In my paper ‘A Logic for Evidential Support’ (this Journal, 17 (1966), 21 ff.) the argument on page 25 is illustrated by wrong and misleading examples.1 The argument proceeds by considering statements logically equivalent to a universal hypothesis U1 that are formed by generalising analogously not about the individual elements of U1's domain of discourse, but about pairs, trios, or n-membered classes of these elements, where the domain of U1 has at least n elements. But the generalisations must be understood (...) distributively : not collectively, as the examples in the original version suggested. Such an equivalent for ‘All ravens are black’ will not be ‘All pairs of ravens are pairs of black things’, but ‘All pairs are pairs of things each of which is a raven only if black’. Similarly, instead of ‘If the pair a, b is a pair of ravens it is a pair of black things’ on page 26,1 should have written ‘The pair a, b is a pair of things each of which is a raven only if black’. If these alterations are made, the argument is unobjectionable, and the qualification about truth-functional conditionals, on page 25, is no longer required. After discussing the interests that ground the right to democratic political participation, arguments for the disenfranchisement of those who commit serious criminal offenses are examined. The arguments are divided into two groups. The first group consists of arguments that are relatively independent of the justifying aims of punishment. It is conceded that two of these arguments establish that some, though by no means all, serious offenders should lose the vote for a period of time that does not necessarily overlap with (...) the duration of the other sanctions visited upon them. These arguments also imply that the state is justified in attempting to exclude the offenders in question from all forms of political participation, a position that arguably runs afoul of moral limits on punishment. The second group of arguments makes explicit reference to the justifying aims of punishment. None supports the blanket disenfranchisement of felons, though some may justify it in relation to some serious offenders for certain periods of time. All of the arguments supporting the disenfranchisement of serious offenders are most persuasive on the assumption that they live in reasonably just societies that are genuinely democratic. If that assumption is false or questionable, then it is argued that the force of such arguments may be weakened considerably. (shrink)

Theory of Mind is the cognitive achievement that enables us to report our propositional attitudes, to attribute such attitudes to others, and to use such postulated or observed mental states in the prediction and explanation of behavior. Most normally developing children acquire ToM between the ages of 3 and 5 years, but serious delays beyond this chronological and mental age have been observed in children with autism, as well as in those with severe sensory impairments. We examine data from studies (...) of ToM in normally developing children and those with deafness, blindness, autism and Williams syndrome, as well as data from lower primates, in a search for answers to key theoretical questions concerning the origins, nature and representation of knowledge about the mind. In answer to these, we offer a framework according to which ToM is jointly dependent upon language and social experience, and is produced by a conjunction of language acquisition with children's growing social understanding, acquired through conversation and interaction with others. We argue that adequate language and adequate social skills are jointly causally sufficient, and individually causally necessary, for producing ToM. Thus our account supports a social developmental theory of the genesis of human cognition, inspired by the work of Sellars and Vygotsky.How are we to decide whether to take reason to be an essentially private thing that can, however, turn on a public display when it chooses to do so, or, like conversing, to be an essentially social skill, which can, however, be retained a while through periods of solitary confinement? .The squirrel does not infer by induction that it is going to need stores next winter as well .The problem of thought and language thus extends beyond the limits of natural science and becomes the focal problem of historical human psychology, i.e. of social psychology. Consequently, it must be posed in a different way .From the very first days of the child's development his activities acquire a meaning of their own in a system of social behaviour and, being directed towards a definite purpose, are refracted through the prism of the child's environment. The path from object to child and from child to object passes through another person. This complex human structure is the product of a developmental process deeply rooted in the links between individual and social history. (shrink)

Since the role of the Asian countries is increasing in the modern world, their philosophical traditions attract more and more attention. Due to this trend, a more complete panoramic view of the development of world philosophy as a whole is accessible, and it has become possible to understand that any constructions of the human mind that have arisen in a particular cultural field of experience cannot be regarded as exemplary and absolute. The researchers of Asian philosophies concentrate mostly on studying (...) the texts of individual thinkers. As a rule, they do not set themselves the task of examining these texts from the point of view of intercultural interactions and transformations of significant ideas and concepts in various cultural and historical contexts, defining the direction and mechanisms of cultural borrowing, as well as revealing new approaches and growth points. To achieve these goals, the research should focus at the problem of the self-determination and development of philosophy as a separate science in non-Western cultures, which are based on intellectual traditions with different origin than Greek and Judeo-Christian traditions. This article deals with the consideration of some topics that elucidate the features of the development of philosophical science in Japan, including the emergence of the concept of “philosophy” in this country, the definition of its subject, the formation of philosophical terminology, and various interpretations of what the term “Japanese philosophy” means. The author pays special attention to the characteristic of the main periods of progress of Japanese philosophical thought. In the conclusion, the author argues that the most important characteristic feature of the Japanese philosophy is its involvement in intercultural dialogue throughout its history. (shrink)

On September 18, 1995, the U.S. Court of Appeals for the Seventh Circuit handed down a decision in Blue Cross & Blue Shield United of Wisconsin v. Marshfield Clinic ) that sets two important precedents regarding the status of health maintenance organizations under antitrust law. Chief Judge Posner, writing for the court, concluded that HMOs do not constitute a market separate from the general market for medical services and that agreements, between HMOs in a region, to operate in separate areas (...) constitute a prohibited form of market splitting.This case primarily involves two HMOs in north central Wisconsin: one a subsidiary of Blue Cross, the other a subsidiary of the Marshfield Clinic. The Blue Cross HMO claimed that the Marshfield HMO had an illegal monopoly in the region's HMO market and therefore violated the Sherman Act ). (shrink)

Blumbergi identifies three kinds of moral criticism: (i) of an individual for violating a moral practice in his society, (2) of a moral practice but not the individual who participates in it, and (3) of both an individual and the practice in accordance with which he acts ('practice-personal' criticism) (p. 348). According to Mr. Blumberg, successful derivation of a conclusive 'ought'-statement from statements about socially-created obligations would show how moral criticisms of type 1 are justified. Moral criticisms of type (...) 2 would still be allowed, but not those of type 3. -/- I discuss the following points made by Blumberg: (A) Criticism of type 1 is 'the most common kind of moral judgment' (p. 356); (B) Searle dispensed 'with the conclusive aspect of the conclusion, and with it the finality of the derivation, when it began to seem unrealizable' (p. 356); (C) 'It is impossible to derive conclusive "ought"-statements embodying our traditional moral outlook from statements about socially-created obligations, . . .' (p. 355); (D) 'Either we surrender the attempt to derive a conclusive "ought" -statement from statements about socially-created obligations, or else we must surrender our right to make practice-personal criticisms' (p. 357). -/- I argue that conclusiveness in judgments, both moral and non-moral, is always relative to the range of reasons weighed, the implications of action considered. Therefore 'ought' must always be taken to be context-bound just as moral principles are taken to be defeasible, elliptical. This interpretation of 'ought' and 'conclusive' as bound to a context, point of view or framework, is quite consistent with Searle's distinction between what is internal and external to an institution. I argue that the criticisms made by d. h. mellor in 'mind', january, 1968, of two arguments central to charles taylor's thesis concerning teleological explanation in 'the explanation of behaviour' can readily be accommodated by taylor. in neither case is the argument used to make the distinction that mellor alleges.

The controversy which has raged between those who accept Aristotelian Logic and those who reject it, seems to continue. It is, I believe, advisable to consider the arguments on both sides. Modern Logicians for the most part insist that Aristotelian Logic breaks down, i.e. it is not true for all meanings of the terms. On the other hand there are those who insist on the validity of Aristotelian Logic claiming that those values for which it fails are not permissible values. (...) But there is one who stands almost entirely alone in his position—namely Professor H. B. Smith—who maintains that Aristotelian Logic breaks down because and only because its interpretation into Boolean terms has been accomplished by means of a definition that is not forced upon us and which, since it gives up desirable principles, is to be rejected. In this chapter, we offer an account of fear and risk in anticipation of catastrophe. We draw on the narrative response to the Mount Enta volcano in medieval Sicily to frame an evaluation of how fear can be seen to impact the understanding of risk when the event of that risk is the catastrophic suffering of an entire community. We aim to demonstrate how an exploration of the philosophical questions surrounding the emotion of fear and the understanding of risk can (...) contribute to broader, interdisciplinary dialogue on the experience of the disastrous and deadly.
