James Harrington (1611-77) was a pioneer in applying the methods of Machiavelli and other civic humanists to English political society and its landed structure. In the century after his death, his ideas were adapted to become an important ingredient in the vocabulary of both English and American political opposition to the methods of Hanoverian parliamentary monarchy. There has been no complete edition of Harrington's writings since 1771, or of Oceana, his best-known work, since 1924. This is a (...) modernised edition, and includes all of his prose works on political subjects. The critical introduction attempts to revalue the evidence concerning Harrington's life and writings, to locate them in the context of Civil War, Commonwealth and Puritan thinking and to trace the development of Harringtonian and neo-Harringtonian ideology during subsequent generations. This paper argues that the Einstein-Minkowski space-time of special relativity provides an adequate model for classical tense logic, including rigorous definitions of tensed becoming and of the logical priority of proper time. In addition, the extension of classical tense logic with an operator for predicate-term negation provides us with a framework for interpreting and defending the significance of future contingency in special relativity. The framework for future contingents developed here involves the dual falsehood of non-logical contraries, only one of which (...) becomes true. This has several methodological, metaphysical and physical advantages over the alternative traditional frameworks for handling future contingents. (shrink)

Aristotle begins his famous discussion of time in Book Δ of The Physics by asking whether time belongs to “the things that exist.” In this paper I argue that Aristotle’s apparently ambiguous answer to this question holds one of the keys to clarifying contemporary philosophy of time . First, I argue that the metaphysical and meta-philosophical presuppositions underlying most philosophy of time are deeply flawed. Second, that Aristotle provides us with a much more plausible alternative set of presuppositions about the (...) nature of time . The Aristotelian conception of time as part of the subject matter of physics or “the philosophy of nature” is particularly illuminating. Finally, I examine several issues about the nature and reality of time often raised in the context of contemporary physics and show how the Aristotelian perspective can resolve those puzzles. Pp. x + 252. $24.95, hardcover.Thomas Rickert had a falling-out with his brother, and this distresses him so much that his disrupted relation is described as “traumatic.” Rickert reports that while listening (...) to a portable CD player during a run on an unexpectedly warm winter day, a song by the now defunct jazz/rock band Morphine reminded him of a happy time at a pool hall with his brother (24). Mediated—or better, medicated—by music, the homological happiness of running in the sun and a positive past memory also resurfaced a painful relational rupture, the reason of which Rickert omits to underscore that mysterious, “little detail or object” of the Real that marks his singular finitude as a writing subject (216 n. 11). We’ll want to come back to this curiously deliberate omission, but for the present we note Rickert is not simply an undead author but a human being with relations and feelings. He is not just a gifted scholar or a bundle of reflections, but a nexus of body and movement and words and affect. If there is anything that Rickert’s study can be said to work through with brilliance, humor, and grace, it is the reality of complex personhood.Rickert’s brotherly confession comes in Chapter 1 as a way to introduce a psychoanalytic understanding of subjectivity, and more specifically, to help illustrate how trauma works itself out as an afterwardness or “belatedness” ( Nachträglichkeit ): traumatic events from the past are not reckoned with or worked-through until some coincidence or reminder, such as a similar [End Page 183] sensory experience, reintroduces the event in doubled re-presentation (18–27). This implies the “subject” (a paradigm person) is a kind of timedelay, a self-conscious temporal moving that becomes this way through re-presentation. The rhetorical subject is analogously a retrojected reckoning with events past (not all traumatic) that Rickert identifies as a scene of writing, a locus that has important implications for rhetorical studies in general and writing pedagogy in particular. Rickert’s logic is as follows: if we agree that the subject is a belated one in the psychoanalytic sense, then how we teach rhetoric needs to change. Rickert opens the book with the observation that his students are producing excellent cultural critiques but that such critiques do not lead the students to change their actions (1–7), perhaps evidence enough that something is not quite right in a classroom grounded by “cultural studies pedagogy” and ideology critique—or at the very least, proof that something has changed. The opening gambit is simply that a “postpedagogy” premised on an understanding of rhetorical subjectivity as belatedness is better than a status quo rooted in the rational subject of the Enlightenment.Mostly through a Žižek-filtered, Lacanian lens, Acts of Enjoyment then undertakes a retake of the rhetorical field, frequently scanning from the traumatic ontology of the rhetorical subject to that domain of knowledge that we hold dear, the subject of rhetoric. In Chapter 2, the (primal) scene thus shifts from the slo-mo subject to rhetorical studies, initially through a reassessment of Kinneavy’s “communications triangle,” but ultimately in response to the shock treatment of poststructuralism. The initial theoretical traumas introduced by Victor Vitanza, Diane Davis, Sharon Crowley, and others discussed in Chapter 1 are threaded into an account of “poststructural” redress in Chapter 2: as is true of all forms of trauma, the initial poststructural jolt delivered to the concept of subjectivity was deadened; poststructural theory was eventually used to “shore up rather than challenge Kinneavy’s triangle” (37). To truly work-through our traumatized subject in both senses, we need a second trauma: Lacanian psychoanalysis. Presumably, “poststructuralist thought” is to be opposed because it has no account of the subject (21–24); “Lacan,” after all, “is not a poststructuralist” (48). This paper will argue that the puzzles about instantaneous velocity, and rates of change more generally, are the result of a failure to recognize an ambiguity in the concept of an instant, and therefore of an instantaneous state. We will conclude that there are two distinct conceptions of a temporal instant: (i) instants conceived as fundamentally distinct zero-duration temporal atoms and (ii) instants conceived as the boundary of, or between,temporally extended durations. Since the concept of classical instantaneous velocity is well- (...) defined only on the second conception of instants, we will conclude that this distinction allows us to avoid the above dilemma. If instantaneous velocity is well-defined then the states of a system at various instants are not logically distinct and thus we cannot generate Zeno’s paradox. However, if we assume that the instants are metaphysically distinct, then instantaneous velocity is not well-defined and thus the second horn of the dilemma about the causal-explanatory role of instantaneous velocity cannot be generated. There are two competing approaches to sustainability in agriculture. One stresses a strict economic approach in which market forces should guide the activities of agricultural producers. The other advocates the need to balance economic with environmental and social objectives, even to the point of reducing profitability. The writings of the eighteenth century moral philosopher Adam Smith could bridge the debate. Smith certainly promoted profit-seeking, private property, and free market exchange consistent with the strict economic perspective. However, his writings are also (...) consistent with many aspects of sustainable agriculture. For example, Smith argued that people ought to exercise restraint in their pursuit of self-interest, and he believed in balancing economic with environmental and social considerations. If both sides of the debate more fully regard the work of Adam Smith, then proponents of the strict economic perspective might be more appreciative of the concerns raised within the sustainable agriculture community, while advocates of sustainability might be more effective in achieving the objective of a sustainable agriculture. In this paper, I defend a theory of local temporality, sometimes referred to as a point-present theory. This theory has the great advantage that it allows for the possibility of an open future without requiring any alterations to our standard understanding of special relativity. Such theories, however, have regularly been rejected out of hand as metaphysically incoherent. After surveying the debate, I argue that such a transformation of temporal concepts (i) is suggested by the indexical semantics of tense in a (...) relativistic universe, (ii) when properly understood easily withstands the usual accusations of metaphysical incoherence and (iii) leads naturally to a meta-philosophical position from which we can understand and escape the increasing sterility of debates between radical Parmenideans and radical Heracliteans in the philosophy of time. On first blush the Jim Crow Era may seem an odd place to locate anything meaningful about democratic, equal citizenship and the promise of the fourteenth amendment. This article argues to the contrary. The period of Jim Crow, in its negation of democratic citizenship, in fact reveals import aspects about the nature of democratic citizenship. This occurred in two ways. First, whites who implemented white supremacy implicitly understood that freedom and citizenship manifest themselves in a multiplicity of spheres, which is (...) why white supremacists sought to subordinate blacks not just politically but across all social spheres. Second, the resistance to comprehensive subordination revealed the multiplicity of the spirit of freedom and equality in actions and arguments African Americans. African Americans created spaces of democratic citizenship within the dominant culture of subordination. This article suggests that, in studying both the implementation of white supremacy and the resistance to it, we can learn more about how equal and democratic citizenship can be affirmed and implemented rather than negated, and also about the role of law as a tool for both subordination and resistance. This essay introduces a formal structure to model the indeterminacy of the future in Einstein-Minkowski space-time. We consider a first-order language, supplemented with an operator for predicate-term negation, and defend the claim that such an operation provides an appropriate model for the indeterminacy of future contingents. In the final section, it is proved that given a language otherwise adequate to represent a physical theory, at least some of the predicates of that language are indeterminate when the future is not causally (...) determined by the present and the past. The symposium »Does the Concept of ›Truth‹ Have Value in the Pursuit of Cross-Cultural Philosophy?« hones on a methodological question which has deep implications on doing philosophy cross-culturally. Drawing on early Confucian writers, the anchor, Henry Rosemont, Jr., attempts to explain why he is skeptical of pat, affirmative answers to this question. His co-symposiasts James Maffie, John Maraldo, and Sonam Thakchoe follow his trail in working out multi-faceted views on truth from Mexican, Japanese Confucian, and Tibetan Buddhist perspectives respectively. (...) As these positions substantiate, the aforementioned non-Anglo-European traditions seem to draw on an integrated view of thinking, feeling, and living a human life. For their practitioners, truth is less of a correspondence with a given external reality. In fact, it enables human beings to strike the right path in living good, social lives. (shrink)

It is largely taken from my law review article entitled "'We Shall Not Be Moved': Eminent Domain, Urban Redevelopment and the Socioeconomics of Just Compensation" published by St. John's Law Review. That article can be downloaded from SSRN at http://papers.ssrn.com/sol3/papers.cfm?abstract_id=904224 This shorter piece focuses on the two proposals outlined in the second part of the law review article that (...) are designed to curb abuses of eminent domain in the urban redevelopment context without destroying its effectiveness as a tool for community revitalization and, even, community empowerment. Specifically, homeowners should not be subject to eminent domain pursuant to a redevelopment plan until the majority of them have approved the plan. To further solidify resident ownership of redevelopment, the right to continued residency in the community should be protected by amending relocation laws to guarantee an alienable entitlement to be offered replacement housing in the redeveloped district area. Together, these two legislative reforms express a more nuanced balance of property and liability rules that will facilitate a more productive interface between community residents and redevelopment officials.
