Putting the New Materialist figure of diffraction to use in a set of readings – in which cultural texts are materially read against their contents and their themes, against their readers or against other texts – this volume proposes a critical intervention into the practice of reading itself.

Deliberative systems theorists have not explained what a deliberative system is. There are two problems here for deliberative systems theory: an empirical problem of boundaries (how to delineate the content of a deliberative system) and a normative problem of evaluation (how to evaluate the deliberation within a deliberative system). We argue that an adequate response to these problems requires a clear ontology. The existing literature suggests two coherent but mutually exclusive ontologies. A functionalist ontology postulates self-sustaining deliberative systems with their (...) own functional goals and logics independent of human intentionality. In contrast, an interpretive ontology conceives of deliberative systems as the products of the beliefs and actions of the actors in the relevant practices—deliberative systems derive from human intentionality. We conclude by showing how these conflicting ontologies lead to different empirical and normative agendas. (shrink)

This book examines the Condorcet Jury Theorem and how its assumptions can be applicable to the real world. It will use the theorem to assess various familiar political practices and alternative institutional arrangements, revealing how best to take advantage of the truth-tracking potential of majoritarian democracy.

The interpretation of if -clauses in the scope of ordinary quantifiers has provoked semanticists into extraordinary measures, such as abandoning compositionality or claiming that if has no meaning. We argue that if -clauses have a normal conditional meaning, even in the scope of ordinary quantifiers, and that the trick is to have the right semantics for conditionals.

While the importance of social norms for shaping and transforming communities is uncontested, their nature and normativity are controversial. Most recent theorists take social norms to arise if members hold certain attitudes, such as expectations on others, perhaps along with certain behaviours. Yet attitudes do not create norms, let alone social norms or social normativity. Social norms are instead ‘made’: through a social process. Social norming processes are special communication processes, often non-verbal and informal. We present different versions of a (...) process-based account of social norms and social normativity. The process-based view brings social norms closer to legal norms, as processes represent social ‘acts’, just as laws and contracts arise through acts rather than mere attitudes, for instances acts of voting or signing. Argues that morality can exist without religion, suggests that values and principles of conduct emerge from life, and examines the consequences of moral absolutism.

This article concerns a new constraint on the interaction of quantifier phrases and epistemic modals. It is argued that QPs cannot bind their traces across an epistemic modal, though it is shown that scoping mechanisms of a differentnature are permitted to cross epistemic modals. The nature and source of this constraint are investigated.

The method of appealing to considered judgments in Wide Reflective Equilibrium has been thought to have unwelcome relativistic or ethnocentric implications. This belief, which is widely held, is, I shall argue, mistaken. Wide Reflective equilibrium has no such untoward implications. I shall first specify what I am talking about in speaking of relativism, then generally characterize WRE, then deploy some central arguments for it and finally try to show that it has no relativistic implications.

A recent judgment by a lower court in Germany brought the problem of ritual male circumcision to the consciousness of the wider public and legal academia. This essay weighs in on this emerging discussion and argues that ritual male circumcision is not covered by parental authority. It first considers and dismisses the best interest of the child test, which is the most widely used test of parental authority in legal practice. Instead, the essay proposes what it terms the autonomy conception (...) of parental authority, according to which parental authority must be exercised such as to ensure that the child will become an autonomous adult. While parents may raise their child in line with their ethical, including religious, convictions, respect for his autonomy requires that this be done in a way that allows the child to later distance himself from these values; this implies, among other things, that irreversible physical changes are impermissible. At first glance, this is an entirely unremarkable kind of sentence. It is easy to find naturally occuring exponents. Its meaning is also clear: taking the A train is a necessary condition for going to Harlem. Hence the term “anankastic conditional”, Ananke being the Greek protogonos of inevitability, compulsion and necessity.

This paper defends what I call the ‘wellbeing conception of harm’, according to which the relevant criterion for determining whether one has suffered harm is whether they have been made worse off in terms of their wellbeing. Firstly, I explain why it is that one might find the wellbeing conception of harm appealing to begin with. Then, I respond to two sets of concerns that have been levied against the wellbeing conception of harm. The first set of concerns relate to (...) the implausible moral/political consequences that would allegedly follow from adopting the wellbeing conception of harm. The second set of concerns challenge the practical significance of adopting the wellbeing conception of harm. I conclude with some remarks on how the wellbeing conception of harm can help to answer, or at least navigate, some controversial issues related to harm. (shrink)

In the first chapter of Karl Marx's Theory of History, G. A. Cohen contrasts Marx's image of history with Hegel's, contrasts, that is, a powerful form of historical idealism with historical materialism. Historical idealism stresses the “dominion of thought” ; social change, on such an account, is to be explained principally in terms of changes in consciousness, the course of history being determined by fundamental ruling ideas and conceptions. This view is to be contrasted with historical materialism. The central vision (...) of history in Hegel is formulated as follows by Cohen, “History is the history of the world spirit which undergoes growth in self-knowledge, the stimulus and vehicle of which is a culture, which perishes when it has stimulated more growth than it can contain”. Marx's vision, a historical materialist vision, is identical in structure with Hegel's, but endows the structure with a new content. This can be seen from the parallel formulation of it, given by Cohen: “History is the history of human industry, which undergoes growth in productive power, the stimulus and vehicle of which is an economic structure which perishes when it has stimulated more growth than it can contain. There are three remarks of Norman Malcolm’s with which I should like to begin. The first is his remark that.

Can Aristotle’s idea of practice be made fruitful for music pedagogical action in schools? That this is the case is repeatedly asserted in the music pedagogical discussion. This article takes up this assertion and develops a proposal for class music making based on Aristotle’s theory of action.

In my essay, I critically discuss the work of the French philosopher and sinologist François Jullien. First, I reconstruct the social and political context from which Jullien’s thinking emerged in the late 1970 s and 1980 s. Second, I analyze a number of philosophical and sinological premises underlying his interpretation of Chinese and European thought. By comparing his interpretation of traditional Chinese thought with other approaches, it is possible to get a better understanding of Jullien’s creative appropriation of the other. (...) This paper engages with the longstanding debate over whether being exposed to a risk of harm amounts to harm itself (what I call ‘risk-harm’). The dominant view has been that those exposed to risks of harm do not suffer harm. In this paper, I defend the widely unpopular subjectivist account of risk-harm – according to which those exposed to unwanted risks of harm can suffer harm – against prominent objections that have been levied against it. The first section sets out (...) to renew and strengthen the appeal of the account in light of recent developments in the surrounding literature. The second section defends the account against arguably its most formidable objection, namely the claim that there is no such thing as risk-harm. The third section wraps up by parrying some prominent general objections, which highlight potentially undesirable upshots to accepting the existence of risk-harm. (shrink)

A method of reflective equilibrium is adumbrated and then used to test the adequacy of moral conceptions appealing to fundamental human rights against Nietzschean conceptions of morality which would reject such an appeal. There is an attempt here both to articulate and critically probe a distinctive moral methodology (the method of reflective equilibrium) and to examine skeptical challenges to a foundationalism which would ground morality in fundamental rights claims. I attempt a partial testing of such a moral methodology by examining (...) its ability to meet such skeptical challenges to the rational grounding of human rights, and I assess (and this is plainly a reciprocal process) the depth of such skeptical challenges by the ability of such challenges to survive such an application of a method of reflective equilibrium. If that method is applied with discrimination and understanding, is it sufficient to defuse skeptical challenges to the pervasive belief that either rationality or the very taking of the moral point of view requires the acceptance of the belief that the design of morally acceptable social institutions and practices must be such that they aim at achieving a state of affairs in which all human beings are to be afforded equal consideration? Can a method of reflective equilibrium establish that a good society must embody such a commitment to an equality of human rights? (shrink)

There are, it is argued, conceptually and empirically adequate naturalistic explanations of religion that explain religion without explaining it away and without leaving out anything needed fully to comprehend religious phenomena. Moreover, naturalistic explanations arc sometimes also critiques of religion. This article concerns itself with a subspecies of such explanations through articulating and defending some naturalistic criticisms of the truth-claims of religion. The rationale is displayed for naturalistic thinkers going from truth-claim analyses to functional analyses and the central naturalistic explanations (...) of the roles and functions of religion are distinguished and related. It is shown how these analyses dovetail and, particularly when supplemented by an error-theory of religious belief, constitute a comprehensive and adequate explanation of religion. (shrink)

Cet article se demande si un dialogue entre la civilisation chinoise et Leo Strauss est possible et à quelles conditions. Il décrit le contexte d’introduction de Strauss en Chine, en se concentrant sur Liu Xiaofeng, l’un des straussiens les plus influents de la Chine contemporaine. L’analyse de son interprétation de la critique straussienne de la modernité occidentale fait ressortir deux distorsions fondamentales : là où Strauss considérait l’« enseignement tyrannique » comme quelque chose de théorique, Liu en fait un plan (...) d’action politique ; au lieu de reconnaître la modernité des bases idéologiques de l’État fondé par Mao Zedong, il les interprète au crible de la tradition. Cette double déformation contredit l’intention de Strauss en tant que philosophe zététique et socratique. (shrink)

It is well known that the Neo-Confucian thinker Zhu Xi particularly emphasizes the role of emotions in human life. This paper shows that the four ‘moral emotions’ are central to Zhu's thinking, insofar as only their genuine actualization enables the individual to achieve spiritual freedom. Moreover, I discuss the crucial notions of ‘awareness’/‘perception’ and ‘knowledge’/‘wisdom’, in order to reveal the complex dynamic that moral emotions are said to create in the moral agent. I also analyse two important passages from the (...) Mencius and examine how Zhu Xi, in his exegetical glosses, defines the conditions of virtuous agency as based on the moral emotions. Finally, I explain the reasons why Neo-Confucians like Zhu Xi have sometimes been described as Kantian thinkers avant la lettre. (shrink)

According to the causal account of harming, an event harms a person if and only if it causes the person to be worse off. This view has emerged as a popular alternative to the more traditional view, according to which an event harms a person if and only if the person would have been better off had the event not occurred. In this paper, my primary aim is to motivate and defend a certain variant of the causal account of harming. (...) The last two decades have witnessed a wide-ranging and global discussion of the theory and structure of human and constitutional rights. This debate initially focused on the principle of proportionality and subsequently on the related ideas of the ‘culture of justification’ and the ‘right to justification.’ There is now a far-reaching agreement that both proportionality and justification in human and constitutional rights law are concerned with the reasonableness, alternatively the justification in terms of public reason, of the act under consideration. (...) Thus, reasonableness and/or public reason have assumed a, perhaps the, central place in the theory of human and constitutional rights. (shrink)

In the jurisprudence of constitutional courts around the world, there is an emerging trend towards an autonomy-based understanding of constitutional rights: increasingly, rights are interpreted as being about enabling people to live autonomous lives, rather than disabling the state in certain ways. This article investigates the conception of autonomy employed by courts by presenting two candidates and examining which of them explains the current practice of constitutional rights law better. The first, labelled the excluded reasons conception of autonomy, claims that (...) a person’s autonomy is violated if he is treated on the basis of certain impermissible—in particular, moralistic or paternalistic—reasons. It is concluded that, while this is a coherent understanding of autonomy, it cannot explain many of the rights that are widely accepted today. The second, the protected interests conception, argues that a person has autonomy interests in controlling certain domains of her life, and offers a scale on which the importance of the various autonomy interests can be assessed. The article demonstrates that this conception is coherent and adequately explains the current practice. The final section briefly explores some implications of this result for a comprehensive reconstructive theory of constitutional rights. (shrink)

A fundamental postulate of statistical mechanics is that all microstates in an isolated system are equally probable. This postulate, which goes back to Boltzmann, has often been criticized for not having a clear physical foundation. In this note, we provide a derivation of the canonical distribution that avoids this postulate. In its place, we impose two axioms with physical interpretations. The first axiom ensures that, as our system of interest comes into contact with different heat baths, the ranking of states (...) of the system by probability is unchanged. Physically, this axiom is a statement that in thermal equilibrium, population inversions do not arise. The second axiom requires that, for any heat bath and any probability distribution on states, there is a universe consisting of a system and heat bath that can achieve this distribution. Physically, this axiom is a statement that energy flows between system and heat bath are unrestricted. We show that our two axioms identify the Boltzmann distribution. (shrink)

(i) Inferences from the (assumed) truth of the asserted sentence. Hearers may have conditional beliefs (if p, q) and upon hearing p asserted they can infer q by Modus Ponens (with suitable caveats about the reliability of their initial conditional belief and the new information that p).

This paper presents two general results of decidability concerning logics based on an indeterministic metric tense logic, which can be applied to, among others, logics combining knowledge, time and agency. We provide a general Kripke semantics based on a variation of the notion of synchronized Ockhamist frames. Our proof of the decidability is by way of the finite frame property, applying subframe transformations and a variant of the filtration technique.

An identification is made of the core metaphilosophical, philosophical, and intellectual history theses in Richard Rorty's pragmatism. Their rationale is displayed and it is argued that his metaphilosophical theses are very much dependent on certain of his non‐metaphilosophical philosophical theses, most centrally his anti‐representationalism. Questions emerge about the status and justification of these theses. Rorty, in his programmatic pronouncements, resists providing a vindication of them. Seeking to avoid what has been called performative contradictions, he regards it as sufficient to provide (...) the best narrative going of what is to be said here. It is argued that a more straightforward defence can be provided that does not depart from his holism or his historicism with its setting aside of claims of necessity. (shrink)
