Reputation is often seen as central to the coordination of transactions in sharing economy platforms. Participants perform a double role regarding reputation management: while engaging in exchanges with other peers, they build their individual ‘reputation capital’ and simultaneously execute community oversight. In Couchsurfing (CS), a network often cited as paradigmatic of the sharing economy, there is, however, a clear bias for positive references. In the digital economy literature, participants’ friendly behaviour is understood as motivated by self-interest and an incentive to (...) maintain a positive reputation. Social research on reputation in CS attributes the bias to fear of retaliation, but also hints at norms of reciprocity leading travellers to require positive feedback for hospitality. This article analyses the lived experience of reputation management in CS and argues that participants seek to reconcile direct and general reciprocity. It proposes breaking these practices down into boundary-work and creative avoidance and argues these result in insufficient protection of inexperienced participants against problematic members. According to the Principle of Conditional Non-Contradiction (CNC), conditionals of the form “If p, q” and “If p, not q” cannot both be true, unless p is inconsistent. This principle is widely regarded as an adequacy constraint on any semantics that attributes truth conditions to conditionals. Gibbard has presented an example of a pair of conditionals that, in the context he describes, appear to violate CNC. He concluded from this that conditionals lack truth conditions. We argue that this conclusion is (...) rash by proposing a new diagnosis of what is going on in Gibbard’s argument. We also provide empirical evidence in support of our proposal. (shrink)

Spinoza claims both that a thing’s essence is identical to power, and that emotions are fundamentally variations in this power. The conjunction of these two theses creates difficulties for his metaphysics and ethics alike. The three main worries concern the coherence of Spinoza’s accounts of essence, diachronic identity, and emotional “bondage,” and put in question his ability to derive ethical and psychological doctrines from his metaphysical claims. In response to these difficulties, this paper offers a new interpretation of Spinoza’s account (...) of affects and his doctrine of the identity of power and essence. It shows that what is fundamental to his ontology of affects is the relation of modification or determination, a relation central to his ontology more generally. The paper argues that we cannot simply identify power and essence but should instead take affects to modify or determine essences as particular exercises of power (particular desires, appetites, and volitions). That is, Spinozistic essences should be viewed as intrinsically determinable, with affects supplying the determinations, and as consisting not in rigid sets of determinate properties, but in ranges of variable properties. Just War Theory debates discussing the principle of the Moral Equality of Combatants involve the notion of Invincible Ignorance; the claim that warfi ghters are morally excused for participating in an unjust war because of their epistemic limitations. Conditions of military deployment may indeed lead to genuinely insurmountable epistemic limitations. In other cases, these may be overcome. This paper provides a preliminary sketch of heuristics designed to allow a combatant to judge whether or not his war is just. It delineates (...) the sets of relevant facts uncontroversially accessible and inaccessible to contemporary professional soldiers. Relevant facts outside these two sets should by default be treated as inaccessible until proven otherwise. Even such a rudimentary heuristic created in this way demonstrates that practical recommendations of MEC-renouncing Just War Theory are not too challenging to follow and still signifi cantly impact a compliant combatant’s behavior. In his recent JME article Daniel Restrepo argues that both legal and ethical rules should protect the so-called Naked Soldiers, combatants engaged in activity unrelated to military operations and unaware of the imminent danger threatening them. I criticize this position from several angles. I deny the existence of any link between vulnerability and innocence, and claim ignorance of deadly threats does not give rise to a morally distinguished type of vulnerability. I argue that actions not contributing to the war effort (...) are nevertheless an inherent part of fighting a war, and that combatants do not signal intention to abandon their commitment to the war effort by undertaking these. I show that by granting hors de combat status to Naked Soldiers, we would unjustly disadvantage their opponents and engender significant and manifold practical difficulties that the proponents of the view fail to solve or even anticipate. Finally, I demonstrate that Restrepo’s general project of “making killing in war difficult to legitimately justify” regardless of why, how and by whom the killing is done is incompatible with just war theory’s basic assumptions. That project is in fact pacifist in nature and as such redundant in light of pacifism’s broader and stronger implications. (shrink)

We live in an era when increasing numbers of babies are conceived through assisted reproduction technologies (ART). Using a comprehensive approach, the present research seeks to contribute to the understanding of gender differences in experiencing and coping with infertility, and in dealing with ART treatment. Our sample consisted of 10 heterosexual couples aged 24 to 43 and the data were collected through semi-structured interviews. In the studied sample, gender differences existed not only in experiences of infertility, but also in understanding (...) it, and in dealing with ART treatment. Responses to stress caused by infertility were stronger in women and they also perceived this stress more intensely than men. For women the central aspect of infertility was the desire for a child, while for men it was perceived more as a socially imposed obligation to fulfill the male role. (shrink)

The ethical Principle of Proportionality requires combatants not to cause collateral harm excessive in comparison to the anticipated military advantage of an attack. This principle is considered a major (and perhaps insurmountable) obstacle to ethical use of autonomous weapon systems (AWS). This article reviews three possible solutions to the problem of achieving Proportionality compliance in AWS. In doing so, I describe and discuss the three components Proportionality judgments, namely collateral damage estimation, assessment of anticipated military advantage, and judgment of “excessiveness”. Some possible approaches to Proportionality compliance are then presented, such as restricting AWS operations to environments lacking civilian presence, using AWS in targeted strikes in which proportionality judgments are pre-made by human commanders, and a ‘price tag’ approach of pre-assigning acceptable collateral damage values to military hardware in conventional attritional warfare. The article argues that application of these three compliance methods would result in AWS’ achieving acceptable Proportionality compliance levels in many combat environments and scenarios, allowing AWS to perform most key tasks in conventional warfare. The field of war ethics changes its focus, and grows, in reaction to salient conflicts of the day – and this is how things should be. World War II made the deficiencies of contemporary law and policy crystal clear, remaining the obvious reference point up to this day. It was in reaction to the atrocities of the Vietnam War that Michael Walzer and others made just war theory relevant again, featured in military academies and politician’s speeches. The Iraq War inspired (...) the so-called revisionists in just war theory and fixated military ethicists’ glance on the complex conundrums of counterinsurgency, while G.W. Bush’s War on Terror ignited debates on torture, use of private military contractors and targeted killing. Had these wars been different, contemporary ethics of war would have dealt with different problems, or at the very least it would apportion attention and expertise differently. Consequently it is no surprise that the Russian invasion of Ukraine, launched clandestinely in April 2014 and escalated in February 2022, has generated its own ethical problems. A rare large scale, conventional, inter-state conflict, fought both with legacy Soviet systems and cutting edge contemporary technologies, the Russo-Ukrainian War is different from the asymmetrical, low-end (though not low harm) conflicts of the last thirty years. It is also marked by the almost complete disregard shown by the aggressor side to the issues of justice, both ad bellum and in bello ones. Indeed, as I write these words, use of nuclear weapons in offensive warfare is being openly threatened, and one is to assume, considered, by the Kremlin. Both frost and hunger are being weaponized against civilians, with the inhabitants of Ukraine being far from the only target, or casualty, of such policies. In a globalized world, the suffering is also global. While the issue of ad bellum justice is uncharacteristically straightforward, many other questions are anything but answered. Nuclear blackmail, and nuclear-backed imperialism, stand out as theoretically underappreciated yet vastly important problems. So does the role of the global community in limiting the spillover effects of the war from hurting the most vulnerable. Devising an appropriate international response to crimes against humanity and acts of genocide committed by a nuclear power, yet by conventional means, offers another set of stark problems. These heavyweight questions are just the very first ones that spring to mind when one contemplates the events of the current war. Russian attacks on power plants and heating stations, conducted at the verge of winter, unfortunately may be said to have some precedent in the actions of Western powers in Serbia and Iraq. Whether such attacks are legal under international laws of armed conflict, and, if they are legal, whether the laws should change is another subject ripe for debate. So is the issue of POW’s notorious vulnerability to wanton and needless cruelty, once again exposed by this war. The internment of Mariupol garrison commanders in Turkey seems to offer a glimpse of a solution far more civilized than the current system. As far as the ethics of novel military technologies are concerned, the widespread use of armed drones, permeating to ever lower levels of military organization has major, though unclear implications both for the future of drones and that of autonomous weapons. Does the wildfire proliferation of armed drones prove the attempts to frame them as illegitimate, morally suspect weapons were naïve and futile? Or does it prove ethicists should double down their efforts to shackle such technologies in their infancy? The general problem is far from the only one. What about the use of drones or autonomous weapons that cannot be tied to a particular actor against critical infrastructure, such as the Nord Stream pipelines? How are such attacks to be responded to or deterred? Regarding technology, this is also the first conflict of this size followed almost in real time by a truly global audience of sympathizers, spectators and trolls capable of impacting political and military outcomes through influence campaigns, donations, volunteer online work etc. It is clear that trying to sway one’s government to increase or cease support for a side of this conflict is not morally neutral, nor is transferring money for the war effort. How should we think of these new forms of extended participation in conflict? And given their importance, how should those who report the truth about the ugly realities of war proceed? What about pundits and commentators with large audiences – what are their responsibilities, and what standards can we expect of them? The questions that may be asked about the behavior of essentially private citizens may of course also be asked about the behavior of governments – and corporations. What degree of assistance to the victim state may be required? What degree of involvement with the aggressor state is permissible? What these and many other conundrums placed in the spotlight by the Russian invasion have in common is that they need answers – most quite urgently. Consequently we invite a variety of learned and considerate voices to opine on these in our journal’s special issue. Among questions and doubts, one thing is certain – when confronted with the evils of war, we cannot stay silent, and we cannot cease to reflect. (shrink)

Novel precision oncology trial designs, such as basket and umbrella trials, are designed to test new anticancer agents in more effective and affordable ways. However, they present some ethical concerns referred to scientific validity, risk-benefit balance and informed consent. Our aim is to discuss these issues in basket and umbrella trials, giving examples of two ongoing cancer trials: NCI-MATCH (National Cancer Institute – Molecular Analysis for Therapy Choice) and Lung-MAP (Lung Cancer Master Protocol) study. We discuss three ethical requirements for (...) clinical trials which may be challenged in basket and umbrella trial designs. Firstly, we consider scientific validity. Thanks to the new trial designs, patients with rare malignancies have the opportunity to be enrolled and benefit from the trial, but due to insufficient accrual, the trial may generate clinically insignificant findings. Inadequate sample size in study arms and the use of surrogate endpoints may result in a drug approval without confirmed efficacy. Moreover, complexity, limited quality and availability of tumor samples may not only introduce bias and result in unreliable and unrepresentative findings, but also can potentially harm patients and assign them to an inappropriate therapy arm. Secondly, we refer to benefits and risks. Novel clinical trials can gain important knowledge on the variety of tumors, which can be used in future trials to develop effective therapies. However, they offer limited direct benefits to patients. All potential participants must wait about 2 weeks for the results of the genetic screening, which may be stressful and produce anxiety. The enrollment of patients whose tumors harbor multiple mutations in treatments matching a single mutation may be controversial. As to informed consent – the third requirement we discuss, the excessive use of phrases like “personalized medicine”, “tailored therapy” or “precision oncology” might be misleading and cause personal convictions that the study protocol is designed to fulfill the individual health-related needs of participants. We suggest that further approaches should be implemented to enhance scientific validity, reduce misunderstandings and risks, thus maximizing the benefits to society and to trial participants. This essay is about the role of visual surveillance technologies in the policing of the external borders of the European Union. Based on an analysis of documents published by EU institutions and independent organizations, I argue that these technological innovations fundamentally alter the nature of national borders. I discuss how new technologies of vision are deployed to transcend the physical limits of territories. In the last twenty years, EU member states and institutions have increasingly relied on various forms of remote (...) tracking, including the use of drones for the purposes of monitoring frontier zones. In combination with other facets of the EU border management regime, these technologies coalesce into a system of governance that has enabled intervention into neighboring territories and territorial waters of other states to track and target migrants for interception in the “prefrontier.” For jurisdictional reasons, this practice effectively precludes the enforcement of legal human rights obligations, which European states might otherwise have with regard to these persons. This article argues that this technologically mediated expansion of vision has become a key feature of post–cold war governance of borders in Europe. The concept of transterritory is proposed to capture its effects. (shrink)

In 1922, Albert Einstein rejected Bergson’s concept of time. He even declared that Bergson’s duration did not exist, something that Bergson never quite came to terms with. On the other hand, some of Bergson’s reflections indicated that in a certain respect he was close to the spirit of modern physics, especially quantum theory. The author, therefore, asks whether it is possible to equate Bergson’s duration with the quantum space-time continuum and thus rehabilitate Bergson’s concept. The first part of the article, (...) in addition to the definition of duration, focuses on the connection of the subject, time, and matter in Bergson, which represents one of the points of contact with quantum theory. The second part describes the role of the subject in quantum theory. The third part presents the definition of the mentioned space-time continuum. At the end of the nineteenth century, the main source of information about the city of Łódź were not local periodicals (as there were no such publications), but correspondence printed in Warsaw papers. Apart from regular reports, m years 1898 and 1899, in one of leading Warsaw daily papers, Kurier Warszawski, there appeared a series of articles under the title “Znasz-li ten kraj?” signed by Antoni Sygietyński. It was the aftermath of the writer’s visit in Łódź (as it was noticed (...) in Goniec Łódzki, Sygietyński arrived in the city on 3rd of December 1889). The reports concerning the life of the textile city appeared in six issues of Kurier Warszawski, dated from 5th, 6th, 15th and 17th of December 1989 and from 6th and 8th of January in the next year. The author of Na skałach Calvados underlined that the title of the series is not unintentional, because Łódź, according to him, was a fully developed city, which had vast contacts with other regions of the world (Russia, Far East, South and North America) rather than with the rest of Polish cities. The writer compares Łódź to a mushroom, which develops rapidly in favourable conditions, whereas in unfavourable circumstances it becomes a latent form of life. Sygietyński underlines also that the city’s growth and organization reminds an American model. The writer attempts to change a stereotypical opinions about the city, mainly concerning its rapid development of industry, huge number of inhabitants or a triplenational character of the textile metropolis. The author aims at acknowledging a true Lodzermensch, he scrutinizes the cultural life of the city. During his visit in Łódź Sygietyński took part in the opening night of Hauptman’s Dwór zatopiony, and in Christmas party in a catholic shelter for children. The meeting with the youngest citizens gave an opportunity for a closer examination of the conditions they lived in as well as of the financial straits their caretaker, Father Szmidel, was facing. The experience triggered an idea of a charity concert, which Sygietyński decided to organize in Łódź The income was donated for modernization of the shelter. The concert was organized on 25th of March 1899 with the participation of the most famous Warsaw artists (Kruszelnik Borcewicz, Michałowski, Wierzbiłowicz, Trenkiel). Such was the social and cultural scale of the event that it was reported in a number of newspapers. Głos underlined Sygietyński’s input into organization by describing him as „a moral impresario of the show”. The author of Wysadzony z siodla while organizing the concert had two main aims: first - to collect money for the shelter, and the second - to arouse a passion for art among the citizens of Łódź. Straipsnyje bandoma pagrįsti, kad tapatybė, veikiama medijų skaitmeninėje kultūroje, tampa transmedijuota ir drauge išsklaidyta, epizodiška ir interaktyvi, kitaip tariant, ji virsta transmedijos produktu.

Celem artykułu jest pokazanie, jak na łódzki folklor miejski i kulturę popularną wpływały głośne zbrodnie dwudziestolecia. Analiza tematu pokazuje, że chętnie sięgano i inspirowano się bieżącymi wydarzeniami, o których pisała łódzka prasa. W ten sposób do drukowanych na łamach miejscowych dzienników powieści popularnych i piosenek śpiewanych na łódzkich podwórkach docierały wątki nawiązujące m.in. do głośnych zbrodni czy skandali obyczajowych. Analiza tekstów piosenek dowodzi, że „przetwarzały” one materiał prasowy, czyniąc go dostępnym nawet dla niepiśmiennych mieszkańców. Omówione piosenki wpisują się w schemat (...) popularnych pieśni nowiniarskich, powtarzając charakterystyczne wzorce konstrukcyjne, sposoby kreacji bohaterów. Kanwą dla wyśpiewywanych treści były przestępstwa, którym towarzyszyły procesy sądowe, szczegółowo relacjonowane na łamach prasy i będące tematem rozmów łodzian. Stąd już tylko krok do tego, by Zajdlowa, Łaniucha czy Ślepy Maks stali się bohaterami piosenek śpiewanych na łódzkich podwórkach. (shrink)

The paper analyzes the collection of the Northern Irish poet Frank Ormsby entitled A Northern Spring published in 1986. On the basis of selected poems, the author of this paper aims to examine the poet’s reflections about World War II, the lives of the soldiers, and the things that remain after a military combat, which are both physical and illusive. The poems included in the volume present the author’s reflections upon the senselessness of war and dying, short lives of the (...) soldiers, the awareness of their own meaninglessness in comparison to the broader picture, and the contradictory and desperate need to be remembered nevertheless. They also show what is left of the soldiers and the war, as well as how life goes on, with or without them. (shrink)

Explicit and implicit values of polish grandmothers and their granddaughters The authors tried to determine if and to what extent maternal granddaughters share the explicit and implicit values of their grandmothers. 80 grandmothers-granddaughter dyads were surveyed using Schwartz' SVS and Mudyń's RN-02, an instrument assigned to identify "ontological orientations". The results indicate that: 1) grandmothers differ significantly from granddaughters in all ontological orientations, especially in Theoretical and Religious orientation, 2) they differ also in personal values, except for Universalism and Power, (...) 3) regression analysis revealed two decisive factors which determine convergence of ontological orientations and values in grandmother-granddaughter dyads, i.e. and level of education and attitudes toward religion. It may mean that these are the two important transmitters of world view as well as personal values. (shrink)

The global pandemic outbreak in 2020 was a disturbing experience for most people worldwide. The primary way of protecting human life was social distancing and lockdown, often forcing people to stay at home. The confinement made the fear and uncertainty grow bigger and bigger. Fortunately, the online connection was still as possible and essential as never before. The text is inspired by a series of remote meetings under the working title Viral Culture: Bio Art and Society, initiated by academic curator (...) Claire Nettleton to put together people working in art&science area. Recordings of the Zoom gatherings complemented by notes and chat transcriptions served as intriguing storage of topics and ideas. This article focuses on the three threads: being-with (other humans, the virus and other non-human actors), caring without touch and the pandemic interpreted as a vast bio art project. All the archived materials, including the present article, will potentially function as historical documents in the future, showing how a specific group of transdisciplinary culture producers dealt with the global crisis in its first phase. Celem artykułu jest zwięzłe przedstawienie historii rozwoju literatury Turków cypryjskich od momentu pojawienia się Osmanów na wyspie pod koniec XVI wieku po czasy najnowsze. Osmańscy zdobywcy przywieźli na Cypr swoją tradycję, kulturę i literaturę, ale rozwój piśmiennictwa na wyspie odbywał się w innym tempie i w zależności od sytuacji politycznej podlegał różnym wpływom, nie tylko anatolijskim. Także wielokulturowość miała duży wpływ na charakter rozwoju tureckojęzycznej literatury w ciągu całej 450-letniej obecności Turków na wyspie. W artykule przedstawiono pokrótce najważniejsze wydarzenia polityczne, (...) które miały wpływ na rozwój i kondycję literatury tureckiej na Cyprze. Następnie omówiony został problem periodyzacji literatury Turków cypryjskich na tle okresów rozwoju literatury w Turcji. Z epokami literackimi zazwyczaj można łączyć konkretne gatunki, które w danym okresie pojawiają się, przeżywają największy rozkwit lub zanikają. Historia rozwoju gatunków takich jak nowela, powieść, sztuka sceniczna wskazuje na pewne różnice między literaturą Turcji osmańskiej i republikańskiej a literaturą Turków cypryjskich. Kolejny ważny element, który może służyć jako narzędzie porównania to tematyka utworów – najbardziej naturalne zwierciadło wydarzeń historycznych i problemów przeżywanych przez naród. Zestawienie cech charakterystycznych literatury tureckocypryjskiej i tureckiej na przestrzeni wieków pokazuje, że poza okresem po 1974 roku literatura Turków cypryjskich rozwijała się wolniej, a nowe trendy pojawiały się z opóźnieniem. Jako główne przyczyny takiego stanu rzeczy wskazać można uwarunkowania polityczne i ekonomiczne. (shrink)

The author describes the relationship between the open public sphere and privacy which, by entering the public sphere, creates a space for secrecy and lack of transparency within the official space. The author discusses the transition from the ancient division into the public area, characterised by overt, open and transparent actions, and the private area, which is hidden in the darkness of the house, to the modern obliteration of the boundary and the clear division between the two areas. The Habermasian (...) diagnosis of modern mass society leads to the conclusion that a certain chimera of concepts, processes and phenomena have been created, both relating to their nature and the meanings they convey associated with secrecy and openness. The book discusses a democratic legitimation for modern law. Debates on Europeanisation are taken into account. Ronald Dworkin's, Neil MacCormick's and Jürgen Habermas's standpoints on relations between the law and the public sphere are investigated. Concepts of self-reflexive polity, self-constitutionalisation, constitutional patriotism are analysed.

The paper offers a new account of Spinoza's conception of “substance”, the fundamental building block of reality. It shows that it can be demonstrated apriori within Spinoza's metaphysical framework that (i) contrary to Idealist readings, for Spinoza there can be no substance that is not determined or modified by some other entity produced by substance; and that (ii) there can be no substance (and hence no being) that is not a thinking substance.

Along with the rapid growth that the field of assisted reproduction has experienced over the last few years, numerous ethical issues have arisen and need to be discussed thoroughly. One of them is the limitation of access to assisted reproduction techniques. Because no one should be discriminated against, it is essential to substantiate every single refusal of access carefully. The criterion of welfare of the child is used most frequently. In this paper, we propose a thought experiment aiming at contributing (...) to the discussion by demonstrating that this criterion, even in its strictest form, can easily allow access to assisted reproduction for legal persons as well. The article proposes a new solution to the long-standing problem of the universality of essences in Spinoza's ontology. It argues that, according to Spinoza, particular things in nature possess unique essences, but that these essences coexist with more general, mind-dependent species-essences, constructed by finite minds on the basis of similarities that obtain among the properties of formally-real particulars. This account provides the best fit both with the textual evidence and with Spinoza's other metaphysical and epistemological commitments. The article offers new (...) readings of how Spinoza understands not just the nature of essence, but also the nature of being, reason, striving, definitions, and different kinds of knowledge. This paper aims to analyze technical and internal aspects of one particular type of human moral enhancement, i.e. enhancement of moral motivation via direct emotion modulation. More precisely, it challenges the assumption that modifying certain emotions will have the results desired by the advocates of this theory. It is argued that neuropsychological understanding of the role and function of emotions, as well as of underlying cognitive mechanisms, might be relevant for the discussion about biomedical enhancement of moral capacities. Moreover, typical (...) claims about direct emotion modulation seem to be contradicted, or at least seriously challenged, by available neuroscientific data. Particular attention is paid to the theory that emotions are evolved and functionally specialized programs whose task is to coordinate other adaptive mechanisms of human psychology in order to promote one’s fitness. If this view of emotions is plausible, it can be argued that several difficulties for moral bioenhancement theory ensue. Neuroscientific and evolutionary-psychological perspective seem to indicate that emotions don’t fulfill necessary requirements to serve as the vehicles of moral enhancement and it should, therefore, take into account role and function of entire cognitive modules associated with moral decision-making. The article is an introduction to the issue of Polish literature written in Germany after 1989. The first part of the work focuses around the current literary discussions on defining and developing the terminology and methods enabling research into this new literature – written abroad after the fall of the Iron Curtain. Post­-emigration literature, migration literature, minority literature, multi­-, inter­-, trans­-cultural and diasporic literature – these are only a few of the suggested terms. The second part of the article refers (...) to the works of selected representatives of Polish literature written after 1989 and the issues they discuss in their works. The purpose of the article is to briefly present the complexity of an important problem in the views of Polish, German and Slavic philologists. At the same time, it aims to show that study of the phenomenon in question is still insufficient. (shrink)

The chief concern of the paper is to initiate discussion on the difference between the private and public power of judgement. The inspiration comes from Kant and his conception of the power of judgement, customs, morality and provisional law.

In the following paper sources of a constitution are put in question in general, and more specifically, the constitutional culture of the European Union Law is being investigated in-depth with regard to principles of deliberative democracy and rulings of the Court of Justice of the European Union. The change of a law application paradigm as well as the change of a legal systems’ nature are taken into account.

The aim of this article is to present some of the results of empirical research on the communication process at a trial conducted in Polish courts. These results will concern the participation of non-professional participants of a trial and the ways in which they deal with the communication process in the courtroom. The article presents the results of the analysis of the research material conducted in accordance with the detailed research questions and analytical categories. The analysis has especially shown that: (...) (1) the non-professional participants used some legal terminology, but the statements without legal terminology were also communicatively effective; (2) the level of activity of non-professional participants related to participation at the trial varied depending on what the activity concerned; the activity in asking questions to the presiding judges regarding legal issues and the course of the court proceedings appeared to be significant; (3) the non-professional participants’ had a real and significant problem with asking questions during the examination (the proper realization of this element of the trial); (4) the statements of the non-professional participants of a trial were very protective; they used many different “linguistic means of protection” (e.g., acts of supposition or acts of doubt) which are connected with the obligation to tell the truth, the prohibition of concealing the truth and giving false testimony during examination; (5) the non-professional participants of a trial reach for adequate argumentative acts, which are suitable for influencing the perception of specific events or persons, and they strengthen their statements by using appropriate linguistic means of persuasion. The subject of interest of this article is procedural acts considered as double-conventionalized acts. It is assumed in this article that in the case of procedural acts, one can distinguish two levels of conventionalization: the level of a speech act and the level of a procedural act. Both above-mentioned levels affect each other in various ways, what is discussed in the article. As assumed in the article, the analysis of acts characterized by this particular trait and with due account of (...) this trait allows one to observe phenomena that can be hard or even impossible to notice in the process of analyzing acts that are deprived of this trait. Furthermore, it seems that the description of this type of acts may particularly enrich the current discussion on some properties of speech acts held on the grounds of philosophy of language or pragmalinguistics. If a firm provides incentives by promoting those who have performed well in a job, it may transfer them to a job to which they are not well suited and agents are promoted to their levels of incompetence. Tournaments are an alternative to reputation as a means of ensuring that firms reward good performance when performance is unverifiable.

The paper explores situational and dispositional underpinnings of cooperative behavior. According to psychological research, cooperation is strongly related to affective states and personality dimensions. In an experimental study we examined the conditions under which people cooperate with each other. The dispositional traits of co-workers, the contribution to a collaborative effort, and a situational factor – ambient odor condition were taken into consideration. A one-way ANOVA revealed that compared to a malodorous condition, both the pleasant odor condition and the natural odor (...) condition showed higher rates of cooperation. Further analysis indicated that only malodors influenced affective states which in turn determined social decisions. Although we found effects for the participants’ agreeableness and the coworker’s contribution to a joint work, they appeared to play a less critical role than affective states induced by the experimental odor conditions tested here. The main purpose of this article is to show some processes of the growth of knowledge. An astrophysical case: a problem of planets around pulsars formation is studied. In the first part reasons for taking this problem are presented. Then some historical facts about discoveries of planets around pulsars are mentioned. The paper focuses on three cases: PSR1257+12, PSR1620-26 and PSR J 1719-1438. In second part of the article the changes in the theoretical point of view, which occured during the (...) last twenty years, are presented. At the end the attempt is made to describe the process of the growth of the planets around pulsars within the framework of formation. (shrink)
