The practice of covertly administering medications to patients without their consent is often discussed in the framework of legal questions around the right of patients to consent and refuse medical treatment. However, this practice also raises significant questions surrounding the professional duties and obligations of health care professionals as it relates to the decision-making process of whether to engage in the covert administration of medications. In this paper, I present an overview of the origin of those duties and obligations, and (...) discuss how those duties and obligations when seen from different perspectives may either justify or prohibit the practice. Further, I discuss whether the duties and obligations of health care professionals as they are currently framed are suited to address the complexities of this issue both from the health care professional and patient perspectives. This analysis is conducted in the context of duties and obligations that arise from not only legal framework but also from the ethical requirements from professional codes of ethics. (shrink)

We all know that renewable energies are important for environmental reasons. However, recent developments should open our eyes to the fact that they are even more critical for sustainable development. In this commentary, we argue that societal benefits should be included in renewable energy decisions. Specifically, we discuss their contributions to freedom, peace, and democracy.

ObjectiveThe family remains one of the most important relationship systems into early adulthood and provides an important foundation for lifelong mental health. Dysfunctional family cohesion can promote adjustment problems in adolescents and might also affect adolescents’ self-concept and strategies for coping with emotional distress. To test these relationships and the underlying mechanisms, we proposed a dual mediation model describing the associations between family cohesion and internalizing and externalizing problems, mediated by shame-proneness and expressive suppression.MethodsA sample of 526 German-speaking adolescents aged (...) 14 to 18 years from Austria, Germany, and Switzerland participated in an online self-report survey encompassing questionnaires on family cohesion, shame-proneness, expressive suppression, and psychological problems. We tested a path model to examine the indirect pathways of the associations between family cohesion and internalizing and externalizing problems via shame-proneness and expressive suppression, while controlling for age, gender, and guilt-proneness.ResultsWe found a significant dual mediation of the associations between family cohesion and internalizing and externalizing problems by shame-proneness and expressive suppression. The indirect pathways were all significant, except for the indirect pathway from family cohesion to externalizing problems via shame-proneness.DiscussionOur results provide a model for the mechanisms by which disrupted family cohesion can be related to psychological problems in adolescents. Expressive suppression emerged as crucial when considering the consequences of shame-proneness in adolescents, as it was only indirectly related to externalizing problems via expressive suppression. Welfare science has built its foundations on veterinary medicine and thus measures of health. Since bottlenose dolphins (Tursiops truncatus) tend to mask symptoms of poor health, management in captivity would benefit from advanced understanding on the links between health and behavioural parameters, and few studies exist on the topic. In this study, four representative behavioural and health measures were chosen: health status (as qualified by veterinarians), percentage of daily food eaten, occurrences of new rake marks (proxy measure of social activity), (...) and willingness to participate (WtP) in Positive Reinforcement Training sessions as qualitatively measured by their caretakers. These data were collected multiple times a day, every day over the course of a year from a multi-facility, large sample size (ndolphins= 51), allowing powerful analyses of the relationships between measures. First, it was found that dolphins with a higher WtP score also had a significantly better health status, ate a higher percentage of their daily food, and a lower occurrence of new rake marks. In addition, the WtP score was significantly lower up to 3 days before the weekly veterinary diagnosis of a decrease in health state; the percentage of daily food eaten and new rake mark measures did not show any significant change before such a diagnosis. These results suggest that WtP in training sessions is a potential behavioural measure of dolphin welfare, and an indicator of early changes in the dolphins’ health state. We therefore suggest measurement of WtP as a more practical and non-invasive tool to support veterinary care and general management. More work needs to be conducted to elucidate the influence of social behaviour on health, and to identify other potential welfare indicators, but this long-term study has shown that qualitative measures can be both practical and valid when assessing dolphin welfare. Ricordato dai contemporanei per l’eccezionale talento da connoisseur e la spregiudicata astuzia negli affari, Baslini fu probabilmente il più importante mercante milanese del secondo Ottocento. La sua bottega in via Montenapoleone 11 divenne riferimento e luogo di richiamo per restauratori, collezionisti e travelling agents di tutta Europa. (...) Fu consulente e fornitore delle collezioni milanesi Poldi Pezzoli e Bagatti Valsecchi, che beneficiarono della poliedricità dei suoi interessi, ma anche della National Gallery di Londra e della Gemäldegalerie di Berlino. Il suo «perfido commercio», come pure il ruolo di mediatore presso gallerie e collezioni private, sono documentati dalle lettere di Giovanni Morelli e Austen Henry Layard, dai taccuini di viaggio di Charles Eastlake e Otto Mündler e dall’autobiografia di Wilhelm von Bode. La restituzione delle vicende biografiche e professionali dell’antiquario, attraverso lo studio di documenti d’archivio inediti, lettere, fatture e cataloghi d’asta, ha rivelato una personalità intrigante e controversa, importante tramite per ricostruire relazioni e provenienze collezionistiche sino a oggi ignote. La dimensione epistemologica dell’opera giovanile, pre-fenomenologica di M. Scheler non è stata ad oggi adeguatamente studiata. Questo breve articolo intende esplorare tale dimensione della prima riflessione filosofica scheleriana da una prospettiva analitica di tipo storiografico. Particolare attenzione sarà quindi riservata alle fonti e ai principali temi di interesse epistemologico affrontati dall’autore. I testi di riferimento sono la tesi di dottorato Beiträge zur festellung der Beziehungen zwischen den logischen und ethischen Prinzipien, lo scritto di abilitazione Versuch über die philosophische Methode, pubblicato (...) con il titolo Die transzendentale und die psycologische Methode e il frammento del primo libro della Logik, opera che Scheler ritira dalle stampe nel 1906. Conclusivamente, si proporrà un percorso di lettura dell’epistemologia che Scheler elabora nel contesto delle due versioni della sua successiva filosofia fenomenologica. (shrink)

Questo articolo ricostruisce la dimensione formale dell’ontologia elaborata da Max Scheler fra il 1908-1909 ed il 1922, nel corso cioè della sua prima fase produttiva d’interesse fenomenologico. Particolare attenzione è riservata alla struttura “architettonica” della prima ontologia formale scheleriana, composta da un trivium di sotto-discipline formali. L’autore elabora in questo modo la distinzione, sostenuta dai maggiori rappresentanti dei primi Circoli tedeschi di fenomenologia realista, fra un’ontologia formale “pura” che indaga la regione formale analitica dell’“oggettività in generale” e ontologie formali generali (...) interessate alle forme o categorie oggettuali dell’essere reale, organizzato in sommi generi materiali. L’articolo mostra inoltre come l’approccio scheleriano all’ontologia formale apra percorsi di recupero e rielaborazione di un’idea tipicamente pre-moderna: l’ontologia è disciplina che tratta anche dell’ordine sovra-predicamentale delle relazioni trascendentali. This paper addresses the treatment of noise caused by word omissions in a corpus of school writings, in order to facilitate their subsequent automatic processing. While a normalization step may facilitate the processing of these texts, certain linguistic expressions remain challenging to comprehend, particularly in instances where the writer omits words from the text. The present contribution proposes three automatic and semi-automatic potential solutions to this problem. The first method employs a "mask" token in the form of xxx. The second (...) is a semi-automatic approach whereby each morpho-syntactic category proposed during normalization is replaced by the corresponding "prototypical word." The third involves a FlauBERT method, using this language model to "reconstruct" the most probable token in the text. The three methods are evaluated quantitatively, and the results obtained using method 3, which proved to be the most effective in the context of our research, are also presented qualitatively. La présente étude se propose d’examiner les liens entre Heidegger et la philosophie médiévale allemande en dehors du binôme bien connu Heidegger – Maître Eckhart. L’opposition que le jeune Heidegger introduit entre le temps continu des sciences de la nature et le temps discontinu propre à l’esprit humain dans son histoire rappelle en effet certains traits fondamentaux de la théorie du temps développée par le dominicain allemand Dietrich de Freiberg. L’hypothèse d’un lien de filiation entre Heidegger et Dietrich est d’une (...) part suggérée par leur refus commun d’une vision « naturaliste » ou « psychologique » du temps, refus qui traduit en effet l’ancrage du temps dans le mode d’être particulier de l’existence humaine. D’autre part, la conception dietrichienne du rapport de fondation circulaire entre l’intellect humain et l’intellect divin apparaît également comme modèle pour la conception, chez le Heidegger moyen et tardif, du « fond-sans-fond » abyssal entre l’événement de l’Être ( Ereignis) et le Dasein. Given its non-invasive nature, there is increasing interest in the use of transcutaneous vagus nerve stimulation across basic, translational and clinical research. Contemporaneously, tVNS can be achieved by stimulating either the auricular branch or the cervical bundle of the vagus nerve, referred to as transcutaneous auricular vagus nerve stimulation and transcutaneous cervical VNS, respectively. In order to advance the field in a systematic manner, studies using these technologies need to adequately report sufficient methodological detail to enable comparison of results between (...) studies, replication of studies, as well as enhancing study participant safety. We systematically reviewed the existing tVNS literature to evaluate current reporting practices. Based on this review, and consensus among participating authors, we propose a set of minimal reporting items to guide future tVNS studies. The suggested items address specific technical aspects of the device and stimulation parameters. We also cover general recommendations including inclusion and exclusion criteria for participants, outcome parameters and the detailed reporting of side effects. Furthermore, we review strategies used to identify the optimal stimulation parameters for a given research setting and summarize ongoing developments in animal research with potential implications for the application of tVNS in humans. Finally, we discuss the potential of tVNS in future research as well as the associated challenges across several disciplines in research and clinical practice. (shrink)

In this paper, I tend to the concept of “immemorial past” and argue that Maurice Merleau-Ponty’s turn in The Visible and the Invisible—a turn toward the conceptualization of time as chiasm and an ontology of the invisible—provides a rich resource for theorizing sexual difference. More precisely, I argue that acknowledging the different kind of temporality of life that the immemorial institutes—a temporality that is generative of meaning and signification—invites us to investigate gender’s “immemorial past.” Shifting attention from the sedimentation and (...) presence of gender habits to the fecund lack that grounds such sedimentation allows us to account for the structure that makes gender production, institution, and differing possible in the first place. Such a structure is a “fecund negativity,” a polymorphous field or depth, that points to the inherent instability and multiplicity of gender, to the fact that gender formation can be traced back to a plural and ambiguous ground that comes to expression in cultural-historical-linguistic manifestations.Dans cet article, je m’appuie sur le concept de « passé immémorial » et montre que le tournant merleau-pontien du Visible et l’Invisible – vers la conceptualisation du temps comme chiasme et d’une ontologie de l’invisible – constitue une riche ressource lorsqu’il s’agit de théoriser la différence sexuelle. Plus précisément, je montre que reconnaître les différents genres de temporalité de vie que l’immémorial institue – une temporalité qui est génératrice de sens et de significations – nous invite à examiner le « temps immémorial » du genre. Passer de la sédimentation et de la présence des habitudes de genre au manque fécond qui fonde une telle sédimentation nous permet de rendre compte de la structure qui rend possible la production, l’institution du genre et de différer le possible à la première place. Une telle structure est une « négativité féconde », un champ ou une profondeur polymorphe, qui souligne l’instabilité inhérente et la multiplicité du genre, le fait que la formation du genre peut être retracée jusqu’à un fond pluriel et ambigu qui s’exprime dans des manifestations culturelles, historiques et linguistiques.Nel presente articolo, intendo elaborare il concetto di “passato immemoriale” e mostrare come la svolta di Merleau-Ponty nel Visibile e l’invisibile – una svolta verso una teorizzazione del tempo come chiasma e verso un’ontologia dell’invisibile – costituisca una risorsa particolarmente ricca per pensare la differenza sessuale. In particolare, vorrei sostenere che comprendere i diversi tipi di temporalità della vita che l’immemoriale istituisce – una temporalità generativa di senso e significato – ci porta a considerare il “passato immemoriale” del gender. Spostare l’attenzione dalla sedimentazione e dalla presenza delle abitudini di genere, alla mancanza feconda che sottende una simile sedimentazione, ci permette di prendere in esame la struttura stessa che rende possibile la produzione, istituzione e differenziazione del genere. Una tale struttura corrisponde ad una “negatività feconda”, un campo polimorfo o profondità che fa segno verso l’instabilità e la molteplicità inerenti al gender, ovvero al fatto che la formazione del genere può essere rintracciata in un orizzonte plurale e ambiguo, che si esprime attraverso manifestazioni culturali-storico-linguistiche. In this paper, I attend to the ontological shift in Merleau-Ponty’s later writing and suggest that this conceptual turn opens the space for questions of the latent sense of the sensible foreclosed by dualist accounts and propositional theories of meaning. By attending to the Nature Lectures, I claim that there is a sens [meaning and orientation] of nature whose regulatory principle ought to be found in nature itself. This is to say that there is a normativity of nature that, albeit (...) not exclusive of sociocultural-linguistic norms, is irreducible to them. As I argue, this normativity is a “transspatializing and transtemporalizing”: it transverses its carnal manifestations, thereby inaugurating and becoming traceable within their materialization while remaining invisible in its excess or poietic renewing. I conclude by attending to the question of the “latent sense” of nature, suggesting that this sense is not conceptual or propositional, but intuitive as in the sense of right and left, a sense that is distributed across spatio-temporal individuals and emerges via the play of yet-to-be-determined incarnate manifestations.Dans cet article, j’aborde le tournant ontologique du dernier Merleau-Ponty et je suggère qu’il implique une interrogation sur le sens latent du sensible, exclu par les approches dualistes ainsi que par les théories propositionnelles de la signification. En analysant les cours sur la Nature, je vise à montrer qu’il y a un sens [signification et direction] de la nature, dont le principe régulateur est à chercher dans la nature elle-même. Cela revient à dire qu’il y a une normativité de la nature qui, bien qu’elle n’exclue pas les normes socio-culturelles-linguistiques, ne leur est pas pour autant réductible. Une telle normativité est « trans-spatiale et trans-temporelle » : elle traverse ses manifestations charnelles, en inaugurant ainsi et en devenant traçable dans ses matérialisations, tout en demeurant invisible dans son excès et dans son renouvellement poïétique. Je termine en abordant la question du « sens latent » de la nature, en suggérant que ce sens n’est ni conceptuel ni propositionnel, mais intuitif, tout comme l’est le sens de la droite et de la gauche, c’est-à-dire un sens qui est distribué à travers les individus spatio-temporels et qui émerge dans le jeu des manifestations incarnées encore-à-déterminer.In questo articolo intendo esaminare la svolta ontologica degli ultimi scritti di Merleau-Ponty per suggerire come questa apra ad un’interrogazione sul senso latente del sensibile, che rimane escluso dagli approcci dualistici e dalle teorie proposizionali del significato. Analizzando i corsi sulla Natura, vorrei mostrare come vi sia un senso [significato e orientamento] della natura il cui principio regolatore deve essere rintracciato nella natura stessa. Ciò significa che vi è una normatività della natura che, benché non esclusiva delle norme socioculturali-linguistiche, è irriducibile ad esse. Questa normatività è “trans-spaziale e trans-temporale”: essa attraversa le sue manifestazioni carnali, inaugurando e divenendo tracciabile nelle sue materializzazioni, pur rimanendo invisibile nella sua eccedenza o rinnovamento poietico. Concludo soffermandomi sulla questione del “senso latente” della natura, suggerendo che questo senso non è concettuale o proposizionale, ma intuitivo al modo del senso della destra e della sinistra, un senso che è distribuito attraverso gli individui spazio-temporali e che emerge nel gioco delle manifestazioni incarnate ancora-da-determinare. Cet article examine le rôle que joue l’approche philosophique de Maître Eckhart dans son exégèse biblique. À travers une analyse de sa théologie trinitaire, de sa théologie de la création, de sa théorie de l’intellect et de sa philosophie du langage, nous montrons qu’Eckhart interprète la Bible à partir de la « grammaire profonde » qui sous-tend la réalité dans son ensemble. Tout en insistant sur l’importance du « livre des créatures », Eckhart souligne néanmoins que le texte biblique reste (...) indispensable pour la théologie dans la mesure où il parle de l’immanence permanente de toutes choses en Dieu, nonobstant leur efflux sous forme de création. En fin de compte, tous les livres dont parle Eckhart – la Trinité, le monde créé et les Écritures – doivent être laissés en arrière pour céder la place au silence, qui seul nous donne accès à l’unité absolue de l’origine. Riassunto: Può la corporalità dirsi ancora una condizione costitutiva dell’esperienza nella presente era digitale? Esistono due fondamentali modi di affrontare la questione, la cui rilevanza è stata di recente sottolineata da ricercatori attivi nei campi dell’ Intelligenza Artificiale Incorporata. Il primo interpreta la questione come incentrata su un’indagine della relazione fra corporalità e digitalizzazione, il processo cioè di digitalizzare dati il quale rende possibile simulare, aumentare e perfino costruire la realtà all’interno di uno spazio di esperienza virtuale, assumendo l’idea tradizionale (...) del computing come un’attività che utilizza dispositivi artificiali, elettronici, per processare, gestire e comunicare informazioni. Il secondo considera la stessa relazione da una diversa prospettiva, facendo cioè riferimento al computing come a un’attività naturale, secondo l’emergente ricerca di computing naturale condotta nel campo del computing non convenzionale. Seguendo quest’ultima prospettiva, che sta acquisendo un crescente consenso all’interno della comunità scientifica, il lavoro indagherà il ruolo costitutivo della corporalità rispetto all’esperienza virtuale associata a una nota ed oramai autonoma area di ricerca del computing naturale, vale a dire il computing morfologico, utilizzando il metodo della fenomenologia genetica. A Phenomenological Perspective: In what sense can corporality still be considered a constitutive condition for experience in the current digital age? Recent scholarship in the fields of Embodied Artificial Intelligence and the philosophy of Embodied Artificial Intelligence has probed the relevance of two approaches to this question. The first queries the relationship between corporality and digitization, i.e., examining how it is possible to simulate, augment, and even construct reality within a space of virtual experience by digitizing data. This approach builds on the traditional idea of computing as an activity that uses artificial, mostly electronic, devices to process, manage, and communicate information. The second approach, increasingly favored by computer scientists, considers computing to be a natural activity, and approaches this same relationship from the perspective of emerging research in unconventional computing, specifically Natural Computing. This paper follows the latter approach, addressing the constitutive role of corporality in virtual experience associated with a well-known and still autonomous research area within Natural Computing, that is, Morphological Computing, from the from the point of view of genetic phenomenology. The paper follows the thesis, that the perception of real or virtual media shares the anthropological state of "Ausdruckswahrnehmung" or perception of expression (Ernst Cassirer). This kind of perception does not represent a distant, neutral point of view, but one that is guided by feelings or "vitality affects" (Daniel N. Stern). The prerequisites, however, for triggering these feelings/"vitality affects" are not recognizable objects or motifs, but rather their sensually evaluable “abstract representations” or their formal logical structures. In contrast to aesthetic (...) feelings, however, they affect not only our feelings of lust or unlust or our knowledge (formal aesthetics) but also our actions (semiotics). So, when I extend aesthetic experiences to semiotic effects, I will talk about vitality semiotics. This new concept is of consequence, because the thesis of the responsibility of the producer is based on these effects. This is to be carried out by analyzing and presenting the approach of the Bauhaus master Josef Albers. (shrink)

Riassunto: Questo lavoro tratta le dimensioni analitiche della hyletica e della genetica nella prima fenomenologia della percezione sensibile di M. Scheler, caratterizzata da una fondazione realistica della materia e della forma del percetto. La hyletica fenomenologica indaga la “materia” o contenuto qualitativo del vissuto nel suo aspetto pre-intenzionale di dato sensoriale informe, privo cioè di forma oggettiva. La genetica fenomenologica indaga la genesi o formazione dei due poli della relazione intenzionale atto-oggetto, a partire dal loro originario momento d’indistinzione allo stadio (...) primitivo della coscienza percettiva. In questo lavoro si sottolinea l’originale elaborazione scheleriana dell’analisi fenomenologica: hyletica e genetica sono parte di un’indagine volta a indagare i diversi aspetti della realtà intesa come fenomeno vissuto caratterizzato dalla resistenza delle cose rispetto a un comportamento animato da finalità adattative. Il percipiente non è per Scheler il soggetto autocosciente, ma l’organismo come agente di informazione/comunicazione in costante interazione con il proprio ambiente circostante. Scheler’s early phenomenology of sense perception, characterized by its realistic foundation for the matter and form of percepts. Phenomenological Hyletics studies the “matter”, i.e., the qualitative content of lived experiences with respect to the pre-intentional aspect of its unformed sensory input, lacking in objectual form. Phenomenological Genetics studies the “genesis” or formation of intentionality’s relata, starting from the early moments of indistinction at the initial phase of perceptual consciousness. This paper highlights the pivotal role and, above all, the original elaboration of these two analytic dimensions by the author: within Scheler’s work, phenomenological Hyletics and Genetics form part of an inquiry that stresses different aspects of reality, understood as a living phenomenon characterized by the resistance of things to adaptive behavior. According to Scheler, therefore, the perceiver is not a self-conscious subject, but rather an organism, i.e., an agent of information-communication that continuously interacts with his surrounding environment. Cet article revient sur la question du rôle de l’esprit dans la pensée de Heidegger pendant les trois grandes étapes de son développement. Au lieu de nous limiter à une approche purement lexicographique du problème, nous entendons montrer qu’il y a chez Heidegger un lien étroit entre le problème de l’esprit et la forme linguistique de la tautologie. Celle-ci est d’abord utilisée dans être et temps pour articuler la structure de la temporalité originaire contre les conceptions idéalistes de l’esprit comme (...) identité. Nous montrerons ensuite que, pendant les années 1930, l’usage explicite par Heidegger du registre du Geist constitue une réponse à l’usage contemporain, aussi répandu que diversifié, de cette notion. Concernant le Heidegger des années 1950, notre travail vise à mettre en lumière la proximité entre son usage massif de la tautologie par rapport à l’essence du langage et l’histoire de la traduction, dans le courant de la tradition mystique et littéraire allemande, d’un verset de l’Évangile de Jean qui parle de l’esprit dans une formule également tautologique.The present article deals with the role of spirit during the three main periods of Heidegger’s philosophy. Beyond a purely lexicographical approach, our analyses intend to show that in Heidegger’s thought the question of spirit is inseparably tied up with the linguistic form of tautology. In Being and time, tautology appears as the linguistic articulation proper to original temporality as opposed to the idealistic conceptions of spirit as identity. In a second step, we will demonstrate that, during the nineteen thirties, Heidegger’s conception of spirit is to be read as an answer to the ambiguous use of this notion in contemporary philosophical and literary discourse. In the third and last section, we will elaborate the analogy between the later Heidegger’s use of tautology with regard to the essence of language and the history of the translation, inside the German mystical and literary tradition, of a verse of the Gospel of Saint John where the nature of spirit is equally expressed in a tautological formula. _Riassunto_: Questo articolo contribuisce alla ricerca in corso sul sé minimale, la configurazione più semplice dell’identità individuale che affonda le sue radici nelle strutture e negli schemi corporei di base. Il tema del sé minimale sarà trattato da una prospettiva fenomenologica, concentrando l’attenzione sulle problematiche relative all’incorporazione tecnologica. Alcuni tipi di tecnologia come le protesi sono vissute dall’individuo come parte del proprio corpo. Esiste una relazione rilevante, da un punto di vista fenomenologico, tra l’incorporazione di una macchina e l’esperienza minimale (...) del sé? La domanda è cruciale per una nuova generazione di macchine incorporabili, nota come tecnologia ibrida bio-macchinale, che beneficia di significativi progressi nella modellazione digitale dei segnali corporei e nella ricerca sui materiali biointegrati. The topic of minimal selfhood will be treated from a phenomenological perspective, focusing on issues of technology incorporation. Some types of technology, such as prosthetics, are experienced by the user as part of her or his own body. Is there a phenomenologically relevant relationship between the incorporation of a machine and minimal self-experience? The question is crucial for a new generation of incorporable machines, known as bio-machine hybrid technology, which benefits from significant advances in digital modeling of bodily signals as well as research on bio-integrated materials. Thanks to the revival in Bergson’s scholarship prompted by Gilles Deleuze’s Bergsonism, it is widely recognized that Bergsonism challenges the metaphysics of presence. Less attention, however, has been devoted to the status of negation or negativity in Bergson’s thought. Differently from Deleuze, I argue that Bergson’s claim that memory and perception, past and present, differ in kind does not call for the erasure of the negative but rather for the radical reconceptualization of negation in temporal terms. Thinking negation temporally allows (...) Bergson to open the space for conceptualizing existence beyond presence, for developing an account of the paradoxical nature of the past. With an insight that anticipates Derrida’s thinking, Bergson tells us that the past is neither “there” nor “not-there,” neither a presence nor an absence. Grâce au regain d’intérêt pour Bergson qu’a suscité le livre de Gilles Deleuze, Le bergsonisme, il est maintenant largement reconnu que le bergsonisme met la métaphysique de la présence à l’épreuve. On a cependant moins porté attention au statut de la négation ou de la négativité dans la pensée de Bergson. Au contraire de Deleuze, je soutiens que l’affirmation de Bergson selon laquelle la mémoire et la perception, le passé et le présent, diffèrent en espèce n’amène pas un effacement du négatif mais plutôt une reconceptualisation radicale de la négation en termes temporels. En pensant la négation temporellement, Bergson peut ouvrir un espace pour conceptualiser l’existence au-delà de la présence et développer une explication de la nature paradoxale du passé. Anticipant la pensée de Derrida, Bergson nous montre que le passé est ni « présent » ni « non-présent », ni une présence ni une absence. (shrink)

The visible condition of a person in bodily pain or of a person who has lost autonomy, social status or self–representation, reveals to some degree an invisible reality which is present in every human being. Assuming the validity of this premise, my primary purpose in the following paper is first to reflect upon social and cultural attitudes that consider disability and vulnerability as a boundary and a threat; and secondly, to propose an alternative in transgressing the differences of socio - (...) anthropological boundaries in order to enable dynamic communication with fellow human beings, and ultimately, to bring about the true human flourishing. The structure of my argument is threefold. In a first part my focus is stressed upon concerns of those living with a physical condition of disability and a mainstream socio–cultural attitudes towards it. In the second part, my attention will be on the meaning of vulnerability associated with, but distinct from the notion of disability. Thirdly, I will elucidate my argument with concrete examples from the L´Arche community - where people with and without disabilities are living together in mutual interdependency and cooperation. Spanning nearly twenty years (1993-2012), the essays in Judith Butler’s Senses of the Subject investigate the processes of subject formation. Via an engagement with canonical philosophical figures like Descartes, Malebranche, Merleau-Ponty, Spinoza, Irigaray, Hegel, Kierkegaard, Sartre, and Fanon, Butler develops the thesis that a radical “susceptibility” or “impressionability” vis-à-vis social and linguistic powers is constitutive of the “I.” This claim, as I suggest in the review, has two implications. First, any attempt to account for this process of initial formation is (...) inherently paradoxical; it seeks to put into words a moment that is temporally and structurally prior to the emergence and development of the “I” and the ability to recount such an emergence. Second, the subject, and also the process of subject’s formation, is structurally and temporally open, incessantly relying upon that which is “external” to the subject for its emergence. This collection, which is exclusively devoted to Butler’s engagement with the philosophical tradition, is an invaluable contribution not only to the understanding of Butler’s philosophy and her relationship with the canon. It also opens the space for an investigation of Butler’s philosophical commitments to query why the body seems to dematerialize from her work, even, it seems, when she makes the materiality of the body an explicit focus of her inquiry.Sur une durée de presque vingt ans (1993-2012), les essais rassemblés dans Senses of the Subject de Judith Butler examinent les processus de la formation des sujets. Questa tesi, come suggerisco nella mia recensione, ha due implicazioni. In primo luogo, qualunque tentativo di rendere conto di questo processo di formazione iniziale è paradossale: si tratterebbe di un tentativo di esprimere attraverso le parole un momento che è temporalmente e strutturalmente precedente all’emergere e svilupparsi dell’“Io” e alla capacità di riportare e riferire questo stesso emergere. In secondo luogo, il soggetto, così come il processo della sua formazione, è strutturalmente e temporalmente aperto, e si affida incessantemente a ciò che è “esterno” al soggetto stesso nel suo emergere. La raccolta in questione, interamente dedicata al confronto di Butler con la tradizione filosofica, non soltanto rappresenta un contributo inestimabile per la comprensione della filosofia dell’autrice e della sua relazione con la tradizione; essa offre anche la possibilità di mettere a fuoco i termini dell’impegno filosofico di Butler, così da chiarire perché il corpo sembri smaterializzarsi dal suo lavoro anche laddove apparentemente l’autrice fa della materialità del corpo un nucleo centrale della propria indagine. Poetry and philosophy have had a long and convoluted relation, characterized often by mutual antipathy and rarely by mutual acknowledgment and respect. Plato was one influential philosopher who trashed poetry’s capacities to trade in the domain of truth and knowledge, but it was J. L. Austin who blew the final whistle by dismissing it as non-serious. And while for many poets that was an invitation to dismiss Austin, for many philosophers that was a confirmation of the overall discomfort they had (...) already felt with respect to poetry. Just how wrong both parties were in this standoff is revealed in the latest book by Maximilian De Gaynesford, The Rift in the Lute: Attuning Poetry and Philosophy, which calls for a dismissal of the separation of the two and for their mutual cooperation. In this paper, we look at De Gaynesford’s proposal, mostly praising its strong points and occasionally raising doubts regarding its success. (shrink)

W pierwszej części zostało nakreślone pojmowanie fenomenu w horyzoncie pytania o Heideggerowskie Sein i Sartre’owskie être. Z kolei część druga umieszcza w tym samym horyzoncie zagadnienia istoty i szeroko ujmowanej zrozumiałości. W toku analiz w projekcie francuskiego filozofa została wyodrębniona sfera fenomenalna i metafizyczna, które następnie są zestawione z poziomem ontycznym i ontologicznym, obszarami, które wyłaniają się w myśli niemieckiego fenomenologa dzięki wypracowaniu (...) różnicy ontologicznej. Wniosek, który płynie z prezentowanego artykułu, zamyka się w konstatacji, że rdzeniem rzeczywistości pozostaje dla Sartre’a absurdalny, lokujący się poza fenomenem i zrozumiałością (oraz całkowicie od nich niezależny) metafizyczny grunt, podczas gdy według Heideggera jądro rzeczywistości stanowi pre-fenomenalne (nie poza-fenomenalne) źródło sensu, „będące” i dziejące się tylko poprzez dynamikę fenomenu i zrozumiałości. In lieu of an abstract, here is a brief excerpt of the content:A Just Share: Justice and Fairness in Resource Allocation*Pat Milmoe Mccarrick (bio) and Martina Darragh (bio)Each of us has some basic sense of what the words “fair” or “just” or “fairness” or “justice” mean. Each of us probably also has an idea of what is “fair” in health care. The attempt by the state of Oregon in the mid-1980s to quantify this notion made a previously private exercise (...) a public one. This transition has been chronicled in the bioethics literature that focuses on resource allocation. These works examine both theories of justice and concepts of “health”; the fair distribution of health resources has been of continuing interest since the beginning of bioethics in the 1960s. Early writing on justice includes authors Tom L. Beauchamp, Robert H. Blank, James F. Childress, H. Tristram Engelhardt, Paul T. Menzel, Paul Ramsey, and Robert M. Veatch (VII).During the 1980s, bioethicists such as Daniel Callahan and Norman Daniels proposed thinking of health care decisions not as moments of personal crisis but as choices that span a lifetime, possibly involving tradeoffs in other areas of one’s life, e.g., education. The Oregon experience added another dimension to the discussion. The initial rank-ordering of health services by cost produced a skewed list—for example, surgery for life-threatening conditions ranked below minor, elective procedures. For the project to make sense, the ranking algorithm could not be based on cost alone, but rather on a combination of costs and benefits both to individuals and to the community—“concatenations of individual and group goods” (I, Jecker and Jonsen 1995). Various metaphors have been used in the literature to facilitate discussion of this shift from individual to individual/community trade-offs: medical services as a “commons” (I, Asch 1995, Jecker and Jonsen 1995, Michels 1994); resource allocation as a “lifeboat” (I, Campbell 1995; III, Kaveny 1994); medical care as “shares” in a community health (III, Nelson 1992, Ford and Kissick 1995; II, Anderson 1993); and rationing as traveling through the desert with one jug of water for two people (a story from the Halachah literature) (I, Zoloth-Dorfman 1995). [End Page 81]Such metaphors do not promote any one “theory of justice” but rather draw from the work of a number of bioethicists as well as from theological, sociological, economic, and business literature. The five major conceptions of justice that are referenced most frequently are: “(1) a libertarian conception, which takes liberty to be the ultimate political ideal; (2) a socialist conception, which takes equality to be the ultimate political ideal; (3) a welfare liberal conception, which takes contractual fairness or maximal utility to be the ultimate political ideal; (4) a communitarian conception, which takes the common good to be the ultimate political ideal; and (5) a feminist conception, which takes a gender-free society to be the ultimate political ideal” (I, Sterba 1995).The use of new metaphors also draws on expanded concepts of “health.” “As health care is currently practiced, the most powerful symbols for public and professional alike are those that promise the defeat of time” (I, Campbell 1995). When medical care is perceived as an unrelated series of individual cures, the fact that health care resources are finite cannot be addressed.Reflections concerning the difficulties in limiting the use of health care resources have an ancient lineage and reveal a tight bond with the obsession to postpone death at all costs. Plato in Book 3 of the Republic recognizes the quandary of infinite expectations and finite resources that characterizes the challenge of health care choices. Some have said that Americans place too much emphasis on individualism to address these issues. Daniels et al. believe that this is too pessimistic a view and that the American commitment to protecting equal opportunity for all provides a firm basis for developing a public consensus on what is fair in health care (III, Daniels, Light, and Caplan 1996). In this article, I propose a conjecture concerning the transmission of Spinoza’s Korte Verhandeling (KV) in the 1670s involving Leibniz. On the basis of a report about Spinoza’s philosophy written down by Leibniz after some conversations with Tschirnhaus in early 1676, I suggest that Tschirnhaus may have had in his possession a manuscript copy of KV and that his account of Spinoza’s doctrine to Leibniz was colored by this text. I support the hypothesis partly by means of external evidence, but (...) mainly through a comparative analysis of Leibniz’s report and the doctrine contained in KV, showing that the report in important respects corresponds better to this text than to Ethics. I finally point to the importance that this hypothesis, if true, would have for our knowledge of Tschirnhaus’ role in the first diffusion of Spinoza’s philosophy outside Holland and for our understanding Leibniz’s reception of Spinoza in the mid-1670s. Disorders of Consciousness (DoCs) raise difficult and complex questions about the value of life for persons with impaired consciousness, the rights of persons unable to make medical decisions, and our social, medical, and ethical obligations to patients whose personhood has frequently been challenged and neglected. Recent neuroscientific discoveries have led to enhanced understanding of the heterogeneity of these disorders, and focused renewed attention on the medical and ethical problem of misdiagnosis. -/- This book examines the entanglement of epistemic and ethical (...) uncertainty in DoCs and other medical contexts, and how they interact to create both epistemic and ethical risks. Philosopher and bioethicist L. Syd M Johnson pulls together multiple threads in this work: the ontological mysteries of consciousness, medical uncertainty about unconsciousness, ableist bias, withdrawal of treatment in neurointensive care, and the rarely questioned view that consciousness is essential to personhood and moral status. Johnson challenges longstanding bioethical dogmas about DoC patients, and argues for an ethics of uncertainty for contexts where there is a need for decisive action in the presence of unavoidable uncertainty. The ethics of uncertainty refocuses ethical inquiry concerning persons with DoCs, placing less emphasis on their contested personhood, and more on inductive risk and uncertainty, on respect for autonomy, and especially on epistemic justice. With applications to various decisional contexts where uncertainty and ethical risk interact, this ethical approach enables surrogate decision makers facing fraught and risky choices to fulfill their obligations as moral and epistemic agents.
