This article provides a conceptual map of the debate on ideal and non‐ideal theory. It argues that this debate encompasses a number of different questions, which have not been kept sufficiently separate in the literature. In particular, the article distinguishes between the following three interpretations of the ‘ideal vs. non‐ideal theory’ contrast: (i) full compliance vs. partial compliance theory; (ii) utopian vs. realistic theory; (iii) end‐state vs. transitional theory. This paper develops an account of intersectional feminist theory by critically examining the notion of identity implicitly assumed in major critiques of intersectionality. Critics take intersectionality to fragment women along the lines of identity categories such as race, class, and sexuality. Underlying this interpretation, I argue, is the metaphysical assumption that identity is a fixed entity. This is a misunderstanding of identity that neglects how identity is actually lived. By exploring how Asian American women experience their “Asian” identity in (...) their everyday lives (e.g., the “Asian-as-patriarchal vs. White-as-gender-progressive” stereotype, growing anti-Asian racism amid COVID-19, and Asian-Black feminist solidarities), I demonstrate that Asian identity is not fixed but changing according to how it is related to power. I identify and discuss three characteristic types of the identity-power relationship: manifestation of power-as-oppression through the construction of identity, reproduction of power-as- oppression, and creation of new forms of power, namely resistance and solidarity, through the reconstruction of identity. The lives of multiply-oppressed women (e.g., Asian women) can be understood as the locus at which the identity-power relationship is worked out, that is, the power dynamics of oppression are manifested, reproduced, and resisted through the (re)construction of identity. Building on this analysis and engaging discussions on non-ideal theory in social/political philosophy, I argue that intersectional feminist theory can be best explained as a non-ideal theory in a strong sense: a theory that, by focusing on the lives of the multiply oppressed, presents the intersecting dynamics of oppression as central and theory-guiding. This article analyses a hitherto neglected problem at the transition from ideal to non‐ideal theory: the problem of knowledge. Ideal theories often make idealising assumptions about the availability of knowledge, for example knowledge of social scientific facts. This can lead to problems when this knowledge turns out not to be available at the non‐ideal level. Knowledge can be unavailable in a number of ways: in principle, for practical reasons, or because there are normative reasons not (...) to use it. This can make it necessary to revise ideal theories, because the principle of ‘ought implies can’ rules out certain theories, at least insofar as they are understood as action‐guiding. I discuss a number of examples and argue that there are two tendencies that will increase the relevance of this problem in the future: the availability of large amounts of sensitive data whose use is problematic from a normative point of view, and the increasing complexity of an interrelated world that makes it harder to predict the effects of institutional changes. To address these issues, philosophers need to cooperate with social scientists and philosophers of the social sciences. Normative theorising can then be understood as one step in a long process that includes thinkers from different disciplines. Ideal theory can respond to many of the charges raised against it if it is understood along these lines and if it takes the problem of knowledge and its implications seriously. (shrink)

This essay responds to criticisms of and reflections on A Theory of Truces offered by Keith Breen, David Lyons, Colleen Murphy and Thaddeus Metz. I focus on the place of truces within just war theory, the permissibility of making truces with particularly unsavory actors, the tension between present and future considerations in truce making, and Truce Thinking as an instance of non-ideal theory.

When interest in political realism started to resurge a few years ago, it was not uncommon to interpret realist political theory as a form of non-ideal theorising. This reading has been subjected to extensive criticism. First, realists have argued that political realism cannot be interpreted as merely a form of applied political theory. Second, realists have explained that political realism can defend a role for unfeasible normative prescriptions in political theory. I explain that these developments, besides (...) allowing us to reject interpretations of political realism as a form of non-ideal theory, have given us reason to think of political realism as a form of ideal theory. Yet, when ideal theory enters the picture, a series of methodological questions arise regarding the proper use of ideals. In this paper, I clarify how the relationship between ideal and non-ideal theory ought to be conceptualised in realist political theory. I examine the two major interpretations of the role of ideals that have been provided so far – the target and benchmark interpretations – and I show that neither is compatible with some of the fundamental theoretical commitments of realist political theory. This both allows me to point out the requirements that an interpretation of the relationship between ideal and non-ideal theory must meet to be defined as properly realist and allows me to emphasise the strengths of the realist approach. Accordingly, I propose a new interpretation of the role of ideals, one consistent with realist theoretical commitments: I suggest that realist political ideals ought to be interpreted as models. This paper centers two complementary theoretical approaches to advance the debate about transgender women’s inclusion in elite women’s sports – namely, non-ideal theory and cultural studies. In doing so, the paper highlights divisions between ideal theory and non-ideal theory, normative internalism in sports and normative externalism in sports, and essentialist views of sports compared to non-essentialist views of sports. In the wake of the non-ideal theory turn in political philosophy, few have paused to ask: Is non-ideal theory a form of ideology? And perhaps even fewer have paused to ask: Is the debate between ideal/non-ideal theorists itself a form of ideology? To the first question, I argue that non-ideal theory is ideological in virtue of the fact that it rules out more utopian ways of theorizing by methodological fiat, and in so (...) doing, risks entrenching an unjust status quo. To the second question, I argue that the debate between ideal/non-ideal theorists is itself a form of ideology, one which serves to reinforce the status quo by convincing political philosophers/theorists that the most pressing problems are problems about what we should think about what we are doing. But this is false. An upshot of my argument is that we ought to abandon the ideal/non-ideal theory debate and address the pressing problems of political philosophy head-on in pluralist fashion, oscillating back and forth between these two modes of theorizing without a decision procedure to tell us when we should take up one perspective or the other. This paper examines what agents should do when others fail to comply with their responsibilities to prevent dangerous climate change. It distinguishes between six different possible responses to noncompliance. These include what I term (1) 'target modification' (watering down the extent to which we seek to prevent climate change), (2) ‘responsibility reallocation’ (reassigning responsibilities to other duty bearers), (3) ‘burden shifting I’ (allowing duty bearers to implement policies which impose unjust burdens on others, (4) 'burden shifting II’ (allowing some to (...) protect peoples rights in ways which impose otherwise unjustified burdens on the duty bearers, (5) 'compromising moral ideals' (permitting agents to compromise non-justice ideals that they are otherwise bound by); and (6) ‘promoting compliance (implementing policies and creating institutions which reduce noncompliance). It concludes by outlining a methodological framework for evaluating these options, and by setting out my tentative and provisional evaluation of which responses are the least bad. (shrink)

This paper has three aims. First, it argues that the present use of ‘ideal theory’ is unhelpful, and that an earlier and apparently more natural use focusing on perfection would be preferable. Second, it has tried to show that revision of the use of the term would better expose two distinctive normative issues, and illustrated that claim by showing how some contributors to debates about ideal theory have gone wrong partly through not distinguishing them. Third, in (...) exposing those two distinct normative issues, it has revealed a particular way in which ideal theory even under the more specific, revisionary definition will often be central to working out what to do in non-ideal circumstances. By clarifying the terms on which debates over ideal and non-ideal theory should take place, and highlighting the particular problems each deals with, it tries to clear the ground for turning to the actual problem, which is what to do in our non-ideal and often tragic circumstances. Some realists in political theory deny that the notion of feasibility has any place in realist theory, while others claim that feasibility constraints are essential elements of realist normative theorising. But none have so far clarified what exactly they are referring to when thinking of feasibility and political realism together. In this article, we develop a conception of the realist feasibility frontier based on an appraisal of how political realism should be distinguished from non-ideal theories. In this (...) realist framework, political standards are feasible if they meet three requirements: they are politically intelligible, contextually recognisable as authoritative, and contestable. We conclude by suggesting that our conception of realist feasibility might be compatible with utopian demands, thereby possibly finding favour with realists who otherwise refuse to resort to the notion of feasibility. The tradition of critical theory, broadly conceived, is skeptical towards the project of ideal theory on the basis of two specific arguments developed in that tradition. One argument questions whether we are epistemically capable of conceptualizing an ideal society, whereas another argument questions whether any “ideal” can be determined by reference to norms the intelligibility and justification of which remains unchanged throughout processes of social transformation. The author argues that the epistemic argument does not rule (...) out the possibility that idealizations could theoretically serve a valuable function, and that it also leaves room for standpoint-theoretic optimism regarding ideals that emerge from the collective practices of subordinated groups. By contrast, the second “immanent critique” argument more fundamentally undermines the idea that there could be a final conception of an ideal society. This argument only leaves room for idealizations as revisable, transient reference points for political practice. (shrink)

Critical attention directed to John Rawls ’s ideal theory has in particular leveled three charges against it: first, its infeasibility; second, its inadequacy for providing normative guidance on actual injustices; and third, its insensitivity to the justice concerns of marginalized groups. Recently, advocates for Rawls ’s ideal theory have replied that problems arising at the stage of ideal theory can be addressed at the later stage of his nonideal theory. This article disputes that (...) claim by arguing that although Rawls ’s nonideal theory provides a good answer to the infeasibility charge, it does not do so for the second and third charges. To argue for this thesis, I illustrate that nonideal theory in Rawls ’s Law of Peoples is unable to identify crucial injustices that emerge in the nonideal conditions of real world globalization. This paper discusses non-ideal theory as guidance for making bad situations better by morally permissible means. It distinguishes constructive theorizing, which suggests ways of improving specific kinds of bad situation, from cautionary theory, which concerns moral risks of actions under bad conditions. Reflective moral judgment yields cautionary precepts, identifying presumptively unjustifiable modes of action. The paper illustrates the application of precepts cautioning about coercion and the exposure of others to significant risks, by considering the 1955–1956 bus boycott (...) in Montgomery, Alabama, and the ‘Children’s Crusade’ of the 1963 Birmingham desegregation campaign. All such campaigns involve coercive elements, but the paper argues that coercion was not a morally significant factor in either case. Endangerment is another matter: given the violent, sometimes lethal, reactions to civil rights actions under Jim Crow, those two campaigns’ endangerment of innocent persons must be taken very seriously, especially as it concerns Birmingham. And, in fact, potentially lethal anti-reform violence occurred during each campaign. Relevant factors include the preparation and understanding of young participants and the difference in risk that is assumed by engaging in peaceful, nonviolent public actions. (shrink)

Political philosophers working on ideal and non-ideal theory sometimes seem to be stuck in a bind: while ideal theory risks being too ideal to be useful in the real world, non-ideal theory risks being so non-ideal that it stops far short of justice. In this paper, I highlight a third – and equally unappealing – possibility: that non-ideal theory, precisely because of its obvious engagement with real-world problems, might fail (...) to recognize the unacceptable ways in which it is itself problematically idealized. I highlight this problem through the case-study of adaptive preferences. Although work in adaptive preferences obviously fits into non-ideal theory, the actual work being done in the literature is idealized in that it takes only the circumstances and needs of adults into account. In the best case, this means that the needs of one of our most vulnerable populations – that is, children – are ignored. In the worst case, where the needs of children and adults conflict, the needs of children will be actively frustrated. In this way, non-ideal theory can fail to approximate justice precisely because it fails to recognize the idealizations that it itself employs. (shrink)

There’s an interesting debate in moral and political philosophy about the nature of, and relationship between, ideal and non-ideal theory. In this paper we discuss whether an analogous distinction can be drawn in philosophy of language. Our conclusion is negative: Even if you think that distinction can be put to work within moral and political philosophy, there’s no useful way to extend it to work that has been done in the philosophy of language.

The two main questions addressed in the chapter are “What is the point of (good) nonideal theory?” and “Can (good) nonideal theory be done in isolation from ideal theory?” To address them, I distinguish between different types of nonideal theory and locate nonideal theory vis‐à‐vis ideal theory as well as realism and applied philosophy. I argue that nonideal theory is useful but some of its versions need to concede that they are (...) defeatist. I also argue that nonideal theory builds on ideal theory, though not in all the ways suggested by defenders of ideal theory. (shrink)

In Against Purity, Alexis Shotwell takes up a multiplicity of tasks with respect to what I think of as non-ideal ethical theory. In what follows, I trace the relationship of her work to that of non-ideal theorists whose work influences mine. Then, more critically, I probe her analysis of gender voluntarism in Chapter 5, “Practicing Freedom: Disability and Gender Transformation,” partly to better understand what she takes it to be, and partly to advance a cautious defense of (...) some of the moral functions of individualistic performances of gender voluntarism that non-ideal theory leads me to value. I conclude that my interest in retaining a positive account of individualistic gender voluntarism as a form of resistance to a hostile world is due to my tendency to take non-ideal theory as a recommendation for some pessimism, whereas Shotwell’s similar commitments turn out to inform her more optimistic philosophy. I defend a conception of Logic as normative for the sort of activities in which inferences super-vene, namely, reasoning and arguing. Toulmin’s criticism of formal logic will be our framework to shape the idea that in order to make sense of Logic as normative, we should con-ceive it as a discipline devoted to the layout of arguments, understood as the representations of the semantic, truth relevant, properties of the inferences that we make in arguing and reason-ing.

The strongest arguments for the permissibility of geoengineering (also known as climate engineering) rely implicitly on non-ideal theory—roughly, the theory of justice as applied to situations of partial compliance with principles of ideal justice. In an ideally just world, such arguments acknowledge, humanity should not deploy geoengineering; but in our imperfect world, society may need to complement mitigation and adaptation with geoengineering to reduce injustices associated with anthropogenic climate change. We interpret research proponents’ arguments as an (...) application of a particular branch of non-ideal theory known as “clinical theory.” Clinical theory aims to identify politically feasible institutions or policies that would address existing (or impending) injustice without violating certain kinds of moral permissibility constraints. We argue for three implications of clinical theory: First, conditional on falling costs and feasibility, clinical theory provides strong support for some geoengineering techniques that aim to remove carbon dioxide from the atmosphere. Second, if some kinds of carbon dioxide removal technologies are supported by clinical theory, then clinical theory further supports using those technologies to enable “overshoot” scenarios in which developing countries exceed the cumulative emissions caps that would apply in ideal circumstances. Third, because of tensions between political feasibility and moral permissibility, clinical theory provides only weak support for geoengineering techniques that aim to manage incoming solar radiation. Elay Shech and John Earman have recently argued that the common topological interpretation of the Aharonov–Bohm (AB) effect is unsatisfactory because it fails to justify idealizations that it presupposes. In particular, they argue that an adequate account of the AB effect must address the role of boundary conditions in certain ideal cases of the effect. In this paper I defend the topological interpretation against their criticisms. I consider three types of idealization that might arise in treatments of the effect. (...) First, Shech takes the AB effect to involve an idealization in the form of a singular limit, analogous to the thermodynamic limit in statistical mechanics. But, I argue, the AB effect itself features no singular limits, so it doesn’t involve idealizations in this sense. Second, I argue that Shech and Earman’s emphasis on the role of boundary conditions in the AB effect is misplaced. The idealizations that are useful in connecting the theoretical description of the AB effect to experiment do interact with facts about boundary conditions, but none of these idealizations are presupposed by the topological interpretation of the effect. Indeed, the boundary conditions for which Shech and demands justification are incompatible with some instances of the AB effect, so the topological interpretation ought not justify them. Finally, I address the role of the non-relativistic approximation usually presumed in discussions of the AB effect. This approximation is essential if—as the topological interpretation supposes—the AB effect constrains and justifies a relativistic theory of the electromagnetic interaction. In this case the ends justify the means. So the topological view presupposes no unjustified idealizations. (shrink)

At the heart of Kant’s legal-political philosophy lies a liberal, republican ideal of justice understood in terms of private independence (non-domination) and subjection to public laws securing freedom for all citizens as equals. Given this basic commitment of Kant’s, it is puzzling to many that he does not consider democracy a minimal condition on a legitimate state. In addition, many find Kant ideas of reform or improvement of the historical states we have inherited vague and confusing. The aim of (...) this paper is to untangle both puzzles by exploring Kant’s idea of self-governance. I argue that Kant’s idea of self-governance gives us a very good starting point for thinking about how to leave room for a variety of political systems—different ideals—that have grown out of and responding to different contingent historical and cultural circumstances. It also helps us identify those areas where we want to take extra care to build in safeguards to secure stability and to take sufficiently seriously humankind’s truly nasty sides. (shrink)

In her article in this volume Linda Martín Alcoff makes the case for a form of political epistemology that denaturalizes, in the sense of historically and socially situating, procedures of knowledge production and distribution. She pursues this project via a discussion of three twentieth-century thinkers (Horkheimer, Habermas and Foucault) who, she argues, pursued this form of political epistemology, albeit in different ways, and to different ends. According to the standard story, there are two defensible theories of property rights: historical and institutional theories. The former says that you own something when you’ve received it via an unbroken chain of just transfers from its original appropriation. The latter says that you own something when you’ve been assigned it by just institutions. This standard story says that the historical theory throws up a barrier to redistributive economic policies while the institutional theory does not. In this paper, (...) I argue that the standard story is wrong in almost every detail. For a start, neither of these theories are defensible. Both generate absurd consequences when combined with our non-ideal circumstances. In actuality, no unbroken chains of just transfers stretch from original appropriation to what we now possess. And our actual institutions are very seriously unjust. So both theories imply that we actually own almost nothing. I revise these theories so that they avoid this absurd consequence. Yet, when we do this, their distributive implications flip. The institutional theory throws up serious barriers to redistribution while the historical theory tears them down. In our non-ideal circumstances, the distributive implications of these theories are the opposite of what is standardly presumed. (shrink)

Ideal theory in social and political philosophy generally works to hide philosophical theories’ complicity in sustaining the structural violence and maintenance of white supremacy that are foundational to settler colonial societies. While non-ideal theory can provide a corrective to some of ideal theory’s intended omissions, it can also work to conceal the same systems of violence that ideal theory does, especially when framed primarily as a response to ideal theory. This (...) article takes a decolonial approach to exploring the limitations of non-ideal theory in its ability to respond to and redress the continuing harms done to Indigenous peoples by settler colonialism, including by outlining non-ideal theory’s relationship to a colonial politics of recognition. This essay considers the relationship between ideal theory and non-ideal theory. It begins with Rawls’s conception of ideal theory and A. John Simmons’s articulation of non-ideal theory. Both defend the priority of ideal theory over non-ideal theory. The essay then considers three different conceptions of the social barriers standing in the way of an ideal society, taken broadly from Mill, Marx, and Foucault. Each conception of power suggests (...) a divergent strategy for pursuing non-ideal theory. The Foucauldian conception also suggests reasons to mistrust our own political and moral judgments. The essay advocates a more limited view of the relationship between ideal and non-ideal theory than is commonly described, in which ideal theory retains its logical priority but not its temporal priority. In other words, the essay argues that we will fare best when we focus first on reducing specific injustices while setting aside further speculation about the character of an ideal society. (shrink)

This paper articulates and responds to a challenge to contemporary compatibilist views of free will. Despite the popularity and appeal of compatibilist theories, many are left with lingering doubts about compatibilism. This paper explains this doubt in terms of the absurdity challenge: because a compatibilist accepts that they do not have causal access to all the actual sufficient causal sources of their own agency, the compatibilist can find their own agency absurd. By taking a cue from political philosophy, this paper (...) argues that a non-ideal construction of the problem of free will allows compatibilists to overcome this existential-metaphysical challenge, and by doing so, perhaps adopt a metaphysically progressive picture of human agency. This paper considers whether eudaimonism is necessarily an idealizing approach to ethics. I argue, contrary to what is implied by Christine Swanton, that it is not, and I suggest that a non-ideal eudaimonistic virtue ethics can be useful for feminist and critical race theorists. For eudaimonist theorists in the Aristotelian tradition, the claim that one should aim to live virtuously assumes that there will typically be good enough background conditions so that an exercise of the virtues, in conjunction with (...) these favorable external conditions, will suffice for someone to flourish both in the sense of living virtuously and in the sense of living well or living the good life. However, under some forms of oppression the background conditions will not be good enough, and thus an exercise of the virtues will often be insufficient to constitute a flourishing life. It may seem that eudaimonism, with its foregrounding of the concept of flourishing and its assumption of a tight connection between living virtuously and living well, may function as a form of ideology that elides the ways in which non-ideal and oppressive conditions can separate virtue from well-being and can make the state of flourishing (in its dual senses) unattainable. I point out that eudaimonism can be revised to incorporate the claim that virtue and flourishing may typically be unlinked, and I advocate retaining flourishing as an unattainable end, exercising the virtues even with a sense of their absurdity, and confronting the existential states of frustration and disappointment that may result. Highlighting the distinct approaches to behavior guidance employed by law and aspirational religious institutions like Buddhism, focusing on the work of Lon Fuller. There is importance to both baseline or duty-centered rules such as found primarily in criminal law and deontic morality, as well as aspirational guidance principles that are found in religious law, virtue ethics, and sometimes seen in civil law. However, the specific assumptions and aims of these two modes of guidance must be harmonized to be effective.

Recently, social and political philosophers have shown increased interest in the ideological nature of ideal theory and the importance of non-ideal theory. Charles Mills, who sparked recent critiques of ideal theory, invokes the notion of “non-idealizing abstractions” and argues that these are helpful when applying non-ideal theory. In contrast, I argue that the notion of non-idealizing abstractions is not a helpful tool for non-ideal theory. I suspect that it pays insufficient (...) attention to the actual power dynamics of oppression, which significantly influence judgments about whose experiences and interests are worth being reflected by an abstraction. Failing to take account of the power differences among the oppressed, what Mills considers non-idealizing abstractions falls into ideology, which cannot reflect the experiences or interests of less-privileged minorities, and only concerns those of more-privileged minorities. I examine cases in which the concept of “patriarchy,” which Mills alleges to be a non-idealizing abstraction, functions as what I refer to as the “Colonialist Concept of Patriarchy” that marginalizes Third World women’s experiences of intersectional oppression. I suggest that a more suitable and less ideological way to apply non-ideal theory should avoid asserting that an abstraction is “non-idealizing” and should, instead, protect “resignifiability” of the abstraction. Jacobson finds two distinct meanings of “dignity” in the literature on dignity and health: intrinsic human dignity and social dignity constituted through interactions with caregivers. Especially the latter has been central in empirical health research and warrants further exploration. This article focuses on the social dignity of people marginalized by mental illness, substance abuse and comparable conditions in extramural settings. 35 studies published between 2007 and 2017 have addressed this issue, most of them identifying norms for social dignity: civilized interactions, (...) non-stigmatizing treatment, treatment as unique individuals, being taken seriously, maintaining a positive identity, experiencing independence, relating to others, and participating in daily life. We argue that these norms belong to ideal theory, whereas we agree with Robeyns and others that improving practice is better served by non-ideal theory. Towards this end, we derive from the literature four building blocks for a non-ideal theory of dignity: avoid violations of dignity rather than seeking to promote it; dignity is not a goal to be reached; it requires ongoing effort; promoting dignity is a balancing act; contradictory norms can make it impossible to realize; and dignity can be undermined by organizational and discursive constraints. First introduced by John Rawls, ideal theory in political philosophy is concerned with putting preferences and interests to one side to achieve an impartial consensus and to arrive at a just society for all. In recent years, ideal theory has drawn increasing criticism for its idealised picture of political philosophy and its inability to account for the challenges posed by inequalities of race, religion, gender and inequality and deep questions about structural injustice. With the (...) increasing importance of non-ideal theories of justice and ethics, the question of how we should act in non-ideal situations has received more attention in the ethics literature in recent years. This article poses and addresses the question of whether we should take up the slack when others do not comply with their own moral duty. This article examines how consequentialism and contractualism might respond to non-ideal situations of taking up the slack and then defends a contractualist-constructivist approach to dealing with these situations. Recently, there has been growing interest in methodological issues of non-ideal theoretical philosophy. While some explicitly commit to non-ideal theorising, others doubt that there is anything useful about the ideal/non-ideal distinction in theoretical philosophy. The aim of this paper is twofold. On the one hand, I propose a way of doing non-ideal theoretical philosophy, once we realise how limited certain idealised projects are. Since there is a big overlap between projects that are called non-ideal (...) and applied, the second aim is to distinguish between these categories in order to show that applied theoretical philosophy is only worth pursuing if it operates in a non-ideal framework. I argue that we should be pluralistic about possible non-ideal theories and view the ideal/non-ideal differences as a matter of degree, rather than kind. As an example, I show how my version of non-ideal theory is useful to a concrete debate in philosophy of language. My proposal allows us to identify already existing non-ideal approaches to linguistic meaning and encourages us to further engage in the debate on non-ideal theoretical philosophy. (shrink)
