En dépit d’une politique étatique néo-patriarcale et d’une répression accrue contre les féministes, le mouvement féministe s’est profondément développé en Russie ces quinze dernières années et s’est fait de plus en plus entendre dans la sphère publique et les médias. Cet article avance qu’une des raisons essentielles de ces avancées marquantes, bien que sous-estimées, tient à l’importance accordée par le mouvement féministe à la construction et au maintien d’une communauté et d’une identité féministes collectives. S’appuyant sur des entretiens avec des (...) militantes féministes, j’examine la manière dont les communautés se constituent en tant qu’espaces de soutien qui apportent à leurs membres la force nécessaire pour mener des actions collectives tout en les protégeant contre l’hostilité environnante. Mettant ces observations de terrain en parallèle avec la recherche existante sur les mouvements sociaux, cet article suggère que plutôt qu’un trait définitoire de la Russie, l’hostilité envers le féminisme constitue un aspect éphémère de la situation politique ; les initiatives permanentes des féministes ont d’ailleurs déjà commencé à la faire reculer. Le progrès choisit ses projets d'avenir parmi les théories générales du futur. L'idéologie politique en est une mais pour réaliser son objectif de pouvoir, elle revendique d'être une pensée générale et totale. Elle crée une identité idéologique à laquelle le citoyen peut adhérer. Pourtant, l'idée du vivre-ensemble signifie aussi que les hommes sont différents mais semblables ; leurs identités idéologiques peuvent s'opposer. Dans ces conditions, l'idéologie voudrait bien subvertir l'idéal d'une éthique universelle pour épurer la pensée, dire la norme (...) du bien, du mal et du pur, et séparer l'ami et l'ennemi. Ce mécanisme relève de la psychologie politique. Les identités individuelle et collective sont liées par le même mécanisme du narcissisme. Le narcissisme primaire et secondaire est à l'origine de l'individualité et de l'altérité sociale. Le narcissisme tertiaire arrivé à maturité sera la source de la solidarité, de l'altruisme puis de la formation de l'éthique. Mais, par ce double biais, la pragmatique linguistique conduirait, selon lui, à une impasse, éludant finalement la question du qui? C�est oublier que, dans l�énonciation, le (...) je lui-même acquiert une certaine épaisseur sémantique. Une poésie mimétique d�action comme la poésie lyrique grecque montre le rôle que peut jouer dans la constitution du moi une identité énonciative collective, qui inscrit d�emblée la dialectique entre l�idem et l�ipse dans le rapport avec les autres, sans référence ni métaphysique ni théologique. Guy Jobin | Résumé : Cette étude est consacrée aux effets de la mutation de la question sociale sur le discours magistériel en éthique sociale et politique. Le mot « mutation » désigne le fait qu’aux enjeux socio-économiques qui formaient traditionnellement le noyau dur de la question sociale s’ajoutent d’autres enjeux de nature différente, notamment ceux liés à la reconnaissance morale et juridique des identités individuelles et collectives. Deux thèmes de l’enseignement social de l’Église seront retenus et explorés ici pour (...) tester l’hypothèse d’une répercussion de la mutation de la question sociale sur l’enseignement social de l’Église catholique. Ce sont l’enseignement sur le bien commun et l’enseignement qui condamne la discrimination. Nous concluons qu’il y a bien une ouverture du discours magistériel aux transformations des idées et des jugements dans le domaine éthico-moral. On voit pourtant que, même dans ces conditions, l’arrimage de logiques hétérogènes génère dans l’enseignement social des « tensions » épistémologiques et pratiques qu’on ne saurait minimiser. |: This article studies the effects of the mutation of the social question on the magisterial discourse in social and political ethics. The word “mutation” refers to the fact that to the socio-economical stakes which traditionally formed the hard core of the social question are added other stakes of a different nature, notably those that are tied to the moral and juridical recognition of individual and collective identities. Two themes of the social teaching of the Church are here retained and explored to test the hypothesis of a repercussion of the mutation of the social question upon the social teaching of the Catholic Church. These are the teaching concerning the common good and the teaching that condemns discrimination. We conclude that there is indeed an opening of the magisterial discourse to transformations in ideas and judgments in the ethical moral domain. Yet one can see that, even under those conditions, the coordination of heterogeneous logics generates in the social teaching epistemological and practical “tensions” which cannot be minimized. Nous montrons comment Quine hérite de Hume certains aspects de sa conception de l’objet physique. L’un et l’autre, examinant l’étendue de la garantie empirique de nos concepts, soutiennent que l’identité de l’objet n’est pas suffisamment déterminée par l’expérience. Chez Quine, cette thèse est fondée sur l’indétermination de la référence, chez Hume sur une analyse de l’identité comme fiction de l’imagination. Quine, déterminant ainsi sa situation propre dans une histoire subjective de l’empirisme, voit cette analyse comme la perception confuse du fait (...) que l’identité apparaît dans le système conceptuel seulement lors de l’acquisition de la référence divisée. Nous montrons comment les deux philosophes font alors face à une même tension, entre les exigences d’une construction empiriste des concepts à partir du matériau empirique et la dénégation d’une détermination complète. En réaction au libéralisme rawlsien pour qui le droit est référé à la liberté d’action des individus, le mouvement communautarien a voulu référer le droit à l’identité culturelle (individuelle ou collective), lui assignant, ultimement, la fonction de stabiliser cette identité. Pour ces auteurs, le lien entre identité et droit est interne, ce qui ouvre la voie à ce qu’on a appelé « les paradoxes de l’identité démocratique » et conduit à la notion problématique de droits collectifs. On montrera ici (...) comment une telle notion repose sur une « réduction identitaire », par principe opérée au point de vue objectivant de la troisième personne, privant par là même les acteurs sociaux de leur capacité d’autodétermination. À cette vision anti-libérale dans son fondement, qui fait de la sécurité identitaire son horizon, on opposera la vision d’une identité risquée qui ne préjuge pas dogmatiquement des constituants identitaires de chacun et ouvre ainsi la voie aux authentiques principes de la coexistence multiculturelle. Le grand mérite de cette traduction est de finalement mettre à la disposition des lecteurs, en français, un certain nombre d’essais éclairant le fil conducteur d’une œuvre complexe et diversifiée. Philippe de Lara souligne à juste titre qu’il faut trouver le sens de cette œuvre dans la critique de ce que Taylor désigne comme «la tradition épistémologique», et que cette entreprise procède par un mode d’enquête particulier, les arguments transcendantaux, articulation à la fois conceptuelle et historique de l’identité moderne. Cette (...) critique de la tradition épistémologique vise principalement la compréhension particulière de la faculté d’agir qu’elle véhicule ; elle s’adresse à l’imaginaire moderne que ces philosophies, issues de l’empirisme et du cartésianisme, ont contribué à forger. Trois thèmes de l’anthropologie philosophique de Taylor sont présentés comme particulièrement centraux, ici: la «philosophie de l’expression», la notion d’interprétation, et la notion d’évaluation forte. Le premier thème implique l’inséparabilité entre la signification et son support, ainsi que le caractère constitutif de l’expression; le deuxième réfère tant à la conception de l’individu comme «self-interpreting animal» qu’à l’idée d’une commensurabilité des interprétations ; le troisième désigne la considération d’un bien irréductible à une définition à partir des préférences de l’agent. L’objectivité des valeurs et l’affirmation de la commensurabilité des fins impliquent que la pratique herméneutique des sciences humaines ne nous condamne pas au relativisme, danger contre lequel Taylor nous met régulièrement en garde. Exploration of the fundamental motivations for attributing moral responsibility to various kinds of collectives serves as the basis for understanding the meaning of such attributions. Such attributions have a mid-range, limited justification. In contemporary scientific discourse, interest in memory problems has increased significantly. This trend, in our opinion, is due to a number of factors, among which one of the leading places is «democratization» of history. This process began to a large extent under the influence of a violent wave of emancipation of peoples and ethnic groups, which began at the end of the twentieth century. It actualized the need to rethink the past and revive a large part of the cultural heritage (...) of a number of ethnic and ethno-regional communities.Growth of attention to memory studios was facilitated by globalization. Itsliberal-oriented universalist intentions led to the erosion of the foundations of national identity without deprecating sociality as such. The fluidity and rapid change in social standards that have become a logical consequence of this process have shown the urgent need to find those ideological landmarks that can provide certainty at least on a daily basis. Here, a person feels the need for group consolidation, which is perceived directly through participation in social practices. Such practices reproduce the identity of the group and at the same time broadcast a historically formed and established system of group values. The revival of local forms of identity, which takes place under the influence of globalization in the conditions of the rapidity of social standards, can be regarded as a completely positive phenomenon. Meanwhile, in cases of politicization of collective memories, such local groups can significantly undermine the stable development of national states. The purpose of the study is to reveal the value of collective memories in the process of forming and preserving group identity.The task of the paper was to identify the universal foundations of human sociality and to reveal the importance of collective memories in the process of formation and preservation of group identity. Methods. The methodological basis of the study was the multidisciplinary approach, which was combined with the principles of objectivity and impartiality. The basic place in the process of scientific understanding of the role of memory in the process of formation and preservation of group identity was played by general scientific principles and methods, namely: the principles of historical and logical unity, objectivity, integrity and comprehensiveness. Also were used such general scientific methods as analysis and synthesis, induction, analogy, retrospective,comparison, etc. Along with the mentioned methods were widely used methods of cultural, social and categorical analysis, as well as the principles of philosophical hermeneutics. Results In the course of the study, M. Halbwachs’es implicit conclusion about the key role of collective memories in the process of formation of collective identity was refuted, some aspects of collective memory theory developed by him were specified. In particular, the provision on the decisive role of collective memory in the process of formation of group identity was revised and the importance of social friendship in the process of formation of the social community was shown, the persistence and moral significance of which is determined by common memories.Memories provide the appearance of images that become the status of collective identity symbols, which contain behavioral patterns and moral teachings for members of the community. Common memories can be transmitted through direct communication that covers a limited social space, or to be executed in a ritual and/or text. Due to rites or texts reinterpretations, a significant part of the memorization that is important for the collective identity can remain unchanged for a long time. (shrink)

Inclusive fitness theory was not originally designed to explain the major transitions in evolution, but there is a growing consensus that it has the resources to do so. My aim in this paper is to highlight, in a constructive spirit, the puzzles and challenges that remain. I first consider the distinctive aspects of the cooperative interactions we see within the most complex social groups in nature: multicellular organisms and eusocial insect colonies. I then focus on one aspect in particular: (...) the extreme redundancy these societies exhibit. I argue that extreme redundancy poses a distinctive explanatory puzzle for inclusive fitness theory, and I offer a potential solution which casts coercion as the key enabler. I suggest that the general moral to draw from the case is one of guarded optimism: while inclusive fitness is a powerful tool for understanding evolutionary transitions, it must be integrated within a broader framework that recognizes the distinctive problems such transitions present and the distinctive mechanisms by which these problems may be overcome. The emergence of collective intelligence has been studied in much greater detail in small groups than in larger ones. Nevertheless, in groups of several hundreds or thousands of members, it is well-known that the social environment exerts a considerable influence on individual behavior. A few recent papers have dealt with some aspects of large group situations, but have not provided an in-depth analysis of the role of interactions among the members of a group in the creation of ideas, as (...) well as the group’s overall performance. In this study, we report an experiment where a large set of individuals, i.e., 789 high-school students, cooperated online in real time to solve two different examinations on a specifically designed platform (Thinkhub). Our goal of this paper 6 to describe the specific mechanisms of idea creation we were able to observe and to measure the group’s performance as a whole. When we deal with communication networks featuring a large number of interacting entities, it seems natural to model the set as a complex system by resorting to the tools of statistical mechanics. Our experiment shows how an interaction in small groups that increase in size over several phases, leading to a final phase where the students are confronted with the most popular answers of the previous phases, is capable of producing high-quality answers to all examination questions, whereby the last phase plays a crucial role. Our experiment likewise shows that a group’s performance in such a task progresses in a linear manner in parallel with the size of the group. Finally, we show that the controlled interaction and dynamics foreseen in the system can reduce the spread of “fake news” within the group. (shrink)

Relying on dialectical methods, classical sociology and psychoanalysis are reconstituted within an Hegelian social ontology to differentiate the ephemeral from the eternal aspects of social life.

Hospital acquired infections (HAIs) are a major threat to patient safety. This paper addresses the following question: given what is known about the causes of and possible interventions on HAIs, to whom or what should the moral responsibility for preventing these infections be attributed? First, we show how generating robust evidence on the effectiveness of preventive hygiene measures is a complex endeavour and review the existing evidence on the causes of HAIs. Second, we demonstrate that the existing literature on the (...) ethical aspects of infection control has focused on responsibility at the individual-level. Thirdly, we argue that these accounts do not accommodate systemic factors relevant for HAI prevention. We show that the notion of collective responsibility is useful for making understandable how systemic factors, such as employment conditions in hospitals, are both causally and ethically relevant in infection control. This book starts from the proposition that the field of intelligence lacks any coherent or systematic ethical review, and then develops an ethical framework for intelligence based on the notion of harm and the establishment of the Just Intelligence Principles. This book argues that the most appropriate ethical framework for intelligence collection is one which is able to recognise that intelligence collection does indeed cause harm, but that sometimes this harm is necessary in order to protect the political community. It (...) tackles this tension by creating an ethical framework specifically designed for intelligence that is able to balance the need to limit the damage caused while securing the political community. This is achieved by developing an ethical framework of two parts. The first part is designed to recognise those features of intelligence that might be considered ethically unacceptable by highlighting the 'harm' it can cause. Once the harm is understood, the second part of the ethical framework establishes a set of Just Intelligence Principles that outline if and when the harm caused is justified. These Just Intelligence Principles are developed by drawing upon the just war tradition and its criteria of just cause, legitimate authority, right intention, last resort, proportionality and discrimination. By placing the harm that intelligence can cause into context of the Just Intelligence Principles it is possible to ensure that intelligence collection is only carried out when the circumstances demonstrate a suitable level of threat, authorised by a sufficient level of authority, carrying a right intention, that the damage is proportional to the expected information gains, and discriminates between legitimate and illegitimate targets. The main feature of the ethical framework created, however, is that it recognises that different intelligence collection activities can cause different levels of harm and that as a result the circumstances needed to justify them must also change. The book examines three of the main collection disciplines in the field of intelligence studies: imagery intelligence, signals intelligence and human intelligence. By applying the ethical framework established at the beginning of the book to these three important intelligence collection disciplines, it is possible to better understand the ethical framework while also demonstrating its real-life applicability. The author analyzes recent Polish debates on researching silenced aspects of national history and the problem of the "collective guilt". One of the major questions arising in these debates is: does the study of "white spots" from the past lead to a trauma of continuous collective self-blame? In Poland, a specialized institution, the Institute of National Memory, was founded in 1998, engaging in research, documentation and public education on events related to German and Soviet occupation during WWII and (...) the activity of political police under communism. Polish debates on the past got particularly inflamed after the discovery made by the historian J.T.Gross on the participation of Poles in the massacre of Jewish inhabitants of the town of Jedwabne in 1941. His book published in 2000 provoked a heated debate in which methodological, political and moral arguments were used on both sides. This case also occasioned a polemic between two prominent historians, identifying two basic visions of national history: the "monumental" one, recognizing only the heroic deeds that the nation takes pride in, and the "skeptical" one, which looks for silenced and shameful facts. Though both participants in the polemic opt for the third vision, the "objective" history which dispassionately seeks the truth, one of them stresses the role of the monumental history in maintaining the cohesion of the national community, while the other emphasizes that the collective acknowledgement of the nation's crimes can be a basis for national pride.. U ovom clanku autor analizira debate koje se u Poljskoj vode oko istrazivanja precutanih aspekata nacionalne istorije i problema "kolektivne krivice". Jedno od osnovnih pitanja koja se u tim debatama namecu glasi: da li se istrazivanje "belih mrlja" iz proslosti moze, ili cak mora, pretvoriti u traumu neprekidnog kolektivnog samooptuzivanja? U Poljskoj je 1998. osnovana specijalizovana ustanova, Institut nacionalnog pamcenja, koji se bavi istrazivanjem, dokumentacijom i javnom edukacijom o dogadjajima vezanim za nemacku i sovjetsku okupaciju tokom II svetskog rata i delovanje politicke policije za vreme komunizma. Poljske debate o proslosti posebno je rasplamsalo otkrice istoricara J.T. Grosa o ucescu Poljaka u istrebljenju jevrejskog stanovnistva gradica Jedvabne 1941. godine. U zaostrenoj polemici koju je Grosova knjiga, objavljena 2000. godine, izazvala u strucnoj i siroj javnosti korisceni su argumenti metodoloske, politicke i moralne prirode. Ovaj slucaj je takodje posluzio kao povod za polemiku dvojice istaknutih istoricara u kojoj su identifikovane dve osnovne vizije nacionalne istorije: "monumentalna", koja priznaje samo herojska dela kojima se nacija ponosi, i "skepticna", koja traga za precutanim cinjenicama zbog kojih se treba stideti. Iako se oba ucesnika u polemici zalazu za trecu, "objektivnu" istoriju koja ce bez strasti tragati za istinom, jedan od njih naglasava ulogu monumentalne istorije u ocuvanju kohezivnosti nacionalne zajednice, dok drugi istice da i kolektivno priznanje sopstvenih zlocina moze biti osnova za nacionalni ponos. Individualist normative theories appear inadequate for the complex moral challenges of climate change. In climate ethics, this is especially notable with the relative marginalization of Kant. I argue that Kant’s philosophy, understood through its historical and cosmopolitan dimensions, has untapped potential for the climate crisis. First, I situate Kant in climate ethics and evaluate his marginalization due to perceived individualism, interiority and anthropocentrism. Then, I explore aspects of Kant’s historical and cosmopolitan writings, which present a global, future-orientated picture of humanity. (...) First, the method of Grounded Normative Theorizing she adopts to engage directly with the contexts and views of those experiencing poverty fits within a range of proposals to enhance the methodology of moral and political philosophy, and I would call on all philosophers working in this space to further develop these innovative methodologies. Second, Deveaux extends the capabilities approach by focusing on the group-based character of poverty and making the (...) case for building the collective capabilities of poor-led social movements. While I do not substantially disagree with this argument (in practice), I argue that we should be careful to avoid normative collectivism (as a theoretical assumption). Finally, Deveaux discusses political solidarity with people experiencing poverty. I argue that this should be based on esteeming each other’s various contributions in more diverse ways than only in narrow economic terms. Treating people in poverty and poor-led social movements as agents of justice, as Deveaux advocates, is a significant step in this endeavour. (shrink)

This collection of twenty-one essays presents a comprehensive, well-rounded picture of Nietzsche’s influence upon philosophy generally, and upon morals, psychology, and literature in particular. Fourteen of the essays have been previously published. To students of Nietzsche the most familiar of these fourteen will be two selections from Walter Kaufmann’s Nietzsche: Philosopher, Psychologist, Antichrist—"The Death of God and the Revaluation," and "The Discovery of the Will to Power;" a discussion of perspectivism from Arthur Danto’s Nietzsche as Philosopher; Hans Vaihinger’s "Nietzsche and (...) His Doctrine of Conscious Illusion," a précis of Nietzschean epistemology; and a selection on morality and human creativity from Karl Jaspers’ Nietzsche: An Introduction to the Understanding of His Philosophical Activity. Other essays previously published include Richard Schacht’s "Nietzsche and Nihilism;" an important excerpt from the first volume of Martin Heidegger’s Nietzsche ; Henry David Aiken’s "Introduction to Zarathustra;" a short piece by Frederick A. Olafson on the relation of Nietzsche and Kant to existentialism; a selection from Max Scheler’s Ressentiment, in which Scheler develops and criticizes Nietzsche’s notion of ressentiment; and a brief exposition by Danto of the "scientific" aspect of Nietzschean eternal recurrence. Aiken’s "Introduction" here is rather unsatisfactory. A much better one would have been the "Introduction" to R. J. Hollingdale’s translation of Zarathustra. Service of the Engine is a common local Chichewa-English expression in the Malawian fishing village where the author did her fieldwork. It refers to the practice of taking various pills--known locally as Ciba--in order to prevent and cure diseases associated with sex. This study explores the sensitive interface between the use of pharmaceuticals, available through an extensive informal distribution system, and self-treatment of sex-related diseases. The author examines morally sensitive situations in which men and women opt for Ciba, and evaluates (...) its efficacy, or effectiveness. The discussion not only covers physical and metaphorical aspects of efficacy, but also the possible social and moral effects of medication. It offers a fresh and empirically grounded perspective on the links between efficacy, sex-related diseases and moralities. Bloggers confessing that they waste food, non-governmental organizations naming corporations selling unsustainably harvested seafood, and veterans apologizing to Native Americans at the Standing Rock Sioux Reservation for environmental and social devastation caused by the United States government all signal the existence of action-oriented guilt and identity-oriented shame about participation in environmental degradation. Environmental Guilt and Shamedemonstrates that these moral emotions are common among environmentally friendly segments of the United States but have received little attention from environmental ethicists though they can (...) catalyze or hinder environmental action. Concern about environmental guilt and shame among "everyday environmentalists"reveals the practical, emotional, ethical, and existential issues raised by environmental guilt and shame and ethical insights about guilt, shame, responsibility, agency, and identity. A typology of guilt and shame enables the development and evaluation of these ethical insights.Environmental Guilt and Shame makes three major claims: first, individuals and collectives, including the diffuse collectives that cause climate change, can have identity, agency, and responsibility and thus guilt and shame. Second, some agents, including collectives, should feel guilt and/or shame for environmental degradation if they hold environmental values and think that their actions shape and reveal their identity. Il s’agit dans cet article d’analyser le travail de désingularisation relative de l’événement que Ricœur opère par couplage avec le récit dans Temps et récit au début des années 1980, puis la reprise de la question de la singularité et de l’unicité de l’événement dans La mémoire, l’histoire, l’oubli dans le cadre théorique recomposé de la représentation historienne mise à l’épreuve de “l’événement aux limites” qu’est la Shoah. Dans Temps et récit Ricœur entend dépasser, par l’entrecroisement entre histoire et fiction (...) appliqué à des événements fondateurs d’identité collective comme la Shoah, l’aporie épistémologique de la dichotomie entre une histoire qui dissout l’événement dans l’explication et une attitude purement émotionnelle face aux événements à intensité éthique considérable. Cette narrativisation de l’événement se heurte cependant à la puissance traumatique de l’extra-textuel radical de l’événement-Shoah qui constitue ainsi un défi pour la représentation historienne du passé. C’est cette question que Ricœur reprend dans La mémoire, l’histoire, l’oubli, mais cette fois-ci cet examen a été largement reconfiguré par la dialectique de la mémoire et de l’histoire contribuant à la représentation du passé. Tout en distinguant l’incomparabilité absolue au plan moral de la Shoah et l’incomparabilité relative sur le plan historiographique, Ricœur maintient que l’enchevêtrement entre jugement historiographique et jugement moral est inévitable, ouvrant ainsi sur la grande question de la responsabilité sociale, politique et éthique de l’historien. The present study proposes a valorization of the work of professor and philosopher Ioan Biriş. The statistics of his books and studies, their distribution by areas of interest, and especially the ideas in his work confirm the need for philosophy in the Romanian cultural life. As a whole, his philosophical endeavor is based on the concept of totality. Thus in the Hegelian spirit, Ioan Biriş successfully convinces us that the logical may exceed the limits of formal exercise and become the (...) organon of philosophy. In this capacity, the logical may operate on the real and valorize the multiple relationships between identity and difference. His books Filosofia și logica științelor sociale, Totalitate, sistem, holon, Rolul imaginarului în cunoașterea științifică, Istorie şi cultură, as well as a series of studies among which let me mention: “L’identité symbolique et la logique partitive des valeurs spirituelles”, “On the logic of religious terms”, “Le rapport identite-difference et la conjonction collective. Aspects logiques”, clearly prove the author’s capacity to integrate existential, religious, cognitive and axiological issues into a unitary vision. As Noica would say, he succeeded to enter the spirit’s life thorough the intellect’s gate. (shrink)

English summary: Taking into account the relevant and mostly contemporary ango-american debates concering collective intentionality, the author eximanes what it means to share reasons and other intentional states such as thoughts and emotions. The guiding question of the dissertation is in what way and to what extent morality and therefore self-consciousness can be understood as conditions of possibility for the sharing of mental states, especially reasons. ‘Shared’ decision-making is heralded as the gold standard of how medical decisions should be reached, yet how does one ‘share’ a decision when any attempt to do so will undermine _autonomous_ decision-making? And what exactly is being shared? While some authors have described parallels in literature, philosophical examination of shared agency remains largely uninvestigated as an explanation in bioethics. In the following, shared decision-making will be explained as occurring when a group, generally comprised of a patient and or their family, (...) and the medical team become a genuine intentional subject which acts as a collective agent. Collective agency can better explain how some medical decisions are reached, contrary to the traditional understanding and operationalization of ‘autonomy’ in bioethics. Paradoxically, this often occurs in the setting of high-stakes moral decision-making, where conventional wisdom would suggest individuals would _most_ want to exercise autonomous action according to their personally held values and beliefs. This explication of shared decision-making suggests a social ontology ought to inform or displace significant aspects of autonomy as construed in bioethics. It will be argued that joint commitments are a fundamental part of human life, informing and explaining much human behavior, and thus suggesting that autonomy - conceived of as discrete, individuated moral reasoning of a singular moral agent - is not an unalloyed ‘good.’. Is a Health Care Ethics possible? Against sceptical and relativist doubts Kantian deontology may advance a challenging alternative affirming the possibility of such an ethics on the condition that deontology be adopted as a total programme or complete vision. Kantian deontology is enlisted to move us from an ethics of two-person informal care to one of institutions. It justifies this affirmative answer by occupying a commanding meta-ethical stand. Such a total programme comprises, on the one hand, a dual-aspect strategy (...) incorporating the macro- (institutional) and micro- (person-to-person) levels while, on the other, it integrates consistently within moral epistemology a meta-ethics with lower-ground moral theories. The article describes the issues to be dealt with and the problems which have to be solved on the way to a unifying theory of that kind (Sections I-III) and indicates elements of Kantian moral philosophy which may serve as building blocks (Section IV). Among these are not only Kant’s ideas concerning the moral acting of persons and his ideas concerning civil society and state but also his ideas concerning morality, schematism and religion. This paper discusses the vast continuum between the letter of the law (legality) and the spirit of the law (ethics or morality). Further, the authors review the fiduciary duties owed by the firm to its various publics. These aspects must be considered in developing a corporate code of ethics. The underlying qualitative characteristics of a code include clarity, comprehensiveness and enforceability. While ethics is indigenous to a society, every code of ethics will necessarily reflect the corporate culture from which that (...) code stems and be responsive to the innumerable situations for which it was created. The importance of the collective management of immaterial resources is a key variable in the valorisation of products in a post-industrial economy. The purpose of this paper is to analyse how, in post-industrial economies, it is possible to devise alternative forms of mediation between producers and consumers, such as organic farmers' markets, to curb the appropriation of rent by transnational and/or local business elites from the value created by immaterial resources. More specifically, we analyse those aspects of the (...) class='Hi'>collective management of ethical values that, in the case of organic farmers' markets, can be a strategic source of competitive advantage for local producers. Irreverence for law, Lyons says in his preface, is the dominant theme of this collection of ten essays. This irreverence is distinct from the virtually commonplace critical attitude of those who agree that law is fallible. Lyons's irreverence goes deeper. When he reflects on the sad history of legal systems, especially those in which law has been the instrument of genocide, chattel slavery, and other forms of injustice and inhumanity, he finds it difficult to be as complacent as, he argues, (...) most other legal theorists--positivists, natural lawyers, and even Ronald Dworkin--seem to be. What legal theorists tend by and large to overlook, Lyons believes, is the basic truth that "someone whose conduct is regulated by a system of law has a right to be treated by the government in a morally defensible way". It is possible, Lyons argues, that a judicial decision be justified in every other relevant way yet still be morally indefensible. This is arguably what occurred in Dred Scott vs. Sandford. What is more, Lyons continues, it seems true that any legal system as such may be properly held to this standard. This follows not from a controversial claim concerning what law ought to be, but, as Lyons sees it, from a clear understanding of what law is. (shrink)

According to Hart’s concept of law one of the distinctive characteristics of a legal order is that it is sustainable on the basis of official acceptance alone. Can we go further and say that law is morally risky in the sense that it is endemically liable to become alienated from its subjects? On the basis of Hart’s weak formulation of acceptance there is nothing to suppose that acceptance and (an absence of) alienation are connected. However, on closer inspection, this weak (...) formulation is defective, failing to account for the normative and collective aspect of the law qua social norm. Pursuing a stronger notion of acceptance as a critical reflective attitude does establish a link between acceptance and (an absence of) alienation, but it fails to establish that the legal regime is, by its nature, endemically alienating in a way that a pre-legal regime is not. It does, however, help to explain why any official-centred picture of the legal regime is problematic in terms of accounting for law’s normativity. Whether alienation materializes, it is concluded, depends on the social and political factors that condition our attitude towards the law rather than on the nature of law as such. (shrink)

Background Moral courage is the ability to defend and practice ethical and moral action when faced with a challenge, even if it means rejecting pressure to act otherwise. However, moral courage remains an unexplored concept among middle eastern nurses. Aim This study investigated the mediating role of moral courage in the relationship between burnout, professional competence, and compassion fatigue among Saudi Arabian nurses. Research design Correlational, cross-sectional design following the STROBE guidelines. Participants and research context Convenience sampling was used to (...) recruit nurses ( n = 684) for four government hospitals in Saudi Arabia. Four validated self-report questionnaires (Nurses’ Moral Courage Scale, Nurse Professional Competence Scale-Short Form, Maslach Burnout Inventory, and Nurses Compassion Fatigue Inventory) were used to collect data between May to September 2022. Spearman rho and structural equation modeling analyses were employed to analyze the data. Ethical considerations The ethics review committee of a government university in Ha’il region, Saudi Arabia, approval this study (Protocol no.: H-2021-012; Approved: 08/022,021). Participants were fully explained the study aims, and consent was voluntarily secured. Results The emerging model showed that burnout had a direct and positive influence on compassion fatigue, while professional competence had a direct, negative effect on compassion fatigue. Moral courage had a small and direct but negative influence on compassion fatigue. Mediation analyses also indicated that moral courage significantly mediated the indirect effects of burnout and professional competence on compassion fatigue. Conclusion Moral courage can be a crucial aspect in preserving the psychological and mental health of nurses, particularly under stressful conditions. Therefore, it is advantageous from an organizational and leadership standpoint to implement measures such as programs and interventions to foster moral courage among nurses. (shrink)
