Este estudio analiza el artículo 146 del Código Orgánico Integral Penal (COIP) de Ecuador, esta trata sobre el homicidio culposo por práctica profesional equivocada. La mala praxis médica es un problema grave en el sistema de salud de Ecuador, y la interpretación inadecuada de este artículo ha generado confusión en los procesos legales relacionados. El objeto de la investigación es analizar la normativa del artículo 146 del COIP y las lagunas de interpretación jurídica para determinar la culpabilidad o inocencia de (...) los profesionales de la salud. Para ello, se emplearán métodos comparativos e históricos, que incluyen revisión bibliográfica, análisis de contenido del artículo 146. Los resultados esperados son demostrar las dudas razonables en la prueba del delito de mala praxis, resaltar la importancia de la bioética en los procedimientos legales. Este estudio busca contribuir a una mejor comprensión del marco legal y brindar ideas para la resolución de casos de mala praxis y homicidio culposo en Ecuador. (shrink)

Resumen: Este artículo busca observar las diferencias entre el modelo sistémico funcional y el modelo pragmático-formal en su comprensión de la experticia científica y su rol en las sociedades modernas. Se elaborará un breve diagnóstico acerca de la importancia de la confianza en experticia científica en la sociedad contemporánea y cómo este proceso ha sido analizado. Luego, se analizará la descripción del conocimiento científico en la sociedad contemporánea desde el modelo sistémico funcional. Utilizando los conceptos de diferenciación funcional y acoplamiento (...) estructural, se sugerirá que, desde este modelo, el conocimiento científico es una forma de comunicación especializada propia de un sistema funcional de la sociedad. A continuación, se describirá la aproximación del modelo pragmático formal. Especial importancia tienen aquí las ideas de mundo de la vida y esfera pública. Sobre la base de estas caracterizaciones, se comparan las visiones de estos autores y se analizan las diferencias en su conceptualización de la experticia. Se argumenta que las diferencias de estos dos modelos en relación con el estatus ontológico del mundo de la vida marcan sus visiones de la experticia y los debates actuales acerca de sus posibilidades de convertibilidad en la literatura especializada. El artículo finaliza con un resumen y posibles líneas futuras de investigación.: This article seeks to observe the differences between the functional-systemic model and the pragmatic-formal model in their understanding of scientific expertise and its role in modern societies. First, a brief diagnosis about the importance of trust in scientific expertise in contemporary society and how this process has been analyzed in the specialized literature will be made. Then, the description of scientific knowledge will be analyzed from the point of view of the functional systemic model. Using the concepts of functional differentiation and structural coupling, it will be argued that scientific knowledge is here considered a specialized form of communication characteristic of a functional system. Next, the approximation of the formal-pragmatic model is described. Of special importance here are the ideas of lifeworld and public sphere. On the basis of these characterizations, the visions of these authors are compared and the differences are analyzed in relation to their conceptualization of expertise. It is then suggested that the differences between these two models in relation to the ontological status of the lifeworld shape their views of scientific expertise as well as current debates on this topic. This study focuses on the influence of the quality of services received by thalassotherapy customers on their global satisfaction and the relationship between this and the word of mouth. This study uses a hybrid SEM—classification tree analysis. The empirical findings reveal a significant relationship between the quality of each offered service and global satisfaction. This study contributes to identify tourist’s satisfaction or delight on received thalasso services through a proposed methodology. The main contribution of this work consists of the proposal (...) of a methodology to identify objectively through the opinion of tourists if they were satisfied or had reached delight. This work demonstrates, confirming what has been found in previous literature, that global satisfaction is related to the different experiences provided by the service. Thus, all hypotheses are accepted, supporting the hypotheses that relate the pool, the staff, the treatments, and the environment to satisfaction. In addition, the hypotheses that link satisfaction with the word of mouth are also supported. This theoretical implication has important practical implications for managers of the type of facilities such as those studied in this paper, since it shows that it is not enough to do well in one of the services provided if the environment or the interaction with the staff is not right. In Older Adults (OAs), Electroencephalogram (EEG) slowing in frontal lobes and a diminished muscle atonia during Rapid Eye Movement sleep (REM) have each been effective tracers of Mild Cognitive Impairment (MCI), but this relationship remains to be explored by non-linear analysis. Likewise, data provided by EEG, EMG (Electromyogram) and EOG (Electrooculogram)—the three required sleep indicators—during the transition from REM to Non-REM (NREM) sleep have not been related jointly to MCI. Therefore, the main aim of the study was to explore, with (...) results for Detrended Fluctuation Analysis (DFA) and multichannel DFA (mDFA), the Color of Noise (CN) at the NREM to REM transition in OAs with MCI vs. subjects with good performances. The comparisons for the transition from NREM to REM were made for each group at each cerebral area, taking bilateral derivations to evaluate interhemispheric coupling and anteroposterior and posterior networks. In addition, stationarity analysis was carried out to explore if the three markers distinguished between the groups. Neuropsi and the Mini-Mental State Examination (MMSE) were administered, as well as other geriatric tests. One night polysomnography was applied to 6 OAs with MCI (68.1 ± 3) and to 7 subjects without it (CTRL) (64.5 ± 9), and pre-REM and REM epochs were analyzed for each subject. Lower scores for attention, memory and executive funcions and a greater index of arousals during sleep were found for the MCI group. Results confirmed that EOGs constituted significant markers of MCI, increasing the CN for the MCI group in REM sleep. The CN of the EEG from the pre-REM to REM was higher for the MCI group vs. the opposite for the CTRL group at frontotemporal areas. Frontopolar interhemispheric scaling values also followed this trend as well as right anteroposterior networks. EMG Hurst values for both groups were lower than those for EEG and EOG. Stationarity analyses showed differences between stages in frontal areas and right and left EOGs for both groups. These results may demonstrate the breakdown of fractality of areas especially involved in executive functioning and the way weak stationarity analyses may help to distinguish between sleep stages in OAs. Se realizó una revisión de fuentes bibliográficas donde aparece una recopilación de fragmentos extraídos de las cartas martianas, conjuntamente con el análisis de los valores presentes en los mismos. Se realizó en el Instituto Superior de Ciencias Médicas de Camagüey, en los meses comprendidos entre julio y agosto de 2007. La escasa divulgación de la problemática axiológica analizada por Martí a través de su correspondencia fue lo que motivó la realización del trabajo. Su objetivo es analizar los valores presentes (...) en la correspondencia de Martí para incidir en la formación integral del profesional de la salud. Entre los resultados más importantes se destacan: la información que se brinda sobre los valores contenidos en su correspondencia y el vínculo que se va estableciendo con su propia personalidad This research work is a revision of José Martí's letters, for the analysis of the reflected axiological facts in them. The realization of this work was motivated by the small amount of information published about the axiological problematic reflected in José Martí's letters. Their objective is to analyze that problematic in Martí's letters to include it in the students of medicine curriculum. In this paper, the relationship between the e-value of a complex hypothesis, H, and those of its constituent elementary hypotheses, Hj, j = 1… k, is analyzed, in the independent setup. The e-value of a hypothesis H, ev, is a Bayesian epistemic, credibility or truth value defined under the Full Bayesian Significance Testing mathematical apparatus. The questions addressed concern the important issue of how the truth value of H, and the truth function of the corresponding FBST structure M, relate to (...) the truth values of its elementary constituents, Hj, and to the truth functions of their corresponding FBST structures Mj, respectively. The Coalition of Immokalee Workers (CIW) has successfully combated modern-day slavery by transforming the ways that over a dozen major brands, including Taco Bell, Subway, and Wal-Mart, manage their supply chains. The CIW’s efforts over more than 20 years have effectively stopped enslavement practices, including abuses such as wage theft and peonage indebtedness. We conducted a field ethnography, interviews, and archival analyses to understand this success. We find that the CIW employs a decentered, egalitarian, and ensemble approach to their multiplicities (...) of alliances by collectively “animating” themselves and their partners through ensemble leadership. This combination of alliances, along with worker-driven monitoring, brings life to the CIW motto “We are all leaders.” Translating this motto into daily practice is how the CIW virtually eradicates enslavement practices in corporate supply chains. It is commonly thought that that the best system account of lawhood ((Mill (1843), Ramsey (1978)[fp. 1928], Lewis (1973)) makes available a nice explanation for why laws are ‘distinctively appropriate targets of scientific inquiry’ (Hall, 2015). The explanation takes the following general form: laws are especially valuable for agents like us because they efficiently encode a lot of valuable (non-nomic) information in a tractable format. The goal of this paper is to challenge this style of explanation: I argue that the (...) general principle it presupposes is in conflict with our best account of practical rationality. After considering and rejecting a number of proposals for dissolving the tension, I conclude that BSA proponents may need to scale back the explanatory ambitions of their theory; in particular, they may need to give up the hope of non-circular explanations of the value of nomic information. I end by outlining some challenges for the humean world-view that results after this shift. (shrink)

Urban Digital Twins (UDTs) have become the new buzzword for researchers, planners, policymakers, and industry experts when it comes to designing, planning, and managing sustainable and efficient cities. It encapsulates the last iteration of the technocratic and ultra-efficient, post-modernist vision of smart cities. However, while more applications branded as UDTs appear around the world, its conceptualization remains ambiguous. Beyond being technically prescriptive about what UDTs are, this article focuses on their aspects of interaction and operationalization in connection to people in (...) cities, and how enhanced by metaverse ideas they can deepen societal divides by offering divergent urban experiences based on different stakeholder preferences. Therefore, firstly this article repositions the term UDTs by comparing existing concrete and located applications that have a focus on interaction and participation, including some that may be closer to the concept of UDT than is commonly assumed. Based on the components found separately in the different studied cases, it is possible to hypothesize about possible future, more advanced realizations of UDTs. This enables us to contrast their positive and negative societal impacts. While the development of new immersive interactive digital worlds can improve planning using collective knowledge for more inclusive and diverse cities, they pose significant risks not only the common ones regarding privacy, transparency, or fairness, but also social fragmentation based on urban digital multiplicities. The potential benefits and challenges of integrating this multiplicity of UDTs into participatory urban governance emphasize the need for human-centric approaches to promote socio-technical frameworks able to mitigate risks as social division. We describe the informed consent procedures in a research clinic in Santiago, Chile, and a qualitative study that evaluated these procedures. The recruitment process involves information, counseling and screening of volunteers, and three or four visits to the clinic. The study explored the decision‐making process of women participating in contraceptive trials through 36 interviews. Women understood the research as experimentation or progress. The decision to participate was facilitated by the information provided; time to consider it and to discuss it with (...) partners or relatives; and perceived benefits such as quality of care, non‐cost provision of methods and medical care. For some women, participation was an opportunity to express altruism. The main obstacles for participation were perceived side effects or risks. The final risk‐benefit balance was strongly influenced by women’s needs. Women perceived that the consent form benefited the clinic, proving that participants had made a free decision, and benefited the volunteers by warranting their right to free medical care. The most important problem detected was occasional misunderstanding of the information given on the form. We concluded that a full decision‐making process enhances women’s ability to exercise their right to choose, and assures research institutions that trials are conducted without coercion and that the participants are committed to the study. The prevalent idea that semiosis is evolutionary is a driving point for biosemiotic research, starting from the Peircean premises of continuity and including a large number of views on how signs evolve. In this paper I wish to add a small pinch of skepticism to an otherwise productive point of view. Briefly, the question to be asked is: Is there any proper and fair connection between the logical abstraction of signs, genetic expressions interpreted as signs and the animal usage of (...) signs? And how do we go about answering this? Instead of attempting a negative account of the possibility of an evolutionary view of biosemiosis, I will attempt to make an argument in favor of skepticism as a way to make a more fine-grained distinction across the areas where biosemiotic thinking seems to have some impact. The aim is then to find philosophical strategies to overcome this skepticism when possible, while also raising some awareness about the possible limits of current biosemiotics regarding the ideal evolutionary chain of signs. Ultimately, the idea is reexamining some core assumptions of the biosemiotic point of view at its most general, accounting for some possible ways in which theory may move forward. The potential incompatibility of theoretical standpoints between some of the different approaches that may be taken is, it will be argued, a desirable outcome for biosemiotic research. That is, the way we deal with the possible theories on the evolutionary continuity of signs will also affect our different research programs, and having a nuanced philosophical discussion on it can only contribute to the expansion and clarification of where different positions within biosemiotics currently stand. En el presente artículo se despliega una revisión documental que tiene como objetivo fundamental, analizar la relevancia de las ciencias cognitivas en articulación con el ámbito educativo. En aras de reflexionar sobre la noción de sujeto, se determina importante revisar el discurso del neoliberalismo y su inscripción en el enigma de la subjetividad. Resignificar el factor de la experiencia humana implica sortear los desafíos de la visión biológica-reduccionista, para privilegiar la máxima del saber inconsciente. El recorrido hermenéutico de este documento (...) retoma un andamiaje interdisciplinario, cuya base es representada por disciplinas como la filosofía, las neurociencias y el psicoanálisis. En tal sentido, se considera necesario efectuar un cambio de paradigma que pondere la historia y constitución subjetiva, en contraposición de prácticas que degradan la singularidad del ser humano. Priorizar la influencia del entorno social en la vida de los educandos, aunado a salvaguardar su desarrollo mental, físico y psicológico, se perfila como un requisito clave para sostener un funcionamiento idóneo del sistema nervioso y construcción del psiquismo. Es imperativo extender el avance de las ciencias a los auspicios de las políticas públicas, vincular el conocimiento neurocientífico y condición subjetiva a los espacios de formación docente, supone un ejercicio de profilaxis educativa. Studies investigating the COVID-19 pandemic from a psychological point of view have mostly focused on psychological distress. This study adopts the framework of existential positive psychology, a second wave of positive psychology that emphasizes the importance of effective coping with the negative aspects of living in order to achieve greater wellbeing. Trait emotional intelligence (trait EI) can be crucial in this context as it refers to emotion-related personality dispositions concerning the understanding and regulation of one’s emotions and those of others. The present study investigated the relationship between trait EI and both wellbeing and psychological distress (i.e., depression, anxiety, and stress), while exploring the mediating role of meaning-centered coping (proactive transformative strategies based on meaning in life) and maladaptive coping (i.e., behavioral disengagement and self-blame) during the first few months of the COVID-19 pandemic. A sample of 326 Lebanese adults completed measures of trait EI, wellbeing, psychological distress, coping, and meaning-centered coping. Results showed a strong positive correlation between trait EI and meaning-centered coping. Trait EI also correlated positively with wellbeing and negatively with psychological distress. Structural equation modeling showed that meaning-centered coping partially mediated the relationship between trait EI and wellbeing. Maladaptive coping fully mediated the relationship between trait EI and psychological distress. Findings indicate that trait EI is positively related to dealing with a stressful situation such as the pandemic in positive ways at both the cognitive level, by reformulating the situation to see something valuable in it, and behavioral level, by being proactive about it. Trait EI was positively linked to seeing the situation as an opportunity for personal growth, finding personal meaning in this situation, maintaining an attitude of hope and courage, and acting more responsibly with one’s self and others during the current crisis. In turn, this coping formula was related to lower psychological distress and improved mental health. These results are consistent with the existential positive psychology framework and can inform implementation programs and policies aiming at raising awareness and promoting healthy and successful coping during the pandemic. Physiological responses in futsal have not been studied together with temporal information about the players’ stay on the court. The aim of this study was to compare heart rate and blood lactate concentration responses between 1-H and 2-H considering the time of permanency of the players on the court at each substitution in a futsal match. HR was recorded during entire match and [La−] was analyzed after each substitution of seven players. %HRmean and [La−] mean did not differ between 1-H (...) and 2-H. Time in intensity zones of 50–100 %HRmax differed only in 60–70 %HRmax. HR coefficient of variation throughout the match was low and among the four outfield players on the court. Substitutions, time of permanence on the court, ratio between time in- and out-ratio on the court also were similar between 1-H and 2-H. Balancing the number of substitutions, and the In:Outcourt ratio of players in both halves of the match, playing lower time at 1-H, ~8 min for each participation in the match, made it possible to maintain intensity of the match in 2-H similar to the 1H. These results are a good guidance to coaches and for application in future studies. (shrink)

The most recent work by Jürgen Habermas tries to revalue religion in today's society. For this he tries to find genealogical connections between secular content and the worldviews that emerged in the Axial Age, including Jewish monotheism. In this article we try to propose that a genealogical approach to monotheism from the perspective of those involved would have to start from the context of undetected origin that constitutes the ethical universalism of Judaism: the Noahide code. To do this, we analyze (...) narrative and conceptual elements of axial and non-axial cultures and show their parallels with the seven laws of the children of Noah as the moral core of humanity. Review of Jonathan Birch’s The Edge of Sentience.

This paper argues for a broad definition of philosophical sources and how Indigenous traditional knowledge fits that definition. It concludes by showing how, following the previous two points, an Indigenous document such as the Huarochirí Manuscript can be considered a philosophical source by academic philosophers. The paper has three sections: the first deals with the methodological point of addressing what can be considered as philosophy. This section presents a conversational approach to philosophy. This approach, although broad, properly captures the practices (...) of inquiring about philosophical issues as is commonly done in Western academic circles, but without excluding the practices of non-Western cultures from being labelled as philosophical. The second section argues for the analytical distinction between a philosophical source, a philosophical text, and a philosophical insight. It shows that what makes a philosophical source such are the philosophical insights that it can provide. The final section shows how the Huarochirí Manuscript has merits making it worthy of being considered a philosophical source and thus a relevant academic source for those working in the field of philosophy. The present paper tries to answer the question _Is religious education compatible with the purposes of liberal education?_ This work argues that it is possible, and desirable, that democratic states built on liberal ideals include religious education in all schools since increasing the number of options among which the future citizen may choose the conception of the good with which he or she wishes to live is a condition for autonomy as one of its educational purposes. However, the proposal is (...) not based on religious confessional education, which by itself does not satisfy the liberal educational goals, but is redefined from the common noahide principles compatible both religious confessions and non-religious views of morality and citizenship. This paper is a critical and comparative legal historical study, which offers a global vision of the U.S. Legal System, according to the religious factor impact and its complex dimensions (e.g. religious liberty, Church-State relations, welfare state & solidarity). The principal goal is the deconstruction of the fake official History, elaborated after the Second World War (e.g. inferences, impostures, fallacies). At the same time, it shows the social development (and the kind of commitment in each period), and how it happens (...) the consolidation of the system thanks to the regulation. In this way, it is possible to pay attention to the American experimental evolution (not lineal or exceptional –as many U.S.hand-books pretend): from colonial Blue Laws (or Sunday regulation), up to the current regulation on freedom of religion and non-discrimination. Also, this paper offers a systematic set of diverse legal sources (e.g. Executive orders & rules, Legislative statutes, Judicial cases & resolutions). Another goal of this paper is the evaluation of the allegedly paradoxical policies and regulations in this field, during the last two Administrations (Clinton and W. Bush); both of them, from extreme views (linked at the end), they used incorrectly the religious factor, and they confused the institutions. Charles Peirce is widely credited as the originator of semiotics, or the general theory of signs, and recognized as the founder of American pragmatism, albeit in that peculiar kind Peirce himself went on to distinguish as “pragmaticism.” The semiotic and pragmatist strands in Peirce’s thought come together in an appraisal of scientific diagrammatic representations. Peirce’s pragmatic maxim entails that the consequences of a sign inform our entire conception of the sign, while his most considered semiotic system entails that a complex (...) sign partakes of iconic, indexical, and symbolic aspects. We illustrate Peirce’s insights by means of the celebrated Feynman Diagrams in Quantum Electrodynamics. We argue that Peirce’s late, post-1903, semiotics provides an adequate characterization of such “hypoicons,” and his pragmatic maxim explains how they can motivate and drive inquiry. We conclude that Peirce’s pragmatic approach to scientific diagrams remains a viable position that skillfully avoids dogmatic scientism and nihilistic skepticism alike. (shrink)

Over recent years, various semantics have been proposed for dealing with updates in the setting of logic programs. The availability of different semantics naturally raises the question of which are most adequate to model updates. A systematic approach to face this question is to identify general principles against which such semantics could be evaluated. In this paper we motivate and introduce a new such principle the refined extension principle. Such principle is complied with by the stable model semantics for (single) (...) logic programs. It turns out that none of the existing semantics for logic program updates, even though generalisations of the stable model semantics, comply with this principle. For this reason, we define a refinement of the dynamic stable model semantics for Dynamic Logic Programs that complies with the principle. (shrink)

The skills of thinking, reading conceptions and reading practice (literacy levels) found in textbook activities for the sixth year of Primary Education in Social Sciences and Spanish Language in Spain are analyzed in this paper. A mixed methodology is used to triangulate the data, integrating the critical analysis of discourse and two types of statistical analysis: descriptive (frequencies and percentages) and inferential (χ 2, ANOVA, and the Mann-Whitney U Test). The results inform us of both the permanence and the strengthening (...) of the design of an activity oriented toward the development of traditional conceptions of linguistic-cognitive reading. In the framework of education for global citizenship, the conclusion is the need for student reading practices that begin with the principles of critical literacy directed at the acquisition of social, critical, and creative thinking skills. Business Ethics: A European Review, EarlyView.

This study examines the cultural roots of ethical conflicts in the global business environment. It begins with a brief look at worldviews on ethical behavior in general. Based on this, it is argued that an in-depth understanding of ethical conflicts has been hampered by an overreliance on Western models and viewpoints. Three common sources, or bases, of ethical conflicts are discussed as they relate to business practices, including conflicts over tastes and preferences, the relative importance of moral imperatives compared to (...) legal requirements, and people’s level of tolerance for different values among others. It is then argued that an understanding of ethical conflicts can be facilitated through different levels of understanding, including the meaning of universal values, the relationship between values and practices, and the existence of multiple levels of conflict within the same organizations or industries. These specific and interrelated ingredients in cross-cultural ethical conflicts form the basis for a broader discussion of the meaning of truth as it relates to such conflicts. The paper concludes with the need for more research that is cross-cultural and multidisciplinary in order to improve theory building and managerial practice. (shrink)

As a continuation of the work of the third author in [5], we make further observations on the features of Galois cohomology in the general model theoretic context. We make explicit the connection between forms of definable groups and first cohomology sets with coefficients in a suitable automorphism group. We then use a method of twisting cohomology (inspired by Serre’s algebraic twisting) to describe arbitrary fibres in cohomology sequences—yielding a useful “finiteness” result on cohomology sets.Applied to the special case of (...) differential fields and Kolchin’s constrained cohomology, we complete results from [3] by proving that the first constrained cohomology set of a differential algebraic group over a bounded, differentially large, field is countable. Este artículo propone una relectura contemporánea de los textos de La Religión dentro de los límites de la mera razón en los cuales Kant esboza la idea de una comunidad ética universal. Esta idea kantiana se puede parangonar con las ideas de otros pensadores de la ilustración, que anticiparon la emergencia de nuevos sujetos sociales cosmopolitas diferentes del sujeto político encuadrado en las estructuras formales del Estado moderno, los cuales no se plantean fines directamente políticos, pero en cuanto tienen presencia (...) en el espacio público, adquieren también una relevancia política significativa. La comunidad ética, sin la cual no podríamos ser personas morales, es para Kant algo ya existente, como comunidades informales, particulares, fragmentadas, e independientes del sistema de las instituciones jurídico-políticas. Se trata de hacer reflexivos los fines morales de estas comunidades para que puedan abrirse a la unidad de todo el género humano. La significación de esta idea kantiana se redescubre y se puede valorar más adecuadamente recién hoy, en el contexto de los debates actuales de la filosofía política, a partir del descentramiento del Estado y del retorno de la sociedad civil, o de la recuperación de su autonomía, y de las redes de integración que significan formas de globalización alternativas. This study uses the American Association of University Women 1993 survey on sexual harassment in America's schools, a national sample of high school students, to examine gender differences in the behavioral, emotional, and educational consequences of sexual harassment. Previous research indicates that a high percentage of both boys and girls experience sexual harassment and that the negative consequences are greater for girls. The authors use a feminist theoretical framework to show that girls' and boys' qualitatively different experiences account for part (...) of this gender gap. Girls are far more likely to perceive harassment as harmful than boys and to experience a far greater frequency and severity of harassment. This article documents that girls are more likely to be targets of physical sexual harassment than boys and that physical harassment rather than derogatory or verbal and/or visual forms of harassment exacerbate the gender gap in educational outcomes. Objective: to determine the relationship between personal management and financial anxiety during COVID-19 times among residents of Northern Peru. Financial mismanagement, as a result of disorder in management and financial anxiety, leads to economic difficulties that can deteriorate citizens' health. Methodology: the approach was quantitative, of a basic type, at a descriptive correlational level, and included a sample of 360 residents from Northern Peru. Results: According to Spearman's Rho correlation, there is a negative correlation (r = -0.119) with a significance (...) of 0.024, which is less than 0.05. This indicates inadequate personal management knowledge that generated financial anxiety among the inhabitants of Northern Peru, due to the economic situation caused by the COVID-19 pandemic. Contribution: about health emergency, the risk and the possibility of knowledge in personal, social management warrants understanding the human person from various perspectives: economic, social, educational, legal, and political in a highly complex world. Se trata de examinar las relaciones entre amor, ética y justicia, adoptando cuatro perspectivas complementarias: en primer lugar, se aborda la confrontación con Freud, en su enconada diatriba contra el concepto de «amor al prójimo». En segundo lugar, se plantea la confrontación con Kant, bajo la forma de la disputa entre «amor» e «imperativo». Situados así en el terreno de la ética, se consideran las relaciones entre amor y justicia, sirviéndonos ante todo de los análisis de Ricoeur, para abordar finalmente (...) lo que podríamos denominar «el amor a los fuera de la ley», apoyándonos en algunos personajes literarios de Dostoievski. Actualmente existe un debate en torno a la naturaleza del sistema nobi a lo largo de la historia de Corea. Podemos encontrar historiadores que definen el sistema nobi como un sistema de esclavitud y a los nobi como esclavos, y a historiadores que prefieren definirlo como un sistema de servidumbre y a los nobi como siervos. En este artículo se expone la interpretación que el historiador estadounidense James B. Palais ofreció sobre el sistema nobi en la dinastía Joseon de Corea (...) a partir de su producción intelectual, poniendo un mayor énfasis en la interpretación ofrecida en su obra Confucian Statecraft and Korean Institutions: Yu Hyongwon and the Late Choson Dynasty, además de exponer las influencias intelectuales que motivaron esta interpretación por parte de Palais. La interpretación de Palais sobre el sistema nobi reviviría el debate en torno a la naturaleza del sistema nobi y sentaría las bases de la interpretación del sistema nobi para los futuros historiadores de Corea. La vida de cada cual es contingente, pero es una contingencia necesaria para una porción de vidas; aunque me atrevo a decir, incluso, que así es para la creación en continuidad. Creo que nosotros tenemos misión. La misión implica que aquello que no haga alguien quedará sin hacerse tal y como lo podría hacer esa persona. En otras palabras, la misión de cada cual, como la propia vida, exige y es disyunción,―o esto o aquello, así o de otro modo. Y (...) si tenemos en cuenta, que la realidad es sistemática, y que un sistema es orden de los elementos que se ve afectado por entero en caso de que suceda algo a alguno de los que lo componen, entonces para estar viviendo tal y como vivimos se nos revelan los otros como contingencias necesarias, imprescindibles. Bien podría hacer una aproximación a Pablo Posada desde la razón vital y algo habrá de ello a lo largo de estos párrafos, pero eso es una tarea prematura, como su muerte. (shrink)

In a recent work (Grasso et al., 2021 ), practitioners of the Integrated Information Theory (IIT) claim to have overcome the weaknesses of causal reductionism in producing a coherent account of causation, as causal reductionism would blatantly conflate causation with prediction and could not answer the question of ‘what caused what.’ In this paper, I reject such a dismissal of causal reductionism since IIT anti-reductionists misunderstand the reductionist stance. The reductionists can still invoke a causal account stemming from the causal (...) power of the universe’s basic units and interactions that, eventually, may lead to structures supporting integrated information. Additionally, I claim that the IIT-inspired misunderstanding of causal reductionism originates from the former’s metaphysical deficit, conflating information with causation. However, as a possible way out, if IIT is complemented with a deeper metaphysical ground, such as nested hylomorphism, an improved argument against causal reductionism can be made to work by invoking formal causality as the ultimate cause of integration in natural systems. The Shroud of Turin is an old linen fabric imprinted with the image of a tortured man who lies prone with his hands crossed before him. Since for many it is related to Jesus of Nazareth, this cloth is among the most studied, controversial and enigmatic of all archaeological and religious objects. Since its radiocarbon dating at the end of the eighties of the last century, it is considered by many to be an object made in the Middle Ages. The (...) controversy is due to the fact that there are other scientific and artistic evidences that place this object outside the medieval sphere. An argument map is a critical thinking way of representing the relationships between evidences and arguments, and is used here to represent the sequences of argumentation that defend that the Shroud of Turin is not a medieval object. The Epistemological Turn of the Twentieth Century’s Legal Positivism This article analyses the essential changes in the positivist law theory from its modern origins, usually remitted to Hobbes, Bentham and Austin, to the positivism of Kelsen and Hart. It is argued that a crucial epistemological break can be noticed, revealed in the most analytic-rationalistic character of Kelsen and Hart’s elaborations, compared to the more facts-descriptive style of their predecessors. Rationalism in Kelsen and Hart may explain the conventional character of the (...) basic norm and the rule of recognition, validity only formally, and the difficulty of accounting for the formal and substantive components. The change can be associated with Kelsen and Hart’s intellectual context, particularly Hume’s ‘guillotine’, the influences of logical positivism and neo-Kantian schools. This turn should not be overlooked since it casts doubts on the usual speaking of Kelsen and Hart’s legal positivism in the descriptive sense of nineteenth-century philosophers, with relevant consequences for thinking of law. Dentro de la historiografía centroamericana, el erotismo ha sido un tema que, en contraposición con otros como la reinterpretación del discurso histórico, no cuenta con una cantidad considerable de estudios comparativos que permitan comprender su desarrollo y sus diferentes acercamientos. Con este indicio, el artículo, en aras de enriquecer las discusiones académicas, se centra en dicha temática en cuentos centroamericanos escritos por mujeres, aspecto que en las últimas décadas ha venido tomando un lugar trascendental dentro de los estudios literarios. La tradición filosófica ha caracterizado el fenómeno de la normatividad, esto es, la capacidad de actuar según normas, como una capacidad exclusiva del ser humano. En contraposición, dicha tradición ha considerado que el comportamiento de los animales no humanos se reduce a meras respuestas al entorno, relegando su actividad al ámbito del instinto y la supervivencia. Sin embargo, los avances realizados a partir del siglo XX en el campo de la etología permiten cuestionar esta caracterización. El objetivo de este trabajo (...) es mostrar la existencia de aspectos normativos presentes en un tipo de comportamiento observado en diversas especies: el juego social. Realizaremos un análisis conceptual y una revisión crítica de la literatura filosófica y de los resultados reportados por la evidencia empírica relativa al juego social. A partir de una reconstrucción del concepto de “práctica” desarrollado por Rawls (1955), intentaremos mostrar que el juego social presenta características normativas que nos habilitan a extender la noción de práctica más allá de nuestra propia especie. Nuestro principal argumento presenta la siguiente estructura: (1) toda práctica supone, necesariamente, normatividad; (2) el juego social en animales presenta ciertas características estructurales por las cuales resulta pertinente describirlo como un tipo de práctica; y, por lo tanto, (3) la tesis de que ciertas especies de animales no humanos exhiben un comportamiento normativo es, al menos, plausible y merece ser considerada seriamente. A traditional account of coincidences has it that two facts are coincidental whenever they are not related as cause and effect and do not have a common cause. A recent contribution by Lando : 132–151, 2017) showed that this account is mistaken. In this paper, I argue against two alternative accounts of coincidences, one suggested by Lando, and another by Bhogal : 677–694, 2020), and defend a third one in their place. In short, I propose that how explanatory links relate (...) to non-coincidental facts in explanation is what drives a wedge between coincidences and non-coincidences. This proposal is not susceptible to the worries I raise, and is more general, since it is not restricted to coincidences and non-coincidences involving physical facts. (shrink)

The egalitarian ethos, as formulated by G.A. Cohen, and the unconditional basic income are two proposals that a priori may seem incompatible. The reason is that Cohen’s ethos – aimed at reducing inequality without sacrificing efficiency or freedom- requires that individuals work hard in socially useful occupations without asking for any inequality-generating incentives. On the contrary, the UBI, as conceived by Van Parijs and van der Veen, consists of an income paid by the government to every full member of society (...) regardless of their willingness to contribute to society in the form of work. In short, the ethos includes a productive requirement while the UBI has an unconditional character. However, if we introduce an absolute level of affluence above what occupational autonomy takes precedence over efficiency and if we broaden the range of socially useful contributions beyond formal employment, the tension between the egalitarian ethos and UBI will be alleviated. Is the macro grounded in the micro? That is, is every truth about a macroscopic object fully grounded in a truth wholly about its microscopic parts? In a recent interesting paper, Martin Glazier argued for a negative answer. Following him, call the position that the macro is grounded in the micro ‘priority micro pluralism’ (‘pluralism’ for short). In this discussion note, I propose a way out for the pluralist. In brief, it consists in the recognition that some metaphysical positions, including (...) pluralism, are best expressed by fundamentally de dicto grounding claims. In that these claims have a distinctive modal force, this recognition has far-reaching consequences that go beyond a defence of pluralism. (shrink)
