Spontaneous orders are an essential concept in political theory and political economy. Such orders entail the impossibility of predicting outcomes in detail and hence controlling and directing social processes. Many phenomena characterizing contemporary societies can be depicted as spontaneous orders, from the housing and financial markets to the evolution of norms and trends. Yet, it is well known that not every spontaneous order is beneficial. Therefore, what form of political framework is compatible with recognizing such orders? In this article, I (...) address this problem through the example of the work of Friedrich Hayek, a prominent liberal theorist of spontaneous orders. His work shows the necessity to theorize a government of spontaneous orders based on maximizing reasonable expectations and individual freedom. I finally emphasize what such a theory implies for political power, which is not abolished but should handle complexity appropriately. (shrink)

The 1930s and 1940s marked a period of crisis for liberalism. Authors as diverse as Friedrich Hayek, Wilhelm Röpke, Walter Lippmann, Michael Polanyi and Louis Rougier came together at two seminal events, the Walter Lippmann Colloquium in 1938 and the creation of the Mont-Pèlerin Society in 1947, to rethink liberalism. This rethinking of the liberal project prompted them to carry out a diagnosis of the crisis of liberalism, which, for the authors mentioned, dated back to the French Revolution. This (...) article seeks to demonstrate the coherence of the neoliberal project from their historical diagnosis in this period of crisis. Indeed, by criticising the French Revolution and its effects as part of a harmful rationalism, which gave rise to both a laissez-faire approach and various collectivisms, neoliberals explicitly took up concepts from critics of the revolution, especially Edmund Burke. The concept of tradition, understood as covering social and legal rules that have slowly evolved to constitute coordination mechanisms that allow our actions, is thus very widely taken up and valued by neoliberals. We, therefore, interpret neoliberal theory on the basis of this recategorisation of the concept of tradition, and point out the affinities between neoliberal positions and philosophical conservatism. This alignment reveals several conceptual tensions between cultural evolutionism on the one hand and the defence of significant Western values on the other. (shrink)

This is the third volume to appear in an edition that will be the first complete, critical, and annotated English translation of all of Nietzsche's work. The edition is a new English translation, by various hands, of the celebrated Colli-Montinari edition. The present volume provides for the first time English translations of all of Nietzsche's unpublished notebooks from summer 1872 to the end of 1874. The major works published in this period were the first three Unfashionable Observations: 'David Strauss the (...) Confessor and the Writer,' 'On the Utility and Liability of History for Life,' and 'Schopenhauer as educator.' Translations of the preliminary notes for these pieces are coordinated with the translations of the published texts printed in Volume 2: Unfashionable Observations. These notebooks represent important transitional documents in Nietzsche's intellectual development, marking, among other things, the shift away from philological studies toward unabashed cultural criticism. Praxis investigates both the existing practices of international politics and relations during and after the Cold War, and the issue of whether problems of praxis can be subjected to a 'theoretical treatment'. The book comes in two parts: the first deals with the constitution of international relations and the role of theoretical norms in guiding decisions, in areas such as sanctions, the punishment of international crimes, governance and 'constitutional' concern, the second is devoted to 'theory building'. While a 'theorization' of (...) praxis has often been attempted, Kratochwil argues that such endeavours do not attend to certain important elements characteristic of practical choices. Praxis presents a shift from the accepted international relations standard of theorizing, by arguing for the analysis of policy decisions made in non-ideal conditions within a broader framework of practical choices, emphasizing both historicity and contingency. Das Narrativ der Verzauberung schildert, wie uns Artefakte und technologische Möglichkeiten unheimlich werden, insbesondere wenn sie sich zu verselbständigen scheinen oder mit „autonomem“ Eigensinn gegenübertreten. In den heutigen Debatten um selbstlernende, ubiquitär verteilte, im Assistenzmodus unsichtbare, dabei opake (...) Techniken schwingt das unheimliche Moment einer „Verselbständigung“ von Technik mit – und trägt im Anschluss an die Mechanisierungs- und Automatisierungsdiskurse des 20. Jahrhunderts zur „Dämonisierung“ der Technik bei. Technik macht Welt einerseits vertraut und nachvollziehbar: Paradigmatisch wird dies in der Idee, dass etwas dann verstanden wird, wenn es technisch rekonstruiert werden kann. Andererseits wird die technische Reproduktion von Welt – oder deren radikale Umgestaltung zu einer entfremdeten – als etwas Verstörendes erlebt. The mechanisms invoked to demonstrate how self-deception can occur without intention or awareness imply that self-deceptive beliefs are nevertheless the outcome of inappropriate and often egoistically driven processes. In contrast, models of pragmatic reasoning suggest that self-deception may well be the “reasonable” output of a more generalized, adaptive approach to hypothesis testing.

Background Sharing anonymized/de-identified clinical trial data and publishing research outcomes in scientific journals, or presenting them at conferences, is key to data-driven scientific exchange. However, when data from scientific publications are linked to other publicly available personal information, the risk of reidentification of trial participants increases, raising privacy concerns. Therefore, we defined a set of criteria allowing us to determine and minimize the risk of data reidentification. We also implemented a review process at Takeda for clinical publications prior to submission (...) for publication in journals or presentation at medical conferences. Methods Abstracts, manuscripts, posters, and oral presentations containing study participant information were reviewed and the potential impact on study participant privacy was assessed. Our focus was on direct and indirect identifiers, such as sex, age or geographical indicators in rare disease studies or studies with small sample size treatment groups. Risk minimization was sought using a generalized presentation of identifier-relevant information and decision-making on data sharing for further research. Additional risk identification was performed based on study participant/personnel parameters present in materials destined for the public domain. The potential for participant/personnel identification was then calculated to facilitate presentation of meaningful but de-identified information. Results The potential for reidentification was calculated using a risk ratio of the exposed versus available individuals, with a value above the threshold of 0.09 deemed an unacceptable level of reidentification risk. We found that in 13% of Takeda clinical trial publications reviewed, either individuals could potentially be reidentified or inappropriate data sharing plans could pose a data privacy risk to study participants. In 1/110 abstracts, 58/275 manuscripts, 5/87 posters and 3/58 presentations, changes were necessary due to data privacy concerns/rules. Despite the implementation of risk-minimization measures prior to release, direct and indirect identifiers were found in 11% and 34% of the analysed documents, respectively. Conclusions Risk minimization using de-identification of clinical trial data presented in scientific publications and controlled data sharing conditions improved privacy protection for study participants. Our results also suggest that additional safeguards should be implemented to ensure that higher data privacy standards are met. (shrink)

This essay redefines the crisis of historicism as a collapse of trust. Following Friedrich Jaeger, it suggests that this crisis should be understood, not as a crisis caused by historicist methods, but as a crisis faced by the classical historicist tradition of Ranke. The "nihilism" and "moral relativism" feared by Troeltsch's generation did not primarily refer to the view that moral universals did not exist; rather, they expressed that the historical justification of bildungsbürgerliche values offered by classical historicism (...) did no longer work. In Niklas Luhmann's vocabulary, this is to say that moral values could no longer be trusted on historical grounds. But when the "reduction of complexity" offered by classical historicism collapsed, Troeltsch's generation faced a justification problem: what other modes of justification, if any at all, were available in a time of increasing secularization and growing feelings of discontinuity with the past? In identifying the crisis of historicism with this moral justification problem, this essay helps explain why such debts of despair could be reached in the early-twentieth-century disputes over historicism. In many ways, grief is thought to be outside the realm of bioethics and clinical ethics, and grieving patients or family members may be passed off to grief counselors or therapists. Yet grief can play a particularly poignant role in the ethical encounter, especially in cases of brain death, where the line between life and death has been blurred. Although brain death is legally and medically recognized as death in the United States and elsewhere, the concept has been contentious since (...) its inception in 1968. Yet in most cases, families are not allowed to reject the determination of brain death. Apart from religious exemptions, families have no recourse to reject this controversial determination of death. This paper explores the role of grief in brain death determinations and argues that bioethics has failed to address the complexity of grief in determinations of brain death. Grief ought to have epistemological weight in brain death determinations because of the contested nature of the diagnosis and the unique ways in which grief informs the situation. Thus, I argue that, in some rare cases, reasonable accommodation policies should be expanded to allow for refusals of brain death determinations based on the emotional and moral force of grief. By drawing on ethnographic accounts of grief in other cultures, I problematize the current procedural and linear understandings of grief in brain death determinations, and I conclude by offering a new way in which to understand the case of Jahi McMath.
