In the discussion of global ethics, philosophical ethics risks losing its distinct theoretical horizons. This predicament arises primarily from philosophy's failure to anchor its own object and to provide a rational basis for global justice from within its current confined theoretical paradigm. Against this background, this paper will first prioritize global co-existence as the primary concern of global ethics, then propose ontological co-existence justice as its foundational principle, and finally argue that the normative validity of co-existence (...) class='Hi'>justice is predicated on the nations fulfilling the critical requirements of modern civilization, namely, the advancement of individual freedom. Though much attention has been paid to different principles of justice, far less has been done reflecting on what the larger concern behind the notion is. In this work, Mathias Risse proposes that the perennial quest for justice is about ensuring that each individual has an appropriate place in what our uniquely human capacities permit us to build, produce, and maintain, and is appropriately respected for the capacity to hold such a place to begin with. Taking his cue from the third century Greek historian Polybius, who argued that the rapid domination of the Mediterranean world by Rome had instituted a new phase of world history, Hegel wondered what the rise of European modernity meant for the rest of the world. This article is an introduction to an ancient Egyptian text called The Tale of the Eloquent Peasant and an argument that it ought to be seen as a classic of political philosophy. After contextualizing the tale as part of a tradition of moral and political philosophy in ancient Egypt, I explore the methods by which the text defines the proper roles of political authority and contrast its approach to justifying political authority with the argument from the state of (...) nature so common in modern Western political philosophy. I claim that the tale's argument from dysfunction anticipates the move in contemporary Western political philosophy towards privileging non-ideal over ideal theory. I discuss challenges in translating the key term in the tale – ma'at – in light of the fact that it can be taken to mean ‘justice’ and/or ‘truth’. Finally, I discuss how the irony at the heart of its narrative can lead us to interpret the tale as having either conservative or revolutionary implications for the political system it depicts. It can be argued that political philosophy begins with the question “What is justice?” raised by Socrates in Plato’s Republic. This book rewrites the story of classical Chinese philosophy, which has always been considered the single most creative and vibrant chapter in the history of Chinese philosophy. Works attributed to Confucius, Mozi, Mencius, Laozi, Zhuangzi, Xunzi, Han Feizi and many others represent the very origins of moral and political thinking in China. As testimony to their enduring stature, in recent decades many Chinese intellectuals, and even leading politicians, have turned to those classics, especially Confucian texts, for alternative (...) or complementary sources of moral authority and political legitimacy. Therefore, philosophical inquiries into core normative values embedded in those classical texts are crucial to the ongoing scholarly discussion about China as China turns more culturally inward. It can also contribute to the spirited contemporary debate about the nature of philosophical reasoning, especially in the non-Western traditions. -/- This book offers a new narrative and interpretative framework about the origins of moral-political philosophy that tracks how the three normative values, humaneness, justice, and personal freedom, were formulated, reformulated, and contested by early Chinese philosophers in their effort to negotiate the relationship among three distinct domains, the personal, the familial, and the political. Such efforts took place as those thinkers were reimagining a new moral-political order, debating its guiding norms, and exploring possible sources within the context of an evolving understanding of Heaven and its relationship with the humans. Tao Jiang argues that the competing visions in that debate can be characterized as a contestation between partialist humaneness and impartialist justice as the guiding norm for the newly imagined moral-political order, with the Confucians, the Mohists, the Laoists, and the so-called fajia thinkers being the major participants, constituting the mainstream philosophical project during this period. Thinkers lined up differently along the justice-humaneness spectrum with earlier ones maintaining some continuity between the two normative values (or at least trying to accommodate both to some extent) while later ones leaning more toward their exclusivity in the political/public domain. Zhuangzi and the Zhuangists were the outliers of the mainstream moral-political debate who rejected the very parameter of humaneness versus justice in that discourse. They were a lone voice advocating personal freedom, but the Zhuangist expressions of freedom were self-restricted to the margins of the political world and the interiority of one's heartmind. Such a take can shed new light on how the Zhuangist approach to personal freedom would profoundly impact the development of this idea in pre-modern Chinese political and intellectual history. Philosophy of history has been condemned in recent times; however, it is becoming increasingly evident that a new Europe cannot do without a critical philosophy of history that analyses values and gives hierarchical structure to diverse experiences and historical memories. From this hypothesis, a result of previous projects, the project “Philosophy of History and Values in the Europe of the 21st century” has these fundamental objectives: 1) critically analyze the complex forms of conceiving science, (...) history (society), culture (languages, religion), law, ethics and politics, in order to understand the full scope of the idea of Europe in which we find ourselves; 2) systemize them with the proposal for a new critical philosophy of history, based on a “practical turn” that contemplates the elements (real responsibility, solidarity and justice) that should form the foundation of social and ethical political relations; 3) apply them to the constructionof a new Europe, in which implicit diversity and the demands of internationality, interculturality and dialogue between the genders can reconcile itself with the basic principles of universality, equality and justice and with the establishment of minimum human rights. The conclusions of our research will help to provide solutions to conflicts that are occurring in the heart of Europe, which at the high point of globalization, transcend European borders. (shrink)

There is a sense of doing justice prior to the juxtaposition of theory and practice, accounting for an ontological vulnerability prior to both social power andsocial vulnerability. Justice in the sense of “being true” involves fidelity to truth that we neither possess nor construct, preceding all efforts to enact justice. The charge to be just precedes any just act. There is a “patience of being,” or a receiving of being before acting, which we must then actively take (...) up. All this has implications for the practices of philosophy, including transcending the will to power by not clinging to one’s own place in History. The philosopher stands back and enters the void space of the human soul which is vulnerable, both terrorized and capable of terrorizing. This void is a “porosity of the soul” rather than pure nothingness. Though it is no particular project or activity, it allows all openness, receiving, and self-transcendence, and out of it comes the practical energy that feeds activity. The poverty of philosophy means relinquishing meaningless activity of construction in a purposeless universe by a willingness to be nothing, understanding the patience of being before servility and sovereignty, and the justice beyond them. Jurisprudence is the prudence of jus, law's consciousness and conscience. Throughout history, when thinkers wanted to contemplate the organisation of society or the relationship between authority and the subject, they turned to law. All great philosophers, from Plato to Hobbes, Kant, Hegel, Marx and Weber had either studied the law or had a deep understanding of legal operations. But jurisprudence is also the conscience of law, the exploration of law's justice and of an ideal law or equity at (...) the bar of which state law is always judged. Jurisprudence brings together 'is' and 'ought', the positive and the normative, law and justice. But after a long process of decay, legal theory is today characterised by cognitive and moral poverty. Jurisprudence has become restricted and academically peripheral, a guidebook to technocratic legalism and a legitimation of the existent. Critical jurisprudence returns to the classical tradition of a general philosophy of law and adopts a much wider concept of legality. It is concerned both with posited law and with the law of the law. All legal aspects of the economic, political, emotional and physical modes of production and reproduction of society are part of critical jurisprudence. This widening of scope allows a radical rethinking of the nature of rights, justice, sovereignty and judgement. A political philosophy of justice today must examine the political economy of law; transitions from Empire to nation; ideological and imaginary constructions through which we understand ourselves and relate to others; ways in which gender, race or sexuality create forms of identity that both discipline bodies and offer sites of resistance. Law's complicity with political oppression, violence and racism has to be faced before it is possible to speak of a new beginning for legal thought, which in turn is the necessary precondition for a theory of justice. Critical Jurisprudence offers an ethics of law against the nihilism of power and an aesthetics of existence for the melancholic lawyer. (shrink)

What happened in New York City on September 11, 2001, creates an urgent need for a turn to practical reason, to ethics, to critique, and to a radical,transformative theory and praxis. Contemplation, speculation, pure theory, and contemplative metaphysics in philosophy, while necessary and valuable, are notsufficient in dealing with such an infamous crime against humanity. The central idea running through this paper and much of my work is that there is an essentiallink between rationality and radicalism. Some scholars have recently found commonalities between Hume's motivational psychology and Kantian understandings of reason and obligation. Although this trend corrects certain misreadings of Hume, it goes too far in other respects. This essay argues that we can understand Hume's explanation of the artificial virtue of justice in a way that avoids such mistakes. I begin by considering Stephen Darwall's argument that features of Hume's account of justice reveal an inadequacy in the empirical naturalist tradition and underlying commitments (...) to the proto-Kantian tradition. I argue that a broader understanding of Hume's ethics and reinterpreting crucial passages dissolve Darwall's 'puzzles' about Humean justice. I defend Hume against the charge of inconsistency by suggesting an alternative interpretation of his theory of the will and his arguments about the justice's development as a virtue. Finally, I argue that Hume's theory of the will can consistently account for motives to Humean justice, properly understood. (shrink)

A signal difference is that it is more constrained in its coverage of figures, texts, and especially in having the topical focus upon moral-political philosophy. At the same time and within the chosen (narrower) confines, it often examines its subject in greater detail and draws on more recent discussions.One neat thing that Jiang does is to deliberately weave in explicit discussions of how each subsequent thinker or text incorporated or criticized ideas associated with earlier thinkers. (I formulated it this way since there isn't enough historical evidence about who-actually-read-what in the ancient world, citation practices being what they were.) But I do wonder if we need to step back and start from a wider context involving what is potentially a deeper divide.Now, it is entirely a caricature but the joke around the water cooler is that philosophers—especially those of a more "analytic" bent—often exude the attitude that they are not in the business of reading old books. Their project is one focused on issues and problems and puzzles that are ultimately about the natural and human world, rather than about texts and their interpretation, or even the historical thinkers themselves. To give some obvious examples, the intellectual questions they see themselves as answering are the likes of:• Can we know that God exists, if God exists at all?• What is the nature of moral claims? Do they admit of truth and falsity?• How is causation related to possibility?• Is a logic that dispenses with the law of non-contradiction viable?• What are the necessary and sufficient conditions of knowledge?• Is abortion morally justifiable?Sometimes the questions they ask even infringe on the results and insights from nearby fields, for instance linguistics and the natural and empirical sciences:• What is time?• Can a presentist conception of time be made consistent with contemporary physics?• What is the nature of consciousness? How is it related to physical neural states or informational computational processes?• Can computers be sentient?• How is morality related to the passions?• In what sense is a political order that does justice to diversity of moral beliefs...
