The past decade has witnessed escalating legal and ethical challenges to the diagnosis of death by neurologic criteria. The legal tactic of demanding consent for the apnea test, if successful, can halt the DNC. However, US law is currently unsettled and inconsistent in this matter. Consent has been required in several trial cases in Montana and Kansas but not in Virginia and Nevada. In this paper, we analyze and evaluate the legal and ethical bases for requiring consent before apnea testing (...) and defend such a requirement by appealing to ethical and legal principles of informed consent and battery and the right to refuse medical treatment. We conclude by considering and rebutting two major objections to a consent requirement for apnea testing: a justice-based objection to allocate scarce resources fairly and a social utility objection that halting the diagnosis of brain death will reduce the number of organ donors. During his lifetime, Sir Ivor Jennings was well known as the author of several standard books on constitutional law. He acted as constitutional adviser to the governments of Ceylon and Pakistan and was Vice-Chancellor of the University of Ceylon. This 1956 book followed in the tradition of his earlier The British Constitution and is a clear statement by an expert with a characteristically practical point of view. It is principally concerned with a practical problem: what constitution shall be given (...) to a new country about to govern itself for the first time? Published at a time when colonial empires were moving more or less peaceably towards self-government, it was based on a series of broadcast talks originally commissioned by the BBC in the belief that the experiences gained in Asia were in principle applicable to other countries approaching self-government. This paper will investigate patterns of historical periodisation with regard to public intellectual work. It will begin with a focus on educational studies and with a specific case study of the Centre for Applied Research in Education (CARE) at the University of East Anglia. The case study will highlight the roles of leading public intellectuals such as Lawrence Stenhouse and explore the genre of applied research. The notion of applied research in education explicitly sought to connect the project of public (...) education and social justice with research which was applied to these projects In this way, in an idealised form, the public intellectual and applied researcher would offer aid and sustenance, which would enhance and energise the overall project of public education for all By exploring a case study of an institution and the associated research genre I hope to elucidate the relationship between educational studies and the public intellectual and also to examine the changing prospects for such work over different historical periods. Part of the task is to delineate the changing ‘windows of opportunity’ for public intellectual work. And as we shall see, Brief Encounters are a reasonable characterisation of such patterns of possibility Using the case study as an entry point the paper goes on to discuss broader questions about public intellectuals’ prospects. These questions are embedded in the discussion of some of the work of Sandel on market societies, and Applebaum on changing patterns of democratic engagement. ONTOLOGY, as a special field of philosophical inquiry, has been considerably neglected in modern times, and it is thus not surprising that little attention has been paid to Descartes in respect of ontology, especially since he himself did not bring it into prominence in his writings. His not having done so is quite in line with his characteristic procedure, which was not to engage head-on the fundamental positions or presuppositions which he was disputing, but rather to distract attention from them (...) so as to secure an unantagonistic hearing for his own theories. I shall argue that Descartes had an ontology, which was not merely implicit, and that when we discern his ontology we can see his position in the basic areas—metaphysics, epistemology and methodology, philosophical psychology or theory of mind-to have been consistently determined by his ontology. Models are one of the main instruments in scientific research. Disciplines have developed a different understanding of the notion, function and purpose of models. We thus need a systematic approach in order to understand, to build and to use models. This book gives an insight into the disciplinary modelling know-howand is a starting point to develop a general model approach that generalises and combines for an interdisciplinary use.

The Strongest Meaning Hypothesis of Dalrymple et al (1994,1998), which was originally proposed as a principle for the interpretation of reciprocals, is extended in this paper into a general principle of plural predication. This principle applies to complex predicates that are composed of lexical predicates that hold of atomic entities, and determines the pluralities in the extension of the predicate. The meaning of such a complex predicate is claimed to be the truth-conditionally strongest meaning that does not contradict lexical properties (...) of the simple predicates it contains. Weak interpretations of reciprocals (as in the books are stacked on top of each other), plural predicate conjunction (e.g. the books are old and new) and ’atomic’ distributivity in general are derived by a unified mechanism, which ’weakens’ the basic universal meanings of strong reciprocals, boolean conjunction and quantification over atomic entities. This essay is a contribution to the field of institutional studies in that it treats the State as a substantial phenomenon, composed of institutions that require analysis in their own right. Here, the focus is on the political form of African states from the 1960s to the 1980s. On the one hand, I will follow Bourdieu here in insisting that the study of government demands that we know something of the history of political thought (la pensée politique). This simple observation (...) is seldomly applied when it comes to politics in postcolonial Africa. On the other, I use Peter Wagner´s concept of modernity to show that struggles against colonialism and Imperialism and the pursuit of self-determination for African and Asian peoples are unambiguously struggles against domination and for autonomy. The emergence of Third World nationalism (and the Non-Aligned Movement) is an event, therefore, firmly in modernity. So too is the phenomenon of the One-party state in Africa. (shrink)

This set of problems first came to light with the Eleatic criticism of Pythagorean theory, and dramatically revealed their importance in the paradoxes of Zeno, which have retained their relevance down the ages, and play a significant role, as we shall see, in the thought of Whitehead. In antiquity Aristotle had attained the clearest realization of these problems. It was in terms of them that he analyzed and rejected the theory of Leukippos and Demokritos of atoms and the void, and (...) worked out his own alternative theory. In the Renaissance these problems became crucial again, especially in the thought of Bruno and Patrizzi. Leibniz saw them as the basic issue presented by the theories of the seventeenth century, and it was in terms of these problems that he made his examination of Descartes' doctrine of res extensa, of Gassendi's revival of Democritean atomism, as well as of Newton's doctrine of space. Insufficient attention to these problems had resulted in his contemporaries getting caught in what he referred to as the "labyrinth of the composition of the continuum"-adopting this phrase from the title of a book by Libertius Fromond which had been published in 1631. Leibniz believed himself to have found the Adriadne's thread out of the labyrinth in the conception of body, as well as of space and time, as phenomenal. In Kant's view this way out was tenable only with a considerable philosophical reconstruction, which he provided with his transcendental philosophy. (shrink)

This article describes a logic of distinction and succession within the late-twentieth-century Leningrad-St. Petersburg cultural field, whereby consecutive intelligentsia mainstreams were replaced by their avant-garde peripheries. In this dynamic picture of socio-cultural transformations, I propose a working hypothesis of a repeated stratification of the field into an ‘official’, an ‘unofficial’, and a third ‘non-aligned’ intelligentsia. This hypothesis is tested in reference to the ‘non-aligned’ groups founded by the avant-garde artist and ideologue Timur Novikov (1958–2002). Three major shifts are described: from (...) the politicized late-Brezhnevite early 1980s to the apolitical radicalism of Novikov’s New Artists; from this anarchistic underground, through the perestroika era, to the playful ‘classicism’ of the New Academy of Fine Arts in the 1990s; and from this postmodern international orientation to an arch-reactionary, neo-imperial posturing at the turn of the 2000s. Lastly, this ‘non-aligned’ intelligentsia is suggested as a possible precedent, or, indeed, a model for understanding other historically significant avant-garde peripheries, which commonly seek to distinguish themselves from (often mutually-exclusive) centres. In this paper, I will argue that ageing can be construed as disease. First, the concept of disease is discussed, where the distinction is made between two lines of thought, an objectivist and a subjectivist one. After determining the disease conception to be used throughout the argument, it is proposed that senescence could be seen as disease. Three common counterarguments are discussed, none of which appears strong enough to effectively counter the advocated view. In the third section, two potential implications (...) of the view advocated here will be briefly touched upon. These are the quest for a cure or treatment for ageing and the general attitude towards the elderly. It is concluded that, utilizing an objective disease concept, ageing could be seen as a disease. None of the considered counterarguments packs enough of a punch to discard this. The implications are complex and intertwined, but need not be negative. (shrink)

We live in a world in which scientific expertise and its epistemic authority become more important. On the other hand, the financial interests in research, which could potentially corrupt science, are increasing. Due to these two tendencies, a concern for the integrity of scientific research becomes increasingly vital. This concern is, however, hollow if we do not have a clear account of research integrity. Therefore, it is important that we explicate this concept. Following Rudolf Carnap’s characterization of the task of (...) explication, this means that we should develop a concept that is (1) similar to our common sense notion of research integrity, (2) exact, (3) fruitful, and (4) as simple as possible. Since existing concepts do not meet these four requirements, we develop a new concept in this article. We describe a concept of epistemic integrity that is based on the property of deceptiveness, and argue that this concept does meet Carnap’s four requirements of explication. To illustrate and support our claims we use several examples from scientific practice, mainly from biomedical research. (shrink)
