Animals, Equality and Democracy examines the structure of animal protection legislation and finds that it is deeply inequitable, with a tendency to favor those animals the community is most likely to see and engage with. Siobhan O'Sullivan argues that these inequities violate fundamental principle of justice and transparency.

In a series of philosophical discussions and artistic case studies, this volume develops a materialist and immanent approach to modern and contemporary art. The argument is made for a return to aesthetics--an aesthetics of affect--and for the theorization of art as an expanded and complex practice. Three philosophical accounts of risk dominate the contemporary literature. On the probabilistic account, risk has to do with the probability of a disvaluable event obtaining; on the modal account, it has to do with the modal closeness of that event obtaining; on the normic account, it has to do with the normalcy of that event obtaining. The debate between these accounts has proceeded via counterexample-trading, with each account having some cases it explains better than others, and some cases that it (...) cannot explain at all. In this article, we attempt to break the impasse between the three accounts of risk through a shift in methodology. We investigate the concept of risk via the method of conceptual reverse-engineering, whereby a theorist reconstructs the need that a concept serves for a group of agents in order to illuminate the shape of the concept: its intension and extension. We suggest that risk functions to meet our need to make decisions that reduce disvalue under conditions of uncertainty. Our project makes plausible that risk is a pluralist concept: meeting this need requires that risk takes different forms in different contexts. But our pluralism is principled: each of these different forms are part of one and the same concept, that has a ‘core-to-periphery’ structure, where the form the concept takes in typical cases (at its ‘core’) explains the form it takes in less typical cases (at its ‘periphery’). We then apply our findings to epistemic risk, to resolve an ambiguity in how ‘epistemic risk’ is standardly understood. (shrink)

SummaryThe term ‘category mistake’ began to turn up regularly in public discourse in the 1990s as a general term to describe a confusion between different fields of thought with serious practical consequences. But it began its career in philosophy, introduced by Gilbert Ryle in The Concept of Mind in 1949 to attack Cartesian dualism and assert a monistic solution to the so-called mind-body problem. This paper traces the stages by which it came into general usage, arguing that while by the (...) later 1960s it had generally been rejected by philosophers, it was saved from disappearance by its migration into fields such as psychology and theology. From there, it moved into critical theory and then into international relations. Its entry into these latter areas first made plain its potential in political argument. Eventually, multiple meanings of the term came to coexist with one another, with the practical and rhetorical usage supplementing rather than replacing its original philosophical sense. (shrink)

Our manuscripts of Cicero contain dozens of Greek words that are presented in some passages in Greek letters, and in others are transliterated into Latin. In a recent paper I collected the evidence for this phenomenon in connection with common nouns and adjectives, surveyed scholarship to date and posited an interpretative framework which is assumed in this study also. Key components of this framework are the use of mixed alphabets in surviving ancient documents and an awareness of the frequency with (...) which modern editors change the alphabets in the manuscripts when dealing with Greek words—hence the importance of using the apparatus critici, not just the printed text, of our editions. The earlier paper was also strict in its exclusion of words in continuous passages, and even short phrases, of Greek, since that context excludes the option of transliteration for the author. The major contention of that earlier study was that a coherent pattern of use in the manuscripts can only really be a reflection of Cicero's own considered choice of alphabets: consistently inexplicable choice may indicate that Cicero himself was indifferent to which alphabet he used for single Greek words, or that our copyists paid no attention to this aspect of their exemplars, or both. The 301 letters in this volume, many of which are previously unpublished, contain correspondence with international leaders such as Simón Bolívar, the 'Liberator', and Bernardino Rivadavia of Buenos Aires, British statesmen such as Robert Peel and Henry Brougham, and leading intellectuals such as John Stuart Mill and Sarah Austin.

This study is an attempt to distinguish the problem of political obligation as it was formulated in the ancient world from the problem as it has presented itself in the modern world, and assesses the idealist achievement in the philosophical treatment of the problem of political obligation. This title will be of interest to students of philosophy and politics.

The difficulty of this little poem is shown by the facts that Ausonius had no idea what it was about, and that Westendorp Boerma's commentary takes 22 pages to explicate its five lines. The latter relies on Quintilian 8.3.27ff., who quotes the poem, saying that Vergil wrote it to attack a certain Cimber for his taste in obsolete words. This is no doubt the Annius Cimber whom Augustus ridiculed when reprimanding Mark Antony for a similar foible and who, as an (...) antiquarius is contrasted with the Asiatici oratores. For convenience, I have kept Westendorp Boerma's text, but I take issue with his interpretation on two points. 4 tau Gallicum: since Bücheler tentatively suggested it in RhM 38 , 508, the standard explanation of this has been to point out that a number of Latin inscriptions in Gaul use a Greek θ or else a barred D , to represent what appears to have been a dental fricative elsewhere indicated in Latin by -sd- or -st-. Thus Frank, AJP 56 , 255, quotes HYÐRITANVS for what is elsewhere spelled Thysdritanus, and says that ‘Ð clearly represents the best that one Celt could do with sd’. On the basis of this supposed Gallic incompetence, Frank went on to see the repeated -st- sounds in the poem as some sort of joke on the orator's inability to pronounce this sound. His view seems to have been generally accepted. There seems to me a profound error in this viewpoint which shows cultural imperialism at its worst. First, let us note that none of the examples of alleged substitution are in Latin words; they are native names for people or places or things. The Latin names by which we know some of them are only the approximation of foreigners, and not in any sense the ‘correct’ names of those people or places. (shrink)

It is widely thought that functionalism and the qualia theory are better positioned to accommodate the ‘affective’ aspect of pain phenomenology than representationalism. In this paper, we attempt to overturn this opinion by raising problems for both functionalism and the qualia theory on this score. With regard to functionalism, we argue that it gets the order of explanation wrong: pain experience gives rise to the effects it does because it hurts, and not the other way around. With regard to the (...) qualia theory, we argue that it fails to capture the sense in which pain 's affective phenomenology rationalises various bodily-directed beliefs, desires, and behaviours. Representationalism, in contrast, escapes both of these problems: it gets the order of explanation right and it explains how pain 's affective phenomenology can rationalise bodily-directed beliefs, desires, and behaviours. For this reason, we argue that representationalism has a significant advantage in the debates about pain 's affective phenomenology. We end the paper by examining objections, including the question of what representationalists should say about so-called ‘disassociation cases’, such as pain asymbolia. (shrink)

This twelfth volume of Correspondence contains authoritative and fully annotated texts of all known letters sent both to and from Bentham between July 1824 and June 1828. The 301 letters, most of which have never before been published, have been collected from archives, public and private, in Britain, the United States of America, Switzerland, France, Japan, and elsewhere, as well as from the major collections of Bentham Papers at University College London Library and the British Library.In mid-1824 Bentham was still (...) preoccupied with the Greek struggle for independence against Turkey, though his active involvement waned as he became disenchanted with the behaviour of the deputies sent to London by the Greek National Assembly. His international reputation was reflected in his continuing contact with Simón Bolívar and Bernardino Rivadavia in South America, and with John Quincy Adams, John Neal, Henry Wheaton, and others in the United States, and his forging of new contacts in Guatemala, India, and Egypt. In the autumn of 1825 he visited France, where he stayed with Jean Baptiste Say and La Fayette, and was fêted by the French liberals.Bentham made considerable progress drafting material for his pannomion, or complete code of laws, and in particular for his Constitutional and Procedure Codes, while John Stuart Mill edited the massive Rationale of Judicial Evidence. Bentham became increasingly active in the cause of law reform, and exchanged a series of letters on the subject with Robert Peel, the Home Secretary, and Henry Brougham. He maintained his friendships with John and Sarah Austin, George and Harriet Grote, James and John Stuart Mill, John Bowring, Joseph Hume, Francis Burdett, Francis Place, and Joseph Parkes, re-established contact with the third Marquis of Lansdowne, son of his old friend the first Marquis, and made new acquaintances in James Humphreys, Sutton Sharpe, and Albany Fonblanque. Prior studies in business ethics highlight the role of philanthropy in shaping stakeholders’ perceptions of a firm’s underlying moral tendencies and values. Scholars argue that philanthropy-based character inferences influence whether and how stakeholders engage with firms. We extend this line of reasoning to examine the impact of philanthropy on firms’ contracting costs in the capital market. We posit that philanthropy-based character inferences reduce investors’ agency concerns, thereby reducing firms’ cost of capital. We also posit that the strength of the philanthropy–cost (...) of capital relationship is contingent on uncertainty regarding a firm’s character, visibility of a firm, and prevailing philanthropic norms. We test and find support for our arguments in a longitudinal study of philanthropy and the cost of capital. Our findings have implications for business ethics research on corporate philanthropy and corporate social performance and for organizational research on social judgment. (shrink)

Many have felt to be anachronistic the casting of proskynesis in the court of Alexander the Great as a matter of worship of the king. Taking this premise as its starting point, this article explores the possible origins of this presentation of Alexander's proskynesis, an understanding that is articulated most fully in the ' proskynesis debates' of Arrian and Curtius. It is argued that the misrepresentation was a deliberate strategy cultivated in the Peripatos, and that it was designed to deflect (...) opprobrium away from Callisthenes and, by extension, away from the Peripatos itself. The question of how realism and metanarratives are related in the philosophy of history does not seem to have been widely discussed. Whereas there are distinct philosophical and political senses of ‘realism’, contrasting with ‘idealism’ and ‘utopianism’ respectively, ‘metanarrative’ has a singular meaning based on Jean-François Lyotard’s sceptical definition of postmodernism as “incredulity towards metanarratives”. Lyotard defined metanarratives as philosophies of history that serve some legitimatory function, but claimed that their importance was waning. From this point of view, postmodernism can (...) be described as a species of philosophical ‘realism’. But the appearance of Francis Fukuyama’s ‘end of history’ thesis, which explicitly presented itself as a neo-Hegelian critique of political realism, suggested that Lyotard had underestimated the enduring power of metanarrative insofar as it served the interests of the American liberal-democratic capitalist order. For Jacques Derrida, Fukuyama’s work thus underlined the importance of breaking with what he called ‘onto-theological’ visions of history, although Derrida himself could be seen as authoring a metanarrative in the service of European social democracy. But if so, Derrida’s approach to metanarratives was very different in kind to contemporary religious and nationalistic versions. One way to resolve the difficulty is to make a distinction between modern ‘utopian’ and postmodern ‘realist’ versions of metanarratives. (shrink)

Discussions of whistleblowing whether in academic literature or in more popular media have tended to very one-sided assessments of the moral worth of the act. Indeed, much of the current literature concentrates on psychological or managerial aspects of whistleblowing while taking for granted this or that moral position or eschewing any normative commitment on the question. The purpose of this article is firstly to reemphasise the importance and complexity of the normative foundations of whistleblowing acts; and secondly, through a moral (...) philosophical analysis of the component decisions that make up any act of whistleblowing, to contribute to a more balanced and less polarised treatment of the topic. It is argued that the polarisation of views on the topic is in part due to a failure to decompose the act of whistleblowing into a number of inevitable component moral decisions leading up to the act. It is furthermore argued on the basis of the analysis that it is impossible to state a priori as a matter of general principle that whistleblowing is always morally right or morally wrong . The article will close with a reflection on the degree to which the weighing up of good and bad in the act of whistleblowing differs sharply among cultures; and with a conjecture as to a possible relation to a people's history which may serve as a pointer to interesting future empirical research on the topic. The concept of the public realm is the most fundamental of all political concepts because it is only the shared relationship it constitutes between rulers and ruled that makes government more than mere domination. It is therefore not surprising that the question of how the public realm is to be defined has been a central concern of political thinkers from Plato to more recent philosophers like Hannah Arendt. Although the answers they have given have of course varied greatly, what is (...) relevant in the present context is simply the assumption, for well over two thousand years, that there could be an answer. What is novel today, by contrast, is the increasing realization that political theory cannot in principle provide philosophical guidance of any kind about how the public realm can be finally and definitively identified, in a way which would clearly distinguish it from the private realm and thereby enable an incontestable limit to be set to the proper scope of politics and of state action. The present essay considers how some leading contemporary political thinkers have responded to this situation. (shrink)

Maurice O'Sullivan was born on the Great Blasket in 1904, and Twenty Years A-Growing tells the story of his youth and of a way of life which belonged to the Middle Ages. He wrote for his own pleasure and for the entertainment of his friends, without any thought of a wider public; his style is derived from folk-tales which he heard from his grandfather and sharpened by his own lively imagination.

Prior studies suggest that firms headquartered in areas with strong religious social norms have higher ethical standards. In this study, we examine whether the ethical standards associated with local religious norms influence the M&A announcement returns. We document that the M&A announcement returns of acquirer firms increase with the strength of religious social norms in the area surrounding firms’ headquarters. We also document that the relationship is attenuated when acquirer firms have strong corporate social responsibility credentials, is amplified when public (...) trust that firms act in the best interest of stakeholders suffers a negative shock and when the M&A deal has greater economic significance for the acquirer, and manifests predominantly in the lower tail of the distribution of M&A returns. Our findings are consistent with investor assessments of firms’ ethical standards driving the relationship between local religious social norms and M&A announcement returns. We find no evidence for the competing explanation—that investor assessments of firms’ risk preferences drive the documented relationship. (shrink)

In this study, we explore the relationship between perceived CEO greed and workplace safety. Drawing on insights from the social psychology literature, we theorize that CEOs are cognizant that their perceived greed has implications for how observers respond to failures in workplace safety. Our theorizing points to a somewhat counterintuitive positive relationship between perceived CEO greed and workplace safety. Consistent with our theorizing, we find that the relationship is attenuated when the CEO is insulated from how observers respond to firm (...) conduct and is amplified when the CEO’s characteristics have a larger impact on how observers respond to adverse firm-level events. We contribute to business ethics research on executive greed, on the relationship between CEO traits and (ir)responsible corporate conduct, and on the antecedents of workplace safety. (shrink)
