This article examines Harold Ramis’s 2005 noir comedy _The Ice Harvest_ as the critically dystopian counter-panel to his beloved 1993 film _Groundhog Day_, a film frequently discussed within the paradigm of utopia. While starkly different in genre, tone, and reception, the two films comprise a dialectical dyad that registers the historical transition from the utopian cultural effervescence of the early 1990s to the tragic foreclosure of imaginative horizons and the dystopian transformation of economic, political, and social landscapes in the (...) new millennium. In _The Ice Harvest_, the author argues, this is achieved through a strategic reactivation of film noir as a variant of the critical dystopia. (shrink)

Rosenberg was a chronicler and a good one, yet much of his inner dialogue was not with the present so much as the omnipresent artistic past. The central question, posed early in his life, concerned a man's individuality. Dostoyevsky had called it his "dearest" possession. At no time, even in his Marxist youth, did Rosenberg relinquish his vision of the individual as the central, most important player in any drama. Rosenberg was positively possessed with Dostoyevsky's doubts. One can hear the (...) rant of the man from the underground repeatedly in Rosenberg's written works—the stubborn hero who maintains the right even to be absurd and to "desire for himself what is positively harmful and stupid" if he claims it as a right. The right of the individual to live up to man's nature which, as Dostoyevsky said, "acts as one whole, with everything in it, conscious or unconscious" was Rosenberg's most consistent ideal. The individual he most admired, both in himself and in others, was the artist. But only in spite of everything. No one was more alert to the tartufferie that bedevils the world of the artist. Rosenberg craved sincerity with the same kind of passion for it he had found in Dostoyevsky. Art and artifact would not be a substitute for ethics and hard thought. Rosenberg's deepest conviction is revealed in his 1960 essay, "Literary Form and Social Hallucination," which begins with Dostoyevsky complaining about literature that does not lead to truth. Aesthetic internalism claims a link between judgement and motivation: aesthetic judgements bring with them motivations to act in characteristic ways. Critics object that there is a difference between merely liking something and judging it to be aesthetically good, and that it is our likings, not our aesthetic judgements, that motivate us. This paper develops a version of aesthetic internalism that can respond to this criticism. Wholehearted aesthetic judgements are characterized by stability, attention, and motivation. Making such judgements is an important (...) part of a good life, and so at least some aesthetic judgements are motivating. So we have reason to think that this version of aesthetic internalism is true. This paper defends wholehearted aesthetic internalism against objections, and assesses an argument from aesthetic internalism to aesthetic non-cognitivism. While wholehearted aesthetic internalism can only offer qualified support to non-cognitivism, it nonetheless offers a number of fruitful avenues for further work. (shrink)

The Uniform Determination of Death Act (UDDA) provides that “an individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead.” We show that the UDDA contains two conflicting interpretations of the phrase “cessation of functions.” By one interpretation, what matters for the determination of death is the cessation of spontaneous functions only, regardless of their generation by artificial means. By the (...) other, what matters is the cessation of both spontaneous and artificially supported functions. Because each UDDA criterion uses a different interpretation, the law is conceptually inconsistent. A single consistent interpretation would lead to the conclusion that conscious individuals whose respiratory and circulatory functions are artificially supported are actually dead, or that individuals whose brain is entirely and irreversibly destroyed may be alive. The fundamental determinant of death in donation after circulatory determination of death is the cessation of brain circulation and function. We therefore propose the term donation after brain circulation determination of death [DBCDD]. In DBCDD, death is determined when the cessation of circulatory function is permanent but before it is irreversible, consistent with medical standards of death determination outside the context of organ donation. Safeguards to prevent error include that: 1] the possibility of auto-resuscitation has elapsed; 2] no brain circulation (...) may resume after the determination of death; 3] complete circulatory cessation is verified; and 4] the cessation of brain function is permanent and complete. Death should be determined by the confirmation of the cessation of systemic circulation; the use of brain death tests is invalid and unnecessary. Because this concept differs from current standards, consensus should be sought among stakeholders. The patient or surrogate should provide informed consent for organ donation by understanding the basis of the declaration of death. In cases of circulatory cessation, such as occurs in DBCDD, death can be defined as the permanent cessation of brain functions, determined by the permanent cessation of brain circulation. (shrink)

The potentiality and power of human rationality is the hallmark of Greek philosophy, whether Platonic or Aristotelian. Renaissance and Enlightenment philosophers developed the logos of rationality as a central feature of modern culture, either in the form of mathematical rationalism or experiential reasoning, with appropriate debate between these diverse modes. A self-conscious culmination of the logos of reason was the elaboration of German Idealism complemented by Anglo-Saxon representatives, which idealism came under severe attack in the twentieth century from both positivistic (...) or analytic philosophers as well as from phenomenological and existential thinkers. Within this latter community and specifically in the arena of philosophy of religion, a most serious attack was launched upon European idealism and classical rationalism, which attack is the focus of this essay. As the series has developed these probings of new directions have taken the two fold direction of exploring the relationships between the disparate traditions of twentieth century philosophy and with developing new insights into the foundations of some enduring philosophic problems. This present volume continues both of these directions. The interaction between twentieth-century (...) Anglo-Saxon and Continental philosophy which was an implicit theme of our first and third volumes and the explicit subject of our second volume is here continued in a series of studies on major figures and topics in each tradition. In the context of these interpretative studies, Professor Durfee returns again and again to the question of the relationships between the will and the reason, and explores the conflicting goals of creativity and objectivity in formulating a philosophic position. In so doing he raises the issue as his title suggests - of the foundations of philosophy itself. He seriously challenges the belief common to both pheomenology and analytic philosophy that philosophizing can be a presuppositionless activity, objectively persued independent of the personal (and, perhaps, arbitrary) commitments of the philosopher. This issue, critical as it is to all forms of philosophy, is surely a worthy one for a series such as ours. (shrink)

This paper considers challenges resulting from the use of advanced artificial judicial intelligence (AAJI). We argue that these challenges should be considered through the lens of value alignment. Instead of discussing why specific goals and values, such as fairness and nondiscrimination, ought to be implemented, we consider the question of how AAJI can be aligned with goals and values more generally, in order to be reliably integrated into legal and judicial systems. This value alignment framing draws on AI safety and (...) alignment literature to introduce two otherwise neglected considerations for AAJI safety: specification and assurance. We outline diverse research directions and suggest the adoption of assurance and specification mechanisms as the use of AI in the judiciary progresses. While we focus on specification and assurance to illustrate the value of the AI safety and alignment literature, we encourage researchers in law and philosophy to consider what other lessons may be drawn. This essay armies that Kant's philosophy provides a justification for free markets. The myths about Kant are that he was a recluse, knew nothing about business, and that his epistemology divorced reason from reality, while his primary interest was metaphysics. Yet Kant's categorical imperative demands obedience even in the face of uncertainty about the external world. Adam Smith described this principle as the inward testimony of an impartial observer. Smith and Kant put individual decisions at the center of morality, but (...) agreed that people have a tendency to make morally inferior choices. Those who propose to regulate the economy are as troubled by this tendency as those they regulate. The self-sacrifice prescription is economically, psychologically, and morally unstable. In recommending market competition. Smith was unconsciously applying a Kantian formula. Market decisions are individual decisions. Individuals prefer to do business with those they trust: this is an incentive to honesty. A morality that depends upon incentives is imperfect but superior to a morality imposed by force. (shrink)

Tuomela (this issue, pp. 96-103) raises several objections to the analysis and critique of methodological individualism in my (1986). In what follows I reply to those criticisms, arguing, among other things, that: (1) the alleged reductions provided by Tuomela and others fail, because they either presuppose rather than eliminate social predicates or do not avoid the problem of multiple realizations; (2) supervenience does not guarantee that the social sciences are reducible, because merely describing supervenieence bases leaves numerous questions unanswered, and (...) (3) the eliminativism that Tuomela favors verges on being self-refuting and is highly implausible short of a detailed empirical critique of the social sciences, something Tuomela does not provide and something there is little reason to think can be provided. To speak of patients' choices is to obscure the distinction between request and refusal of treatment. The distinction is particularly crucial for questions of killing or letting die.

It is argued that there is no agreed definition of disease. Purely biological definitions are inadequate and combined biological and social definitions are not yet satisfactory. One approach has been to say that what doctors treat is disease. We are uncomfortable with that because we feel it releases people from obligations on a basis of convenience. In practice the weight given to the idea of disease varies according to what it will imply about obligations and privileges. It is suggested that (...) what doctors treat can be accepted as disease provided that we recognize that the significance of disease must vary with circumstances. Those circumstances include the agreement, more or less, of all persons affected when someone is considered to be a patient. The individual must also be competent and not constrained except by his own biological or psychological characteristics. However, there is the challenge to "mention" Being which brings a new and better kind of atunement. Man can think Being because he can be ontological. Man is both questioner and context. Any clarity in our understanding of Heidegger is a step. Professor Alderman helps us take this (...) step. Against the common assumption that modern medicine is altogether secular and scientific, this article argues that the practice of medicine manifests characteristic features of religion. This exposition is predicated upon a delineation of the phenomenological characteristics of religion and upon a critical analysis of the ways scientific medicine does or does not manifest these characteristics. Insofar as medical practice is unknowingly religious, that practice can cause harm and delusion. An acknowledgment that scientific medicine embodies features of religion is a beginning (...) point for scholarly reflection, criticism, and research from a variety of academic perspectives. (shrink)
