An account of the virtues of limitation management: intellectual virtues of adapting to the fact that we cannot solve many of the problems that we can describe. I argue that the best response to many problems depends not on the most rationally promising solution, but on the most likely route to success. I argue against techniques that assume that one will fulfil ones intentions, and distinguish between failures of rationality and failures of intelligence. The history of ideas deals with the elemental unit-ideas which for Lovejoy are components of systems distinguished by their patterns. Special histories explain how a particular form of human history developed. General histories draw on special histories to document or explain social contexts. Since patterns influence philosophers, the history of ideas contributes little to the history of philosophy, a discontinuous strand within a period's continuous intellectual history. By accepting cultural pluralism, denying the monistic position that there always are internal (...) connections among all or some strands of intellectual and cultural history, both continuity and change in philosophy can be best understood. Background: Surveillance technology such as tag and tracking systems and video surveillance could increase the freedom of movement and consequently autonomy of clients in long-term residential care settings, but is also perceived as an intrusion on autonomy including privacy. Objective: To explore how clients in residential care experience surveillance technology in order to assess how surveillance technology might influence autonomy. Setting: Two long-term residential care facilities: a nursing home for people with dementia and a care facility for people with (...) class='Hi'>intellectual disabilities. Methods: Ethnographic field study. Ethical considerations: The boards representing clients and relatives/proxies of the clients were informed of the study and gave their written consent. The clients’ assent was sought through a special information leaflet. At any time clients and/or proxy were given the option to withdraw from the study. The research protocol was also reviewed by a medical ethics committee. Findings: Our findings show a pattern of two themes: (1) coping with new spaces which entailed clients: wandering around, getting lost, being triggered, and retreating to new spaces and (2) resisting the surveillance technology measure because clients feel stigmatized, missed the company, and do not like being “watched.” Conclusion: Client experiences of surveillance technology appear to entail a certain ambivalence. This is in part due to the variety in surveillance technology devices, with each device bringing its own connotations and experiences. But it also lies in the devices’ presupposition of an ideal user, which is at odds with the actual user who is inherently vulnerable. Surveillance technology can contribute to the autonomy of clients in long-term care, but only if it is set in a truly person-centered approach. (shrink)

The Russian philosopher and cultural theorist Mikhail Bakhtin has traditionally been seen as the leading figure in the group of intellectuals known as the Bakhtin Circle. The writings of other members of the Circle are considered much less important than his work, while Bakhtin's achievement has been exaggerated in proportion to the downgrading of the thinkers with whom he associated in the 1920s. This volume, which includes new translations and studies of the work of the most important members of the (...) Circle, sets out to correct the distortions in the established representations of its activity. The original contributions to literary and linguistic theory made by Valentin Voloshinov and Pavel Medvedev (but frequently credited to Bakhtin) are assessed, and the distinctiveness of their approaches is highlighted. Aim: This article explores the issues of knowledge deficits of healthcare professionals in meeting the needs of people with IDD throughout the life span, and to identify factors that contribute to these deficits. Although statistics vary due to census results and the presence of a “hidden population,” approximately 1%–3% of the global population identify as living with an intellectual or developmental disability. People with intellectual or developmental disability experience health inequities and confront multiple barriers in society, often related (...) to the stigma of intellectual or developmental disability. Disparities in care and service are attributed to a lack of knowledge and understanding among healthcare providers about people with intellectual or developmental disability, despite their increased risk for chronic health problems. The near absence of educational programs in nursing both nationally and internationally contributes to this significant knowledge deficit. In addition, ethical considerations between paternalistic beneficence and idealized autonomy have resulted in a lack of clear direction in working with a population that is often ignored or exploited. Nurses who view people with intellectual or developmental disability as vulnerable without assessing or acknowledging their capabilities may err toward paternalism in an effort to “first do no harm.” Likewise, nurses who fail to recognize the challenges and limitations faced by people with intellectual or developmental disability may not provide sufficient protections for a vulnerable person. People with intellectual or developmental disability are not binary, but rather complex individuals with a myriad of presentations. This article seeks to encourage a well-informed model of nursing care. Through an ethical lens, this article explores the nurse’s ethical commitments in cases of victimization, access to care, decision making, and the provision of optimal end-of-life care for people with intellectual or developmental disability. In his influential paper “Grasping the Third Realm,” John Bengson raises the question of how we can non-accidentally grasp abstract facts. What distinguishes successful intuition from hallucinatory intuition? Bengson answers his “non-accidental relation question” by arguing for a constitutive relationship: The intuited object is a literal constituent of the respective intuition. Now, the problem my contribution centers around is that Bengson’s answer cannot be the end of the story. This is because, as Bar Luzon and Preston Werner have recently pointed (...) out, this answer leads to the follow-up question of why certain intuitional experiences are constituted by the facts, but others are not. My objective is to answer this question by specifying precisely what is epistemically defective about intellectual hallucinations. My result is that, in stark contrast to perception, intellectual hallucinations are epistemically defective in the sense that something is overlooked. In successful intuition, by contrast, all relevant possibilities/scenarios are considered/imagined. This has crucial epistemological implications. In particular, I argue that intuitions exhibiting a certain phenomenology cannot fail to successfully grasp abstract facts. I call this the non-accidental correctness thesis, which constitutes the main thesis of this paper. (shrink)

This article examines recent controversies over the relationship between human rights and intellectual property rights (IPRs). Many activists have claimed that IPRs conflict with human rights. Others have argued that IPRs are themselves human rights. The article approaches the debate as an opportunity to clarify the nature of IPRs in relation to human rights, as well as the nature of contemporary struggles over these rights. After surveying the dual expansion of both human rights and IPRs and rejecting the view (...) that IPRs are rooted in human rights, the author investigates the example of the HIV/AIDS crisis and the global Campaign for Access to Essential Medicines in order to illustrate attempts to represent IPRs as an outright threat to human rights. Highlighting the limitations of a human rights-based critique of IPRs, he concludes by proposing to study contemporary conflicts over IPRs and human rights as struggles for recognition and as struggles over the institutionalization of a transnational “recognition order.”. The Essay concerning Human Understanding was published at the end of 1689.1 It sold well, and within three years Locke was planning revisions for a second edition. Among those whose “advice and assistance” he sought was the Irish scientist William Molyneux. Locke had begun a correspondence with Molyneux a few months before, after the latter had lavishly praised the Essay and its author in the Epistle Dedicatory of his own Dioptrica Nova, published early in 1692. Here was a man, Locke (...) concluded, whose judgment one could trust. He returned Molyneux’s compliment in the Essay’s new edition, calling him “that very Ingenious and Studious promoter of real Knowledge, ... whom I am proud to call my friend”. (shrink)

Vietnam is home to a prospering technology community and numerous enterprises that range from small start-ups to development giants. Virtually all public services are offered online. In fact, the country even has a system for e-residency and “data embassies.” This achievement derives in part from the nation’s transparent and enduring political preferences, but more importantly from Vietnamese law and its regulatory system regarding information, the digital general public, and intellectual property rights (IPR) protection. In this examination of the most (...) pertinent aspects of Vietnam’s digital economy legislation, this study explores the nation’s regulatory structure regarding copyright and patents within the context of digital transformation. The study discusses the relationship between foreign and national regulations in terms of IPR protection and the advancement of digitalization. Research on Vietnamese regulations and the practical application of major patent and copyright regulations has revealed that in many respects, the nation is highly reliant on the effective operation of a broader foreign institutional and legal framework. Thus, in the near future, technological advancement will necessitate the establishment of additional transnational regulatory systems. (shrink)

He was first and foremost a great moral philosopher, whose masterwork The Methods of Ethics is still widely studied today. He also wrote on economics, politics, education and literature. He was deeply involved in the founding of the first college for women at the University of Cambridge. He was also much concerned with the sexual politics of his close friend John Addington Symonds, a pioneer of gay studies. (...) Through his famous student, G. E. The article analyzes attempts to “normalize” disabilities, particularly intellectual disabilities, in contemporary Russia. The NGOs that emerged in the 1990s put a lot of work into reforming the long-term state residential care system and changing the principles of care for people with disabilities. They offered so-called assisted living as an alternative — specially created conditions in which people who have no experience of living outside the state institutions can become familiar with a “normal” life. However, as the author shows, (...) due to the depoliticization of their activities and ongoing financial crises, initiatives that could have influenced the integration of people who spent most of their lives in residential institutions — and could have put an end to Soviet segregationist policies have radically transformed the Western idea of “normalization” by adapting it to the local context. By drawing on Patrick McKearney’s theory of “transparency” on the one hand and Vincento Carpanzano’s “realistic” imagination on the other, the author examines the epistemology of NGO staff and investigates why, even in an intended normalizing project, intellectual disability still serves as a marker of radical alterity. Focusing primarily on practices of imagination and fantasizing about the future, the article demonstrates how the staff of one specific NGO, instead of advocating for their clients’ rights and expanding socializing opportunities, essentialized the psychiatric diagnoses and intellectual differences of its clients and fetishized the hope of financial security, locking former orphans with intellectual disabilities into the status of “disabled.”. Many thinkers agree that facilitating the development of students’ autonomy is a proper aim of education generally and higher education in particular. I defend a version of the autonomy view, but not as I think its other advocates imagine it. I suggest that an important aim of education is the facilitation of intellectual virtues. What is right about the idea that education should facilitate students’ autonomy is best captured in virtue terms as intellectual charity and humility.

This book is the authorized political biography of Kenneth Waltz. The theoretical work of Kenneth Neal Waltz (June 8, 1924 - May 12, 2013) during the last half of the twentieth century in international relations theory is known by virtually everyone in this scholarly field. He is among the few likely still to be cited in the last half of the twenty-first century. Then, as now, he no doubt has followers within the realist camp who see him as an earlier (...) luminary as well as his critics drawn to the lightning-rod quality of his work. Paul Viotti identifies the intellectual sources and experiences leading to the ideas that underlie Waltz's theoretical work. Viotti has been granted unfettered access to Waltz's files at Columbia, in his residences in Manhattan and Maine, and in archives at Oberlin, and uses these documents to paint a thorough, insightful biography bolstered by some of Waltz's previously-unexplored work. Through a series of interviews with Waltz about his life-starting with his German great-grandparents' immigration to the US in the 19th century-this biography produces personal insights into the development of his theoretical and policy-based contributions. Persons with profound intellectual and multiple disabilities cannot speak about their Quality of Life, which makes it necessary to involve others. In current approaches, these ‘others’ are seen as assessors trying to describe QoL as objectively as possible, which involves a reduction of their experiences, through which they develop knowledge on the QoL of the person with PIMD. The objective of this paper is to give caregivers’ knowledge on the QoL of a person with PIMD a theoretical basis that (...) values these experiences. We will argue that caregivers should be seen as witnesses, not assessors, and their statements on QoL as testimonies, not assessments. Audiences judge the trustworthiness of these witnesses intersubjectively, which implies a relationship characterized by trust and suspicion. Trust supports the witness to tell in her own words about the QoL of the person with PIMD; it demands receptivity, indicating that both the witness and the audience are willing to reconsider their perspective on QoL. Suspicion is necessary too, which helps the witness to critically approach her own interpretations and supports her to create more trustworthy testimonies. We conclude that the concept of witnessing helps to acknowledge caregivers’ experiential knowledge of QoL of a person with PIMD, which may also apply to other persons who cannot speak about their own QoL. We hope that our study will empower caregivers to give testimonies on QoL of a person with PIMD, which is crucial when complex decisions about the life of this person have to be made. (shrink)
