Haber-i vâhidin delil değeri problemi, 2. (8.) yüzyıldan itibaren kelamcılar (:Mutezile), fıkıhçılar ve hadisçiler arasında tartışılan ve hakkında kayda değer bir literatür ortaya çıkan usûlî konuların başında gelmektedir. Şeybânî (ö. 189/805), Şâfiî (ö. 204/820), İsâ b. Ebân (ö. 221/836) ve Buhârî (ö. 256/870) gibi sünnî ekolün tanınmış fıkıh ve hadis alimlerinin haber-i vâhid lehine ortaya koydukları çalışmalar bu noktada oldukça etkili olmuştur. Bu etkinin bir sonucu olarak başlangıçta haber-i vâhidi toptancı bir yaklaşımla reddeden Mutezili isimler, yerini zamanla Ebû Ali el-Cübbâî (...) (ö. 303/916) gibi başka bir delille desteklenmesi şartıyla kabul eden alimlere bırakmıştır. Cübbâî, muhtemelen Kitâbü’l-ahbâr isimli günümüze ulaşmayan çalışmasında, hem tek kişinin haberi anlamındaki haber-i vâhidin hücciyet delillerini tenkit etmiş hem de çeşitli delillerle kendi kişisel görüşünü temellendirmeye çalışmıştır. Onun bu tenkit ve görüşleri, 4. (10.) yüzyılın önemli Hanefi fakih ve usulcüsü Cessâs (ö. 370/981) tarafından usul ilminin kurucu metinlerinden el Fusûl’de üstü kapalı bir şekilde nakledilmiş ve eleştirel bir değerlendirmeye tabi tutulmuştur. Araştırmamızda Cübbâî’nin, haber-i vâhidin delil değeri, kabul şartları konusundaki eleştiri ve görüşleri ile Cessâs’ın ona verdiği cevaplar ve karşı eleştirileri ele alınmıştır. (shrink)

This study examined the validity and reliability of a Turkish version of the Modified Moral Sensitivity Questionnaire for Student Nurses. After obtaining permission to adapt the MMSQSN into Turkish, the translation/back-translation method was used with expert opinions to determine content validity. Factor analysis was conducted to examine the construct validity and test–retest was performed on the questionnaire to determine reliability. Cronbach’s alpha coefficients were calculated to assess for internal consistency. Participants included 272 baccalaureate degree student nurses who took ethics lessons (...) prior to their clinical internship. The factor analysis revealed that even though the factor structure in the original scale was the same, relevant items were categorized with similar components, and factor loads were sufficient. The correlation coefficient in the analyses of test–retest scores was.66 for the total scale and the Cronbach’s alpha was.73 for the total scale. The translated MMSQSN is a valid and reliable measure of ethical sensitivity in student nurses in Turkey. (shrink)

Although lay notions in normative ethics have previously been investigated within the framework of the dual-process interpretation of the terror management theory (TMT), meta-ethical beliefs (subjective vs. objective morality) have not been previously investigated within the same framework. In the present research, we primed mortality salience, shown to impair reasoning performance in previous studies, to see whether it inhibits subjectivist moral judgments in three separate experiments. In Experiment 3, we also investigated whether impaired reasoning performance indeed mediates the effect of (...) mortality salience on subjectivism. The results of the three experiments consistently showed that people in the mortality salience group reported significantly less subjectivist responses than the control group, and impaired reasoning performance partially mediates it. Overall, the results are consistent with the dual-process interpretation of TMT and suggest that not only normative but also meta-ethical judgments can be explained by this model. (shrink)

Although the effect of religious belief on morally relevant behavior is well demonstrated, the reverse influence is less known. In this research, we examined the influence of morality on religious belief. In the first study, we used two samples from Turkey and the United States, and specifically tested the hypothesis that intergroup tolerance predicts a shift in meta-ethical views toward subjective morality, which in turn predicts decreased religious belief. To examine the relationship between intergroup tolerance and religiosity via subjective morality, (...) a structural equation model (SEM) was run. SEM results yielded good fit to the data for both samples. Intergroup tolerance positively predicted subjective morality, and in turn, morality negatively predicted religiosity. The bias-corrected bootstrap analysis confirmed the mediation, indicating that the association between intergroup tolerance and religious belief was mediated via subjective morality. In Study 2, we probed for the causal relationship, and the results showed that manipulating intergroup tolerance increases subjective morality, but does not influence religiosity. Therefore, we found only partial evidence for our proposed model that tolerance causally influences subjective morality, but not religiosity. (shrink)

The discovery and invention of new medical applications may be considered blessings to humankind. However, some applications which might be the only remedy for certain diseases may contain ingredients or involve methods that are not in harmony with certain cultural and religious perspectives. These situations have raised important questions in medical ethics; are these applications completely prohibited according to these perspectives, and is there any room for mitigation? This paper explores the concept of darurah and its deliberation in the formulation (...) of fatwas on medicine issued by the National Fatwa Council of Malaysia. Darurah has explicitly been taken into consideration in the formulation of 14 out of 45 fatwas on medicine thus far, including one of the latest fatwas regarding uterine donation and transplantation. These fatwas are not only limited to the issues regarding the use of unlawful things as remedies. They include issues pertaining to organ transplantation, management of the corpse and treatment of brain dead patients. While deliberation of darurah in medicine may vary from issue to issue, darurah applies in a dire situation in which there are no lawful means to prevent harm that may be inflicted upon human life. Nevertheless, other aspects must also be taken into the deliberation. For example, consent must be obtained from the donor or his next of kin to conduct a cadaveric organ transplantation. (shrink)

Discussions of the relationship between consciousness and language are troubled by simplistic views of both. Denying a central role of consciousness in linguistics is commonplace in generative linguistics, but self-contradictory. On the other hand, a defence of consciousness by some cognitive and functional linguists is marred by a conflation of consciousness with 'introspection'. I argue for the need to distinguish (at least) between three kinds of acts of consciousness: observation, introspection and intuition, where the last one is based on intersubjectively (...) binding social norms. It is intuition that is the most fundamental form of consciousness for the study of language, from antiquity to the present. Furthermore, I show how the three modes of (linguistic) consciousness are related, by defining empathy (as used e.g. in typological explanations) as vicarious introspection, and intuition as conventionalized empathy. The recent development of CRISPR/Cas9 technology has rekindled the ethical debate concerning human germline modification that has begun decades ago. This inexpensive technology shows tremendous promise in disease prevention strategies, while raising complex ethical concerns about safety and efficacy of the technology, human dignity, tampering with God’s creation, and human genetic enhancement. Germline gene editing may result in heritable changes in the human genome, therefore the question of whether it should be allowed requires deep and careful discussion from various perspectives. (...) This paper explores Islamic perspectives on the concerns raised and highlights the ethical principles in Islam that should be taken into consideration when assessing the permissibility of CRISPR/ Cas9-mediated human germline gene editing. As argued in this paper, human germline gene editing would be considered lawful for medical purpose under certain conditions. It should not be applied on humans until the safety and efficacy issues are resolved. Robust ethical guidelines and strict regulations are necessary to preserve human dignity and to prevent premature and misuse of the technology. Maqasid al-shariah’s principles of preservation of human life, lineage, and dignity and ‘preventing harm takes precedence over securing benefit’ are among the guiding principles in assessing the permissibility of CRISPR/Cas9-mediated human germline editing from an Islamic perspective. Further discussions are important to address the controversies as well as to explore the related ethical principles. (shrink)

The subject of this study is the naḳīḍa (opposing) type of poetry competitions between the Meccan poet Ḍirār b. al-Khaṭṭāb (d. 12/633) and the Muslim poet Kaʿb b. Mālik (d. 50/670) from Medina during the Battle of Badr, when the Muslims and the polytheists confronted for the first time. The problem is the questioning of the approaches reflected in the naḳīḍa poems, which were used as a means of propaganda and psychological superiority by the Muslims and polytheists during the Battle (...) of Badr. Naḳīḍa poems, the subject of the study, are important for getting to know the two opposite understandings closely and forming an opinion about the naḳīḍa poems sung during the era of the Prophet Muhammad. Although there are some recent studies on naḳīḍa poems from the era of the Prophet, these studies lacked details and only mentioned general features. The interesting approaches and fine details reflected in the verses, such as Ḍirār b. al-Khaṭṭāb's claims aiming to distract attention and discredit the Muslims of Medina in the face of the unexpected defeat of the Meccan army at Badr that the Battle of Badr was a tribal war between the Meccans and the Medinans, makes this study prominent. On the other hand, Kaʿb b. Mālik's verses reflect the approaches bearing traces of the Islamic faith and draw attention to the fact that the battle was between faith and unbelief and the Muslims of Medina were proud of their support for the Messenger of Allah. Undoubtedly, Meccan immigrants participated in the Battle of Badr along with the Muslims of Medina. Even so, Kaʿb b. Mālik does not mention Muhājirs (immigrants) in his verses. This suggests that Kaʿb b. Mālik may have concentrated on responding to the allegations made by Ḍirār b. al-Khaṭṭāb. Document analysis, one of the qualitative method techniques, was used in the study. First, a literature review was conducted to better understand the subject, and the studies related to the field were briefly mentioned. Then, summary information about the concept and background of naḳīḍa is provided. Two call-and-response poems between the Jāhiliyyah period poet Imruʾ al-Qays (d. 545) and ʿAbīd b. al-Abraṣ (d. 555) are included as an example for the first phases of naḳīḍa poems. Then, brief information about the Meccan poet Ḍirār b. al-Khaṭṭāb and the Medinan poet Kaʿb b. Mālik are presented. After the background information, two naḳīḍa poems of both poets were examined and analyzed, and the differences in the Battle of Badr were pointed out. Concepts that are common in the eulogies of the Jāhiliyyah period, such as nobility, being a master warrior, and generosity, draw attention in Ḍirār b. al-Khaṭṭāb's verses. On the other hand, in his verses Ka'b b. Mālik uses terms and expressions brought by Islam such as the Messenger of Allah, there is no Lord but Allah, unbelievers, Hell, and hellfire. In the verses of both poets, there are clues about the commonly used battle orders and war equipment of the period. The opinions are summarised in the conclusion part of the study. (shrink)

The increasing number of companies providing internet services and auction tools helped popularize the online reverse auction trend for purchasing commodities and services in the last decade. As a result, a number of owners, both public and private, accepted the online reverse auctions as the bidding technique for their construction projects. Owners, while trying to minimize their costs for construction projects, are also required to address their ethical responsibilities to the shareholders. In the case of online reverse auctions for construction (...) projects, the ethical issues involved in the bidding technique directly reflects on the owner’s ethical and social responsibilities to their shareholders. The goal of this paper is to identify the shareholder ethics and responsibilities in online reverse auctions for construction projects by analyzing the ethical issues for the parties involved in the process. The identification of the ethical issues and responsibilities requires clear definition and understanding of professional ethics and the roles of the involved parties. In this paper, first, the concept of professional ethics and social responsibility is described in a general form. To illustrate the ethical issues and responsibilities, a sample case of bidding for a construction project using online reverse auction techniques is presented in which the shareholders were actively involved in questioning the ethical issues. The issues involved in the bidding process and their reflection on the shareholder responsibilities are described and analyzed for each stage of the process. A brief discussion of the overall process is also included to address the general ethical issues involved in online reverse auctions. (shrink)

Aydınlanma üzerine konuşmaya niyet eden birinin ilk kabulü, onun Avrupa‘da çıkmış olan bir ―durum‖ olduğu üzerine olacaktır. ―Durum‖ dedik çünkü Aydınlanma, hem ideolojik, hem siyasal, hem toplumsal, hem kültüreldir ve bu nedenle toplum içinde yaşayan bütün pratikleri etkilemiş ve etkilenmiştir. Yani Aydınlanma, yalnızca bunlardan biri değildir; o, hem düşünsel hem de eylemsel bir süreç olarak ele alınabilir. Bu eylemsel süreç bir şekilde Avrupa‘da başarıya ulaşmıştır. Ancak Türk Aydınlanması Avrupa odaklı hareket ettiği halde, kısmen başarılı olsa da genel olarak Osmanlı Devleti‘nin (...) çöküşünü hızlandırdığı kabul edilmektedir. ZusammenfassungMenschen mit türkischem Migrationshintergrund zählen zu einer der größten Bevölkerungsgruppen mit Migrationshintergrund in Deutschland. Im Vergleich zu Menschen ohne Migrationshintergrund leiden sie im Durchschnitt häufiger an einigen chronischen Erkrankungen, was teilweise auf ihren durchschnittlich niedrigeren sozioökonomischen Status zurückzuführen ist. Im Gesundheitssystem begegnen sie zudem unterschiedlichen Zugangs- und Wirksamkeitsbarrieren, da ihre Bedarfe und Erwartungen von Versorgungseinrichtungen oft nicht ausreichend berücksichtigt werden. Eine solche nicht nutzerorientierte Versorgung chronisch kranker Menschen kann der erfolgreichen Behandlung bzw. Krankheitsbewältigung im Weg stehen. Die Berücksichtigung von subjektiven (...) Krankheitsvorstellungen ist notwendiger Bestandteil einer nutzerorientierten Gesundheitsversorgung. Sie muss dabei sowohl die Sensibilisierung des Personals für die Krankheitsvorstellungen seiner Patientinnen und Patienten, als auch die gezielte Förderung von Krankheitsvorstellungen auf Seiten von Patientinnen und Patienten umfassen, die sich positiv auf die Krankheitsbewältigung auswirken. Gleichzeitig müssen Patientinnen und Patienten befähigt werden, sich kritisch mit eigenen Krankheitsvorstellungen auseinanderzusetzen, wenn diese eine erfolgreiche Krankheitsbewältigung behindern. Als Strategien kommen hierfür zum Beispiel Interventionen wie Storytelling in Frage, die auf dem Austausch von Wissen und Erfahrungen basieren. (shrink)

Covid-19, yeni koronavirüs salgını, insanoğlunun karşısına birdenbire çıkmış ve insan bu felaket karşısında yaşamını devam ettirebilmek için belli birtakım kurallara bağlı olmak zorunda olduğunu görmüştür. Pandeminin getirdiği yeni kurallara bağlı olarak kullanmaya başladığımız maske de bu şartlardan biridir. Tarih boyunca somut olarak maske kullanımı insana uzak ya da yabancı bir durum değildir. Maskenin sözlük anlamlarına baktığımızda tozdan ya da kimyasallardan korunmak için kullanılan bir araç olduğunu gördüğümüz gibi, bir de soyut anlamda kendini ötekine farklı bir şekilde yansıtma veya aktarma durumu (...) olarak ele alınabileceğini görmekteyiz. Biz bu çalışmamızda maskenin soyut kullanımından hareketle günümüzde kullandığımız bir araç olarak maskenin, ortak yönleri olup olamayacağını değerlendirmeye çalıştık. Öte yandan içinden geçmekte olduğumuz bu salgın hastalıkların tarihte ilk kez bizim başımıza gelen bir şey olmadığını görmezsek ve bu süreci değerlendirmezsek, geçiş döneminden sonra pandeminin birey, toplum, ekonomi, siyaset ve devlet görüşleri üzerinde ne tür değişiklikler yapacağını kontrol etmezsek, salgın günün birinde bitecek olsa bile olumsuz sonuçlarla karşılaşmayacağımızı söyleyemeyiz. Çünkü salgın insanın sadece biyolojik yönünü etkileyen bir felaket değildir, aynı zamanda insanın diğer yönü olan psikoloji tarafını da doğrudan ve dolaylı olarak etkilemektedir. İnsan psişik yönü de olan bir varlık olduğu için bu yönün de ele alınarak incelenmesi gerekir. Pandemi koşullarında birtakım kurallara uymayı alışkanlık haline getiren insan şu ana kadar getirmiş olduğu tüm değerlerinden hızlı bir şekilde kopma eğilimi göstermeye veya bu duruma gönüllü olmaya başlamıştır. Kurallara uymayan insanlar ise sorumluluk almadıkları için bir ahlak varlığı olmaktan uzak hale gelmişlerdir. Çalışmamız söz konusu salgının, insanın günlük hayatında kullandığı somut ve soyut maske tanımlarından hareketle, değerlerine nasıl yabancılaştığını ve öte yandan ahlaki sorumluluklarını ne şekilde göz ardı ettiği üzerine eğilmeye çalışmıştır. Çünkü insanın kendini bilmemesi yani eksikliğinin, aldatılırlığının ya da yanılabilirliğinin farkında olmaması onun temelde kendi benliğini, toplumsal rollerini, ahlaki ve siyasal varlık oluşunu yitirmesine sebep olacaktır. İnsan aklıyla ayakları yere basan ama kibriyle başını arşa kaldıran bir varlıktır. Eğer aklı onun kibirli başını eğdirmeyi başaramazsa kaçınılmaz olarak kibirli söz ve üslup, kibirli bakış ve görüş ortaya çıkacaktır. Kibir ile ortaya konulmuş her düşünce en temelde ahlaki sorunlar ortaya çıkaracağı gibi bir de, eksikliklerini kabul etmeyen dogmatik bir tutum (...) sergileyecektir. Kibir insana her yaptığının en doğru, en güzel, en kudretli olduğunu fısıldar durur. Bu fısıltı kişinin durup düşünmesine, aklın devreye girmesine izin vermedikçe de, hata yapılmaya devam edilir. Tüm bunlardan hareketle bu çalışmamızda günümüz felsefesinin temel bir sorunu olan, bir alanda uzmanlaşmış olma özgüveniyle birlikte kâinatın bilgisine bütünüyle sahip olunduğuna ilişkin bir düşünce geliştirmenin entelektüel dünyaya büyük bir darbe vuracağı, Yunus Emre’nin Risalet’ün Nushiye eserinin “Kibir Destanı” bölümünden hareketle ele alınacaktır. Polygyny, the marriage of a man with more than one woman at the same time is a well-known practiced in human history. Islamic law accepts the institution of polygyny as a substitute provision if it fulfills the certain conditions and reasons, -and limited the maximum number of wives to four. Although polygyny is mubah (permissible) in Islamic law, it is not an absolute right that every man can use arbitrarily. Thus in Islamic law, the legitimacy of polygyny has been attributed (...) to the presence of two basic conditions: the observance of justice among co-wives and providing maintnance. However, the observance of these conditions that is left to the mercy of men leads to the exploitation of the right for practicing to polygyny and victimization of the first spouse. Therefore, inserting some restrictions for using this right has come to the agenda from time to time in Islamic legal history. The first legal arrangements concerning the restriction of the polygyny (taaddud al-zawjāt) in the history of Islamic law were indirectly made with the Family Law Decree of 1917 which was prepared in the last periods of the Ottoman Empire. Among the late Islamic jurists, the issue of the limitation of polygyny by public authority in Islamic law continues to be discussed. The civil laws of contemporary Muslim countries contain different regulations on the issue. In this article, the restriction of polygyny by the public authority in Islamic family law will be focused on.Summary: Polygyny, the marriage of a man with more than one woman at the same time is a well-known practiced in human history. Islamic law accepts the institution of polygyny as a substitute provision if it fulfills the certain conditions and reasons, and limited the maximum number of wives to four. Thus, relevant verses in the Qur’an (al-Nisa 4/3, 129) and the Prophet’s own practice (al-Ahzab 33/50, 51, 59 al-Tahrim 66 / 3-5) show that it is legitimate for a man to marry more than one woman (up to four) at the same time in Islamic law. Although polygyny is legally permissible (mubah) in Islamic law it is not an absolute right that every man can arbitrarily use. Thus in Islamic law, the legitimacy of polygyny has been attributed to the presence of two basic conditions: the observance of justice among co-wives and providing maintenance. On the other hand, there may be some exceptional circumstances permitting polygyny in Islamic law. For example, when female population is much more than male in the society and when a, woman is can not fulfill her family duties due to her cureless illness, polygyny is permitted in Islamic law.As it can be understood from the explanations above, polygyny in Islamic law is not a general and mandatory provision that should be applied by every man who has legal capacity to marry. On the contrary, it is an exceptional provision that is justified if there are certain conditions and justifications. According to this; polygyny is a moral and legal institution that is made up of mutual consent based on individual and social conditions and needs in Islamic law. Therefore, men do not have to marry a second woman on their current wives, as well as women have the right to say “no” to marry a married man as a second wife.When the conditions and rationales indicated in the relevant verses and doctrine are evaluated together, it can be said that in order to be able to legitimize the polygyny in Islamic law, there must be three basic conditions:(1) Observing justice among spouses, (2) Having sufficient financial power to provide maintenance for spouses, (3) Existence of individual or social need or necessity.Therefore, in order to prevent the exploitation of polygyny, which is justified under certain conditions and justifications in Islamic law, the above-mentioned conditions must be fulfilled. Otherwise, polygyny can cause some problems, unrest and injustice for individual, family and society. Hence, in the presence of certain conditions and justifications, polygyny accepted in Islamic law as a moral and legal institution aiming the elimination of individual and social arbitration.Although the legitimacy of polygyny in Islamic law depends on the existence of certain conditions and special circumstances, it is a known fact that they are not always observed in practice. It can be said that the right of polygyny is a subject of abuse in practice. Therefore, the limitation of polygyny by the public authority has come to the fore in Islamic legal history. Today, control of the public authority and inserting some restrictions of polygyny continue to be discussed among the Islamic jurists. In the past, it is possible to say that the control of the exercising of this right has been done relatively by society (social environment). However, nowadays, since the society cannot perform the control mechanism, it is brought up by the state (public authority) on behalf of the society.Among the contemporary Islamic jurists regarding the supervision or limitation of polygyny by the public authority; there are two approaches: “those who accept” and “those who do not accept” such restrictions.Islamic jurists, who accept that public authority is allowed to intervene in polygyny, grounded their views on two perspectives: The first is that the polygyny is legally permissible and the public authority has the authority to limit the permissible (mubah) in Islamic law. The second is that polygyny is restricted with the conditions in the Qur’anic verses such as “husband’s observation supervision of justice among his wives” and “having the power for ensuring the livelihood (nafaqa) of his wives” and it is more appropriate for the benefit of society and the purpose of the legislator (Shari’) to be subject to the control of the public authority whether these conditions are present or not. Islamic jurists, who do not agree that the public authority has the right to intervene in polygyny grounded their views on two perspectives as well: First, polygyny is a legitimate right mentioned in the verses in Islamic law and there is no definite proof that this can be prohibited or restricted by the public authority. Secondly, it is contrary to the verses to prohibit or limit the right that the Qur’an makes legitimate (free).Thus, it is possible to say that the opinion which accepts that the public authority has to limit polygyny is more accurate in terms today’s social conditions. Namely, polygyny is linked to two basic conditions: ”husband’s observance of justice among his wives and having the power to provide maintenance for his wives. Therefore, supervision of the public authority on checking the existence of these conditions is more appropriate for the purpose of the legislator (Shari legitimizing polygyny and social benefit.In fact, the Ottoman Family Law Decree of 1917 indirectly limited the right of the husband to marry more than one woman, giving the woman right to stipulate a condition in her marriage contract that her husband not to marry a second woman. In the 1924 Draft of Family Law Decree, which was prepared after the repeal of the Family Law Decree of 1917, but not enacted, it was proposed that the application of polygyny should be presented to the approval judge.In today’-s Muslim countries, there are three different practices: namely “completely prohibiting polygyny”, ”releasing polygyny” and “giving the court the right to monitor the existence of necessary conditions “. In countries such as Morocco, Algeria, Iraq, Syria, Indonesia, Malaysia (and Pakistan), the validity of polygyny depends on the permission and supervision of the judiciary. Some of these countries which have accepted judicial review have given the judicial control for the requirement of justice, some of them the conditions of justice and maintenance some of them for the conditions of justice, maintenance and a legitimate justification.In sum, in accordance with the provisions of the relevant verses, polygyny in Islamic law is legitimately permissible (mubah). However, the public authority has the right and authority to limit the mubah in Islamic law in the case of the elimination of damage and the necessity of the public interest. On the other hand, the public authority has the right and authority to enact the law in Islamic law by preferring one of the existing ijtihads that meet the needs of the society and conforms to the conditions of the age.According to this, when the public authority made a statutory regulation that links the use of right of polygyny to the permission of the judge, this regulation is binding on society.Therefore, in the event of such a legal arrangement, it is possible for the public authority to allow the men who comply with the conditions and not to allow the ones who are not to comply with the conditions after conducting the necessary investigation. As a matter of fact, now Family Laws of many Muslim countries now include such legal arrangements. It is also worth mentioning here that there may be a necessity for a man to marry more than one woman (up to four) at the same time in terms of social benefits, when the population of male and female in a society is excessively disproportionate. In such circumstances, it is also possible that the public authority encourages, or even mandates, the marriage of men who have fulfilled the conditions to more than one woman. (shrink)

Dört neden kuramı söz konusu ilkelerin temelini oluşturmaktadır. The field of bioethics aims to ensure that modern scientific and technological advancements have been primarily developed for the benefits of humankind. This field is deeply rooted in the traditions of Western moral philosophy and socio-political theory. With respect to the view that the practice of bioethics in certain community should incorporate religious and cultural elements, this paper attempts to expound bioethical tradition of the Malay-Muslim community in Malaysia, with shedding light on the mechanism used by the National Fatwa Council (...) to evaluate whether an application of biological sciences is ethical or not. By using the application of the genetically modified food as a case study, this study has found that the council had reviewed the basic guidelines in the main references of shari'ah in order to make decision on the permissibility of the application. The fatwa is made after having consultation with the experts in science field. The council has taken all factors into consideration and given priority to the general aim of shari'ah which to serve the interests of mankind and to save them from harm. (shrink)

Advancement of modern agricultural biotechnology has brought various potential benefits to humankind, but at the same time ethical concerns regarding some applications such as genetically modified foods have been raised among the public. Several questions are being posed; should they utilize such applications to improve quality of their life, or should they refrain in order to save themselves from any associated risk? What are the ethical principles that can be applied to assess these applications? By using GMF as a case (...) study, this paper discusses possible answers to these questions from Islamic perspective. Such answers are based on the understanding of the Islamic concept of maslahah and mafsadah as well as the Islamic principles of priority. There is no specific GMF that has been declared as unlawful by Muslim scholars thus far. Nevertheless, they generally state that any GMF that contains unlawful substance is prohibited in Islam. Such statement can be understood since Islam puts highest priority to preserve shari’ah which prescribes the lawful and unlawful things in human life. Priorities have also been given to preserve human health and environment therefore any GMF that may inflict harm on both entities is also considered as unlawful. (shrink)

This paper describes maslahah, a fundamental concept in Islam and its application in deliberating permissibility of human germline gene editing from an Islamic perspective. This paper refers to He Jiankui’s research that led to the birth of the world’s first gene edited babies, who were edited to be protected from HIV. The objective, procedure, and output of the research were assessed against the conditions of maslahah. It can be concluded that the experiment did not meet the conditions; it is inconsistent (...) with the objectives of shariah and some fundamental Islamic teachings that it did not preserve greater benefit, hence it could be considered impermissible. Yakın zamana kadar dominant olan Newtoncu doğa anlayışı doğa bilimlerindeki gelişmelerle ciddi olarak eleştirilmeye başlanmıştır. Hiç kuşku yok ki bu eleştirel dönüşüm sürecinin başlangıcında Einstein ve Schrödinger fiziği vardır. Buna bağlı olarak biyolojide geçtiğimiz yüzyılın başından günümüze kadar gerçekleşen gelişmeler (evrimsel biyoloji, genetik, epigenetik, moleküler biyoloji, gelişim biyolojisi, ekoloji, fizyoloji konularıyla ilgili değişim ve gelişimler) biyolojinin temel kavramları olan fenom, genom ve çevre’deki değişimleri de içermektedir. Yeni bir doğa kavrayışını da beraberinde getiren bu süreçte biyoloji, bize canlıların çevreleriyle sınırları net (...) olmayan ve kompleks etkileşimleri üzerinden kendilerini dinamik bir halde sürekli olarak organize eden sistemler olduğunu söylemektedir. Canlıların, değişimini gözlemleyebileceğimiz kadar hızlı olan özellikleri de uzun süreler boyunca stabil halde gözlemlediğimiz özellikleri de süreçlerden oluşmaktadır. Canlılara ait tüm özellikler (fenomlar ve genomlar) kompleks bir ağ oluşturan diğer akışlarla etkileşimleri içinde akmaktadır. Bu yüzden, bir fenotipik özelliği etraflıca açıklama iddiasıyla yola çıkılıp, buna rağmen araştırmanın ve sonucundaki açıklamanın tek yönlü (sadece tek bir tür parametreyi dikkate alarak ve bir parametreye özellikle yoğun vurgu yaparak) yapılması sorunludur. Çünkü fenom, ancak bütüncül bir yaklaşımla ve fenom oluşumunun kompleksite ve dinamizm özelliklerinin farkında olarak etraflıca açıklanabilir. Bir fenotipik özelliğin etraflıca açıklanması iddiasının olmadığı durumlarda (ki standart bir biyoloji araştırması çoğunlukla bu iddiada değildir), sadece bir parametre dikkate alınabilir ve bu durum son derece anlaşılırdır. Bilim insanları her durumda (fenotipik özelliği hem etraflıca inceleme hem de tek bir parametreyle etkileşimini inceleme durumlarında) fenom oluşumunun kompleksite ve dinamizm özelliklerinin farkında olmalıdırlar ve açıklamaları da araştırma süreçleri de bu farkındalığı içermelidir. Burada araştırmacının zihnini belirleyen soru şudur: doğa bütünsel, stabil ve mekanik nedenselliğin egemen olduğu bir varlıklar alanı mıdır yoksa parçaların birbirleriyle sürekli etkileşerek yeni uyumlar ve ilişkiler geliştirdiği karmaşık ve akışkan varlıklar topluluğu mudur? Bu soruya karmaşıklık, akışkanlık, karşılıklı etkileşim ve uyum üzerinden cevap verilirse üzerine odaklanılacak olan kavram ne varlık ne fenomen, fakat süreçtir. Nitekim süreç felsefesi, biyolojideki felsefi problemler ve kavramsal incelemeler için çok kullanışlıdır. Bu durumun iki temel nedeni: 1) biyolojinin konusu olan şeylerin temel olarak süreçler olması ve 2) bilim insanlarının araştırmaları sırasında süreçler üzerinden akıl yürütmeleri ve bu yolla kavramları kullanmaları, açıklamalara, bilgiye ulaşmalarıdır. Bu çalışma, bu iki temel unsuru göz önünde bulundurarak ortaya çıkan yeni biyolojinin beraberinde getirdiği ve yeni imkanlar sunan yeni bir doğa anlayışına odaklanmıştır. Bu yeni doğa anlayışı, mekanik ve statik olmaktan ziyade kendi içinde stabil ama bütünüyle dinamik doğa anlayışıdır. (shrink)

The negotiations with the Ottomans over how exactly to define the boundary separating each party's domain were largely confused by a completely different set of criteria. The Ottomans constantly argued that the areas they claimed had historically and thus always formed part of the Ottoman territory. They installed troops in the areas in dispute and actually started to collect taxes, in part thanks to Muqbil's aggressive alliance-building. The longer this physical presence was maintained, the more difficult it was for the (...) British to argue that these areas were actually Dali. It was largely the growing insurgency in Ottoman Yemen, in some respects a product of British machinations, that ultimately led to the 1903 capitulation by the Ottoman authorities to British demands for formal control of the Dali plateau. Theism in Indic philosophy from the point of view of Christianity.

Esta é a terceira vez que tenho a honra de participar dos Colóquios Habermas, o qual tem propiciado aos pesquisadores da Ciência da Informação, no Brasil, um encontro com o pensamento do filósofo e sociólogo Jürgen Habermas. No processo, aprendi com meus colegas pesquisadores e entrei na rede de conexões conceituais que tece o fio de Habermas no tear conceitual da Ciência da Informação, no Brasil. Começou em 2020, quando compartilhei o resultado de exercício sobre o conceito de esfera pública (...) aplicado no Laboratório de Tecnologias Intelectuais – LTi. Na revisão da literatura, na Brapci, usando, identifiquei 94 artigos que fazem menção ao descritor, no período de 1972 a 2020. Alguns desses artigos me ajudaram a compreender o conceito e aplicá-lo às ações de mediação no Portal do LTi na web. Uma nova busca, combinando tornou-se necessária, sendo recuperados apenas oito arquivos. O entendimento, ao final, é que as redes sociais do LTi podem ser consideradas como esfera pública, embora não apresentem o aspecto político partidário presente na abordagem habermasiana. (shrink)

Investiga a produção científica na temática Epistemologia e Historiografia da Ciência da informação a partir dos Anais do Encontro Nacional de Pesquisa em Ciência da informação, de dados da Plataforma Lattes e da literatura indexada na Base de Dados da Ciência da informação. Identifica o coletivo de pesquisadores que dão continuidade e consistência ao trabalho epistemológico e historiográfico da área. Destaca, na temática abordada, um grupo que consegue produzir mais que a maioria dos demais pesquisadores. Pesquisadores com alunos na pós-graduação (...) tendem a publicar mais artigos em colaboração do que os outros autores que se não encaixam nesse perfil. Os resultados permitiram a descrição de perfis de pesquisadores a partir de um recorte. Conclui que as pesquisas sobre a referida temática, alinhadas aos preceitos dos estudos métricos, podem permitir o desenvolvimento de teias conceituais e metodológicas da Ciência da Informação. In this article, our aim is to examine the place of “reality” in Richard Rorty’s thought in view of the important and key discussion of language in the philosophy of this thinker. In other words, we know that with the occurrence of the “linguistic turn” in the middle of the twentieth century, the relationship between language and reality has become one of the central debates of philosophy, especially analytical philosophy, and has become of particular importance. Is it language that determines (...) the external reality for us? Is knowing the world outside the mind possible only through the possibilities that language gives us? And to what extent does the structure of language affect our cognitive pattern? These are only a part of the linguistic concerns that have occupied the minds of contemporary philosophers. The main concern and problem of the present article, which has been approached using a descriptive-analytical method, is to examine the relationship between language and reality in Richard Rorty’s thought and to show how he defends the linguistic structure of having reality. Rorty, following an analytical philosophy that, in addition to detailed analyses of traditional philosophical concepts, like the concepts of truth, meaning, necessity, etc. and by changing the discussion from experience to discussion from language in the direction of pragmatizing the basic principles of positivism, believes that it is trans-lingual and trans-temporal. The common denominator that Plato found in the outside world and transferred to man in the Cartesian-Kantian tradition is sought in analytic philosophy in language, and so analytic philosophers continue to pursue the traditional philosophy project of providing a trans-historical and eternal framework for the accurate representation of the world. Rorty tries to overcome this view of analytical philosophers with a Darwinist and pragmatic view of language and under the influence of philosophers such as Wittgenstein.For Darwinists, language is a tool among other tools that gives its users the ability to better and more efficiently adapt to their environment and meet their needs. For the likes of Wittgenstein and like-minded people, despite their many and sometimes profound differences, language had an important and pivotal place with its eventual and possibility feature. Influenced by thinkers such as Wittgenstein, and in the context of his Darwinist and pragmatic approach to language, Rorty attributes certain characteristics to language that can be said to influence his whole thought. Firstly, he considers language as a tool like other tools and, therefore, considers it to have no fixed nature and identity. Given that it is not possible to leave the language and on the other hand language has a poetic and metaphorical character, the function of language cannot be a representation of reality and reality can never be available to us naked and as independent of language and descriptions. Therefore, from Rorty’s point of view, reality is a linguistic and constructed matter of language that we humans have invented in cooperation with each other and in accordance with our historical-cultural situation and needs. Of course, Rorty’s point in saying that reality is made by language is by no means that we create reality arbitrarily and as we wish; rather, what is happening is that we are responding to an external stimulus, a response of various sentence types that manifests itself as linguistic reactions. Bu bölümde karşılaştırmalı siyaset teorisinin, siyaset teorisinin hem bir alt alanı, hem de bir yöntemi olarak ortaya çıkış sürecini ele alacağım. Bu bağlamda öncelikle ‘karşılaştırmalı siyaset teorisinin’ (KST) ne zaman ortaya çıktığı sorusuyla ilgileneceğim. Ardından, KST’nin neden ortaya çıktığı, ne olduğu ve nasıl yapılması gerektiği ile ilgili tartışmalara değineceğim. Bu tartışmayı, son otuz yılda literatürde öne çıkan bazı çalışmalar ve isimler ve onların tartıştığı konular, meseleler, sorular ve sorunlar üzerinden (karşılaştırmada özne/nesne ilişkisi ve güç problemi, soruların ya da sorunların evrenselliği (...) meselesi, Batı/Avrupa merkezciliğini yeniden üretme riski) ve eleştirel bir değerlendirmeye tabi tutarak yürüteceğim. Son olarak, başlangıçta Amerika odaklı bir tartışma/gelişme olarak ve siyaset teorisinin belli sorunlarını (Avrupamerkezcilik, yanlış evrensellik, dar görüşlülük) aşma hedefiyle ortaya çıkan KST’nin aradan geçen otuz yılın ardından bugünkü durumu ile ilgili bazı değerlendirmelerde bulunacağım. Welcome to the 25th volume 1st issue of Cumhuriyet Theology Journal. With this issue, we are excited and happy to be 25 years old. Cumhuriyet Theology Journal has gained a rapid momentum with its format and publishing principles, and managed to attract the attention of the world of science. With the Isnad Citation System developed within the Cumhuriyet Theology Journal and the work-shops held in 2018 and 2019, a number of decisions were taken to increase the publication quality of Theology (...) Field Journals and many of them were implemented. The third workshop was carried out virtual on 26 December 2020 under the name of "Social Sciences Academic Publishing Workshop III" in cooperation with Atatürk High Insti-tution of Culture, Language and History and Sivas Cumhuriyet University. The theme of the workshop was determined as "Refereed Journal Publishing". Preparations for our 4th workshop have begun. In this sense, our journal continues its mission of being both a new ecole and a school with an effort to increase the quality of academic publishing. Moreover, we have also announced the preliminary review form and the review form for the blind review process. We examine Turkish and English titles, summaries, and keywords to make sure that they correspond to the field’s terminology. Furthermore, we require proper nouns and concepts/terms to be written in the reference style of TDV Encyclopaedia of Islam. We also particularly require for the articles to use the Isnad Citation Style. To improve the academic quality of the journal, we have also checked the article up for plagiarism. The articles that are marked with a result above %15 are returned to the authors with a plagiarism report. It might be right to note here that we have been getting more attention from scholarly world day by day with our mission and standards. The journal has received 93 articles between January 1- March 1, 2021 from the academic world. All articles went through the pre-review process to check the referencing and transliteration style before testing them using a plagiarism checker. We then have forwarded the articles that successfully passed the plagiarism check to our reviewers. Following this process, we have been able to offer to you 25 articles three of which are in English at this issue. We are delighted to offer you the various ranges of themes and topics with this new issue. This essay argues for the importance of an organismic perspective in plant biology and considers some of its implications. These include an increased attention to plant-environment interaction and an emphasis on integrated approaches. Furthermore, this essay contextualizes the increased emphasis on the concept of organism in recent years and places the concept in a longer history. Recent developments in biology and worsening environmental crises have led researchers to study plant responses to changing environments with whole plant approaches that situate plants (...) in their environments, emphasizing the intricate and dynamic interaction between them. This renewed attention to the organism recalls the debates of the early twentieth century, when organicism was one of the three main frameworks in biology (along with vitalism and mechanism). Some scholars see this renewed importance today as a “return” of this earlier period. This essay argues that including insights from plant biology will benefit philosophy of biology research that examines the concept of organism and organicism now and in earlier periods. A comprehensive account of the concept of organism should involve a botanical conception of the organism as well as a zoological one (which is more frequently considered). Although this essay does not aim to present a conceptual analysis, it presents examples of how an organismic perspective can be useful for understanding concepts (such as phenotype, stress, etc.) and research processes (such as experiment set-ups, data processes, etc.) in plant biology. Philosophy of biology investigations that aim at a comprehensive understanding of the concept of organism can benefit greatly from examinations of cases in plant biology, both now and in the past. Understanding the actions of others is fundamental for human social life. It builds on a grasp of the subjective intentionality behind behavior: one action comprises different things simultaneously (e.g., moving their arm, turning on the light) but which of these constitute intentional actions, in contrast to merely foreseen side-effects (e.g., increasing the electricity bill), depends on the description under which the agent represents the acts. She may be acting intentionally only under the description “turning on the light,” but did not (...) turn on the light in order to increase the electricity bill. In preregistered studies (N = 620), we asked how adults and children engage in such complex subjective action interpretation and evaluation in moral dilemmas. To capture the deep structure of subjects' representations of the intentional structures of actions, we derived “act trees” from their response patterns to questions about the acts. Results suggest that people systematically distinguish between intended main and merely foreseen side-effects in their moral and intentionality judgments, even when main and side-effects were closely related and the latter were harmful. Additional experimental conditions suggest that, when given ambiguous information, the majority of subjects assume that agents act with beneficial main intentions. This “good intention prior” was so strong that participants attributed good intentions even when the harmful action was no longer necessary to resolve the dilemma (Study 2). These methods provide promising new ways to investigate in more subtle and fine-grained ways how reasoners parse, interpret, and evaluate complex actions. (shrink)
