Bu çalışmanın amacı İbn Kesîr’in (öl. 774/1373) el-Bidâye ve’n-nihâye isimli tarih çalışmasının siyer bölümünde Sahîhayn hadislerini muhteva açısından tenkidinin araştırılması ve tahlilidir. Çalışmamızın konusu ise İbn Kesîr’in mezkûr eserinde yirmi Sahihayn hadisini Kur’ân-ı Kerîm (3 hadis), akıl (1 hadis), icmâ (1 hadis), sahih hadisler (7 hadis) ve sağlam târihî bilgilere (8 hadis) uygunluk/aykırılık kıstaslarını kullanarak tenkidi ve on dört hadiste izah getiremediği yanlışların birer hata olduğunu kaydetmesidir. İbn Kesîr’in incelenen hadislerin muhteva tenkidine müsait bir hâle gelmesine yol açan râvi tasarruflarına (...) dair verdiği bilgiler ayrıca kıymetlidir. Bu çalışmanın kapsamını oluşturan hadislerden yedi tanesi hem Sahîh-i Buhârî hem Sahîh-i Müslim, altı tanesi sadece Sahîh-i Buhârî, yedi tanesi de sadece Sahîh-i Müslim’de yer almaktadır. Hem Sahîh-i Buhârî hem Sahîh-i Müslim’de yer alan hadisler Hayber’de müt‘a nikahının yasaklanışı, Rasulullah’ın (s.a.v.) umre ve hacca niyeti, Hz. Peygamber’in gümüş yüzüğü atması, kıblenin değişimi haberinin Kubâ’ya ertesi sabah ulaşması, namazda konuşma yasağının zamanı, ye’cûc ve me’cûc’un seddinin delinmesi ve Hz. Araştırmamızın yöntemi kaynak taraması ve sonuçların diğer şarihlerinkiyle mukayeseli tahlilidir. Araştırmamızın sonucunda eleştirilen hadislerin büyük bir kısmında İbn Kesîr’in değerlendirmelerinin İbn Hacer ve Nevevî gibi muhaddislerinkinden farklı olduğu görülmüştür. Çalışmamızın önemi İbn Kesîr’in tenkitlerinin muhaddislerin senedin sıhhatinin metnin sıhhatini temin etmeyeceğine dair tespitlerinin uygulamadaki somut delillerini oluşturmasıdır. Kısaca İbn Kesîr’in, eserine güçlü tenkit zihniyetini, özgün görüşlerini ve geniş ilmî birikimini başarıyla yansıttığı görülmektedir. (shrink)

In this article, I offer a reading of City of God 19.6 that is consonant with Augustine’s message to real judges. Often read as a suggestion that torture and execution are judicially necessary, I argue that 19.6 actually calls such necessities into question, though this is not its primary purpose; first and foremost, 19.6 is an indictment of Stoic apatheia. Situating 19.6 within Augustine’s larger polemic against the Stoics, I find that it presents the Stoic judge as a man who (...) lacks fellow feeling, and therefore, has only a parodic happiness, costly to himself and those judges. A new look at Augustine’s letters to judges confirms this reading, and shows that, for Augustine, the man of humanitas is the true model for the good judge, not the man of apatheia. (shrink)

In this volume, Veronica Roberts Ogle offers a new reading of Augustine's political thought as it is presented in City of God. Focusing on the relationship between politics and the earthly city, she argues that a precise understanding of Augustine's vision can only be reached through a careful consideration of the work's rhetorical strategy and sacramental worldview. Ogle draws on Christian theology and political thought, moral philosophy, and semiotic theory to make her argument. Laying out Augustine's understanding of (...) the earthly city, she proceeds by tracing out his rhetorical strategy and concludes by articulating his sacramental vision and the place of politics within it. Ogle thus suggests a new way of determining the status of politics in Augustine's thought. Her study clarifies seemingly contradictory passages in his text, highlights the nuance of his position, and captures the unity of his vision as presented in City of God. (shrink)

In this pilot study, deliberate practice and competence-based assessment were incorporated into a first-year graduate course on professional issues and ethics. Students responded to challenging simulations of basic ethical situations in therapy before and after the course. Aspects of deliberate practice were incorporated into the course. Student self-report ratings and independent performance ratings blind to timing found improvements in students’ ability to manage basic ethical situations in practice. Pilot evidence suggests competence-based assessment and training have potential use for training students (...) preparing to engage in their first therapy practicum experiences. Additional controlled studies are needed to examine the benefits of competence-based assessment and training. (shrink)

To the untrained eye, it may seem as if debates concerning the various properties and abilities of (...) purely spiritual beings are the epitome of Scholastic extravagance, which can be safely disregarded—if not outright ridiculed—as a fanciful diversion from more essential philosophical concerns. The truth, of course, is that angelological reflection gave rise to some of the most original philosophical ideas of the Middle Ages, from Anselm's two affectiones of the will to Aquinas's "real distinction" between essence and existence. Far from being an idiosyncratic theological addendum to an already complete philosophical system, consideration of the angelic nature was in fact a central component of medieval philosophy, without which certain crucial metaphysical and psychological insights might not have occurred. This often-neglected truth is given detailed expression in Tobias Hoffmann's Free Will and the Rebel Angels in Medieval Philosophy, which explores how philosophical investigation into the fall of the angels—that is, the hypothesis of an evil choice made by rational beings under optimal psychological conditions—helped bring about significant advances in medieval debates about free will. Focusing on the century immediately following the reception of Aristotle's action theory in the Latin West (from roughly the 1220s to the 1320s), Hoffmann examines how theological claims regarding angelic sin influenced medieval thinkers as they sought to reconcile the intellectualism of Aristotelian moral psychology with their understanding of free will as the power to choose between alternatives.This period is particularly deserving of study, Hoffmann argues, because it was then that the existence of free will first began to be "investigated within a philosophical account of action," rather than merely asserted on theological grounds as a necessary corollary of the doctrines of grace and sin (1). Consequently, theological anthropology took what Hoffmann calls a "psychological turn," with theologians newly determined to explain rational agency in terms of the interaction between different powers of the soul. In Hoffmann's estimation, the subsequent debates over the respective roles of intellect and will in the process of decision-making, as well as the relation between faulty cognition and voluntary wrongdoing, gave rise to some of the most innovative theories of free will in the later Middle Ages—including not only those of celebrated thinkers such as Thomas Aquinas and John Duns Scotus, but also those of lesser-known luminaries such as [End Page 388] John of Pouilly and Peter Auriol. Although the concerns that motivated these debates were primarily anthropological, having to do with specifically human psychological processes, Hoffmann's study foregrounds the role that the angels played in the unfolding of various controversies. Comparing medieval angelological discussion to the thought experiments commonly employed by contemporary philosophers, Hoffmann argues that angels proved significant because they provided a subject matter in which rational freedom could be considered in a pure and ideal form, abstracted from any material constraints (3). Judgments of moral culpability play a crucial role in our lives, providing a basis for practices of accountability that are essential to a just society. Yet when they exceed their proper limits, such judgments can breed resentment and mistrust, thereby undermining the social bonds that they are meant to preserve. In this essay, I explore this tension in cases where the person being judged is sincerely ignorant of having done anything wrong. Drawing upon Aquinas’s discussion of negligence as a cause (...) of sin, I argue that individuals can sometimes be accountable for sins of which they are completely unaware, but only when this ignorance is of something that they could and should have known. Such a perspective, I suggest, offers a helpful way of addressing contemporary concerns regarding social sin and systemic injustice from within the Thomistic tradition. (shrink)

While many scholars have explored the Ciceronian roots of Augustine’s thought, the influence of De Finibus on De ciuitate dei has, as yet, remained unexamined. Dismissed by Testard as abstract and scholastic, De Finibus has long remained in the shadow of Cicero’s other work of moral philosophy, Tusculanae Dispuationes. This article reconsiders the nature of De Finibus and demonstrates its importance for De ciuitate dei. It begins by arguing that the dialogue is actually a meta-commentary on philosophic dogmatism, showing how (...) each of the schools that Cicero’s interlocutors represent—i.e., the Epicureans, Stoics, and Peripatetics—claim certainty about the Wise Man’s happiness. At the heart of the dialogue’s drama is Cicero’s skepticism about this claim. This article then shows how Augustine picks up on Cicero’s explanation as to why the adherents of these schools cling so tightly to their belief in the Wise Man’s happiness. Echoing Cicero, Augustine suggests that the reason for this belief is therapeutic. Going beyond Cicero, however, he diagnoses it as a symptom of pride, arguing that what the philosophers really need is not a model of self-sufficient virtue, but a Mediator. The article ends by briefly considering how Cicero might respond to Augustine’s position. (shrink)

The present collection of essays is dedicated to the work of Elizabeth Anscombe, in particular her work collected in the Anscombe Archive at the University of Pennsylvania. The collection brings together scholars working on Anscombe and her tradition, all of whom have significant expertise in Anscombe’s philosophical thought, with many having worked directly at the Archive. Trait emotional intelligence (“trait EI”) concerns our perceptions of our emotional abilities, that is, how good we believe we are in terms of understanding, regulating, and expressing emotions in order to adapt to our environment and maintain well-being. In this article, we present succinct summaries of selected findings from research on (a) the location of trait EI in personality factor space, (b) the biological underpinnings of the construct, (c) indicative applications in the areas of clinical, health, social, educational, organizational, and (...) developmental psychology, and (d) trait EI training. Findings to date suggest that individual differences in trait EI are a consistent predictor of human behavior across the life span. (shrink)

The distribution of scarce healthcare resources is an increasingly important issue due to factors such as expensive ‘high tech’ medicine, longer life expectancies and the rising prevalence of chronic illness. Furthermore, in the current healthcare context lifestyle-related factors such as high blood pressure, tobacco use and obesity are believed to contribute significantly to the global burden of disease. As such, this paper focuses on an ongoing debate in the academic literature regarding the role of responsibility for illness in healthcare resource (...) allocation: should patients with self-caused illness receive lower priority in access to healthcare resources? This paper critically describes the lower priority debate's 12 key arguments and maps out their relationships. This analysis reveals that most arguments have been refuted and that the debate has stalled and remains unresolved. In conclusion, we suggest progression could be achieved by inviting multidisciplinary input from a range of stakeholders for the development of evidence-based critical evaluations of existing arguments and the development of novel arguments, including the outstanding rebuttals. This study aimed to investigate whether a range of tasks that have been generally classed as requiring insight form an empirically separable group of tasks distinct from tasks generally classed as non-insight. In this study, 24 insight tasks, 10 non-insight tasks, and tests of individual differences in cognitive abilities and working memory were administered to 60 participants. Cluster analysis of the problem-solving tasks indicated that the presumed insight problems did tend to cluster with other presumed insight problems, and similarly the (...) presumed non-insight problems tended to cluster with other presumed non-insight tasks. Performance on presumed insight problems was particularly linked to measures of ideational flexibility with a different pattern of results for the non-insight tasks. Spatial insight problems were linked to spatial flexibility and verbal insight tasks were linked to vocabulary scores. The results are discussed in relation to recent developments of dual process theories of thinking. (shrink)

Since Erich Lindemann's seminal work on 'the symptomatology and management of acute grief' from 1944, it has been common to define grief through its particular emotional structure and dynamics. According to this perspective, grief announces itself in socalled 'pangs of grief' in which the bereaved is occasionally flooded by waves of emotions. This picture has become so ingrained in our understanding of grief that it has defined both public discourse on grief and contemporary clinical constructs. In this paper, I propose (...) that underneath grief's fluctuating emotivity, there is a deeper feeling of grief. This deeper feeling reflects an altered mode of being in the world in which the bereaved experiences herself as 'at a distance' from the worldly. I will refer to this state as world-distancing and emphasize it as a protective affective state that shields the bereaved from a limit situation in which the world has become overwhelming in the absence of the deceased. It is experienced as being in a bubble or as if enclosed in a kind of membrane that shields the bereaved from the intrusiveness and penetrating character of the world. Worlddistancing, however, comes with significant perils if the bereaved are unable to reattach to the world. I outline this danger as a state of existential loneliness that follows from what Eugené Minkowski termed a felt lack of vital contact with the world. (shrink)

Although science supplies medicine's “gold standard,” knowledge exercised in the care of patients is, like moral knowing, a matter of narrative, practical reason. Physicians draw on case narrative to store experience and to apply and qualify the general rules of medical science. Literature aids in this activity by stimulating moral imagination and by requiring its readers to engage in the retrospective construction of a situated, subjective account of events. Narrative truths are provisional, uncertain, derived from narrators whose standpoints are always (...) situated, particular, and uncertain, but open to comparison and reinterpretation. Reading is thus a model for knowing in both morality and clinical medicine. While principles remain essential to bioethics and science must always inform good clinical practice, the tendency to collapse morality into principles and medicine into science impoverishes both practices. Moral knowing is not separable from clinical judgment. While ethics must be open to discussion and interpretation by patients, families, and society, it is nevertheless substantively and epistemologically an inextricable part of a physician's clinical practice. This essay discusses an alternative interpretation of the term “Dasein” as Heidegger uses it in Being and Time and, in particular, the possibility that Dasein is meant to contain an inherent form of intersubjectivity to which we must “return” in order to achieve authenticity. In doing so, I build on the work of John Haugeland and his interpretation of Dasein as a mass term, while exploring the implications such an interpretation has on Heidegger’s conception of “authenticity”. Ultimately, this paper aims (...) to take seriously Heidegger’s claim to be moving past the isolated Cartesian subject and towards a view of authentic human existence that is cognizant of the way our identities are always formed within a pre-existing community. In addition, since many interpretations of Heidegger have argued that “the Anyone” is representative of all possible forms of community, I consider how this alternative understanding of Dasein as intersubjective can shed new light on critical remarks Heidegger makes about “the Anyone”. Thus, I argue that by reinterpreting Dasein as community, we can find more coherence between Heidegger’s otherwise conflicting conceptions of authenticity and “the Anyone”. (shrink)

It is only when mixing two or more pure substances along a reversible path that the entropy of the mixing can be made physically manifest. It is not, in this case, a mere mathematical artifact. This mixing requires a process of successive stages. In any finite number of stages, the external manifestation of the entropy change, as a definite and measurable quantity of heat, isa fully continuous function of the relevant variables. It is only at an infinite and unattainable limit (...) thata non-uniform convergence occurs. And this occurs when considered in terms of the number of stages together with a distinguishability parameter appropriate to the particular device which is used to achieve reversibility. These considerations, which are of technological interest to chemical engineers, resolve a paradox derived in chemical theory called Gibbs'' Paradox. (shrink)

This paper presents a natural deduction system for orthomodular quantum logic. The system is shown to be provably equivalent to Nishimura’s quantum sequent calculus. Through the Curry–Howard isomorphism, quantum $$\lambda $$ -calculus is also introduced for which strong normalization property is established.
