John Locke's treatises on government make frequent reference to the Hebrew Bible, while references to the New Testament are almost completely absent. To date, scholarship has not addressed this surprising characteristic of the treatises. In this book, Yechiel Leiter offers a Hebraic reading of Locke's fundamental political text. In doing so, he formulates a new school of thought in Lockean political interpretation and challenges existing ones. He shows how a grasp of the Hebraic underpinnings of Locke's political theory resolves (...) many of the problems, as well as scholarly debates, that are inherent in reading Locke. More than a book about the political theory of John Locke, this volume is about the foundational ideas of western civilization. Brian Leiter and Peter Kail have delivered thoughtful critiques of my book, Nietzsche’s Naturalism: Philosophy and the Life Sciences in the Nineteenth Century.1 It is a great pleasure to respond to these critiques, since they raise some crucial issues with regard to Nietzsche’s understanding of naturalism and normativity. The last decade has witnessed a particularly intensive debate over methodological issues in legal theory. The publication of Julie Dickson's Evaluation and Legal Theory (2001) was significant, as were collective returns to H.L.A. Hart's 'Postscript' to The Concept of Law. While influential articles have been written in disparate journals, no single collection of the most important papers exists. This volume - the first in a three volume series - aims not only to fill that gap but also propose a systematic (...) agenda for future work. In THE GENEALOGY OF MORALITY Nietzsche assess the value of the value judgments of morality from the perspective of human flourishing. His positive descriptions of the “higher men” he hopes for and the negative descriptions of the decadent humans he thinks morality unfortunately supports both point to a particular substantive conception of what such flourishing comes to. The Genealogy, however, presents us with a puzzle: why does Nietzsche’s own evaluative standard not receive a genealogical critique? The answer to this puzzle, (...) I argue, lies in recognizing the centrality of the notion of “life”, and its connection to power, in Nietzsche’s overall account. Leiter has argued that his “Millian Model” provides the most charitable reconstruction of appeals to a privileged evaluative standard of power; this model ascribes an inference from a strong doctrine of the will to power according to which only power can be desired. I propose a “Benthamite Model” that ascribes an inference from the inescapability of a tendency towards power, a tendency that is essential to life. I argue that this model avoids the objections Leiter directs at the Millian Model. (shrink)

Since Leibniz's time, Cartesian mental causation has been criticized for violating the conservation of energy and momentum. Many dualist responses clearly fail. But conservation laws have important neglected features generally undermining the objection. Conservation is _local_, holding first not for the universe, but for everywhere separately. The energy in any volume changes only due to what flows through the boundaries. Constant total energy holds if the global summing-up of local conservation laws converges; it probably doesn't in reality. Energy conservation holds (...) if there is symmetry, the sameness of the laws over time. Thus, if there are time-places where symmetries fail due to nonphysical influence, conservation laws fail there and then, while holding elsewhere, such as refrigerators and stars. Noether's converse first theorem shows that conservation laws imply symmetries. Thus conservation trivially nearly entails the causal closure of the physical. But expecting conservation to hold in the brain simply assumes the falsehood of Cartesianism. Hence Leibniz's objection begs the question. Empirical neuroscience is another matter. So is Einstein's General Relativity: far from providing a loophole, General Relativity makes mental causation _harder_. (shrink)

The question of the cognitive role of fictionality is this: what is the correct cognitive attitude to take to p, when it is fictional that p? We began by considering one answer to this question, implicit in the work of Kendall Walton, that the correct response to a fictional proposition is to imagine that proposition. However, this approach is silent in cases of fictional incompleteness, where neither p nor its negation are fictional. We argue that that Waltonians should embrace a (...) pluralistic account of the cognitive role of fictional incompleteness: in some cases of fictional incompleteness, we are permitted to resolve the incompleteness during our engagement with the target fiction, and in other cases, we are obliged not to resolve the incompleteness. But though pluralism is accommodated by Walton’s wider account of fictionality, it puts tension on his motivating idea that fictionality stands to the imagination as truth stands to belief. And so we develop a rival conception of the cognitive role of fictionality that is built around a different analogy: on this evidentialist approach, (known) fictionality stands to the imagination as evidence stands to credence. Buku pertamanya berjudul Nietzsche on Truth and Philosophy juga diterbitkan oleh Oxford University Press pada tahun 1990. Sejak saat itu, Clark sering menuliskan kajian-kajiannya mengenai Nietzsche pada berbagai antologi buku maupun jurnal, termasuk Journal of Nietzsche Studies (New York: Penn State University Press). Salah satu kekhasan pendekatan Clark adalah pendekatan kombinasinya yang bercorak analitis. Meski demikian, tafsiran ter sebut bukanlah hal yang baru di kalangan akademisi Nietzschean yang berkembang pesat dalam satu dekade terakhir ini. Misalnya, tafsir yang memprioritaskan nilai-nilai aristokratis ketimbang institusi/tatanan politik aristokratis sekurang-kurangnya telah muncul sejak tahun 1990-an seperti yang dipaparkan oleh Ted Sadler dalam buku Nietzsche: Truth and Redemption (London: Athlone Press, 1995). Dalam buku tersebut, Sadler mengistilahkannya dengan roh aristokratis yang dibedakan dengan dua jenis roh lainnya: roh kelas jelata dan roh kelas menengah. Selain itu, format NPE sebagai kumpulan esai-esai Clark lebih menekankan kekayaan sudut pandang ataupun kritik atas tafsiran umum mengenai etika dan politik Nietzschean ketimbang kedalaman argumentasi akan suatu isu tertentu. Measurement realism, the view that measurement targets quantitative attributes and that not all attributes are quantitative, has come under attack both from metrologists and philosophers. In this paper, I take a close look at two influential arguments against measurement realism: the argument from obsolescence and the argument from coordination. I concede that these arguments do challenge the epistemological position traditionally taken by measurement realists, but argue that the metaphysical core of measurement realism survives the challenge posed by these arguments. Humans have now amassed a sizable knowledge of widespread, nonconscious cognitive biases which affect our behavior, especially in social and economic contexts. I contend that a democratic government is uniquely justified in using knowledge of cognitive biases to promote pro-democratic behavior, conditionally justified in using it to accomplish ends traditionally within the scope of government authority, and unjustified in using it for any other purpose. I also contend that the government ought to redesign institutional infrastructure to avoid triggering cognitive biases (...) where it is not permitted intentionally to manipulate such biases and to optimize the effects of such biases where permissible. I shall use the United States of America as an example throughout, but my conclusions apply equally to any democracy which values the political autonomy of its populace. (shrink)
