Few twentieth century novelists have been subjected to as exhaustive and self-confident interpretations of the ultimate meaning of their work as was Franz Kafka. Veritable regiments of men of letters, psychoanalysts, sociologists, philosophers, and just plain busybodies followed the urge to formulate theories on Kafka’s concern with the alienation of Western man. Personal friends like Max Brod, dramatizers of the loveless world of The Trial, André Gide and Jean-Louis Barrault, analyzers of parental stunting of the child psyche like Josef Rattner, (...) observers of Kafka’s Austro-Bohemian world like Pavel Eisner and Peter Demetz, investigators of traditional themes in Kafka’s fiction—notably of their Hebraic and Chasidic ingredients—like André Nemeth and Hartmut Binder, hunters of allegorical and parabolic semantics like Norbert Fuerst and Clements Heselhaus, all seem to share one common trait in their vastly differing approaches: a singular disrespect for the frequent hints made by the author himself as to his ultimate objectives. In this book, Binder shows that at the heart of the most prominent arguments in favour of value-neutral approaches to overall freedom lies the value freedom has for human agency and development. Far from leading to the adoption of a value-neutral approach, however, ascribing importance to freedom’s agency value requires one to adopt a refined value-based approach. Binder employs an axiomatic framework in order to develop such an approach. She shows that a focus on freedom’s agency value has (...) far reaching consequences for existing results in the freedom ranking literature: it requires one to move beyond a person’s given all-things-considered preferences to the values underlying a person’s preference formation. Furthermore, it requires, as Binder argues, one to account for those differences between choice options which really matter to people. Binder illustrates the implications of her analysis for the evaluation of public policy and human development with the capability approach: only if sufficient importance is ascribed to freedom’s agency value can the capability approach keep its promises. ​. The paper starts by identifying dynamic stabilization as a defining feature of modern societies. This term refers to the fact that such a society requires (material) growth, (technological) augmentation and high rates of (cultural) innovation in order to reproduce its structure and to preserve the socioeconomic and political status quo. The subsequent sections explore the mechanisms and consequences of this mode of social reproduction, proceeding in three steps. First, three key aspects or ‘motors’ of dynamization are identified, namely the mechanisms (...) of (socio-economic) appropriation, (socio-cultural) acceleration and (socio-political) activation. In the second step, we argue that this ‘Triple-A-Mode’ of dynamic stabilization necessarily entails a logic of incessant escalation which eventually threatens to undermine itself, leading to a multifaceted process of destabilization. Unmistakable signs of this can be seen in the current financial, democratic, ecological and psychosocial crises. The third and last part briefly and very preliminarily sketches out the possible contours of a ‘post-growth’ society which could move beyond the current mode of dynamic stabilization. (shrink)

Hartmut Rosa advances an account of the temporal structure of society from the perspective of critical theory. He identifies three categories of change in the tempo of modern social life: technological acceleration, evident in transportation, communication, and production; the acceleration of social change, reflected in cultural knowledge, social institutions, and personal relationships; and acceleration in the pace of life, which happens despite the expectation that technological change should increase an individual's free time. According to Rosa, both the structural and (...) cultural aspects of our institutions and practices are marked by the "shrinking of the present," a decreasing time period during which expectations based on past experience reliably match the future. When this phenomenon combines with technological acceleration and the increasing pace of life, time seems to flow ever faster, making our relationships to each other and the world fluid and problematic. It is as if we are standing on "slipping slopes," a steep social terrain that is itself in motion and in turn demands faster lives and technology. As Rosa deftly shows, this self-reinforcing feedback loop fundamentally determines the character of modern life. (shrink)

It is an attempt to understand western modernity in terms of the different ways in which people imagine their social existence. Abastract The article analyses the intense public debate between the author Martin Walser and Ignatz Bubis caused by Walser's speach on the occasion of the award of the »Friedenspreis des Deutschen Buchhandels 1998«. lt argues that the conflict is based on two different conceptions of democratic public, public moral, and the function of moral elites in public. Both conceptions have religious implications and analogies in traditional theological conceptions of social corporations.

Während der größte Teil der Bevölkerung die kieferorthopädische Therapie, also die Veränderung der Zahn- bzw. Kieferstellung, als eine Behandlung betrachtet, die vor allem auf eine Verbesserung des Erscheinungsbildes zielt, sehen der kieferorthopädische und zahnärztliche Berufsstand sowie auch private und öffentliche Kostenträger in bestimmten Abweichungen von Zahn- oder Kieferstellungen eine Gefährdung der oralen Gesundheit und der Funktionsfähigkeit des Gebisses. Letztere Auffassung bestimmt das ärztliche Handeln in der Kieferorthopädie und begründet auch die Übernahme zumindest bestimmter Leistungen durch die gesetzlichen Krankenkassen. Anhand aktueller (...) wissenschaftlicher Erkenntnisse lassen sich jedoch in vielen Fällen keine (akuten oder potentiellen) gesundheitlichen oder essentiellen funktionellen Beeinträchtigungen und Risiken abweichender Zahnstellungen nachweisen. Ziel dieses Aufsatzes ist es, diesem Widerspruch nachzugehen. Im Folgenden werden wir aufzeigen, welche Faktoren die Anbieter kieferorthopädischer Leistungen beeinflussen, welches die entscheidenden Gründe und Grundlagen für die Behandlung sind und an welchen Kriterien sich die Leistungsübernahme durch die Krankenkassen orientiert. Dabei wird deutlich werden, dass die formalen Kriterien von Behandlung und Kostenübernahme, die tatsächliche Behandlungs- und Kostenerstattungspraxis, die Erwartungen derjenigen, die Behandlungsleistungen in Anspruch nehmen und der aktuelle Stand der Forschung zu erwartbaren Funktionsbeeinträchtigungen durch Zahnstellungsvariationen nicht zwanglos zu vereinbaren sind. Erforderlich erscheint ein interdisziplinärer normativer Diskurs über die Frage, wie die diagnostizierten Spannungen aufzulösen wären. Als Anregung für einen solchen Diskurs werden wir im Ausblick alternative Lösungsstrategien vorstellen. (shrink)

Franz Brentano gilt als einer der einflussreichsten Philosophen an der Wende vom 19. zum 20. Jahrhundert. Dennoch sind die Philosophiehistoriker noch zu keinem endgültigen Urteil über seine Bedeutung gelangt. Der Grund hierfür ist vor allem darin zu suchen, dass Brentanos Werk bis heute nur unzureichend zugänglich ist, was vor allem daran liegt, dass der größte Teil davon nur in handschriftlicher Form existiert: Nach seinem unvollendet gebliebenen Hauptwerk, der Psychologie vom empirischen Standpunkt, hat Brentano keine größere Arbeit mehr veröffentlicht. Im ersten (...) Teil analysiert Binder die Gründe für Brentanos zurückhaltende Publikationstätigkeit, wobei einerseits der konfliktbehaftete biographische Hintergrund und die komplexe Persönlichkeit des Philosophen, andererseits theoretische Probleme, eine psychologische Einheitswissenschaft zu formulieren, die ihn an der Fertigstellung seines Hauptwerks scheitern ließen, im Vordergrund stehen. Im zweiten Teil verfolgt der Autor die wechselhafte Geschichte von Brentanos philosophischem Nachlass, die ihrerseits die Rezeption seiner philosophischen Theorien stark behindert hat. (shrink)

The Convention on Biological Diversity opens the possibility to negotiate a legally binding Biosafety Protocol to assess and minimize risks in the field of transboundary transfer, handling, and use of organisms modified by genetic engineering. Two principles— the Precautionary Principle and the Principle of Familiarity—guiding the risk assessment as basis of import decisions on such organisms are discussed. Developing and European industrialized countries favor the Precautionary Principle. The U.S., Australia, Japan, and some others call for the Principle of Familiarity. These (...) two principles exhibit opposite effects on scientific progress in general and on scientific methodology of risk assessment in particular. With the example of risk assessment by the U.S. company Monsanto discussed below, it could be illustrated that the Principle of Familiarity opens the way for superficial evaluations based on citing arbitrary references while the Precautionary Principle is an incentive for developing and applying sound methodology in experimental risk assessment. on the transboundary transfer of such LMOs, for example, on the international exchange of and trade with transgenic seeds, grains, animals, or bacteria. The negotiations are based on Articles 19.3 and 8(g) of the Convention on Biological Diversity, elaborated during the Earth Summit in Rio de Janeiro, Brazil, in 1992, and on Decision II/5 of the Second Conference of the Parties to this Convention in Jakarta, Indonesia, in 1995 (see the appendix; for more documents, see www.biodiv.org). Until the Fourth Conference of the Parties in 1998, 172 states ratified this convention. This conference decided to finish the Biosafety Protocol in February 1999. In 1998, transgenic crops were allowed to be planted in eight (75%) countries of the world. As the country with the largest acreage of transgenic crops and as the main trader of LMOs, the United States cannot become a member of the protocol until it has ratified the Convention on Biological Diversity. Two decades ago, Rolf Landauer (1991) argued that “information is physical” and ought to have a role in the scientific analysis of reality comparable to that of matter, energy, space and time. This would also help to bridge the gap between biology and mathematics and physics. Although it can be argued that we are living in the ‘golden age’ of biology, both because of the great challenges posed by medicine and the environment and the significant advances that have been made—especially (...) in genetics and molecular and cell biology—we feel that information as an essential aspect of life has been neglected, or at least misunderstood. We therefore summon Maxwell’s Demon and its distant relative the ratchet, and apply these to biology. (shrink)

This paper explores the role of existential vulnerability in the experience of personal identity and how identity is found and created. Existential vulnerabilities mark a boundary between what humans can bring about willfully or manipulate to their advantage and what is resistant to such actions. These vulnerabilities have their origin, on an ontological level, in fundamental conditions of human existence. At the same time, they have implications on a psychological level when it comes to self-experience and identity formation. Narrative and (...) value-based identity depend on how a person relates to finitude and the ambiguous side of lived experience. Relational identity depends on how a person relates to existential aloneness and the fact that the meaning and value of our actions are partly out of our control; they are always also dependent on other people’s responses to us. Bodily identity makes us feel continuous and real, but at the same time vulnerable to death and the gaze and actions of others. Being ‘thrown’ into an arbitrary life context is also a form of existential vulnerability. Authentic psychological identities can develop by giving meaning to these circumstances and balancing acceptance of existential vulnerability with the courage to make choices and act. (shrink)

In this paper one aspect of Leibniz' optical ideas, the law of refraction, is the main topic. This law had been formulated before him by Snellius, Descartes and Fermat. Their mathematical equations are analogous in the relations between the geometrical parameters and the optical resistances, but they differ concerning the velocities of light. From the Leibnitian point of view this situation has its reasons in uncompletely developed principles. Leibniz had shown that the solution of this problem requires a new metaphysics (...) as well as other mathematical, namely infinitesimal methods, which are connected in Leibniz by his dynamics. As one of the influences of his dynamical statement, the beginning of a new type of physical explanation will be demonstrated, which replaced the construction of mechanical models in the 18th century.
