From the perspective of a contemporary German reader, one consideration is particularly important from the start. Illumination of the political conduct of Martin Heidegger cannot and should not serve the purpose of a global depreciation of his thought. As a personality of recent history, Heidegger comes, like every other such personality, under the judgment of the historian. In Farias’ book as well, actions and courses of conduct are presented that suggest a detached evaluation of Heidegger’s character. But in general, as (...) members of a later generation who cannot know how we would have acted under conditions of a political dictatorship, we do well to refrain from moral judgments on actions and omissions from the Nazi era. Karl Jaspers, a friend and contemporary of Heidegger, was in a different position. In a report that the denazification committee of the University of Freiburg at the end of 1945, he passed judgment on Heidegger’s “mode of thinking”: it seemed to him “in its essence unfree, dictatorial, uncommunicative.”7 This judgment is itself no less informative about Jaspers than about Heidegger. In making evaluations of this sort Jaspers, as can be seen from his book on Friedrich Schelling, was guided by the strict maxim that whatever truth a philosophical doctrine contains must be mirrored in the mentality and lifestyle of the philosopher. This rigorous conception of the unity of work and person seems to me inadequate to the autonomy of thought and, indeed, to the general history of the reception and influence of philosophical thought. I do not mean by this to deny all internal connection between philosophical works and the biographical contexts from which they come—or to limit the responsibility attached to an author, who during his lifetime can always react to unintended consequences of his utterances. 7. In this essay, I address the question of whether the indisputable progress being made by the neurosciences poses a genuine threat to the language game of responsible agency. I begin by situating free will as an ineliminable component of our practices of attributing responsibility and holding one another accountable, illustrating this via a discussion of legal discourse regarding the attribution of responsibility for criminal acts. I then turn to the practical limits on agents' scientific self-objectivation, limits that turn out to (...) be mirrored philosophically in the conceptual problems that plague reductionist strategies. Having shown that free will is rooted in unavoidable performative presuppositions belonging to agents' participant perspective, I then take up the difficult issue of how to reconcile an epistemic dualism of participant and observer perspectives with the assumption of ontological monism. I critically review a range of proposed physicalist solutions, including non-reductionist and (standard) compatibilist approaches. An underlying problem with scientistic, physicalist approaches is the methodological fiction of an exclusive ?view from nowhere? which relies on the problematic move of disengaging the objectivating perspective of the scientific observer from the investigators' participant perspective of those engaged in scientific practice. Since there is no way of getting around the requisite complementarity of both the observer's encounter with the objective world and the participant's involvement in shared lifeworld practices, the remaining option is to take an epistemological turn. But even the recognition that science is ultimately constituted from within the lifeworld still leaves us with the question as to how the human mind can understand itself as the product of natural evolution. I conclude with some tentative suggestions as to how this difficult question might be addressed. (shrink)

Ellsberg's (1961) famous paradox shows that decision-makers give events with ‘known’ probabilities a higher weight in their outcome evaluation. In the same article, Ellsberg suggests a preference representation which has intuitive appeal but lacks an axiomatic foundation. Schmeidler (1989) and Gilboa (1987) provide an axiomatisation for expected utility with non-additive probabilities. This paper introduces E-capacities as a representation of beliefs which incorporates objective information about the probability of events. It can be shown that the Choquet integral of an E-capacity is (...) the Ellsberg representation. The paper further explores properties of this representation of beliefs and provides an axiomatisation for them. (shrink)

Ever since Hegel made poignant the difference between morality and ethical life, philosophical discourse in the traditions that developed subsequently, up to and including the Frankfurt school, has oscillated between those poles. This paper starts out with a short exposition of autonomy as one of the few large-scale innovations in the history of philosophy and then proceeds to discuss Hegel’s concept of “Sittlichkeit” and the objections to be raised against it from a Kantian point of view. Political theory, however, has (...) to move beyond pure normativism and consider actual social relations of power, as Marx disclosed. Mapping out this winding trajectory from Kant to Marx provides some perspective that may be illuminating for challenging present-day issues. (shrink)

Contractarian theories are meant to settle the issue of when political authority meets the conditions of rational legitimacy. The author addresses the same issue, but using different premises and a different conceptual frame. He takes as his point of departure the two basic problems which rational collective will‐formation refers to ‐ conflict‐resolution and goal attainment. He then introduces the codes of law and power, with which such will‐formation can be institutionalized. The legitimation gap that then still remains open can be (...) filled by a practical reason which is not limited simply to morality but also permeates the procedures of law application, policy‐formation and legislation. In a series of lectures on German philosophy ‘since Kant’, the names of Fichte, Schelling, and Hegel and their critical reference to Kant are, of course, a must. No less a must, though, would seem to be Wilhelm von Humboldt, a philosopher and linguist who, together with Herder and Hamann, formed the alliterating triumvirate of a romanticist critique of Kant. The response, within the discipline, to transcendental philosophy from this side was, in contrast to the idealistic mainstream, long in the (...) coming but, in the end, rich in consequences. This paper focuses on the question: Do persisting disagreements in constitutional interpretation affect the legitimacy of “the democratic system as a whole”? According to both Michelman and Waldron, the epistemic indeterminacy of interpretation—that is, the fact that principles do not possess stable meanings beyond, and independent of, their application to concrete cases—puts its finger on a point of the contractualist and prevailing political theory. But, if neither the legitimacy of any democratic order nor the standard of internal criticism can be (...) founded on a broad background consensus on constitutional essentials, “what else makes a deliberative process of legislation and adjudication a generator of legitimacy so that citizens are induced to accept controversial results as ‘worthy of respect’?” The route pursued goes beyond all views that require legitimacy to be based on sharing a set of “thick” ethical beliefs. In this perspective, the author argues that the performative meaning of constitution‐making “provides a thin yet sufficiently strong base,” which corresponds to the minimal requirements inherent in the very practice of framing a constitution. Analogy making from examples is a central task in intelligent system behavior. A lot of real world problems involve analogy making and generalization. Research investigates these questions by building computer models of human thinking concepts. These concepts can be divided into high level approaches as used in cognitive science and low level models as used in neural networks. Applications range over the spectrum of recognition, categorization and analogy reasoning. A major part of legal reasoning could be formally interpreted as an (...) analogy making process. Because it is not the same as reasoning in mathematics or the physical sciences, it is necessary to use a method, which incorporates first the ability to specify likelihood and second the opportunity of including known court decisions. We use for modelling the analogy making process in legal reasoning neural networks and fuzzy systems. In the first part of the paper a neural network is described to identify precedents of immaterial damages. The second application presents a fuzzy system for determining the required waiting period after traffic accidents. Both examples demonstrate how to model reasoning in legal applications analogous to recent decisions: first, by learning a system with court decisions, and second, by analyzing, modelling and testing the decision making with a fuzzy system. The general relativistic and covariant differential form of Helmholtz's first vorticity theorem is presented. We prove in relation with it an invariant kinematic identity which is the generalisation of the Helmholtz theorem for general continua.
