Jacques Derrida’s philosophy greatly disrupted traditional Western metaphysics by questioning our understanding of the relationship between language and reality. This paper examines how Derrida deconstructs logocentric and phonocentric perspectives that have influenced Western thought, focusing on his analyses of Plato’s Cratylus and Phaedrus, as well as Ferdinand de Saussure’s Course in General Linguistics. For Derrida, the meaning in language is always shifting, suggesting that absolute truths, as traditionally conceived in Platonic metaphysics, are inherently unstable. His concept of différance illustrates the (...) fluid nature of meaning and the limitations of language. In his critique of “Plato’s Pharmacy,” he explores the inclusive potential of writing, which contrasts with Plato’s preference for speech and dialectics. While Plato is concerned with texts reaching readers he deems “inappropriate” for not fully grasping their meaning, Derrida views access to texts as positive and equitable. He argues that writing removes hierarchical barriers of interpretation, empowering readers and promoting inclusivity and diverse voices. Through this approach, he not only reshapes Western philosophical thinking but also encourages continuous questioning of the truths we often take for granted, expanding philosophy’s relevance to social and political aspects of everyday life. Derrida believes that philosophy should be accessible to all and not limited to privileged academic circles. He critiques elitism and advocates for philosophy to adapt to new social demands, challenging outdated rhetorical models and institutional authority. Derrida’s deconstruction encourages us to consider perspectives beyond our own backgrounds and experiences. In November 1996, Catherine Clément and Julia Kristeva began a correspondence exploring the subject of the sacred. In this collection of those letters Catherine Clément approaches the topic from an anthropologist's point of view while Julia Kristeva responds from a psychoanalytic perspective. Their correspondence leads them to a controversial and fundamental question: is there anything sacred that can at the same time be considered strictly feminine? The two voices of the book work in tandem, fleshing out ideas and (...) blending together into a melody of experience. The result is a dialogue that delves into the mysteries of belief -- the relationship between faith and sexuality, the body and the senses -- which, Clément and Kristeva argue, women feel with special intensity. Although their discourse is not necessarily about theology, the authors consider the role of women and femininity in the religions of the world, from Christianity and Judaism to Confucianism and African animism. They are the first to admit that what they have undertaken is "as impossible to accomplish as it is fascinating." Nevertheless, their wide-ranging and exhilarating dialogue succeeds in raising questions that are perhaps more important to ask than to answer. (shrink)

Leibniz maintains that even though God’s intellect contains all possibles, some of these possibles are not compossible. This incompossibility of some possibles is supposed to explain which collections of possibles are possible worlds and why God does not actualize the collection of all possibles. In order to fully understand how this works, we need to establish what precisely Leibniz takes to be the source of incompossibility, that is, which divine attribute or faculty gives rise to the incompossibility of certain possibles. (...) Different interpretations answer this question in different ways. This chapter explores the role that God’s faculties play on some of the standard interpretations of Leibniz’s notion of incompossibility and argues that we are faced with a dilemma: even though incompossibility must somehow arise from God’s faculties, none of the faculties usually distinguished seems up to the task. To escape this dilemma, we need to revise the traditional understanding of the divine faculties. More specifically, we need to recognize wisdom as an attribute that is distinct from intellect, power, and will and that is the source of incompossibility. (shrink)

Since 1983, legislators and advocates have introduced Land Access Policy Incentives in twenty of the fifty United States. These bills share a demographic goal: to fund land rental or purchase for young and beginning farmers and ranchers. States’ efforts to facilitate land access are part of a global movement to support farmers’ entry into agriculture and to resist farmers’ increasing exclusion from land. We examine the policy creation processes of nine states to describe how coalitions and government leaders are translating (...) their values around land access barriers into policy tools whose political appeal is broad. The bills often pass unanimously, and enrollments are strong: about 2,000 young and beginning US farmers and ranchers will purchase or rent farms this year through a few states’ land access policy programs. We trace the themes from interviews with 66 of the bills’ authors and advocates, and their documentation and media coverage, to demonstrate the values that bipartisan coalitions enlist to construct successful bills and the compromises that make them politically feasible. The coalitions’ values turn on the threats of rising land costs, farm expansion or consolidation, and land conversion out of agriculture. As a group, the policies serve broadacre farming operations while leaving specialty crop farms largely unserved. Two states have endeavored to include all farmers of color among their policies’ beneficiaries. Our findings demonstrate tradeoffs of states’ current Land Access Policy Incentives and suggest next steps for research and advocacy to inform policy development to support next generation farming opportunities. This article seeks to examine the representation of Chinese Indonesians in New Media after the demise of Suharto’s New Order regimes. It takes root in the recent phenomenon in Indonesia as the “reappearance” of Chinese faces in popular Indonesian media by discussing the celebrities or public figures, and ordinary ‘man-on-the street’ of Chinese Indonesians, who are catapulted in the mainstream mass media and portrayed in popular television formats in particular such as reality-shows, talk-shows, news and variety shows. Based on participatory (...) observation and in-depth-interview to the producers of several popular TV shows casting Chinese figures, this article argues that the political changes from authoritarian Suharto’s regimes which marginalized Chinese ethnicity to democracy has re-identified the representation of Chineseness in public sphere which contributes to more reception of Chinese identity at large in the country. This representation intermingles to produce the debates on religiosity and nationalism. (shrink)

German theologian F. D. E. Schleiermacher's doctrine of God-the first to be developed in the post-Kantian era-fundamentally changed the course of Christian theology. The degree to which his doctrine of God was influenced by the philosophy of Benedict de Spinoza remains in dispute, however. This study examines the ways in which Schleiermacher actively adopted elements of Spinoza's thought in the development of his own theological doctrine of God. Julia Lamm's analysis of little-known but seminal essays by Schleiermacher reveals his (...) young creative genius in daring to go beyond the neo-Spinozism of Herder and the post-Kantianism of Fichte by developing his own post-Kantian Spinozism. Schleiermacher's unique simultaneous appropriation of Kant and Spinoza is characterized by four themes: an organic monism, an ethical determinism, a critical realism, and a nonanthropomorphic view of God, which Lamm traces through his two major theological works, On Religion: Speeches to Its Cultured Despisers and The Christian Faith. Ultimately, Lamm finds that Schleiermacher departs from Spinoza in significant ways. Most notably, he talks about "the living God" who is best expressed through the divine attributes of love and wisdom. This living God is what Schleiermacher refers to as the "third alternative" to, on the one hand, the anthropomorphized God of orthodox Protestantism and, on the other hand, Spinoza's natura naturans. The essays in this volume convince me of something which, until now was only a hypothesis of mine. Academic discourse, and perhaps American university discourse in particular, possesses an extraordinary ability to absorb, digest, and neutralize all of the key, radical or dramatic moments of thought, particularly, a fortiori, of contemporary though. Marxism in the United States, though marginalized, remains deafly dominant and exercises a fascination that we have not seen in Europe since the Russian Proletkult of the 1930s. Post-Heideggerian (...) "deconstructivism" though esoteric, is welcomed in the United States as an antidote to analytic philosophy or, rather, as a way to valorize, through contrast, that philosophy. Only one theoretical breakthrough seems consistently to mobilize resistances, rejections and deafness: psychoanalysis—not as the "plague" allowed by Freud to implant itself in America as a "commerce in couches" but rather as that which, with Freud and after him, has led the psychoanalytic decentering of the speaking subject to the very foundations of language. It is this latter direction that I will be exploring here, with no other hope than to awaken the resistances and, perhaps, the attention of a concerned few, after the event .For I have the impression that the "professionalism" discussed throughout the "Politics of Interpretation" conference is never as strong as when professionals denounce it. In fact, the same preanalytic rationality unites them all, "conservatives" and "revolutionaries"—in all cases, jealous guardians of their academic "chairs" whose very existence, I am sure, is thrown into question and put into jeopardy by psychoanalytic discourse. I would therefore schematically summarize what is to follow in this way:1. There are political implications inherent in the act of interpretation itself, whatever meaning that interpretation bestows. What is the meaning, interest, and benefit of the interpretive position itself, a position from which I wish to give meaning to an enigma? To give a political meaning to something is perhaps only the ultimate consequence to he epistemological attitude which consists, simply, of the desire to give meaning. This attitude is not innocent but, rather, is rooted in the speaking subjects' need to reassure himself of his image and his identity faced with an object. Political interpretation is thus the apogee of the obsessive quest for A Meaning.2. The psychoanalytic intervention within Western knowledge has a fundamentally deceptive effect. Psychoanalysis, critical and dissolvent cuts through political illusions, fantasies, and beliefs to the extent that they consist in providing only one meaning, an uncriticizable ultimate Meaning, to human behavior. If such a situation can lead to despair within the polis, we must not forget that it is also a source of lucidity and ethics. The psychoanalytic intervention is, from this point of view, a counterweight, an antidote, to political discourse which, without it, is free to become our modern religion: the final explanation.3. The political interpretations of our century have produced two powerful and totalitarian results: fascism and Stalinism. Parallel to the socioeconomic reasons for these phenomena, there exists as well, another, more intrinsic reason: the simple desire to give a meaning to explain, to provide the answer, to interpret. According to a major trend in Hegel scholarship, Hegel advocates a McDowell-style transformativist conception of the human mind. Central to this conception is a methodological dualism, according to which phenomena belonging to the rational mind, in contrast to those belonging to non-rational nature, must be accounted for from within the ‘space of reasons.’ In this paper I argue, by contrast, that Hegel rejects methodological dualism. For Hegel, a constitutive aspect of the rational mind is the activity of expression. I show (...) how Hegel’s philosophy of mind adequately accounts for low-level forms of expressivity without appealing to capacities connected to conceptual thought and judgment, and that he does so by drawing on methods similar to those employed within the empirical sciences of his time. Thus, for Hegel, the sphere of the rational mind is broader than the McDowellian space of reasons. (shrink)

This research aims to determine the quality of public services through the Electronic-Based Government System (SPBE), as well as to know and analyze the Implementation of Strategies for Achieving PERPRES No. 95 of 2018 concerning SPBE in the Medan City Government. This research is important to obtain a Strategic Management Model in Achieving PERPRES No.95 of 2018 concerning SPBE in the Medan City Government. The research paradigm used is Constructivist Paradigm, with Qualitative Research Method. Data were collected through in-depth interviews, (...) discussions with several informants from the Medan City Office, DPRD, UPT Kecamatan, and community leaders. In addition, data was also collected through literature study, document study, and secondary data. The results showed the following: First, there is coordination between agencies in the development of application services. The coordination is conducted by the Diskominfo of Medan City Government. A number of Departments used external consultants in the development of SPBE. Diskominfo made new rules to address ICT service issues. The services use external programmers and experts and if an error occurs, the City Government is not responsible for the service. Secondly, Medan City Government conducted a Memorandum of Understanding with Tangerang City to collaborate and share resources through the innovation of E-Files application for correspondence needs. The use of shared correspondence applications by the Government in Tangerang City was adjusted based on the specific needs of each city. The platform used is the same, but with different application names, E-Files in Tangerang and Sarana in Medan. Third, there are 3 SPBE service providers in Medan City Government, including: Telkom (PT. Telekomunikasi Indonesia) for Kelurahan/Kecamatan, GDS (Global Digital Solusi) for Diskominfo and other OPDs, and TNC (Telemedia Network Cakrawala) for Medan City Office. Fourth, Medan City Government uses a Strategic Management Model that combines the Environmental Model with the Collaboration Model in developing the Achievement of PERPRES No.95/2018 on SPBE in Medan City Government. The Environmental Model/Flow emphasizes vertical and horizontal coordination between work units in Medan City Government. The Collaboration Model develops a strategy of collaborative cooperation with other local governments or state-owned/private enterprises. (shrink)

This article analyses the current state of empirical legal research in the law and the regulation of financial markets. It aims to provide a brief survey of the main work done either by lawyers or by others but which is pertinent to the operation of law and regulation. It focuses on six main areas of research and debates. These are the debates on the efficient markets hypothesis and mandatory disclosure rules in securities regulation; studies on behavioralism and their impact on (...) disclosure as a tool for protecting investors; studies on the impact of rules relating to market misconduct on market development; research into the relationship between legal rules and securities market development; evidence of the unintended impacts of regulation; and research into the dynamics of financial market regulatory regimes. Finally, this article mentions that understanding the general context in which law and regulation operates deepens our understanding of the nature, potential, and limits of law and regulation themselves. According to so-called transformative theories of rationality, human nature is of a fundamentally different kind than the nature of non-human animals, because it is transformed by the possession of rational capacities. This is assumed tobe reflected in the fact that human nature and non-human nature require two fundamentally different forms of explanation: reason-based explanations on the one hand, explanations with reference to natural laws on the other. There is no continuity between these two forms of explanation, i.e. a transition from (...) one to the other is not intelligible. In this paper, I will draw on Hegel to sketch a counter-position to this kind of “continuity skepticism” (Dorit Bar-On, 2013). The central thesis is that Hegel’s project in his anthropology is to make the transition from one order of explanation to another intelligible by outlining an intermediate realm in which the phenomena under investigation are no longer entirely outside, and not yet entirely inside, the rational order of explanation. She was wearing an enormous and elaborate black velvet hat with yards of veiling and several large red silk roses. The combination of textures, shadows, (...) colors, forms, and the suggestion of a story, of meaning beyond the exercise itself, drew me in I think. Using an entire large sheet of tan-colored drawing paper, soft vine charcoal, and a kneaded rubber eraser I began to draw, moving from the impossible hat to the model's high cheekbones, deep-set shadowed eyes, soft cheeks, and curved neck. Somewhere between the top of the paper (the crown of her hat) and the woman's face, however, my hand, my self, the drawing, the young woman, and the hat merged by some means outside my control. I was the act of drawing. I was the charcoal, the curved cheek, the dark eyes, the wonderful hat. There were no boundaries among us. No distances. The drawing, it seemed, drew me at the same time that it revealed an image of the model and her black velvet hat on the paper and tied me to the woman seated before me. I was exalted, transported, amazed.Now, as I think back to that drawing, I understand it as my first clear art experience of doing, not thinking, being, not observing that all artists encounter on their best days. It was, in another way of considering, my initial encounter with the fact that "the imaginative faculty, especially as engaged in the art process is one of the strongest and clearest ways in which we can learn within the qualitative, immediate present, within kairotic as opposed to chronic time, or within the eternal present,"1 as the art educator Kenneth [End Page 51] Beittel explains. Or, put another way, it was my experience with the fact that, as the writer Lawrence Weschler suggests in his biography of the artist Robert Irwin, "Seeing is forgetting the name of the thing one sees."2 Or, as the sculptor Anne Truitt explains, drawing can be "a direct channel between one's [my] experience and one's [my] hand."3This transformation from a distinct see-er and seen to a single entity sharing both time and space, from a distant relationship to intimacy, from a world of the generalized to the place of the particular brings us to the intertwined themes of this article: the importance of the awesome transcendent particularity of the singular—person, creature, place, object, plant, or moment in art and, similarly, religious contemplation and the likeness and/or overlap of artistic engagement with spiritual experience.In order for us to examine the artist in the midst of creating, and to explore our theme of art's relationship to the awful (think of the older usage meaning "full of awe" here) particularity of thisness as John Dun Sotus4 describes the perfection of the particular and specific, as well as to explore the relationship of art making, art learning, art teaching, and spiritual experience, exemplars are necessary. Our first exemplar is Gordie, a member of the art class I teach at a local hospital. Our second exemplar, the filmmaker, writer, and painter Derek Jarman,5 exemplifies by his lifetime of creative accomplishment an artist in the most literal manner. Before delving into the work in question, it may be fruitful first to have a glimpse at the artist’s iconic aesthetic. In 2015, and at the age of twenty-seven, Wu, a self-taught artist, debuted her first graphic memoir, Gazpacho Agridulce. The book commences with her parents’ newfound life in Spain after leaving Qingtian, a province of Zhejiang, China, to run a restaurant in Algeciras, a municipality of Cadiz. The opening pages of Gazpacho pack a punch, depicting Wu’s dramatic and untimely birth in a taxicab en route to the hospital.Gazpacho’s publication initiated a crucial sea change in the predominantly white Spanish publishing world, which would soon after be rocked by a boom of racialized1 authors penning anti-racist memoirs and other works of non-fiction.2 Gazpacho would also eventually become the first of the author’s trilogy of graphic memoirs, which was completed by the sequels Andaluchinas por el mundo (2017) and the most recent La agridolce vita (2023).Wu’s narratives capture the familial, identarian, and social conflicts that erupt from cultural disloyalties and racism—direct consequences of migration. She and her sisters, for example, loathe their family’s rigid Chinese and Christian mores and long for the cultural markers of an ordinary Spanish childhood, structured of course by U.S. global consumer culture, e.g. Barbie, Pizza Hut, and McDonald’s.An illustrator, cartoonist, and podcaster, Wu’s talent as a storyteller lies in her complex use of humor. With great care for her subject and her reader, Wu deploys humor to tend to the uncouth, raw, and ugly parts of life. In so doing, the author invites us to laugh and ultimately reckon with our own discomfort as we with sit with the heaviness of racism, sexism, and post-migration melancholy—using humor as a salve.At her best, Wu serves irreverence, rawness, and wit. To be immersed in her books is to rub up against the rough-hewn emotions that bring her characters to life. The vibrancy of her palette and the whimsy of her pen strokes are inviting, animated, and deceptively light-hearted. In an instant, lines and pigment rearrange into abstractions dense with affect. La danse permet-elle d'affiner notre perception de certaines propriétés expressives, notamment musicales? Justinus Kerner's Reflections on Science. Justinus Kerner (1786–1862) was a physician as well as a poet. In his research, as well as his profession, he tried to reconcile empirical observation with dreams, mesmerism, and the unconscious. Like the romantic naturalists of his time, Kerner rejected the exclusive preoccupation with rational science as a restriction to epistemology, which he wanted to complement by considering the “nocturnal sides of nature” (“Nachtseiten der Natur”) as well. This article wants to show how Kerner reflected (...) on science, medicine, and nature, and how it became possible for a physician who became famous for the discovery of food poisoning by botulism to be ridiculed at the same time, or at least to be frowned upon, for writing about seeing ghosts and having visions. How could he combine empiric case studies and exact, detailed observation with his belief in the supernatural? And how could he, not only harmonize these apparently contradictory concepts in his writings, but also turn them into paradigms that are based on one another? To answer these questions, this article will refer to Kerner's works on “sausage poisonings” (1817–1842) in the early nineteenth century, as well as his case study of The Seeress of Prevorst (Die Seherin von Prevorst, 1829), in which he described the case of a female patient who was supposed to be a clairvoyant, and finally his literary writings, like The Homeless (“Die Heimatlosen”, 1816) and his autobiographic work Sketches from My Boyhood (Das Bilderbuch aus meiner Knabenzeit, 1849). His personal observations and experiences were the reason that Kerner did not simply deny positivist medicine, but expanded his concept of healing by adding dreams, mesmerism, and visions. For, in the end, the unconscious, as well as the “sausage poison”, evades determination by scientific empiricism alone. (shrink)

In den Rhythmusbegriff, wie ihn der Kreis um Ludwig Klages auffaßte, schreibt sich das Konzept der langen Dauer ein, während in den Arbeiten des sowjetischen Künstlers Alexander Michailowitsch Rodtschenko der Takt die Geschichte gleichsam auslöscht.

This chapter aims to present some of the highlights of the early modern debate about slavery. We will start by exploring theoretical debates about slavery by nature. As we will see, several authors view natural slavery as incompatible with widely held doctrines about human equality and natural liberty. Yet we will also see that many early modern authors are sympathetic to natural slavery—perhaps surprisingly so. Moreover, we will see that even in texts that are not explicitly about transatlantic slavery, natural (...) slavery is often tied to race. Next, we turn to theoretical debates about circumstantial slavery. We will see that most early modern authors accept at least some instances of this type of justification. It is only in the mid-eighteenth century that some prominent philosophers reject circumstantial slavery categorically, though there are earlier philosophers who argue against some forms of it while accepting others. Finally, we will examine the portion of the debate that is explicitly about transatlantic slavery. As one would expect, racial natural slavery plays a major role in this debate. What is surprising, however, is that race enters the debate earlier than one might think. As early as the 1680s, when theories of race were still in their infancy, critics of transatlantic slavery argue that racial bias fuels transatlantic slavery and that proponents of slavery view Black people as subhuman and as natural slaves. This article points out the significance of the materiality of written language for the understanding of literature and aspects of poiesis. For this purpose it is necessary to consider the interaction of materiality and mediality from a general point of view. Reading E.T.A. Hoffmann’s novel »Lebens-Ansichten des Katers Murr« (The Life and Opinions of the Tomcat Murr), this paper explores how literature reacts to technical changes in the production of books and subsequent juridical debates. I read the novel as an (...) intertextual play in reaction to an article by Johann Gottlieb Fichte on literary property (»Beweis der Unrechtmäßigkeit des Büchernachdrucks«). In trying to work through Fichte’s proposals concerning materiality and mediality, Hoffmann generates a new style of writing. (shrink)

Although the literature on organizational justice enactment is becoming richer, our understanding of the role of the deontic justice motive remains limited. In this article, we review and discuss theoretical approaches to and evidence of the deontic justice motive and deontic justice enactment. While the prevalent understanding of deontic justice enactment focuses on compliance, we argue that this conceptualization is insufficient to explain behaviors that go beyond the call of duty. We thus consider two further forms of deontic behavior: humanistic (...) and supererogatory behavior. Drawing on the concepts of situation strength and person strength, we further argue that the reduced variance in behavior across morally challenging situations makes deontic justice enactment visible. We thus observe deontic justice enactment when an actor’s deontic justice motive collides with strong situational cues or constraints that guide the actor to behave differently. We formulate propositions and develop a theoretical model that links the deontic justice motive to moral maturation and deontic justice enactment. (shrink)

This paper provides an analysis of data collected on the continued prevalence of outdated, marginalizing terms in contemporary cataloguing practices, stemming from the Library of Congress Subject Heading term “Indians” and all its related terms. Using Manitoba Archival Information Network’s (MAIN) list of current LCSH and recommended alternatives as a foundation, we built a dataset from titles published in the last five years. We show a wide distribution of LCSH used to catalogue fiction and non-fiction, with outdated but recognized terms (...) like “Indians of North America-History” appearing the most frequently and ambiguous and offensive terms like “Indian gays” appearing throughout the dataset. We discuss two primary problems with the continued use of current LCSH terms: their ambiguity limits the effectiveness of an institution’s catalog, and they do not reflect the way Indigenous Peoples, Nations, and communities in North America prefer to represent themselves as individuals and collectives. These findings support those of parallel scholarship on knowl­edge organization practices for works on Indigenous topics and provide a foundation for further work. (shrink)

Im Dialog Georgias beispielsweise erläutert Platon, inwiefern StrafeStrafeRechtfertigung, Funktion, Wirksamkeit von Strafe eine vergangene Ungerechtigkeit ausgleicht und dadurch wieder eine harmonische Gleichheit herstellt (Georgias 466a–480e). Auch in seinem Hauptwerk Politeia verteidigt er, dass Gerechtigkeit die Tüchtigkeit der Seele sei und sich Ungerechtigkeit daher niemals lohnen könne.

Der Aufsatz beschäftigt sich mit dem “Fall Thompson” – einem kaum erforschten Streitfall innerhalb der Anglikanischen Kirche und der wissenschaftlichen Theologie über die Zulässigkeit der Kritik an zentralen Bekenntnisinhalten vom Anfang des 20. Jahrhunderts. Die Verfasserin rekonstruiert sowohl die akademisch-theologische Diskussion über Thompsons umstrittene Veröffentlichung als auch die komplexen rechtlich-formalen Vorgänge innerhalb des Magdalen Colleges in Oxford. Der Fall illustriert exemplarisch den Konflikt zwischen liberalen und konservativen Theologen über die Grundlagen des christlichen Glaubens, der den westeuropäischen Protestantismus im 19. und (...) 20.
