This article takes issue with the common view that cosmopolitan normative commitments are incompatible with recognition of state sovereignty as a basic principle of international law. Against influential cosmopolitans, who at best ascribe a derivative significance to the sovereignty of states, the article argues that state sovereignty is not only compatible with, but also essential to the recognition of individuals as units of ultimate concern. The argument challenges a problematic distributive conception of justice underlying many cosmopolitans’ support for reforms of (...) the international legal order towards a system where respect for basic human rights is the only criterion for political legitimacy. An alternative relational conception of justice makes it possible to see why there is an internal connection between the rights of individuals and the rights of states. It does not seem particularly daring to say that one objective of science education is to enable students to understand different phenomena in the world in their mutual relationship. This is roughly equivalent to promoting knowledge of scientific explanations, which involve resorting to regular relationships between certain phenomena and which, certainly, is different from knowledge of this or that type of event taken in isolation. In this text, we will draw attention to two opposing tendencies that, however, tend towards the (...) common result of hindering the achievement of such an objective. On the one hand, we find characterizations of scientific explanation that assimilate it to argumentation and, therefore, lose sight of what specifically makes explanations explanatory; that is, they ask too little of a scientific explanation. On the other hand, those that consider paradigmatic cases of scientific explanation −such as those achieved by subsuming phenomena such as tides to Newton's laws− do not really constitute explanations but merely descriptions; it is about asking too much of an explanation here. We will therefore point out that a greater attention to the elaborations provided by the philosophy of science about the notion of explanation is crucial to better serve educational purposes. Schopenhauer aborda a morte como natural, intrinsicamente ligada a vida, e que a mesma não é um mal para o homem e nem representa perigo para a espécie humana, por isso, não deveríamos temê-la, mas encará-la com serenidade, visto que a (...) morte não é o fim absoluto, mas apenas o retorno do indivíduo para a natureza. O filósofo pontua que o Ser é indestrutível e que, após a morte, permanecerá presente por meio da vontade nos seres que continuam vivos. O que se perde com a morte é apenas a individualidade; a matéria, jamais a essência do Ser. Cada Ser que morre, nasce um novo em uma matéria diferente, porém com a mesma essência do que se fora, por isso o Ser em si, e por essência, não morre por ser indestrutível. Normative economics and a hermeneutic approach to interpretation of legal norms are only compatible if - and this is the exception - such legal norms have the goal of accomplishing economic efficiency. But economic analysis of law as a positive approach may be used in the legal interpretation process in order to evaluate different options of norm interpretations. In fields of law where economic issues are at stake such a methodological evaluation of interpretative variants are superior to common sense analysis (...) and should be applied. But even in fields where non-economic issues play a major role an economic analysis is a helpful tool in order to get aware of the opportunity costs of economically sub-optimal solutions. Economic analysis of law thus becomes an integral part of the norm interpretation process without colliding with the autonomy of the legal decision enhancing the rationality of the endeavour. ObjectivesTo measure general psychopathology in dermatologic outpatients using the Symptom-Checklist-K-9 ; to investigate whether the SCL-K-9 is able to categorize patients with and without significant non-psychotic disorders; and to perform a single-item analysis of the SCL-K-9, with a focus on gender differences.MethodsCross-sectional study on consecutive dermatological patients. We used two self-administered questionnaires to assess general psychopathology symptoms: General Health Questionnaire-12 and SCL-K-9. Sociodemographic information was collected with standardized forms. The performance of the SCL-K-9 in classifying patients according to their current (...) emotional distress severity was assessed using a ROC procedure. Finally, we measured differences in scores obtained among women and men in SCL-K-9 single items.ResultsA total of 292 patients were studied. We observed statistically significant differences in SCL-K-9 total mean scores and in most single items among genders. We found that it would be more appropriate to use gender-specific cut-offs when using SCL-K-9 to screen dermatological patients for general psychopathology.ConclusionThe SCL-K-9, with its compact format could provide, in a short time, a wide range of information related to critical areas that challenge the mental health of patients with skin diseases. In this article, I will discuss the relationship between mathematical intuition and mathematical visualization. I will argue that in order to investigate this relationship, it is necessary to consider mathematical activity as a complex phenomenon, which involves many different cognitive resources. I will focus on two kinds of danger in recurring to visualization and I will show that they are not a good reason to conclude that visualization is not reliable, if we consider its use in mathematical practice. Then, I (...) will give an example of mathematical reasoning with a figure, and show that both visualization and intuition are involved. I claim that mathematical intuition depends on background knowledge and expertise, and that it allows to see the generality of the conclusions obtained by means of visualization. (shrink)

From fertilization to approximately the sixteenth day of development, human embryonic cells are said to have the capacities of totipotency and monozygotic twinning, both of which are problematic to a theory of ensoulment at fertilization. In this article I will address the problems which these capacities pose to such a theory and present an interpretation of the biological data which renders ensoulment at fertilization more plausible. I will then argue that not only is an ensoulment theory consistent with current biological (...) data on the human embryo, but it may offer an explanation for the phenomencon of monozygotic twinning. This paper analyses the hegemony of the growth paradigm through the example of its naturalisation in capitalist production and consumption relations. Applying a combination of theoretical elements from the Marxian tradition, the Regulation approach and Bourdieusian sociology, emphasis is placed on how the growth imperative is reflected in people's minds and bodies. It becomes hegemonic because it appears to be the natural way of steering economy and society. As a result, all people – including working people – benefit from the (...) continuation of growth. From a cognitive-psychological perspective, physical exercise (PE) and sports are an interesting tool for improving people’s cognitive abilities. One field of application for such a tool is decision making (DM) support in chronic patients, cancer patients, and survivors in particular. On the one hand, cancer patients and survivors have to continually take important decisions about their own care (e.g., treatment choice; changes in lifestyle), in collaboration with caregivers and health providers; on the other hand, side effects of treatment may be (...) detrimental to cognitive abilities, such as attention, which make the health DM tasks even more demanding, complex, and emotionally disruptive for patients. Since cancer patients have to engage in healthy activities both for improving their own quality of life and for sustaining the effects of medications, clinical advice to engage in sport and PE is becoming more and more widespread within interventions. However, while sports are usually seen as healthy physical activities, their impact on cognitive abilities is mostly overlooked in the literature. The hypothesis of the present work is that sports could be fully exploited in their potential as focused exercises for cognitive ability training, in the field of cognitive training for chronic patients specifically. Indeed, literature shows that different sports (e.g., individual or team-based) influence and possibly augment cognitive abilities such as focused and divided attention, working memory, and DM under time constraints. Moreover, besides providing training for cognitive abilities, the experience of sports may represent an opportunity to explore, train and sharpen DM abilities directly: we identify five ways in which sport experiences may influence DM processes, and provide indications for future research on the topic. In this short Introduction to the present section, I will first briefly point out the reasons why the chapters collected here present original research in the context of the philosophy of the practice of mathematics, and open even newer perspectives. It is important to note that one crucial issue for future research will be to explore the connections within these chapters and with other chapters included in other sections – in particular, but not exclusively, the sections on Proof, on “Experimental” (...) mathematics, and on the Semiology of Mathematical Practice. Second, I will present a short – and not exhaustive – summary of the themes that are tackled in the chapters. There will be overlaps and common threads: These chapters are indeed the final product of several discussions and exchanges within the community of the philosophers of the mathematical practice, which is extending toward other regions of philosophy thus blurring standard boundaries. In which a scientist searches for an empirical explanation for phenomenal experience, spurred by his instinctual belief that life is meaningful. What links conscious experience of pain, joy, color, and smell to bioelectrical activity in the brain? How can anything physical give rise to nonphysical, subjective, conscious states? Christof Koch has devoted much of his career to bridging the seemingly unbridgeable gap between the physics of the brain and phenomenal experience. This engaging book--part scientific overview, part memoir, part futurist (...) speculation--describes Koch's search for an empirical explanation for consciousness. Koch recounts not only the birth of the modern science of consciousness but also the subterranean motivation for his quest--his instinctual belief that life is meaningful. Koch describes his own groundbreaking work with Francis Crick in the 1990s and 2000s and the gradual emergence of consciousness as a legitimate topic for scientific investigation. Present at this paradigm shift were Koch and a handful of colleagues, including Ned Block, David Chalmers, Stanislas Dehaene, Giulio Tononi, Wolf Singer, and others. Aiding and abetting it were new techniques to listen in on the activity of individual nerve cells, clinical studies, and brain-imaging technologies that allowed safe and noninvasive study of the human brain in action. Koch gives us stories from the front lines of modern research into the neurobiology of consciousness as well as his own reflections on a variety of topics, including the distinction between attention and awareness, the unconscious, how neurons respond to Homer Simpson, the physics and biology of free will, dogs, Der Ring des Nibelungen, sentient machines, the loss of his belief in a personal God, and sadness. Normative criteria adopted to assure just, equitable, and efficient allocation of donor organs to potential recipients has been widely praised as a model for the allocation of scarce medical resources. Because the organ transplantation program relies upon voluntary participation by potential donors, all such programs necessarily rely upon public confidence in allocation decision making protocols. Several well publicized cases have raised questions in North America about the efficacy of allocation procedures. An analysis of those cases, and the relevant technical literature, (...) suggest consistent structural deficits exist in the organ allocation process as it is applied by many individual transplantation centres. These irregularities are based upon both the failure of rank waiting as a method to guarantee just treatment and a general failure to recognize the extent to which prescriptive criteria — social values — are commonly used to screen potential organ transplant candidates. Resulting idiosyncratic determinations, and a devaluation of rank waiting as a criterion, raise fundamental questions regarding justice, fairness, and equability in the application procedure at large. To correct these structural problems in organ allocation procedures, a multicriterion model defining prescriptive criteria through the Analytic Hierarchy Process (AHP) is proposed. (shrink)

In "The Quest for Consciousness," Caltech neuroscientist Christof Koch explores the biological basis of consciousness.

In clinical ethics, there remains a great deal of uncertainty regarding the appropriateness of attempting cardiopulmonary resuscitation (CPR) for certain patients. Although the issue continues to receive ample attention and various frameworks have been proposed for navigating such cases, most discussions draw heavily on the notion of harm as a central consideration. In the following, I use emerging philosophical literature on the notion of harm to argue that the ambiguities and disagreement about harm create important and oft-overlooked challenges for the (...) ethics of CPR. I begin by elucidating the standard account of harm, called the Counterfactual Comparative Account (CCA). I then show that three challenges to the CCA—preemptive harms, the harm of death, and non-experiential harms—are particularly salient when assessing potential harms for candidates of CPR and likely impact-related decision-making and communication. I extend this argument to explore how the ambiguities of harm might extend to other realms of clinical decision-making, such as the use and limitations of life-sustaining treatments. To address these challenges, I propose two strategies for identifying and minimizing the impact of such uncertainty: first, clinicians and ethicists ought to promote pluralistic conversations that account for different understandings of harm; second, they ought to invoke harm-independent considerations when discussing the ethics of CPR in order to reflect the nuances of such conversations. These strategies, coupled with a richer philosophical understanding of harm, promise to help clinicians and ethicists navigate the prevalent and difficult cases involving patient resuscitation and many other harm-based decisions in the clinical setting. The objective of this chapter is to introduce some of the views that have been put forward in almost 20 years of research on diagrammatic proofs in the philosophy of mathematical practice. In Sect. 1, some contextual elements will be presented on the reasons why diagrammatic proofs have attracted so much philosophical attention in the past years. In Sect. 2, the “first wave” in the research on diagrammatic proofs based on the analysis of case studies will be described: this is (...) how it started. In Sect. 3, the “second wave,” which is calling for “big pictures” and divides into two different strategies, will be discussed: this is where it is going. In Sect. 4, some conclusions will be drawn. In pluralistic deliberative settings, where people come from different cultural and social backgrounds, sharing personal experiences and narratives in the first person is often advocated as a preferential means to bridge the informational and motivational gap between members of different social groups. Whatever the epistemic merits of personal storytelling in democratic deliberation may be, the request for transparency and disclosure of people’s private experiences that this practice entails may be objectionable on moral grounds, because it disrespects people as agents who (...) have practical authority over their own lives. Having people disclose their personal stories in public can humiliate them, reify them and abridge their personal liberties. What is worse, these harms are especially likely to be inflicted upon members of marginalised or disadvantaged minorities. For deliberativists, this should be a matter of concern because respect for people as agents is arguably one of the founding principles of democratic deliberation. (shrink)

Before 1250, even with a statutorily restricted field of research, the Arts masters of Paris included in their teaching a certain number of philosophical disciplines. Courses imposed on Arts masters included ethics, using Aristotle’s Nicomachean Ethics. Commenting on this text, Arts masters would interpret it and teach their own doctrine of “happiness”, involving concepts not always in agreement with those of the theologians. Taking into account the controversial context of the University of Paris, we focus in this paper on the (...) opinions of Arts masters in both their differences and their agreements with the theologians, regarding the concept of happiness. Résumé Avant 1250, même avec un champ d’études statutairement restreint, les maîtres ès arts de Paris abordaient un certain nombre de disciplines philosophiques. Parmi les enseignements prescrits à ces maîtres se trouvait l’éthique, étudiée dans l’Éthique à Nicomaque d’Aristote. En interprétant ce texte, les maîtres ès arts enseignaient ce qu’ils comprenaient comme « bonheur » en utilisant un réseau de concepts pas toujours en accord avec celui des théologiens. Autour du concept de bonheur, nous tentons ici d’observer les différences et les ressemblances dont témoignent — dans le contexte controversé de l’Université de Paris — les ouvrages pertinents des maîtres ès arts par rapport à l’opinion des théologiens. Unlike conceptual analysis, conceptual engineering does not aim to identify the content that our current concepts do have, but the content which these concepts should have. For this method to show the results that its practitioners typically aim for, being able to change meanings seems to be a crucial presupposition. However, certain branches of semantic externalism raise doubts about whether this presupposition can be met. To the extent that meanings are determined by external factors such as causal histories or microphysical (...) structures, it seems that they cannot be changed intentionally. This paper gives an extended discussion of this ‘externalist challenge’. Pace Herman Cappelen’s recent take on this issue, it argues that the viability of conceptual engineering crucially depends on our ability to bring about meaning change. Furthermore, it argues that, contrary to first appearance, causal theories of reference do allow for a sufficient degree of meaning control. To this purpose, it argues that there is a sense of what is called ‘collective long-range control’, and that popular versions of the causal theory of reference imply that people have this kind of control over meanings. Bioethics claimed to offer a set of generally applicable, universally accepted guidelines that would simplify complex situations. In Thieves of Virtue, Tom Koch argues that bioethics has failed to deliver on its promises.

A philosopher argues that state-sponsored cyberattacks against central military or civilian targets are always acts of war. What is this philosopher doing? According to conceptual analysts, the philosopher is making a claim about our concept of war. According to philosophical realists, the philosopher is making a claim about war per se. In a quickly developing literature, a third option is being explored: the philosopher is engineering the concept of war. On this view, the philosopher is making a proposal about which (...) concept we should have – even if it deviates from the extant concept, and even if it does not capture ‘what war really is’. El siguiente artículo pretende dar cuenta de una mirada alternativa en lo que respecta al abordaje de problemáticas socio-productivas y habitacionales. Para esto se acercaran diferentes discusiones que aportan a la comprensión integral de un escenario complejo: producción epistémica participativa, desarrollo de tecnología, territorialidad e interactoralidad. The new situation in Europe, as exemplified in Germany, calls for a common consciousness, one traditionally characterized as sensus communis or common sense. Kant organized his ruminations on common sense — specifically, the logical common sense — around three maxims: enlightenment, the extended way of thinking and the consistent way of thinking. These are here described with an eye to their consequences for the issues of identity, community and pedagogy.

Although there is much confusion about it in everyday language, the distinction between public and common goods is clear enough within Economics. While the former involves the fact of being open to all and state management, the latter requires common but still limited management. The different kind of administration can also be explored through the reference to a different kind of agent meant as the one who makes use of the different goods: if in the case of public goods, we (...) have individuals, as an aggregate, in that of commons we necessarily need to assume the existence of a plural form of subject, who can in fact act in concert in the management of the good itself. Exploring this distinction in its details and consequences, the paper sets out to apply it to a typical public good – green areas in cities – and to show the theoretical advantages that such a consideration of the commons can have, including through a concrete case such as community gardens.
