The constantly accelerating progress of contemporary natural science is indissolubly associated with the development and use of mathematics and with the processes of mathematical modeling of the phenomena of nature. The essence of this diverse and highly fertile interaction of mathematics and natural science and the dialectics of this interaction can only be disclosed through analysis of the nature of theoretical notions in general. Today, above all in the ranks of materialistically minded researchers, it is generally accepted that theory possesses (...) a value of its own. Contrary to positivist concepts of the nature of our knowledge, the meaning and significance of theory do not consist merely of the recording of experimental data, their classification and notation in abbreviated form. The meaning of theory is considerably more significant and is revealed, above all, in its explanatory and predictive functions. Contemporary theoretical knowledge is quite advanced and comprises a highly complex system, relatively self-contained and capable of internal development. Mathematics is the most interesting and distinctive phenomenon in the system of theoretical knowledge, in the system of science in general. It is in its dialectical development that the internal force and dynamics of the development of theory, in the very broadest sense of that word, find expression. Paul Lafargue tells us that Karl Marx held that "science only attains perfection when it succeeds in making use of mathematics" . In many fields of research the formulation of new ideas and concepts rests upon mathematics, its concepts and notions, and "is suggested" by the latter. "Mathematics," writes F. Dyson, "is the main source of the notions and principles out of which new theories are created" . The basic significance of mathematics to theory has been noted by outstanding thinkers over the course of the entire history of development of science. Today the expressive phrase, "the mathematization of knowledge," has come into general currency as a description of the principal direction of growth of theoretical notions in natural science. However, with respect to the growth of modern theoretical physics in general, the statement that it develops primarily by the method of the mathematical hypothesis has general validity. For example, the principal findings and discoveries of quantum theory and particle physics, starting from the corpuscularwave dualism and terminating with the omega minus hyperon and hypothetical quarks, were obtained or made "at the tip of a mathematician's pen.". Andrews, Robert M A way of dealing with historical episodes, the consequences of which continue to challenge us, is to ask a counterfactual-a 'what if?' question. Martin Luther's life, his critique of the Catholic Church, his challenge to the social and political hegemony of European Catholicism, the resultant splintering of an ecclesial unity assumed by the medieval mind to be practically impenetrable, is one such historical episode. My counterfactual is as follows: What would have been the consequences to European Catholicism (...) had Luther not rebelled against the church? As this article will later discuss, Luther famously spent many hours in the confessional during his time as an Augustinian friar. Luther's superior, spiritual guide, and confessor, Johann von Staupitz -whose motto was 'I am yours, save me'-often assured Luther that his sins were forgiven, that Christ's work had been done, and that he consequently had no need to despair of the mercy of God. It was advice that Luther ultimately found unsatisfactory. 'I did not love, no, rather I hated the just God who punishes sinners', Luther famously said in 1545, reflecting on his time as a monk, articulating a conscience that found solace only outside of Roman communion. Health reform must include health care rationing, both for reasons of fairness and efficiency. Few politicians are willing to accept this claim, including the Clinton Administration. Brown and others have argued that enormous waste and inefficiency must be wrung out of our health care system before morally problematic cost constraining options, such as rationing, can be justifiably adopted. However, I argue that most of the policies and practices that would diminish waste and inefficiency include implicit (and therefore morally problematic) (...) rationing. Critics of rationing see as its most morally and psychologically troubling feature that an identified individual is denied potentially beneficial care. That psychic anguish may not be eliminable, and perhaps ought not be eliminated. But if rationing protocols are fairly adopted through a process of free and informed rational democratic deliberation to which all have access, the moral objections are largely overcome. Such a process is possible only if implicit rationing is recognized and rejected. I defend my logic against the trenchant critique offered by Ellen Meiksins Wood and I take up the pertinent question, which she raises, of Locke's general attitude to the traditional constitution. I assume in this section, but will argue further in the next, that the mass of people were taxpayers in Locke's time. I begin, as ever, from Second Treatise ?158 and with Locke's preference for �just and lasting . . . just and undeniably equal measures�. Wood entertains the idea (...) that Locke thought that equal measures between taxpayers of different locality are of much greater importance than equal measures between taxpayers in all other respects. But this idea is surely mistaken, since Locke says nothing about rights which people have simply because of their locality and says much about the rights which all people have simply because they pay tax: it is these taxpayer rights which he depends upon even in his argument about localities. On the other hand, I think it is true that just measures for localities formed, in practical terms, the essential first step towards democratic changes: they still formed the essential first step in 1832, a fact which democrats of that time had to recognize, sometimes reluctantly. ‘Patient satisfaction’: Knowledge for ruling hospital reform — An institutional ethnography Driven by funding restraint, Canadian health‐care has undergone over a decade of significant reform. Hospitals are being restructured, as text‐based practices of accountability bring a new business‐orientation into hospital and clinical management. New forms of knowledge, generated through records of various sorts, are a necessary resource for managing care in the new environment. This paper's research uses Canadian sociologist Dorothy E. Smith's institutional ethnographic methodology to critically analyse (...) one instance of text‐based management. I analyse information about ‘patient satisfaction’ as it is generated through a patient survey (in which I was implicated through my involvement with a hospitalized family member). Subsequently, I have studied the management environment into which that information would be entered. I argue that in the instance analysed, the information becomes part of a dominant consumer oriented healthcare discourse that subordinates concerns about ‘what actually happened’ as a professional caregiver would have known it. On this basis, I contend that this sort of taken‐for‐granted approach to making decisions about quality care in hospitals may be seriously, even dangerously, flawed. (shrink)

Gender, ‘race’, poverty, health and discourses of health reform in the context of globalization: a postcolonial feminist perspective in policy researchIn this paper, I draw on extant literature and my empirical work to discuss the impact of globalization and healthcare reform on the lives of women — those from countries of the South as well as of the North. First, I review briefly the economic hardships identified in different sectors of the population that have been attributed to how (...) globalization is now working. Second, I examine what these global processes mean for health, with particular focus on poverty, gender, racialization and health. Third, I reflect on how nurse scientists might develop research agendas in the 21st century that would foster social transformation and social justice for all people. The position taken here is not an indictment of globalization. Rather, I argue that globalization is a fact in all of our lives. There are positive aspects of globalization. There are also negative aspects which we must collectively address, given that the issues identified can have deleterious consequences for the world’s poor, women in particular. I suggest that, to construct knowledge for practice and praxis, research agendas of the future should be inclusive of subaltern voices. I argue that drawing on a postcolonial feminist epistemology might help us to define such agendas, and express the multilayered sociopolitical contexts of health and illness in advocacy with policy‐makers. In his applied moral philosophy, Kant formulates the parents’ duty to make their child happy. I argue that, for Kant, this duty is an ad hoc attempt at compensating for the parental guilt of having brought a person into the condition of existence – and hence also having created her need for happiness – on their own initiative. I argue that Kant’s considerations regarding parental duties and human reproduction in general imply arguments for an ethically justified anti-natalism, but that this (...) position is abolished in his teleology for meta-ethical reasons. A hundred years have passed since publication of the first edition of Engels's book The Origin of the Family, Private Property, and the State, which Lenin regarded as "one of the basic works of modern socialism." Engels's interest in the remote past of mankind and Lenin's evaluation of his work were, of course, not coincidental. They may be explained by the tremendous role played by the concept of primitive history in a general materialist understanding of the universal historical process. What (...) was the nature of this very first term in the sequence of socioeconomic formations, this cornerstone of the Marxist concept of universal history? When did private property, antagonistic social classes, and state power, separate from the people, emerge, and what were they, original and permanent institutions, or historically determined institutions of human communal life? These problems are clearly of great philosophical importance. They were, and continue to be, the arena of a bitter ideological struggle, and inevitably attracted the most conscientious attention of the founders of scientific communism. (shrink)

Many methods are conceivable for resolution of the difficulties arising when motion is depicted in the logic of concepts. We shall set forth some of these methods, presenting them within the framework of the discussion in which V. I. Sviderskii, B. A. Dragun, and I. S. Narskii have already participated. In our opinion, attention must be directed primarily to the fact that in resolving the contradictions in the presentation of motion by means of ideal mathematical abstractions, it is impossible to (...) base ourselves directly upon that which is occurring in the sphere of the things which we perceive with our senses. It is particularly when one forgets this fact that contradictory situations usually result. However, this does not at all mean that these data are of little value in treating of motion. Furthermore, the refinement of the meaning of the concepts in terms of which motion is described, taken together with the requirement that there be a rigorous differentiation between theories based on ideal abstractions and theories based on concepts derived from the sphere of empirical existence, may lead to the resolution of Zeno's paradoxes. The purpose of this essay is to investigate and critically analyse some of the formative factors which led to the spiritual maturation of a leading Vīraśaiva saint, Basava. This inquiry focuses on a single event in the life of this great reformer of medieval times, i.e. his spiritual conflict leading to his rejection of the upanayana ceremony. The study will proceed through an investigation of the earliest and subsequent sources which veil the personality of Basava. The traditional view will be (...) challenged as one-sided. In January 1889, V.I. Vernadskii wrote to his wife from Munich about the "great truth" that "Dürer's powerful mind" had expressed in his painting The Four Apostles. "The dreamer,… the profound philosopher seeks… the truth and gives rise to a less profound pupil as an intermediary," who "cannot understand the full essence," but "is closer to life,… explains in concrete terms what the other has said,… distorts him, but that is precisely why the masses will understand him: because he will (...) grasp a small piece of the new and combine it with age-old popular beliefs." Beside them stand two figures with the severe countenances not of thinkers but of politicians. One is "ready to fight for the truth and will have no mercy on the enemy, unless the enemy comes over to his side.… He wants power too, he is capable of leading the crowd, but he understands what the cause is about, this is the fighter-thinker. And next to him is the fanatical, bestial countenance of the fourth apostle. He is a petty politician.… He pursues this idea in a harsh, mercilessly narrow spirit" and "is already a completely base mouthpiece of the crowd and its means. But he is easiest to understand, and de facto most powerful. But one can hardly recognize the thoughts of the first apostle in the outward form of the fourth, and thus, in particular, even that which has influenced humanity most strongly and powerfully may come to pass.". In a fluent, clear, and lively style this translation by two of Maslov's junior colleagues brings the work of the late Soviet scientist S. Yu. Maslov to a wider audience. Maslov was considered by his peers to be a man of genius who was making fundamental contributions in the fields of automatic theorem proving and computational logic. He published little, and those few papers were regarded as notoriously difficult. This book, however, was written for a broad audience of readers and (...) describes elegant examples of applications in such fields as computer science, artificial intelligence, operations research, economic modeling, and biological modeling, among others. The book also brings to light the work by the American mathematician E. L. Post, which inspired Maslov's own work in the development of a general theory and which has been long neglected by mathematicial logicians and systems theorists in the United States. The book's first chapter introduces the Rules of the Game. Part I, Mathematics of Calculi, covers E. L. Post's canonical systems, deductive systems and algorithms, and probabilistic calculi and deductive information. Part II, Horizonal Modeling, takes up a "toy" economy, the calculi of technological possibilities, and the development of rules. Part III, Vertical Modeling, deals with the topics of "to fight and to search" and the consequences of the asymmetry of cognitive mechanisms. The struggle for peace and social progress was and remains a strategic policy of the Soviet state. As the General Secretary of the CPSU Central Committee, M.S. Gorbachev, stated it at the Extraordinary March Plenum of the Central Committee, it is now vital to reach agreement "on an immediate end to the arms race—particularly nuclear arms—on earth and the banning of it in space.".

When talk of philosophy of pedagogy comes up today, it is common to hear the names of Aristotle, Thomas Jefferson, John Dewey, or Paulo Freire, but the name of Paul Goodman, who campaigned vigorously for pedagogical reform much of his life, is seldom mentioned. In spite of neglect of his work, Goodman had much to say on pedagogical practice that is rich, poignant, and relevant today. In consequence, it is unfortunate that he is seldom read and discussed today. This (...) essay is an attempt to fill in the gap in the scholarship. I begin by presenting an elaboration of Goodman's key insights. I then offer a critical analysis of those pedagogical insights. (shrink)

The article is devoted to the well-known Russian public figure and philosopher N. I. Turgenev. For public his name is known primarily as one of the participants in the movement of the Decembrists. However, the scope of its activity is much wider. N. I. Turgenev’s personality insufficiently assessed and covered in Russian historiography. The authors reviewed the pre-revolutionary, Soviet and contemporary works of local scholars on the N. I. Turgenev. On the basis of the analysis of the key works of (...) pre-revolutionary historiography, it is stated that the main approaches to the study of the contribution of N. I. Turgenev in Russian social thought, an assessment of his views on the peasant question were formed during this period. The authors of the article connect the reduction of interest to Turgenev personality in Soviet historiography with his liberal views and aspirations. This fact was not compatible with the official way of the Decembrists created by Soviet historians. The authors note the increased interest to the personality of N. I. Turgenev in the post-Soviet historiography. It is explained in part by increase of the interest to the general problems of society and the development of the Russian state in the nineteenth century, as well as the history of the Decembrist movement. The authors paid attention to the Lotman concept of a special type of behavior characterizing representatives of aristocratic intellectuals. The authors also consider the views of historian V. S. Parsamov on the influence of the French public opinion on the formation of the N. I. Turgenev’s liberal concept. Overall, the authors conclude that, despite the fact that the life and work of N. I. Turgenev largely studied, his findings and assessments on the state of Russian society of the nineteenth century, the factors and the degree of influence on the representatives of the liberation movement in Russia of European political theory, and experience of reforms are not reviewed and require further analysis. The comparative analysis of the approaches to philosophy and philosophizing by the two prominent Russian thinkers of the Soviet era: Evald V. Ilyenkov and Merab K. Mamardashvili. The author discusses specific methodological and conceptual features of Ilyenkov's dialectic and Mamardashvili's phenomenology, showing their theoretical and topical affinity.

The relevance of the study lies in the fact that in the reforms of the system of compulsory enforcement of decisions stipulated the possibility of performing these functions by private enforcers. The purpose of the article is to consider problematic aspects of the legal status of a private enforcer as a participant of legal relations in the enforcement process. The results of the study contain generalizations on the analysis of the legal status of a private enforcer, proposals for amendments to (...) current legislation on private enforcers and the protection of the rights of the parties of enforcement proceedings. Finally, conclusions were formulated, which may be useful to practitioners of various legal professions such private enforcers, lawyers, judges, as well as citizens and legal persons, including those who are parties to the executive procedure. I think we will agree that there are questions that it is not always preferable to put point-blank. Among them we may class that of whether ethics belongs to the category of philosophical knowledge. We know that the custom of regarding ethics as knowledge exclusively philosophical in nature persists to this day. Such a notion, with origins in the past, expresses, in our view, the dominance of spontaneous, uncontrollable factors in the real morality of society. In Hegel's expression, ethical theory (...) usually came too late: all that was left for it to do was to interpret various changes that had taken place in moral attitudes, shifts in the world of moral reflection and moral feeling. But sometimes it entered the picture entirely too early. On the one hand, this means that ethical theory has been insufficiently oriented toward practice, limiting itself to the rationalization of spontaneously established views and preferences of moral consciousness that we were incapable of abandoning. On the other hand, it testifies that the moral regulation of people's behavior was to only a very small degree subject to the need to be equipped with theory, inasmuch as practice itself was strongly constrained within the narrow limits of the processes of life . Ethical theory, for the most part, provided the morality actually being practiced with various philosophical illusions, in the form of compensatory and adaptive viewpoints, and, along with this, offered certain regulatory notions in the area of socialization to morality. In spite of his post-World War II works on international law, which seems more purely juridical, Hans Kelsen continues to put forward in his vast body of work an implicit – and sometimes even explicit – juridical objectivism and pacifism. Especially before and during the second World War he makes – by means of many moral-political writings – an effort for a more effective assurance of international peace. The fact that Kelsen regards the law as the pre-eminent means to achieve (...) the end of peace, is – in view of the tradition running from Hobbes to Kant – still not very innovating. But the primary and central role he assigns to the judiciary in order to guarantee international peace is on the other hand really original. To bring out Kelsen’s juridical objectivism and pacifism, I restrict myself in this article to his plea before and during the second World War for the judicial primacy in the international legal order. In that plea, which is spread over many writings and founded by several arguments, I distinguish however three main convincing arguments – namely an evolutionary, a technical and a moral-political argument – for the establishment of an international court with compulsory jurisdiction as the ‘guardian of international peace’. The fact that Kelsen’s original plea is still relevant to our times, is already evident from the post-World War II UN-system of peace-enforcement, which still functions little satisfactorily and of which the existing plans of reform go no further than strengthening the position of the Security Council, the current hardly effective ‘maintainer of world peace’. In this article, I describe how I made use of Foucault theoretically and methodologically in a study of five specific parrhesiastic scholars. Such scholars challenge hegemony in educational policies and practices, and advocate for educational reform and societal structures that move toward equity instead of marginalization. The article begins by exploring Foucault's notion of specific intellectuals through the experiences of the scholars. It then moves to an explanation of why the five scholars selected for this study should be considered (...) specific parrhesiastic scholars. An account of how I made use of Foucault in this study follows. My interpretation of Foucault's work into a research methodology for this project has been a process of identifying illustrations of technologies of the self and technologies of power in text, dialogue, and narrative—qualitative data, which I analyzed using a framework that merged these technologies into the analytical categories of (1) application of logos, (2) engagement with politeia, and (3) practice of techne toubiou. ElukinSince the Reformation, European Christians have sought to understand the origins of Christianity by studying the world of Second Temple Judaism. These efforts created a fund of scholarly knowledge of ancient Judaism, but they labored under deep-seated pre judices about the nature of Judaism. When Jewish scholars in nineteenth-century Europe, primarily in Germany, came to study their own history as part (...) of the Wissenschaft des Judentums movement, they too looked to the ancient Jewish past as a crucia l element in understanding Jewish history.A central figure in the Wissenschaft movement was Heinrich Graetz (1817–1891). 1 In his massive history of the Jews, the dominant synthesis of Jewish history until well into the twentieth century, Graetz constructed a narrative of Jewish history that imbedded mysticism deep within the Jewish past, finding its origins in the first-cen tury sectarian Essenes. 2 Anchoring mysticism among the Essenes was crucial for Graetz’s larger narrative of the history of Judaism, which he saw as a continuing struggle between the corrosive effects of mysticism [End Page 135] and the rational rabbinic tradition. An unchanging mysticism was a mirror image of the unchanging monotheistic essence of normative Judaism that dominated Graetz’s understanding of Jewish history. Ironically, this narrative model of the history of mystic ism may have been influenced by Christian attacks on Judaism itself, a point which I can briefly take up at the conclusion of the article. First let us turn to the role that the Essenes played in Graetz’s historical ideology of mysticism.Graetz inherited a long intellectual tradition about the identity of first-century sectarians. Ever since the fourth-century historian Eusebius asserted that the therapeutae, a group mentioned by Philo, were actually Christian monks, the religious identity of these Alexandrian sectarians—distinct from the Essenes—had been the subject of constant debate. 3 Were they Jews or Christian ascetics? During the Middle Ages the tradition articulated by Eusebius gave the Church an additional claim for the antiquity of one of its central institutions. The religious identity of the Essenes, a seemingly similar sectar ian group mentioned by Josephus and other ancient historians, also became a point of dispute. 4 The secluded, monastic life of the Essenes made them equally likely candidates to be proto-Christians. The dispute over the alleged Christian nature of the therapeutae and the Essenes would survive, after generations of Catholic and Protestant sch olarly polemic, into nineteenth-century scholarship on late antique Judaism. 5It was in the work of Graetz that the Essenes and their putative relationship to Christianity received the fullest treatment by a Jewish historian. 6 Since the only documented therapeutae were in Alexandria, they could not be considered [End Page 136] likely sources—even if they were Jewish—for a nascent Palestinian Christianity. In the Republic Plato describes the best city; in the Laws, he describes what he calls the ’second-best city’. I argue that Magnesia, the city of the Laws, is second-best because she fails to promulgate a single concept of human virtue that transcends the allegedly separate virtues of men and women. Magnesia institutionalizes philosophy in the Nocturnal Council to mitigate the consequent ethical flaws, but excludes women from the Council and thus from philosophic inquiry. I show that this exclusion of (...) women is itself a consequence of Magnesia's moral failings. In imperfect cities, of which Magnesia is supposedly the best, reform of women's status is thus only possible within limits, and those limits on the improvement of women's status are limits on the goodness of political life. The level of medical care to patients and the success of the implementation of the national project "Health" depend on the health status and doctor's professionalism. Modern healthcare reform is being implemented by optimizing costs, merging medical organizations, closing ineffective hospitals, expanding the use of high-tech care and informatization of the doctor's activities. All this makes it necessary to assess the health of doctors. Scientists have studied the quality of life and identified the professional burnout of doctors in children's (...) clinics in different age groups. Primary care pediatricians have a higher quality of life score when compared to the standard [1]. However, all groups have a high level of professional burnout. The pre-retirement group of doctors has more unfavorable profile. They are highly professional specialists but may experience emotional discomfort because the pension system has been reformed. This situation requires the introduction of preventive work with doctors of this age as a group with great potential and capable of professional longevity. (shrink)

In this paper, I ask how – and whether – the rectification of injury at which corrective justice aims is possible, and by whom it must be performed. I split the injury up into components of harm and wrong, and consider their rectification separately. First, I show that pecuniary compensation for the harm is practically plausible, because money acts as a mediator between the damaged interest and other interests. I then argue that this is also a morally plausible approach, because (...) it does not claim too much for compensation: neither can all harms be compensated, nor can it be said when compensation is paid that the status quo ante has been restored. I argue that there is no conceptual reason for any particular agent paying this compensation. I then turn to the wrong, and reject three proposed methods of rectification. The first aims to rectify the wrong by rectifying the harm; the second deploys punitive damages; the third, punishment. After undermining each proposal, I argue that the wrong can only be rectified by a full apology, which I disaggregate into the admission of causal and moral responsibility, repudiation of the act, reform, and, in some cases, disgorgement and reparations, which I define as a good faith effort to share the burden of the victim’s harm. I argue, further, that only the injurer herself can make a full apology, and it is not something that can be coerced by other members of society. As such, whether rectification of the wrong can be a matter of corrective justice is left an open question. (shrink)

Specifically, we must learn that the need for health care rationing is inescapable, that any rationing process must be public and visible, and that fair rationing protocols must be self-imposed through a process of rational democratic deliberation. Part I of this essay notes that rationing is a ubiquitous feature of our health care system at present, but it is mostly (...) hidden rationing, which is presumptively unjust. Part II argues that the need for health care rationing is inescapable. Although Oregon is flawed as a model of health rationing, it gives us worthy moral lessons for health reform at the national level, which I analyze and defend in Part III. The most significant of these lessons is the importance of rational democratic deliberation in articulating fair rationing protocols for a community. In Part IV I sketch the philosophic justification for this approach and respond to some important criticisms from Daniels. Jardine examines the evolution of concepts of dialectics during the Renaissance and problems of methodology that influenced the teachings of the founder of philosophy in the modern era, F. Bacon. The work traces the sources of these problems in the dialectics of antiquity and its medieval interpretation. Sources little known to the Soviet reader are cited. In order to evaluate Bacon's reaction to the dialectics of his day, the author also describes works named in the statutes of Cambridge University in (...) the sixteenth century as textbooks on dialectics. They are writings by humanists — bearers of the ideas of the Enlightenment — I. Caesarius, R. Agricola, D. Seton, and others. To a certain extent they were based on the work by Peter the Spaniard Summulae Logicales, which is taken as a point of departure for the further evolution of dialectics. (shrink)

As the crime rate rises and attempts to rehabilitate criminals prove unsuccessful, attacks upon recent reforms in our handling of crime increase. In this book van den Haag offers both a theory of punishment which supports traditional penal policies and factual data which show the failure of recent reforms. van den Haag claims that the main purpose of a legal system is to preserve order but that not every system that does this is acceptable. Along with preserving order, a legal (...) system should also be retributively just, i.e., punish those and only those who deserve it, because only such a system will gain public support. Although van den Haag does not present an original thesis on the moral justification of punishment, he covers many important issues in a lucid fashion, argues forcefully for his views, and presents some new arguments. In his discussion of our legal system’s exclusion of illegally obtained evidence, he argues that such evidence should be admissible in court since the misconduct of the police is irrelevant to the guilt or innocence of the accused. If the police obtain evidence illegally, then they should be punished rather than society harmed by allowing the guilty to go free. In defending the death penalty, van den Haag contends that it is the opponents of the penalty’s effectiveness as a deterrent who have the burden of proof. Since, other things being equal, increasing the severity of the penalty decreases the incidence of various crimes, it must be assumed that the incidence of any crime can be decreased by increasing the severity of the punishment. Thus, without clear evidence to the contrary, the death penalty would have to be deemed likely to have a deterrent effect. The factual data presented by van den Haag is interesting and one recent experiment he discusses has produced particularly surprising results. This experiment on student cheating showed that the threat of punishment was effective in producing the desired behavior, but that exhortations to be honest were counterproductive.—M.G. (shrink)

Although Brentano generally regarded himself as at heart a metaphysician, his work then and subsequently has always been dominated by the Psychology. He is rightly celebrated as the person who reintroduced the Aristotelian-Scholastic notion of intentio back into the study of the mind. Brentano's inspiration was Aristotle's theory of perception in De anima, though his terminology of intentional inexistence was medieval. For the history of the work and its position in his output may I refer to my Introduction to the (...) reprinted English translation. Alongside Aristotle the work shows influences of Descartes, Comte and the British empiricists. The theory of intentionality presented in the Psychology is much less modern and less plausible than almost all recent commentary would have it, and was in any case not where Brentano's main interest lay. Intentionality simply served to demarcate mental phenomena from physical, in Book One, but the main aim was a classification of the mental, outlined in Book Two. Books Three to Five were to have dealt in detail with the three main classes of presentations, judgements and feelings, with the final book considering the metaphysics: mind-body and the immortality of the soul. Brentano's shifting views, recently documented in English with Benito Muller's translation of Descriptive Psychology, a work from the transitional 1890s, made the original plan obsolete. The role of an a priori, philosophical or descriptive psychology, methodologically prior to empirical-experimental genetic psychology, foreshadowed and influenced Husserl's notion of phenomenology, and Brentano's Comtean methodological epoche of desisting from controversial metaphysical statements in favour of an examination of the phenomena likewise presaged Husserl's more ponderous phenomenological reductions. Brentano's other work covers most areas of philosophy, notably ethics, where he upheld a form of a priori intuitionism much admired by G. E. Moore, the philosophy of religion, metaphysics, philosophy of language, deductive and inductive logic, and the history of philosophy. I shall mention just two areas. In his logic lectures from 1866 onwards (a compilation published 1956) Brentano rejected the subject-predicate analysis of simple judgements and proposed instead (for which he apparently secured written assent from Mill) that all judgements are logical compounds of positive and negative existential judgements. For example the universal judgement All men are mortal becomes the negative existential There are no immortal men. On this basis Brentano radically simplified the inference rules of deductive logic. While unlike de Morgan, Frege and others he does not go beyond logic's traditional scope by recognising relations, within its bounds his reformed-term logic is simple, elegant and easily teachable. Some of his ideas in logic influenced the young Husserl. Unfortunately Brentano took against mathematical logic, which he wrongly associated exclusively with Hamilton's confused doctrine of the quantification of the predicate. His inductive logic, which takes up by far the greater part of his logic lectures, remains unresearched to this day. (shrink)

This last result leads, rather naturally, to some concluding observations and a series of questions for further investigation. These case studies show that in all of the sites examined, the institutionalization of molecular biology as a “discipline” was primarily driven by the need to separate groups of practitioners with divergent but overlapping interests within the local context. Thus molecular biology was contingently separated from agricultural or medical biochemistry, virology, work on the physiology of nucleic acids, and so forth for contingent (...) local institutional reasons. This makes it even more pressing to try to understand how molecular biology came to be delimited on a larger scale. How did it come to be a discipline with specific intellectual content (or did it?), including some problems, tools, and practices and excluding others? How did it gain authority as the forefront biological science by the mid-1960s? We need to understand the ways in which the tensions between different practices, projects, aims, understandings of the goals of molecular biology, and so on were resolved, on what scale and in what venues, so that something approximating the political character of a discipline, rather than a federation, was achieved. If these case studies provide a sound starting point, it will nevertheless prove difficult to answer the interconnected questions implicit here satisfactorily.One means of getting at such questions that should prove of considerable interest is to examine carefully the work of those who were widely cited in the papers of the late fifties through the mid-seventies by the people now considered major founders of molecular biology. By studying the contributions of those who are now omitted in the standard histories and recollections, we will gain a clearer sense of the possibilities that were open as molecular biology took shape. It is already widely recognized that the contributions of a number of biochemists have been given short shrift, but (as the example of Ernest Gale in Rheinberger's study illustrates) there are a great many more figures whose line of work were then crucial but who are now overlooked.6 To understand both what molecular biology was at the time of its early institutionalization and what is has become, it will be enormously helpful to understand at what point the definition or ideology “hardened” and the grounds for inclusion and exclusion of individuals and lines of work were reformed. Studies of this sort are appropriate in many other areas as well, of course; in general, they should different histories, political standing, and institutional bases of those disciplines in their national cultures. It is likely (but a matter for investigation!) that such differences influenced the opportunities for introducing new bench practices, if in no other way than by delimiting the niches within which certain practices could be initiated.7 And since new practices can fail to achieve their objectives, can transform the direction of work and disciplinary allegiances of their practitioners, can lead to only routine results, or can open up important new vistas, the character of the available niches from which to work can prove to have a strong influence on the direction that new work takes if and when it starts to flourish. A key aspect of this problematic (not yet adequately studied, I believe) is the problem of drawing boundaries between different kinds of work and determining where each should fit among established disciplines and/or within some new construct. To the extent that an “international” solution is ultimately achieved to such problems, it must surely be achieved in light of initially different ways of dealing with it in different countries.Underlying work of the sort we have been exploring is the thorny problem of how best to contextualize the work being studied. This, I believe, is one of the major historiographic problems that we must face in the history of science. It is by no means a new problem, of course, but a particularization of the age-old problem of the (seeming) overdetermination of historical events. If we deal with local cultures, to understand how they develop and their fate we need to understand their location within larger cultures. But it is utterly unclear how to draw appropriate boundaries on the relevant larger culture(s). As even this brief discussion has shown, institutional cultures, the cultures of sponsoring agencies, “the” culture of science (or of biological science, physical science, etc., as appropriate), and national cultures all can provide relevant contexts, all can occasionally determine the fate of work undertaken in a particular local context. The potentially intractable problem of delimiting the boundaries of investigation looms large here, but it is one that must be faced explicity if we are to profit fully from the enormously stimulating investigations of local cultures exemplified in the four papers published in this symposium. My own view is that we have no abstract standard available for determining which boundaries are appropriate to a given study, and, indeed, that no single contextualization is adequate to the examination of any given case, but that, nonetheless, we can (at least sometimes) distinguish useful and explanatory delimitations of the larger context from others that prove to be misleading.Against this background, I hope that the four papers published in this special issue will stimulate the readers of the JHB to carry out similar studies—that is, studies that seek to characterize and contextualize local experimental cultures —over a wide range of cases. I also hope that some of those who take up this challenge will deal with the larger questions raised by the need to find a way of balancing different, sometimes competing, contextualizations of such studies. The fact that any given case requires multiple contextualizations, resulting in multifaceted representations no one of which is alone adequate, will surely land us in fascinating, hopefully fruitful and productive, controversies. Are DRGs just? This is the primary question which this essay will answer. But there is a prior methodological question that also needs to be addressed: How do we go about rationally (non-arbitrarily) assessing whether DRGs are just or not? I would suggest that grand, ideal theories of justice (Rawls, Nozick) have only very limited utility for answering this question. What we really need is a theory of “interstitial justice,” that is, an approach to making justice judgments that is suitable (...) to assessing the social practices and institutions that comprise the interstices of our social life as opposed to its basic structure. Rawls's appeal to “our considered moral judgments” provides us with a useful starting point for this task, which we shall discuss in the first part of this essay. In the second part, we shall actually assess DRGs from the perspective of interstitial justice. What we shall show is that DRGs violate a large number of our considered judgments regarding a just approach to financing health care for the elderly in a cost-effective manner. This is true to such an extent that efforts to reform DRGs and make them fairer, such as the recent effort by Robert Veatch, should be abandoned. In the concluding section of the essay we discuss one especially pernicious feature of DRGs, namely, that they represent an invisible approach to rationing access to health care. In the minds of many this is one of the virtues of DRGs. That claim needs critical examination. (shrink)

It is well known that modern epistemology is a discipline that was left as a legacy by the great French philosopher René Descartes, and it is generally believed that it is a typically philosophical discipline whose problems can be dealt with only by philosophical (speculative) means of inquiry. Recently, however, the idea of naturalization of epistemological inquiry has emerged, and one of its most prominent advocates was Quine. However, the question is to what extent, if at all, the proposal offered (...) by Quine is tenable, as evidenced, apart from numerous criticisms, by significantly different interpretations regarding assumptions on which it should be based. Namely, three types of interpretations of Quine’s call for the reform of epistemological inquiry prevail in contemporary literature: behaviorist, which was largely advocated by Quine, but also coherentist and physicalist, which some of his interpreters argued for. However, while the first two of these options are in my opinion unacceptable because they are unable to provide the necessary autonomy for the epistemological context of inquiry, I will try to show that physicalism is also burdened with difficulties, albeit different ones, which make it an untenable position when it comes to epistemological inquiry. Nevertheless, even before I started writing, I thought that there were valuable insights in Quine’s proposal, and that we could learn important lessons from the failure of previous interpretations, both regarding the position that should be taken in its interpretation, and, closely related to this, the possibility of reforming epistemological inquiry in general. In other words, informed by the weaknesses of Quine’s proposal and its interpretations, I will argue that epistemological inquiry can ultimately be approached from one of two mutually incompatible theoretical positions: the traditional or Cartesian one, and the Kantian one. Given that, as noted above, Quine’s proposal was primarily a reaction to Cartesianism, I discuss the possibility of establishing the fundamental level of inquiry such as epistemological to which Quine had to aspire, but in a way that would enable the synthesis of his approach with Kant’s view, which is in my opinion the only genuine alternative to the traditional program. Although it implies taking a position that would be a kind of compromise and could not be attributed to Quine (which is why it is uncertain whether he would have supported this interpretation), I believe that, apart from preserving certain naturalistic elements, it is an interpretation that would ultimately satisfy most of the demands that Quine himself has set for epistemological inquiry. Canada has an enviable record of relatively progressive and egalitarian legislation and policy in relation to Canadian family forms. The country’s constitutional guarantees of equality and multiculturalism provide the legal foundation for this record. In particular, Canada’s leadership in the recognition of and support for same-sex relationships in family law and social policy is widely acknowledged. This is, however, also deeply contested terrain: Feminist legal scholars informed by critical political economy argue that recent family law advances in Canada sit compatibly (...) with neo-liberal social policy and restructuring of the welfare state; the neo-conservative and religious right assert that the fundamental nature of family has been undermined by the recognition of same-sex marriage, facilitating the legal recognition of polygamous relationships, among others. Still others take the view that despite a liberal, progressive and formally egalitarian approach to family, the legal recognition of same-sex marriage in Canada reflects and reinforces a historically patriarchal, heterosexual institution that should be jettisoned rather than embraced. These arguments raise issues and illustrate more generally the tensions in state and legal construction and regulation of familial relations — historically and in the current context. In this Article, I re-theorize the significance of patriarchy and the relationship between patriarchal relations and the discourse of privatization in critical family law. Using the experience of women from the “outskirts” — lesbian spouses, welfare mothers, and women in polygamous relationships — I demonstrate the limits of any theory of “privatization” that does not theorize patriarchal relations. In particular, I identify and analyze the impediments to equality posed by increasingly invisible, but no less enduring, patriarchal familial ideologies in order to envision forms of family law reform and state social policy that might actually improve gendered and generational familial relations and transform the social landscape more generally. Doctrinally, Buddhism is free of the myths and symbols that make some other religions so intractable to feminist reforms. In its philosophical views and its meditation practices, Buddhism has tremendous potential for deconstructing gender. In less than thirty years, we have gone from a situation in which almost nothing had been written about Buddhist women to a situation in which books and articles appear regularly. There is now a worldwide Buddhist women's movement, many women Buddhist teachers—at least in North America—and (...) a growing consensus that the traditional male dominance of Buddhism is a problem. Yet, despite the advances made in the last thirty years, Buddhism still privileges men above women. So is the glass half full? Are we well on the way to recasting Buddhism in ways that make it more adequate for its female followers? Or is the glass half empty? Is Buddhism still a religion that works better for men than for women, despite the changes of the past thirty years? In looking at the half-full, half-empty glass, I will consider three topics: first, Buddhism's potential for deconstructing gender, second, some reasons why this potential did not come to fruition historically, and third, some of the changing situations in the contemporary Buddhist world, both Asian and Western. I have suffered a lot because of the work I have done on sexism, including a very diminished career. After nearly fifty years of demonstrating the presence of sexism in religious studies and in (...) Buddhism, and taking a lot of flak and criticism for bringing to light many things that many people simply don’t want to know, I would be delighted if such discussions were no longer needed. That, however, is not the case. So bringing together these two s-words—suffering and sexism—is very potent. The only effect of sexism is suffering. Forming identities and organizing society on the basis of male dominance have no redeeming benefits that offset the suffering.However, it is critical that we understand what is the real issue as we begin these reflections on suffering and sexism. I have long contended that, rather than trying to reform gender roles or discern what an ideal set of gender roles might be, the fundamental problem is the very existence of gender roles—any set of gender roles whatsoever. Does the shape of our genitals really predetermine our hearts, minds, longings, and abilities? Does it have anything to do with one’s ability to think theologically or to excel at spiritual disciplines? Gender roles severely and arbitrarily constrain people. That is the real suffering of sexism, and that, rather than male dominance, is the true problem. Male dominance is only one of the more unfortunate results of the constraint of arbitrary and binding gender roles. LevineWhen Edward Gibbon decided to banish primary causes from the Decline and Fall and integrate secular and ecclesiastical history, he was completing a revolution that had begun unwittingly two centuries before. 1 To bring into his narrative of empire a consideration of the “Johannine comma” (the interpolation in 1 John 5:7–8) was not perhaps either digressive or inevitable; but it (...) would certainly have surprised and dismayed some of Gibbon’s immediate predecessors, such as the Catholic Frenchmen, Bossuet and Tillemont, each of whom had written about his subject and exercised an important effect on him at different times in his life; and it would have seemed even more incomprehensible to earlier generations. 2 Something had happened in the two centuries between Erasmus and Gibbon to make this new vantage point possible and congenial.It was, I think, nothing less than a victory for the idea of history. At the beginning of the sixteenth century theology still ruled as queen of the sciences and the claims of religion were largely justified by an appeal to reason and authority, that is, to Aristotelian logic and the dictates of the Church. It was Erasmus, however, as Gibbon himself suspected, who had first set some of the key problems, which he and his enlightened friends believed they had solved.For Erasmus the decision to edit the Greek New Testament was the result of an early commitment to Renaissance humanism and a response in particular to several lively currents in the contemporary intellectual scene. On the one hand Erasmus, encouraged perhaps by his new friend John Colet, began to think of the Bible principally as a record of history rather than as an arsenal of theological texts, above all as the story of Christ on earth—Christ as the supreme exemplar to be followed and imitated. Apparently, he had been well prepared for this by his acquaintance with the Brothers of the Common Life, and by a characteristic humanist distaste for logic and metaphysics—and a preference for rhetoric and history—which he displayed in all his early writing. 4 It seems to have been Colet’s Lectures on the New Testament that encouraged his view that Paul and the apostles, if not Christ himself, were best understood in their historical setting and that their message was primarily ethical. 5 In effect the churchman, Colet, and the wandering monk, Erasmus, wanted to place Christian responsibility back in the hands of the laity, in the conscience and behavior of the Christian believer, rather than in what they took to be the mechanical observances of Church ritual. This required that the Bible be placed at the very center of worship, in the hands of every man (and woman), accessible and intelligible as the Vulgate was not, and read in the first place for its story. In this chapter I explore the possibility and prospects of what I’m calling reformed demonology, an extension of a reformed epistemology that includes belief in the Devil. I begin by characterizing reformed epistemology as denying the necessity of propositional evidence—via argument—for the positive epistemic status of a religious belief. I then turn to the influential reformed approaches of Alvin Plantinga and William Alston, seeing whether or not one can developed their Reformed approaches to beliefs about God to beliefs about the (...) Devil. For Plantinga, this question amounts to whether or not God could/would have created us with a faculty designed to produce beliefs about the Devil immediately. For Alston, this question becomes one as to whether one lives in a community such that direct (quasi)perceptual experience of the Devil is made possible. In each case, I suggest that we find neither a ‘yes’ nor ‘no’ answer: Plantinga’s epistemology hinges on what sort of aims God would have in creating us and Alston’s on what sort of epistemic communities there are as well as in which one finds oneself. (Rome: Editori Riuniti, 1966.Pp. 154.Paper, L. 1,500.) This volume consists of a re-examination of the views of Benedetto Croce and Giovanni Gentile, in the light of their respective positions in the history of philosophy. Valentini proposes that some important notions in the philosophies of Croce and Gentile ]ustify a Kantian interpretation and (...) thus constitute a counter-reformation with respect to some important assumptions in Hegel's doctrine. This proposal is especially interesting with regard to Croce, since it contradicts Croce's evaluation of his own position as representing a furtherance of the viable portions of Hegel's system, just as Hegel's system is supposed to represent a furtherance of Kant's view. Moreover, since Croce's evaluation follows from his general philosophic assumptions, Valentini's proposal attacks not only Croce's evaluation of his own position, but also his views on the nature of history and philosophy. According to Valentini, the views of Croce and Gentile agree in the abandonment of the "dogmatism" of Hegel and in a return to a transcendental philosophy which examines the conditions which make experience possible, rather than experience itself, in its concrete, historical development. (Gentile's view is supposed to be fundamentally the same as Croce's, save that Gentile's conclusions are more radical and thus, according to Valentini, more deo structive.) However, according to Valentini, this return to an examination of the nature of consciousness represents a retrogression, not only historically, but also philosophically with respect to the empirical and historical portions of Hegel's philosophy. In Chapter I of Part I, Valentini begins his discussion of Croce's notion of spirit, by stating that Croce generally professed an antitheological and antimetaphysical attitude, but that his intended resolution of the religious and theological into the mundane is not always complete. Accordingly, Valentini believes that he has discovered two prejudices which derive from this incomplete resolution: the first is supposed to be a monistic prejudice, which means the attempt to reduce all aspects of reality to the same characteristic or structure; and the second--a bias towards "inwardness", which shows preference for everything which can be reduced to the autonomous operation of consciousness. Chapter II examines Croce's view of the nature of consciousness, as well as the subjective aspects of his views of historical judgment. The relations between the forms of experience, aesthetic, conceptual and practical are discussed and criticized according to the views of modem psychology. Croce's subjectivism is supposed to lie in his notion that all history is contemporary and is formed by a kind of cognitive construction of the past. Here Valentini maintains that Italian idealism has made a "subjective correction" of Hegel's philosophy of history. Chapter IH treats of the development of Croce's views on historicism and describes his attitude as being characteristic of anti-enlightenment doctrines of the nineteenth century. Chapter IV traces what Valentini believes to be a certain ambivalence in Croce's aesthetics, that is, a vacillation between two themes which are supposed to be present throughout Croce's philosophy--the idealist theme which emphasizes the nature of consciousness and the theme of historicism. The idealist aspect can be perceived in Croce's theory of intuition and above all, in certain romantic developments of his doctrine, such as, the vindication of the character of "cosmic totality" and in the notion of the "eternality" of artistic expression. The theme of historicism can be found in some corrections which Croce made in his theory of intuition, as well as in some judgments and literary preferences, which are not completely reconcilable with his theoretical formulations. The fifth and last chapter of Part I treats of Croce's ethical doctrine and generally distinguishes between the views of Croce and Hegel on this topic. The second part of Valentini's work discusses Gentile as a philosopher of consciousness and is divided into four chapters. To write a history “from antiquity to the present” of classical art or literature (or, worst of all, classicism) is the ultimate nightmare aspiration for a scholar whose colleagues are attentive methodologists. The product, when there is one (which I add because the aspiration can yield paralysis), is always in part an apologetic treatise on historical method. Professor Vout—of Christ's College, Cambridge—apologizes with the first word of her subtitle, A, which stresses that many differing histories may be as valid as (...) her own. The next two words, Life History, imply that her study is unauthorized, conjectural, a bit personal or informal, and reliant to an extent on unconfirmable stories. Her book, she tells readers, is of necessity an arrangement of “fragments” and “a mapping not of facts, but of ways in which Greek and Roman artifacts experience history.” She sets down, moreover, as a rule that “classical” is not “a self-standing category: it is always relational” (which historians of the novel have been telling us for many decades about “realism”).We might expect the result of Vout's axioms to be evenhanded diffidence when treating definitions of the classical, and indeed she entertains even the idea of Jeff Koons—maker of Balloon Venus (Orange) and Gazing Ball (Barberini Faun)—as a classical sculptor. There is, however, one approach that she dismisses out of hand: the obsession of classical humanism with authenticity and its renascence. She objects especially to research into the original conditions of objects and to the application of increasingly intrusive methods of restoring them. As she writes, “ ‘Real knowledge’ comes not from antiquities that have been ripped from their original context, cleaned and reconstituted for display in galleries and glass cabinets. ‘Real knowledge’ comes from antiquities that carry their dirt with them.”What Vout, as a critic of humanism, means by dirt is patina—the residue, interesting and sometimes beautiful in itself, of the use and misuse of objects. Dirt is a word that would occur to a humanist art historian when examining the patina of a Greek or Roman object. Vout's use of the word is a parodic expression of reverse snobbery. When studying changes, whether mistakes or enhancements, in a Greek or Roman document, a humanist literary historian would speak of corruption and edit the corrupt text by means of processes that humanist editors invented and perfected. Despite the humanists’ devotion to the recovery of classical learning, however, once a Renaissance edition of a manuscript was in print, the original, however rare, was often destroyed or lost. In effect, the work was reborn, better than new. Rebirth is not the same as preservation: though both are perhaps conservative (or better, in Ulysses's words, “rere regardant”), a renascence or a resurrection is cataclysmic.The humanist approach to the past can appear unlovable and is certainly arrogant, but it can also inspire awe and gratitude. The work of Michelangelo depended on it, and so (more to the point) did Martin Luther's. Vout's attitude toward dirt (patina, corruption, misprision, insertions, recontextualizations, bowdlerizations, misappropriations, translocations) resembles that of Catholic theologians to the depositum fidei. Restoring the original conditions of the Christian church involved methods of research learned from Renaissance humanists and the removal, often destructive, of the “deposit” or residue or patina that adhered to, distorted, discolored, and obscured the conditions of the “primitive church.” A Roman Catholic may well dislike the processes that Luther set in motion, but imagine a scholarly history of Christianity that mentioned Protestantism only to regret its existence.Still, Vout's reasoning, it seems to me, is more sophisticated in its defense of dirt and in its criticism of restoration than any offered against the Protestants’ reasoning during the Counter-Reformation. Consider, for instance, this inspiring passage: “When the curators at the Munich Glyptothek removed Thorwaldsen's restorations from the Aegina pediments, they did not so much take them back to a pristine state as out of the feedback loop, rendering them damaged goods. It was not a restriction of avenues or a change of direction that was being enacted here, but a refusal to speak the language, or rather an insistence that the only language worth speaking was an academic [humanist, restorationist] one.... In 2011, the Glyptothek marked the two hundredth year of the pediments’ discovery by putting new versions of Thorvaldsen's restored figures on display. They had relearned the lingo. For art to be ‘classical,’ it has to know its place in the discourse.” May lingo and feedback loop have successful careers in the lexicon of classical scholarship. “Far from producing a nostalgic narrative,” as Vout informs us, “the lessons learned from looking back ensure that we keep traveling.”.
