This contribution aims at proposing a framework for articulating different kinds of “normativities” that are and can be attributed to “algorithmic systems.” The technical normativity manifests itself through the lineage of technical objects. The norm expresses a technical scheme’s becoming as it mutates through, but also resists, inventions. The genealogy of neural networks shall provide a powerful illustration of this dynamic by engaging with their concrete functioning as well as their unsuspected potentialities. The socio-technical normativity accounts for the manners in (...) which engineers, as actors folded into socio-technical networks, willingly or unwittingly, infuse technical objects with values materialized in the system. Surveillance systems’ design will serve here to instantiate the ongoing mediation through which algorithmic systems are endowed with specific capacities. The behavioral normativity is the normative activity, in which both organic and mechanical behaviors are actively participating, undoing the identification of machines with “norm following,” and organisms with “norminstitution”. This proposition productively accounts for the singularity of machine learning algorithms, explored here through the case of recommender systems. The paper will provide substantial discussions of the notions of “normative” by cutting across history and philosophy of science, legal, and critical theory, as well as “algorithmics,” and by confronting our studies led in engineering laboratories with critical algorithm studies. This is the tenth volume of the Correspondence produced in the new edition of The Collected Works of Jeremy Bentham. The great majority of the letters have never before been published. They illustrate the composition, editing, publication, and reception of several of his works. The volume reveals Bentham's attempts to influence developments in France, the USA, Greece, Spain, Portugal, and South America. Despite Bentham's importance as jurist, philosopher, and social scientist, and leader of the Utilitarian reformers, the only previous edition (...) of his works was a poorly edited and incomplete one brought out within a decade or so of his death. The essays which Bentham collected together for publication in 1830 under the title of Official Aptitude Maximized; Expense Minimized, written at various times between 1810 and 1830, deal with the means of achieving efficient and economical government. In considering a wide range of themes in the fields of constitutional law, public finance, and legal reform, Bentham places the problem of official corruption at the centre of his analysis. He contrasts his own recommendations for good administration, which he had fully developed (...) in his magisterial Constitutional Code, with the severe deficiencies he saw in English practice. The core of the volume consists of four major essays directed against the principles and policies of four leading statesmen: Edmund Burke, George Rose, Robert Peel, and Lord Chancellor Eldon. Of particular concern to Bentham were the abuses sanctioned by the judges and their officials in the Westminster Hall courts, which, he argues, resulted in the denial of justice to the majority of the population. Eight volumes of the new Collected Works, five of correspondence, and three (...) of writings on jurisprudence, appeared between 1968 and 1981, published by the Athlone Press. Further volumes in the series since then are published by Oxford University Press. The contractarian theory elaborated by John Rawls in A Theory of Justice exploits the difference principle in a great many ways. Rawls argues that, when used as part of a set of guiding principles for structuring the basic institutions of society, it simplifies the problem of interpersonal comparisons (91-4)1, helps compensate for the arbitrariness of natural endowments (101-3), promotes a harmony of interests between citizens (104-5), reintroduces the principle of fraternity to democratic society (105-6), and, what is critical to his (...) contractarian theory, it is an essential part of the principles of justice which would be chosen by free, equal, and rational persons in the original position. " "Jeremy Kirby addresses a difficulty in Aristotle's metaphysics, namely the possibility that two organisms of the same species might share the same matter.

This paper asks how we should regard the laws and customs of armed conflict, and specifically the rule prohibiting the targeting of civilians. What view should we take of the moral character and significance of such rules? Some philosophers have suggested that they are best regarded as useful conventions. This view is sometimes motivated by a "deep moral critique" of the rule protecting civilians: Jeff McMahan believes for example that the existing rules protect some who ought to be liable to (...) attack (on account of their having voluntarily contributed to the injustice or aggression being resisted). He thinks we would be better off with a different principle of discrimination in warfare. But McMahan acknowledges that for the time being we must stick with the rules that we have. The present paper does five things: (1) it explores and takes further some of McMahan's insights about the importance of existing positive law in this area; (2) it argues that some of the features that philosophers find problematic with the rule offering blanket protection to all civilians have to do with administrability; (3) it raises some questions about whether the rule protecting civilians can really be regarded as a convention (and it argues that certainly it cannot be regarded as a "Lewis-convention" in a strict sense); (4) to the extent that the rule can be regarded as conventional, the paper argues that it remains a deadly serious moral rule, partly because of the circumstances of death and destruction in which it operates and which it tries to ameliorate, and partly on account of its fragility. The fifth point is the most important. (5) The rule protecting civilians does not operate in circumstances in which, apart form positive law, civilians like everyone would be liable to attack. The rule operates against a moral background in which all deliberate killing is to be regarded as murder; some deliberate killings (of combatants) are privileged in warfare; but the rule about civilians reflects the fact that this is a strictly limited privilege and that those who target civilians do not get the benefit of it. Changing our view of the default position in this way enables us to better understand the distinctive work that this rule does. (shrink)

Since his death in 1986, Michel de Certeau's reputation as a thinker has steadily grown both in France and throughout the English-speaking world. His work is extraordinarily innovative and wide-ranging, cutting across issues in historiography, literary and cultural studies, anthropology, sociology, theology, philosophy and psychoanalysis. This book represents the first full-length study of Certeau's thought. It is organized around the central theme of interpretation and alterity, which Ahearne uses to illuminate Certeau's work as a whole. The author also examines Certeau's (...) theory and practice of historiography; his reflection on the relations between changing historical forms of writing, reading and orality; and his distinction between the "strategic" programmes of the politically powerful and the "tactics" of the relatively powerless. Ahearne places Certeau's work in its general intellectual context, relating it to the views of important contemporary thinkers, such as Pierre Bourdieu and Michel Foucault, and demonstrating the decisive importance to Certeau's thought of the writings of the early modern mystics and travellers. Author Jeremy Waldron has thoroughly revised thirteen of his most recent essays in order to offer a comprehensive critique of the idea of the judicial review of legislation. He argues that a belief in rights is not the same as a commitment to a Bill of Rights. This book presents legislation by a representative assembly as a form of law making which is especially apt for a society whose members disagree with one another about fundamental issues of principle.

The first five volumes of the Correspondence of Jeremy Bentham contain over 1,300 letters written both to and from Bentham over a 50-year period, beginning in 1752 (aged three) with his earliest surviving letter to his grandmother, and ending in 1797 with correspondence concerning his attempts to set up a national scheme for the provision of poor relief. Against the background of the debates on the American Revolution of 1776 and the French Revolution of 1789, to which he made significant (...) contributions, Bentham worked first on producing a complete penal code, which involved him in detailed explorations of fundamental legal ideas, and then on his panopticon prison scheme. Despite developing a host of original and ground-breaking ideas, contained in a mass of manuscripts, he published little during these years, and remained, at the close of this period, a relatively obscure individual. Nevertheless, these volumes reveal how the foundations were laid for the remarkable rise of Benthamite utilitarianism in the early nineteenth century. Bentham’s early life is marked by his extraordinary precociousness, but also family tragedy: by the age of 10 he had lost five infant siblings and his mother. The letters in this volume document his difficult relationship with his father and his increasing attachment to his surviving younger brother Samuel, his education, his interest in chemistry and botany, and his committing himself to a life of philosophy and legal reform. A critical edition of three of Bentham's works, Deontology and The Article on Utilitarianism previously unpublished. Together with his An Introduction to the Principles of Morals and Legislation, they provide a comprehensive picture of Bentham's psychological and ethical views. This edition, based entirely on manuscripts written by Bentham of by his amanuenses, is equipped with a full introduction linking the three works. Each work is accompanied by detailed critical and explanatory notes.

The writings collected in this volume make an important addition to The Collected Works of Jeremy Bentham. They lend credence to Bentham's claim that his ideas were appropriate `for the use of all nations and all governments professing liberal opinions'. The essays, dating mainly from late 1822 and early 1823, are based exclusively on manuscripts, many of which have not been previously published. -/- Turning his attention towards the Mediterranean basin, Bentham here attempts to legislate for one Islamic state, and (...) offers advice to another in the process of throwing off Islamic rule. The Writings for Tripoli include the famous `Securities against Misrule', in which Bentham draws up a constitutional charter with an accompanying explanation of its provisions. He also discusses the social, political, and religious institutions of the country, and proposes a scheme for the introduction of constitutional reform both there and in the other Barbary states. The Writings for Greece include a rare commentary on the first Greek constitution of 1822, and advice and warnings to the Greek legislators against the temptation of `sinister appetites'. The main theme in both groups of writings is the efficacy of representative institutions and the publicity of official actions in preventing the abuse of government power. (shrink)

This paper develops some ideas from previous work (coauthored, mostly with C.J.Isham). In that work, the main proposal is to assign as the value of a physical quantity in quantum theory (or classical physics), not a real number, but a certain kind of set (a sieve) of quantities that are functions of the given quantity. The motivation was in part physical---such a valuation illuminates the Kochen-Specker theorem; in part mathematical---the valuations arise naturally in the theory of presheaves; and in part (...) conceptual---the valuations arise from applying to propositions about the values of physical quantities some general axioms governing partial truth for any kind of proposition. In this paper, I give another conceptual motivation for the proposal. I develop (in Sections 2 and 3) the notion of a topos (of which presheaves give just one kind of example); and explain how this notion gives a satisfactory general framework for making sense of the idea of partial truth. Then I review (in Section 4) how our proposal applies this framework to the case of physical theories. (shrink)

Can the right to private property be claimed as one of the `rights of mankind'? This is the central question of this comprehensive and critical examination of the subject of private property. Jeremy Waldron contrasts two types of arguments about rights: those based on historical entitlement, and those based on the importance of property to freedom. He provides a detailed discussion of the theories of property found in Locke's Second Treatise and Hegel's Philosophy of Right to illustrate this contrast. The (...) book contains original analyses of the concept of ownership, the ideas of rights, and the relation between property and equality. The author's overriding determination throughout is to follow through the arguments and values used to justify private ownership. Literary pedagogy occupied a privileged place in Bourdieu's early work on education insofar as he saw it as exemplifying in unconscious mode socially segregational dynamics. Bourdieu's expressly ‘reductionist’ critique was uncannily mirrored, however, by the spread of more economically instrumental approaches to education. Bourdieu's engagement with these led him to develop a fuller apprehension of literature. Yet while the conceptual apparatus he developed can allow the genesis of a literary work in its socio-historical complexity to be grasped more fully, its (...) framing poses significant problems of its own. In particular, its ‘hypercontextualizing’ injunctions risk stifling ordinary reading practices and the practical pedagogy of canon-formation. Bourdieu's actual practice with literary materials is not bound by these injunctions. His transepochal ‘collaboration’ with Blaise Pascal, for example, takes place through the insinuation of decontextualised shards of thought into his own writing. The teachings of literature exceed in various ways their scientific framing. (shrink)

A rarely examined internal reading by Bourdieu at the end of The Rules of Art of William Faulkner's short story ‘A Rose for Emily’ provides the starting point for a reflection on Bourdieu's theories of reading and reflexivity. The article begins by looking at Bourdieu's theory of literary reception, and its identification of two distinct modalities of reading, ‘scholastic’ and ‘naive’. It then places Bourdieu's discussion of ‘A Rose for Emily’ as a ‘reflexive’ text in the context of his wider (...) theory of reflexivity. Bourdieu's approach to reading Faulkner's text is compared with those deployed elsewhere by more established literary critics, notably Jean-Paul Sartre and Roland Barthes. Finally, the question of how his internal reading fits within the logic of a theoretical work devoted to the ‘reflexive’ practice and method of field analysis is discussed. (shrink)

The present volume is one of a type we should soon expect to be seeing more of in philosophy of medicine. Philosophy of medicine has now been around long enough that entire careers, or at least substantial portions of careers, can and have been devoted to it. This is an important milestone in the field.This is true, even though, as the author indicates in the introduction, this is not solely a book of philosophy of medicine. Investigations in philosophy of medicine, (...) and the essays included in this volume in particular, can not only contribute to “the development of philosophy of medicine as a discipline” but can also “test and help revise some of [philosophy of science’s] views” . Political Tactics, composed for the Estates General just before the French Revolution, is one of Bentham's most original works. It contains the earliest and perhaps most important theoretical analysis of parliamentary procedure ever written. It was subsequently translated into many languages and has had a far-reaching influence -- as recently as the early 1990s it was reprinted by the Spanish Cortes.

Early to mid-nineteenth-century America experienced a cultural fascination with oneness or monism--the notion that individuals are not separate from divinity but, rather, that the individual soul is an incarnation of the universal soul. Everything is one. This buzz of monism was traceable in part to translations of the Vedas by Indian philosopher Rammohun Roy and found some of its fullest expression in the work of Ralph Waldo Emerson and Walt Whitman. This oneness tradition is what animates Jeremy David Engels--not only (...) because we can't understand Emerson, Whitman, and other American philosophers without it, but because Engels thinks this tradition offers a way of thinking and acting that can meet the ethical challenges of everyday democracy in the present.
