Few subjects have generated so many newspaper headlines and such heated controversy as the treatment, or non-treatment, of handicapped newborns. In 1982, the case of Baby Doe, a child born with Down's syndrome, stirred up a national debate in the United States, while in Britain a year earlier, Dr. Leonard Arthur stood trial for his decision to allow a baby with Down's syndrome to die. Government intervention and these recent legal battles accentuate the need for a reassessment of the complex (...) issues involved. This volume--by two authorities on medical ethics--presents a philosophical analysis of the subject based on particular case studies. Addressing the doctrine of the absolute sanctity of life, Singer and Kuhse examine some actual cases where decisions have been reached; consider the criteria for making these decisions; investigate the differences between killing and letting die; compare Western attitudes and practices with those of other cultures; and conclude by proposing a decision-making framework that offers a rational alternative to the polemics and confusion generated by this highly controversial topic. According to the "sanctity-of-life" view, all human lives are equally valuable and inviolable, and it would be wrong to base life-and-death medical decisions on the quality of the patient's life. Examining the ideas and assumptions behind the sanctity-of-life view, Kuhse argues against the traditional view that allowing someone to die is morally different from killing, and shows that quality-of-life judgments are ubiquitous. Refuting the sanctity-of-life view, she provides a sketch of a quality-of-life ethics based on the belief that there is (...) a profound difference between merely being alive and life being in the patient's interest. Sex, Love, and Gender is the first volume to present a comprehensive philosophical theory that brings together all of Kant's practical philosophy — found across his works on ethics, justice, anthropology, history, and religion — and provide a critique of emotionally healthy and morally permissible sexual, loving, gendered being. These sets come with their own concepts, which specify how the possibilities are realized and what effects they have on our lives lived together. Partly the task is descriptive. The description has to be plausible. Plausibility comes from the phenomenology (and not the other way around). Partly the task is normative. The normative content also has to be plausible. Plausibility here comes from vindicating the principles that underwrite the possibilities that define human beings’ sexualities and sexual experiences and behaviors lived by human beings and from the philosophical explanations and conclusions that follow. Overall plausibility, then, comes from discursive analysis of alternatives, from a priori argument, and, in the evaluative case, from showing how the Kantian account of a good life fits with reasonable conceptions of goodness consistent with the phenomenology of human lives. Although this exploration leads us, as we will see, to most corners of Kant’s practical philosophy, including his metaethics and metaphysics, the main focus is on an account of human sex, love, and gender explored explicitly with respect to happiness and ethics (virtue) and justice (right). This paper presents and defends Kant’s non-voluntarist conception of political obligations. I argue that civil society is not primarily a prudential requirement for justice; it is not merely a necessary evil or moral response to combat our corrupting nature or our tendency to act viciously, thoughtlessly or in a biased manner. Rather, civil society is constitutive of rightful relations because only in civil society can we interact in ways reconcilable with each person’s innate right to freedom. Civil society is the (...) means through which we can rightfully interact even on the ideal assumption that no one ever succumbs to immoral temptation. (shrink)

This paper defends a legal and political conception of sexual relations grounded in Kant’s Doctrine of Right. First, I argue that only a lack of consent can make a sexual deed wrong in the legal sense. Second, I demonstrate why all other legal constraints on sexual practices in a just society are legal constraints on seemingly unrelated public institutions. I explain the way in which the just state acts as a civil guardian for domestic relations and as a civil guarantor (...) for private property and contract relations—and thereby enables the existence of legally enforceable claims. Throughout the aim is to demonstrate that Kant’s relational conception of justice entails that legally enforceable claims regarding sexual deeds are fully justifiable only insofar as they are determined and enforced by a public authority that we may refer to as a liberal democratic welfare state. Robert Nozick initiated one of the most inspired and inspiring discussions in political philosophy with his 1974 response in Anarchy, State, and Utopia to John Rawls’s 1971 account of distributive justice in A Theory of Justice. These two works have informed an enormous amount of subsequent, especially liberal, discussions of economic justice, where Nozick’s work typically functions as a resource for those defending more right-wing (libertarian) positions, whereas Rawls’s has been used to defend various left-wing stances. Common to these discussions, (...) as found in politics generally (where similar kinds of arguments frequently are used to defend right and the left-wing policies and conclusions) is that they end in rather stubborn stalemates: the right defending minimal states while the left defends more extensive states. Interesting, too, is that both Nozick and Rawls take themselves to be consistent with, inspired by, and furthering Kant’s freedom project in the development of their own theories of justice. In this paper, I start by outlining the structures of these debates with an emphasis on the original disagreements between Nozick and Rawls. I then show how neither theory actually employed Kant’s own theory of justice, but rather drew on or out (presumed) implications of his ethical theory. In the final sections, I argue that if Nozick and Rawls had instead used Kant’s theory of justice and not his ethics, not only would their individual theories have been stronger, but they could have found ways of overcoming the unproductive stalemates that characterize their own as well as subsequent related discussions of economic justice as we currently find them in much scholarly and contemporary political debate. Central to Nozick’s Anarchy, State and Utopia is a defense of the legitimacy of the minimal state’s use of coercion against anarchist objections. Individuals acting within their natural rights can establish the state without committing wrongdoing against those who disagree. Nozick attempts to show that even with a natural executive right, individuals need not actually consent to incur political obligations. Nozick’s argument relies on an account of compensation to remedy the infringement of the non-consenters’ procedural rights. Compensation, however, cannot remedy (...) the infringement, for either it is superfluous to Nozick’s account of procedural rights, or it is made to play a role inconsistent with Nozick’s liberal voluntarist commitments. Nevertheless, Nozick’s account of procedural rights contains clues for how to solve the problem. Since procedural rights are incompatible with a natural executive right, Nozickeans can argue that only the state can enforce individuals’ rights without wronging anyone, thus refuting the anarchist. In my response to Andrew Webster's examples I point to certain limitations, while fully supporting the thrust of his argument for a re-engagement of science and technology studies with policy making. When analyzing the policy implications of knowledge, the larger context must be considered. New criteria, like transparency, have arisen and the tendency for evidence-based policy making has become widespread. The managerial side of policy making emphasizes that "only what can be measured, can be managed." The crucial question is how (...) well prepared-and how willing-the STS community is to tackle policy making in this new guise. In the end, what is needed are institutions that are capable of developing their own reflexivity-a task to which STS can certainly contribute, but the road to be taken may be less direct than Andrew Webster suggests. According to a contemporary school of thought there is a specific female approach to ethics which is based not on abstract “male” ethical principles or rules, but on “care”. Nurses have taken a keen interest in these female approaches to ethics. Drawing on the views expounded by Carol Gilligan and Nel Noddings, nurses claim that a female “ethics of care” better captures their moral experiences than a traditional male “ethics of justice”. This paper argues that “care” is best understood in (...) a dispositional sense, that is, as sensitivity and responsiveness to the particularities of a situation and the needs of “concrete” others. While “care”, in this sense, is necessary for ethics, it is not sufficient. Ethics needs “justice” as well as “care”. If women and nurses excessively devalue principles and norms, they will be left without the theoretical tools to condemn some actions or practices, and to defend others. They will, like generations of nurses before them, be condemned to silence. (shrink)

The article retraces the social and institutional circumstances that in 1986 led two researchers at the IBM laboratory near Zurich, Müller and Bednorz, to discover high-temperature superconductivity. After confirmation of the unexpected breakthrough an unprecedented mobilization of research groups all over the world took place while simul taneously high-temperature superconductivity turned into a subject of intense media interest. The authors discuss these events under three perspectives: the closer interlinkage capacity of researchers and the relationship between the social organization of research (...) and unforeseen cases of scientific creativity. Relying on a powerful collective narrative through which political, legal and social decision-making is guided in the name of science, the authority of scientific experts reaches beyond the boundaries of their certified knowledge base. Therefore, expertise constitutes and is constituted by transgressive competence. The author argues that (1) changes in the decision-making structure of liberal Western democracies and changes in the knowledge production system diminish the authority of scientific expertise while increasing the context-dependency of expertise - thereby altering the nature (...) of its predictive claims; (2) the societal distribution of expertise, while displaying emancipatory features of empowerment of citizens, also raises issues of quality control; and (3) in order to regain a balance between public and private, i.e. individual-based societally distributed expertise, future expert systems will need to adopt a longer time-perspective. Network analysis views complex systems as networks with well-defined structural properties that account for their complexity. These characteristics, which include scale-free behavior, small worlds and communities, are not to be found in networks such as random graphs and lattices that do not correspond to complex systems. They provide therefore a robust ground for claiming the existence of “complex networks” as a non-trivial subset of networks. The theory of complex networks has thus been successful in making systematically explicit relevant marks of (...) complexity in the form of structural properties, and this success is at the root of its current popularity. Much less systematic has been, on the other hand, the definition of the properties of the building components of complex networks. The obvious assumption is that these components must be nodes and links. Generally, however, the internal structure of nodes is not taken into account, and links are serendipitously identified by the perspective with which one looks at the network to be analyzed. For instance, if the nodes are Web pages that contain information about scientific papers, one point of view will match the relevant links with hyperlinks to similar Web pages, and another with citations of other articles. We intend to contribute here a systematic approach to the identification of the components of a complex network that is based on information theory. The approach hinges on some recent results arising from the convergence between the theory of complex networks and probabilistic techniques for content mining. At its core there is the idea that nodes in a complex network correspond to basic information units from which links are extracted via methods of machine learning. Hence the links themselves are viewed as emergent properties, similarly to the broader structural properties mentioned above. Indeed, beside rounding up the theory, this approach based on learning has clear practical benefits, in that it makes networks emerge from arbitrary information domains. We provide examples and applications in a variety of contexts, starting from an information-theoretic reconstruction of the well-known distinction between “strong links” and “weak links” and then delving into specific applications such as business process management and analysis of policy making. This book explores the limits of our knowledge. The author shows how uncertainty and indefiniteness not only define the borders confining our understanding, but how they feed into the process of discovery and help to push back these borders. Starting with physics the author collects examples from economics, neurophysiology, history, ecology and philosophy. The first part shows how information helps to reduce indefiniteness. Understanding rests on our ability to find the right context, in which we localize a problem as a (...) point in a network of connections. New elements must be combined with the old parts of the existing complex knowledge system, in order to profit maximally from the information. An attempt is made to quantify the value of information by its ability to reduce indefiniteness. The second part explains how to handle indefiniteness with methods from fuzzy logic, decision theory, hermeneutics and semiotics. It is not sufficient that the new element appears in an experiment, one also has to find a theoretical reason for its existence. Indefiniteness becomes an engine of science, which gives rise to new ideas.. (shrink)

This paper reflects on a genesis that seems inseparable from that of the human, namely, the coming into being of social organization. It seems impossible to think of a time when humans were not embedded in some social configuration, but it is equally impossible to think of the human species evolving complete with sociocultural formations attached. Even deciding on the word for the beginning of organization prejudges the issue: are we speaking of an emergence, a development, a making, or a (...) virgin birth? Calling on three authors – Giambattista Vico, Michel Serres, and Paolo Virno – I present three kinds of processes of becoming: one as a directional sequence of interlocking steps, one as the fertility of unintended consequences, and one as the creativity of linguistic ruse. Glancing at these different versions sideways one can make out some universal features of the genesis of organization: a self-referential circularity at its inception which hides the starting point, a unique engagement with language and the symbolic, and an intentional act that creates the possibility of a new and different future. Kant’s example of lying to the murderer at the door has been a cherished source of scorn for thinkers with little sympathy for Kant’s philosophy and a source of deep puzzlement for those more favorably inclined. The problem is that Kant seems to say that it’s always wrong to lie – even if necessary to prevent a murderer from reaching his victim – and that if one does lie, one becomes partially responsible for the killing of the victim. If this (...) is correct, then Kant’s account seems not only to require us to respect the murderer more than the victim, but also that we somehow can become responsible for the consequences that ultimately result from someone else’s wrongdoing. After World War II our spontaneous negative reaction to this apparently absurd line of argument is brought out even more starkly by making the murderer at the door a Nazi officer looking for Jews hidden in people’s homes. This paper argues that Kant’s discussion of lying to the murderer at the door has been seriously misinterpreted. The suggested root of the problem is that the Doctrine of Right has been given insufficient attention in Kant interpretation. It is in this work we find many of the arguments needed to understand Kant’s analysis of lying to the murderer in “On a Supposed Right to Lie from Philanthropy”. When we interpret this essay in light of Kant’s discussion in the Doctrine of Right, we can make sense of why lying to the murderer isn’t to wrong the murderer, why we nevertheless become responsible for the consequences of the lie and why choosing to lie to do wrong ‘in the highest degree’. Finally, the Doctrine of Right account of rightful relations makes it possible for us to analyze the example when we make the murderer at the door a Nazi officer. (shrink)

Kant's conception of women is complex. Although he struggles to bring his considered view of women into focus, a sympathetic reading shows it not to be anti-feminist and to contain important arguments regarding human nature. Kant believes the traditional male-female distinction is unlikely to disappear, but he never proposes the traditional gender ideal as the moral ideal; he rejects the idea that such considerations of philosophical anthropology can set the framework for morality. This is also why his moral works clarifies (...) that all citizens, including women have the right, and should be encouraged to strive towards an active condition. (shrink)

Uncertainty is interwoven into human existence. It is a powerful incentive in the search for knowledge and an inherent component of scientific research. We have developed many ways of coping with uncertainty. We make promises, manage risks and make predictions to try to clear the mists and predict ahead. But the future is inherently uncertain - and the mist that shrouds our path an inherent part of our journey. The burning question is whether our societies can face up to uncertainty, (...) learn to embrace it and whether we can open up to a constantly evolving future. In this new book, Helga Nowotny shows how research can thrive at the cusp of uncertainty. Science, she argues, can eventually transform uncertainty into certainty, but into certainty which remains always provisional. Uncertainty is never completely static. It is constantly evolving. It encompasses geological time scales and, at the level of human experience, split-second changes as cells divide. Life and death decisions are taken in the blink of the eye, while human interactions with the natural environment may reveal their impact over millennia. Uncertainty is cunning. It appears at unexpected moments, it shuns the straight line, takes the oblique route and sometimes the unexpected short-cut. As we acknowledge the cunning of uncertainty, its threats retreat. We accept that any scientific inquiry must produce results that are provisional and uncertain. This message is vital for politicians and policy-makers: do not be tempted by small, short-term, controllable gains to the exclusion of uncertain, high-gain opportunities. Wide-ranging in its use of examples and enriched by the author’s experience as President of the European Research Council, one of the world’s leading funding organisations for fundamental research. The Cunning of Uncertainty is a must-read for students and scholars of all disciplines, politicians, policy-makers and anyone concerned with the fundamental role of knowledge and science in our societies today. Se o primeiro precariamente avança sobre suas próprias sugestões, o pernambucano, ao valorizar o passado colonial brasileiro, consegue romper com certa "sociologia da ausência" presente em trabalhos de alguns de seus contemporâneos. Neste esforço, Freyre constrói (...) obra inaugural marcada por elementos inovadores. Spirituality is as an individual, dynamic, and a complex concept. Meleis's theory includes spirituality in many aspects, and looking at this dimension within this specific theory may help in understanding spirituality as a critical dimension in transitions, as processes, but also as a dimension of self–transition as individual development and growing. Therefore, spirituality is an inherent and integral element of the several foundations of this theory, especially in nursing therapeutics, patterns of responses and transition conditions (facilitators and inhibitors).

This paper explores the pragmatic routines that occur in clause 2 chaining. It demonstrates that the tense-aspect dependency markers in Toposa texts not only combine chained clauses with an initial clause, but also guide the audience to understand information in texts as foregrounded. The understanding of which information is foregrounded is achieved through pragmatic routines that cut the comprehension process short because of frequently encountered inferential processes occurring in repeatedly accessed contextual environments. The pragmatic routines are explained as part of (...) the relevance-theoretic comprehension heuristic. It will also be shown how these routines apply to narratives, and procedural texts. (shrink)

As a part of religious discourse, Christian sermons are a “…persuasive discourse par excellence”. This is more pronounced in the Christian Prosperity Gospel, a system of thought and belief in which preachers The word preacher and speaker are used interchangeably in this paper. attempt to convince audiences to donate to their churches with the expectation that God will reward them with health and wealth. Previous research shows that the use of metaphors and metonymies pervade CPG sermons but an explanation on (...) the mechanisms through which they persuade is rarer. With this in mind and viewing CPG sermons from their persuasive angle; this paper sets out to investigate how metaphors and metonymies are used for persuasion purposes in televised sermons presented in the Gĩkũyũ language Gĩkũyũ is the language of the Agĩkũyũ who are largely found in central Kenya as well as in some other parts of the country. It is a Bantu language classified as a Zone E language by Guthrie. According to the 2019, Population and Housing Census, the gĩkũyũ is the largest tribe in Kenya at 8,148,668 individuals. The community has dominated in televangelism but the position is changing due to the proliferation of many vernacular television stations.. The data is drawn from authentic televised sermons. The findings indicate that metaphors and metonymies engender persuasion in sermons by affecting the perceived altruism and trustworthiness of a speaker in a sermon. This is done by means of manipulating various forms of distance suggested in the Media Proximization Approach. Metaphor is found to affect the axiological, epistemic, temporal and emotional distances while metonymy affects the axiological and spatial distances to activate certain pragmatic presuppositions which make them persuasive in a covert way. This volume provides a critical introduction to contemporary attempts to base nursing ethics on a feminine 'ethics of care'.

: In this paper, I consider objections to advance directives based on the claim that there is a discontinuity of interests, and of personal identity, between the time a person executes an advance directive and the time when the patient has become severely demented. Focusing narrowly on refusals of life-sustaining treatment for severely demented patients, I argue that acceptance of the psychological view of personal identity does not entail that treatment refusals should be overridden. Although severely demented patients are morally (...) considerable beings, and must be kept comfortable whilst alive, they no longer have an interest in receiving life-sustaining treatment. (shrink)

Kant’s comments on sexuality are commonly found to be at best perplexing and at worst extraordinarily unenlightened and morally offensive. In this paper, I start by reconstructing what seems to be Kant’s view on sexuality as well as providing an overview of the main, existing Kantian philosophical responses and alternative proposals to this account. In the last part of the paper, I outline a new Kantian approach to sexuality that overcomes the shortcomings of both Kant’s own and the existing Kantian (...) accounts. (shrink)

Contrary to the received view, I argue that Kant, in the “Doctrine of Right”, outlines a third, republican alternative to absolutist and voluntarist conceptions of political legitimacy. According to this republican alternative, a state must meet certain institutional requirements before political obligations arise. An important result of this interpretation is not only that there are institutional restraints on a legitimate state's use of coercion, but also that the rights of the state (‘public right’) are not in principle reducible to the (...) rights of individuals (‘private right’). Thus, for Kant, political obligations are intimately linked to the existence of a certain kind of republican institutional framework. (shrink)

(Early) Modern social contract theories reject the idea that legal and political institutions are grounded in an alleged natural ordering or hierarchy of human beings, and instead argue that only government by a public (and not private) authority can fulfil the idea of justice as freedom and equality for all. To be authoritative and not just powerful, governing institutions must be shared as ours in this irreducible sense. I first outline how Kant’s ideal account of rightful freedom brilliantly transforms this (...) tradition as found in the works of Hobbes, Locke, and Rousseau, before proposing a way to see Kant’s two-layered non-ideal theory—his accounts of human nature (“moral anthropology”) and historical societies (“the principle of politics”)—as complementing his ideal theory of rightful freedom. This enables us to envision a conception not only of rightful external freedom but of rightful human freedom in particular societies—with their histories—on planet Earth. With these arguments at hand, we can also better appreciate the importance of realizing that the four possible political conditions for Kant—anarchy, barbarism, despotism, and republic—are ideas of reason, which means that they are never perfectly realized. Hence, historical societies we are not either in the state of nature or in civil society. In addition, in historical societies founded on principles of freedom, there are pockets of injustice or pockets that are devoid of justice that can only be captured by means of one of the three political ideas that are not constitutive of the republican legal-political framework. Kant’s four ideas therefore give us more tools with which to capture the nature of different political forces and challenges facing us in our historical societies. (shrink)
