First collection of essays entirely devoted to the inscription of Diogenes of Oinoanda. The texts of Diogenes of Oinoanda (2nd century AD) who invited his readers to an Epicurean life is the largest ancient inscription ever discovered. Over 70 new finds have increased the number of known wall blocks and fragments to nearly 300, offering new insights into Diogenes' distinctive presentation of philosophy. This collection of essays discusses the philosophical significance of these discoveries and is the first of this kind (...) entirely devoted to Diogenes of Oinoanda. Particular attention is paid to his philosophical aims and polemical strategies. Diogenes was apparently well aware of still ongoing philosophical debates, engaging in polemics against Presocratic philosophers, Platonics, and especially Stoics. His views about important issues like happiness, fear, old age, and the afterlife are explained on the bases of Epicurean physics and theology, ethics, politics, theory of knowledge, and psychology. The article investigates how Diogenes of Oenoanda in his huge 2ndcent. AD Epicurean wall inscription deals with the control of fear. It argues for restoring the fragmentary title of Diogenes’Ethics–treatise with “feelings [of soul] and [body]”. In this way the importance given inEthicsto the evaluation of our feelings according to the Epicurean doctrine is reflected in the title. Diogenes in his introduction to the whole inscription lists up the control of irrational fears in the first place of achievements of Epicureanism. (...) The analysis of the relevant passages on hisEthicsresults in assigning fr. 47 III–IV and NF 137 to a subsection dealing with fear of pain from diseases which on the inscription must have followed fr. 48. Fear from gods is abundantly discussed in the recently combinedTheological Physics Sequence. The article argues, that this topic was not treated once more inEthics. Indeed, the “unclear fear” mentioned in fr. 35 (Ethics) refers, as a comparison with Epic.Ep. In Between Facts and Norms, Jürgen Habermas works out the legal and political implications of his Theory of Communicative Action (1981), bringing to fruition the project announced with his publication of The Structural Transformation of the Public Sphere in 1962. This new work is a major contribution to recent debates on the rule of law and the possibilities of democracy in postindustrial societies, but it is much more. The introduction by William Rehg succinctly captures the special nature of the work, (...) noting that it offers a sweeping, sociologically informed conceptualization of law and basic rights, a normative account of the rule of law and the constitutional state, an attempt to bridge normative and empirical approaches to democracy, and an account of the social context required for democracy. Finally, the work frames and caps these arguments with a bold proposal for a new paradigm of law that goes beyond the dichotomies that have afflicted modern political theory from its inception and that still underlie current controversies between so-called liberals and civic republicans. The book includes a postscript written in 1994, which restates the argument in light of its initial reception, and two appendixes, which cover key developments that preceded the book. This anthology brings together for the first time, in revised or new translation, ten essays that present the main concerns of Jürgen Habermas's program in formal pragmatics. Jürgen Habermas's program in formal pragmatics fulfills two main functions. First, it serves as the theoretical underpinning for his theory of communicative action, a crucial element in his theory of society. Second, it contributes to ongoing philosophical discussion of problems concerning meaning, truth, rationality, and action. By the "pragmatic" dimensions of language, Habermas means (...) those pertaining specifically to the employment of sentences in utterances. He makes clear that "formal" is to be understood in a tolerant sense to refer to the rational reconstruction of general intuitions or competences. Formal pragmatics, then, aims at a systematic reconstruction of the intuitive linguistic knowledge of competent subjects as it is used in everyday communicative practices. His program may thus be distinguished from empirical pragmatics--for example, sociolinguistics--which looks primarily at particular situations of use. In this essay, I address the question of whether the indisputable progress being made by the neurosciences poses a genuine threat to the language game of responsible agency. I begin by situating free will as an ineliminable component of our practices of attributing responsibility and holding one another accountable, illustrating this via a discussion of legal discourse regarding the attribution of responsibility for criminal acts. I then turn to the practical limits on agents' scientific self-objectivation, limits that turn out to (...) be mirrored philosophically in the conceptual problems that plague reductionist strategies. Having shown that free will is rooted in unavoidable performative presuppositions belonging to agents' participant perspective, I then take up the difficult issue of how to reconcile an epistemic dualism of participant and observer perspectives with the assumption of ontological monism. I critically review a range of proposed physicalist solutions, including non-reductionist and (standard) compatibilist approaches. An underlying problem with scientistic, physicalist approaches is the methodological fiction of an exclusive ?view from nowhere? which relies on the problematic move of disengaging the objectivating perspective of the scientific observer from the investigators' participant perspective of those engaged in scientific practice. Since there is no way of getting around the requisite complementarity of both the observer's encounter with the objective world and the participant's involvement in shared lifeworld practices, the remaining option is to take an epistemological turn. But even the recognition that science is ultimately constituted from within the lifeworld still leaves us with the question as to how the human mind can understand itself as the product of natural evolution. I conclude with some tentative suggestions as to how this difficult question might be addressed. (shrink)

Ingenieur- und Naturwissenschaften sind als ars humana zudem stets eine Form menschlicher Handlung. Damit werden sie zu einem Schlüsselproblem der theoretischen und praktischen Philosophie. Denn der Mensch, seine Handlungen und seine Eingliederung in die Gesellschaft stehen ebenso wie die Natur und die (...) Kultur seit jeher im Zentrum philosophischer Untersuchungen. Die Philosophie vermag diese beiden Wissenschaftsbereiche zu fundieren und kritisch zu begleiten. Philosophie, Ingenieur- und Naturwissenschaften haben das Vermögen, sich gegenseitig zu befruchten. In Anbetracht der humanen, sozialen und ökologischen Probleme des 21. Jhds. ist die fachbereichsübergreifende und partnerschaftliche Zusammenarbeit dieser drei Schlüsselbereiche unabdingbar. Methodenstreit in Economics. This essay offers an account of the Methodenstreit in economics between first Menger and Schmoller and later Max Weber and again Schmoller. It is argued that, for Schmoller, two issues were central; to use economics (widely conceived) as an instrument for economic policy and notably social policy: and to base the science empirically with all the modern methods available. Goethe’s encounter with Napoleon, in which the poet succeeded in standing up to the emperor at eye level, was of such self-preserving significance. For Blumenberg himself, his sole encounter with Thomas Mann was of comparable significance, since the Nobel prize-winner asserted himself in the face of the ascendant Nazis as the representative (...) of Goethe and the defender of a humane world. Blumenberg likewise sought contact with Carl Schmitt in order to claim his own interpretative sovereignty over Goethe and thereby — following the model of Goethe and Thomas Mann — assert himself against a representative of the Third Reich. The essay deals with the question whether Fichte’s socio-economic model which based both on the experiences and ideas of his time. Additionally, it explores how his socio-economic theorems stood out against cameralistic and feudal-conservative discussions and to what extent they can be described as an early critique of capitalism. Is the essence of Fichte’s socio-economic ideas to be seen in his model of state regulation or rather in his methodological claim of genetically developing the phenomena by showing their mediating links? (...) What is however still relevant today is Fichte’s idea that human beings are not the objects or means of social relations but their subjects and aims. For this purpose, Fichte developed a concept of justice that is constitutive for his notion of society. Democracy aiming at an active use of reason and social justice are the two moments which depend on each other. (shrink)

It is known that in connection with proposed educational reforms in the German states around 1800, Johann Gottliebe Fichte, following the Enlightenment concepts, developed a program, which considered education as an indispensable human right. In this program, the idea of providing all the citizens with the opportunity to get an education has been formulated as a social task and a condition of social and political modernization. In accordance with Fichte’s thought, over the cultivation of individuals, a new morality, and then, (...) on that basis, a new civic subject had to shape itself. The science thenceforth should have obtained a function of organizing a new society, in Fichte’s vision of it, instead of theology having previously played that role, while the public education system should have mediated the application of the scientific principles of organizing the society and thus to become a driving force in this development process. The generally accessible education and science were conceived by Fichte as autonomous moments of social organization, being the area intact by any immediate influence of authorities and based on the principles of individuals’ free communication. Fichte’s theorem of intersubjectivity has introduced an understanding of teaching as a social and communicative process into the ethical and political, as well as into the educational thought. It was not limited to reproduction of predetermined skills by the subject, but took into account the subject’s formation in the course of actively perception of educational contents and the change of the subject himself taking place by that. Фихтевская теорема интерсубъективности ввела в этико-политическую и педагогическую мысль понимание обучения как социально-коммуникативного процесса, не ограничивающегося воспроизведением субъектом предзаданных навыков, но имеющего в виду его образование в ходе активного восприятия учебного материала и осуществляющееся при этом изменение самого субъекта. Arming uninhabited vehicles is an increasing trend. Widespread deployment can bring dangers for arms-control agreements and international humanitarian law. Armed UVs can destabilise the situation between potential opponents. Smaller systems can be used for terrorism. Using a systematic definition existing international regulation of armed UVs in the fields of arms control, export control and transparency measures is reviewed; these partly include armed UVs, but leave large gaps. For preventive arms control a general prohibition of armed UVs would be best. If (...) that is unattainable, several measures should be taken. An explicit prohibition of autonomous attack, that is without a human decision, should be added to IHL. Concerning armed UVs remotely controlled by a human soldier, recommendations differ according to type or mission. New kinds of uninhabited nuclear-weapon carriers should be banned. Space weapons should be prohibited in general. UVs smaller than 0.2–0.5 m should be banned. Bigger remotely controlled armed UVs not equipped with weapons of mass destruction should be subject to numerical limitations in various categories. For these the Treaty on Conventional Armed Forces in Europe is an important precedent. (shrink)

This monograph is a collection of conference contributions chosen by the editors who led a three-year project on evolution, cooperation, and rationality. The collected works are held together by a six-page introduction identifying common strands and differences of positions in the different chapters. Since no two chapters have a common author, the chapters do not build on each other. Rather, they offer a variety of perspectives on a number of different aspects of rationality and evolution. The monograph thus does not (...) offer a unified account of evolution and rationality despite the possibly somewhat misleading title, nor is there a clearly identifiable overarching theme that runs through the entire book. However, the fact that the term occurs only six times in the 400 pages of the emPhilosophy of Right/em has obscured its structural role, and accordingly scholarly effort is scant on the concept as it might pertain to this work. It is the argument of this paper that despite its lsquo;invisibilityrsquo; it governs foreground proceedings as (...) if from behind a curtain, for it cannot be gainsaid that the conceptual foundation of the Rights empresupposes/em the principle of recognition. The suspicion has been voiced that Hegel deliberately emsuppressed/em reminders of the presence of emAnerkennung/em in his philosophy of rights in order to distance himself from the perceived limitations of the Fichtean exposition of the concept. Accordingly this paper brings up the background of Fichte and examines the PhR in its strategic dispositions to uncover the recognitive structure implied in it. (shrink)
