Suppose the prevailing distribution of property rights is unjust as determined by the relevant conception of distributive justice. You have far more than you should have under that theory and I have far less. Then I defraud you and in doing so reallocate resources so that our holdings ex post more closely approximate what distributive justice requires. Do I have a duty to return the property to you? There are many good reasons for requiring me to return to you what (...) I have taken. One is that while you may have no right in justice to all that you own, it does not follow that I do, or that I have a right to take it. Thus, requiring me to return the property to you is a way of recognizing that I had no right to take it from you in the first place. (shrink)

Can implicit biases be properly thought of as epistemic vices? I start by sketching the contours of implicit biases (1), and then turn to the recent claim, from Cassam, that implicit biases are epistemic vices (2). However, I argue that concerns about the stability of implicit biases and their role in producing behavior make for difficulties in establishing that implicit biases of individuals are epistemic vices (3). I then consider a recently developed model which prompts us to consider implicit biases (...) as properties of groups (4). This raises the question of whether implicit biases might constitute collective epistemic vice. I suggest that there is a way to make sense of this claim, but it requires rethinking how we conceptualise collective epistemic vice (5). These re-conceptualisations can be independently motivated. I close by marshalling some considerations in favour of using the terminology of vice to capture these defects of collective epistemic practice (6). (shrink)

Peu de notions semblent a priori aussi vertueuses, donc aussi inoffensives, que celle de " transparence ", synonyme de clarté, de sincérité voire de rectitude morale. Mais en philosophie, c'est bien connu, aucun concept n'est bon ou mauvais en soi. Et, à y bien regarder, rien n'est si clair qu'il n'y paraît lorsqu'il s'agit de transparence. Si un homme politique a pour obligation d'être irréprochable, peut-il tolérer d'être constamment épié, y compris jusque dans sa vie privée? Cette recherche sans limite de " transparence " est en train de gommer une frontière qu'on croyait jusqu'ici sacrée : celle qui sépare l'espace publique de l'espace privé. Qu'il s'agisse de la presse à scandale ou de la téléréalité, de la vie de nos dirigeants, du traitement de l'information par les médias ou des nouvelles technologies, l'exigence de transparence s'est imposée dans tous les domaines de la société, glissant subrepticement de l'injonction morale au fantasme de contrôle absolu, au risque de nous conduire à la lisière du totalitarisme. Jules Janssens a construit une œuvre importante, qui, pour de nombreux chercheurs, a ouvert des perspectives de recherches nouvelles et fécondes. Ses travaux ont fait date. Ils portent principalement sur la philosophie d'Avicenne, ses sources, ses rapports avec la pensée musulmane, son influence sur la théologie ash'arite (al-Ghazālī, Fakhr al-Dīn al-Rāzī) et sa réception dans le monde latin. Pour lui rendre hommage, quatorze collègues et amis de renommée internationale se sont réunis pour poursuivre ses réflexions sur ces thèmes. I argue that our acts of moral appraisal should be communicative. Praise and blame should communicate, to the appraised, information about their status and competences as moral agents; that they are recognised by the appraiser as a competent moral agent, and thus a legitimate candidate for appraisal. I argue for this thesis by drawing on empirical data about factors that can affect motivation. On the basis of such data, I formulate a constraint, and argue that two prominent models of moral (...) appraisal – a consequentialist model and Wallace’s ‘evaluative response’ model – violate this constraint. The model that I propose – the communicative conception of appraisal – does not violate this constraint. This conception, I argue, can provide a fuller picture of the role of appraisals in deepening agents’ commitment to moral norms. On this model, praise and blame has not only an evaluative component, but also communicates to the agent competence affirming information. (shrink)

Philosophers who have written about implicit bias have claimed or implied that individuals are not responsible, and therefore not blameworthy, for their implicit biases, and that this is a function of the nature of implicit bias as implicit: below the radar of conscious reflection, out of the control of the deliberating agent, and not rationally revisable in the way many of our reflective beliefs are. I argue that close attention to the findings of empirical psychology, and to the conditions for (...) blameworthiness, does not support these claims. I suggest that the arguments for the claim that individuals are not liable for blame are invalid, and that there is some reason to suppose that individuals are, at least sometimes, liable to blame for the extent to which they are influenced in behaviour and judgment by implicit biases. I also argue against the claim that it is counter-productive to see bias as something for which individuals are blameworthy; rather, understanding implicit bias as something for which we are liable to blame could be constructive. This essay is part of a larger project exploring the extent to which the market paradigm might be usefully employed to explain and in some instances justify nonmarket institutions. The focus of the market paradigm in this essay is the relationship between the idea of a perfectly competitive market and aspects of both the rationality of political association and the theory of collective choice. In particular, this essay seeks to identify what connections, if any, exist between one kind of market (...) account of the rationality of political association and one kind of market-based social choice rule. The market theory of political association I intend to discuss I call “market contractarianism,” and the collective choice rule whose relation to it I intend to explore is the unanimity rule. What, if anything, is the relationship between market contractarianism and the unanimity rule? (shrink)

Do participants in shared activity have mutual obligations to do their bit? This article shows this question has no one-size-fits-all answer and offers a pluralist account of the normativity of shared agency. The first part argues obligations to do one's bit have three degrees of involvement in shared activity. Such obligations might, obviously, bolster co-participants’ resolve to act as planned (degree 1). Less obviously, there also are higher and lower degrees of involvement. Obligations to do one's bit might provide our (...) agency-pooling mechanism. When they do, we act together by virtue of satisfying them (degree 2). Conversely, some shared activities involve no obligation (degree 0). In the second part, I argue shared agency theory is best served by a non-moralistic conception of obligation, one on which co-participants’ obligations need be neither strict-performance obligations, nor directed ones. Overall, my arguments suggest that we can choose how to coordinate normatively our shared activities. (shrink)

In this paper, I set out some desiderata for a model of implicit cognition. I present test cases and suggest that, when considered in light of them, some recent models of implicit cognition fail to satisfy these desiderata. The test cases also bring to light an important class of cases that have been almost completely ignored in philosophical discussions of implicit cognition and implicit bias. These cases have important work to do in helping us understand both the role of implicit (...) cognition in action and our attempts to combat implicit biases. (shrink)

This book by one of America's preeminent legal theorists is concerned with the conflict between the goals of justice and economic efficiency in the allocation of risk, especially risk pertaining to safety. The author approaches his subject from the premise that the market is central to liberal political, moral, and legal theory. In the first part of the book, he rejects traditional "rational choice" liberalism in favor of the view that the market operates as a rational way of fostering stable (...) relationships and institutions within communities of individuals with broadly divergent conceptions of the good. However, markets are needed most where they are most difficult to create and sustain, and one way to understand contract law in liberal legal theory, according to Professor Coleman, is as an institution designed to reduce uncertainty and thereby make markets possible. Another target of this book is the prevalent view that tort law helps rectify market failures when transaction costs are too high to permit contracting. The author argues instead that tort law should be understood as a way of rectifying wrongful losses not inefficient exchanges. (shrink)

When is it justifiable to exclude a person who wishes to enter a country? What are the acceptable moral bases for immigration policy? These questions lie at the heart of this book, the first interdisciplinary study of the fundamental normative issues underpinning immigration policy. A distinguished group of economists, political scientists, and philosophers offer a provocative discussion of this complex topic. The term 'implicit bias' has very swiftly been incorporated into philosophical discourse. Our aim in this paper is to scrutinise the phenomena that fall under the rubric of implicit bias. The term is often used in a rather broad sense, to capture a range of implicit social cognitions, and this is useful for some purposes. However, we here articulate some of the important differences between phenomena identified as instances of implicit bias. We caution against ignoring these differences: it is likely (...) they have considerable significance, not least for the sorts of normative recommendations being made concerning how to mitigate the bad effects of implicit bias. Il y a un mot de passe pour entrer dans ce livre. Un mot de passe facile à retenir. C'est le mot AMOUR. L'auteur ne le révèle qu'à la toute fin, mais dès les premières pages, on le devine. On a tôt fait de découvrir un homme en amour avec «son» Plateau, où il habite depuis plus de trente ans. Cet amour bien réel en cache un autre plus profond, l'amour de la langue française. Quelques essais bien sentis en témoignent (...) éloquemment. C'est ainsi qu'à travers récits et essais, dans une langue belle et empreinte d'humour, Jules Tessier nous invite à partager des souvenirs où il sera question de pièces de théâtre, de personnages méconnus mais hauts en couleur, de conseils pour augmenter sa longévité, d'invitations au voyage et même de péchés et de vertus! «Un dénominateur commun relie tous ces chapitres, que ce soit le point de vue d'un observateur ou d'un actant: un vif intérêt, peut-être même une passion pour les thèmes abordés.» Au cours de sa carrière universitaire, Jules Tessier s'est intéressé notamment aux manifestations de la vie française sur le continent, tant sur le plan de la langue que sur celui de la littérature. Research programs in empirical psychology over the past few decades have led scholars to posit implicit biases. This is due to the development of innovative behavioural measures that have revealed aspects of our cognitions which may not be identified on self-report measures requiring individuals to reflect on and report their attitudes and beliefs. But what does it mean to characterise such biases as implicit? Can we satisfactorily articulate the grounds for identifying them as bias? And crucially, what sorts of cognitions (...) are in fact being measured; what mental states or processes underpin such behavioural responses? In this paper, we outline some of the philosophical and empirical issues engaged when attempting to address these three questions. Our aim is to provide a constructive taxonomy of the issues, and how they interrelate. As we will see, any view about what implicit bias is may depend on a range of prior theoretical choices. Our focus here is on whether, when influenced by implicit biases, those behavioural dispositions should be understood as being a part of that person’s character: whether they are part of the agent that can be morally evaluated.[4] We frame this issue in terms of control. If a state, process, or behaviour is not something that the agent can, in the relevant sense, control, then it is not something that counts as part of her character. A number of theorists have argued (...) that individuals do not have control, in the relevant sense, over the operation of implicit bias. We will argue that this claim is mistaken. We articulate and develop a notion of control that individuals have with respect to implicit bias, and argue that this kind of control can ground character-based evaluation of such behavioural dispositions. Begehren, Sexualität, Intimität und Affektivität sind feinmaschig in die spätkapitalistische Matrix des Sozialen eingewebt. Die Studie untersucht die politische Ökonomie des Begehrens nach 1968. Sie unternimmt einen Streifzug quer durch die Philosophiegeschichte – von Platon über die Psychoanalyse zum Poststrukturalismus. Dabei geht sie von der Annahme aus, dass Ökonomie einen konstitutiven Faktor darstellt, wenn man Begehren begreifen will. Umgekehrt lassen sich sozioökonomische Strukturen nicht ohne die Rolle des Begehrens verstehen. Begehren wirkt sozialmobilisierend, indem es normative Ordnungen sowohl errichten und aufrechterhalten (...) als auch überschreiten kann. Neben paradigmatischen Positionen von Platon, Georg W. F. Hegel, Friedrich Nietzsche und Sigmund Freud werden begehrensökonomische Thesen von Gilles Deleuze und Félix Guattari und der im Paris von Mai ’68 aufkommenden Philosophie des Begehrens betrachtet.
