Identifying, classifying, and analyzing arguments in legal discourse has been a prominent area of research since the inception of the argument mining field. However, there has been a major discrepancy between the way natural language processing (NLP) researchers model and annotate arguments in court decisions and the way legal experts understand and analyze legal argumentation. While computational approaches typically simplify arguments into generic premises and claims, arguments in legal research usually exhibit a rich typology that is important for gaining insights (...) into the particular case and applications of law in general. We address this problem and make several substantial contributions to move the field forward. First, we design a new annotation scheme for legal arguments in proceedings of the European Court of Human Rights (ECHR) that is deeply rooted in the theory and practice of legal argumentation research. Second, we compile and annotate a large corpus of 373 court decisions (2.3M tokens and 15k annotated argument spans). Finally, we train an argument mining model that outperforms state-of-the-art models in the legal NLP domain and provide a thorough expert-based evaluation. Multiple selves is a conventional assumption in behavioural welfare economics for modelling intrapersonal well-being. Yet an important question is which self has normative authority over others. In this paper, we advance an argument for what we call the ‘ontological approach’ to personal identity in behavioural welfare economics. We find here a translation for the first time of the sanskrit philosophical work entitled Pancaprakriya which belongs to the relatively early Advaita Vedanta thinker Sarvajnatman and a thematic analysis of the contents of that work. The Pancaprakriya is a menual of Advaita Vedanta philosophy of language which for Sarcajnatman is reduced to the discernment of the proper meaning of certain great Upanisadic statements or mahavakyss such as Iam Brahman and That thou art. Through the approprition of such a proper (...) understanding which resorts to the secondary of implied usafe of language the qualifies striver after enlghtenment obtains release from bondage int he world. The philosopher Jorge J. E. Gracia engages fifteen prominent scholars on race, ethnicity, nationality, and Hispanic/Latino identity in the United States. Their discussion joins two distinct traditions: the philosophy of race begun by African Americans in the nineteenth century, and the search for an understanding of identity initiated by Latin American philosophers in the sixteenth century. Participants include Linda M. Alcoff, K. Anthony Appiah, Richard J. Bernstein, Lawrence Blum, Robert Gooding-Williams, Eduardo Mendieta, and Lucius T. Outlaw Jr., and their dialogue (...) reflects the analytic, Aristotelian, Continental, literary, Marxist, and pragmatic schools of thought. These intellectuals start with the philosophy of Hispanics/Latinos in the United States and then move to the philosophy of African Americans and Anglo Americans in the United States and the philosophy of Latin Americans in Latin America. Gracia and his interlocutors debate the nature of race and ethnicity and their relation to nationality, linguistic rights, matters of identity, and Affirmative Action, binding the concepts of race and ethnicity together in ways that open new paths of inquiry. Gracia's Familial-Historical View of ethnic and Hispanic/Latino identity operates at the center of each of these discussions, providing vivid access to the philosopher's provocative arguments while adding unique depth to issues that each of us struggles to understand. Love, especially romantic and partnership love, has been a legitimate research theme in social science since the mid-twentieth century. In the research less attention is paid to how personal conceptions of love are formed within specific sociocultural contexts. One question that emerges in relation to social representations theory is: how are ideas about love, or knowledge of love, re-presented among particular social groups and which sociocultural resources are used in the process? In our questionnaire-based research we ascertained which perceptions, ideas (...) and knowledge are prevalent among young people who are gaining their first experiences of partner relationships, what they consider love to be in their own context and what knowledge they have of love. The questionnaire was completed by 268 higher education students, who provided 38 representations of love, based on personal experience and linked to sociocultural sources of love. (shrink)

ABSTRACT In this article I confront and criticize the widespread tendency to ignore, marginalize, or dismiss without serious consideration Nietzsche's psychological hypothesis that a “will to power” is the major motivator of human behavior. I begin by separating Nietzsche's psychological hypothesis from both his occasional cosmological extension of it into an account of all processes in the world and from his power-based theory of value. And I argue that, since the psychological thesis does not depend on the cosmological extension, is (...) more fundamental to Nietzsche's overall project, and is much better supported by Nietzsche's argument, it deserves to be seriously considered on its own merits. Then, I critically consider Robert Solomon's attempts to deny any value at all to the will to power as a general motivational hypothesis and to reinterpret Nietzsche's theory of the will to power in a way that ignores what Nietzsche actually says about it and, moreover, radically undermines its significance. Aunque fueron contemporáneos, Borges y Wittgenstein nunca se conocieron, ni se citaron, ni se leyeron. Pero hay poderosas afinidades y conexiones entre ambos. Por ejemplo, al fin del Tractatus Wittgenstein entiende que hay que callar precisamente ahí porque se ha llegado a un punto en el que conceptual se subordina a lo poético. La idea de que la naturaleza estética del mundo no puede representarse por medio del lenguaje también es característica de Borges. El mar, los atardeceres, la llama de (...) una hoguera, por ejemplo, son la inminencia de una revelación que nunca se produce, son el hecho estético. La obra de Wittgenstein es estrictamente filosófica y al mismo tiempo literaria. Esa proposición parece verdadera también para el caso de la obra de Borges. (shrink)

Martha Nussbaum es fundamentalmente una filósofa política y moral que, cimentada en la tradición aristotélica, ha logrado integrar en unapostura teórica una visión de la justicia social con una perspectiva sobre la naturaleza y el cultivo de ciertas emociones morales que resultan apropiadas para edificar una nueva ciudadanía democrática. Para nuestra autora, la justicia no puede estar desligada del accionar de las personas en la vida cotidiana, por tanto, considera que este vínculo se puede materializar mediante el cultivo de las (...) emociones, las cuales se entienden como elementos claves de la vida moral que afinan nuestra percepción del mundo y orientan nuestras elecciones. Guiados por esta noción, en este artículo presentamos algunos aspectos fundamentales del pensamiento político de Nussbaum, mostrando la transición que la autora experimenta en sus teorías desde las posturas del liberalismo de Rawls hasta consolidar su propia visión de la “justicia compasiva”, la cual es unaforma concreta de apuntalar la norma pública que defiende cómo todas las personas merecen igual respeto y dignidad. En este recorrido igualmente reflexionaremos sobre la influencia de las posturas comunitaristas de finales del siglo XX en los ideales de ciudadanía de la filósofa de Chicago. (shrink)

En el año 2013 el artista Eduardo Navarro presentó su obra Tratamiento homeopático del Río de la Plata en el Parque de la Memoria - Monumento a las Víctimas del Terrorismo de Estado, como parte de la exhibición Aquella mañana fue como si recuperara, si no la felicidad, sí la energía, una energía que se parecía mucho al humor, un humor que se parecía mucho a la memoria, bajo la (...) curaduría de Inés Katzenstein y Javier Villa. En palabras del artista, el proyecto se inspiró en la teoría del científico japonés Masaru Emoto, quien sostiene que las diversas formas de cristalización del agua se deben a las energías y afectos a las que ésta se expone. The author analyses the problems faced by Continental Europe's legal systems as a result of the appearance of the so‐called new religious movements. He is of the opinion that the expected change towards the achievement of full legal neutrality regarding the religious phenomena cannot be based on the sole assumption that each and every religion deserves protection. In fact, he considers that any system of equality should be aimed at protecting the legitimate expression of the individual's free will; that is (...) to say, neither a particular religion nor all of them, but the person considered as a citizen, regardless of whether he believes or not. El artículo contextualiza e investiga los detalles del «Mes de Reflexión Episcopal» organizado por el Departamento de Pastoral de Conjunto del Celam en julio de 1971, que reunió providencialmente varios obispos, algunos de los cuales no estuvieron en la II Conferencia General tres años antes, y que darían testimonio del espíritu de Medellín hasta el martirio o hasta una muerte trágica en cumplimiento de su misión: Oscar Arnulfo Romero, Juan Gerardi Conedera, Gerardo Valencia Cano y Raúl Zambrano Camader. El encuentro (...) se describe a partir de la revisión documental de las actas y de los pocos informes impresos. La tesis central del artículo es que el diálogo informal entre obispos, teólogos y otros expertos en el «Mes de Reflexión Episcopal» es fuente de propuestas novedosas para una Pastoral de Conjunto, contra la clericalización y el autoritarismo en la Iglesia latinoamericana. Desafortunadamente, no hay una reunión posterior similar debido a una controversia con la Congregación romana para los obispos. (shrink)

In the study of human cognitive activity using electroencephalogram (EEG), the brain dynamics parameters and characteristics play a crucial role. They allow to investigate the changes in functionality depending on the environment and task performance process, and also to access the intensity of the brain activity in various locations of the cortex and its dependencies. Usually, the dynamics of activation of different brain areas during the cognitive tasks are being studied by spectral analysis based on power spectral density (PSD) estimation, (...) and coherence analysis, which are de facto standard tools in quantitative characterization of brain activity. PSD and coherence reflect the strength of oscillations and similarity of the emergence of these oscillations in the brain, respectively, while the concept of stability of brain activity over time is not well defined and less formalized. We propose to employ the detrended fluctuation analysis (DFA) as a measure of the EEG persistence over time, and use the DFA scaling exponent as its quantitative characteristics. We applied DFA to the study of the changes in activation in brain dynamics during mental calculations and united it with PSD and coherence estimation. In the experiment, EEGs during resting state and mental serial subtraction from 36 subjects were recorded and analyzed in four frequency ranges: θ1 (4.1–5.8 Hz), θ2 (5.9–7.4 Hz), β1 (13–19.9 Hz), and β2 (20–25 Hz). PSD maps to access the intensity of cortex activation and coherence to quantify the connections between different brain areas were calculated, the distribution of DFA scaling exponent over the head surface was exploited to measure the time characteristics of the dynamics of brain activity. Obtained arrangements of DFA scaling exponent suggest that normal functioning of the brain is characterized by long-term temporal correlations in the cortex. Topographical distribution of the DFA scaling exponent was comparable for θ and β frequency bands, demonstrating the largest values of DFA scaling exponent during cognitive activation. The study shows that the long-term temporal correlations evaluated by DFA can be of great interest for diagnosis of the variety of brain dysfunctions of different etiology in the future. (shrink)

The research deals with the issue of genre hybridization in the novel “Silence – Chronicle of a Killer” written by a contemporary Austrian writer Thomas Raab. An examination of the novel's composition and structure, as a text in motion, has been accomplished in the article. The novel “Silence” is an excellent illustration of how the genre of adventure has been adapted to include elements of science fiction. This novel is a love tale, a rural life saga, a formation narrative, and (...) a psychological thriller all in one. As a fictionalized account of the life of a serial murderer with hypersensitive hearing who became a legend for his mental torment and suffering, it serves both as a biography and a thriller. Novelist Raab uses elements from classic horror novels like Frankenstein, German romantics, in particular, G. Kleist, the tale of Casper Hauser, and detective novels like Friedrich Durrenmatt's "Promise" to tell the story of Casper Hauser's disappearance in his book. A new aesthetic experience may be formed at various degrees of identification ranging from naive perception to higher levels of literary reception. Concentration is required for poetic and philosophical substance. Michel Focalut's nomadism, marginality, and authoritarian power rhetoric have been discussed in this article. The novel's ultimate content has been disclosed as the aphesis torment, emotional sublimation, as the birth of an artwork and, at the same time, death of the author, who exposes discourses, accountable for creating texts that are allocated to him. En el presente trabajo se propone rebajar una de las condiciones para adoptar un principio lógico. La condición a la cual se rebaja tiene que ver con la aceptación del conocimiento proposicional y, por otro lado, con contemplar las consecuencias prácticas efectivas beneficiosas que nos da un principio lógico. Para esto, primero se realiza una reconstrucción del problema de la adopción entendido como una reductio, mostrando que el problema se encuentra en el modo en que los agentes aceptan el conocimiento (...) proposicional. Luego de haber diagnosticado el problema muestro que al rebajar el peso de la adopción es necesario introducir las consecuencias prácticas efectivas beneficiosas del principio lógico para que el agente pueda adoptar el principio lógico. Por último se analizan algunas posibles objeciones a mi propuesta y doy una breve conclusión. (shrink)

Es conocida la oposición de Albert Camus a la pena capital. En sus Réflexions sur la guillotine (1957) va a criticar la máquina judicial que hace sufrir en el tiempo y en el espacio al condenado a muerte. Antes, en L'homme revolté (1951), ha criticado la perversa lógica contractual rousseauniana implicada en la auto-imputación que conduce silenciosamente a Saint-Just al patíbulo en la época del terror revolucionario en Francia y a los condenados a muerte en la purgas del régimen de (...) Stalin en la Unión Soviética. Pero unos años antes, en El Mito de Sísifo (1942), hablando del suicidio, se ha referido a Galileo y al peligro que ha corrido de morir en la hoguera por defender sus verdades. Nos preguntamos aquí por aquello que, en el pensamiento de Camus, convierte a la pena capital en suicidio. (shrink)

En el presente trabajo buscaremos intervenir en el debate filosófico – político actual respecto de si ciertas prácticas biomédicas pueden ser consideradas como una “nueva eugenesia liberal”. Nos centraremos, entonces, en la tríada constituida por la imbricación entre ciencias humanas, técnicas biopolíticas y tecnologías de gobierno de la población en el marco de la construcción del “capital humano” como problema , para dar cuenta genealógicamente del interrogante que opera como disparador del presente trabajo.
