In Part 1 of this wide-ranging interview Heikki Patomäki discusses his early work and career up to the Global Financial Crisis. He provides comment on his role as a public intellectual and activist, his diverse academic interests and influences, and the many and varied ways he has contributed to critical realism and critical realism has influenced his work. In Part 2 he discusses his later work, the predicament of humanity and the role of futures studies.

Globalization is a topic of some anxiety among international lawyers. On the one hand, its fluid dynamics — fragmentation, deformalization and empire — undermine traditional diplomatic rules and institutions. On the other hand, the effort to reimagine international law in purely managerial terms appears intellectually shallow and politically objectionable. To avoid marginalization and instrumentalization, many lawyers have begun to think about international problems through a constitutional vocabulary and have often cited Kant in that connection. This Article argues that, while it (...) is always possible to grasp the world through a constitutional vocabulary, this does not provide determinate answers to international problems. Instead of an institutional architecture or a set of legal rules, constitutionalism is best seen as a mindset — a tradition and a sensibility about how to act in a political world. Contrary to a widespread assumption, Kant’s political writings may also be read in this fashion and, if so, a meaningful international transformation might necessitate not only legislative or institutional intervention but a professional and perhaps spiritual regeneration. In Greek Writers and Philosophers in Philo and Josephus Erkki Koskenniemi investigates how two Jewish writers, Philo and Josephus, quoted, mentioned and referred to Greek writers and philosophers.

By examining the relationship between international law and empire from early modernity to the present, this volume aims at deepening current understandings of the way international legal institutions, practices, and narratives have shaped specifically imperial ideas about and structures of world governance.

This Article is based on a larger work that seeks to map the uses of different legal vocabularies by ambitious European legal and political thinkers in the period of c.1300-1800 in order to defend, explain and organize the exercise of power outside the domestic commonwealth. The Article examines the ways in which English legal languages were used to think about, propagate and defend English transatlantic expansion. For most of that time, in their relations public and private power remained closely interwoven. (...) The pluralism of English law also contributed to the appearance of arguments from property and sovereignty in different configurations so that it is often hard to figure out which precise connotation is being made. The uses also varied significantly from Continental practices. I am above all interested in the imperial or colonial significance of these arguments. The point that emerges here is that by 1800, a conception of British Empire had arisen where the exercise of sovereign power was clearly derivative from and supplementary to claims about private property. To the Uttermost Parts of the Earth shows the vital role played by legal imagination in the formation of the international order during 1300–1870. It discusses how European statehood arose during early modernity as a locally specific combination of ideas about sovereign power and property rights, and how those ideas expanded to structure the formation of European empires and consolidate modern international relations. By connecting the development of legal thinking with the history of political thought and by showing the gradual (...) rise of economic analysis into predominance, the author argues that legal ideas from different European legal systems - Spanish, French, English and German - have played a prominent role in the history of global power. This history has emerged in imaginative ways to combine public and private power, sovereignty and property. There is today a wide consensus that ‘recognition’ is something that we need a clear grasp of in order to understand the dynamics of political struggles, and, perhaps the constitution and dynamics of social reality more generally. Yet, the discussions on ‘recognition’ have so far often been conceptually rather inexplicit, in the sense that the very key concepts have remained largely unexplicated or undefined. Since the English word ‘recognition’ is far from unambiguous, it is possible, and to our mind also (...) actually the case, that different authors have meant partly different things with this word. In what follows, we will make a number of conceptual distinctions and clarificatory proposals that are meant to bring to sharper focus the field of phenomena that are being discussed under the catchword ‘recognition’. This is meant to serve a dual purpose: to suggest a number of distinctions which are of help in formulating rival views, and to propose what strikes us as the best overall position formulated in terms of those distinctions. This open access volume provides an in-depth analysis of philosophical discussions concerning the common good and its relation to self-interest in the history of Western philosophy. The thirteen chapters explore both renowned and lesser-known thinkers from the Middle Ages to the eighteenth century, covering also the relevant ancient background. By bridging the gap between the medieval and early modern periods, they provide fresh insights into how moral and political philosophers understood the concepts of the common good and self-interest, along with (...) their ethical and political implications. The concept of the common good occupies a central role in philosophical reflections on the public and private dimensions of moral and social life in contemporary debates. This article makes several conceptual proposals for a closer analysis of recognition more or less in line with Axel Honneth's account of recognition: (1) a proposal as to the genus of recognitional attitude and recognition, (2) a sketch of an analytical scheme intended to be heuristically useful for analysing the different species of recognitional attitude and recognition, (3) some proposals as to the precise contents of self-conceptions involved in each species and subspecies of recognition, and (4) suggestions as to the (...) relation of the species of recognitional attitude to social settings and concrete personal relationships as well as to the totalities of attitudes instantiated in these settings and relationships. A guiding idea is that the somewhat mechanistic Meadian vocabulary of 'urges' and 'internalizations' of Honneth's original formulations should be replaced with formulations where recognition is consistently conceptualized as consisting of attitudes with propositional or judgmental content. A recently widely accepted view has it that the nature-spirit distinction in Hegel is to be understood as a distinction between a space or realm that is not normative or does not involve norms, and one that is or does. Notwithstanding the merits of this view, it has tended to create a separation between nature and spirit which is both philosophically troubling and difficult to reconcile with the picture of Hegel as the arch enemy of abstract or unreconciled dualisms. In (...) this paper I aim to show that the defining phenomenon for this view—collective self-government by norms—is on Hegel’s account both dependent on living nature that involves normativity broadly conceived all the way down and also subject to the normative or evaluative super-principle of Hegel’s Philosophy of Spirit—concrete freedom—the essence of spirit according to him. It is widely accepted that the seventeenth-century natural lawyers constructed the minimal requirement for social coordination between self-seeking individuals animated by the desire for self-preservation. On most interpretations, Grotius and his successors focused on the “perfect” duties (rules of justice) and had little to say about the “imperfect” duties of love and civility. This essay provides an alternative reading of post-Grotian natural law by reconstructing Pufendorf’s and Locke’s understanding of how the duties of civility and love might be realised in (...) civil society. The essay argues that, for Pufendorf and Locke, the desire for esteem offers an explanation of how people recognize the content of the reciprocal duties of social morality and motivate themselves to act accordingly. The reconstruction of their views on the beneficial effects of esteem-seeking points towards a new interpretation of how, and why, philosophical interest in an economy of esteem and the social nature of the self emerged, prior to their treatment by eighteenth-century authors such as Hume and Smith. In this article a wide range of candidates for features that are defining of personhood are conceived of as interrelated, yet irreducible, layers and dimensions of what it is to be a person in the full-fledged sense of the word. Three layers of personhood -- consisting of person-making psychological capacities, person-making interpersonal significances, and person-making institutional or deontic powers -- are distinguished. Running through the layers there are then two dimensions -- the deontic and the axiological -- corresponding to the (...) recognitive attitudes of respect and love. These recognitive attitudes of 'taking something/-one as a person' are responses to the psychological layer and directly constitutive of the interpersonal layer of the respective dimensions of personhood. The multiplicity of ways to understand what 'personhood' means is only apparently chaotic and reveals, on a closer look, a well-ordered and dynamic internal structure. (shrink)

What is recognition and why is it so important? This book develops a synoptic conception of the significance of recognition in its many forms for human persons by means of a rational reconstruction and internal critique of classical and contemporary accounts. The book begins with a clarification of several fundamental questions concerning recognition. It then reconstructs the core ideas of Fichte, Hegel, Charles Taylor, Nancy Fraser, and Axel Honneth and utilizes the insights and conceptual tools developed across these chapters for (...) developing a case for the universal importance of recognition for humans. It argues in favour of a universalist anthropological position, unusual in the literature on recognition, that aims to construe a philosophically sound basis for a discourse of common humanity, or of a shared human life-form for which moral relations of recognition are essential. This synthetic conception of the importance of recognition provides tools for articulating deep intuitions shared across cultures about what makes human life and forms of human co-existence better or worse, and thus tools for mutual understanding about the deepest shared concerns of humanity, or of what makes us all human persons despite our differences. -/- Recognition and the Human Life-Form will appeal to readers interested in philosophical anthropology, social and political philosophy, critical theory, and the history of philosophy. This paper discusses critically W.V. Quine's relation to the tradition of pragmatism. Even though Quine is often regarded as a pragmatist, it is far from clear what his commitment to pragmatism actually amounts to. It is argued that while there are pragmatist elements in Quine's position, this is not sufficient to classify him as a pragmatist in any strong historical sense; indeed, he was not even clear himself what it means to be a pragmatist. It is also shown that neither (...) Quine's philosophy nor pragmatism are as anti-metaphysical as has sometimes been thought. In order to enrich the picture of Quine's place in the pragmatist tradition, some neopragmatist criticisms of his ideas (e.g., by Hilary Putnam and Richard Rorty) are also discussed. (shrink)

In this paper, we argue that Samuel Pufendorf's works on natural law contain a sentimentalist theory of morality that is Smithian in its moral psychology. Pufendorf's account of how ordinary people make moral judgements and come to act sociably is surprisingly similar to Smith's. Both thinkers maintain that the human desire for esteem, manifested by resentment and gratitude, informs people of the content of central moral norms and can motivate them to act accordingly. Finally, we suggest that given Pufendorf's theory (...) of socially imposed moral entities, he has all the resources for a sentimentalist theory of morality. (shrink)

This book centres on Samuel Pufendorf’s moral and political philosophy, a subject of recently renewed interest among intellectual historians, philosophers and legal scholars in the English-speaking world. Pufendorf’s significance in conceptualizing sociability in a way that ties moral philosophy, the theory of the state, political economy, and moral psychology together has already been acknowledged, but this book is the first systematic investigation of the moral psychological underpinnings of Pufendorf’s theory of sociability in their own right. Readers will discover how Pufendorf’s (...) psychological and social explanation of sociability plays a crucial role in his natural law theory. By drawing attention to Pufendorf’s scattered remarks and observations on human psychology, a new interpretation of the importance of moral psychology is presented. The author maintains that Pufendorf’s reflection on the psychological and physical capacities of human nature also matters for his description of how people adopt sociability as their moral standard in practice. We see how, since Pufendorf’s interest in human nature is mainly political, moral psychological formulations are important for Pufendorf’s theorizing of social and political order. This work is particularly useful for scholars investigating the multifaceted role of passions and emotions in the history of moral and political philosophy. It also affords a better understanding of what later philosophers, such as Smith, Hume or Rousseau, might have find appealing in Pufendorf’s writings. The presence of various mechanisms of non-genetic inheritance is one of the main problems for current evolutionary theory according to several critics. Sufficient empirical and conceptual reasons exist to take this claim seriously, but there is little consensus on the implications of multiple inheritance systems for evolutionary processes. Here we use the Price Equation as a starting point for a discussion of the differences between four recently proposed categories of inheritance systems; genetic, epigenetic, behavioral and symbolic. Specifically, we address how (...) the components of the Price Equation encompass different non-genetic systems of inheritance in an attempt to clarify how the different systems are conceptually related. We conclude that the four classes of inheritance systems do not form distinct clusters with respect to their effect on the rate and direction of phenotypic change from one generation to the next in the absence or presence of selection. Instead, our analyses suggest that different inheritance systems can share features that are conceptually very similar, but that their implications for adaptive evolution nevertheless differ substantially as a result of differences in their ability to couple selection and inheritance. Why is recognition of such an importance for humans? Why should lack of recognition motivate people to fight or work for recognition? In this article, I first discuss shortly Axel Honneth's psychologizing strategy for answering these questions, and suggest that the psychological harms of lack of recognition pointed out by Honneth are neither sufficient nor necessary for motivation to fight or work for recognition to arise. According to the alternative that I then spell out, recognition and lack of it are (...) so intimately intertwined with some of the most fundamental and intuitively appealing facts about what it is to be a person in a full-fledged sense — arguably in any culture — that there are reasons to be optimistic about a more or less universal existence of latent motivation to fight or work for more or more equal recognition. All social phenomena, all social interaction, anything that exists in society, is temporal. Anticipation of futures is a necessary part of all social actions, and particularly so in the world of modern organisations. If social sciences are to be relevant they should also be able to say something about possible and likely futures. My paper articulates an ontology for futures studies and then, on that ontological basis, specifies the methodology of futures studies. Critical realist ontology explains why there are multiple (...) possible futures. The actual is only a part of the real world, which also consists of non-actualised possibilities and unexercised powers of the already existing structures and mechanisms that are transfactually efficacious in open systems. Social sciences are also involved in envisaging better possible futures in terms of concrete utopias. However, building concrete utopias is not the only task of a futurologist. We are also interested in other possible and likely futures, and in determining the ways in which our actions and the actions of others contribute—sometimes via unintended effects and consequences—to making some of them real. Empirico-analytical models have a role to play, as do systematic modelling of geo-historical realities: embodied agency and actors; modes of action; rules and principles; resources, as competencies and facilities; practices; relational structures ; and self-organising social systems. However, scenario-construction should also be seen as self-reflective exercise in cultural studies, moral philosophy and creative ability. (shrink)

R. G. Collingwood's re-enactment doctrine has been widely discussed in recent years by his commentators. However, most philosophers who discuss the re-enactment doctrine touch only briefly on his view of the identity of thoughts. This is surprising because Collingwood claims that the historian's successful re-enactment of the thought behind the historical agent's action involves re-thinking the same thought as the agent and not merely a copy of his thought.

This chapter examines first two broadly Hegelian variations of the freedom-justice connection by Axel Honneth and Rainer Forst, and then critically contrasts them with Hegel’s own concept of “concrete freedom” as the immanent ideal of social life and Hegel’s state as its “actuality.” I argue that this concept is capacious enough to do justice both to the human capacity in principle for context-transcending reflection on the justness of the social order central for Forst and to the limitations in practice of (...) individuals and groups for transcending the embeddedness and particularity of their perspectives emphasized by Honneth. The question of what makes a theory of a good society also a theory of justice is raised at the beginning with regard to Honneth’s account, and a reason stemming from the ontology of objective spirit is suggested at the end with regard to Hegel’s. Rahel Jaeggi’s Critique of Forms of Life represents a welcome new development in critical social thought. It aims to overcome the ‘liberal abstinence’, which forbids criticizing the ethical fabric of social life, and proposes to connect normative evaluation with a serious social-ontological model of ‘forms of life’. In this article we argue, however, that Jaeggi’s ontological characterization of the concept of form of life is problematic in ways that introduce a number of adverse consequences for social critique. In section 1, (...) we lay out the main components of Jaeggi’s account. In section 2, we present four interconnected problems that beset Jaeggi’s substantializing conception of forms of life. In section 3, we present an alternative construal of the idea of forms of life, one which does not utilize the concept for grasping substantial unities, but rather focuses on the ‘forms’ that specifically human life takes, and which grasps social practices as concrete collaborative activities involving expectations of recognition. We thereby bring together the recognition-theoretical strand of critical social thought with Jaeggi’s welcome new gambit. In section 4 we briefly put forth three mutually complementary ways to conceive of recognitive expectations immanent in social life understood as a collaborative endeavor. (shrink)

While recent scientific discoveries and theories can be taken to provide additional evidence for some of the central critical realist claims, overall critical realism seems to be in need of reassessment, revisions and further developments. First, I argue that here has been an inclination among critical realists to prefer the language and model of philosophy to falsifiable science, creating a predisposition towards somewhat sectarian practices. These tendencies also account for the relative lack of substantive research based on, or inspired by, (...) critical realism. Second, I make a case for radicalising the critique of anthropomorphism and applying it to critical realism itself. Third, and in some contrast to the second point, I argue for rethinking the subject-object relationship and the concept of the intransitive dimension of science. The critique of anthropocentrism has been taken too far. We are implicated in and are a part of the object of our study. It even seems that we humans are a part of the process of the cosmos becoming conscious of itself, also through science. (shrink)

This article begins by tracing two issues to be kept in mind in discussing the theme of love as far back as Aristotle: on the one hand the polysemy of the term philia in Aristotle, and on the other hand the fact that there is a focal or core meaning of philia that provides order to that polysemy. Secondly, it is briefly suggested that the same issues are, mutatis mutandis, central for understanding the discussion of love or Liebe by Hegel, (...) the central classic reference in debates on recognition. Thirdly, by pointing out a certain ambiguity in Harry Frankfurt’s recent work on love, the article focuses more closely on the thought that love in the simple sense which Aristotle had pinpointed as the focal meaning of philia, which is arguably at the core of Hegel’s discussion of Liebe, and which still forms at least one of the core senses of the term, is a ‘personifying’ attitude of recognition. Finally, drawing on the above points the article addresses the question whether love as a form of recognition is restricted to intimate relations such as those between family-members, ‘lovers’, close friends and so on, or whether it has applications in interhuman relations more broadly. The answer to this question, it is suggested, is essential for the viability of ethically substantial notions of solidarity beyond circles of close acquaintances, whether within the civil society, across nations, or towards future generations. Samuel Pufendorf’s major work on natural law, De jure nature et gentium, included a long chapter on the power of the civil sovereign to determine the value of citizens. There, Pufendorf identified several forms of esteem (existimatio), according to which human beings are ranked in social life. The article argues that behind Pufendorf’s discussion of this topic was the idea that the way people esteem others and want others to esteem them has profound consequences for maintaining peaceful social life and (...) is therefore morally regulated by the fundamental natural-law duty to maintain sociality. The article explores the key elements of Pufendorf’s multifaceted analyses of esteem, making apparent how they were connected to sociality. The article also analyses Pufendorf’s argument for the duty to esteem other humans as one’s equals by nature, questioning the view that this relied on the idea of human dignity understood as an intrinsic value of human beings. Pufendorf’s argument for this duty was a part of same project as his analyses of existimatio, namely, to define how natural law regulates the way human beings esteem each other, and it relied on his observations concerning the character of human self-esteem. Social esteem, based on contributions the common good, or to the good of others, is an important phenomenon, and following Axel Honneth, it can be seen as an important subspecies of interpersonal recognition, side by side with respect and love. In this paper we will contrast two accounts of this phenomenon, hoping that this kind of cross-illumination will prove useful by clarifying a number of conceptual questions and options that one needs to be conscious of indiscussions about esteem as a (...) form of recognition.
