film, and popular fiction. From Aeschylus to Deadwood, from Harriet Beecher Stowe to Harry Potter, the authors show how the narrative arts provide some of our most valuable instruments for complex and sensitive moral inquiry.

Ryan Johnson and Biko Mandela Gray study the relationship between Hegel's Phenomenology of Spirit and Black Thought from Frederick Douglass to Angela Davis. This staging of an elongated dialectical parallelism between Hegel's classic text and major 19th-20th-century Black thinkers explodes the western canon of philosophy. Johnson and Mandela Gray show that Hegel's abstract dialectic is transformed and critiqued when put into conversation with the lived dialectics of Black Thought: from Frederick Douglass and Harriet Jacobs through to Malcolm (...) X and Angela Davis. While Hegel articulates the dynamic logics that we see in these Black thinkers, when they are placed in parallel and considered together, the whiteness, both explicit and implicit, of Hegelianism itself is revealed. Forcing Hegelianism into the embodied history of Black Thought reveals a phenomenology of America whose spirit is Black. (shrink)

This article is an attempt to explore the theme of ‘humanhood’ in the Fourth Gospel. The most important questions to be posed at the outset are the following: who is the model human presented in the gospel as per the Johannine community standards? How can a person acquire humanhood status according to the Johannine community? The divine and human interaction in the life and ministry of Jesus dynamically introduces the life ethics and mission aspects of the Johannine community. According to (...) the Johannine community standards, people can achieve ‘humanhood’ status exclusively in relation to Jesus. As the community of John emphasises humanhood in relation to Jesus, a person can overcome all sorts of human-made boundaries, including the sexual, racial and class-oriented boundaries through the mediation of Jesus. This further means that the all-inclusive mission of Jesus foregrounds a new criterion for ‘humanhood’ in the Johannine community context. The article concludes by stating that the Johannine understanding of humanhood can be considered as a paradigm in the contemporary global scenario. Contribution: This article contributes to the reader a wider hermeneutical framework and a new way forward in interpreting the gospel according to John by taking into consideration the humanhood aspects. As a theological and contextual interpretation of the Fourth Gospel, the article fits well within the scope of HTS Teologiese Studies/Theological Studies. (shrink)

It seeks to demonstrate that Mill’s Subjection of Women still has close ties with the earlier feminist thought of the South Place Chapel circle. Specifically, it will show that key (...) arguments like the characterisation of marriage as slavery, the pernicious moral effects of gendered education, and the social benefits of women’s liberation feature in the early essays by Mill himself, Harriet Taylor Mill, William Bridges Adams, and William Johnson Fox as well as in Mill’s Subjection. My thesis is that moral ignorance does not imply a failure to care adequately about what is in fact morally significant. I offer three cases: one in which someone is ignorant of the precise nature of what she cares about; one in which someone does not reflect on the significance of what she cares about in a particular set of circumstances, and one in which someone cares deeply about two morally significant considerations while being mistaken about their relative significance. I (...) argue that these agents all clearly care at least “adequately” about everything morally significant, including the very considerations that in fact make their acts wrong. This creates theoretical room for a way of thinking about culpable moral ignorance that respects the key concerns of those in the voluntarist tradition who have held that moral ignorance is typically blameless, within an approach to thinking about moral responsibility according to which we are blameworthy for that which manifests poor quality of will; caring adequately does not require moral omniscience, but motivated moral ignorance and moral ignorance that reflects indifference to things that matter morally are still blameworthy. My thesis also suggests a fruitful change of direction for quality-of-will theorists: we should articulate the nature and structure of the standards for adequate caring, i.e. those that specify what it is to care “adequately”. I close by offering an initial proposal as to what these standards might look like and identifying four promising avenues for further research on this topic. (shrink)

The question of what it means to be human has never before been more difficult and more contested. The human, with a complicated social history that his rarely been examined, remains entrenched in traditional Enlightenment thinking. Human, All Too Human considers how we might radicalize our notion of the human. Can the human be thought outside humanism? Any rethinking of the human places us immediately inside an ever-widening field of contrasting labels: animate and inanimate, natural and artificial, living and dead, (...) organic and mechanistic. These and other boundary confusions at the frontier of the human are the subject of this volume, as each essay takes up one of three disputed border identities: animals, things or children. Human, All Too Human examines how we explain our interest in anthropomorphism and our fascination with species categorizations. Essays explore what we mean by "things" and how the integrity of the human may already be compromised by them. The nine essays in this volume all attempt to rethink the category of the human, challenging some of our most cherished cultural classifications. For the Love of Cinema brings together a wide range of film scholars to explore the relationship between cinephilia and pedagogy. All of them ask whether cine-love can inform the serious study of cinema. Chapter by chapter, writers approach this question from various perspectives: some draw on aspects of students' love of cinema as a starting point for rethinking familiar films or generating new kinds of (...) analyses about the medium itself; others reflect on how their own cinephilia informs the way they teach cinema; and still others offer new ways of writing with a love of cinema in the age of new media. In this book, Bonnie Lander Johnson explores early modern ideas of chastity, demonstrating how crucial early Stuart thinking on chastity was to political, medical, theological and moral debates, and that it was also a virtue that governed the construction of different literary genres. Drawing on a range of materials, from prose to theatre, theological controversy to legal trials, and court ceremonies - including royal birthing rituals - Lander Johnson unearths previously unrecognised opinions about chastity. The “beyond a reasonable doubt” standard of proof, currently used in criminal trials, is notoriously vague and undermotivated. This paper discusses two popular strategies for justifying our choice of a particular precise interpretation of the standard: the “ratio-to-standard strategy” identifies a desired ratio of trial outcomes and then argues that a certain standard is the one that we can expect to produce our desired ratio, while the “utilities-to-standard strategy” identifies utilities for trial outcomes and then argues that a certain standard (...) maximizes expected utility. I argue that both strategies fail on their own terms, by requiring us to perform calculations that we simply cannot perform. No version of either strategy can be performed by jurors or legislators in our actual epistemic position, in which, since we do not know which of the defendants in our trial system are genuinely innocent and which are genuinely guilty, we cannot determine the extent to which our trial system tends to produce evidence that misleadingly incriminates the innocent or misleadingly exonerates the guilty. But we would need to determine this in order to perform the calculations required by any possible version of the ratio-to-standard or utilities-to-standard strategies. I then suggest some empirical reasons to be pessimistic about the evidence produced by our actual trial system. The upshot is that the “beyond a reasonable doubt” standard lacks a clear interpretation and rationale, nor do we have a promising way to identify an alternative. This article presents three experiments that examine the relation between order effects and frequency learning, with the following results. First, when frequencies of occurrence are presented as sequences of real events, base rates can be learned and used with a high degree of accuracy. However, conditional probabilities for multiple sequentially presented evidence items cannot be completely learned, due to the distortion of a recency order effect for actual decisions. Second, there is also a recency order effect for belief evaluations, which (...) cannot be eliminated even if base rates are used correctly. Third, base rates learned in one environment can be transferred to another environment, but the transfer soon diminishes due to learning in the new environment. However, belief evaluations are not transferred from one environment to another The existing models of frequency learning cannot explain the order effect for actual decisions because they do not consider sequential information. The existing models of belief updating can explain both types of order effects, but they do not have any mechanisms for frequency learning. To account for the complete spectrum of frequency learning and order effects, we outline our initial effort in developing a unified model that integrates frequency learning and order effects. With most states now making sex offender registration information available to the public, journalists must balance their obligation to inform the public about potential dangers with respect for individuals' rights. This article examines the problems journalists face in truth telling and minimizing harm and offers suggestions for covering community notification. At minimum, we suggest journalists verify the accuracy of information received from police, make independent judgments about whether or not publication of sex offender registration information is warranted, and provide background (...) information on the scope and effectiveness of community notification in their areas. Some philosophers think that if someone acts wrongly while falsely believing that her act is permissible, this moral mistake cannot excuse her wrongdoing. And some think that this is because it is morally blameworthy to fail to appreciate the moral significance of non‐moral facts of which one is aware, such that mistakenly believing that one's act is permissible when it is in fact wrong is itself morally blameworthy. Here I challenge the view that it is blameworthy to fail to appreciate (...) the moral significance of non‐moral facts of which one is aware. This view seems okay if we focus on examples of people mistakenly believing that their wrongful acts are permissible. But it is not remotely plausible when we consider other varieties of moral mistake – such as believing that one's action is required when it is in fact supererogatory, believing that one's action is wrong when it is in fact permissible, and believing false things about the moral properties of others’ actions and of merely possible actions. The upshot is that those who maintain that moral mistakes cannot excuse are sent back to the drawing board; we need a new explanation of why this would be the case. (shrink)

As we move our social institutions from paper and ink based operations to the electronic medium, we invisibly create a type of surveillance society, a panopticon society. It is not the traditional surveillance society in which government officials follow citizens around because they are concerned about threats to the political order. Instead it is piecemeal surveillance by public and private organizations. Piecemeal though it is, It creates the potential for the old kind of surveillance on an even grander scale. The (...) panopticon is the prison environment described by Foucault in which prison cells are arranged in a large circle with the side facing the inside of the circle open to view. The guard tower is placed in the middle of the circle so that guards can see everything that goes on in every cell. When we contemplate all the electronic data that is now gathered about each of us as we move through our everyday lives --- intelligent highway systems, consumer transactions, traffic patterns on the internet, medical records, financial records, and so on --- there seems little doubt that we are moving into a panopticon. The social issues that arise from this are too numerous to detail here, but data retention is an important part of it. In the paper-and-ink world, documents are filed, files are boxed, boxes are put away or thrown away. The capacity for data retrieval and manipulation is, thereby, limited by the sheer difficulty and cost of storing, finding, searching, and manipulating large numbers of paper files. This inconvenience functions as a mechanism whereby the system forgets past information, not unlike the way we ourselves forget. However, the story is very different in the digital world; digital information is easy to store, easy to search and manipulate, and inexpensive to keep over extensive periods of time. Digitalized information systems tend, therefore, to collect extensive ancillary information and to retain this information indefinitely. Such lack of forgetfulness is likely to hamper the ability of individuals to shed their past, and start over with a clean slate. Concerns about data retention were expressed in the early literature on the social impact of computing, but for the most part the issue has dropped from sight. Rarely, has the social good of discarding accumulated personal data been addressed. In this paper, we want to make the case by examining diverse cases in which retention of information by either business or governmental institutions hinders the ability of individuals to start over or to act autonomously. We hope our argument for the good of forgetfulness will challenge the standard framework in which such issues have traditionally been debated. The privacy debate exemplifies the traditional framework insofar as it has been characterized as involving an inherent tension between, on the one hand, the needs of organizations and institutions for more accurate and efficient information systems so as to further their goals and, on the other hand, the desire of individuals to have information about them kept private. Regan argues against this framing of the privacy issue in favor of one that recognizes the social importance of personal privacy. We will examine the non-forgetfulness of information systems as a problem threatening not just individual interests but social good as well. Cryptography is often cited as the technology that will give us privacy and mediate against surveillance. One of the uses of cryptography, encryption, will allow us, some hope, to create confidentiality and relationships of trust that will facilitate many of the social arrangements we now have and perhaps make them even more secure than they are now. Electronic cash, for example, could be created in such a form that it would have the anonymity associated now with hard cash Others are less optimistic of the potential for cryptography to re-create relationships of trust in the new medium. One important point that already seems clear is that even if encryption technology will protect the confidentiality and integrity of electronic transactions and data, it will NOT stop the observation of traffic patterns on networks. This seems an important distinction to put on the table. Our patterns of communication will continue to be available, no matter what is encrypted, and an amazing amount of information can be gleaned from this data. In a sense, it means content integrity but no anonymity. This will indubitably impact how we interact and with whom we interact. (shrink)

Law is a critical determinant of health that public health practitioners encounter in everyday practice. Yet most do not receive any formal public health law training. This article discusses tangible opportunities for strengthening the capacity of current and future practitioners to leverage law to advance health equity priorities.

This dialogue discusses a proposal for the legalization of torture under specific circumstances and contrasts it with arguments for a total ban on torture. We consider three types of objection: first, that the difficulty of having adequate knowledge renders the stock “ticking bomb” scenario such a low-probability hypothetical as to present no realistic threat to a policy banning all torture; second, that empirically the information gleaned from torture is so unlikely to be reliable that it could not justify the moral (...) risk; and third, that sanctioning torture, even if only under the most extreme circumstances, would generate a ‘culture of torture,’ hence undermining fragile advances in international human rights rooted in unwavering commitment to human dignity. Compelling as these arguments appear, not all the conversants are wholly convinced by them; to this extent the dialogue ends aporetically. (shrink)
