Abstract“Suffering” is a central concept within bioethics and often a crucial consideration in medical decision making. As used in practice, however, the concept risks being uninformative, ambiguous, or even misleading. In this paper, we consider a series of cases in which “suffering” is invoked and analyze them in light of prominent theories of suffering. We then outline ethical hazards that arise as a result of imprecise usage of the concept and offer practical recommendations for avoiding them. Appeals to suffering are (...) often getting at something ethically important. But this is where the work of ethics begins, not where it ends. (shrink)

Behavioral research has revealed how normal human cognitive processes can tend to lead us astray. But do these affect economic researchers, ourselves? This article explores the consequences of stereotyping and confirmation bias using a sample of published articles from the economics literature on gender and risk aversion. The results demonstrate that the supposedly ‘robust’ claim that ‘women are more risk averse than men’ is far less empirically supported than has been claimed. The questions of how these cognitive biases arise and (...) why they have such power are discussed, and methodological practices that may help to attenuate these biases are outlined. (shrink)

Work done within the realm of what is sometimes called ‘descriptive ethics’ brings two questions readily to mind: How can empirical findings, in general, inform normative debates? and How can these empirical findings, in particular, inform the normative debate at hand? Brick et al 1 confront these questions in their novel investigation of public views about lives worth living and the permissibility of withdrawing life-sustaining treatment from critically ill infants. Mindful of the is-ought gap, the authors suggest modestly that their (...) data ‘may be useful when constructing guidelines for clinical practice’. In this commentary, I consider some potential limitations on the generalisability of these data in the context of policy and clinical practice, limitations which may in turn serve as directions for future empirical research. The authors’ study presented participants six case scenarios, five of which involved the possibility of withdrawing life-sustaining treatment from critically ill infants. The results revealed that “[a]lmost all respondents agreed that at some level of quality of life, life may be of no benefit or worse than death for an infant” and that “participants significantly favoured withdrawal of treatment for the most severe cases.” One salient detail in these scenarios …. The unique context of the rural setting provides special challenges to furnishing ethical healthcare to its approximately 62 million inhabitants. Although rural communities are widely diverse, most have the following common features: limited economic resources, shared values, reduced health status, limited availability of and accessibility to healthcare services, overlapping professional–patient relationships and care giver stress. These rural features shape common healthcare ethical issues, including threats to confidentiality, boundary issues, professional–patient relationship and allocation of resources. To date, there exists a limited (...) focus on rural healthcare ethics shown by the scarcity of rural healthcare ethics literature, rural ethics committees, rural focused ethics training and research on rural ethics issues. An interdisciplinary group of rural healthcare ethicists with backgrounds in medicine, nursing and philosophy was convened to explore the need for a rural healthcare ethics agenda. At the meeting, the Coalition for Rural Health Care Ethics agreed to a definition of rural healthcare ethics and a broad-ranging rural ethics agenda with the ultimate goal of enhancing the quality of patient care in rural America. The proposed agenda calls for increasing awareness and understanding of rural healthcare ethics through the development of evidence—informed, rural-attuned research, scholarship and education in collaboration with rural healthcare professionals, healthcare institutions and the diverse rural population. The hermeneutical tradition represented by Yorck, Heidegger, and Gadamer has distrusted Dilthey as suffering from the two sins of modernism: scientific “positivism” and individualistic and aesthetic “romanticism.” On the one hand, Dilthey’s epistemology is deemed scientistic in accepting the priority of the empirical, the ontic, and consequently scientific inquiry into the physical, biological, and human worlds; on the other hand, his personalist ethos and Goethean humanism, and his pluralistic life- and worldview philosophy are considered excessively aesthetic, culturally liberal, relativistic, and (...) subjective. This essay involves two tasks in response to this negative evaluation of Dilthey that has shaped our current understanding of his philosophical project; first, an interpretation of the issues at stake in Heidegger’s reception of and struggles with Dilthey. These issues touch upon language, historicity, and the nature of hermeneutics. Second, by pursuing this task in light of Guignon’s interpretation of Dilthey and Heidegger, I hope to question and challenge the “overcoming” of Dilthey’s epistemic and life-philosophical hermeneutics in the “ontological” or “philosophical” hermeneutics of Heidegger. Can work be done for pay, and still be loving? While many feminists believe that marketization inevitably leads to a degradation of social connections, we suggest that markets are themselves forms of social organization, and that even relationships of unequal power can sometimes include mutual respect. We call for increased attention to specific causes of suffering, such as greed, poverty, and subordination. We conclude with a summary of contributions to this Special Issue.

I consider the intertextuality between Chinese and Western thought by exploring how images, metaphors, and ideas from the texts associated with Zhuangzi and Laozi were appropriated in early twentieth-century German philosophy. This interest in “Lao-Zhuang Daoism” encompasses a diverse range of thinkers including Buber and Heidegger. I examine how the problematization of utility, usefulness, and “purposiveness” in Zhuangzi and Laozi becomes a key point for their German philosophical reception; how it is the poetic character of the Zhuangzi that hints at (...) an appropriate response to the crisis and loss of meaning that characterizes technological modernity and its instrumental technological rationality; that is, how the “poetic” and “spiritual” world perceived in Lao-Zhuang thought became part of Buber's and Heidegger's critical encounter and confrontation with technological modernity; and how their concern with Zhuangzi does not signify a return to a dogmatic religiosity or otherworldly mysticism; it anticipates a this-worldly spiritual or poetic way of dwelling immanently within the world. This chapter examines: (1) the Black Notebooks in the context of Heidegger's political engagement on behalf of the National Socialist regime and his ambivalence toward some but not all of its political beliefs and tactics; (2) his limited "critique" of vulgar National Socialism and its biologically based racism for the sake of his own ethnocentric vision of the historical uniqueness of the German people and Germany's central role in Europe as a contested site situated between West and East, technological modernity (...) and the Asiatic. Heidegger did not break with radical right-wing Germanist thought, as some scholars have argued. He at most placed National Socialism within his narrative of the history of being, metaphysics, and technology, and thereby relativized it without addressing either its uniqueness or its totalitarian structures and practices. Heidegger formulated his own metaphysical and ontological version of Antisemitism during the National Socialist period. This vision was deeply connected with his understanding of the "history of being" and was intensified during and immediately after the Second World War. Heidegger could perceive no difference between the Shoah and the Allied bombing, defeat, and occupation of Germany. Heidegger's post-war philosophy (of home, history and technology) is deeply shaped by, and remained complicit with, his thinking during this period. (shrink)

This paper challenges the standard view that Kant ignored the role of prudence in moral life by arguing that there are two notions of prudence at work in his moral and political thought. First, prudence is ordinarily understood as a technical imperative of skill that consists in reasoning about the means to achieve a particular conditional end. Second, prudence functions as a secondary form of practical thought that plays a significant role in the development of applied moral and political judgment. (...) The political judgment of citizens and politicians is prudence regulatively guided by right and virtue. As informed by regulative ideas, prudential judgment negotiates the demands of these ideas in relation to the cultural, political, and social realities of a particular form of life. This sense of prudence is empirically informed and involves a context-sensitive application of morality as well as conceptions of individual and general welfare. (shrink)

This paper is about the relevance of the ineffable and the singular to hermeneutics. I respond to standard criticisms of Friedrich Schleiermacher by Karl Barth and Hans-Georg Gadamer in order to clarify his understanding of language, interpretation, and religion. Schleiermacher’s “indicative hermeneutics” is developed in the context of the ethical significance of communication and the ineffable. The notion of trace is employed in order to interpret the paradox of speaking about that which cannot be spoken. The trace is not a (...) brute singularity but bears a fundamental relationship to the word—and ultimately the word of God—for Schleiermacher. (shrink)

Objective: To determine whether bioethicists are distributed along a rural-to-urban continuum in a way that reflects potential need of those resources as determined by the general population, hospital facilities and hospital beds.Methods: US members of a large, multidisciplinary professional society, the American Society of Bioethics and Humanities , the US population, hospital facilities and hospital beds were classified across a four-tier rural-to-urban continuum. The proportion of each group in rural settings was compared with that in urban settings, and odds ratios (...) were calculated with 95% confidence intervals.Results: Although 91% of ASBH members live or work in urban settings, only 66% of the US population did so. In contrast, 2% of ASBH members live or work in rural settings compared with 13% of the population. ASBH members were 10.7 times as likely to be represented in urban than in rural settings when compared with the general population, 25.6 times and 6.9 times as likely with regard to hospital facilities and hospital beds, respectively.Conclusions: Using various comparisons it was found that ASBH members are under-represented in rural as compared with urban settings. Although not all bioethicists are ASBH members, these findings suggest that the availability of professional bioethical resources may be inadequate in rural America. The disparities that were found may have considerable effect on ethics scholarship, research, ethical committees and education, and adds to the argument that rural American communities are under-served. In this paper it is argued that certain stimulus-response learning models which are adequate to represent finite automata (acceptors) are not adequate to represent noninitial state input-output automata (transducers). This circumstance suggests the question whether or not the behavior of animals if satisfactorily modelled by automata is predictive. It is argued in partial answer that there are automata which can be explained in the sense that their transition and output functions can be described (roughly, Hempel-type covering law explanation) while their (...) behaviors are in principle not predictable short of possession of their complete histories or of information concerning present internal states by indirect observation. A new way of understanding entropy as a macroscopic property is presented. This is based on the fact that heat flows from a hot body to a cold one even when the hot one is smaller and has less energy. A quantity that determines the direction of flow is shown to be the increment of heat gained divided by the absolute temperature. The same quantity is shown to determine the direction of other processes taking place in isolated systems provided that (...) q is determined by the state of the system. Entropy emerges as the potent energy of a system [Σ], the potency being determined by 1/T. This is shown to tie in with the statistical mechanical interpretation of entropy. The treatment is shorter than the traditional one based on heat engines. (shrink)

What follows is an attempt to do some conceptual housekeeping around the notion of secret law as provided by Christopher Kutz (2013). First I consider low-salience (or merely obscure) law, suggesting that it fails to capture the legal and moral facts that are at stake in the case which Kutz used to motivate it. Then I outline a theoretical contrast between mere obscurity and secrecy, in contrast to the 'neutral' account of secrecy provided by Sissela Bok (1989). The upshot of (...) the two sections is that low-salience law is neither secret law nor necessarily problematic, though it closely resembles a kind of law that is both secret and problematic: namely, those legal obscurities that subvert manifest interests related to the informational needs of citizens. The ensuing argument undermines the fiction of constructive presence found in Austin and Blackstone. (shrink)

In diesem Aufsatz, werde ich die Frage des Naturalismus in Plessners Philosophie des organischen Lebens und seiner amerikanischen Rezeption, in besonders die philosophischen-biologischen Schriften von Marjorie Grene, untersuchen. Die amerikanische Philosophin Grene war die Hauptvertreterin Plessners im Englischen Sprachraum in 20sten Jahrhundert, die Plessners anthropologischen Argumentation in ihren Schriften zur Philosophie der Biologie aufgenommen und verwendet hat. Grene kritisierte in ihren frühen Schriften Heidegger, Sartre, und die Existenzphilosophie, die das menschliche Dasein von der Natur radikal absondert und die negative Affekte (...) wie Angst hervorhebt, in Vergleich mit Plessners weiterem Blick der Leibhaften, Sinnlichen, Tierischen Entwicklung des menschlichen Lebens. Die menschliche Existenz kann nicht dualistisch, wo „keine Brücke über den Abgrund zwischen Mensch und Tier führt,“ sondern nur biologisch-lebensphilosophisch oder ökologisch verstanden werden. Plessner und Grene setzen sich mit dem Reduktionismus des modernen Naturalismus auseinander und zeigen, wie das Natürliche weiter und ergänzt gedacht werden muss, weil der Naturalismus keine ausreichenden Begriffe für die Auslegung der Erscheinungen und Ausdrucksformen des organischen Lebens besitzt. Die Unterscheidung zwischen der "zentrischen Positionalität" des Tiers und der "exzentrischen Positionalität" des menschlichen Tiers ermöglicht eine holistisch aber differenzierte Beschreibung der Natur und Kultur, insbesondere die natürlichen Künstlichkeit, die der Kultur und das des gesellschaftlichen Lebens. Diese sind Grundlage für die geschichtliche und soziale Bildung, Aufbau, und Strukturierung der natürlichen Spontaneität, Produktivität, und Expressivität des Lebens und ermöglichen die dezentrierte, utopische, und persönliche Individuation der einzelnen Menschen im Lebenszusammenhang, was wichtige soziologische und auch ethische und politische Konsequenzen für Plessner und Grene hat: Der Mensch ist ein natürliches biologisches Individuum, das durchaus fähig ist, eine verantwortliche Person zu werden , und zwar durch die umfassende Beteiligung an (oder als ein einzigartiger Ausdruck) einer Kultur. The hermeneutical dimensions of Chinese philosophy from the Changes of Zhou through its Confucian, Daoist, and contemporary developments have been a creative inspirational source and guiding intellectual thread in the thought of Chung-ying Cheng. Cheng's extensive engagement with the Classic of Changes, its role in the formation of the Chinese philosophical tradition and its comparative interconnections with occidental philosophies, has disclosed its deep hermeneutical orientation. The Yijing encompasses processes of empirical observation, empathetic feeling, and self-reflection in the generation of “images,” (...) or prototypical models that are “form-objects” or “process-events,” which performatively enact a comprehensive ontological and situationally appropriate understanding of nature, society, and one self. I examine three issues in outline arising from Cheng's works in this situation: to what extent Chinese philosophy is hermeneutical with respect to modern European understandings of hermeneutics, and the possibility of the distinctive “onto-generative hermeneutics” that has been articulated for over forty years in the context of Chinese and Western thought in Cheng's prolific works concerning the Yijing. This paper explores the possibility that Hobbesian jurisprudence is best understood as a ‘third way’ in legal theory, irreducible to classical natural law or legal positivism. I sketch two potential ‘third theories’ of law -- legal pragmatism and legal dualism -- and argue that, when considered in its broadest sense, Leviathan is best viewed as an example of legal pragmatism. I consider whether this legal pragmatist interpretation can be sustained in the examination of Leviathan’s treatment of civil law, and argue (...) that the pragmatic interpretation can only be successful if we can resolve two textual issues in that chapter. First, while Hobbes argues that law entails the existence of public (sharable) reasons, he does not adequately defend the view that the sovereign is the unique authority over such reasons in all cases, especially as far as they concern known collective emergencies. Second, Hobbes both affirms and denies that a sovereign can fail to do justice, which is paradoxical. Both problems are best resolved by legal pragmatism, though the second problem resists a fully satisfying resolution. The upshot is that, although Leviathan ought to be regarded as an episode of legal pragmatism, there are trade-offs on every reading. (shrink)
