The aim of this article is to assess the impact of Big Data technologies for insurance ratemaking, with a special focus on motor products.The first part shows how statistics and insurance mechanisms adopted the same aggregate viewpoint. It made visible regularities that were invisible at the individual level, further supporting the classificatory approach of insurance and the assumption that all members of a class are identical risks. The second part focuses on the reversal of perspective currently occurring in data analysis (...) with predictive analytics, and how this conceptually contradicts the collective basis of insurance. The tremendous volume of data and the personalization promise through accurate individual prediction indeed deeply shakes the homogeneity hypothesis behind pooling. The third part attempts to assess the extent of this shift in motor insurance. Onboard devices that collect continuous driving behavioural data could import this new paradigm into these products. An examination of the current state of research on models with telematics data shows however that the epistemological leap, for now, has not happened. (shrink)

Philosophers have often claimed that general ideas or representations have their origin in abstraction, but it remains unclear exactly what abstraction as a psychological process consists in. We argue that the Lockean aspiration of using abstraction to explain the origins of all general representations cannot work and that at least some general representations have to be innate. We then offer an explicit framework for understanding abstraction, one that treats abstraction as a computational process that operates over an innate quality space (...) of fine-grained general representations. We argue that this framework has important philosophical implications for the nativism-empiricism dispute, for questions about the acquisition of unstructured representations, and for questions about the relation between human and animal minds. For Kant right and ethics are two formally distinct departments of a single morality of reason and freedom. Unlike ethics, right involves an authorization to coerce, and this coercion serves as a pathological incentive. I argue that for Kant the distinctive character of right flows from the fact that juridical obligation has a different relational structure than ethical obligation. I argue that this relational structure explains the connection of right to coercion, and also explains how a categorical imperative can be (...) known a priori to issue in both a pathological and non-pathological incentive. Thus the justification of coercion and its special role as incentive are rooted in the relational character of juridical obligations, and so ultimately in categorical imperatives of reason. Since this pathological incentive has a moral basis in the structure of juridical obligations, and so ultimately in a representation of moral laws, I argue that Kant’s discussion of the juridical incentive of coercion is more continuous with his main discussion of moral incentives in the Critique of Practical Reason than it might at first appear. I illustrate the consequences of this reading by discussing the propensity to injustice, as Kant understands it, and the unique way in which the juridical incentive undermines it. (shrink)

Throughout his early writings, Leibniz was concerned with developing an acceptable account of God's relationship to the created world. In some of these early writings, he endorsed the idea that this relationship was similar to the human soul's relationship to the body. Though he eventually came to reject this idea, theanima mundi thesis remained the topic of several essays and correspondences during his career, culminating in the correspondence with Clarke. At first glance,Leibniz's discussions of this thesis may seem less important (...) in comparison to others, since it might seem like a topic which is far removed from what are regarded as his most important philosophical doctrines. I hope to show in what follows that such a view is mistaken. The large amount of attention Leibniz paid to this thesis is a sure indication of its importance to him. Further, as we shall see, his discussions of this thesis tum on some of his most interesting metaphysical topics, including the development of his thinking about the actual infinite, the structure of organic wholes, and the relationship between God and the created universe. In what follows, I examine these discussions chronologically, from the De Summa Rerum (1675-6), to the correspondence with Clarke (1715-6). (shrink)

Brevity in conversation is a window to the workings of the mind. It is both a multifaceted topic of deep philosophical importance and a phenomenon that serves as a testing ground for theories in linguistics, psycholinguistics and computer modeling. Speakers use elliptical constructions and exploit salient features of the conversational environment, a process of pragmatic enrichment, so as to pack a great deal into a few words. The ‘gene of’ is a teleosemantic expression that conveys a simplistic and linear relationship between a gene and a phenotype. Throughout the 20th century, geneticists studied these genes of traits. The studies were often polemical when they concerned human traits: the ‘crime gene’, ‘poverty gene’, ‘IQ gene’, ‘gay gene’ or ‘gene of alcoholism’. Quite recently, a controversy occurred in 2006 in New Zealand that started with the claim that a ‘warrior gene’ exists in the Mãori community. This claim came from (...) a geneticist working on the MAOA gene. This article is interested in the responsibility of that researcher regarding the origin of the controversy. Several errors were made: overestimation of results, abusive use of the ‘gene of’ kind of expression, poor communication with the media and a lack of scientific culture. The issues of the debate were not taken into account sufficiently, either from the political, social, ethical or even the genetic points of view. After more than 100 years of debates around ‘genes of’ all kinds (here, the ‘warrior gene’), geneticists may not hide themselves behind the media when a controversy occurs. Connaissons-nous l'enfant? Au sortir du " siècle de l'enfant ", la différence de l'enfance ne cesse de nous interroger. Si l'exigence de penser l'enfance à nouveau est aujourd'hui partagée, les voies de cette entreprise, et plus précisément les problématiques au sein desquelles elle s'impose, sont diverses et mouvantes, à l'image du monde dont héritent ceux que Hannah Arendt appelait " les nouveaux-venus ". Emergent toutefois du foisonnement des pensées de l'enfance quelques paradigmes que l'ouvrage se propose de rendre visibles. Le (...) paradigme démocratique inscrit la question de l'enfance dans la dynamique égalitaire des sociétés démocratiques, et dans l'inéluctable effacement de la différence enfant/adulte auquel les conduit leur " passion de l'égalité ". Le développement de la " philosophie pour enfants " relève-t-il de cette passion de l'égalité? La figure de " l'enfant philosophe " participe-t-elle de cet effacement? Assurément son émergence au cours des vingt dernières années constitue l'un des faits marquants d'une histoire commune à l'enfance et à la philosophie. Que dire alors de la figure de l'enfant artiste, de l'enfance saisie dans sa proximité avec l'artiste? Elle participe d'une tentative de penser l'enfance autrement, d'une pensée esthétique de l'enfance alliant l'héritage schillérien des Lettres sur l'éducation esthétique de l'humanité aux tentations d'une pensée poétique de l'enfance. Que devient alors, dans cette pensée de l'enfance bousculée, cette autre figure qui ne cesse d'accompagner l'enfance, du moins depuis qu'on la pense comme éducable, la figure du pédagogue? Voilà peut-être l'un des points de résistance aux bouleversements postmodernes : l'impossibilité d'une connaissance de l'enfance qui n'en passe pas par l'éducation de l'enfance. Le point de vue paradigmatique n'épuise toutefois pas la question. Par-delà les paradigmes qui tentent de la saisir, quelque chose de l'enfance ne cesse de se dérober. (shrink)

Several approaches to clinical ethics consultation (CEC) exist in medical practice and are widely discussed in the clinical ethics literature; different models of CECs are classified according to their methods, goals, and consultant’s attitude. Although the “facilitation” model has been endorsed by the American Society for Bioethics and Humanities (ASBH) and is described in an influential manual, alternative approaches, such as advocacy, moral expertise, mediation, and engagement are practiced and defended in the clinical ethics field. Our Clinical Ethics Center in (...) Paris was founded in 2002 in the wake of the Patients’ Rights Act, and to date it is the largest center that provides consultation services in France. In this article we shall describe and defend our own approach to clinical ethics consultation, which we call the “Commitment Model,” in comparison with other existing models. Indeed commitment implies, among other meanings, continuity through time, a series of coherent actions, and the realization of important social goals. By drawing on a recent consultation case, we shall describe the main steps of our consultation procedure: interviews with major stakeholders, including patients and proxies; case conferences; and follow up. We shall show why we have chosen the term “commitment” to represent our approach at three different but interrelated levels: commitment towards patients, within the case conference group, and towards society as a whole. Johnathan Cohen's book provides a lucid and penetrating treatment of the fundamental issues of contemporary analytical philosophy. This field now spans a greater variety of topics and divergence of opinion than fifty years ago, and Cohen's book addresses the presuppositions implicit to it and the patterns of reasoning on which it relies.

The clinical ethics literature is striking for the absence of an important genre of scholarship that is common to the literature of clinical medicine: systematic reviews. As a consequence, the field of clinical ethics lacks the internal, corrective effect of review articles that are designed to reduce potential bias. This article inaugurates a new section of the annual "Clinical Ethics" issue of the Journal of Medicine and Philosophy on systematic reviews. Using recently articulated standards for argument-based normative ethics, we provide (...) a systematic review of the literature on concealed medication for the management of psychiatric disorders. Four steps are completed: identify a focused question; conduct a literature search using key terms relevant to the focused question; assess the adequacy of the argument-based methods of the papers identified; and identify conclusions drawn in each paper and whether they apply to the focused question. We identified seven papers and provide an assessment of them. While none of the papers fully meet the standards of argument-based ethics, they did provide rationales for the use of concealed medications, with the important requirement such a practice be accountable in explicit organizational policy to prevent abuse of patients with mental illness or dementia. Incivility among physicians, between physicians and learners, and between physicians and nurses or other healthcare professionals has become commonplace. If allowed to continue unchecked by academic leaders and medical educators, incivility can cause personal psychological injury and seriously damage organisational culture. As such, incivility is a potent threat to professionalism. This paper uniquely draws on the history of professional ethics in medicine to provide a historically based, philosophical account of the professional virtue of civility. We use a two-step method of (...) ethical reasoning, namely ethical analysis informed by pertinent prior work, followed by identifying the implications of clearly articulated ethical concepts, to meet these goals. The professional virtue of civility and the related concept of professional etiquette was first described by the English physician-ethicist Thomas Percival (1740–1804). Based on a historically informed philosophical account, we propose that the professional virtue of civility has cognitive, affective, behavioural and social components based on a commitment to excellence in scientific and clinical reasoning. Its practice prevents a dysfunctional organisational culture of incivility and sustains a civility-based organisational culture of professionalism. Medical educators and academic leaders are in a pivotal and powerful position to role model, promote and inculcate the professional virtue of civility as essential to an organisational culture of professionalism. Academic leaders should hold medical educators accountable for discharge of this indispensable professional responsibility. (shrink)

Two new philosophical problems surrounding the gradation of certainty began to emerge in the 17th century and are still very much alive today. One is concerned with the evaluation of inductive reasoning, whether in science, jurisprudence, or elsewhere; the other with the interpretation of the mathematical calculus of change. This book, aimed at non-specialists, investigates both problems and the extent to which they are connected. Cohen demonstrates the diversity of logical structures that are available for judgements of probability, and explores (...) the rationale for their appropriateness in different contexts of application. Thus his study deals with the complexity of the underlying philosophical issues without simply cataloging alternative conceptions or espousing a particular "favorite" theory. (shrink)

In non-ideal theory, the political philosopher seeks to identify an injustice, synthesize social scientific work to diagnose its underlying causes, and propose morally permissible and potentially efficacious remedies. This paper explores the role in non-ideal theory of the identification of a plausible agent of change who might bring about the proposed remedies. I argue that the question of the agent of change is connected with the other core tasks of diagnosing injustice and proposing practical remedies. In this connection, I criticize (...) two linked postures that nonideal theorists sometimes adopt: a technocratic mode of neutral policy recommendation, whereby philosophers say what “we” must do to address some problem, without attending to the way agency enters the problem and its possible resolution; and the tendency to treat non-ideal theory as primarily consisting int eh enumeration of duties we are failing to fulfill, and specification of who is under what additional duties in light of this shortfall. My argument is that these tendencies fail to register in a coherent way the practical character of political philosophy. (shrink)

The Russell class does not exist because the conditions purporting to specify that class are contradictory, and hence fail to specify any class. Equally, the conditions purporting to specify the Liar statement are contradictory and hence, although the Liar sentence is grammatically in order, it fails to yield a statement. Thus the common source of these and related paradoxes is contradictory (or tautologous) specifying conditions-for such conditions fail to specify. This is the diagnosis. Rosamond Rhodes makes a persuasive case for the view that medical ethics does not derive from common morality.1 Rhodes identifies the challenge that immediately arises and its corollary: Whence the origin of medical ethics? And, should we understand medical ethics as autonomous? From the perspective of professional ethics in medicine, the first question can now be restated: Whence the origin of the ethical concept of medicine as a profession, the basis of the ethical obligations of physicians in patient care, research, (...) medical education, and in advocacy and healthcare policy? The history of Western philosophy offers us two pathways to address this question. The first is the quest for certainty,2 a quest fulfilled by using methods designed to discover concepts that are independent of human thought and judgement and thus intellectually and morally authoritative for everyone. Such concepts are timeless and therefore transcultural, transreligious and transnational. Examples include Plato’s Forms,3 PF Stawson’s (1919–2006) ‘our conceptual structure’,4 Edmund Pellegrino’s (1920–2003) ‘fact of illness’ and the ‘act of profession’ in response to the vulnerability that illness creates,5 and common morality.6 Thought experiments, using what Rhodes characterises as ‘the hypethetico-deductive method’,1 aim to discover timeless concepts.
