According to the "definitivist" interpretation recently offered by John Deigh, the laws of nature are generated by reason operating on a definition of "law of nature," where the content of this definition is given by linguistic usage.2 I aim to accomplish two (...) things in this note. First, I want to locate as clearly as possible the point at which the orthodox and definitivist interpretations must disagree. Second, I want to show that once the claim on which these interpretations disagree is made clear, it is the orthodox interpretation that turns out to be the superior.31.Deigh takes as the initial test case for the various interpretations of Hobbes's moral theory the passage in chapter fifteen of Leviathan commonly known as "the reply to the fool." The fool, it will be recalled, argues that the precept that covenants be kept is not a rule of reason; Hobbes argues that the fool's "specious reasoning is neverthelesse [End Page 259] false," for to break a valid covenant is to violate a dictate of reason.4 Deigh summarizes his criticism of the orthodox interpretation of this passage as follows.On [the orthodox] interpretation, the dispute between Hobbes and the Fool concerns the deliverances of reason when reason is exercised in the service of self-interest, that is, when its exercise consists in determining the fittest means to achieving the ends set by egoistic desires. Such an exercise falls outside of the definition of reason that Hobbes gives in chapter five. It exemplifies strategic or means-to-end thinking and not deduction. Indeed, it corresponds to what Hobbes, in chapter three, defines as seeking... Hence, the orthodox interpretation of the laws of nature implies that Hobbes, in expounding the laws of nature, went back on the notion of reason he defined in chapter five. It implicitly attributes a fundamental inconsistency to Hobbes's philosophy.5The laws of nature—among which is the rule requiring the keeping of covenants6 —are held by Hobbes to be precepts of reason.7 Hobbes deems them, collectively, a science,8 by which he means that they are the deliverances of reason that pertain to a specific subject-matter.9 But, argues Deigh, Hobbes understands reason in a very specific way, a way that is distinct from the sort of means-end thinking that Hobbes describes in detail in chapter three and labels "seeking." Thus the orthodox interpretation of Hobbes's moral theory is at odds with Hobbes's own conception of the laws of nature individually as dictates of reason and collectively as the science of the true moral philosophy.It is of course true that the sort of thinking that Hobbes calls "seeking" and the sort of thinking that Hobbes calls "reasoning" are fundamentally different. Seeking takes its origin from experience: we have seen certain events following other events, and we retain a trace of that experience in imagination. Thus when we have some desire, there arises "the Thought of some means we have seen produce the like of that which we ayme at; and from the thought of that, the thought of means to that mean; and so continually, till we come to some beginning within our power."10 Those that are able to engage in this sort of thinking well are prudent,11 and on Hobbes's view, humans with comparable experience will exhibit a comparable degree of prudence.12 And because seeking requires only desire to regulate thought and some experience of events succeeding other events, there is nothing distinctively human about this form of thinking, and indeed Hobbes acknowledges that prudence is common to humans and other animals.13 By contrast, the process that Hobbes calls "reasoning" [End Page 260] is characterized independently of desire. This book offers an advanced introduction to central questions in legal philosophy. What factors determine the content of the law in force? What makes a normative system a legal system? How does law beyond the state differ from domestic law? What kind of moral force does law have? The most important existing views are introduced, but the aim is not to survey the existing literature. Rather, this book introduces the subject by stepping back from the fray to sketch the big (...) picture, to show just what is at stake in these old debates. Legal philosophy has become somewhat arid and inward looking. In part this is because the disagreement between the main camps on the important questions is apparently intractable. The first Young Researchers in Human–Robot Interaction Workshop, held on March 1, 2006 in Salt Lake City, Utah, provides insight into how to facilitate the establishment of the HRI community. Organized in conjunction with the first annual ACM/IEEE Human Robot Interaction Conference, the NSF-sponsored workshop assembled 15 graduate students from 5 different countries in computer science, psychology, engineering, and the arts to build the HRI community. This report highlights recommendations from discussion sessions, a synopsis of the plenary address, and representative (...) examples of the participants’ presentations. Participants emphasized that HRI is a unique field, requiring knowledge in computing, psychology, and communications despite the differences in the courses, methods, and philosophies across disciplines. The following are needed for future growth in HRI: stable, canonical robotics platforms for research purposes, a multidisciplinary community infrastructure to connect researchers, and a “Berlitz phrasebook” and collected reference materials for helping understand the “other” disciplines. Background This study introduces an empirical approach for studying the role of prudence in physician treatment of end-of-life (EOL) decision making.Methods A mixed-methods analysis of transcripts from 88 simulated patient encounters in a multicenter study on EOL decision making. Physicians in internal medicine, emergency medicine, and critical care medicine were asked to evaluate a decompensating, end-stage cancer patient. Transcripts of the encounters were coded for actor, action, and content to capture the concept of Aristotelian prudence, and then quantitatively and qualitatively (...) analyzed to identify actions associated with preference-concordant treatment.Results Focusing on codes that describe characteristics of physician-patient interaction, the code for physicians restating patient preferences was associated with avoiding intubation. Multiple codes were associated with secondary measures of preference-concordant treatment.Conclusions Prudent actions can be identified empirically, and research focused on the virtue of prudence may provide a new avenue for assessment and training in EOL care. In many ways, we live in propitious times for gay and lesbian people. In 1996, the Supreme Court struck down Colorado law prohibiting any kind of protected status based on sexual orientation. In 2003, the Supreme Court held that states may not criminalize sexual conduct between consenting adults of the same sex in private, so long as no money changes hands. In 2010, the Congress repealed the “Don't Ask, Don't Tell” policy that excluded openly gay men and lesbians from military (...) service. In 2013, the Supreme Court struck down key elements of the Defense of Marriage Act that prohibited any federal recognition of same‐sex marriage. Most states do not allow same‐sex marriage, but more and more states are joining the fold. Likewise, most U.S. states do not forbid discrimination based on sexual orientation, but the number that does is increasing. Arguably, no other social minority has made as much legal progress in so short a time. Despite these advances, the story of gay and lesbian people and the law is not yet finished, and the meaning of homosexuality for bioethics is still being written too. Concerns about gay and lesbian people remain important to bioethics in key domains, especially in seeing to the conferral of optimal health care benefits and in sorting through the priorities and social effects of research. Progress in these domains still involves lifting certain burdens of medical and social misjudgments about same‐sex attraction. (shrink)

Phenomenology, the philosophical method that seeks to uncover the taken-for-granted presuppositions, habits, and norms that structure everyday experience, is increasingly framed by ethical and political concerns. Critical phenomenology foregrounds experiences of marginalization, oppression, and power in order to identify and transform common experiences of injustice that render “the familiar” a site of oppression for many. The formal properties of orbits in a plane are explored by elementary topology. The notions developed from first principles include: convex and polygonal orbits; convexity; orientation, winding number and interior; convex and star-shaped regions. It is shown that an orbit that is convex with respect to each of its interior points bounds a convex region. Also, an orbit that is convex with respect to a fixed point bounds a star-shaped region.Biological considerations that directed interest to these patterns are indicated, and (...) the implications of the prospect of higher orders of star-shapedness mentioned. In the current study we look at whether subjective and proprioceptive aspects of selfrepresentation are separable components subserved by distinct systems of multisensory integration. We used the rubber hand illusion to draw the location of the ‘self’ away from the body, towards extracorporeal space , thereby violating top-down information about the body location. This was compared with the traditional RHI which drew position of the ‘self’ towards the body . We were successfully able to draw proprioceptive position of the limbs (...) in and out from the body suggesting body perception is a purely bottom-up process, resistant to top-down effects. Conversely, we found subjective self-representation was altered by the violation of top-down body information – as the strong association of subjective and proprioceptive factors found in the In Condition became non-significant in the Out Condition. Interestingly, we also found evidence that subjective embodiment can modulate tactile perception. (shrink)

If logic binds all reality, it would appear that God must be bound by logic. Swinburne argues that logic binds only actual human sentences. His case rests on an argument against Platonism, and the assertion that contradictions are incoherent. I argue that logic binds any possible language and so places a significant limit on God’s actions, that one need not be a Platonist to hold this, and that contradictions are not incoherent. In considering the argument that Thomas Szasz advances on behalf of his claim that there is no mental illness, it becomes evident that despite his stated assumptions, moral valuations are necessarily tied up with assessment of disease. By following his remarks about differential diagnosis, it becomes evident that behavior is the occasion for differential diagnosis, that behavior determines which anatomical deviations are counted as diseases, and that Szasz's insistence on autonomy introduces his own moral assumptions into the concept of disease. (...) Consequently, although none of these considerations disproves Szasz's conclusions about the existence of mental illness, neither can his argument support the weight of that conclusion. Holistic ethics education in the professions is never fully served by a reliance on regulatory compliance alone. Data obtained from penalties due to corporate non-compliance in specific professions rarely describe the underlying ethical failures that are the foundation for “rule-breaking” in the professions. However, “violations” data may serve as a springboard for an educational discussion and approach that helps professionals (and those studying to become professionals) to understand the basic moral reasoning that underlies the “good” that is served by adhering (...) to professional Codes of Conduct, Codes of Practice, Codes of Ethics, and the professional regulatory environment. We here use data obtained from the US FDA, US DOJ, and from Violations Tracker and compare these data with the IFPMA (International Federation of Pharmaceutical Manufacturing Association) Ethos and guiding principles. These side-by-side linkages serve as a mechanism to help students assess which ethical principles are at the core of each such violation in the pharmaceutical industry. We further recommend that this approach be incorporated into ethics education, especially beginning at the undergraduate level, as prophylaxis to ethical lapses in later professional life. (shrink)

The category of jus post bellum is a welcome addition to discussions of the justice of war. But, despite its handy Latin label, we will argue that it cannot be properly understood merely as a set of corollaries from jus ad bellum and jus in bello. Instead, an acceptable theory of justice in the postwar period will have to draw on a broader set of normative ideas than those that have been the focus of the just war tradition.
