This article explores the co-existence of, and relationship between, alternative education in the form of home education and mainstream schooling. Home education is conceptually subordinate to schooling, relying on schooling for its status as alternative, but also being tied to schooling through the dominant discourse that forms our understandings of education. Practitioners and other defenders frequently justify home education by running an implicit or explicit comparison with school; a comparison which expresses the desire to do ‘better’ than school whilst simultaneously (...) encompassing the desire to do things differently. These twin aims, however, are not easy to reconcile, meaning that the challenge to schooling and the submission to norms and beliefs that underlie schooling are frequently inseparable. This article explores the trajectories of ‘better than’ and ‘different from’ school as representing ideas of utopia and heterotopia respectively. In particular I consider Foucault's notion of the heterotopia as a means of approaching the relationship between school and other forms of education. Whilst it will be argued that, according to Derrida's ideas of discursive deconstruction, alternative education has to be expressed through the dominant educational discourse, it will also be suggested that employing the idea of the heterotopia is a strategy which can help us explore the alternative in education. Informal home education occurs without much that is generally considered essential for formal education—including curriculum, learning plans, assessments, age related targets or planned and deliberate teaching. Our research into families conducting this kind of education enables us to consider learning away from such imposed structures and to explore how children go about learning for themselves within the context of their own socio-cultural setting. In this paper we consider what and how children learn when no educational agenda is arranged for them (...) and we link this manner of learning to the Deweyan ideas of learning as transactional and learning-in-context. We also use our empirical evidence to explore the notion of ZPD with regard to informal learning and to consider how children, without specific guidance, go about charting a course of learning through the ZPD. We consider the quality of informal learning particularly with regard to the educational aim of developing reflective and critical thinking, showing how these are integral to informal learning. We suggest that a much wider conception of what learning is and how it happens is needed, away from the confines of formal educational structures. (shrink)

This book considers who should undertake humanitarian intervention in response to an ongoing or impending humanitarian crisis. It develops a normative account of legitimacy to assess not only current interveners, but also the desirability of potential reforms to the mechanisms and agents of humanitarian intervention.

Recent discussions in Just War Theory have been framed by a polarising debate between “traditionalist” and “revisionist” approaches. This debate has largely overlooked the importance of an applied account of Just War Theory. The main aim of this essay is to defend the importance of this applied account and, in particular, a nonideal account of the ethics of war. I argue that the applied, nonideal morality of war is vital for a plausible and comprehensive account of Just War Theory. A (...) subsidiary aim of the essay is to show that once we appreciate the importance of the applied, nonideal account, it becomes clear that the positions proposed by revisionists and traditionalists are, in fact, much closer than often presumed. Although the ideas of Soren Kierkegaard played a pivotal role in the shaping of mainstream German philosophy and the history of French existentialism, the question of how philosophers should read Kierkegaard is a difficult one to settle. His intransigent religiosity has led some philosophers to view him as essentially a religious thinker of a singularly anti-philosophical attitude who should be left to the theologians. In this major new survey of Kierkegaard's thought, George Pattison addresses this question head on and (...) shows that although it would be difficult to claim a "philosophy of Kierkegaard" as one could a philosophy of Kant, or of Hegel, there are nevertheless significant points of common interest between Kierkegaard's central thinking and the questions that concern philosophers today. Taking up the critique of theology found in the work of Heidegger, George Pattison argues for a model of thinking about God that would not be liable to the charge of `enframing' that Heidegger sees as characteristic of technological thinking. He constructs his case in relation to particular issues in bioethics, the place of theology in the university, the arts, and the contemporary experience of living in the city.

In this contribution, I defend the standard list of jus ad bellum principles. In The Ethics of War and the Force of Law: A Modern Just War Theory, Uwe Steinhoff endorses only three principles of jus ad bellum (right intention, just cause, and proportionality) and claims that the others are redundant. I argue that, although fundamentally all jus ad bellum principles can be reduced to proportionality, in practice it is vital to retain the main jus ad bellum criteria as separate (...) principles. According to the Argument for Autonomous Mental Disorder, mental disorder can occur in the absence of brain disorder, just as software problems can occur in the absence of hardware problems in a computer. This article argues that the AAMD is unsound. I begin by introducing the “natural dysfunction analysis” of disorder, before outlining the AAMD. I then analyze the necessary conditions for realizer autonomous dysfunction. Building on this, I show that software functions disassociate from hardware functions in a way that (...) mental functions do not disassociate from brain functions. This paper argues that proper functions are proximal functions. In other words, it rejects the notion that there are distal biological functions – strictly speaking, distal functions are not functions at all, but simply beneficial effects normally associated with a trait performing its function. Once we rule out distal functions, two further positions become available: dysfunctions are simply failures of proper function, and pathological conditions are dysfunctions. Although elegant and seemingly intuitive, this simple view has had surprisingly little uptake in (...) the literature. Indeed, our position departs from that of almost every theorist who has engaged with the issue at any depth. We start by presenting three arguments for the position that proper functions are proximal: one from the specificity of functions, one from their relation to intervention, and one from their relation to pathology. We then consider two case studies evidencing the trouble that accepting distal functions causes for philosophical reflection on the nature of pathological conditions. Finally, we anticipate and respond to three objections: that there can be failure of function without dysfunction; that our account is unacceptably revisionary in respect of normal function-talk; and that our thesis over-generalises from a narrow set of cases. This article considers the duty to undertake humanitarian intervention. It first examines the arguments for the duty to intervene and questions the possibility of supererogatory humanitarian intervention. It then considers the leading objections to this duty which, it is argued, are largely unpersuasive. In the final section, the article considers the duty to intervene in the context of the responsibility to protect doctrine, which provides the framework within which debates about humanitarian intervention now in large part occur.

This study shows how Kierkegaard's mature theological writings reflect his engagement with the wide range of theological positions which he encountered as a student, including German and Danish Romanticism, Hegelianism and the writings of Fichte and Schleiermacher. George Pattison draws on both major and lesser-known works to show the complexity and nuances of Kierkegaard's theological position, which remained closer to Schleiermacher's affirmation of religion as a 'feeling of absolute dependence' than to the Barthian denial of any 'point of contact', (...) with which he is often associated. Pattison also explores ways in which Kierkegaard's theological thought can be related to thinkers such as Heidegger and John Henry Newman, and its continuing relevance to present-day debates about secular faith. The secondary literature generally ignores the fact that he also took an active role in the public debate about the significance of the modern age that was taking shape in the flourishing feuilleton literature during the period of his authorship. Through a series of sharply focussed studies, George Pattison contextualises Kierkegaard's religious thought in relation to the debates about religion, culture and (...) society carried on in the newspapers and journals read by the whole educated stratum of Danish society. Pattison brings Kierkegaard into relation to not only high art and literature but also to the ephemera of his contemporary culture. In the Bible, the human God-relationship is typically established through and by the phenomenon of “calling”. However, for much subsequent theology, this has been displaced by “vision”, “taste” or “feeling”. Referring to the notion of an inner word, the paper follows Kierkegaard's treatment of silence as, alternatively, a mode of inattention and attention to such an inner word. With Heidegger, the paper turns to the notion of vocation, both as in the discussion of the call of conscience in Being and (...) Time and the poetic vocation exemplified in the figure and poetry of Hölderlin. Finally, it considers the possible difference between such a poetic vocation and a divine calling. (shrink)

The paper argues that the question of Kierkegaard’s pseudonyms has been largely misconceived. Referencing comparable devices such as anonymity, noms de plume, and heteronyms, and drawing on Heidegger’s discussion of Kierkegaardian pseudonymity in the lectures on Parmenides, the paper further distinguishes between fictional characters (e. g. the Seducer and Assessor Vilhelm), noms de plume (H.H.), fictional editors, and pseudonyms proper. It is argued that in the first authorship only Constantin Constantius and Johannes Climacus approximate to the criteria Kierkegaard himself lays (...) down for pseudonymity. Furthermore, Kierkegaard’s anxieties regarding the form of publication of his works in the late 1840s reveals the whole project of pseudonymity collapsing into incoherence. By means of a comparison with Nietzsche, it is argued that Kierkegaard’s work is less a manifold of different literary personalities and more a play of revealing/concealing voices. In these voices there is nevertheless a literary watermark that makes Kierkegaard’s work as a whole distinctively Kierkegaardian. (shrink)

Recent work in the ethics of war has done much to challenge the collectivism of the convention-based, Walzerian just war theory. In doing so, it raises the question of when it is permissible for soldiers to resort to force. This article considers this issue and, in doing so, argues that the rejection of collectivism in just war should go further still. More specifically, it defends the ‘Individual-Centric Approach’ to the deep morality of war, which asserts that the justifiability of an (...) individual’s contribution to the war, rather than the justifiability of the war more generally, determines the moral acceptability of their participation. It then goes on to present five implications of the Individual-Centric Approach, including for individual liability to attack in war. (shrink)

Private military companies are taking over a growing number of roles traditionally performed by the regular military. This article uses the framework of just war theory to consider the central normative issues raised by this privatization of military force.

This paper attempts a partial, critical look at the construction and use of case studies in ethics education. It argues that the authors and users of case studies are often insufficiently aware of the literary nature of these artefacts: this may lead to some confusion between fiction and reality. Issues of the nature of the genre, the fictional, story-constructing aspect of case studies, the nature of authorship, and the purposes and uses of case studies as "texts" are outlined and discussed. If the resources used to wage wars could be spent elsewhere and save more lives, does this mean that wars are unjustified? This article considers this question, which has been largely overlooked by Just War Theorists and pacifists. It focuses on whether the opportunity costs of war lead to a form of pacifism, which it calls ‘Opportunity Costs Pacifism’. The article argues that Opportunity Costs Pacifism is, at the more ideal level, compelling. It suggests that the only plausible response to (...) Opportunity Costs Pacifism applies in highly nonideal circumstances. This has major implications for Just War Theory and pacifism since it is only at the highly nonideal level that war can be justified. (shrink)

In 2008 the United Kingdom Nursing and Midwifery Council (NMC) published the latest version of its code of conduct (The code: standards of conduct, performance and ethics for nurses and midwives). The new version marked a significant change of style in the Code compared with previous versions. There has been considerable controversy and the accrual of an extensive body of literature over the years in the UK and Europe criticizing nursing codes of ethics and questioning their ethical standing and their (...) usefulness. In this article we review the current NMC Code. We argue that the NMC has been misguided in labelling the Code as a code of ethics, and suggest that the new document falls short in many respects. At the time when existentialism was a dominant intellectual and cultural force, a number of commentators observed that some of the language of existential philosophy, not least its interpretation of human existence in terms of nothingness, evoked the language of so-called mystical writers. This book takes on this observation and explores the evidence for the influence of mysticism on the philosophy of existentialism. It begins by delving into definitions of mysticism and existentialism and then traces the elements of mysticism present (...) in German and French thought during the late nineteenth and early twentieth centuries. The book goes on to make original contributions to the study of figures including Kierkegaard, Buber, Heidegger, Beauvoir, Sartre, Marcel, Camus, Weil, Bataille, Berdyaev, and Tillich, linking their existentialist philosophy back to some of the key concerns of the mystical tradition. Providing a unique insight into how these two areas have overlapped and interacted, this study is vital reading for any academic with an interest in twentieth-century philosophy, theology, and religious studies. The moral permissibility of the intervention in Libya largely turns on two fairly tricky assessments: whether the situation was sufficiently serious at the time the intervention was launched and what the predominant purposes of the intervention were.

This article provides a theoretical critique from a particular ‘ideal type’ ethical perspective of professional codes in general and the United Kingdom Central Council for Nursing, Midwifery and Health Visiting (UKCC) Code of professional conduct (reprinted on pp. 77-78) in particular. Having outlined a specific ‘ideal type’ of what ethically informed and aware practice may be, the article examines the extent to which professional codes may be likely to elicit and engender such practice. Because of their terminological inexactitudes and confusions, (...) their arbitrary values and principles, their lack of helpful ethical guidance, and their exclusion of ordinary moral experience, a number of contemporary professional codes in health and social care can be arraigned as ethically inadequate. The UKCC Code of professional conduct embodies many of these flaws, and others besides. Some of its weaknesses in this respect are anatomized before some tentative suggestions are offered for the reform of codes and the engendering of greater ethical awareness among professionals in the light of greater public ethical concerns and values. The International Commission on Intervention and State Sovereignty's report, The Responsibility to Protect, argues that when a state is unable or unwilling to uphold its citizens? basic human rights, such as in cases of genocide, ethnic cleansing, and crimes against humanity, the international community has a responsibility to protect these citizens by undertaking humanitarian intervention. An essential issue, however, remains unresolved: which particular agent in the international community has the duty to intervene? In this article, I critically examine four ways (...) of assigning this duty. Although I highlight the benefits of institutionalising the responsibility to protect, I argue that we should adopt, in the short term at least, a consequentialist solution: humanitarian intervention should be the responsibility of the intervener that will be the most effective. Despite the popularity of arming rebels as a foreign policy option, there is very little, if any, detailed engagement with the ethical issues surrounding the practice. There is a growing literature on the ethical issues surrounding civil wars and, more specifically, the conditions for engaging in just rebellion; but the focus of this literature is largely on the question of the justifiability of the rebels themselves in engaging in civil war and their conduct when doing so, rather than the permissibility (...) of the arming of rebels by other agents. It is precisely this issue that I want to address here. Overall, I argue that the process should be generally eschewed. More specifically, this article seeks to establish that arming rebels is generally impermissible and only exceptionally morally permissible. The former, far more restrictive claim will be established in the first part of the article. The latter, more permissive claim will be established in the second part of the article. (shrink)

Justin Garson has recently advanced a Generalised Selected Effects Theory of biological proper function. According to Garson, his theory spells trouble for the Dysfunction Account of Disorder. This paper argues that Garson’s critique of the Dysfunction Account from the Generalised Theory fails, and that we should reject the Generalised Theory outright. I first show that the Generalised Theory does not, as Garson asserts, imply that neurally selected disorders are not dysfunctional. Rather, it implies that they are both functional and dysfunctional. A Phenomenology of the Devout Life is the first part of a three-part work, A Philosophy of Christian Life. Rather than approaching Christianity through its doctrinal statements, as philosophers of religion have often done, the book starts by offering a phenomenological description of the devout life as that is set out in the teaching of Francois de Sales and related authors. This is because for most Christians practice and life-commitments are more fundamental than formal doctrinal beliefs. Although George Pattison (...) will address the metaphysical truth-claims of Christianity in Part three, the guiding argument is that it is the Christian way of life that best reveals what these beliefs really are. As the work is a philosophical study, it does not presuppose the truth of Christianity but assumes only that there is a humanly accessible meaning to the intention to live a devout life, pleasing to God. This can be said to find expression in a certain view of selfhood that emphasizes the dimensions of feeling and will rather than intellect and that culminates in the experience of the annihilation of self. This is a model of selfhood deeply opposed to contemporary models that privilege autonomous agency and the devout life is therefore presented as offering a corrective to extreme versions of the contemporary view. In ‘Defending the City’ George Pattison seeks to defend the modern city against the charge — made, for example, by Graham Ward — that it is a merely secular phenomenon. Instead, he argues that, in its essence, it is multi‐dimensional and pluralistic, representing a range of diverse possibilities, creative as well as destructive. Also, the modern city is shown to anticipate the essential features of the postmodern city. The argument is illustrated by references to Pugin's critique of architectural eclecticism, (...) to Dostoevsky's invocation of the fantastical reality of St. Petersburg, to Kierkegaard and to Murnau's film Sunrise. This book examines the question of death in the light of Heidegger's paradigmatic discussion in Being and Time. Pattison reveals where and how Heidegger and theology part ways but also how Heidegger can helpfully challenge theology to rethink one of its own fundamental questions: human beings' relation to their death and the meaning of death in their religious lives.

The standing of the Danish philosopher and religious thinker S¿ren Kierkegaard has gone up in recent years. Yet because he regarded communication as being as much about self-concealment as about self-revelation, he can still seem a forbidding and difficult figure. The deliberate ambiguity of Kierkegaard, in which he set out to repel as much as to attract his readers, is here explored by George Pattison, who gives full attention to the scandalous element of the philosopher's work, and does not (...) shy away from his ambivalent attitudes towards sexuality, the body, marriage, and the family. This book is unlike other nontechnical introductions to Kierkegaard in that it does not seek to promote one part of Kierkegaard's writings over others, but offers, rather, a perspective on his life and output as a whole. That Kierkegaard grappled in his own age with many of the problems which beset our own, and frequently offered fascinating responses to those problems, is a major incentive to examine his thought today. By placing Kierkegaard in the context of a "crisis of faith"and making valuable connections between events in the philosopher's life and the development of his thinking, the author of this timely, readable, and attractively written study has produced a book which should be of interest to a wide nonspecialist readership. The legitimacy of the military is frequently overlooked in standard accounts of jus ad bellum. Accordingly, this paper considers how the military should be organized. It proposes a normative conception of legitimacy – the ‘Moderate Instrumentalist Approach’ – that outlines the qualities that a military should possess. It then assesses the three leading ways of organizing the military according to this approach: the use of private military and security companies (PMSCs), a conscripted force and the all-volunteer force (AVF). The private military industry has been growing rapidly since the end of the Cold War. The Morality of Private War uses normative political theory to assess the leading moral arguments for and against the use of private military and security companies.

This paper asks when a natural disease kind is truly 'reactive' and when it is merely associated with a corresponding social kind. I begin with a permissive account of real kinds and their structure, distinguishing natural kinds, indifferent kinds and reactive kinds as varieties of real kind characterised by super-explanatory properties. I then situate disease kinds within this framework, arguing that many disease kinds prima facie are both natural and reactive. I proceed to distinguish ‘simple dependence’, ‘secondary dependence’ and ‘essential (...) dependence’ between a natural kind and its classification, and argue that a natural kind is only really reactive, in an important sense, under conditions of essential dependence. On this basis, I offer a principled hypothesis for why psychiatric kinds tend to be more metaphysically unstable than paradigm somatic disease kinds. (shrink)

The present work looks to the sense of being called that lies at the heart of Christian life and asks what this shows us about what it is to be human and what the God-relationship means for those having such a call.

Defining Mental Disorder: Jerome Wakefield and His Critics, edited by Denis Forest and Luc Faucher, is essential reading for students and researchers in philosophy of medicine whose work is informed by that of Jerome Wakefield, or the disease debate in general. If you are anything like me, this book will open the door to a new depth of understanding of the harmful dysfunction analysis (HDA) and its methodical underpinnings, and an enriched appreciation of what is at stake in defining medical (...) disorder. To those confident that they understand Wakefield’s view and the surrounding debate, thinking perhaps that they do not need a refresher, I would say: perhaps you do not understand it as well as you think. Defining Mental Disorder provides much more than an overview of previously well-trodden ground. The chapters themselves, and Wakefield’s own detailed responses, help to elucidate a number of methodological nuances and peculiarities that have rarely been covered in such depth before. I was startled to learn how philosophically complex Wakefield’s position actually is, and how shallow my own understanding of it has been. It emerges as a far more nuanced and sophisticated account than I had given it credit for, and one that deserves serious reevaluation. (shrink)

The current mechanisms and agents of humanitarian intervention are inadequate. As the crisis in Darfur has highlighted, the international community lacks both the willingness to undertake humanitarian intervention and the ability to do so legitimately. This article considers a cosmopolitan solution to these problems: the creation of a standing army for the United Nations. There have been a number of proposals for such a force, including many recently. However, they contain two central flaws: the force proposed would be, firstly, too (...) small and, secondly, too dependent on major states. Accordingly, I argue that, to be a substantial improvement on the current situation, such a force would need to be, firstly, much larger and, secondly, in the hands of cosmopolitan democratic institutions. This two-part solution would solve the problems faced by current interveners, but is unlikely to be realised soon. Accordingly, I argue that our immediate efforts should instead be concentrated on improving regional organisations' ability to intervene. (shrink)
