Identifying, classifying, and analyzing arguments in legal discourse has been a prominent area of research since the inception of the argument mining field. However, there has been a major discrepancy between the way natural language processing (NLP) researchers model and annotate arguments in court decisions and the way legal experts understand and analyze legal argumentation. While computational approaches typically simplify arguments into generic premises and claims, arguments in legal research usually exhibit a rich typology that is important for gaining insights (...) into the particular case and applications of law in general. We address this problem and make several substantial contributions to move the field forward. First, we design a new annotation scheme for legal arguments in proceedings of the European Court of Human Rights (ECHR) that is deeply rooted in the theory and practice of legal argumentation research. Second, we compile and annotate a large corpus of 373 court decisions (2.3M tokens and 15k annotated argument spans). Finally, we train an argument mining model that outperforms state-of-the-art models in the legal NLP domain and provide a thorough expert-based evaluation. This paper argues for the normative significance of attention. Attention plays an important role when describing an individual’s mind and agency, and in explaining many central facts about that individual. In addition, many in the public want answers and guidance with regard to normative questions about attention. Given that attention is both descriptively central and the public cares about normative guidance with regard to it, attention should be central also in normative philosophy. We need an ethics of attention: a field (...) of study of which normative pressures, if any, govern attention. Like the ethics of belief, the ethics of attention will connect those normative questions to issues regarding the nature of attention, i.e. to what is subject to such normative pressures. Philosophers should develop an ethics of attention that helps to provide normative guidance and that is commensurate in its richness to the descriptive significance of attention. The second half of the paper sketches a framework that may help us to get started at developing the ethics of attention. (shrink)

Introduction: This paper has two, interrelated aims. The first is to clarify Sartre's theory of intersubjectivity. Sartre's discussion of the Other has a puzzling way of going in and out of focus, seeming at one moment to provide a remarkably original solution to the problem of other minds and at the next to wholly miss the point of the skeptical challenge. The nature of his argument is equally uncertain: at some points it looks like an attempt to mount a transcendental (...) argument, a kind of Refutation of Idealism regarding the existence of others, at others, to be a defence of direct realism; yet again, it can seem to propose a dissolution of the problem closely analogous to Wittgenstein. I will argue (Section 1) that none of these provides quite the right model for understanding Sartre, which requires one to take seriously his method of resolving epistemological issues into matters of ontology. I argue further (Section 2) that Sartre's theory becomes fully coherent only if we make explicit its implicit presupposition of a conception of intersubjectivity articulated by Fichte. My second aim is to pursue the connection opened up of Sartre with German idealism. To the extent that commentators attempt to relate Sartre systematically to German idealism, it is almost always Hegel who provides the other term of comparison.1 What I try to show (Section 3) is that the usual comparison of Sartre with Hegel, which is largely negative, is distracting, and that Sartre's closer philosophical [End Page 325] relations are to Fichte and Schelling.2 This supplies, I argue, an important correction to the tendency of anglophone discussion of Sartre to isolate his claims from historical considerations, or to restrict Sartre's historical frame of reference to Hegel, Husserl and Heidegger: Sartre's philosophy, I suggest, is viewed fruitfully in the context of philosophical debates pursued in early German idealism. Sartre's ethics, I argue (Section 4), provide supporting evidence for this view. I propose tentatively in conclusion (Section 5) a corresponding view of existential phenomenology as a whole. It has often been claimed, e.g. by William James or Aldous Huxley, that mystical experiences across times and cultures exhibit a striking similarity. Even though the words and images we use to describe them are different, underneath the surface we find a common experiential core. Others have rejected this claim and argued that all experiences are intrinsically shaped by the mystics’ pre-existing religious concepts. Against these constructivist objections, I defend the idea of a common core by arguing that even if (...) all experience is interpreted through concepts, there could still be a common core. Those who reject the common core thesis usually argue that no distinction between experience and interpretation can be made since all experience is per se already interpreted. The notion of an uninterpreted experience is self-defeating. Drawing on current research on nonconceptual mental content, I argue that experiences can have nonconceptual content; that interpretation must be understood as conceptualization and that conceptualization presupposes a raw mental content that is not conceptualized. This raw content is not experienced as nonconceptual. Rather, the nonconceptual, uninterpreted common core is an abstraction which shows itself only through reflection. Thus, the existence of a common core is compatible with the fact that all experiences are interpreted. (shrink)

Farmers perceive and appraise climate change, related risks and opportunities as well as adaptation measures differently. Such differences are not well understood and rarely considered in extension services, outreach activities and agricultural policies. We aim to develop empirically based farmer types, who differ in their socio-cognitive and emotional processes towards droughts, their expected drought impacts, their appraisal of drought adaptation measures, and their previous and intended implementation of such measures. The Model of Private Pro-Active Adaptation to Climate Change provides the (...) theoretical foundation for a three-phase procedure of semi-structured interviews, a standardized survey and a qualitative workshop. The principal component analysis reveals eight socio-cognitive and emotional processes of relevance for forming the famer types of drought adaptation: perceived opportunities resulting from droughts, perceived effectiveness of drought adaptation measures, negative affect towards droughts, perceived work effort and perceived social approval of drought adaptation measures, fatalism, trust in public measures, and perceived self-efficacy. Cluster analyses of these processes yield four types of Austrian farmers. The social implementers perceive themselves as capable, and drought adaptation measures as effective, socially approved, and effortless. The unaffected profiteers have hardly been affected by droughts and perceive beneficial impacts due to a decline in precipitation. The trusting fearfuls have already experienced severe drought impacts and express intense negative affect towards droughts. The passive fatalists focus on avoidance and do neither trust in important others nor in public measures. The identified farmer types of drought adaptation may support the design of climate and agricultural policy instruments and of tailor-made education and communication programs, for instance to increase self-efficacy and reduce fatalism. In moments of daring, some physical scientists consider problems of social inquiry, hoping naively that the methods of physical inquiry will provide them with special insight. In my own work on problems of industrial production where I am searching for “practical” means for optimizing production in some socially satisfactory sense, I find that the physical scientist cannot escape the responsibility for social inquiry. So far as I can understand the nature of this work, it requires for its fruitful pursuit a (...) methodology which leans heavily on the concepts of statistical control of Shewhart, of cybernetics of Wiener and of experimentalism of Singer, Churchman and Ackoff. While Darwin pictured organismal evolution as “descent with modification” more than 150 years ago, a detailed reconstruction of the basic evolutionary transitions at the molecular level is only emerging now. In particular, the evolution of today's protein structures and their concurrent functions has remained largely mysterious, as the destruction of these structures by mutation seems far easier than their construction. While the accumulation of genomic and structural data has indicated that proteins are related via common ancestors, naturally occurring protein structures (...) are often considered to be evolutionarily robust, thus leaving open the question of how protein structures can be remodelled while selective pressure forces them to function. New information on the proteome, however, increasingly explains the nature of local and global conformational diversity in protein evolution, which allows the acquisition of novel functions via molecular transition forms containing ancestral and novel structures in dynamic equilibrium. Such structural plasticity may permit the evolution of new protein folds and help account for both the origins of new biological functions and the nature of molecular defects. Evidence is currently mixed regarding the way in which cognitive conflict modulates the effect of emotion on task performance. The present study aimed to address methodological differences across previous studies and investigate the conditions under which interference from emotional stimuli can either be elicited or eliminated under high cognitive conflict. Four behavioural experiments were conducted with a university sample using a gender-discrimination stimulus-response compatibility task. In line with our previous findings, Experiment 1 found that when emotion and cognitive conflict conditions (...) were blocked, emotional faces increased reaction time interference during response compatible trials (low conflict) but not response incompatible trials (high conflict). However, when conflict and emotion conditions were randomised in different configurations across Experiments 2 (all trials randomised), 3 (emotion blocked, compatibility randomised) and 4 (compatibility blocked, emotion randomised), emotion interfered with task performance across both high and low conflict trials. These results suggest that predictability of both compatibility and emotion is required in order to obtain reduced emotional interference under high cognitive conflict. Consistent with prior reports, a top–down anticipatory control mechanism seems to be engaged in the presence of negative emotion when there are incompatible stimulus-response mappings. (shrink)

Culture or Biology? The question can seem deep and important. Yet, I argue in this chapter, if you are enthralled by questions about our biological differences, then you are probably confused. My goal is to diagnose the confusion. In debates about the role of biology in the social world it is easy to ask the wrong questions, and it is easy to misinterpret the scientific research. We are intuitively attracted to what is called psychological essentialism, and therefore interpret what is (...) biological as what can be traced to “essences”. On this interpretation, it would be deep and important to know what about, say, the differences between the genders is biological: it would correspond to what is essential to being a man or being a woman, and be opposed to what is a mere accidental feature that some women or some men have. Yet, the psychological essentialist understanding of ‘biological differences’ is deeply mistaken about biology. It has the wrong conception of biological kinds, of biological heritability, and of how genes and hormones work. Those who argue for an important role of ‘biology’ in the explanation of human differences often see ‘the science’ on their side. But this is false – on the interpretation of ‘biological differences’ that is most intuitive and that makes the question appear to be most interesting. Defenders of ‘biology’ often have the science against them. What is often called ‘biology’ is a myth: a myth created by an intuitive tendency that grotesquely distorts real biological research. This essay aims to extend Paul Ricœur’s account of recognition to address some of the concerns of globalization, especially those voiced by Enrique Dussel. The extension is accomplished in two parts. First, Dussel’s account of spatial existence as dwelling is reviewed as it is pertinent to the concerns of globalization. Next, it is demonstrated that each of the aspects of Ricœur’s account of recognition may be given a spatial re-articulation. The results thus establish an outline of how recognition theory might (...) address some of the concerns of globalization. The essay concludes with several consequences for the modification of recognition politics as one finds it in the late work of Ricœur and in Axel Honneth’s ongoing inquiries. . (shrink)

The shift from state-led import-substitution industrialization to more market-oriented economic models often has the result of shrinking and demobilizing the labor movement. Yet, evidence from Argentina suggests that a subsequent resurgence of even a downsized labor movement may occur and furthermore that a type of “segmented neocorporatism” may be established in the new economic context. We argue that the establishment of this new form of interest intermediation is driven by economic and political factors that are both immediate and longer term. (...) In addition to the short-term condition of the labor market and the political strategy of the government in power, of longer-term importance are structural and institutional conditions that derive from the earlier process of market reform, specifically the nature of sectoral shifts in the economy and the degree of labor law deregulation affecting the “associational power” of unions. The aim of this paper is to consider in what sense the modal-Hamiltonian interpretation of quantum mechanics satisfies the physical constraints imposed by the Galilean group. In particular, we show that the only apparent conflict, which follows from boost-transformations, can be overcome when the definition of quantum systems and subsystems is taken into account. On this basis, we apply the interpretation to different well-known models, in order to obtain concrete examples of the previous conceptual conclusions. This study adds to a small but growing literature that situates sleep within gendered work— family responsibilities. We conducted interviews with 25 heterosexual dual-earner working-class couples with children, most of whom had one partner who worked at night. A few men suffered disrupted sleep because of their commitment to being a coparent to their children, but for most their provider status gave them rights to longer and more continuous sleep. By contrast, as they were the primary caregiver during sentient hours, (...) women’s sleep was curtailed and interrupted by responding to the needs of family members at night and at the beginning of each day, and this was true for women who worked nights as well as days. Furthermore, in struggling to meet their daily employment and familial obligations while tired and sleepy, women further stressed their bodies in ways that can cause cumulative sleep debt. This article demonstrates that sleep deficits are another manifestation of gender inequality, with important implications for long-term health and well-being. (shrink)

The Squaring of the Bermuda Triangle. In the course of the great success of theory programs and the funding of young researchers within media studies and the history of science over the past 15 years, a generation of scholars has emerged (including the authors of this article) who have been genuinely trained in approaching interdisciplinary problems and objects. However, in view of a recently increasing renaissance of scientific ‘disciplines’, this raises the question of how to deal with such an innate (...) lack of discipline in the future. We respond here with two personal scenes that are by no means intended as a self‐adulation of our own research approaches, but as pleas for a continued multi‐voicedness between the history of science, media studies, the history of technology, and other interdisciplinary (non‐)disciplines. Learning Analytics und Künstliche Intelligenz in der Hochschulbildung versprechen individualisierte und personalisierte Verbesserung des Lernens und Lehrens. Bildungstechnologien bieten aus ethischer Perspektive jedoch nicht nur Verbesserungspotentiale und -chancen, sondern sie bringen auch Risiken und potenzielle Gefahren mit sich, für das Individuum, aber auch für die Gesellschaft als Ganzes. Eine ethische Reflexion und Diskussion der Chancen und Risiken ist für eine ethisch vertretbare Gestaltung, Implementierung und Nutzung von solchen Technologien von fundamentaler Bedeutung, wie z. B. im Rahmen des Projekts KI:edu-nrw an (...) der Ruhr-Universität Bochum. Eine solche Reflexion und Diskussion bedarf allerdings gewisser ethischer Basiskompetenzen. Das Teilprojekt Ethik entwickelte ein Konzept tugendethischer Kompetenzbildung, um u. a. disziplinäre Barrieren abzubauen sowie um Praktizierenden Basiswerkzeuge der ethischen Reflexion und Entscheidungsfindung in ihren jeweiligen Anwendungskontexten bereitzustellen. In diesem Beitrag stellen wir sowohl die theoretischen Fundamente unseres Ansatzes als auch den Prozess und die Ergebnisse unserer Arbeit dar. (shrink)

All projects take place within a context of uncertainty. That is especially noticeable in complex hydroelectric power generation projects, which are affected by factors such as the large number of multidisciplinary tasks to be performed in parallel, long execution times, or the risks inherent in various fields like geology, hydrology, and structural, electrical, and mechanical engineering, among others. Such factors often lead to cost overruns and delays in projects of this type. This paper analyzes the efficiency of the Earned Value (...) Management technique and its Earned Schedule extension, as means of forecasting costs and deadlines when applied to complex hydroelectric power production projects. It is worth noting that this analysis was based on simulation models applied to real-life projects. The results showed that cost forecasting becomes very accurate over time, whereas duration forecasting is not reliably accurate. (shrink)

In this essay I argue that Hegel’s system includes no ontology of nature, either in any traditional sense, or in any specifically Hegelian sense, of “ontology.” What Hegel provides instead is a philosophy of nature in which specifically natural activities generate specifically natural differences and identities out of themselves. I make my case first by considering the meaning of “ontology” Hegel inherited from Wolff and Kant. I show that Hegel rejected this sense of ontology for his own philosophy, in part (...) because of his recognition of the success of the Kantian critical project in making traditional ontology impossible. I then argue that although Hegel sometimes characterizes his own Objective Logic in ontological terms, he also restricts that characterization in a way that makes it inapplicable to his treatment of apparently natural categories in the Logic itself, and to his Philosophy of Nature. Against this anti-ontological background I examine a small portion of Hegel’s concrete treatment of natural phenomena and kinds: his discussion of the nervous system in higher-order animals. Through its self-formation and the contribution of its nervous-system activity to its overall life, the animal does not implement differences, identities, or logical structures borrowed from elsewhere, but itself produces the differences and identities through which it is constituted. The self-determination Hegel articulates in his study of the nervous system gives us a good example of his typically “on-the-ground” approach, which is strikingly different from the “top-down” approach more common in the ontological tradition. However, a renewed interest in this field is increasingly exposing the philosophical (...) and theological stereotypes of the few earlier studies. Although institutional [End Page 160] philosophy and theology throughout Europe between the Reformation and the Enlightenment continued to identify itself as Scholastic, it is now clear that it was far from homogeneous. One of the diverse currents was the Scholasticism in Evangelical Protestantism. Within the reformed Church, academies aimed explicitly at continuing and contributing to the theological and philosophical tradition of the entire Church. Several studies have in particular suggested continuity between Thomas Aquinas and philosophers and theologians of good standing in the reformed Church. The most recent study is Christopher Cleveland’s Thomism in John Owen.The subject of this study is well chosen. John Owen (1616-83) was an influential pastor, scholar, vice-chancellor of the University of Oxford, and chaplain of Oliver Cromwell. He received a first-rate education at Oxford and maintained a wide-ranging scholarship throughout his life. His complete works comprise twenty-four volumes in the critical edition, and these are often thorough and systematic. From his tutor and friend Thomas Barlow, Owen seems to have gained a deep and lifelong appreciation of Aquinas, Alvarez, Bañez, and other Scholastics.Cleveland rightly aims at a focused investigation. His purpose is to “expand the inquiry into Reformed Thomism” (17) and “examine the role of Thomism in the theology of John Owen” (2). By “Thomism” he means “Aquinas” and sometimes “Diego Alvarez and Domingo Bañez.” In the first chapter Cleveland outlines the book and surveys some of the secondary literature. In the second chapter he contends that Owen was influenced by Aquinas’s concept of actus purus in arguing divine simplicity, divine immutability, and divine concurrence. In the third and fourth chapters he asserts that Aquinas’s understanding of infused “habits” strengthened Owen’s explanation of justification and sanctification. In the fifth chapter Cleveland proposes that Owen’s account of the hypostatic union is greatly indebted to Aquinas. Strangely the author concludes that Owen’s thought represents “a Western Trinitarian Theology” although he does not treat Owen’s doctrine of the Trinity.This book is a laudable and well-needed attempt to determine the particular influence of Aquinas on Owen. However, Cleveland’s work would benefit from a greater methodological rigor. Let us first consider Cleveland’s criteria for tracing Aquinas’s influence. He suggests that there are “four categories into which Thomistic influence falls.” These are: (1) quotations or paraphrases of “Thomas or a Thomist author,” (2) the development of a subject by means of similar theological concepts, (3) the “use of similar but not identical principles,” and (4) a coincidence of thought because of a common source. The second criterion is said to identify the most common type of influence, and the fourth the rarest (3). Now, that Owen was influenced by Aquinas is not in contest; the question is: how was Owen influenced? And there are limitations to what can be drawn from the application of these categories. The first category is not decisive, since any [End Page 161] author may be quoted or paraphrased for widely various reasons, and some influential authors may not be quoted or paraphrased. The fourth criterion is somewhat irrelevant, since the coincidental rarely reveals steady influence.Cleveland identifies “three major areas of Thomistic influence upon Owen’s theology” (4; similarly 154). These are God as actus purus, infused dispositions of grace, and the hypostatic union. Yet, the book contains no argument for that conclusion. Having formulated four criteria for the assessment of influence in the first chapter, Cleveland surprisingly does not return to them in the remainder of the book.
