This reflection on Palestine’s political impasses in relation to the experiences of other colonized places and peoples was inspired by the current ferment in critical indigenous and native studies, and now Palestinian studies, about settler colonialism. Tracing the promises and pitfalls of new imaginations of sovereignty and self-determination emerging through indigenous activism, the essay reflects on museums and contested rituals of liberal recognition in North America and Australia to highlight both the stark differences in the situations of Palestinians under Israeli (...) rule and the radical significance of the recent efflorescence of Palestinian cultural projects. Focusing particularly on the history of the Palestinian Museum (that opened in Birzeit in 2016), the article argues that the productivity of the settler-colonial framework lies less in the way it maps directly onto the situation on the ground than in the new solidarities it engenders and its potential to burst open the Palestinian political imagination. This chapter presents the text of a lecture on the anthropology in the territory of rights given at the British Academy's 2009 Radcliffe-Brown Lecture in Social Anthropology. This text discusses the transnational initiatives for Muslim women's rights and the everyday lives of some village women in Egypt and argues that anthropologists can provide critical insight into the limits and politics of global discourses on rights. It suggests that anthropologists should intervene into the worlds of power that authorise, shape, and naturalise (...) rights work and the understandings of human social life to which it gives rise. This essay examines the experience of rewriting historical narratives from a world-system perspective, drawing on the author's attempt to construct an integrated image of the world economy in the thirteenth century. Searching for an intermediate epistemological path between unanchored postmodern hermeneutics and overconfident positivism, the author argues that three apparent deviations from the "ideals of positivist social science," which she ironically labels eccentricity, ideology, and idiosyncrasy, can yield significant "remakings" of world history. Eccentricity, namely, recognizing perspectives other than those that (...) conventionally view the world through the eyes of the West, can help historians to escape from ethnocentrism or Eurocentrism. Ideology, more conventionally called theory, is essential if historians are to select and integrate new material. And idiosyncrasy in the interests and backgrounds of historians can often be the source of the re-vision so essential for challenging earlier historical narratives. The author alludes to parallels with ethnographic research methods and cautions against substituting these three aids to research for rigorous attention to empirical sources and "the real world.". This study focuses on discussing the choices of lessee in Jordan legislation because of a Defense Order in Curfew to face Corona Virus Disease 2019 and the impact of Corona virus disease 2019 on the lessor obligation. The study finds out that the lessee has two options: to cancel the contract regarding force majeure or refuge to court and to reduce the fare amount regarding exceptional circumstances. The study also recommended issuing a Defense Order specifying the exact percentage to be (...) reduced. In the absence of a Defense Order, the study of a friendly agreement should be recommended between the lessor and the tenant on the reduced percentage. (shrink)

In this paper an Artificial Neural Network (ANN) model, for predicting the category of a tumor was developed and tested. Taking patients’ tests, a number of information gained that influence the classification of the tumor. Such information as age, sex, histologic-type, degree-of-diffe, status of bone, bone-marrow, lung, pleura, peritoneum, liver, brain, skin, neck, supraclavicular, axillar, mediastinum, and abdominal. They were used as input variables for the ANN model. A model based on the Multilayer Perceptron Topology was established and trained using (...) data set which its title is “primary tumor” and was obtained from the University Medical Centre, Institute of Oncology, Ljubljana, Yugoslavia Test data evaluation shows that the ANN model is able to correctly predict the tumor category with 76.67 % accuracy. This paper describes an Intelligent Tutoring System for helping users with ADO.NET called ADO-Tutor. The Intelligent Tutoring System was designed and developed using (ITSB) authoring tool for building intelligent educational systems. The user learns through the intelligent tutoring system ADO.NET, the technology used by Microsoft.NET to connect to databases. The material includes lessons, examples, and questions. Through the feedback provided by the intelligent tutoring system, the user's understanding of the material is assessed, and accordingly can be guided to different difficulty (...) level of exercises and/or the lessons. The Intelligent Tutoring System was evaluated by a group of users and the results were more than satisfactory in terms of the quality of the material and the design of the system. (shrink)

This paper develops phenomenological resources for understanding the nature of intercultural understanding, drawing on the work of Merleau-Ponty in dialogue with feminist anthropologist Abu-Lughod. Part One criticizes Western framings of non-Western violence against women that render the experience of non-Western Others inaccessible. Part Two discusses how certain strains in Western feminism reinforce some of these problematic framings. Part Three offers a phenomenological account of our experience of other persons, and Part Four argues that intercultural understanding takes the form of (...) a “variation” between one’s own and the other’s experience. Part Five explores the implications of this phenomenology of cross-cultural understanding for interpreting dynamic cultural transformations, and the politics of violence against women, in an interconnected and unequal world. Ancient Arabic literature dealt with linguistic sciences such as sarf, nahiw, belagha and Islamic sciences such as fıqh, hadith and tafsîr. This is known to the elite and the common people. But what is hidden and forgotten is that Arabic literature also includes the foundations and rules of modern sciences such as sociology and economics. Among the ancient Arabic literature is the writing of Maqamat, which holds an important position among the masterpieces of Arabic literature. For this reason, it is (...) important to study the writing of Maqamat from the perspective of the various disciplines of Islamic sciences and modern sciences. This study deals with fıqh and economic issues within the framework of Al-Hariri’s famous book, Maqamat. The aim of the study is to reveal the fıqh and economic aspects of Makamat writing through Hariri's Makamat as an exemplary study. The approach followed by the study is to select three maqama from Al-Hariri’s book, which contained fifty complete maqama, and to search for what is in them of fıqh and economics. Accordingly, the study includes three main headings, and in these three headings, fıqh, farâid (inheritance law) and economic issues are discussed, respectively. Although the science of farâid (inheritance law) is a branch of fıqh, it is singled out for mention independently because it has its own rulings. The study examined the jurisprudential aspect of the Maqamat in the thirty-second maqama called “the Tayyibi Maqamat,” the aspect related to the science of farâid in the fifteenth maqama called “the Faradiya Maqamat,” and the economic aspect in the forty-ninth maqama called “the Sassanid Maqamat.” The method followed by Hariri in her book is to present the issues in the form of stories through two fictional characters, Haris bin Hammam and Abu Zayd, whom she chose as mirrors reflecting the two opposing identities of the society. Abu Zaid appears in different forms and in various clothes. He sometimes appears as a beggar who deceives and a thief who betrays, and at other times as a preacher who advises and a scholar who guides. Rather, he is an imaginary character that Hariri put in place. Wherever he went, he met Al-Harith bin Hammam and the strange and adventurous incident begins, or he appears as a person from whom Al-Harith narrated the incident and the story. Harith is the person who always warns his against bad things, orders his to do good, and sometimes condemns his if he does evil. The results obtained in the study are, first of all, the determination that the Makâmât writing deals with the subjects of the science of fiqh as in the thirty-second makama and the subjects of the science of farâid (inheritance law) as in the fifteenth makama and the subjects of economics as in the forty-ninth makama. It is seen that some of the principles put forward by Adam Smith years later were also present in the Maqamat literature centuries ago. The fact that fiqh views are according to the Shafi'i sect shows that the Shafi'i sect was widespread in the region at that time. Additionally, as can be understood from the forty-ninth makama, there is also a profession of begging in the society where Hariri lives. The study also reveals the society's interest in, submission to, and acceptance of moral principles at that time, and shows that the Arabic language reached its peak during this period. (shrink)

Grammar studies on Arabic started with Abu Aswad ad-Duali (d. 69/688) in Basra, the center of science and culture. Grammar studies have improved with scholars such as Khalil b. Ahmed (d. 175/791) and Sibeweyhi (d. 180/796) during the Abbasid period (750-1258). These studies, which continued in the style of commentary and annotation after the Abbasid period, reached its peak in the Ottoman period (1300-1922). One of the scholars who wrote a work in the style of commentary on the science of (...) nahw (syntax) is Ali b. Muhammed b. Mas‘ud al-Bistami al-Shahrudi (d. 875/1470). He became famous with the nickname Musannifak because he started to write books at a young age. 15th-century Ottoman scholar Alaaddin Musannifak Mas‘ud al-Bistami al-Shahrudi (d. 875/1470) grounded the nahw issues, he used the Qur’an, hadith and Arabic theology; he also applied to rational proofs such as qiyas and istishab. In this article, Musannifak’s method of applying only to narrated sources such as the Qur’an, hadith and Arabic words in order to reveal his methods of commentary is discussed. In this context, Musannifak’s method of reference to narrative sources in his commentary has been revealed with a qualitative approach by analysing his work on al-Misbah by Nasir b. Abdiseyyid b. ‘Ali al-Mutarrizi (d. 610/1213), Sharḥ al- Miṣbâḥ fi al-naḥw. (shrink)

The book under study is "Kitāb al-Uṣūl" and its commentary "Sharḥ al-Uṣūl" written by Ibn Ḥallād al-Basrī, one of Abū Ḥāshim al-Jubbāʾī's leading students. This work is the result of the Mu'tazilite Manuscripts Project conducted by Sabine Schmidtke and D. E. Sklare, and has been published in an edited edition by Camilla Adang, Wilferd Madelung, and Sabine Schmidtke. The study, entitled "-A Critical Edition of the Ziyādāt Sharḥ al-uṣūl by the Zaydī Imām al-Nāṭiq bi-l-ḥaqq Abū Ṭālib Yaḥyā b. al-Ḥusayn b. (...) Hārūn al-Buṭḥānī " begins with quotations from Ibn Ḥallād's Kitāb al-uṣūl or its incomplete commentary, Sharḥ al-uṣūl. This is followed by various quotations written in addition to Ibn Ḥallād's incomplete commentary, which are mostly from Kādī ʿAbd al-Jabbār's Sharḥ. Then the commentary of the Zaydī Imam Nāṭīq-Bilḥāq is added, and finally, the text is completed by the commentary of his student and annotator, Abū al-Ḳāsīm Aḥmad b. Mahdī al-Ḥasan. Although the text does not directly define the usūl al-hamsa, the reader can recognize this progression. Beginning with tawhid, the text moves on to justice, followed by va'd-va'id, and finally concludes with topics such as predestination, sustenance, accident, and fate. (shrink)

Cet article examine la théorie de la connaissance immédiate d' ʿAbd al-Jabbār à partir de sonMughnī, ainsi que de textes écrits par ses élèves ou par (...) des Muʿtazilites tardifs. Est aussi étudié le rapport entre cette théorie et les arguments théologiques d'ʿAbd al-Jabbār. : In Islamic inheritance law, although in different ratios, the shares of male and female siblings are already determined. The testator has no right to deprive the inheritors of inheritance. However, in today’s Islamic countries, it is well known that some testators deprive the inheritors of inheritance fully or partially through various ways such as donation, last will, and fictitious. Last will, as a legal term, means that a person transfers his\her property complimentarily to person\persons who have the right to (...) inherit originally or legally, provided that it is valid after death. In Islamic law, principally, making a last will to foreigners is regarded as a legitimate act. However, today, as it was in the past, the right of last will is being misused in causing harm to the inheritors and depriving them of the inheritance. For this reason, in Islamic law, there have been taken some precautions to prevent any possible misuse of the last will right in order to protect the rights of the inheritors and third persons. These precautions are as follow: The last will that is made is restricted to one third of the total amount; It is prohibited to make last will to the inheritors; There have been laid down some formal conditions for proving a last will; It is prohibited to make a last will with the intention of harming the inheritors, even if it is one third and less than one third. All legal systems that accept the legitimacy of the last will set out some regulations and restrictions on the use of the last will to protect the rights of individuals and public order. In Islamic law, the last will is also regarded as a legitimate regulation in order to meet people's earthly needs and to be a means of solidarity and getting reward in hereafter. However, in today's Islamic countries, the right of last will is being misused in causing harm to the inheritors and depriving them of the inheritance. In Islamic law, the precautions that have been taken to prevent any possible misuse of the last will right in order to protect the rights of the inheritors and third persons are as follow: The last will that is made is restricted to one third of the total amount The Prophet Muhammad visited Sa'd b. Abu Vakkas due to his illness in the year in which the Last Pilgrimage was being performed. Sa'd b. Abu Vakkas had no children other than a daughter. That is why he told the Prophet that he wanted to make a last will according to which the two third of his property shall be given to the foreigners. Thereupon, the Prophet Muhammad told him that he could only give one third of his property maximum. The Prophet Muhammad explained the reason why as follows: “It is better to leave your inheritors as wealthy than to leave them as needy people.” ; Muwatta, “Wasiyyāt”, 3; Tirmīzī, “Wasāyā”, 1, Abū Dāvūd, “Wasāyā”, 2; Nasāī, “Wasāyā”, 3; Bayhakī, “Wasāyā”, 5.). The Muslim jurists who regard this event as a proof have arrived at the consensus that the Muslims can only give one third of their property to foreigners by means of the last willIt is prohibited to make last will to the inheritors The Prophet Muhammad said, "Allah surely gives every right. There is no will to inheritors.” The Muslim jurists who regard this saying as a proof have arrived at the consensus that the last will to inheritors cannot not be made. There have been laid down some formal conditions for proving a last will Since a last will is a process that is upon death, there might be some disagreement between the inheritors and those who are a last will made to after the death of testator. For this reason, the last will shall be proven so that any possible dispute would be prevented. In the classical Islamic Law, it is emphasized that the last will should be oral, written or by any means of signs that might express oneself well, and the last will shall be made in the presence of the witnesses as a matter of principle. However, in my opinion, following the verses that require the last will to be made before the witnesses, placing the last will on record through an official procedure is much more suitable in regard to the purpose of the Shari’ and the spirit of Islam. Indeed, in the Islamic countries, the Family Law Codes are subject to the legal dispute that a case cannot be open if a last will is not been made in accordance with the law. It is prohibited to make a last will with the intention of harming the inheritors, even if it is one third and less than one third. In Islamic law, the last will made to foreigners is limited to one third of the property of the testator. Nevertheless, still there is a possibility of misusing this right against the inheritors with the intention of depriving them of the inheritance even if it is one third and less than one third. However, the verse which lay down the condition "the will made without harming the inheritors" indicates that the last will is legitimate only with the intention of not harming the inheritors, even if it is less than one third. Therefore, the last will made to foreigners with the intention of harming the inheritors, as it is contrary to the purpose of the law maker, can be restricted by the public authority. No doubt, the most important of the above-mentioned precautions is to restrict a testator's right of the last will to one third of the property when it is a foreigner to whom he is willing to give from his property, and the remaining two third is left to the inheritors. That is why in Islamic law, this two-third share, which is legally guaranteed and will be passed on to the inheritors, is called "reserved share". In principle, except for some exceptions, the testator has no authority to give from the "reserved share." Although in Islamic law, theoretically, the two-third share called "reserved share" is legally secured, nowadays, the testators are misusing their right of the last will. Therefore, the question “is it possible for the public authority, in Islamic law, to restrict a person’s essentially legitimate right of making last will in a case of misuse?” is quite important concerning our subject matter. It has been accepted as a basic principle that the acts in the category of "mubah" in Islamic law are to be taken without violating the rights of others and harming the public. Accordingly, it is possible for the public authority to restrict the acts that are taken in contradiction to the purpose of Shari and the interest of others. From this point of view, the use of the right of the last will in Islamic law is not absolute and unrestricted. Therefore, in the case of harming to the inheritors, it is possible that the right to be restricted by the public authority. As a result, the last will right, in Islamic law, is restricted in four different ways in favour of the inheritors as briefly summarized above. (shrink)

Abū Isḥāq Ibrāhīm al-Zāhid al-Ṣaffār is one of the important representatives of the Kalām thought of the Ḥanafī-Māturīdī School. He was born in A.H. 450/ C.E. 1058 in Bukhara that is one of the city of Transoxiana/Mawara al-nahr where Maturidi School has emerged around this socio-cultural environment. He completed his education and served as a leader (rais/ ṣadr) of the Hanafite scholars there until he was exiled to the city of Marv. Upon his return from exile, he passed away in (...) Bukhara in A.H. 534/ C.E. 1139. The present study aims to determine his method in Kalām. The introduction outlines the subject, significance, purpose, method, and sources of the research. In this study, it was employed a method that focuses on a person in which he/she is examined with his/her views and thoughts by taking into account his/her socio-cultural factors. By doing this, the first chapter of this study deals with the political, socio-economic, and scientific situation in Transoxiana, and the activities of diverse religions, sects, and philosophical schools in this region in A.H. V-VI/C.E. XI-XII. In the second chapter, it studies al-Ṣaffār’s life, scientific personality, works as well as the sources that he made references to in his works in detail. In the third chapter, the kalām method of al-Ṣaffār has been tried to be determined. For this purpose, it analyzes his extant works, Talkhīṣ al-adilla li-qawāʿid al-tawḥīd and Risālah fī al-kalām and elaborates first on his defense of the Kalām that gives great importance to reason (ʿaql) and to intellectual debates, if necessary, in theological issues. Then it explores his theory of knowledge with his ideas on the definition, possibility, sources, and types of knowledge, and the epistemological understandings he defensed or criticised. Furthermore, to determine his Kalām method, it evaluates his approach towards the value of ‘aql and naql (Qurʾān-Ḥadīth) as sources of knowledge. Since this issue is a distinctive tool for unveiling the kalām methods of different mutakallims and Muslim sects. Finally, it finds out the types of istidlāl, meaning inference of one thing from the other that he used when he argues and defends his views, and illustrates with examples. (shrink)

Abū Ishāq al-Ṣaffār was one of scholars of the Western Qarakhānids’ period who followed the Kalām thought of al-Māturīdī (d. 333/944). His theological works Talkhīs al-adilla and Risāla fī al-kalām, his method in kalām, and frequent reference to his works by Ottoman and Arab scholars indicate that al-Ṣaffār is a respected and authorative Māturīdī theologian. The article focuses on his defense of the kalām. By adding a long introduction to Talkhīs about the naming, importance, and religious legitimacy of the science (...) of kalām, Saffār asserted that the kalām should be learned. When systematical vindication of the science of kalām is examined, it is understood that al-Ṣaffār is the first theologian who reserved a private and voluminous part for defensing the kalām among Ḥanafī-Māturīdīs. Even though he does not state its systematic, it can be understood that vindication of kalām in al-Ṣaffār divides into three parts as of explanation, demonstration and refutation. Al-Ṣaffār’s defending the science of kalām shows that there were opposite thoughts against kalām in the 4th/10th and 5th/11th centuries throughout in Transoxania. In this period Aṣḥāb al-Ḥadīth and Ikhwān al-Ṣafāʾ were the opposite fronts of kalām. In addition, he was trying to go beyond the oppositions of Ḥanafī jurists. His vindication is consistent and has scholarly depth because it is able to be against a strong opposition. -/- SUMMARY: Abū Ishāq Ibrahīm b. Ismāil Zāhid al-Ṣaffār al-Bukhārī is a scholar belonging to the Ḥanafī theological tradition which was improved by the contribution of Ḥanafī theologians who used thinking system of Abū Ḥanīfa (d. 150/767) as base and adopted Abū Manṣūr al-Māturīdī (d. 333/944) and his thoughts in historical process. The contents of his theological works Talkhīs al-adilla li-qawāʿid al-tawḥīd and Risāla fī al-Kalām, the method that he used, and references to his works made by Ottoman and Arab scholars indicate that he is an important Māturīdī theologian. The article focuses on his defense of the science of Kalām. -/- In Talkhīs al-adilla, there are two sections including the subject of naming, and importance and necessity of Kalām discipline. Here, the necessity of learning Kalām and its value are defended in detail. -/- Besides, rumors “Abū Ḥanīfa turned away from the science of Kalām in his doomsdays” and that “He prohibited to make occupation with Kalām completely” are evaluated. -/- When systematical vindication of the science of Kalām is examined, it is understood that al-Ṣaffār is the first theologian who reserved a private and voluminous part for defensing the Kalām among Ḥanafī Māturīdīs. Even if Abū Manṣūr al-Māturīdī, Abū al-Yusr al-Bazdawī (d. 493/1100) and Abū Muʿīn al-Nasafī (d. 508/1115) defend that the science of Kalām is not wrong for religion; yet, the vindication of Kalām does not take a place under a separate title and in a detailed manner in any of Māturīdī theologians works. -/- The method that al-Ṣaffār used when he is defending the science of Kalām, differs from strategy of Abū Ḥanīfa. While Abū Ḥanīfa has mentioned that there is a need for the science of Kalām under these new circumstances, al-Ṣaffār has defended theologians who were charged with being Ahl al-Bidaʿ, by trying to prove that the prophets especially the Prophet Ibrāhīm, even the Companions of the Prophet Muḥammad (Ṣaḥāba) and the Successors of the Companions (Tābiʿūn) scholars use their minds and make arguments in religious matters. In this respect, he emphasizes that the Qurʾān orders to think and discuss gently, not to be stay in silence: “And dispute with them, using what is best” (16.125-126). Therefore, he states that this discipline which took a mission to explain and defend the creed of Islam (ʿaqīda), cannot be characterized as an innovation (bidʿah) or illicit. -/- His vindication method can be defined as a more developed type of method that Abu’l-Ḥasan al-Ash’arī’s (d. 324/935) used in Risāla fī istiḥsān al-khawḍ fī ʿilm al-kalām. Even though he does not state its systematic, it can be understood that vindication of Kalām in al-Ṣaffār divides into three parts as of explanation, demonstration and refutation: -/- a) Explanation: Explaining the necessity and importance of the science of Kalām by giving information about its definition, names, value and place among other principles. -/- b) Demonstration: Revealing the religious basics of the science of Kalām from the Qurʾān, the Sunna of the Prophet Muḥammad, the Companions of the Prophet, and the Successors of the Companions thus specifying that it is legitimate for religion. -/- c) Refutation: Replying the claims having aim to weaken the value of Kalām principle and its religious legality. -/- Al-Ṣaffār describes ‘the science of Kalām’ as ‘Knowing the Real with the evidences which help to reach the absolute information’. By allocating the concept of 'Ḥaqq', he repeats the definition of Kalām as “it is to know God with certain evidences” in a part of his work, and “it is to know the principles of religion (uṣūl al-dīn) with certain evidences” in another part. He describes Kalām as “Knowing ḥaqq / God / uṣūl al-dīn by depending on evidence”, and tries to prove that it is wrong to consider a science which performs the stated duty, as illicit and abominable and thus turn away from it. -/- Al-Ṣaffār thinks that it is right to call this principle as ‘Kalām’ because of the certain evidences leading to the truth that this science has used. This thought was defended by other theologians as well. -/- For example, according to Saʿd al-Dīn Masʿūd al-Taftazānī (d. 792/1310) it seems like to say “This is the word (kalām), not the other knowings” by the way of the power of evidences used in Kalām.Thus, it is appropriate to give name Kalām for this science which based on certain evidences. -/- Al-Ṣaffār’s explanations revealed in scope of vindication of the Kalām are adopted by some of following scholars. Ḥusām al-Dīn al-Sighnāqī (d. 714/1314) in his book called al-Tasdīd sharḥ al-Tamhīd fī qawāʿid al-tawḥīd quotes Saffâr’s explanations as the same. -/- Al-Ṣaffār indicates that the method told in the Qurʾān is to reply questions about religion, beliefs and rejection instead of remaining in silence. The duty taken on by Kalām is this vindication activity performed by the prophets whose examples are described in the Qurʾān and which is legal and demanded. His way of thinking and vindication of the Kalām resembles that of Abū Manṣūr al-Māturīdī. Al-Māturīdī says, “Prophets and we were ordered to invite infidels to Islam. When this invitation happens, the respondents will ask for evidence and explanation, and discussion will be inevitable. Therefore, discussing and talking about subjects of Kalām is not objectionable”. -/- Thoughts of al-Māturīdī and al-Ṣaffār regarding the vindication of the Kalām were repeated by Nūr al-Dīn al-Ṣābūnī (d. 580/1184), and Fakhr al-Dīn al-Rāzī (d. 606/1210) later. According to al-Ṣābūnī, the evidences put against deniers and especially the discussion made by the Prophet Ibrāhīm to defend his own belief, prove the legality of Kalām discipline. Likewise, according to al-Rāzī, the duty of Kalām is just an activity performed already in the Qurʾān and ordered to the prophets. At this point of view, since the prophets were leading to Kalām, banning this activity is nonsense. -/- According to al-Ṣaffār, the reason for why Abu Hanifa avoids his son Hammād from these discussions is that Abu Hanifa does not like discussions based on obstinate. Otherwise, it cannot be that Abū Ḥanīfa prohibits to learn Kalām and make discussion about Kalām. According to him, this behavior of Abū Ḥanīfa results from that people discussing with him are ignorant about the subject of Kalām, discussion turns to an obstinate, and coming to an end of discussion seems impossible. This comment of al-Ṣaffār is quoted in Miftāḥ al-saʿāda wa-miṣbāḥ al-siyāda by ʿIṣām al-Dīn Aḥmed b. Muṣṭafā Tashköprüzāde (d. 968/1561) and in Minaḥ al-rawḍ al-azhar fī sharḥ al-Fiqh al-akbar by ʿAlī b. Sulṭān Muḥammad al-Qārī (d. 1014/1606) as same as his words. -/- Al-Ṣaffār’s defending the science of Kalām shows that there were opposite thoughts against Kalām in the 4th/10th and 5th/11th centuries throughout in Transoxania.In this period Aṣḥāb al-Ḥadīth and Ikhwān al-Ṣafāʾ were the opposite fronts of Kalām. In addition, he was trying to go beyond the oppositions of Ḥanafī jurists (fuqahāʾ). Because some of the Ḥanafī jurists thought that Abū Ḥanīfa forsook occupation with the science of Kalām and even he prohibited his son to have interest in this discipline. But some of Ḥanafī theologians such as al-Māturīdī, al-Nasafī and al-Ṣaffār protested this thought which describes Abū Ḥanīfa as a banner for Kalām. -/- His vindication is consistent and has scholarly depth because it is able to be against a strong opposition. -/- His book Talkhīs al-adilla li-qawāʿid al-tawḥīd is a unique source in terms of containing vindication of the Kalām in detail and also influencing the approaches of the next period scholars. Abu Ishaq al-Saffar was one of scholars of the Western Qarakhanids' period who followed the Kalam thought of al-Maturidi (d. 333/944). His theological works Talkhis al-adilla and Risala fi al-kalam, his method in kalam, and frequent reference to his works by Ottoman and Arab scholars indicate that al-Saffar is a respected and authorative Maturidi theologian. The article focuses on his defense of the kalam. By adding a long introduction to Talkhis about the naming, importance, and religious legitimacy of the science (...) of kalam, Saffar asserted that the kalam should be learned. When systematically vindication of the science of kalam is examined, it is understood that al-Saffar is the first theologian who reserved a private and voluminous part for defending the kalam among Hanafi-Maturidis. Even though he does not state its systematic, it can be understood that vindication of kalam in al-Saffar divides into three parts as of explanation, demonstration and refutation. Al-Saffar's defending the science of kalam shows that there were opposite thoughts against kalam in the 4th/10th and 5th/11th centuries throughout in Transoxania. In this period Ashab al-Hadith and Ikhwan al-Safa were the opposite fronts of kalam. In addition, he was trying to go beyond the oppositions of Hanafi jurists. The article covers main features of Early Modern Sufi Philosophy in Crimea. Based on the new discoveries of Arabic manuscripts in Turkey (libraries in Istanbul and Corum) and Germany (Berlin library), the study provides analysis of the Sufi approach towards human onthology, developed by Crimean thinkers Ibrahim al-Qirimi, Abu Bakr al-Kafawi and finally Hussam al-Din al-Qirimi. Apart from the classical Sufi rethinking of a human being as the body-soul entity making spiritual journey towards final Perfect Man (al-insan al-kamal) and (...) approaching ultimate revival, Crimean thinkers also paid great attention to the issue of human freedom, naming it by special term (Arabic al-istiqlal, literary meaning “independence”). In contrast to rather conservative background of Islamic discursive theology (kalam) and other schools of Islamic philosophical thought of the Post-Classical period, special attention to this concept can be regarded as evidence of some "humanistic" tendencies among thinkers of the Crimean Khanate. The article also notes that this concept of freedom was considered by Crimean thinkers as one of the important conditions for the manifestation of Divine Attributes in human existence; that is, the anthropologic measurement of the pantheistic idea of "unity of being", widely poplular among Sufis of those times. Taking into account the fact that the modern notion of "freedom" in the Arabic philosophical thought is based predominantly on Western concepts, the new reading of Sufi Post-Classical manuscripts reveals autochthonous cultural potential of this tradition. This article provides an ethnographic analysis of the agency of women who reside in the rural areas of the Argentine Pampas, based on their promotion and production of agroecological family horticulture. The recognition of these women’s agency through care – care of their children, global care, and green care – offers a significant challenge to some metrocentric and Eurocentric feminist perspectives that claim care work can only be oppressive for women. The first of these types of care empowers women to (...) improve the nutrition of their children. It also relates to another underlying type of care, which is to provide a sufficiently robust education as to ensure their children have a better and alternative future. The second type of care has the power to socially transform the territorial space of the district’s countryside and its marginalized populations which, through care, acquire greater public and political attention. The third type of care empowers women to transform and care for the environment, and is exercised by not using pesticides in horticultural production and by disseminating knowledge on the matter. In line with discussions of postcolonial feminism (Abu-Lughod, 1986; Mahmood, 2001; Suárez Navaz, 2008), I argue that certain properties that are attributed to women relative to caregiving – by way of a dichotomous view of gender relations – fuel their agency: for these women the cultivation of vegetables is a form of agency that actively combats food, training and labor inequality. ABSTRACT. — This article examines the concept of adaptive preference as it has appeared in feminist political philosophy since the 2000’s. This concept refers to preferences shaped in compliance with an oppressive environment and that jeopardizes one’s well-being. In the first part, the two most influential conceptions of adaptive preference will be discussed : the ones provided by the philosophers Martha Nussbaum and Serene Khader. Afterwards, I will assess these conceptions in the light of recent work by feminist anthropologists Saba (...) Mahmood and Lila Abu-Lughod, in which they revaluate the political project of feminist philosophy underlying adaptive preferences. -/- RÉSUMÉ. — Cet article porte sur le concept de préférence adaptative tel qu’il est apparu en philosophie féministe politique et anglophone depuis les années 2000. Ce concept désigne les préférences formées conformément à un milieu oppressif et qui vont à l’encontre du bien-être. The manuscript preserved in the Bibliothèque National de France, arabe 4235 is a fragmentary copy of Abū ‘Alī l-Qālī’s al-Bāri‘ and belonged to a certain Ibrāhīm b. Ḥumām Ibn Aḥmad. Although we know nothing about him, we have information about his father, Ḥumām Ibn Aḥmad al-Uṭrūš, who lived in Cordoba between 357/968 and 421/1030. He was a professor of Language and Poetry and, at the same time, he copied books for living during the crisis of the cordovan Caliphate. A marginal (...) note in f.22b, in a personal codex of Abū ‘Alī l-Qālī allows the author to believe that the manuscript comes from a privileged Cordovan environment. The orthographic and philological care with which the copy was made, as well as the graphic style makes also evident that the manuscript was the work of a language professor and not of an expert copyist. The context of its production and the data provided by a codicological and paleographical analysis, make also clear that the dating of this manuscript should be the end of the IV/X century or the beginning of next century. Muʻtazilite thinkers put forward the first systematic ideas for the relationship of essence and attributes, one of the most fundamental and complicated issues of Islamic theology, and comprehensive explanations to the question of God’s names. Although almost all the thinkers agreed on uṣūl al-khamsa, they differed in their approach to the principle of unity (tawḥīd). ‘Abbād b. Sulaymān, who lived in the period when these approaches emerged, is a scholar who reveals his distinctive view of God’s names and attributes in (...) which heslightly differs from his contemporaries such as Abu al-Hudhayl al-‘Allāf, Mu‘ammar b. ‘Abbād al-Sulamī and Ibrāhīm b. Sayyār al-Naẓẓām from the Basran Muʻtazila, by his extreme opinions on the Muʻtazilite principle of tawḥīd. He is one of thefour principle thinkers who presented original opinions in the early Basran Muʻtazila. Also he is the only known student of Hishâm al-Fuwaṭī and constitutes the last major circle of this tradition of knowledge that ended after him. This article aims to reveal the relationship between essence and attributes, the names and attributes of God in a holistic and systematic way in the thought of ‘Abbād b. Sulaymān. Unfortunately, his works have not survived to the present day and has not received the attention he deserves. Since his views were scattered in the classic books, our study was focused primarily on these classical sources. The modern literature was not ignored, either. The relevant records, analysis and criticism were re-contextualized. According to ‘Abbād b. Sulaymān, the view that “Allah is a thing” is the same with the view that “Allah is other (ghayr)”, he draws attention to a definite distinction between Allah and human beings. In his thought about the relationship between Allah and space, he rejects the idea that God could be related to space or anything spatial in order to refrain from an anthropomorphic conception of God. In the case of visibility (ru’ya) of Allah, he radically opposes the idea of “seeing Allah with the heart,” which was adopted by the majority of the Muʻtazila. He tries to solve the issue in his own terms by avoiding the terms essence (dhāt) and nafs in the relationship between God’s essence and His attributes. He reveals a unique classification of names and thus adopts the method of analogy. He does not accept essential attributes as the majority of the Mu’tazila did. On the other hand, he tacitly accepts that Allah’s names have their own meanings in a way that they are not merely words (aqvāl). By a true comparison or perfect analogy (fī ḥaqīqati’l-qıyās), while he rejects that God is ālim, qadīr etc., he tries to ground that human beings is ālim, qadīr etc. He does not admit that God is eternally samʻi and baṣīr. Without interpreting samʻi as His knowledge or baṣīr as His power, he accepts that each name has a distinctive functionality. He rejects the assumption that God knows conditionally. Regarding the issue of whether living beings are in the knowledge of Allah before they exist, it makes a dual distinction: “a direction that can be subject to the eternal knowledge” and “the direction in which it actually came to existence”. Because of his view of non-existent and creatures, Ibn al-Rāwandī and modern resources refer the view of the eternity of objects to him. However, when the relevant records are examined, it is seen that this claim is not valid. According to ‘Abbād, Allah is capable of creating possible things that he knows, although He does not create impossible things that he knows, even though He is capable of creating them potentially (bi-al-quwwa). Allah has not created evil, neither literally nor figuratively; so much so that He created only man, not faith and unbelief. It is not possible to talk about any good that he did not create. He defends the createdness of the Qur’an (Khalq al-Qur’ān) by saying that the Qur’ān was created of accidents. About God’s names, he states that God has the names indicating His relationship to the universe. He does not accept that in eternity He is a willing agent, creator etc. However, he also does not accept the otherwise. He emphasizes that creation is reserved only for Allah. On the other hand, according to him, Allah creates without secondary causes and thus does not create things for a specific purpose. Regarding the revealed attributes (or informative attributes, khabarī), he recites these expressions only when reading of the Quran.He states that these expressions should not be used for Allah under any circumstances. He avoids naming Allah as wakīl, kafīl, laṭīf, kā’in, fard and mutakallim as he says that the name wāḥid should be used only for praising Him. (shrink)

Mamluks reigned in Egypt a long time is an era of Kipchak Turks that have influence management, and Kipchak Turks has been influential in a period in the administration there. During this period, that Turkish rulers do not know Arabic language well, Turkish language is spoken in the palace and also idea of being closer to Turkish manager screated an interest in learning. One of the famous scholars realizing that interest is Abū Ḥayyān al-Andalusī. Abū Ḥayyān by learning Turkish language (...) especially from Fakhr al-dīn Divrigi and analysing written previously works, wrote Kitāb al-Idrāk li-lisān al-Atrāk. This book has consisted of introduction, vocabulary and grammar section. We also aimed in our study to examine Kitāb al-Idrāk in terms of content and than in terms of lexicography of the linguistic branch. -/- SUMMARY Mamluks reigned in Egypt a long time and in its reign Kipchak Turks had influence in management. One of the famous scholars realizing that interest is Abū Ḥayyān al-Andalusī (d. 745/ 1344). The true name of Abū Ḥayyān is Muḥammed b. Yūsuf b. Ali b. Ḥayyān al-Tawḥīdī and he is an Andalusian linguist and exegete. Abū Ḥayyān who came from a Berber family born in the Matahsharesh village of Granada in 654/1256 and died in Cairo in 28th time 745 (11 July 1344). There is not much information about his family in the sources, but it is mentioned that he has a daughter whose name is Nada, a son named Hayyân in his name, and some grandchildren which are named Muḥammad and Ummu Ḥayyān. Abū Ḥayyān became a famous as Ethīr al-dīn and at the same time, he is also known as Naḥvī, Ghirnātī (Granadian), Ceyyānī, and Nafzī. He took lessons in Granada from great scholars such as Abd al-ḥaķ b. Ali al-Anṣarī, Abū Ḥasan al-Ubbezī, Abū Cafer Aḥmed b. Ibrahīm b. Zubair, Ibn Abū al-Ahvas and became a proficient scholar and teacher in matters such as morphology, syntax, language, commentary, hadith, methodology of Fiqh and Kalām. He wrote about 18 works in different sciences and if we mention some of that are al-Baḥr al-muhīt, al-Nahr al-mād, Tuhfat al-arīb bimā fī al-Qur'ān min al-gharīb and some of his works have reached to our time and some of those did not. Abū Ḥayyān left Andalus for various reasons and visited many centers of science and eventually continued his scientific activities in Cairo. Abū Hayyān, who is a great interest in learning languages, has learned Turkish language with the other popular languages ​​such as Persian, Amharic and Himyarite language and written books about these languages. His mainly works about Turkish language are the Kitāb al-Idrāk li-lisān al-Atrāk, Zehv al-mulk fi naḥv al-Turk, al-Af'al fi lisān al-Turk and al-Durret al-mudiyye fi lughat al-Turkiyye. These works did not reach to our days except Kitāb al-Idrak. Kitāb al-Idrāk consists of three sections, namely introduction, dictionary which includes 2200 words, and grammar that is composed of morphology and syntax and this book which is known as al-Idrāk is written in the Turkish which is spoken in XIV-XVI century tongue and named as Middle Turkish Period-Mamluk Kipchak Turkish. The first chapter begins with basmala and continues with detailed his genealogy, personal record, praise to Allah and salawat and salaam to Prophet Muhammad. After this introduction, it is explained the intention of writing this work. The second chapter is a dictionary which the words are explained in alphabetical order. Although Abū Ḥayyān speaks about 23 letters in the Kipchak alphabet, he does not explain the words related to all, but examines 19 items. In this dictionary, it does not take part some letters, that is letters sā, zāl, zā (letters of lips which is written in English th); letters dâd, ayn, fa (letters of throat) which Arabs use. In the third chapter, there is a part of the tasrif (knowledge of morphology) which is generally called knowledge of morphology today. In this section, it is dealt with about the types of words namely, name of diminutive, name of belonging name, plural, agent name, passive name, exaggerated factor name, infinitive, name indicating the location, name of device, arbitrary name, and idâd (which adds are derivation of noun from name like lık, lik at the end of the word) and then it comes to the end with shadda. Section of syntax which is called by the author as consisted of compound and is prepared according to systematic of Arabic grammar begins with the sentence structure in Kipchak language. After that it continues with definite-ambiguous names, verb (orders, past, imperfect verbs), subject-predicate in nominal sentence, nevāsiḫ (additional actions helped change the meaning of the noun phrase), Arabic leyte which express by the actual wish mold and the like, such as two mef'ūl area of ​​the heart of verbs in Arabic told (I think) were deaf ( Turkmen thinks he), acts like it yet scientists (verb phrase in), acts offender (verb-subject), the abutment of the verb nefiy prepositions, prepositions, the nehiy (ban), passive verbs and naib-i fail (so-called subject); other elements of the sentence, called the act müteallakat are: cognate accusativ, direct object, time period (time complement), the envelope space (located complement), state (envelope), causative object, the exception, the specification, conflict of laws, the annexation, the oat, the dependencies: adjective, conjunction, confirm, the apposition; conditional structure. After these, he mentions to letters of meanings (huruf al-maani), and concludes this chapter with information about the date, place, and name of the author of the book. Abū Hayyān used induction method in the book. Since he gave the forms of the words in double, then the triple, quadruple, quintet and other forms. He tried to teach the pronunciation of words by explaining the etymology of word sand the changes of the voices. He examined the words which are synonyms/ contrasted, synonym voice, singular/plural, and words that are passed by foreign languages into Turkish dialects then they are turned into Turkish word structure; brought out witnesses from proverbs and poetries. As a result, in this work, which consists of dictionary and grammar sections, it can be said that it is used predominantly in linguistic information - translation method . (shrink)

Throughout the history of Islam, mosques and masjids have been in a position where Muslims both perform their prayers and perform their scientific activities. In this sense, in the history of Islamic culture, Muslims mostly learned and taught sciences such as the Qur'an, tafsir, hadith and fiqh in these places until the spread of madrasahs. Especially the al-Masjid al-Nabawi, which the Muslims built here with their migration from Mecca to Medina, has become a full center of science. People called Companions (...) of Suffa have a great share in this situation. Because they used this place both as a housing and a school. This function of al-Masjid al-Nabawi affected the mosques of cities such as Kufa. With the foundation of Kufa in 17/638, mosques were built in the center and in the quarters of the city. The Companions who came here for different reasons conveyed their knowledge to the public in these mosques. Thus, in the first period the masjids in Kufa became the centers where the Companions conveyed their knowledge of Islamic sciences. Over time, various scientific circles were established in these mosques, and scholars transferred their knowledge of tafser, hadith and fiqh to the next generations. Especially many important jurists were trained in these places. Some of them are ’Alqamah b. Qays, Masruq b. Abdurrahman, Aswad b. Yazīd, Ibrāhīm al-Naḥa’ī, Ḥammād b. Abū Suleimān, Abū Ḥanīfah, Sufyan al-Thawri, Abū Yūsuf and Imam Muhammad. That these important jurists mostly acquired their knowledge of fiqh in the mosques in Kūfa and that some of them had important effects on the formation of the Hanafi sect made important the quantity and quality of the fiqh education in these places. As a result, it has been seen that the masjids in Kūfa have an important role in the raising of many jurists and the function of these places in this regard has been studied. In this study, the distortion of claims on the text of the Qur’ān in Tafsīr al-Qummī which is one of the main sources of Shī‘a has been investigated. al- Qummī, the first scholar of the Shi’ite scholars, claims that in the account of the commentary are distorted in the text of the Qur’ān with various subtitles, such as the verses that are in the land of Allah's descendants and distorted verses. While interpreting the verses, he discloses this claim in detail (...) and sometimes gives the correct shapes of the revelations as the difference of interpretation, sometimes based on the narrations, and sometimes in the way of reading the verse. In this study, the verses alleged to be literally distorted in his commentary have been determined and this claim has been compared with other commentaries. The purpose of the article in this context is; in the case of al-Qummī exegesis, it is the examination of the verses allegedly distorted in the Qur’ān and the determination of the Shī‘ī commentators based on the doctrine of sects by changing the text of the Qur’ān. Summary: The Glorious the Qur’ān by almight Allah, it is a divine book that has been revealed to Muhammad (pbuh) through Gabriel. It has been preserved from all kinds of changing, transmutation and distortion, since the day the Qur’ān was revealed. “ إِنَّا نَحْنُ نَزَّلْنَا الذِّكْرَ وَإِنَّا لَهُ لَحَافِظُونَ ” “We have, without doubt, sent down the message; and we will assuredly guard it (from corruption)”. This verse is the greatest proof that the Holy Qur’ān is under protection, and it has not been distorted or will not. Distortion (falsification) is the change of the sacred texts by adding or subtracting the original text, arbitrarily changing the meaning, or misinterpreting the actual text. This term is often used to describe Jews’ and Christians’ deliberately changing or misinterpreting their own sacred texts. However, this term is also used by the a few scholars of the Shī‘as Imamiyya sect for the Qur’ān. There are two schools who claims the distortion of the Qur’ān within the Imamiyya Shī‘ah. The first is the Akhbāris who claim that the Qur’ān has been distorted; and the second is the Usūlites who oppose this claim. Those who have Akhbārī thoughts do not only interpret the verses according to their sectarian teachings but go further and claim that these teachings are included in the text of the Qur’ān. As a matter of fact, one of those who have this idea is Qummī. The full name of Qummī, the first scholar of the Shi’ite scholars, is Abu’l-Hasan ‘Alī b. İbrāhīm b. Hāshim. It is mentioned that al-Qummī, who had no information about the date of his birth in the sources, died in 329 Hijri. He has written books in almost all of science such as Tafsīr, Hadith, Fiqh and History. Among the books of Qummi, only the book he wrote in the field of commentary has reached the present day. Shī‘a accepts this commentary as the main source. This work, which is classified under the category of tafsīr bil riwayah(narration commentary), is regarded as tafsīr bildirayah(acumen commentator) because he gives weight to his own opinions. Qummī, by trying to make the Qur’ān as book thats only support ʿAlī and his descendants, reflecting a complete ideology in the form of representation of political tafsīr in Shī‘a. It is seen in the issues mentioned in the preface of his tafsīr that he used the method that supports this ideology. As a matter of fact, that Qummī in the preface attempt to explain the doctrines of the sect such as the imāmate, prophecy and the seized of Ahl al-bayt rigt of caliphate in the context of the verses that are different from that which Allah has revealed, distorted verses and taqdim and ta’khir verses in the Qur’ān text. Briefly, Qummī in the preface to of his tafsīr gives examples of some verses that are literally distorted, and explains these distortions in detail when interpreting the verses in question. Qummī gives in the “distorted verses” section that there are deficiencies in some of the verses and claims that the verse is revealed in this way by adding words that are not actually found in the verse. According to Qummī, one of the words extracted from the text of the Qur’ān is “‘Alī” that version of this words in Arabic is “ علي ”. These words are usually in the verses as “ فى علي ” means that “about ‘Alī”, “ فى ولاية علي ” “guardian of ‘Alī”, “ فى حق علي ” “about ‘Alī’s right”. According to Qummī, another expression derived from the Qur’ānic text is “ آل محمد ” means that “family of Muhammad”. He sometimes bases his claim on the narrations that the verses revealed in that way and sometimes verse recited in that way among different recitations. Qummī says that some of the verses have been revealed as such by by adding various phrases to verses besides “ فى علي ” means that “about ‘Alī” and “ آل محمد ” “family of Muhammad”. Some of these words that added to verses are mentioned as the different style of recitation in other sources. In the other words this differentiate is related with how you are reciting. Qummī, another classification which he refers to regarding the allegation of distorting, is that some verses are different from those revealed. He gives examples of this issue in various forms. He sometimes claims that when someone reads a verse, he interrupts the recitation by saying that “the verse has been revealed in this way” base on the narratives; sometimes saying that the verse is revealed differently by indicating the verse is not appropriate in terms of meaning and sometimes without making any explanation claims that how the verse revealed. Qummī’s another distortion claim is that taqdim and ta’khir among the words constitute the verse. Qummī says that the verse is different from the one that was actually revealed, after he stated that it was taqdim and ta’khir among the words mentioned in the verses. Qummī proves the allegations of distortion on the text of the Qur’ān in various ways. One of the ways he follows in this context is that giving the expressions like “ هكذا نزلت ”/ “the verse was revealed in this way”, and “ نزل جبرائيل بهذه الآية هكذا ” “Gabriel sent down the verse in this way” by changing the the different kind of revealing of those verses. The second way Qummī follows is that mentioning the verse different from the fact that it is by changing the its originality. The third way he follows is that mentioning added words as the different kind of the recitation. However, Qummī did not use this method that much. Indeed, while Shī‘ī tafsīrs mention this kind of expressions as a different kind of recitation, Qummī mentions them as a different kind of revealing in his claim. Most of the verses alleged to have been distorted in the Qummī’s tafsīr are relate to the teachings of the Shī‘a sect. In this context, Qummī uses various expressions while explaining his claim that some verses in the Qur’ān has been distorted. By adding ‘Alī phrase, claims that “ فمحى اسمه من هذا الموضع ”/ “His name has deleted from this place”, and by adding “ آل محمد ”/ “Muhammad’s family”, claims that “ فأسقطوا آل محمد من الكتاب ”/ “Muhammad’s family has been reduced from the book”. Sometimes, making some changes on words such as changing the structure of the term “ أمة ”/ “ummah” as “ أئمة ” /“Imāmiyya”. Under the influence of the ideology of Shī‘a, Qummī asserts that Shī‘ah teachings such as prophethood, and Imāmiyya are not just the Qur’ānic interpretations but rather are the Qur’ānic teachings by adding words to the text of the Qur’ān and making some changes in the construction of the Qur’ān. Ḥadīths have been preserved and recorded in various ways since the Companions. These activities continued dur-ing the Tābiīn (the successors of the Companions) Period. So much so that these methods have formed the infra-structure of other methods that will emerge later. In this context, before the 70's (A.H.), works named al-Aṭrāf appeared. However, these first works consisted of the notes that they wrote some of the ḥadīths before coming to the science assemblies to help students remember in ḥadīth learning. Ḥadīth (...) scholars have adopted and applied this method in a very short time. Thus, this method also provided the opportunity for the formation of the first written ḥadīth documents. In addition, with the writing of ḥadīth works, it has turned into a system of al-Taṣnīf and al-Takhrīj in order to make maximum use of these books and to reach the source of a narration that is tried to be found. As a result, al-Aṭrāf literature, which can be evaluated as index, has emerged. As a matter of fact, the first examples of this literature, arranged alphabetically according to the names of the Companions or ḥadīth texts, started to be given since the 4th (A.H.) century. In this way, the way to quickly benefit from the accumulation of the ḥadīth area has been opened. This article focuses on the historical adventure of al-Aṭrāf and their contributions to the ḥadīth field, as well as literature knowledge of the works of al-Aṭrāf which are of great importance for both al-Kitābah, al-Taṣnīf and al-Takhrīj.Summary: In order to understand and practice the religion of Islām, great efforts have been made both in the past and later periods in order to convey the words, verbs, interpretations and qualifications of the Prophet to the next genera-tions as they are protected from all kinds of falsification and changes. This process, which started with memoriza-tion and partly writing at the beginning, has gained momentum with the use of other methods since the period of Tābiīn. In this context, the method of aṭrāf was started to be used to facilitate memorization, to be a reminder, and to transmit the ḥadīth through the hearing of the ḥadīth sheikh. The first examples of this method were seen by Muḥammad b. Sīrīn during his participation of his teacher Abīde/Ubayda Salmān in the scholarly assembly. At this stage, the relevant method was manifested as writing a passage from the beginning of the ḥadīth. Thus, the aforementioned method, which had great contributions in recording and memorizing ḥadīths in accordance with the original, has gained widespreadness and application among the ḥadīth scholars like Ubeydullaḥ b. Omar, Shu’bah b. al-Ḥajjāj, Sufyān as-Sawrī, Mālik b. Anas, Ismāīl b. Ayyāş and Vakī b. Jarrāḥ in a very short time. In this context, Yazīd b. Zuray’ stated that he went to his teacher without his aṭrāf work of ḥadīths which he transmitted from Shu’bah and listened to ḥadīth in this way. Therefore, this mentioned event is important in terms of putting forth that Shu’bah allowed the aṭrāf method in his assemblies. The method was used by Aḥmad b. Ḥanbal, who traveled to Madīnah to convey the reports recorded with the mentioned method of his teacher Abū Alḳama al-Farawī and at the same time listen to the related transfers from him, but who could not reach his goal. Therefore, the related narrations show that aṭrāf method was used effectively by ḥadīth scholars to remember the ḥadīths in the 1st and 2nd centuries, so sections from the narrations were written during the preparatory stage before coming to the scholarly assembly. Ultimately, the importance of these works, which manifest in different ways and offer great contributions to writing, is an undeniable reality for the history of ḥadīth.Aṭrāf, the plural form of taraf that literally means the side and edge of something, mean a section, phrase or first part that indicates the whole of the ḥadīth. This method, along with the formation of ḥadīth literature, has been started to be given as a name to the works organized alphabetically according to the name of the Companions or ḥadīth texts by mentioning some of the ḥadīths with the 4th century. In this sense, aṭrāf has started to become a unique literature in a sort of taṣnīf and takhrīj method in order to make use of the ḥadīth writing easier.Aṭrāf studies may aim to bring together the isnāḍs (chains of transmitters) in all books, or they can be limited to the chains in certain books. Aṭrāf books contain the ḥadīths in the Ṣaḥīḥān or Kutub al-Sittah and are written in alphabetical form based on the name of the companions or according to the texts of ḥadīth. The first of these, which has the attribute of the musnad in a sense, is arranged in alphabetical order according to the name of the Companion, and if there are many people who narrate from him, according to the names of the tābiīn and taba-i tābiīn (successors of the tābiīn). Accordingly, the narrations of each companion were determined and listed in al-phabetical order in aṭrāfs in musnad-type, and a passage was written from the ḥadīths and marked as books/chapters in the places of relevant narration. On the other hand, the second type of aṭrāf books were ar-ranged by giving a few words from a section that allows remembering the head or all of the ḥadīths without in-cluding chains, and then placing these texts in alphabetical order.The type of aṭrāf offers the opportunity to see different chains of narrations together and provides many facilities for the ḥadīth researchers. Therefore, ḥadīth researchers show great interest in this genre. Aṭrāfs provide many benefits for both ḥadīth chain and text. In this respect, it is possible to talk about many advantages of the ḥadīth to its transmister such as the determination of mutawātīr, garīb, azīz, mashhūr, mutābī or the testimony of ḥadīth; to provide facility to make a reputation research of a riwāyah (narration), to provide an opportunity to determine the location of the narrations in the primary sources; to detect the link or any blackout in the chain, to reach the nu-merical knowledge of ḥadīth narrated by a companion or other narrators, to obtain information about narrators whose identity is not explicitly stated, to know the first narrator, to provide the protection of the ḥadīths from taḥrīf or alteration, to give the opportunity to identify the subject they contain, to be able to obtain text integrity by getting various chains, the detection of the sabab al-wurūd (the context of ḥadīth).Due to the contributions we have mentioned above, many books on aṭrāf literature that started with Abu’l-Ḥasen Ali b. Omar ad-Dārakutnī have been published. Among them Aṭrāfu’s-ṣaḥīḥayn/el-Jem`u bayna’s-ṣaḥīḥayn by Abū Mas`ūd Ibrāhīm b. Muḥammad b. Ubayd ad-Dimashkī, Aṭrāfu’s-ṣaḥīḥayn by Abū Muḥammad Ḥalaf b. Muḥammad b. Ali al-Vasiṭī, Zaḫāiru’l-mavārīs fi’d-dalālati alā mavāzi`i’l-hadīs by Abdülganī b. İsmāīl en-Nāblūsī and Tuḥfatu’l-ashrāf bi ma`rifati’l-aṭrāf by Abu’l-Ḥajjāj Yūsuf b. Abdurrahman el-Mizzī can be mentioned. Some of the related works are arranged in musnad style while others are arranged according to the first word of ḥadīth texts. As a result, the method of aṭrāf has become a kind of indexer in order to facilitate reaching the source of the re-ports and make the highest level of use required by the classification and bookings of the ḥadīths in the 3rd centu-ry. These works, arranged alphabetically in the name of the Companions or according to the texts of the ḥadīth, have taken their place in the history of the ḥadīth with their many examples, both in the form of taṣnīf and the method of takhrīj by mentioning a part of the ḥadīth by the head. A notion that the theologians consider as a physical explanation model while discussing the movement in accordance with their theological views on the comprehension and interpretation of the universe is i‘timād. In conclusion, this notion, which has various meanings in different contexts, has been used to express “the tendency of object in motion, potential energy, pressure or resistance of an object to another object”. Within this framework, including weight-lightness, ascent-descent, impulse-pull etc., many phenomena related to the unidirectional and compulsory movement (...) of objects have been explained. On the other hand, theologians dealt with i‘timād in the context of their own conceptions of the universe, in relation to their understanding of causality while discussing the movements of bodies in the universe and their changes-transformations, and the causality relationship between them. As a result of their discussions, they asked questions about i‘timād and tried to find answers to these questions in the perspective of their own views of the universe. Furthermore, in relation to the theory of i‘timād, Mu‘tazilite scholar Abû Ishâq Ibrâhîm al-Nazzâm (d. 231/845) discussed the theory of tafra (leaping) and put forward contrary arguments. One of those who sought answers to the questions discussed in this direction and expressed an opinion on i‘timād is the Ash’arî theologian Abû al-Maâlî al-Juwaynî (d. 478/1085). He discussed i'timād in terms of the accidents of spatial generation and used i'timād as a universal explanatory theory for the phenomena of movement, space, weight and lightness, and directional phenomena such as up and down. From this point of view, he also tried to interpret i'timād with examples from natural phenomena and objects. In doing so, he synthesized i'timād within his own system and presented it as an explanatory element by considering the Ash'arite metaphysical principles through the examples he frequently gave. Thus, he put forward views on whether the movements of objects give rise to i'timād or not, and drew attention to the usage of i'timād in the Muʿtazilite and Ashʿarī schools. In this context, he tried to prove with examples whether the Muʿtazilite understanding of iʿtimād overlaps with the Ashʿarī understanding of iʿtimād. On the other hand, al-Juwaynī put forward his proofs in the context of his criticisms of the Muʿtazilites in general and al-Naẓẓām in particular. His criticisms were generally in response to the views of Muʿtazilite scholars on the phenomenon of motion in the context of iʿtimād. In fact, al-Juwaynī criticized the arguments of Abū ʿAlī al-Jubbāʾī (d. 303/916) and Abū Ḥāshim (d. 321/933) in the context of the theory of tawlīd and al-Naẓẓām in the context of the theory of tafra through their arguments. In this direction, the paper concentrates on how Juwaynî stated the examples he put while proving the theory of i‘timād in terms of movement phenomenon and what he comprehended from it. In addition, the paper discusses his criticisms against Nazzâm’s theoretical and experimental arguments he brought in the context of tafra theory while elaborating Juwaynî’s explanation of movement phenomenon. The debate on the Prophet’s parents’ (abawayn al-Rasūl) religious status and their position in the hereafter goes back to several narrations from the Prophet himself. This subject, which can principally be considered part of the problem of the religious status of ahl al-fatrah, seems to be raised by the Shīʿah as an issue of creed in line with their understanding of imamate. Abū Ḥanīfah’s (d. 150/767) statement in his al-Fiqh al-akbar that “Prophet’s parents passed away on kufr/jāhiliyyah” is seen as (...) a Sunnī reaction to this earlier position and led to a new area of discussion shaping the approach of several scholars to the issue. The earliest treatises dedicated to this issue are attributed to al-Ghazzālī (d. 505/1111) and Abū Bakr Ibn al-ʿArabī (d. 543/1148), but these works did not survive to this day. The earliest examples available today are the six epistles that al-Suyūṭī (d. 911/1505) penned. Literature on the Prophet’s parents flourished during the Ottoman times after the introduction of al-Fiqh al-akbar to the Ottoman scholarship. Starting with the first examples that belong to Ibrāhīm al-Ḥalabī (d. 956/1549), Ibn al-Khaṭīb al-Amāsī (d. 940/1534), and Kamālpashazādah (d. 940/1534), the treatises in question were mostly written in Arabic in the Ottoman scholarly milieu. Consequently, it seems that Rawḍat al-ṣafā fī wāliday al-Muṣṭafá is the first treatise dedicated to the issue in Ottoman Turkish. In the library catalogue records, some bio-bibliographical sources, and consequently in some modern studies on the issue of abawayn al-Rasūl, Rawḍat al-ṣafā wrongly attributed to a certain Wajdī Aḥmad Efendī (in Turkish: Vecdî Ahmed Efendi). This is probably due to the author’s presentation of himself in the introduction as just “Wajdī,” without making further description. Besides the data in Bursalı Meḥmed Ṭāhir’s Osmanlı Müʾellifleri, no more information could be provided about the identity of Wajdī Aḥmad Efendī who is shown as the author of the treatise. Intra-textual signs such as the author’s words about the reason and process of writing the work, the way he handled the subject and the evidence he put forward indicate that the treatise belongs to Nūḥ ibn Muṣṭafá al-Qūnawī (d. 1070/1660). Indeed, it overlaps with the fact that Nūḥ ibn Muṣṭafá presented himself as Wajdī in many of his other works. Seemingly the fact that Nūḥ ibn Muṣṭafá defends the view that the parents of the Prophet are among the people of salvation (ahl al-najāh), and while doing this, he was mainly based on the view that they were resurrected after death and that their souls are recaptured after they believed in the Prophet, stem from various reasons such as the view that attributed to Abū Ḥanīfah, Nūḥ’s Sufi identity to the extent that he was initiated to the Khalwatiyyah/Gulshaniyyah along with the ever-growing Sufi influences and the consequent idea of nūr-i Muḥammadī in the public sphere, the authority of the narrations attributed to the Prophet, and perception about the Prophet Muḥammed in the public imagination. Turkish-Islamic literature contains numerous religious literar writings. In the existing literature, it can be seen that many kinds such as tawhīd, munājāt, nʿat, mawlid, hilya, hijrah-nāma, shafāʿat-nāma, miʿrāj, qisas al-anbiya, ramaḍāniyya, and al-asmā al-ḥusnā were written. Al-Asmā al-ḥusnā, written in the form of poetry and prose, were mostly sharḥ or their khawaṣṣ were explained. Çihil-nām al-Manẓūm, which is mentioned in the study, was written as khawaṣṣ al-asmā al-ḥusnā. The work is a poet entitled as Fażāyī. Manuscript was written in the (...) last quarter of the fifteenth century, and thus, it is presumed that the poet lived in the same century. This work has been identified in a manuscript. In addition, the poet’s Hadiyyat al-aḥbāb, der-Bayān al-maqāmāt al-darwīshān, Kitāb al-sharʿiyyat al-arbāb, and Ghazaliyyāt al-Darwīsh Fażāyī four other works have been identified. In the writings of the asmā al-ḥusnās, the names of ninety-nine were emphasized. In this study, the forty names of God are expressed. The text presented is a continuation of the tradition of writing some prose works written in Arabic and Persian. Çihil-nām al-Manẓūm, written in Arabic prose and known as Asmā al-Idrīsiyya it can be seen as a free stsyle translation of the prophet Idrīs. Forty names in the content of the work, their proper-ties, when, how much and how to read is explained. In this study, firstly the information about the subject of Qurʾān, hadith, Arabic, Persian and Turkish literature in the beautiful names of God is provided. Then, the information about the poet Fażāyī was given. Çihil-nām al-Manẓūm was introduced and the transcriptional form of the text was given.SummaryOne of the reasons that deeply affect a nation is the change of religion. This change did not only affect the individual but also influenced the society in which he was born and grew. One of the nations with strong influence is the Turks. Turks, after Islamization, have estab-lished a new civilization. One of the areas where this Islamic civilization reflects is the literary aspect of society. In this literature, which has begun to be formed, religious genres such as tawhīd, munājāt, nʿat, mawlid, hilya, hijrah-nāma, shafāʿat-nāma, miʿrāj, qisas al-anbiya, ramaḍāniyya, have been revealed. One of them is about God. Religious literary writings about God were written in the form of tawhīd and munājāts, which consist of one or more prophets found at the head of the dīwāns, or as the annotations of asmā al-ḥusnā or as khawaṣṣ asmā al-ḥusnā.In time, the need for some Turkish literary and scientific works to be translated into a different language were born. It can be seen that with some changes such as subtraction and addition, texts are rewritten or poetic works are translated into prose. The original of our research subject Çihil-nām al- Manẓūm’s is written in Arabic and prose. Çihil-nām al-Manẓūm, it is a munājāt of the work known as Asmā al-Idrīsiyya, which describes the call of prophet Idrīs.Asmā al-ḥusnā is a religious term used mostly to describe the attributes and names of God. In the Qurʾān, there is no information about the number of asmā al-ḥusnā mentioned as a concept. However, the number of the names of God in the Qurʾān is 155. This number is differ-ent in ḥadīths. It is widely accepted that the number of asmā al-ḥusnā is 99. Some Islamic schol-ars have argued against such restricting statements, arguing that ninety-nine names, such as the hiding of the Night of Qadr, were hidden in all Divine names during the month of ramaḍān, while others suggested that the number of ninety-nine was large number of asmās (names).The first examples of asmā al-ḥusnā were written in Arabic literature. Some of them are not detached: Abū Manṣūr al-Māturidī (d. 333/944) Kitāb al-Tawḥīd, Abū ʿAbdullāh al-Ḥalīmī (d. 403/1012) al-Minhāj fī shuʿabiʾl īmān, Taḳī al-Dīn Ibn Taymiyya (d. 728/1328) al-Īmān. Among them, asmā al-ḥusnās has a special importance. Many asmā al-ḥusnā were written in Turkish literature. The most famous among the verses of Ibn Isa b. The verses of the Qurʾān, the rings, the hours of the days, some prayers, the names of God have some of the accents. It is believed that the desire of the person who reads them in certain conditions, in a certain amount, or in any manner, in specific hours, will occur. The fact that the concept of khawaṣṣ met these meanings allowed him to acquire scientific knowledge and to call it “khawaṣṣ science” characteristic in the literature.The works that deal with the Qurʾān and the asmā al-ḥuṣnā are written. Among the miracles of prophet Idrīs, there have been intresting miracoulus performances such as possessing the knowledge of astronomy, fortune, mathematics, plants, writing, sew-ing, using the scales and strange art. The mysterious secrets were revaled to him in 30 ṣuḥuf. His major miracles are governing spiritual beings, knowing the properties of the beings and possessing the knowledge of various unknown things. Again, he wrote a book about the char-acteristics of letters. Aristotle later wrote a commentary using the majority of the information found in this book. Some of the works are written to narrate the Prophet Idrīs’s praising God with forty names:Muḥammad al-Tunisian, al-Ravḍatu al-Sundusiyya fī asmā al-ḥusnā al-Idrīsiyya al-Suhrawardiyya; Shāb al-Dīn Yaḥya b. Ḥabash al-Suhrawardī, Çihil-nām. Among these, the most famous is the work called Asmā al-Idrīsiyyā, written by Suhrawardī. Here, in addition to the asmā al-ḥusnā (forty names), prayers, prayers, conquests, their meanings, and the merits of reading them are explained. The book is written in Arabic. Many copies of this work have been identi-fied. The work examined in this study was written as a manuscript. Çihil-nām-ı Manẓūm is distinguished from the others in this respect. Another point that makes the study important is the fact that Çihil-nām-ı Manẓūm has a very old period, this is written in the fifteenth century. (shrink)

The issue of wiping over socks is part of the more general issue of wiping over leather socks (khuffayn) for ablution (wuḍū’). Washing feet or wiping over them is a debate whose sides bases their claims on the verses of the Qur’an and supports these claims with narrations. When performing ablution, if shoes or socks are on the feet, whether one can wipe over them without taking these off and the qualities that these clothes should have is a debate based (...) on hadith narrations. Most Muslims except for the Ja’farite are of the opinion that either washing the feet or wiping over a khuff or similar clothing that was put on while a person already had ablution can be done during ablution, while the Ja’farite think that wiping over bare feet is enough but wiping over khuff is not. There is a consensus that shoes, boots, buskins and other leather footwear qualify as khuff. However, there is disagreement over whether clothing from materials like cotton, linen, wool, and felt -usually referred to as socks- qualify as khuff. For this reason, some Muslims of the world wipe over socks while others do not. There are contemporary fatwas (legal opinion) that are supportive of either of the positions. However, there are those who treat this issue beyond choosing a side in an ijtihad (process of juristic legal reasoning) and some who wipe on socks are censured strongly. In this research based on an examination of the fiqh heritage, the goal is to contribute to making this issue better understood and its fiqh ruling clearer.Summary: The sixth verse of Surah Ma’idah in the Qur’an clearly states that wuḍū’ requires washing the face, arms up until elbows, and wiping over the head. However, when it comes to the fourth element of wuḍū’, the feet, there has been disagreement about whether it should be wiped or washed. Arabic grammar rules and narrations have been interpreted in ways that support both views; in general Sunni sects, Zaydis, and Kharijites argue the feet should be washed while Shia Ja’farites are in favor of wiping over bare feet. There have also been efforts among faqihs (jurists) to reconcile washing and wiping; washing slightly; choosing the better one between the two; washing when not covered, wiping when covered; washing if there is dirt, wiping if it is clean; viewing at least wiping as fard (obligatory), washing as a Sunna (recommended) that includes the fard as a way to unify the two approaches have also been proposed.According to widely accepted narrations, the prophet and his companions washed their feet when performing wuḍū’ and once they put on their shoes having had wuḍū’, the next time they only wiped over the shoes without taking them off. In less commonly accepted narrations, which some hadith authorities regard as authentic, the Prophet is said to have wiped over his socks. In narration sources, it has been narrated that about fifteen faqih companions, among them ʿUmar b. al-Khaṭṭāb, ʿAlī b. Abī Ṭālib, ʿAbdallāh Ibn Masʿūd, ʿAbdallāh b. ʿAbbās, ʿAbdallāh b. ʿUmar, saw wiping over socks as appropriate. However, there are no narrations about the companions disapproving of wiping over socks. Among those who approved of wiping over socks are tābiʿūn (successors) faqihs like Saʿīd b. D̲j̲ubayr, Saʿīd b. al-Musayyab, Ibrāhīm al-Nakhaʿī, ʿAṭāʾ b. Abī Rabāḥ, al-Ḥasan al-Baṣrī ve al-Aʿmash, and Mujtahid Imams like Zufar, Sufyan al-Thawri, al-Ḥasan b. Ṣāliḥ, Ibn al-Mubārak, Abū Yūsuf, Muḥammad al-Shaybānī, Aḥmad b. Ḥanbal, Isḥāq b. Rāhawayh. Considering their most prominent positions, we can say that Ḥanafis and Shafis allow wiping over socks that are thick and opaque, Hanbalis allow it over socks that cover the foot even if thin, while Mālikīs do not allow wiping over socks at all.As far as it is understood from narrations from the Prophet’s time, due to both climate conditions and weaving possibilities, socks were used only rarely. Also, footwear like shoes or slippers made of leather were very hard to find and narrations suggest that prayers were performed at houses and the masjids over soil base on either bare foot or with shoes. For these reasons, the issue of wiping over socks did not arise at the time and at later periods different opinions on the issue led to disagreements. When carpets were placed on the ground at later periods, performing the prayer with shoes was abandoned and a second layer of shoes (khuff) was placed inside the shoes as khuff. Since removing the shoes would invalidate wuḍū’ performed over that shoe, those who wanted to avoid the difficulty of having to wash their feet each time they needed wuḍū’ have instead wiped over this second layer once they put them on after performing wuḍū’.Ḥanafīs and Shāfiʿīs, who tend to approach the issue of wiping over socks with hesitation and make this conditional on some strict rules, emphasize that the socks to be wiped over should be similar to shoes in terms of thickness, based on the idea that it is certain that the Prophet has wiped over shoes made of leather but his wiping over socks is weaker and that the qualities of those socks are not clear. Among the thickness criteria expressed for the socks are being waterproof, the ability to walk for at least a league with it, and its ability to hold on to feet without being tied at the wrists. Due to these criteria, which have been developed to protect the wuḍū’ and whose boundaries are not well specified, especially among Ḥanafis the idea that wiping over socks is not allowed has gained popularity. As opposed to this, in circles dominated by Ḥanbalīs opinions allowing wiping over any type of socks have been expressed.At times when the Prophet had his shoes on and did not want to take off his shoes, he used to wipe over the shoes. The equivalent of this act today is to wipe over socks since prayer with shoes on is not common any more. While nowadays wiping over socks is an ease for everybody when performing wuḍū’, it is something that is especially needed under certain circumstances. Cold weather and the lack of drying possibilities for the feet leading catching cold and illness, socks that are put on when feet are wet leading to bad smell and fungus on feet, the hardship of elevating the feet high enough to the sink and of changing socks on one foot when there are no special wuḍū’ places, the fact that at societies distant from Islamic culture it is seen against the etiquette to wash feet in the sink are among the reasons why this need arises. Because most of the time we are not in a position to determine the circumstances of our work and travels at modern times, it can be said that today this need is more than it was in the past.Some scholars of today use a precautionary principle and argue that the Qur’an commands to wash the feet, and the only narration powerful enough to make an exception to this rule is about masts made of leather, and extending this to include socks would go against the precaution principle and some other principles of uṣūl al-fiqh (Islamic legal theory). However, some other scholars who use the ease in religion principle argue that the permission to wipe over masts also include wiping over socks and that they are of the same nature, that there are authentic narrations that show wiping over socks are allowed and that one can even talk of an ijmāʿ (consensus) among the companions on this issue, and that seeking additional qualities socks on which one is to wipe over, such as thickness, ability to walk with it, its ability to hold on to the feet, being waterproof, have no merit in the sharīʿa. Jamaleddīn Qāsimī, who wrote a special research book on the topic, and scholars like Abū l-Aʿlā Mawdūdī, Yūsuf al-Qaradāwī, ʿAbd al-ʿAzīz b. Bāz, Ibn al Uthaymeen think that one can wipe over daily socks that do not show the skin beneath it, while scholars predominantly of the Ḥanafi opinion hold that one cannot wipe over the thin daily socks. Here, Wael Abu-'Uksa examines the development of the concept of freedom in nineteenth-century Arab political thought, its ideological offshoots, their modes, and their substance as they developed the dynamics of the Arabic language. Abu-'Uksa traces the transition of the idea of freedom from a term used in a predominantly non-political way, through to its popularity and near ubiquity at the dawn of (...) the twentieth century. Through this, he also analyzes the importance of associated concepts such as liberalism, socialism, progress, rationalism, secularism, and citizenship. He employs a close analysis of the development of the language, whilst at the same time examining the wider historical context within which these semantic shifts occurred: the rise of nationalism, the power of the Ottoman court, and the state of relations with Europe. Often, semantic accounts of ethical statements wherein those statements have their truth-conditions linked in some capacity to the mental state of an agent face the difficulty of explaining how it is that moral agents and communities genuinely disagree. However, there are––I shall argue––such semantic theories of ethical statements we can construct that avoid this explanatory deficit, insofar as they are both absolute and dispositional theories. In this paper, I will (i) explore and analyze one such semantic theory, Roderick Firth (1952)’s (...) ‘ideal observer theory’, and its relation to the problem of genuine moral disagreement, and (ii) argue that the theory successfully accounts for genuine moral disagreement in virtue of its being absolute and dispositional. ABSTRACT An ethical analysis of Jordan's Clinical Research Law, which became effective in 2001, was performed. Accordingly, this paper discusses the major components, key strengths and weaknesses of this law. As an initial effort, the Law addresses important aspects of research ethics and, hence, should serve as an example for other Arab Countries in the Middle East. Unique aspects of the Law include the requirement that those conducting any study have insurance that can compensate for research injuries and a system (...) of fines and punishments for noncompliance with the Law. There are, however, some key items missing in the Jordanian Law. For example, the Law does not mention the requirement of a favourable assessment of risks and benefits, the fair selection of subjects, or articles regarding the protection of the rights and welfare of children and other vulnerable subjects participating in research. The paper concludes with the suggestion that new amendments should be considered for future revisions of the Clinical Research Law in Jordan. (shrink)
